  4. Installer 43.3 and Installer project icon (hereinafter "Files") and
  5. their related documentation, utilities, and examples
  6. (c) Copyright 1995-96 Escom AG.  All Rights Reserved

  8. These Files and their related documentation, utilities, and examples
  9. are provided "AS-IS" and subject to change without notice; no warranties
  10. are made.  All use is at your own risk.  No liability or responsibility
  11. is assumed.

  13. A. DISTRIBUTION OF UNMODIFIED INSTALLER DEVELOPER ARCHIVE
  14.  
  15. The complete and unmodified Installer developer archive, as provided
  16. by Escom or AMIGA Technologies, may be freely redistributed via any
  17. means which preserves its copyrights.  The archive may not be sold for
  18. profit.

  21. B. DISTRIBUTION OF INSTALLER
  22.  
  23. Specific Files from the archive may be reproduced and distributed
  24. separately under license subject to agreement with the following terms
  25. and conditions (wherein the reference to Files shall mean Installer and
  26. the Installer project icon, either individually or collectively):
  27.  
  28. 1.   The Files may be reproduced but may not be modified in any way.
  29.  
  30. 2.   The Files may only be distributed as an integral part of a software
  31.      product solely for AMIGA computers.
  32.  
  33. 3.   The related documentation, utilities, and examples provided by
  34.      Escom or AMIGA Technologies may not be reproduced or distributed,
  35.      in whole or in part, except as part of a complete and unmodified
  36.      archive as provided by Escom or AMIGA Technologies.
  37.  
  38. 4.   Licensee shall hold Escom and AMIGA Technologies harmless from any
  39.      and all claims, damages and liabilities resulting from or arising
  40.      out of its use or distribution of the Files.

  42. 5.   All copies of Licensee's software product containing the Files and
  43.      of Licensee's product documentation related thereto (either paper
  44.      or electronic) must include the following copyright notice:

  48.      Reproduced and distributed under license from Escom AG.

  50. 6.   Licensee's product documentation (either paper or electronic) must also
  51.      include a disclaimer substantially similar to the following:

  53.      INSTALLER SOFTWARE IS PROVIDED "AS-IS" AND SUBJECT TO CHANGE;
  54.      NO WARRANTIES ARE MADE.  ALL USE IS AT YOUR OWN RISK.  NO LIABILITY
  55.      OR RESPONSIBILITY IS ASSUMED.

  57. 7.   Licensee may only distribute the versions of the Files that have
  58.      been approved by Escom or AMIGA Technologies for electronic licensing
  59.      as evidenced by AMIGA Technologies's inclusion of the Files in an
  60.      official AMIGA Technologies archive or diskette containing the Files,
  61.      the related documentation, utilities, and examples, and this Electronic
  62.      License Agreement. Ongoing distributions must include only the most
  63.      recently approved releases of the Files which AMIGA Technologies has
  64.      designated for electronic licensing and distribution.

  66. 8.   The Files may not be installed on a user's system or Workbench
  67.      unless the installation procedure included with Licensee's product has
  68.      determined that the user's system or Workbench does not contain a more
  69.      recent version of the Files.

  71. 9.   Such technical information as is contained in the Files (and any
  72.      product thereof) or in the related documentation, utilities, and
  73.      examples may not be exported in contravention of the laws and
  74.      regulations of the Federal Republic of Germany.

  76. 10.  Prior to any distribution of the Files, Licensee must acknowledge and
  77.      consent to these terms by forwarding a completed and signed copy of
  78.      this entire Agreement, on paper, to:

  81. 11.  Escom or AMIGA Technologies may terminate this license at any time,
  82.      with or without cause. This license and Licensee's rights hereunder
  83.      will automatically terminate upon any breach of these terms and
  84.      conditions. Upon any such termination, Licensee shall destroy all
  85.      copies of the Files and the related documentation, utilities, and
  86.      examples in its possession.
