  2.   SOFTWARE LICENSE AGREEMENT
  3. ===========================================================
  4.   You should carefully read the following terms and conditions
  5.   before using this software.  Unless you have a different license
  6.   agreement signed by AlphaCom Software your use of this software 
  7.   indicates your acceptance of this license agreement and 
  8.   warranty. AlphaCom Software has the right to grant any licenses
  9.   for any users based solely on AlphaCom Software's decision (usually,
  10.   these users are beta-testers or other supporters).

  12.   1. EVALUATION COPY
  13.  
  14.   1.1. Anyone may use evaluation copy of this software. The following
  15.   restrictions are applied to evaluation copy:
  16.     1.1.1. number of domain names to handle at a time cannot exceed 15
  17.  
  18.   1.2. Evaluation copy of this software is provided for evaluation
  19.   purposes only. Once you decide to use this software for any other 
  20.   purposes, you should purchase one or more licenses in accordance
  21.   with terms below.

  23.   2. REGISTERED VERSION
  24.  
  25.   2.1 AlphaCom Software grants you a license to use one copy of
  26.   the version of this software on any one hardware product (for as many
  27.   licenses as you purchase. "You" means the company, entity or individual
  28.   whose funds are used to pay the license fee. "Use" means storing,
  29.   loading, installing, executing or displaying the SOFTWARE.

  31.   3. COMMON TERMS AND CONDITIONS
  32.  
  33.   3.1. You may not modify the SOFTWARE or disable any licensing or 
  34.   control features of the SOFTWARE except as an intended part of the 
  35.   SOFTWARE's programming features. This license is not transferable 
  36.   to any other hardware product or other company, entity, or
  37.   individual.

  39.   3.2. OWNERSHIP. The SOFTWARE is owned and copyrighted by
  40.   AlphaCom Software. Your license confers no title or ownership in the 
  41.   SOFTWARE and should not be construed as a sale of any right in the 
  42.   SOFTWARE.

  44.   3.3. COPYRIGHT. The SOFTWARE is protected by United States copyright
  45.   law and international treaty provisions. You acknowledge that no 
  46.   title to the intellectual property in the SOFTWARE is transferred 
  47.   to you. You further acknowledge that title and full ownership rights 
  48.   to the SOFTWARE will remain the exclusive property of AlphaCom Software 
  49.   and you will not acquire any rights to the SOFTWARE except as 
  50.   expressly set forth in this license. You agree that any copies 
  51.   of the SOFTWARE will contain the same proprietary notices which 
  52.   appear on and in the SOFTWARE.

  54.   3.4. REVERSE ENGINEERING. You agree that you will not attempt to 
  55.   reverse compile, modify, translate, or disassemble the SOFTWARE 
  56.   in whole or in part.
  57.  
  58.   3.5. UNAUTHORIZED USE. You may not use, copy, rent, lease, sell, 
  59.   modify, decompile, disassemble, otherwise reverse engineer, or 
  60.   transfer the SOFTWARE except as provided in this agreement. Any 
  61.   such unauthorized use shall result in immediate and automatic 
  62.   termination of this license.

  64.   3.6. BUNDLING. In no case may this product be bundled with 
  65.   hardware or other non-evaluation copy of software without written 
  66.   permission from AlphaCom Software.

  68.   3.7. DISTRIBUTION. Permission to distribute the SOFTWARE is not 
  69.   transferable, assignable, saleable, or franchisable. Each entity 
  70.   wishing to distribute the package must independently satisfy the 
  71.   terms of the distribution license.

  73.   3.8. U.S. GOVERNMENT INFORMATION. Use, duplication, or disclosure by
  74.   the U.S. Government of the computer software and documentation in this
  75.   package shall be subject to restrictions as set forth in subparagraph
  76.   (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at
  77.   DFARS 252.277-7013 (Oct 1988) and FAR 52.227-19 (Jun 1987). The
  78.   Contractor is AlphaCom Software.
  79.  
  80.   3.9. NO OTHER WARRANTIES.  DOES NOT WARRANT 
  81.   THAT THE SOFTWARE IS ERROR FREE. AlphaCom Software DISCLAIMS ALL
  82.   OTHER WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER
  83.   EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED
  84.   WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  85.   PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.
  86.   SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF
  87.   IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED
  88.   WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION OF
  89.   INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
  90.   LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS
  91.   WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY
  92.   ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO
  93.   JURISDICTION.

  95.   3.10. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT
  96.   SHALL AlphaCom Software OR ITS SUPPLIERS BE LIABLE TO YOU FOR
  97.   ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT
  98.   DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY,
  99.   PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF AlphaCom Software
  100.   HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN
  101.   NO EVENT WILL AlphaCom Software's LIABILITY FOR ANY CLAIM,
  102.   WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF
  103.   LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.

  105.   3.11. ENTIRE AGREEMENT. This is the entire agreement between 
  106.   you and AlphaCom Software which supersedes any prior agreement or 
  107.   understanding, whether written or oral, relating to the subject 
  108.   matter of this license.

  110.   3.12. RESERVED RIGHTS. All rights not expressly granted here are 
  111.   reserved to AlphaCom Software.

  114.   THE SOFTWARE IS PROVIDED TO LICENSEE "AS IS". ALL EXPRESS 
  115.   OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES, 
  116.   INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, 
  117.   SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR 
  118.   NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT 
  119.   THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

  121.   THIS SOFTWARE IS NOT FAULT TOLERANT AND SHOULD NOT BE 
  122.   USED IN ANY ENVIRONMENT WHICH REQUIRES THIS, SUCH AS 
  123.   ON-LINE CONTROL OF AIRCRAFT.

  125.   TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, AUTHOR'S 
  126.   AGGREGATE LIABILITY TO LICENSEE OR TO ANY THIRD PARTY FOR 
  127.   CLAIMS RELATING TO THIS AGREEMENT, WHETHER FOR BREACH 
  128.   OR IN TORT, WILL BE LIMITED TO THE FEES PAID BY 
  129.   LICENSEE FOR SOFTWARE WHICH IS THE SUBJECT MATTER OF 
  130.   THE CLAIMS. IN NO EVENT WILL AUTHOR BE LIABLE FOR ANY 
  131.   INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL 
  132.   DAMAGE IN CONNECTION WITH OR ARISING OUT OF THIS 
  133.   AGREEMENT (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, 
  134.   USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT 
  135.   ARISES, WHETHER FOR BREACH OR IN TORT, EVEN IF AUTHOR 
  136.   HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH 
  137.   DAMAGE. LIABILITY FOR DAMAGES WILL BE LIMITED AND 
  138.   EXCLUDED, EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN 
  139.   THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.
