  6. NETSCAPE NAVIGATOR END USER LICENSE AGREEMENT NO FEE VERSION (EXPORT
  7. VERSION ONLY)

  9. GRANT. Netscape Communications Corporation ("Netscape") hereby grants
  10. you a non-exclusive license to use its accompanying software product
  11. ("Software") free of charge if (a) you are a student, faculty member or
  12. staff member of an educational institution (K-12, junior college or
  13. college) or an employee of a charitable non-profit organization; or (b)
  14. your use of the Software is for the purpose of  evaluating whether to
  15. purchase an ongoing license to the Software.  The evaluation period for
  16. use by or on behalf of a commercial entity is limited to 90 days;
  17. evaluation use by others is not subject to this restriction.
  18. Government agencies are not considered charitable non-profit
  19. organizations for purposes of this license agreement.  If you do not
  20. fit within the description above, a license fee is due to Netscape and
  21. no license is granted. If you are using the Software free of charge,
  22. you will not be entitled to support or telephone assistance.  If you
  23. purchased a license to version 1.0 of the Software, you may also
  24. download the export version of 1.1 as a free update.

  26. If you fit within the above description, you may: use the Software on
  27. any single computer; use the Software on a second computer so long as
  28. the first and second computers are not used simultaneously; or copy the
  29. Software for archival purposes, provided any copy must contain all of
  30. the original Software's proprietary notices.

  32. You may not: permit other individuals to use the Software except under
  33. the terms listed above; modify, translate, reverse engineer, decompile,
  34. disassemble (except to the extent applicable laws specifically prohibit
  35. such restriction), or create derivative works based on the Software;
  36. copy the Software (except for back-up purposes); rent, lease, transfer
  37. or otherwise transfer rights to the Software; or remove any
  38. proprietary  notices or labels on the Software.

  40. SOFTWARE. If you receive your first copy of the Software
  41. electronically, and a second copy on media, the second copy may be used
  42. for archival purposes only.  This license does not grant you any right
  43. to any enhancement or update.
  44.  
  45. TITLE. Title, ownership rights, and intellectual property rights in and
  46. to the Software shall remain in Netscape and/or its suppliers. The
  47. Software is protected by the copyright laws of the United States and
  48. international copyright treaties.  Title, ownership rights, and
  49. intellectual property rights in and to the content accessed through the
  50. Software is the property of the applicable content owner and may be
  51. protected by applicable copyright or other law. This License gives you
  52. no rights to such content.

  54. DISCLAIMER OF WARRANTY. Since the Software is provided free of charge,
  55. the Software is provided on an "AS IS" basis, without warranty of any
  56. kind, including without limitation the warranties of merchantability,
  57. fitness for a particular purpose and non-infringement. The entire risk
  58. as to the quality and performance of the Software is borne by you.
  59. Should the Software prove defective, you and not Netscape assume the
  60. entire cost of any service and repair. In addition, the security
  61. mechanism implemented by the Software has inherent limitations, and you
  62. must determine that the Software sufficiently meets your requirements.
  63. This disclaimer of warranty constitutes an essential part of the
  64. agreement. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY,
  65. SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL
  66. RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

  68. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL
  69. THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL NETSCAPE OR ITS SUPPLIERS
  70. OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT,
  71. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
  72. INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK
  73. STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  74. COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL NETSCAPE BE LIABLE FOR
  75. ANY DAMAGES IN EXCESS OF NETSCAPE'S LIST PRICE FOR A LICENSE TO THE
  76. SOFTWARE, EVEN IF NETSCAPE SHALL HAVE BEEN INFORMED OF THE POSSIBILITY
  77. OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION
  78. OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY
  79. TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE,
  80. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
  81. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY

  84. TERMINATION.  This license will terminate automatically if you fail to
  85. comply with the limitations described above.  On termination, you must
  86. destroy all copies of the Software.

  88. EXPORT CONTROLS.  None of the Software or underlying information or
  89. technology may be downloaded or otherwise exported or reexported (i)
  90. into (or to a national or resident of) Cuba, Iraq, Libya, Yugoslavia,
  91. North Korea, Iran, Syria or any other country to which the U.S. has
  92. embargoed goods; or (ii) to anyone on the U.S. Treasury Department's
  93. list of Specially Designated Nationals or the U.S.  Commerce
  94. Department's Table of Deny Orders. By downloading  or using the
  95. Software, you are agreeing to the foregoing and you are representing
  96. and warranting that you are not located in, under the control of, or a
  97. national or resident of any such country or on any such list.

  99. MISCELLANEOUS. This Agreement represents the complete agreement
  100. concerning this license between the parties and supersedes all prior
  101. agreements and representations between them. It may be amended only by
  102. a writing executed by both parties. If any provision of this Agreement
  103. is held to be unenforceable for any reason, such provision shall be
  104. reformed only to the extent necessary to make it enforceable.  This
  105. Agreement shall be governed by and construed under California law as
  106. such law applies to agreements between California residents entered
  107. into and to be performed within California, except as governed by
  108. Federal law. The application the United Nations Convention of Contracts
  109. for the International Sale of Goods is expressly excluded.
  110.  
  111. U.S. Government Restricted Rights.  Use, duplication or disclosure by
  112. the Government is subject to restrictions set forth in subparagraphs
  113. (a) through (d) of the Commercial Computer-Restricted Rights clause at
  114. FAR 52.227-19 when applicable, or in subparagraph (c)(1)(ii) of the
  115. Rights in Technical Data and Computer Software clause at DFARS
  116. 252.227-7013, and in similar clauses in the NASA FAR Supplement.
