  1.                 Sample Program License Agreement

  4. BEFORE USING THESE DEVICE DRIVERS, (HEREINAFTER REFERRED TO AS THE
  5. PROGRAM), YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS.
  6. USING THE PROGRAM INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

  8.      The PROGRAM is licensed not sold. IBM grants you a license for the
  9. PROGRAM only in the country where you acquired the PROGRAM.  You obtain no
  10. rights other than those granted you under this license.  The term "PROGRAM"
  11. means the original and all whole or partial copies of it, including
  12. modified copies or portions merged into other programs.  IBM retains the
  13. title to the PROGRAM  IBM owns or has licensed from the owner, copyrights in
  14. the PROGRAM.  You are responsible for the selection of the PROGRAM and for 
  15. the installation of, use of, and results obtained from, the PROGRAM.

  17. 1. License
  18.  
  19.      Under this license, you may:
  20.                                    
  21.      1) use the PROGRAM only if you are a licensee of OS/2;
  22.      2) use the PROGRAM on only one machine at any one time;
  23.      3) copy the PROGRAM for backup or in order to modify it;
  24.      4) modify the PROGRAM and/or merge it into another program 
  25.         as an essential utilization of the PROGRAM in conjunction 
  26.         with your machine, and;
  27.      5) transfer the possession of the PROGRAM to another party.

  29. If you transfer the PROGRAM, you must transfer a copy of this license, all 
  30. other documentation and at least one complete, unaltered copy of the 
  31. PROGRAM to the other party.  You must, at the same time, either transfer 
  32. all you other copies of the PROGRAM to the other party or destroy them.  
  33. Your license is then terminated.  The other party agrees to these terms and
  34. conditions by its first use of the PROGRAM.

  36. You must reproduce the copyright notice(s) on each copy, or partial copy, 
  37. of the PROGRAM.
  38.  
  39.      Under this license, you may not:
  40.                             
  41.      1) use the PROGRAM unless you are a licensee of OS/2;
  42.      2) use, copy, modify, merge, or transfer copies of the PROGRAM
  43.         except as provided in this license;
  44.      3) reverse assemble or reverse compile the PROGRAM; or
  45.      4) sublicense, rent, lease, or assign the PROGRAM.

  47. 2. Warranty

  49. THIS PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY (OR CONDITION) OF ANY 
  50. KIND. IBM DISCLAIMS ALL WARRANTIES (AND CONDITIONS) FOR THE PROGRAM,
  51. EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED 
  52. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  54. Some jurisdictions do not allow exclusions of implied warranties, so the 
  55. above exclusions may not apply to you.

  58. 3. Limitation of Remedies
  59.  
  60. IN NO EVENT WILL IBM BE LIABLE FOR ANY LOST PROFITS, LOST SAVINGS, 
  61. INCIDENTAL OR INDIRECT DAMAGES OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES, 
  62. EVEN IF IBM OR ITS AUTHORIZED SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY 
  63. OF SUCH DAMAGES.  IN ADDITION, IBM WILL NOT BE LIABLE FOR ANY DAMAGES 
  64. CLAIMED BY YOU BASED ON ANY THIRD-PARTY CLAIM.

  66. The above limitations of remedies also applies to any developer or supplier
  67. of the PROGRAM.  Such developer and/or supplier is an intended beneficiary 
  68. of this Section.
  69.  
  70. Some jurisdictions do not allow these limitations or exclusions, so they 
  71. may not apply to you.

  73.  
  74. 4. General
  75.  
  76. You may terminate your license at any time.  IBM may terminate your license
  77. if you fail to comply with the terms and conditions of this license.  In 
  78. either event, you must destroy all your copies of the PROGRAM.
  79.  
  80. You are responsible for payment of any taxes, including personal property 
  81. taxes, resulting from this license.  
  82.  
  83. Neither party may bring an action, regardless of form, more than two years 
  84. after the cause of the action arose.
  85.  
  86. If you acquire the PROGRAM in the United States, this license is governed 
  87. by the laws of the State of New York.  If you acquired the PROGRAM in 
  88. Canada, this license is governed by the laws of the Province of Ontario.  
  89. Otherwise, this license is governed by the laws of the country in which you 
  90. acquired the PROGRAM.
