  1. This End-User License Agreement (EULA) is a 
  2. legal agreement between you, either an 
  3. individual or a single entity, and Selectra Ltd 
  4. (SELECTRA) for the software identified above, 
  5. which includes: PC-Telephone product 
  6. components, distributives, documentation, 
  7. services and any related explanatory materials 
  8. (SOFTWARE). The term SOFTWARE shall also 
  9. include any upgrades, updates, new releases 
  10. and new components of the SOFTWARE. By 
  11. installing, copying, or otherwise using the 
  12. SOFTWARE, you agree to be bound by the 
  13. terms of this EULA. If you do not agree to the 
  14. terms of this EULA, do not install and use the 
  15. SOFTWARE.

  17. 1. EVALUATION COPY
  18.  
  19. The free evaluation copy of the SOFTWARE 
  20. has the following limitations:
  21.  
  22. - PC-Telephone API not included;
  23. - PC-Telephone Fax with watermark;
  24. - Network ID information disabled;
  25. - Import/Export Phonebook disabled;
  26. - Limited calls duration over ISDN;
  27. - PC speaker call notification disabled;
  28. - USB phone call notification disabled;
  29. - USB keypad disabled.

  31. All the functions of the SOFTWARE are 
  32. available in the evaluation copy. You may install 
  33. and use the evaluation copy of the SOFTWARE 
  34. free of charge as long as you like. You must 
  35. register your copy and pay the license fee to use 
  36. the registered copy of the SOFTWARE without 
  37. the limitations identified above. If you use a 
  38. registered copy of the SOFTWARE without 
  39. paying the license fee you will be using the 
  40. SOFTWARE on an unlicensed basis, which is in 
  41. violation with International Copyright laws. 
  42. Violators will be prosecuted to the maximum 
  43. extent possible.

  45. The original evaluation copy of the SOFTWARE 
  46. can be copied and distributed in its unmodified 
  47. form via electronic means: Internet, CD-ROMs, 
  48. diskettes, etc. You may not charge any fee for 
  49. the copy or the use of the evaluation 
  50. SOFTWARE itself and you must not represent in 
  51. any way that you are selling the SOFTWARE 
  52. itself. Your distribution of the evaluation 
  53. SOFTWARE will not entitle you to any 
  54. compensation from SELECTRA.

  56. 2. REGISTERED COPY
  57.  
  58. After you have purchased the license for the 
  59. SOFTWARE, and have received the license key 
  60. enabling the registered copy, you are licensed to 
  61. copy the SOFTWARE only into the memory of 
  62. the number of computers corresponding to the 
  63. number of licenses purchased. You may not give 
  64. to anyone or otherwise distribute in any way a 
  65. registered copy of the SOFTWARE and/or a 
  66. license key enabling the registered copy. The 
  67. registered copy of the SOFTWARE may not be 
  68. rented or leased, but may be permanently 
  69. transferred in its entirety if the person receiving 
  70. it agrees to the terms of this EULA. You may 
  71. terminate this EULA at any time by destroying 
  72. the original and all other copies of the 
  73. SOFTWARE in whatever form.

  75. 3. RESTRICTIONS
  76.  
  77. You may not modify, adapt, translate, reverse 
  78. engineer, de-compile, disassemble or otherwise 
  79. attempt to crack or discover the source code of 
  80. the SOFTWARE. You may not use the 
  81. SOFTWARE to perform any unauthorized 
  82. transfer of information or for any illegal purpose. 
  83. Any such unauthorized use shall result in 
  84. immediate and automatic termination of this 
  85. EULA and may result in severe civil and criminal 
  86. penalties. Violators will be prosecuted to the 
  87. maximum extent possible.

  89. 4. TERMINATION
  90.  
  91. Without prejudice to any other rights, 
  92. SELECTRA may terminate this EULA if you fail to 
  93. comply with the terms and conditions of this 
  94. EULA. In such event, you must destroy the 
  95. original and all other copies of the SOFTWARE 
  96. in whatever form.
  97.  
  98. 5. COPYRIGHTS
  99.  
  100. The SOFTWARE is owned by SELECTRA and 
  101. is protected by the International Copyright Law 
  102. and International Treaty provisions. You 
  103. acknowledge that no title to the intellectual 
  104. property in the SOFTWARE is transferred to you. 
  105. You further acknowledge that title and full 
  106. ownership rights to the SOFTWARE will remain 
  107. the exclusive property of SELECTRA and you 
  108. will not acquire any rights to the SOFTWARE 
  109. except as expressly set forth in this EULA. You 
  110. agree that any copies of the SOFTWARE will 
  111. contain the same proprietary notices, which 
  112. appear on and in the SOFTWARE.

  114. 6. DISCLAIMER OF WARRANTIES
  115.  
  116. SELECTRA expressly disclaims any warranty for 
  117. the SOFTWARE. The SOFTWARE is provided 
  118. "as is" without warranty of any kind, either 
  119. express or implied, including, without limitation, 
  120. the implied warranties or merchantability, fitness 
  121. for particular purpose, or non-infringement. The 
  122. entire risk arising out of use or performance of 
  123. the SOFTWARE remains with you.
  124.  
  125. 7. LIMITATION OF LIABILITY
  126.  
  127. In no event shall SELECTRA be liable to you for 
  128. any consequential, special, incidental, or 
  129. indirect damages of any kind arising out of the 
  130. delivery, performance, or use of the 
  131. SOFTWARE, even if SELECTRA has been 
  132. advised of the possibility of such damages or for 
  133. any claim by any third party. SELECTRA shall not 
  134. be liable for data loss, loss of profits, loss of 
  135. savings or any other kind of loss while using or 
  136. misusing the SOFTWARE.

  138. All rights not expressly granted in this EULA are 
  139. reserved by SELECTRA.
  140.  
  141. Your acceptance of the foregoing agreement 
  142. was indicated during the installation procedure.
