  1. IMPORTANT! READ THIS LICENSE AGREEMENT BEFORE INSTALLING THE 
  2. SOFTWARE CD-ROM. STREETWISE IS WILLING TO LICENSE THE ENCLOSED 
  3. SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE 
  4. TERMS CONTAINED IN THIS LICENSE AGREEMENT. BY INSTALLING THE CD-
  5. ROM, YOU WILL INDICATE YOUR AGREEMENT TO BE BOUND BY THE TERMS OF 
  6. THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, THEN 
  7. STREETWISE IS UNWILLING TO LICENSE THE SOFTWARE TO YOU, IN WHICH 
  8. EVENT YOU SHOULD RETURN THE UNOPENED CD-ROM PACKAGE, TOGETHER WITH 
  9. ALL ACCOMPANYING MATERIALS AND PROOF OF PAYMENT, TO THE PLACE FROM 
  10. WHICH IT WAS ACQUIRED FOR A FULL REFUND.

  12. 1. LICENSE GRANT. You are permitted to use Professor Franklin's 
  13. Instant Photo Effects (the "Software") on any single computer, 
  14. provided the Software is in use on only one computer at any time. 
  15. "Use" means loading the Software into temporary memory (RAM) or 
  16. installing the Software onto the hard disk or other permanent 
  17. memory storage device of that computer.

  19. You are not permitted to rent, lease, lend, sub-license or 
  20. otherwise temporarily transfer the right to use the Software or 
  21. the user documentation accompanying the Software (the 
  22. "Documentation"). You may permanently transfer all of your rights 
  23. to use the Software to another person, provided that you at the 
  24. same time transfer all copies of the Software and destroy all 
  25. copies not transferred - and the Documentation and the recipient 
  26. agrees to the terms of this agreement. You are not permitted to 
  27. reverse engineer, decompile, disassemble, or otherwise attempt to 
  28. render source code from the Software.

  30. Your right to use the Software and the Documentation terminates 
  31. automatically if you fail to comply with the terms of this 
  32. agreement.

  34. 2. COPYRIGHT PROTECTION. The Software is protected by various 
  35. laws, including United States copyright law and international 
  36. copyright treaties. You may use the content contained in the 
  37. Software for your own personal or business purposes other than for 
  38. resale or publication in whole or in part. You are permitted to 
  39. make one copy of the Software or to transfer the Software to a 
  40. single hard disk only for archival purposes, provided that you 
  41. destroy the archival copy in the event you permanently transfer 
  42. possession of the Software or your continued possession of the 
  43. Software ceases to be rightful. You may not copy the 
  44. Documentation.

  46. 3. LIMITED WARRANTY. Streetwise warrants that the media on which 
  47. the Software is furnished will be free of defects in material and 
  48. workmanship for a period of 90 days from the date of purchase. 
  49. STREETWISE DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE 
  50. SOFTWARE, SOFTWARE CONTENT, USER DOCUMENTATION AND MEDIA, EXPRESS 
  51. OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES 
  52. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND 
  53. NONINFRINGEMENT OF THIRD PARTY RIGHTS. Some jurisdictions do not 
  54. allow the exclusion or limitation of implied warranties, so these 
  55. exclusions and limitations may not apply to you. This warranty 
  56. gives you specific legal rights, and you may have others which 
  57. vary from jurisdiction to jurisdiction.

  59. 4. PURCHASER REMEDIES. Streetwise's entire liability and your sole 
  60. and exclusive remedy for breach of the Streetwise Limited Warranty 
  61. shall be, at Streetwise's option, either (1) replacement of the 
  62. defective media, or (2) refund of the price paid, provided that 
  63. you return all materials to Streetwise with a copy of your 
  64. receipt. The Limited Warranty is void if failure of the Software 
  65. results from accident, abuse or misapplication. Any replacement 
  66. Software will be warranted only for the remainder of the original 
  67. warranty period. Streetwise will not be liable to you, under any 
  68. circumstances, for any claim for damages (including special, 
  69. incidental, indirect or consequential damages) resulting from the 
  70. use of the Software, even if Streetwise has been advised of the 
  71. possibility of such damages. In no event will Streetwise's 
  72. liability for any claim of any kind exceed the license fee paid by 
  73. you for use of the Software.

  75. 5. U.S. GOVERNMENT RESTRICTED RIGHTS. The Software and 
  76. Documentation are licensed to the U.S. Government with RESTRICTED 
  77. RIGHTS. Use, duplication, or disclosure by the U.S. Government is 
  78. subject to restrictions as set forth in the Rights in Technical 
  79. Data and Computer Software clause at DFARS 252.227-7013 and the 
  80. Commercial Computer Software clause at 48 CFR 52.227-19, as 
  81. applicable. Contractor/manufacturer is Streetwise Software, 2716

  84. 6. GENERAL TERMS. This License Agreement is: (1) governed by the 
  85. laws of the State of California; (2) may only be modified in 
  86. writing signed by Streetwise and you; and (3) constitutes the 
  87. entire agreement between Streetwise and you, and supersedes any 
  88. prior agreement, whether oral or written, relating to this 
  89. agreement.
