  2.     License Agreement 
  3.         JGL - The Generic Collection Library for Java(tm)
  4.             Release Version 3.1
  5.  
  6.  
  7. WHEREAS, ObjectSpace, Inc. is the owner of valuable intellectual 
  8. property rights relating to the Generic Library Release for Java(tm) 
  9. Version 3.1 ("JGL") and wishes to license JGL subject to the terms 
  10. and conditions set forth below; and 
  11.  
  12. WHEREAS, you ("Licensee") acknowledge that ObjectSpace, Inc. has the right 
  13. to grant licenses to the intellectual property rights relating to JGL, and 
  14. that you desire to obtain a license to use JGL subject to the terms and 
  15. conditions set forth below; 
  16.  
  17. ObjectSpace, Inc. grants Licensee a non-exclusive, non-transferable, 
  18. royalty-free license to use JGL and related materials without charge 
  19. provided the Licensee adheres to all of the terms and conditions of 
  20. this Agreement. 
  21.  
  22. By downloading, using, or copying JGL or any portion thereof, Licensee 
  23. agrees to abide by the intellectual property laws and all other applicable 
  24. laws of the United States of America, and to all of the terms and 
  25. conditions of this Agreement, and agrees to take all necessary steps to 
  26. ensure that the terms and conditions of this Agreement are not violated 
  27. by any person or entity under the Licensee's control or in the Licensee's 
  28. service. 
  29.  
  30. Licensee shall maintain the copyright and trademark notices on the 
  31. materials within or otherwise related to JGL, and not alter, erase, 
  32. deface or overprint any such notice. 
  33.  
  34. Except as specifically provided in this Agreement, Licensee is expressly 
  35. prohibited from copying, modifying, merging, selling, leasing, assigning,
  36. or transferring in any manner, JGL or any portion thereof. 
  37.  
  38. Licensee may copy materials within or otherwise related to JGL that bear 
  39. the ObjectSpace copyright only as required for backup purposes or for use 
  40. solely by the Licensee. 
  41.  
  42. Licensee may not distribute in any form of electronic or printed 
  43. communication the materials within or otherwise related to JGL that 
  44. bear the ObjectSpace copyright, including but not limited to the 
  45. source code, documentation, help files, examples, and benchmarks, 
  46. without prior written consent from ObjectSpace, Inc. Send any requests 
  47. for limited distribution rights to jgl@objectspace.com. 
  48.  
  49. The Licensee may distribute binaries (.class files) derived from or 
  50. contained within JGL ("Binaries") provided that: 
  51.  
  52. 1) The Binaries are not integrated, bundled, combined, or otherwise 
  53.    associated with a Java development environment or Java development 
  54.    tool; and 
  55. 2) The Binaries are not a documented part of any distribution material. 
  56.  
  57. OBJECTSPACE, INC. DISCLAIMS AND MAKES NO REPRESENTATIONS OR WARRANTIES 
  58. ABOUT THE SUITABILITY OF JGL, EITHER EXPRESSED OR IMPLIED, INCLUDING 
  59. BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS 
  60. FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. OBJECTSPACE, INC. SHALL 
  61. NOT BE LIABLE FOR ANY DIRECT OR CONSEQUENTIAL DAMAGES SUFFERED BY 
  62. LICENSEE AS A RESULT OF USING, MODIFYING, OR DISTRIBUTING JGL OR 
  63. ITS DERIVATIVES. 
  64.  
  65. This agreement shall be construed and enforced in accordance with the 
  66. laws of the United States of America and the State of Texas (excluding 
  67. its choice of law rules).
