  1. Software User's License
  2.  
  3. The present document is the User's license for the attached software
  4. (hereinafter known as the SOFTWARE).
  5.  
  6. License Agreement
  7.  
  8. You should carefully read the following terms and conditions
  9. before using this software.  Unless you have a different license
  10. agreement signed by Mokry Software. your use of this software 
  11. indicates your acceptance of this license agreement and warranty.
  12.  
  13. Registered Version
  14.  
  15. One registered copy of the SOFTWARE may either be used by a single
  16. person who uses the software personally on one or more computers,
  17. or installed on a single workstation used nonsimultaneously by
  18. multiple people, but not both.
  19.  
  20. You may access the registered version of the SOFTWARE through a network,
  21. provided that you have obtained individual licenses for the
  22. software covering all workstations that will access the software
  23. through the network.  For instance, if 8 different workstations
  24. will access the SOFTWARE on the network, each workstation must have its
  25. own the SOFTWARE license, regardless of whether they use the SOFTWARE at
  26. different times or concurrently.

  28. Governing Law

  30. This agreement shall be governed by Czech law. Any dispute arising therefrom 
  31. shall be the exclusive competence of the courts of the headquarters 
  32. of ORNIC Technologies, Inc.
  33.  
  34. Disclaimer of Warranty
  35.  
  36. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  37. WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY
  38. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  In particular,
  39. there is no warranty for the optional virus scanning feature
  40. (the SOFTWARE does not scan for viruses, it simply runs external
  41. programs that claim to perform this function).  Because of the
  42. various hardware and software environments into which the SOFTWARE may
  43. be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS
  44. OFFERED.
  45.  
  46. Good data processing procedure dictates that any program be
  47. thoroughly tested with non-critical data before relying on it.
  48. The user must assume the entire risk of using the program.  ANY
  49. LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT
  50. REPLACEMENT OR REFUND OF PURCHASE PRICE.

  52. Evaluation Version

  54. Evaluation and Registration
  55.  
  56. This is not free software.  Subject to the terms below, you are
  57. hereby licensed to use this software for evaluation purposes
  58. without charge for a period of 30 days.  If you use this software
  59. after the 30 day evaluation period a registration fee is
  60. required. Credit card ordering and quantity discounts are available. 
  61. When payment is received you will be sent
  62. a registered copy of the latest version of the SOFTWARE.
  63.  
  64. Unregistered use of the SOFTWARE after the 30-day evaluation period is 
  65. in violation of Czech and international copyright laws.
  66.  
  67. Distribution
  68.  
  69. Provided that you verify that you are distributing the evaluation
  70. version (select About the SOFTWARE from the Help menu to check) you are
  71. hereby licensed to make as many copies of the evaluation version of
  72. this software and documentation as you wish; give exact copies of
  73. the original evaluation version to anyone; and distribute the
  74. evaluation version of the software and documentation in its
  75. unmodified form via electronic means.  There is no charge for any
  76. of the above.

  78. You are specifically prohibited from charging, or requesting
  79. donations, for any such copies, however made; and from
  80. distributing the software and/or documentation with other products
  81. (commercial or otherwise) without prior written permission.
