  9. You should carefully read the following terms and conditions before using this 
  10. software. Your use of this software indicates your acceptance of this license 
  11. agreement and warranty.

  14. Evaluation and Registration
  15.  
  16. This is commercial software. You are hereby licensed to use a demo version of 
  17. this software for evaluation purposes without charge for a period of 30 days. 
  18. If you use this software after the 30 day evaluation period a registration fee 
  19. of $29 is required. Payments must be in US dollars drawn on a US bank, and 
  20. should be sent to Bravo Zulu Consulting, Inc., P. O. Box 462136, Escondido, CA 
  21. 92046-2136.

  23. Credit card ordering and site license discounts are available, as described in 
  24. the section Ordering Information/Order Form. The latest version of JToExe will 
  25. be sent when payment is received.

  27. Unregistered use of JToExe after the 30 day evaluation period is in violation 
  28. of U.S. and international copyright laws.

  31. Distribution
  32.  
  33. The demo version of JToExe may be distributed freely as long as no changes or 
  34. modifications are made to the documentation, application or installation 
  35. application.

  37. Distribution of the commercial version is strictly prohibited, except by 
  38. authorized resellers.
  39.  
  40. You are specifically prohibited from charging, or requesting donations, for 
  41. any such copies, however made; and from distributing the software and/or 
  42. documentation with other products (commercial or otherwise) without prior 
  43. written permission.

  45. Registered Version
  46.  
  47. Duplication of the registered version of JToExe is limited to copies for 
  48. backup purposes. The application may be sold but transfer of the registration, 
  49. manuals and disks must accompany the sale.

  51. One registered copy of JToExe may either be used by a single person who uses 
  52. the software personally on one or more computers, or installed on a single 
  53. workstation used nonsimultaneously by multiple people, but not both.
  54.  
  55. You may access the registered version of JToExe through a network, provided 
  56. that you have obtained individual licenses for the software covering all 
  57. workstations that will access the software through the network. For instance, 
  58. if two different workstations access JToExe on the network, each workstation 
  59. must have its own JToExe license, regardless of whether they use JToExe at 
  60. different times or concurrently. A more reasonable coverage is to purchase the 
  61. site license.

  64. Governing Law

  66. This agreement shall be governed by the laws of the State of California.

  69. Disclaimer of Warranty

  71. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT 
  72. WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES 
  73. WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software 
  74. environments into which JToExe may be put, NO WARRANTY OF FITNESS FOR A 
  75. PARTICULAR PURPOSE IS OFFERED.

  77. Good data processing procedure dictates that any program be thoroughly tested 
  78. with non-critical data before relying on it. In addition, applications should 
  79. be backed up before using JToExe. The user must assume the entire risk of 
  80. using the program.

  82. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT 
  83. OR REFUND OF PURCHASE PRICE.
