  7. NETSCAPE NAVIGATOR END USER LICENSE AGREEMENT

  9. REDISTRIBUTION NOT PERMITTED

  11. GRANT. Netscape Communications Corporation ("Netscape")
  12. hereby grants you a non-exclusive license to use its
  13. accompanying software product ("Software") free of charge if
  14. (a) you are a student, faculty member or staff member of an
  15. educational institution (K-12, junior college or college) or
  16. an employee of a charitable non-profit organization; or (b)
  17. your use of the Software is for the purpose of  evaluating
  18. whether to purchase an ongoing license to the Software.  The
  19. evaluation period for use by or on behalf of a commercial
  20. entity is limited to 90 days; evaluation use by others is not
  21. subject to this restriction.  Government agencies are not
  22. considered charitable non-profit organizations for purposes
  23. of this license agreement.  If you do not fit within the
  24. description above, a license fee is due to Netscape and no
  25. license is granted. If you are using the Software free of
  26. charge, you will not be entitled to support or telephone
  27. assistance.

  29. If you fit within the above description, you may: use the
  30. Software on any single computer; use the Software on a second
  31. computer so long as the first and second computers are not
  32. used simultaneously; or copy the Software for archival
  33. purposes, provided any copy must contain all of the original
  34. Software's proprietary notices.

  36. You may not: permit other individuals to use the Software
  37. except under the terms listed above; modify, translate,
  38. reverse engineer, decompile, disassemble (except to the
  39. extent applicable laws specifically prohibit such
  40. restriction), or create derivative works based on the
  41. Software; copy the Software (except for back-up purposes);
  42. rent, lease, transfer or otherwise transfer rights to the
  43. Software; or remove any proprietary  notices or labels on the
  44. Software.

  46. SOFTWARE. If you receive your first copy of the Software
  47. electronically, and a second copy on media, the second copy
  48. may be used for archival purposes only.  This license does
  49. not grant you any right to any enhancement or update.

  51. TITLE. Title, ownership rights, and intellectual property
  52. rights in and to the Software shall remain in Netscape and/or
  53. its suppliers. The Software is protected by the copyright
  54. laws of the United States and international copyright
  55. treaties.  Title, ownership rights, and intellectual property
  56. rights in and to the content accessed through the Software is
  57. the property of the applicable content owner and may be
  58. protected by applicable copyright or other law. This License
  59. gives you no rights to such content.

  61. DISCLAIMER OF WARRANTY. Since the Software is provided free
  62. of charge, the Software is provided on an "AS IS" basis,
  63. without warranty of any kind, including without limitation
  64. the warranties of merchantability, fitness for a particular
  65. purpose and non-infringement. The entire risk as to the
  66. quality and performance of the Software is borne by you.
  67. Should the Software prove defective, you and not Netscape
  68. assume the entire cost of any service and repair. In
  69. addition, the security mechanism implemented by the Software
  70. has inherent limitations, and you must determine that the
  71. Software sufficiently meets your requirements.  This
  72. disclaimer of warranty constitutes an essential part of the
  73. agreement. SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED
  74. WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY
  75. HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY
  76. JURISDICTION.

  78. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO
  79. LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL NETSCAPE OR
  80. ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER
  81. PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR
  82. CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT
  83. LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE,
  84. COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  85. COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL NETSCAPE BE
  86. LIABLE FOR ANY DAMAGES IN EXCESS OF NETSCAPE'S LIST PRICE FOR
  87. A LICENSE TO THE SOFTWARE, EVEN IF NETSCAPE SHALL HAVE BEEN
  88. INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM
  89. BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT
  90. APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT
  91. APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME
  92. STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL
  93. OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION
  94. MAY NOT APPLY TO YOU.

  96. TERMINATION.  This license will terminate automatically if
  97. you fail to comply with the limitations described above.  On
  98. termination, you must destroy all copies of the Software.

  100. EXPORT CONTROLS.  None of the Software or underlying
  101. information or technology may be downloaded or otherwise
  102. exported or reexported (i) into (or to a national or resident
  103. of) Cuba, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria
  104. or any other country to which the U.S. has embargoed goods;
  105. or (ii) to anyone on the U.S. Treasury Department's list of
  106. Specially Designated Nationals or the U.S.  Commerce
  107. Department's Table of Deny Orders. By downloading  or using
  108. the Software, you are agreeing to the foregoing and you are
  109. representing and warranting that you are not located in,
  110. under the control of, or a national or resident of any such
  111. country or on any such list.

  113. MISCELLANEOUS. This Agreement represents the complete
  114. agreement concerning this license between the parties and
  115. supersedes all prior agreements and representations between
  116. them. It may be amended only by a writing executed by both
  117. parties. If any provision of this Agreement is held to be
  118. unenforceable for any reason, such provision shall be
  119. reformed only to the extent necessary to make it
  120. enforceable.  This Agreement shall be governed by and
  121. construed under California law as such law applies to
  122. agreements between California residents entered into and to
  123. be performed within California, except as governed by Federal
  124. law. The application the United Nations Convention of
  125. Contracts for the International Sale of Goods is expressly
  126. excluded.

  128. U.S. Government Restricted Rights.  Use, duplication or
  129. disclosure by the Government is subject to restrictions set
  130. forth in subparagraphs (a) through (d) of the Commercial
  131. Computer-Restricted Rights clause at FAR 52.227-19 when
  132. applicable, or in subparagraph (c)(1)(ii) of the Rights in
  133. Technical Data and Computer Software clause at DFARS
  134. 252.227-7013, and in similar clauses in the NASA FAR
  135. Supplement.  Contractor/manufacturer is Netscape
