  6.    JAVATM 2 RUNTIME ENVIRONMENT (J2RE), STANDARD EDITION, VERSION 1.4.2_X
  7.  
  8. SUN MICROSYSTEMS, INC. ("SUN") IS WILLING TO LICENSE THE SOFTWARE IDENTIFIED
  9. BELOW TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS
  10. CONTAINED IN THIS BINARY CODE LICENSE AGREEMENT AND SUPPLEMENTAL LICENSE
  11. TERMS (COLLECTIVELY "AGREEMENT").  PLEASE READ THE AGREEMENT CAREFULLY.  BY
  12. DOWNLOADING OR INSTALLING THIS SOFTWARE, YOU ACCEPT THE TERMS OF THE
  13. AGREEMENT. INDICATE ACCEPTANCE BY SELECTING THE "ACCEPT" BUTTON AT THE
  14. BOTTOM OF THE AGREEMENT. IF YOU ARE NOT WILLING TO BE BOUND BY ALL THE
  15. TERMS, SELECT THE "DECLINE" BUTTON AT THE BOTTOM OF THE AGREEMENT AND THE
  16. DOWNLOAD OR INSTALL PROCESS WILL NOT CONTINUE.

  18.   1. DEFINITIONS. "Software" means the identified above in binary form, any
  19.      other machine readable materials (including, but not limited to,
  20.      libraries, source files, header files, and data files), any updates or
  21.      error corrections provided by Sun, and any user manuals, programming
  22.      guides and other documentation provided to you by Sun under this
  23.      Agreement. "Programs" mean Java applets and applications
  24.      intended to run on the Java 2 Platform, Standard Edition (J2SETM
  25.      platform) platform on Java-enabled general purpose desktop computers
  26.      and servers.
  27.  
  28.   2. LICENSE TO USE. Subject to the terms and conditions of this Agreement,
  29.      including, but not limited to the Java Technology Restrictions of the
  30.      Supplemental License Terms, Sun grants you a non-exclusive,
  31.      non-transferable, limited license without license fees to reproduce and
  32.      use internally Software complete and unmodified for the sole purpose of
  33.      running Programs. Additional licenses for developers and/or publishers
  34.      are granted in the Supplemental License Terms.
  35.  
  36.   3. RESTRICTIONS. Software is confidential and copyrighted. Title to
  37.      Software and all associated intellectual property rights is retained by
  38.      Sun and/or its licensors. Unless enforcement is prohibited by
  39.      applicable law, you may not modify, decompile, or reverse engineer
  40.      Software.  You acknowledge that Licensed Software is not designed or
  41.      intended for use in the design, construction, operation or maintenance
  42.      of any nuclear facility. Sun Microsystems, Inc. disclaims any express
  43.      or implied warranty of fitness for such uses. No right, title or
  44.      interest in or to any trademark, service mark, logo or trade name of
  45.      Sun or its licensors is granted under this Agreement. Additional
  46.      restrictions for developers and/or publishers licenses are set forth in
  47.      the Supplemental License Terms.
  48.  
  49.   4. LIMITED WARRANTY.  Sun warrants to you that for a period of ninety (90)
  50.      days from the date of purchase, as evidenced by a copy of the receipt,
  51.      the media on which Software is furnished (if any) will be free of
  52.      defects in materials and workmanship under normal use.  Except for the
  53.      foregoing, Software is provided "AS IS".  Your exclusive remedy and
  54.      Sun's entire liability under this limited warranty will be at Sun's
  55.      option to replace Software media or refund the fee paid for Software.
  56.      Any implied warranties on the Software are limited to 90 days. Some
  57.      states do not allow limitations on duration of an implied warranty, so
  58.      the above may not apply to you. This limited warranty gives you
  59.      specific legal rights. You may have others, which vary from state to
  60.      state.
  61.  
  62.   5. DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS AGREEMENT, ALL
  63.      EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES,
  64.      INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A
  65.      PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  66.      EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

  68.   6. LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED BY LAW, IN NO
  69.      EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT
  70.      OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR
  71.      PUNITIVE DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF LIABILITY,
  72.      ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE,
  73.      EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  In no
  74.      event will Sun's liability to you, whether in contract, tort (including
  75.      negligence), or otherwise, exceed the amount paid by you for Software
  76.      under this Agreement.  The foregoing limitations will apply even if the
  77.      above stated warranty fails of its essential purpose. Some states do
  78.      not allow the exclusion of incidental or consequential damages, so some
  79.      of the terms above may not be applicable to you.

  81.   7. SOFTWARE UPDATES FROM SUN. You acknowledge that at your request or
  82.      consent optional features of the Software may download, install, and
  83.      execute applets, applications, software extensions, and updated
  84.      versions of the Software from Sun ("Software Updates"), which may
  85.      require you to accept updated terms and conditions for installation. If
  86.      additional terms and conditions are not presented on installation, the
  87.      Software Updates will be considered part of the Software and subject to
  88.      the terms and conditions of the Agreement.
  89.  
  90.   8. SOFTWARE FROM SOURCES OTHER THAN SUN. You acknowledge that, by your use
  91.      of optional features of the Software and/or by requesting services that
  92.      require use of the optional features of the Software, the Software may
  93.      automatically download, install, and execute software applications from
  94.      sources other than Sun ("Other Software"). Sun makes no representations
  95.      of a relationship of any kind to licensors of Other Software. TO THE
  96.      EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE
  97.      LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  98.      CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED
  99.      REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE
  100.      USE OF OR INABILITY TO USE OTHER SOFTWARE, EVEN IF SUN HAS BEEN ADVISED
  101.      OF THE POSSIBILITY OF SUCH DAMAGES. Some states do not allow the
  102.      exclusion of incidental or consequential damages, so some of the terms
  103.      above may not be applicable to you.

  105.   9. TERMINATION.  This Agreement is effective until terminated.  You may
  106.      terminate this Agreement at any time by destroying all copies of
  107.      Software.  This Agreement will terminate immediately without notice
  108.      from Sun if you fail to comply with any provision of this Agreement.
  109.      Either party may terminate this Agreement immediately should any
  110.      Software become, or in either party's opinion be likely to become, the
  111.      subject of a claim of infringement of any intellectual property right.
  112.      Upon Termination, you must destroy all copies of Software.
  113.  
  114.  10. EXPORT REGULATIONS. All Software and technical data delivered under
  115.      this Agreement are subject to US export control laws and may be subject
  116.      to export or import regulations in other countries.  You agree to
  117.      comply strictly with all such laws and regulations and acknowledge that
  118.      you have the responsibility to obtain such licenses to export,
  119.      re-export, or import as may be required after delivery to you.

  121.  11. TRADEMARKS AND LOGOS. You acknowledge and agree as between you and Sun
  122.      that Sun owns the SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET
  123.      trademarks and all SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET-related
  124.      trademarks, service marks, logos and other brand designations ("Sun
  125.      Marks"), and you agree to comply with the Sun Trademark and Logo Usage
  126.      Requirements currently located at
  127.      http://www.sun.com/policies/trademarks. Any use you make of the Sun
  128.      Marks inures to Sun's benefit.
  129.  
  130.  12. U.S. GOVERNMENT RESTRICTED RIGHTS.  If Software is being acquired by or
  131.      on behalf of the U.S. Government or by a U.S. Government prime
  132.      contractor or subcontractor (at any tier), then the Government's rights
  133.      in Software and accompanying documentation will be only as set forth in
  134.      this Agreement; this is in accordance with 48 CFR 227.7201 through
  135.      227.7202-4 (for Department of Defense (DOD) acquisitions) and with 48
  136.      CFR 2.101 and 12.212 (for non-DOD acquisitions).

  138.  13. GOVERNING LAW.  Any action related to this Agreement will be governed
  139.      by California law and controlling U.S. federal law.  No choice of law
  140.      rules of any jurisdiction will apply.
  141.  
  142.  14. SEVERABILITY. If any provision of this Agreement is held to be
  143.      unenforceable, this Agreement will remain in effect with the provision
  144.      omitted, unless omission would frustrate the intent of the parties, in
  145.      which case this Agreement will immediately terminate.
  146.  
  147.  15. INTEGRATION.  This Agreement is the entire agreement between you and
  148.      Sun relating to its subject matter.  It supersedes all prior or
  149.      contemporaneous oral or written communications, proposals,
  150.      representations and warranties and prevails over any conflicting or
  151.      additional terms of any quote, order, acknowledgment, or other
  152.      communication between the parties relating to its subject matter during
  153.      the term of this Agreement.  No modification of this Agreement will be
  154.      binding, unless in writing and signed by an authorized representative
  155.      of each party.

  157.                          SUPPLEMENTAL LICENSE TERMS
  158.  
  159. These Supplemental License Terms add to or modify the terms of the Binary
  160. Code License Agreement. Capitalized terms not defined in these Supplemental
  161. Terms shall have the same meanings ascribed to them in the Binary Code
  162. License Agreement . These Supplemental Terms shall supersede any
  163. inconsistent or conflicting terms in the Binary Code License Agreement, or
  164. in any license contained within the Software.

  166.   A. Software Internal Use and Development License Grant. Subject to the
  167.      terms and conditions of this Agreement, including, but not limited to
  168.      the Java Technology Restrictions of these Supplemental Terms, Sun
  169.      grants you a non-exclusive, non-transferable, limited license without
  170.      fees to reproduce internally and use internally the Software complete
  171.      and unmodified for the purpose of designing, developing, and testing
  172.      your Programs.

  174.   B. License to Distribute Software. Subject to the terms and conditions of
  175.      this Agreement, including, but not limited to the Java Technology
  176.      Restrictions of these Supplemental Terms, Sun grants you a
  177.      non-exclusive, non-transferable, limited license without fees to
  178.      reproduce and distribute the Software, provided that (i) you distribute
  179.      the Software complete and unmodified (unless otherwise specified in the
  180.      applicable README file) and only bundled as part of, and for the sole
  181.      purpose of running, your Programs, (ii) the Programs add significant
  182.      and primary functionality to the Software, (iii) you do not distribute
  183.      additional software intended to replace any component(s) of the
  184.      Software (unless otherwise specified in the applicable README file),
  185.      (iv) you do not remove or alter any proprietary legends or notices
  186.      contained in the Software, (v) you only distribute the Software subject
  187.      to a license agreement that protects Sun's interests consistent with
  188.      the terms contained in this Agreement, and (vi) you agree to defend and
  189.      indemnify Sun and its licensors from and against any damages, costs,
  190.      liabilities, settlement amounts and/or expenses (including attorneys'
  191.      fees) incurred in connection with any claim, lawsuit or action by any
  192.      third party that arises or results from the use or distribution of any
  193.      and all Programs and/or Software.
  194.  
  195.   C. License to Distribute Redistributables. Subject to the terms and
  196.      conditions of this Agreement, including but not limited to the Java
  197.      Technology Restrictions of these Supplemental Terms, Sun grants you a
  198.      non-exclusive, non-transferable, limited license without fees to
  199.      reproduce and distribute those files specifically identified as
  200.      redistributable in the Software "README" file ("Redistributables")
  201.      provided that: (i) you distribute the Redistributables complete and
  202.      unmodified (unless otherwise specified in the applicable README file),
  203.      and only bundled as part of Programs, (ii) you do not distribute
  204.      additional software intended to supersede any component(s) of the
  205.      Redistributables (unless otherwise specified in the applicable README
  206.      file), (iii) you do not remove or alter any proprietary legends or
  207.      notices contained in or on the Redistributables, (iv) you only
  208.      distribute the Redistributables pursuant to a license agreement that
  209.      protects Sun's interests consistent with the terms contained in the
  210.      Agreement, (v) you agree to defend and indemnify Sun and its licensors
  211.      from and against any damages, costs, liabilities, settlement amounts
  212.      and/or expenses (including attorneys' fees) incurred in connection with
  213.      any claim, lawsuit or action by any third party that arises or results
  214.      from the use or distribution of any and all Programs and/or Software.
  215.  
  216.   D. Java Technology Restrictions. You may not modify the Java Platform
  217.      Interface ("JPI", identified as classes contained within the "java"
  218.      package or any subpackages of the "java" package), by creating
  219.      additional classes within the JPI or otherwise causing the addition to
  220.      or modification of the classes in the JPI.  In the event that you
  221.      create an additional class and associated API(s) which (i) extends the
  222.      functionality of the Java platform, and (ii) is exposed to third party
  223.      software developers for the purpose of developing additional software
  224.      which invokes such additional API, you must promptly publish broadly an
  225.      accurate specification for such API for free use by all developers.
  226.      You may not create, or authorize your licensees to create, additional
  227.      classes, interfaces, or subpackages that are in any way identified as
  228.      "java", "javax", "sun" or similar convention as specified by Sun in any
  229.      naming convention designation.
  230.  
  231.   E. Source Code. Software may contain source code that, unless expressly
  232.      licensed for other purposes, is provided solely for reference purposes
  233.      pursuant to the terms of this Agreement. Source code may not be
  234.      redistributed unless expressly provided for in this Agreement.
  235.  
  236.   F. Third Party Code. Additional copyright notices and license terms
  237.      applicable to portions of the Software are set forth in the
  238.      THIRDPARTYLICENSEREADME.txt file. In addition to any terms and
  239.      conditions of any third party opensource/freeware license identified in
  240.      the THIRDPARTYLICENSEREADME.txt file, the disclaimer of warranty and
  241.      limitation of liability provisions in paragraphs 5 and 6 of the Binary
  242.      Code License Agreement shall apply to all Software in this
  243.      distribution.
