  1. BALLOONrain User Software License
  2.  
  3. This license agreement binds you and Emmanuel Rivoire ("the Author") and
  4. covers your use of software comprising the BALLOONrain program ("the
  5. Software"). No title passes as a consequence of a license to the
  6. Software being granted to you, and all rights are expressly reserved by
  7. the Author. This license agreement is non-transferable, and non-
  8. exclusive.
  9.  
  10. This license agreement is effective upon the Software being installed
  11. onto a computer in your possession or control, or the copying of the
  12. Software onto any media in your possession.
  13.  
  14. During the period of 14 days of such installation or copying ("the Trial
  15. Period"), you may use the Software for the purpose of deciding whether
  16. you wish to retain the Software. you may also make copies of the
  17. Software for distribution to others, but you may not sell it.
  18.  
  19. Should you decide to retain the Software, you agree to pay the Author a
  20. license fee. The Author may specify certain approved means for payment,
  21. and you agree to pay the Author using these approved means.
  22.  
  23. Payment of the license fee allows you to use one copy of the Software on
  24. a single computer. The Software may not be made available on a network,
  25. and you may not use the Software or make it available for use on more
  26. than one computer at the same time. You may make one copy of the
  27. Software solely for the purpose of archival and backup.
  28.  
  29. You may not rent or lease the Software, nor may you modify, adapt,
  30. translate, reverse engineer, decompile, or disassemble the Software. If
  31. you violate any part of this agreement, your right to use this Software
  32. terminates automatically and you must then destroy all copies of the
  33. Software in your possession.
  34.  
  35. Should you decide not to retain the Software, you agree to delete,
  36. without notice, all copies of the Software in your possession before the
  37. expiration of the Trial Period.
  38.  
  39. You agree to destroy all copies of the Software in your possession
  40. upon termination of the agreement. No damages, including recovery
  41. of the license fee if it has been paid, are recoverable by you upon
  42. such termination.
  43.  
  44. No warranty is offered, whether express or implied, by the Author in
  45. relation to the downloading, installation or use of the Software. The
  46. Author disclaims all liability for damages arising from the use or
  47. misuse of the Software.
  48.  
  49. This Agreement is governed under the laws in force in France.
