  1.                     License Agreement and Limited Warranty

  4. 1. Introduction.  This agreement explains when and how you may use 
  5.    Unregistered and Registered Copies of Oxygen Phone Manager for 
  6.    Nokia 71**/62**.
  7.  
  8.    In this agreement:
  9.  
  10.    *  "Oxygen Phone Manager" means the Oxygen Phone Manager for
  11.       Nokia 71**/62** program you have purchased or obtained for 
  12.       evaluation.
  13.  
  14.    *  "Unregistered Copy" means a copy of Oxygen Phone Manager
  15.       distributed by us for evaluation.  
  16.  
  17.    *  "Registered Copy" means a copy of the Oxygen Phone Manager
  18.       purchased from us.
  19.  
  20.    *  "we" or "us" means Oxygen Software.
  21.  
  22.    *  "you" means the end user of Oxygen Phone Manager.
  23.  
  24.    *  "Commercial Application" any application that will be distributed
  25.       to others for any kind of compensation or fee.  This includes
  26.       shareware and other try before you buy as well as commercial
  27.       distribution methods.

  30. 2. Legal Agreement.  This is a legal agreement which allows you, the end
  31.    user, to use Oxygen Phone Manager under certain terms and
  32.    conditions.  If you cannot agree to abide by the terms of this
  33.    agreement you should not use Oxygen Phone Manager.
  34.    Oxygen Software reserves the right to change this license
  35.    agreement for the future versions of Oxygen Phone Manager.

  37. 3. Use of Oxygen Phone Manager. You may use the Unregistered Copy of 
  38.    Oxygen Phone Manager on as many computers as you like for a 30 
  39.    day period. After that period, you must either register Oxygen 
  40.    Phone Manager or remove it from all the computers you had 
  41.    installed it on.

  43.    You assume full responsibility for the selection and use of
  44.    Oxygen Phone Manager to achieve your intended results.

  46. 4. Copying Registered Copies of Oxygen Phone Manager. When you receive 
  47.    a Registered Copy of Oxygen Phone Manager you may make copies of 
  48.    Oxygen Phone Manager which are necessary for normal backup purposes.  
  49.    You agree not to make any other copies of the software, or any part of 
  50.    them, or sell or give any copies to others, without our advance written 
  51.    permission.

  53. 5. Licensing for Oxygen Phone Manager is as follows:

  75. 6. LIMITED WARRANTY:  The following limited warranty applies to Unregistered
  76.    and Registered Copies of Oxygen Phone Manager.

  78.    Bugs and Program Errors.  We do not promise that Oxygen Phone 
  79.    Manager will be free of bugs or program errors. If you report a program 
  80.    error or bug to us, we will use our best efforts to correct it. If we 
  81.    issue a maintenance release for Oxygen Phone Manager which includes 
  82.    a correction for an error you reported, we will send you a copy of that 
  83.    maintenance release at no charge. We will only do this for maintenance 
  84.    releases, not for new major releases or other new versions of Oxygen 
  85.    Phone Manager.

  87.    Hardware damages.  We are not responsible for any possible damages which 
  88.    may occur with your mobile phone or PC during use or misuse of our 
  89.    software. We are also not responsible for any problems caused by original
  90.    or hand-made connection cables.

  92. 7. Disclaimer.

  94.    Except for the limited warranty stated above, we disclaim any and all 
  95.    other warranties, express or implied, oral or written, including any 
  96.    implied warranties of merchantability or fitness for a particular 
  97.    purpose. Oxygen Software reserves the right to change this license
  98.    agreement for the future versions of Oxygen Phone Manager.
