  4. License Agreement
  5. WEST END SOFTWARE LICENSE AGREEMENT AND LIMITED WARRANTY
  6. West End Software, Inc. ("West End") grants you the right to use this West End
  7. software product ("Software"), including any accompanying documentation, in the
  8. manner provided below.  This Software is owned by West End or its suppliers and
  9. is protected by copyright law and international copyright treaty.
  10.  
  11. The Software is a "shareware program." A shareware program is a program
  12. provided at no charge to the you for evaluation.  You may share it with others,
  13. but you must not give it away altered or as part of another system.
  14.  
  15. If you find the Software useful and continue to use it after a reasonable trial
  16. period, you must make a registration payment of US$10 to West End.  The
  17. registration fee will license one copy for use on any one computer at any one
  18. time.  You must treat this software just like a book.  An example is that this
  19. software may be used by any number of people and may be freely moved from one
  20. computer location to another, so long as there is no possibility of it being
  21. used at one location while it is being used at another. Just as a book cannot
  22. be read by two different persons at the same time.

  24. Commercial users of the Software must register and pay for their copies of the
  25. Software within 30 days of first use or their license is withdrawn.
  26. Site-License arrangements may be made by contacting West End.
  27.  
  28. Anyone distributing the Software for any kind of remuneration must first
  29. contact West End for authorization. This authorization will be automatically
  30. granted to distributors recognized by the (ASP) as adhering to its guidelines
  31. for shareware distributors, and such distributors may begin offering the
  32. Software immediately. However, West End must still be advised so that the
  33. distributor can be kept up-to-date with the latest version of the Software.

  35. If you have purchased a license for the Software, you may transfer the license
  36. on a permanent basis provided you retain no copies of the Software and the
  37. recipient agrees to the terms of this license agreement.  Except as provided in
  38. this agreement, you may not transfer, rent, lease, lend, copy, modify,
  39. translate, sublicense, time-share or electronically transmit or receive the
  40. Software or documentation.  You acknowledge that the Software in source code
  41. form remains a confidential trade secret of West End and/or its suppliers and
  42. therefore you agree not to modify the Software or attempt to decipher,
  43. decompile, disassemble or reverse engineer the Software, except to the extent
  44. applicable laws specifically prohibit such restriction.

  46. DISCLAIMER OF WARRANTY
  47. THE SOFTWARE IS PROVIDED AS IS.  TO THE MAXIMUM EXTENT PERMITTED BY
  48. APPLICABLE LAW, WEST END AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EITHER
  49. EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO,  IMPLIED WARRANTIES OF
  50. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE
  51. SOFTWARE AND THE ACCOMPANYING DOCUMENTATION.

  53. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEST
  54. END OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING,
  55. WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
  56. INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS)
  57. ARISING OUT OF THE USE OF OR INABILITY TO USE THIS WEST END PRODUCT, EVEN IF
  58. WEST END HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  60. HIGH RISK ACTIVITIES
  61. The Software is not fault-tolerant and is not designed, manufactured or
  62. intended for use or resale as on-line control equipment in hazardous
  63. environments requiring fail-safe performance, such as in the operation of
  64. nuclear facilities, aircraft navigation or communication systems, air traffic
  65. control, direct life support machines, or weapons systems, in which the failure
  66. of the Software could lead directly to death, personal injury, or severe
  67. physical or environmental damage ("High Risk Activities"). West End and its
  68. suppliers specifically disclaim any express or implied warranty of fitness for
  69. High Risk Activities.

  71. U.S. GOVERNMENT RESTRICTED RIGHTS
  72. The Software and documentation are provided with RESTRICTED RIGHTS. Use,
  73. duplication, or disclosure by the Government is subject to restrictions as set
  74. forth in subparagraphs (c)(1)(ii) of the Rights in Technical Data and Computer
  75. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the
  76. Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as
  77. applicable. Manufacturer is West End Software, Inc.

  79. GENERAL PROVISIONS
  80. This agreement may only be modified in writing signed by you and an authorized
  81. officer of West End.  If any provision of this agreement is found void or
  82. unenforceable, the remainder will remain valid and enforceable according to its
  83. terms.  If any remedy provided is determined to have failed for its essential
  84. purpose, all limitations of liability and exclusions of damages set forth in
  85. the Limited Warranty shall remain in effect.

  87. This agreement shall be construed, interpreted and governed by the laws of the
  88. State of Missouri, U.S.A.  This agreement gives you specific legal rights; you
  89. may have others which vary from state to state and from country to country.
  90. West End reserves all rights not specifically granted in this agreement.

  102. What is Shareware?
  103. Shareware distribution gives users a chance to try software before buying it.
  104. If you try a Shareware program and continue using it, you are expected to
  105. register. Individual programs differ on details -- some request registration
  106. while others require it, some specify a maximum trial period. With
  107. registration, you get anything from the simple right to continue using the
  108. software to an updated program with printed manual.

  117. some authors require written permission before a commercial disk vendor may
  118. copy their Shareware.
