  21. What's WebPainter for Windows?
  22. ------------------------------
  23. WebPainter for Windows is an easy to use tool for creating
  24. eye-catching animated graphics for Web pages. WebPainter
  25. provides standard painting tools as well as a large number 
  26. of animation specific features which make it a breeze to
  27. add animation to your Web site.
  28.  
  29. In addition to powerful tools, WebPainter also support a
  30. wide selection of import and export file formats including
  31. GIF87, GIF89, Windows BMP, AVI movies, and Sizzler Animations.
  32.  
  33. WebPainter for Windows is currently available for Windows 95
  34. and Windows NT 3.51 or greater. WebPainter is also available
  35. for the Macintosh. For further information on this or any

  59. Run the Setup program and it will perform the necessary tasks for 
  60. installing WebPainter for Windows.

  108. Run the Uninstall WebPainter for Windows application located inside 
  109. the WebPainter program group.

  132. IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR AN 
  133. ENTITY) AND TOTALLY HIP SOFTWARE INC. BY USING THE SOFTWARE YOU 
  134. ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU 
  135. DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, DO NOT USE THE 
  136. SOFTWARE.

  138. 1.  Totally Hip Software Inc. ("Totally Hip") grants to you 
  139. royalty-free a personal, non-transferable, non-exclusive, 
  140. non-sublicensable right to use this version of WebPainter 
  141. (the "Software"), in binary executable form for evaluation and 
  142. trial use purposes only.

  144. 2.  Any and all content accessed through or used with the Software 
  145. is the property of the applicable content owner and may be 
  146. protected by applicable copyright law. This license gives you no 
  147. rights to such content.

  149. 3.  While Totally Hip intends to distribute a commercial version of 
  150. the Software, Totally Hip reserves the right at any time not to 
  151. release a commercial version of the Software or, if released, to 
  152. alter prices, features, specifications, capabilities, functions, 
  153. licensing terms, release dates or general availability of the 
  154. commercial version.

  156. 4.  Title and intellectual rights in and to the Software are 
  157. owned by Totally Hip or its suppliers and are protected by United 
  158. States copyright laws and international treaty provisions. You 
  159. acknowledge that the Software in source code form is a confidential 
  160. trade secret of Totally Hip or its suppliers and you agree not to 
  161. modify the Software or attempt to decompile, disassemble or reverse 
  162. engineer the Software.

  164. 5.  Totally Hip may terminate this license at any time by 
  165. delivering notice to you and you may terminate this license at any 
  166. time by destroying or erasing your copy of the Software. Upon 
  167. termination of this license, or in any event within thirty (30) 
  168. days following the release of a commercial version of the Software 
  169. by Totally Hip, you agree to destroy or erase the Software. In the 
  170. event of termination, sections 2, 3, 4, 5, 6, 7 and 8 of this 
  171. license will survive.

  173. 6.  This license sets forth the entire agreement between you and 
  174. Totally Hip. This license is personal to you and you agree not to 
  175. assign your rights herein.

  180. AND WARRANTIES THAT THE USE OF THE SOFTWARE OR ANY INFORMATION

  182. OR TRADEMARK OF ANY THIRD PERSON. THIS SOFTWARE IS PROVIDED FREE AND

  186. IN NO EVENT SHALL TOTALLY HIP,  ITS EMPLOYEES,  OR ITS SUPPLIERS BE 
  187. LIABLE FOR ANY DAMAGES WHATSOEVER ( INCLUDING WITHOUT LIMITATION, 
  188. DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS 
  189. OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) SUFFERED BY YOU 
  190. OR ANY OTHER USER OF THE SOFTWARE ARISING OUT OF THE USE OF OR THE 
  191. INABILITY TO USE THE SOFTWARE, EVEN IF TOTALLY HIP HAS BEEN ADVISED 
  192. OF SUCH DAMAGES. BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW THE
  193. EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL 
  194. DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  196. 8.  The Software is provided with Restricted Rights. Use, 
  197. duplication, or disclosure by the Government is subject to 
  198. restrictions as set forth in subparagraphs (a) through (d) of the 
  199. Commercial Computer Restricted Rights clause at CFR 52.227-19, or 
  200. in subparagraph ( c ) (1) (ii) of the Rights in Technical Data and 
  201. Computer Software clause of DFARS 252.227-7013, as applicable.

  227. In order to register WebPainter you can do one of the following:

  229. 1) Go to www.totallyhip.com/support/registration and fill in the appropriate info.
  230. 2) Fill in the appropriate info on the registration card which came along with the 
  231.    WebPainter package and mail it in.
  232. 3) Email us at webpainter@totallyhip.com with the appropriate info
