  5. IMPORTANT-READ CAREFULLY:  This SpiralCom 
  6. End-User License Agreement ("EULA") is a 
  7. legal agreement between you (either an 
  8. individual or a single entity) and SpiralCom 
  9. Communications Inc. for using the registered 
  10. version of WinTAR (the "SHAREWARE PRODUCT" 
  11. or "SHAREWARE"). By installing, copying, or 
  12. otherwise using the SHAREWARE, you agree to 
  13. be bound by the terms of this EULA.

  15. SHAREWARE PRODUCT LICENSE
  16.  
  17. The SHAREWARE PRODUCT is protected by 
  18. copyright laws and international copyright treaties, 
  19. as well as other intellectual property laws and 
  20. treaties. The SHAREWARE PRODUCT is licensed, 
  21. not sold. This agreement shall be governed by the 
  22. laws of the Province of British Columbia, Canada.

  24. You are hereby licensed to:
  25. 1) use the SHAREWARE for a 21 day evaluation 
  26. period;
  27. 2) make as many copies of the SHAREWARE and 
  28. documentation as you wish;
  29. 3) give exact copies of the original SHAREWARE 
  30. to anyone;
  31. 4) distribute the SHAREWARE and documentation 
  32. in its unmodified form via electronic means.

  34. There is no charge for any of the above.
  35.  
  36. You are specifically prohibited from charging, or 
  37. requesting donations, for any such copies, however 
  38. made; and from distributing the SHAREWARE and/or 
  39. documentation with other products (commercial or 
  40. otherwise) without prior written permission.

  42. Using the SHAREWARE after the 21-day 
  43. evaluation period is in violation of federal 
  44. copyright laws.

  46. DISCLAIMER OF WARRANTY

  48. THIS SOFTWARE AND THE ACCOMPANYING 
  49. FILES ARE SOLD "AS IS" AND WITHOUT 
  50. WARRANTIES AS TO PERFORMANCE OF 
  51. MERCHANTABILITY OR ANY OTHER 
  52. WARRANTIES WHETHER EXPRESSED OR 
  53. IMPLIED.  Because of the variety of hardware 
  54. and software environments into which the 
  55. SHAREWARE may be put, NO WARRANTY OF 
  56. FITNESS FOR A PARTICULAR PURPOSE IS 
  57. OFFERED.

  59. Good data processing procedure dictates that 
  60. any program be thoroughly tested with non-critical 
  61. data before relying on it. The user must assume 
  62. the entire risk of using the program.  ANY 
  63. LIABILITY OF THE SELLER WILL BE LIMITED 
  64. EXCLUSIVELY TO PRODUCT REPLACEMENT OR 
  65. REFUND OF PURCHASE PRICE.  NEITHER THE 
  66. AUTHOR NOR SPIRALCOM COMMUNICATIONS 
  67. INC. SHALL BE HELD LIABLE FOR ANY KIND 
  68. OF DAMAGES OR CLAIMS THAT DIRECTLY OR 
  69. INDIRECTLY RESULT FROM USING THIS 
  70. SHAREWARE.
