  3. AND LIMITED WARRANTY
  4.  
  5. IMPORTANT - READ CAREFULLY
  6. This License Statement and Limited Warranty constitutes a legal agreement
  7. ("License Agreement") between you (either as an individual or a single
  8. entity) and InterBase Software Corporation ("InterBase") for the software
  9. product ("Software") identified above, including any software, media, and
  10. accompanying on-line or printed documentation.
  11.  
  12. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE
  13. BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.  If you
  14. are the original purchaser of the Software and you do not agree with the
  15. terms and conditions of the License Agreement, promptly return the unused
  16. Software to the place from which you obtained it for a full refund.
  17.  
  18. Upon your acceptance of the terms and conditions of the License Agreement,
  19. InterBase grants you the right to use the Software in the manner provided
  20. below.
  21.  
  22. This Software is owned by InterBase or its suppliers and is protected by
  23. copyright law and international copyright treaty.  Therefore, you must 
  24. treat this Software like any other copyrighted material (e.g., a book), 
  25. except that you may either make one copy of the Software solely for backup 
  26. or archival purposes or transfer the Software to a single hard disk 
  27. provided you keep the original solely for backup or archival purposes.  
  28.  
  29. Except as provided in this License Agreement, you may not transfer, rent, 
  30. lease, lend, copy, modify, translate, sublicense, time-share or
  31. electronically transmit or receive the Software, media or documentation.
  32. You acknowledge that the Software in source code form remains a confidential
  33. trade secret of InterBase or its suppliers and therefore you agree not to
  34. modify the Software or attempt to decipher, decompile, disassemble or
  35. reverse engineer the Software, except to the extent applicable laws
  36. specifically prohibit such restriction.

  38. If you purchased this Software as an upgrade, it constitutes a single product
  39. together with the product that you upgraded, and may not be used to increase
  40. the total number of licensed copies of the Software.  You may use the
  41. upgraded product only in accordance with this License Agreement and you may
  42. not transfer this Software or the product you upgraded unless they are
  43. transferred together as a single product. 
  44.  
  45. This Software is subject to U.S. Commerce Department export restrictions, 
  46. and is intended for use in the country into which InterBase sold it (or is 
  47. intended for use in the EEC, if sold into the EEC).

  50. GENERAL TERMS WHICH APPLY TO THE INTERBASE MEDIA KIT
  51. The Software includes a number of components, including, (a) the INTERBASE 
  52. SERVER SOFTWARE ("Server Software"), (b) the INTERBASE CLIENT SOFTWARE 
  53. ("Client Software"), (c) the INTERBASE PRECOMPILER SOFTWARE ("Precompiler 
  54. Software"), and (d) the LOCAL INTERBASE SOFTWARE ("Local InterBase").  
  55. In order to install and use these components, you must purchase additional 
  56. licenses from InterBase.  The Software also includes the INTERCLIENT / 
  57. INTERSERVER JDBC DRIVER ("InterClient Software") which is subject to 
  58. this License Agreement.  You may also purchase additional Internet Access 
  59. Licenses to use the Software through the Internet.

  62. ADDITIONAL TERMS WHICH APPLY TO LOCAL INTERBASE
  63. You may use the Local InterBase Software only if you have purchased a 
  64. Local InterBase Activation License from InterBase.  The Local InterBase 
  65. Activation License allows you to install a single copy of the Local 
  66. InterBase Software on a single computer for your internal data 
  67. processing needs and to access this copy of the Local InterBase Software
  68. by logging into the same computer on which it is installed. The Local
  69. InterBase Software may also be used as Client Software to connect with
  70. Server Software located on a computer other than the computer on which
  71. the Local InterBase Software is installed.

  74. ADDITIONAL TERMS WHICH APPLY TO THE SERVER SOFTWARE
  75. You may use the Server Software only if you have purchased a Server 
  76. Activation License from InterBase.  The Server Activation License 
  77. allows you to use the Server Software on a single computer network for 
  78. supporting your internal data processing needs.  You may install the Server 
  79. Software on the hard disk of a single computer for each Server Activation 
  80. License you purchase.  In order to connect your users to the Server
  81. Software you must purchase as many Simultaneous User Licenses as you have 
  82. simultaneous users on that Server.

  85. ADDITIONAL TERMS WHICH APPLY TO THE CLIENT SOFTWARE
  86. You may use the Client Software only if you have purchased at least one 
  87. Simultaneous User License from InterBase.  You may install the Client 
  88. Software on as many computers as you wish.  Each Simultaneous User 
  89. License allows you to use the Client Software to connect a single user
  90. to the Server Software. You may use the Client Software to connect as many 
  91. simultaneous users to the Server Software as you have Simultaneous User 
  92. Licenses for that Server. 
  93.  
  94. All users accessing the InterBase Server in any manner other than as
  95. members of the general public through an unrestricted-access Internet
  96. application, must be licensed as Simultaneous Users.
  97.  
  98. You must provide safeguards to ensure that the number of such
  99. simultaneous users does not exceed the total number of Simultaneous 
  100. User Licenses.  If the number of simultaneous users exceeds the number of 
  101. Simultaneous User Licenses, you must purchase additional licenses from 
  102. InterBase.
  103.  
  104. If you use multiplexing software or hardware to reduce the number of 
  105. users directly connected to the Server Software, the number of simultaneous 
  106. users must be measured as the number of distinct inputs to the multiplexing
  107. front-end.  
  108.  
  109. If any of your users connect to the Server Software via an
  110. unrestricted-access Internet application you must purchase an Internet Access
  111. License from InterBase. For terms governing public access to an InterBase
  112. database from the Internet, see the section in this document entitled
  113. Additional Terms Which Apply To Internet Access To The Server Software.
  114.  
  115. Regardless of system configuration, no user may make more than four 
  116. simultaneous connections to the Server Software.  If any user requires 
  117. more than four simultaneous connections to the Server Software you may 
  118. obtain the right to make an additional four connections for each 
  119. additional Simultaneous User License you purchase from InterBase.
  120.  
  121. Each Simultaneous User License also contains a version number.  Each 
  122. Simultaneous User License allows you to connect Client Software to the 
  123. Server Software only if the Simultaneous User License has a major 
  124. version number which is the same as the major version number of the Server 
  125. Software (the major version number is the integer to the left of the 
  126. leftmost decimal point).

  129. ADDITIONAL TERMS WHICH APPLY TO INTERNET ACCESS
  130. TO THE SERVER SOFTWARE
  131.  
  132. If you allow unrestricted access for users to connect to the InterBase
  133. Server Software through an Internet application as members of the 
  134. general public, you must purchase (a) an Internet Access License for
  135. Licensed Users, or (b) an Internet Access License for Unlimited Users.
  136. If you implement any mechanism to restrict access to the InterBase Internet
  137. application to specific users or categories of users so that it is not
  138. available to any member of the general public, access is not considered
  139. unrestricted.
  140.  
  141.      (a)  The Internet Access License for Licensed Users allows you to
  142. connect a limited number of general public users to the InterBase 
  143. Server software through the Internet.  It allows you to use your existing
  144. Simultaneous User Licenses to connect a single general public user to 
  145. the Server Software for each Simultaneous User License you have. It does 
  146. not, however, increase the total number of simultaneous users who may access
  147. the Server Software. The total number of simultaneous users from all sources
  148. may not exceed the number of Simultaneous User Licenses you have purchased. 
  149.  
  150.      (b)  The Internet Access License for Unlimited Users allows you to
  151. connect an unlimited number of general public users to the InterBase
  152. Server software through the Internet.  
  153.  
  154. Both Internet Access Licenses described in (a) and (b) above are
  155. available only if access to the InterBase Internet application is 
  156. unrestricted. If you require a password or any other method to restrict such
  157. access to the Server Software, then you must purchase Simultaneous User
  158. Licenses for each simultaneous user that is granted access to the Server
  159. Software.  For example, users who access the Server Software through a LAN,
  160. WAN or Client/Server system must be licensed as simultaneous users.  Users
  161. who access the Server Software through a web site that employs a password
  162. or other restriction, for example an Intranet or Extranet, must be licensed
  163. as simultaneous users.  
  164.  
  165. In all cases, you must provide safeguards to ensure that the number of
  166. actual simultaneous users, except as provided in (b) above, does not 
  167. exceed the total number of Simultaneous User Licenses you have purchased.

  169.  
  170. ADDITIONAL TERMS WHICH APPLY TO PROGRAMS COMPILED WITH THE SOFTWARE 
  171. You may write and compile your own applications using the Software, 
  172. including the InterClient Software and any libraries and source code 
  173. included with the Software for such purpose, so long as (a) your 
  174. application is a product which operates in conjunction with the 
  175. Software, (b) you do not use InterBase's name, logo or trademark to market
  176. your software product, (c) you include InterBase's copyright notice as part 
  177. of the sign-on message for your software product, (d) you agree to 
  178. indemnify, hold harmless, and defend InterBase and its suppliers from and
  179. against any claims or lawsuits, including attorney's fees, that arise out
  180. of your use or distribution of your application software product, and
  181. (e) your program is not merely a set or subset of the Software or any
  182. libraries or source code included with the Software.  In addition, in order
  183. to use the Precompiler Software to build your applications, you must
  184. purchase a Precompiler License from InterBase.

  187. ADDITIONAL TERMS WHICH APPLY TO THE EVALUATION PERIOD
  188. If you have obtained permission from InterBase to evaluate the 
  189. Software, you may install the Software on a temporary basis for evaluation 
  190. purposes only.  The evaluation period is limited to 60 days from the date
  191. the Software is installed ("Evaluation Period").  Upon completion of the 
  192. Evaluation Period your license to use the Software expires.
  193.  
  194. During the Evaluation Period, you may install the Server Software on a 
  195. single (1) computer network on a temporary basis for evaluation purposes
  196. only. During the Evaluation Period, you may use the Client Software to 
  197. connect up to five (5) simultaneous users to the Server Software on a
  198. temporary basis for evaluation purposes only.  
  199.  
  200. During the Evaluation Period, you can write and compile applications 
  201. which use the Software for your own personal, non-commercial use on the 
  202. computers on which you have installed the Software, but you do not have 
  203. a right to distribute or otherwise share those applications or any of the 
  204. files of the Software which may be required to support those 
  205. applications.
  206.  
  207. THE SOFTWARE CONTAINS A TIME-OUT FEATURE THAT DISABLES ITS OPERATION
  208. AFTER THE EXPIRATION OF THE EVALUATION PERIOD.  APPLICATIONS THAT YOU 
  209. CREATE DURING THE EVALUATION PERIOD MAY REQUIRE THE SOFTWARE IN ORDER TO
  210. RUN. UPON EXPIRATION OF THE EVALUATION PERIOD, THOSE APPLICATIONS WILL NO 
  211. LONGER RUN.  YOU SHOULD THEREFORE TAKE PRECAUTIONS TO AVOID ANY LOSS OF 
  212. DATA THAT MIGHT RESULT.
  213.  
  214. DURING THE EVALUATION PERIOD, THE SOFTWARE IS PROVIDED ON AN "AS IS" 
  215. BASIS "WITH ALL FAULTS."  YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY
  216. AND PERFORMANCE OF THE SOFTWARE DURING THE EVALUATION PERIOD.  SHOULD THE 
  217. SOFTWARE PROVE DEFECTIVE DURING THE EVALUATION PERIOD, YOU, AND NOT 
  218. INTERBASE OR ITS SUPPLIERS, ASSUME THE ENTIRE COST OF ALL NECESSARY 
  219. SERVICING AND REPAIR. 
  220.  
  221. In order to use the Software after the Evaluation Period, you must 
  222. purchase a Server License and as many Simultaneous User Licenses as you 
  223. have simultaneous users.  If you do not purchase additional licenses 
  224. from InterBase, you agree to destroy or permanently delete the Software
  225. from your computer upon expiration of the Evaluation Period, and not to
  226. re-install a new copy of the Software.

  229. LIMITED WARRANTY
  230. InterBase warrants that the Software, as updated and when properly 
  231. used, will perform substantially in accordance with its accompanying 
  232. documentation, and the Software media will be free from defects in 
  233. materials and workmanship, for a period of ninety (90) days from the 
  234. date of receipt.  Any implied warranties on the Software are limited to 
  235. ninety (90) days.  Some states or jurisdictions do not allow limitations on 
  236. duration of an implied warranty, so the above limitation may not apply 
  237. to you.

  239. InterBase's and its suppliers' entire liability and your exclusive 
  240. remedy shall be, at InterBase's option, either (a) return of the price paid, 
  241. or (b) repair or replacement of the Software that does not meet the 
  242. Limited Warranty and which is returned to InterBase with a copy of your 
  243. receipt. DO NOT RETURN ANY PRODUCT UNTIL YOU HAVE CALLED THE INTERBASE
  244. CUSTOMER SERVICE DEPARTMENT AND OBTAINED A RETURN AUTHORIZATION NUMBER.  This 
  245. Limited Warranty is void if Software fails as a result of accident, abuse, 
  246. or misapplication.  Any replacement Software will be warranted for the 
  247. remainder of the original warranty period or thirty (30) days, whichever is
  248. longer.  Outside the United States, neither these remedies nor any product
  249. support services offered by InterBase are available without proof of
  250. purchase from an authorized non-U.S. source.
  251.  
  252. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTERBASE AND ITS 
  253. SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, 
  254. INCLUDING, BUT NOT LIMITED TO,  ANY IMPLIED WARRANTIES OF 
  255. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR TITLE,
  256. WITH REGARD TO THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION.  THIS LIMITED 
  257. WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHERS, WHICH VARY FROM 
  258. STATE TO STATE OR JURISDICTION TO JURISDICTION.

  260. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 
  261. INTERBASE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER 
  262. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  263. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER 
  264. PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS 
  265. INTERBASE PRODUCT, EVEN IF INTERBASE HAS BEEN ADVISED OF THE 
  266. POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, INTERBASE'S ENTIRE LIABILITY UNDER
  267. ANY PROVISION OF THIS LICENSE AGREEMENT SHALL BE LIMITED TO THE GREATER OF 
  268. THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT OR US$25. 
  269. Notwithstanding the above, if you have entered into a support agreement 
  270. with InterBase, InterBase's entire liability regarding support services 
  271. shall be governed by the terms of that agreement.  Because some states 
  272. and jurisdictions do not allow the exclusion or limitation of liability, 
  273. the above limitations may not apply to you.

  276. HIGH RISK ACTIVITIES
  277. The Software is not fault-tolerant and is not designed, manufactured or 
  278. intended for use or resale as on-line control equipment in hazardous 
  279. environments requiring fail-safe performance, such as in the operation 
  280. of nuclear facilities, aircraft navigation or communication systems, air 
  281. traffic control, direct life support machines, or weapons systems, in 
  282. which the failure of the Software could lead directly to death, 
  283. personal injury, or severe physical or environmental damage ("High Risk 
  284. Activities"). InterBase and its suppliers specifically disclaim any 
  285. express or implied warranty of fitness for High Risk Activities.

  288. RESTRICTED RIGHTS LEGEND
  289. If the Software is acquired for or on behalf of the United States of 
  290. America, its agencies and/or instrumentalities ("U.S. Government"), it 
  291. is provided with Restricted Rights. Use, duplication, or disclosure by the 
  292. U.S. Government is subject to restrictions as set forth in subparagraph 
  293. (c)(1)(ii) of the Rights in Technical Data and Computer Software clause 
  294. at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial 
  295. Computer Software - Restricted Rights at 48 CFR 52.227-19, as 
  296. applicable. Manufacturer is InterBase Software Corporation, 1800 Green Hills

  300. GENERAL PROVISIONS
  301. This License Agreement may only be modified in writing signed by you 
  302. and an authorized officer of InterBase.  If any provision of this License 
  303. Agreement is found void or unenforceable, the remainder will remain 
  304. valid and enforceable according to its terms.  If any remedy provided is 
  305. determined to have failed for its essential purpose, all limitations of 
  306. liability and exclusions of damages set forth in the Limited Warranty 
  307. shall remain in effect.
  308.  
  309. This License Agreement shall be construed, interpreted and governed by 
  310. the laws of the State of California, U.S.A.  This License Agreement gives 
  311. you specific legal rights; you may have others which vary from state to 
  312. state and from country to country.  InterBase reserves all rights not 
  313. specifically granted in this License Agreement.
