  109. -This End-User License Agreement (EULA) is a 
  110. -legal agreement between you, either an 
  111. -individual or a single entity, and Selectra Ltd 
  112. -(SELECTRA) for the software identified above, 
  113. -which includes: PC-Telephone product 
  114. -components, distributives, documentation, 
  115. -services and any related explanatory materials 
  116. -(SOFTWARE). The term SOFTWARE shall also 
  117. -include any upgrades, updates, new releases 
  118. -and new components of the SOFTWARE. By 
  119. -installing, copying, or otherwise using the 
  120. -SOFTWARE, you agree to be bound by the 
  121. -terms of this EULA. If you do not agree to the 
  122. -terms of this EULA, do not install and use the 
  123. -SOFTWARE.

  125. -1. EVALUATION COPY
  126. -
  127. -The free evaluation copy of the SOFTWARE 
  128. -has the following limitations:

  130. -- PC-Telephone API not included;
  131. -- PC-Telephone Fax with watermark;
  132. -- Network ID information disabled;
  133. -- Import/Export Phonebook disabled;
  134. -- Limited calls duration over ISDN;
  135. -- PC speaker call notification disabled;
  136. -- USB phone call notification disabled;
  137. -- USB keypad disabled.

  139. -All the functions of the SOFTWARE are 
  140. -available in the evaluation copy. You may install 
  141. -and use the evaluation copy of the SOFTWARE 
  142. -free of charge as long as you like. You must 
  143. -register your copy and pay the license fee to use 
  144. -the registered copy of the SOFTWARE without 
  145. -the limitations identified above. If you use a 
  146. -registered copy of the SOFTWARE without 
  147. -paying the license fee you will be using the 
  148. -SOFTWARE on an unlicensed basis, which is in 
  149. -violation with International Copyright laws. 
  150. -Violators will be prosecuted to the maximum 
  151. -extent possible.

  153. -The original evaluation copy of the SOFTWARE 
  154. -can be copied and distributed in its unmodified 
  155. -form via electronic means: Internet, CD-ROMs, 
  156. -diskettes, etc. You may not charge any fee for 
  157. -the copy or the use of the evaluation 
  158. -SOFTWARE itself and you must not represent in 
  159. -any way that you are selling the SOFTWARE 
  160. -itself. Your distribution of the evaluation 
  161. -SOFTWARE will not entitle you to any 
  162. -compensation from SELECTRA.

  164. -2. REGISTERED COPY
  165. -
  166. -After you have purchased the license for the 
  167. -SOFTWARE, and have received the license key 
  168. -enabling the registered copy, you are licensed to 
  169. -copy the SOFTWARE only into the memory of 
  170. -the number of computers corresponding to the 
  171. -number of licenses purchased. You may not give 
  172. -to anyone or otherwise distribute in any way a 
  173. -registered copy of the SOFTWARE and/or a 
  174. -license key enabling the registered copy. The 
  175. -registered copy of the SOFTWARE may not be 
  176. -rented or leased, but may be permanently 
  177. -transferred in its entirety if the person receiving 
  178. -it agrees to the terms of this EULA. You may 
  179. -terminate this EULA at any time by destroying 
  180. -the original and all other copies of the 
  181. -SOFTWARE in whatever form.

  183. -3. RESTRICTIONS

  185. -You may not modify, adapt, translate, reverse 
  186. -engineer, de-compile, disassemble or otherwise 
  187. -attempt to crack or discover the source code of 
  188. -the SOFTWARE. You may not use the 
  189. -SOFTWARE to perform any unauthorized 
  190. -transfer of information or for any illegal purpose. 
  191. -Any such unauthorized use shall result in 
  192. -immediate and automatic termination of this 
  193. -EULA and may result in severe civil and criminal 
  194. -penalties. Violators will be prosecuted to the 
  195. -maximum extent possible.

  197. -4. TERMINATION

  199. -Without prejudice to any other rights, 
  200. -SELECTRA may terminate this EULA if you fail to 
  201. -comply with the terms and conditions of this 
  202. -EULA. In such event, you must destroy the 
  203. -original and all other copies of the SOFTWARE 
  204. -in whatever form.
  205. -
  206. -5. COPYRIGHTS
  207. -
  208. -The SOFTWARE is owned by SELECTRA and 
  209. -is protected by the International Copyright Law 
  210. -and International Treaty provisions. You 
  211. -acknowledge that no title to the intellectual 
  212. -property in the SOFTWARE is transferred to you. 
  213. -You further acknowledge that title and full 
  214. -ownership rights to the SOFTWARE will remain 
  215. -the exclusive property of SELECTRA and you 
  216. -will not acquire any rights to the SOFTWARE 
  217. -except as expressly set forth in this EULA. You 
  218. -agree that any copies of the SOFTWARE will 
  219. -contain the same proprietary notices, which 
  220. -appear on and in the SOFTWARE.

  222. -6. DISCLAIMER OF WARRANTIES
  223. -
  224. -SELECTRA expressly disclaims any warranty for 
  225. -the SOFTWARE. The SOFTWARE is provided 
  226. -"as is" without warranty of any kind, either 
  227. -express or implied, including, without limitation, 
  228. -the implied warranties or merchantability, fitness 
  229. -for particular purpose, or non-infringement. The 
  230. -entire risk arising out of use or performance of 
  231. -the SOFTWARE remains with you.
  232. -
  233. -7. LIMITATION OF LIABILITY
  234. -
  235. -In no event shall SELECTRA be liable to you for 
  236. -any consequential, special, incidental, or 
  237. -indirect damages of any kind arising out of the 
  238. -delivery, performance, or use of the 
  239. -SOFTWARE, even if SELECTRA has been 
  240. -advised of the possibility of such damages or for 
  241. -any claim by any third party. SELECTRA shall not 
  242. -be liable for data loss, loss of profits, loss of 
  243. -savings or any other kind of loss while using or 
  244. -misusing the SOFTWARE.

  246. -All rights not expressly granted in this EULA are 
  247. -reserved by SELECTRA.

  249. -Your acceptance of the foregoing agreement
