  1.                         SOFTWARE LICENSE AGREEMENT

  3. This Software License Agreement (the "Agreement") is a legal 
  4. agreement between you, the end-user, and Brandyware Software.  By 
  5. continuing the installation of this program, by loading or running 
  6. the program, or by placing or copying the program onto your computer 
  7. hard drive, you are agreeing to be bound by the terms of this Agreement.

  9. Brandyware Software LICENSE
  10.  
  11.   1. Grant of License.  Brandyware Software grants to you, the right to
  12. use "Makaha v1.2" (the "Software"). For purposes of this
  13. section, "use" means loading the Software into RAM, as well as installation 
  14. on a hard disk or other storage  device.  You may not:  modify, translate, 
  15. disassemble, decompile, reverse engineer, or create derivative works based 
  16. upon the Software. The Software may ONLY be "used" on ONE  
  17. computer system at a time! You agree that the Software will not be shipped,
  18. transferred or exported into any country in violation of the
  19. U.S. Export Administration Act and that you will not utilize, in any other
  20. manner, the Software in violation of any applicable law.

  22.   2. Copyright. The Software is owned by Brandyware Software and is 
  23. protected by United States copyright laws and international treaty 
  24. provisions. You must treat the Software like any other copyrighted 
  25. material.

  27. You agree to use to your best efforts to see that the Software licensed 
  28. hereunder complies with this Agreement.

  30.   3. BRANDYWARE SOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS 
  31. OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES 
  32. OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT 
  33. TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIALS, IF ANY. 
  34. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE 
  35. OTHERS WHICH VARY FROM JURISDICTION TO JURISDICTION. BRANDYWARE SOFTWARE 
  36. DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, 
  37. ERROR FREE OR MEET LICENSEE'S SPECIFIC REQUIREMENTS. THE WARRANTY SET FORTH 
  38. ABOVE IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES WHETHER ORAL OR WRITTEN.  
  39. ADDITIONAL STATEMENTS SUCH AS DEALER ADVERTISING OR PRESENTATIONS, 
  40. WHETHER ORAL OR WRITTEN, DO NOT CONSTITUTE WARRANTIES BY BRANDYWARE SOFTWARE
  41. AND SHOULD NOT BE RELIED UPON.

  43.   4. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, YOU UNDERSTAND THIS
  44. AGREEMENT, AND UNDERSTAND THAT BY CONTINUING THE INSTALLATION OF THE 
  45. SOFTWARE, BY LOADING OR RUNNING THE SOFTWARE, OR BY PLACING OR COPYING THE 
  46. SOFTWARE ONTO YOUR COMPUTER HARD DRIVE, YOU AGREE TO BE BOUND BY THIS 
  47. AGREEMENT'S TERMS AND CONDITIONS.  YOU FURTHER AGREE THAT, EXCEPT FOR WRITTEN 
  48. SEPARATE AGREEMENTS BETWEEN BRANDYWARE SOFTWARE AND YOU, THIS AGREEMENT 
  49. IS A COMPLETE AND EXCLUSIVE STATEMENT OF THE RIGHTS AND LIABILITIES OF THE 
  50. PARTIES.  THIS AGREEMENT SUPERSEDES ALL PRIOR ORAL AGREEMENTS, PROPOSALS OR 
  51. UNDERSTANDINGS, AND ANY OTHER COMMUNICATIONS BETWEEN BRANDYWARE SOFTWARE
  52. AND YOU RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.

  55. License statement required by Unisys Corp. for licensing LZW compression:
  56.  
  57. Use of this software is permitted only to the extent reasonably required to determine
  58. whether to purchase the software.
  59. After payment is made, use of this software is limited to use on only a single personal
  60. computer or workstation which is not used as a server. An additional payment is required
  61. for each use on another personal computer or workstation.
  62. Only a single copy may be made of this software solely for backup or archival purposes.
  63. The software may also be transferred to a single hard disk.
  64.  
  65. Any use of this software in violation of the above is not licensed.
