  1. SEARCH4 END USER LICENSE AGREEMENT
  2. ----------------------------------

  4. LICENSE: Intermania grants you a non-exclusive license to use the 
  5. Software free of charge.  If you are using the Software free of 
  6. charge under the terms of this Agreement, you are not entitled to 
  7. hard-copy documentation, support or telephone assistance.
  8.  
  9. DISCLAIMER OF WARRANTY: Free of charge Software is provided 
  10. on an "AS IS" basis, without warranty of any kind, including without 
  11. limitation the warranties of merchantability, fitness for a particular 
  12. purpose and non-infringement. The entire risk as to the quality and 
  13. performance of the Software is taken by the user. Should the 
  14. Software prove defective, the user, and not Intermania, assume the 
  15. entire cost of any service and repair.   Any Online Services charges 
  16. that result from the use of this program are the sole responsibility of 
  17. the user. 
  18.  
  19. USER MAY: 
  20. - Use the Software on one or more computers, or on a network
  21. - Copy the Software for archival purposes, provided any copy must 
  22.   contain all of the original Software's proprietary notices.
  23.  
  24. USER MAY NOT: 
  25. - Permit other individuals to use the Software except under the  
  26.   terms listed above 
  27. - Modify, translate, reverse engineer, decompile, disassemble 
  28.   (except to the extent applicable laws specifically prohibit such 
  29.   restriction), or create derivative works based on the Software 
  30. - Rent, lease, grant a security interest in, or otherwise transfer rights 
  31.   to the Software 
  32. - Remove any proprietary notices or labels on the Software. 
  33.  
  34. TITLE: Title, ownership rights, and intellectual property rights in the 
  35. Software shall remain in Intermania. The Software is protected by 
  36. copyright laws and treaties. Title and related rights in the content 
  37. accessed through the Software is the property of the applicable 
  38. content owner and may be protected by applicable law. This License 
  39. gives you no rights to such content. 
  40.  
  41. TERMINATION: The license will terminate automatically if you fail 
  42. to comply with the limitations described herein. On termination, you 
  43. must destroy all copies of the Software. 
  44.  
  45. EXPORT CONTROLS. None of the Software or underlying 
  46. information or technology may be downloaded or otherwise exported 
  47. or reexported (i) into (or to a national or resident of) Cuba, Iraq, 
  48. Libya, Yugoslavia, North Korea, Iran, Syria or any other country to 
  49. which the U.S. has embargoed goods; or (ii) to anyone on the U.S. 
  50. Treasury DepartmentÆs list of Specially Designated Nationals or the 
  51. U.S. Commerce DepartmentÆs Table of Denial Orders. By 
  52. downloading or using the Software, you are agreeing to the 
  53. foregoing and you are representing and warranting that you are not 
  54. located in, under the control of, or a national or resident of any such 
  55. country or on any such list.

  57. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND 
  58. UNDER NO LEGAL THEORY, TORT, CONTRACT, OR 
  59. OTHERWISE, SHALL INTERMANIA OR ITS DISTRIBUTERS BE 
  60. LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, 
  61. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF 
  62. ANY CHARACTER  INCLUDING, WITHOUT LIMITATION, 
  63. DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, 
  64. COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL 
  65. OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT 
  66. WILL INTERMANIA BE LIABLE FOR ANY DAMAGES IN EXCESS 
  67. OF THE AMOUNT INTERMANIA RECEIVED FROM YOU FOR A 
  68. LICENSE TO THE SOFTWARE, EVEN IF INTERMANIA SHALL 
  69. HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH 
  70. DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS 
  71. LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY 
  72. FOR DEATH OR PERSONAL INJURY TO THE EXTENT 
  73. APPLICABLE LAW PROHIBITS SUCH LIMITATION. 
  74. FURTHERMORE, SOME JURISDICTIONS DO NOT ALLOW THE 
  75. EXCLUSION OR LIMITATION OF INCIDENTAL OR 
  76. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND 
  77. EXCLUSION MAY NOT APPLY TO THE USER.

  79. HIGH RISK ACTIVITIES. The Software is not fault-tolerant and is 
  80. not designed, manufactured or intended for use or resale as on-line 
  81. control equipment in hazardous environments requiring fail-safe 
  82. performance, such as in the operation of nuclear facilities, aircraft 
  83. navigation or communication systems, air traffic control, direct life 
  84. support machines, or weapons systems, in which the failure of the 
  85. Software could lead directly to death, personal injury, or severe 
  86. physical or environmental damage ("High Risk Activities"). 
  87. Intermania and its distributers specifically disclaim any express or 
  88. implied warranty of fitness for High Risk Activities. 
  89.  
  90. MISCELLANEOUS. If the copy of the Software you received was 
  91. accompanied by a printed or other form of "hard-copy" End User 
  92. License Agreement whose terms vary from this Agreement, then the 
  93. hard-copy End User License Agreement governs your use of the 
  94. Software. This Agreement represents the complete agreement 
  95. concerning this license and may be amended only by a writing 
  96. executed by both parties. If any provision of this Agreement is held 
  97. to be unenforceable,  such provision shall be reformed only to the 
  98. extent necessary to make it enforceable. The application the United 
  99. Nations Convention of Contracts for the International Sale of Goods 
  100. is expressly excluded.

  102. U.S. GOVERNMENT RESTRICTED RIGHTS. Use, duplication or 
  103. disclosure by the Government is subject to restrictions set forth in 
  104. subparagraphs (a) through (d) of the Commercial Computer-
  105. Restricted Rights clause at FAR 52.227-19 when applicable, or in 
  106. subparagraph (c)(1)(ii) of the Rights in Technical Data and 
  107. Computer Software clause at DFARS 252.227-7013, or at 252.211-
  108. 7015, and in similar clauses in the NASA FAR Supplement.
