  15.          1.     I HEREBY REVOKE all wills and testamentary 
  16.          dispositions of every nature and kind whatsoever by me 
  17.          heretobefore made.

  27.          3.     I GIVE, DEVISE, AND BEQUEST all my property of 
  28.          every nature and kind and wheresoever situate, including 
  29.          any property over which I may have a general power of 
  30.          appointment to my said Trustee upon the following 
  31.          trusts, namely:
  32.                 a)      To use his or her discretion in the 
  33.          realization of my estate, with power to my Trustee to 
  34.          sell, call in and convert into money any part of my 
  35.          estate not consisting of money at such time or times in 
  36.          such manner and upon such terms, and either for cash or 
  37.          credit or for part cash and part credit as my said 
  38.          Trustee in his or her absolute discretion may decide 
  39.          upon, or to postpone such conversion of my estate or any 
  40.          part or parts thereof for such length of time as he or 
  41.          she may think best, and I hereby declare that my trustee 
  42.          shall have a separate and substantive power to retain 
  43.          any of my investments or assets in the form existing at 
  44.          the date of my death at his or her absolute discretion 
  45.          without responsibility for loss to the intent that 
  46.          investments or assets so retained shall be deemed to be 
  47.          authorized investments for all purposes of this my Will.
  48.                 b)      To use his or her discretion in making 
  49.          elections with power to make all such elections as he or 
  50.          she shall deem in his or her absolute discretion to be 
  51.          in the best interests of my estate as a whole, and 
  52.          specifically, and elections as may be necessary under 
  53.          The Income Tax Act and the provisions thereof from time 
  54.          to time in force.
  55.                 c)      To make any division of my estate or set 
  56.          aside or pay any share or interest therein, either 
  57.          wholly or in part, in the assets forming my estate at 
  58.          the time of my death or at the time of such division, 
  59.          setting aside or payment, and I declare that my trustees 
  60.          shall, in their absolute discretion, fix the value of my 
  61.          estate or any part thereof for the purpose of making any 
  62.          such division. setting aside or payment, and their 
  63.          decision shall be final and binding upon all persons 
  64.          concerned. In fixing the value of the assets of my 
  65.          estate, I direct my Trustee to keep an even hand and I 
  66.          direct them to take into account not only fair market 
  67.          value of capital property but also its adjusted cost 
  68.          base.
  69.                 d)      To make a distribution of assets 
  70.          according to the items of this my Will if, in their 
  71.          opinion, there is no further liability for any taxes 
  72.          even though they have not obtained a clearance. My 
  73.          Trustees may, if they consider it advisable, make any 
  74.          such distribution, and as a condition for so doing shall 
  75.          have the right to ask for and receive signed 
  76.          indemnification from the beneficiaries to whom any such 
  77.          distributions are made.
  78.                 e)      To pay my just debts, funeral, and 
  79.          testamentary expenses, and all estate, legacy, 
  80.          succession and inheritance taxes and duties (if any), 
  81.          whether imposed by or pursuant to the law of any 
  82.          domestic or foreign jurisdiction whatsoever, that may be 
  83.          payable in connection with the property passing (or 
  84.          deemed to pass by any governing law) on my death or in 
  85.          connection with any insurance on my life or in 
  86.          connection with any gift or benefit given or provided by 
  87.          me either in my lifetime or by the survivorship or by 
  88.          this my Will or any Codicil thereto, and whether such 
  89.          taxes and duties payable in respect of estates or 
  90.          interests which fall into possession at my death or any 
  91.          subsequent time; and I hereby authorize my Trustees to 
  92.          commute or repay any such taxes or duties.
  93.                 f)      To divide the reside of my estate into as 
  94.          many parts as I have brothers and sisters, as at the 
  95.          date of the signing of this will, and then to give one 
  96.          such equal share to each of my brothers and sisters, for 
  97.          their own use absolutely.
  98.                 g)      If any of my above stated brothers and 
  99.          sisters shall die before I die, I direct that that 
  100.          brother or sisters share shall be divided into as many 
  101.          equal shares as the said brother or sister has 
  102.          children, as at the time of my death, and to give one 
  103.          such share to each of the said children, for their own 
  104.          use absolutely.

  106.          4.     I DECLARE that in this my will the term 'trustee' 
  107.          or 'trustees' and all references thereto shall (where 
  108.          the context so permits) mean and include the Executor, 
  109.          the Executrix, the Executors, the Trustee, the Trustees 
  110.          for the time being hereof, whether original, additional, 
  111.          or substitutional, and shall be construed accordingly.

  113.          5.     If any person shall become entitled to any share 
  114.          in this my Estate before attaining the age of majority, 
  115.          the share of such person shall be paid to the parent, 
  116.          or parents, or trustee, or guardian (as the case may be) 
  117.          of that person, in trust for that minor; and the receipt 
  118.          signed by that parent, or parents, or trustee, or 
  119.          guardian (as the case may be) shall be sufficient to 
  120.          discharge my trustee of his or her obligations under this 
  121.          my will.
