  3. End User License Agreement for RaidenFTPD

  5. IMPORTANT-READ CAREFULLY:
  6.  
  7. This End-User License Agreement ("EULA") is a legal agreement between
  8. you (either an individual or a single entity) and RaidenFTPD Team for the
  9. RaidenFTPD software accompanying this EULA, which includes computer
  10. software and may include associated media, printed materials, and
  11. "online" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE").
  12. By exercising your rights to make and use copies of the SOFTWARE PRODUCT,
  13. you agree to be bound by the terms of this EULA.
  14. If you do not agree to the terms of this EULA, you may not use the
  15. SOFTWARE PRODUCT.
  16.  
  17. Software PRODUCT LICENSE
  18.  
  19. The SOFTWARE PRODUCT is protected by copyright laws and international
  20. copyright treaties, as well as other intellectual property laws and
  21. treaties.  The SOFTWARE PRODUCT is licensed, not sold.

  23.  
  24. 1.  GRANT OF LICENSE.  This EULA grants you the following rights:
  25.     Installation and Use -
  26.       You may install and use a copy of the SOFTWARE PRODUCT.
  27.     Reproduction and Distribution -
  28.       You may reproduce and distribute copies of the SOFTWARE PRODUCT;
  29.       provided that:
  30.       1) each copy shall be a true and complete copy, including all
  31.          copyright and trademark notices;
  32.       2) each copy shall be accompanied by a copy of this EULA; and
  33.       3) such distribution shall not be for commercial purposes.

  36. 2.  DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  37.     Limitations on Reverse Engineering, Decompilation, and Disassembly -
  38.     You may not reverse engineer, decompile, or disassemble the SOFTWARE
  39.     PRODUCT, except and only to the extent that such activity is expressly
  40.     permitted by applicable law notwithstanding this limitation.
  41.  
  42.     Separation of Components -
  43.     The SOFTWARE PRODUCT is licensed as a single product.  Its component
  44.     parts may not be separated for use on more than one computer.
  45.  
  46.     Software Transfer -
  47.     You may permanently transfer all of your rights under this EULA,
  48.     provided the recipient agrees to the terms of this EULA.
  49.  
  50.     Termination -
  51.     Without prejudice to any other rights, RaidenFTPD Team may terminate this
  52.     EULA if you fail to comply with the terms and conditions of this EULA.
  53.     In such event, you must destroy all  copies of the SOFTWARE PRODUCT
  54.     and all of its component parts.
  55.  
  56.     Trial version limitation -
  57.     Free trial version of RaidenFTPD will request user to visit our web sites upon
  58.     startup and after one hour of execution , If you do not agree , you may remove
  59.     this RaidenFTPD software now , only if you agree with this limitation , you are
  60.     are licensed to use the free trial version of RaidenFTPD.
  61.     
  62.     Resposibilities -
  63.     RaidenFTPD Team explicitly disclaims that we will not have knowledge about any 
  64.     content which will be hosted on the clients' ftp server , if you violate the 
  65.     United States or the local copyright laws , you agree to take full legal 
  66.     responsibilities by yourself.

  68. 3.  COPYRIGHT.
  69.  
  70.     All title and copyrights in and to the SOFTWARE PRODUCT (including,
  71.     but not limited to, any images, photographs, animations, video, audio,
  72.     music, text, and "applets" incorporated into the SOFTWARE PRODUCT),
  73.     the accompanying printed materials, and any copies of the SOFTWARE
  74.     PRODUCT are owned by RaidenFTPD Team or its suppliers.

  76.     The SOFTWARE PRODUCT is protected by copyright laws and international
  77.     treaty provisions.  Therefore, you must treat the SOFTWARE PRODUCT
  78.     like any other copyrighted material.

  81. 4.  LIMITED WARRANTY.  NO WARRANTIES.
  82.  
  83.     RaidenFTPD Team expressly disclaims any warranty for the SOFTWARE PRODUCT.

  85.     The SOFTWARE PRODUCT and any related documentation is provided
  86.     "as is" without warranty of any kind, either express or implied,
  87.     including, without limitation, the implied warranties or
  88.     merchantability, fitness for a particular purpose, or noninfringement.
  89.  
  90.     The entire risk arising out of use or performance of the SOFTWARE
  91.     PRODUCT remains with you.

  93.  
  94. 5.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
  95.  
  96.     In no event shall RaidenFTPD Team or its suppliers be liable for any
  97.     damages whatsoever (including, without limitation, damages for loss
  98.     of business profits, business interruption, loss of any business
  99.     information, or any other pecuniary loss) arising out of the use of
  100.     or inability to use this RaidenFTPD product, even if RaidenFTPD Team has
  101.     been advised of the possibility of such damages.
  102.     Because some states/jurisdictions do not allow the exclusion or
  103.     limitation of liability for consequential or incidental damages,
  104.     the above limitation may not apply to you.

  106. 6.  REGISTERED VERSION
  107.  
  108.     A single registered copy of RaidenFTPD may either be used by a single person 
  109.     who uses the software himself on one computer of his own , or installed 
  110.     on a single computer and used by multiple people, but not both.
  111.     
  112.     A personal/student license key may only be used for non-commercial purpose ,
  113.     if the registered copy of RaidenFTPD is being used for your organization or 
  114.     company a commercial license is required.
  115.     
  116.     You agree not to distribute your registration key to anyone else , we reserve
  117.     the right the disable your registration key if we found that your registration
  118.     key is publicly distributed.
  119.  
  120. 7.  MISCELLANEOUS.
  121.  
  122.     If this product was acquired outside the United States, then local
  123.     laws may apply.
