  1.                INTEL END USER SOFTWARE LICENSE AGREEMENT

  3. BY UNZIPPING THIS FILE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF 
  4. THIS AGREEMENT.  DO NOT UNZIP THIS FILE UNTIL YOU HAVE CAREFULLY READ 
  5. AND AGREED TO THE FOLLOWING TERMS AND CONDITIONS.  IF YOU DO NOT AGREE 
  6. TO THE TERMS OF THIS AGREEMENT, PROMPTLY DELETE THIS FILE.

  9.                 BE BOUND BY THE TERMS OF THIS AGREEMENT

  11. License: Intel grants you the right to use the enclosed program (the 
  12. "Software").  You will not use, copy, modify, rent, sell, or transfer 
  13. the Software or any portion thereof except as provided for in this 
  14. Agreement. 
  15.  
  16. You may:  
  17. 1 Use the Software on a single computer;  
  18. 2 Copy the Software solely for backup or archival purposes. 
  19.  
  20. RESTRICTIONS: 
  21.  
  22. You WILL NOT: 
  23. 1  Use the Software or cause the Software to be used on more than one 
  24.    computer at the same time, including using the Software across a 
  25.    network system; 
  26. 2  Sublicense the Software; 
  27. 3  Reverse engineer, decompile, or disassemble the Software; 
  28. 4  Copy the software except as provided in this Agreement;' 
  29. 5  Permit simultaneous use of the Software by more than one user. 
  30.  
  31. TRANSFER: You may transfer the Software to another party if the 
  32. receiving party agrees to the terms of this Agreement and you retain no 
  33. copies of the Software and accompanying documentation. 
  34.  
  35. Transfer of the license terminates your right to use the Software. 
  36.  
  37. OWNERSHIP AND COPYRIGHT OF SOFTWARE: Title to the Software and all 
  38. copies thereof remain with Intel or its vendors.  The Software is 
  39. copyrighted and is protected by United States copyright laws and 
  40. international treaty provisions.  You will not remove the copyright 
  41. notice from the Software.  You agree to prevent any unauthorized 
  42. copying of the Software. 
  43.  
  44. WARRANTY: Intel warrants that it has the right to license you to use 
  45. the software. 
  46.  
  47. Intel warrants that the media on which the Software is furnished will 
  48. be free from defects in material and workmanship under normal use for a 
  49. period of ninety (90) days from the date of purchase.  Intel's entire 
  50. liability and your exclusive remedy shall be the replacement of the 
  51. Software if the media on which the Software is furnished proves to be 
  52. defective.  This warranty is void if the media defect has resulted from 
  53. accident, abuse, or misapplication.  Any replacement of media will be 
  54. warranted for the remainder of the original warranty period or thirty 
  55. (30) days, whichever is longer. 
  56.  
  57. DISCLAIMER: Except as provided above, the Software is provided "AS IS" 
  58. without warranty of any kind. 
  59.  
  60. LIMITATION OF LIABILITY: THE ABOVE WARRANTIES ARE THE ONLY WARRANTIES 
  61. OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF 
  62. MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.  NEITHER INTEL 
  63. NOR ITS VENDORS SHALL BE LIABLE FOR ANY LOSS OF PROFITS, LOSS OF USE, 
  64. INTERRUPTION OF BUSINESS, NOR FOR INDIRECT, SPECIAL, INCIDENTAL, OR 
  65. CONSEQUENTIAL DAMAGES OF ANY KIND WHETHER UNDER THIS AGREEMENT OR 
  66. OTHERWISE.

  68. AUDIT: Intel reserves the right to conduct or have conducted audits to 
  69. verify your compliance with this Agreement. 
  70.  
  71. TERMINATION OF THIS LICENSE: Intel may terminate this license at any 
  72. time if you are in breach of any of its terms or conditions.  Upon 
  73. termination, you will immediately destroy the Software or return all 
  74. copies of the Software to Intel along with any copies you have made. 
  75.  
  76. U.S.  GOVERNMENT RESTRICTED RIGHTS: The Software and documentation are 
  77. provided with "RESTRICTED RIGHTS." Use, duplication, or disclosure by 
  78. the Government is subject to restrictions as set forth in FAR54-227-14 
  79. and DFAR252-227-7013 et seq or its successor.  Use of this Software by 
  80. the Government constitutes acknowledgment of Intel's proprietary rights 
  81. in the Software. 
  82.  
  83. EXPORT LAWS: You agree that neither the Software nor the direct product 
  84. thereof is intended to be shipped either directly or indirectly to 
  85. country groups Q, S, W, Y, Z, Afghanistan or the People's Republic of 
  86. China, unless a validated export license is obtained from the U.S. 
  87. Department of Commerce. 
  88.  
  89. APPLICABLE LAWS: This Agreement is governed by the laws of the state of 
  90. California and the United States, including patent and copyright laws. 
  91. Any claim arising out of this Agreement will be brought in Santa Clara, 
  92. California.
