  3. END-USER LICENSE AGREEMENT FOR MICROSOFT SOFTWARE
  4. IMPORTANT-READ CAREFULLY: This Microsoft End-User License Agreement ("EULA") is a legal
  5. agreement between you (either an individual or a single entity) and Microsoft Corporation
  6. for the Microsoft Microsoft Excel Viewer identified above, which includes computer software
  7. and may include associated media, printed materials, and "online" or electronic documentation
  8. ("Microsoft Excel Viewer" ). By installing, copying, or otherwise using the Microsoft Excel
  9. Viewer, you agree to be bound by the terms of this EULA. If you do not agree to the terms of
  10. this EULA, do not install or use the MICROSOFT EXCEL VIEWER.

  12. MICROSOFT EXCEL VIEWER LICENSE
  13.  
  14. The MICROSOFT EXCEL VIEWER is protected by copyright laws and international copyright treaties,
  15. as well as other intellectual property laws and treaties. The MICROSOFT EXCEL VIEWER is licensed,
  16. not sold.
  17.  
  18. 1.GRANT OF LICENSE. This EULA grants you the following rights:
  19.  
  20. Installation and Use. You may install and use an unlimited number of copies of the
  21. MICROSOFT EXCEL VIEWER.
  22.  
  23. Reproduction and Distribution. You may reproduce and distribute an unlimited number of copies
  24. of the MICROSOFT EXCEL VIEWER;  provided that each copy shall be a true and complete copy, 
  25. including all copyright and trademark notices, and shall be accompanied by a copy of this EULA.
  26. Copies of the MICROSOFT EXCEL VIEWER may be distributed as a standalone product or included with
  27. your own product.

  29. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  31. Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer,
  32. decompile, or disassemble the MICROSOFT EXCEL VIEWER, except and only to the extent that such
  33. activity is expressly permitted by applicable law notwithstanding this limitation.
  34.  
  35. Separation of Components. The MICROSOFT EXCEL VIEWER is licensed as a single product. Its
  36. component parts may not be separated for use on more than one computer.
  37.  
  38. Support Services. Microsoft may provide you with support services related to the MICROSOFT
  39. EXCEL VIEWER ("Support Services"). Use of Support Services is governed by the Microsoft
  40. policies and programs described in the user manual, in "online" documentation, and/or in
  41. other Microsoft-provided materials. Any supplemental software code provided to you as part
  42. of the Support Services shall be considered part of the MICROSOFT EXCEL VIEWER and subject
  43. to the terms and conditions of this EULA. With respect to technical information you provide
  44. to Microsoft as part of the Support Services, Microsoft may use such information for its
  45. business purposes, including for product support and development. Microsoft will not utilize
  46. such technical information in a form that personally identifies you.

  48. Software Transfer. You may permanently transfer all of your rights under this EULA, provided
  49. the recipient agrees to the terms of this EULA.
  50.  
  51. Termination. Without prejudice to any other rights, Microsoft may terminate this EULA if you
  52. fail to comply with the terms and conditions of this EULA. In such event, you must destroy
  53. all copies of the MICROSOFT EXCEL VIEWER and all of its component parts.

  55. 3. COPYRIGHT. All title and copyrights in and to the MICROSOFT EXCEL VIEWER
  56. (including but not limited to any images, photographs, animations, video, audio, music,
  57. text, and "applets" incorporated into the MICROSOFT EXCEL VIEWER), the accompanying printed
  58. materials, and any copies of the MICROSOFT EXCEL VIEWER are owned by Microsoft or its
  59. suppliers. The MICROSOFT EXCEL VIEWER is protected by copyright laws and international
  60. treaty provisions. Therefore, you must treat the MICROSOFT EXCEL VIEWER like any other
  61. copyrighted material except that you may install the MICROSOFT EXCEL VIEWER on a single
  62. computer provided you keep the original solely for backup or archival purposes.

  64. 4. U.S. GOVERNMENT RESTRICTED RIGHTS. The MICROSOFT EXCEL VIEWER and documentation are
  65. provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject
  66. to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  67. Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the 
  68. Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable.

  71. MISCELLANEOUS
  72. If you acquired this product in the United States, this EULA is governed by the laws of
  73. the State of Washington. 
  74. If you acquired this product in Canada, this EULA is governed by the laws of the Province
  75. of Ontario, Canada. Each of the parties hereto irrevocably attorns to the jurisdiction of 
  76. the courts of the Province of Ontario and further agrees to commence any litigation which
  77. may arise hereunder in the courts located in the Judicial District of York, Province of 
  78. Ontario. 
  79. If this product was acquired outside the United States, then local law may apply.

  84. LIMITED WARRANTY

  86. NO WARRANTIES. Microsoft expressly disclaims any warranty for the MICROSOFT EXCEL VIEWER.
  87. The MICROSOFT EXCEL VIEWER and any related documentation is provided "as is" without warranty
  88. of any kind, either express or implied, including, without limitation, the implied warranties
  89. or merchantability, fitness for a particular purpose, or noninfringement. The entire risk 
  90. arising out of use or performance of the MICROSOFT EXCEL VIEWER remains with you.
  91.  
  92. NO LIABILITY FOR DAMAGES. In no event shall Microsoft or its suppliers be liable for any
  93. damages whatsoever (including, without limitation, damages for loss of business profits,
  94. business interruption, loss of business information, or any other pecuniary loss) arising
  95. out of the use of or inability to use this Microsoft product, even if Microsoft has been 
  96. advised of the possibility of such damages. Because some states/jurisdictions do not allow
  97. the exclusion or limitation of liability for consequential or incidental damages, the above
  98. limitation may not apply to you.
