  1.   Sony Corporation Alpha License Agreement

  3. 1.  Sony Corporation ("Sony") grants to you a non-exclusive,
  4. non-sublicensable, license to use this version of
  5. Community Place Browser 2.0 Alpha 2
  6. (the "Software"), in binary executable form for 
  7. evaluation and trial use purposes only.  THIS SOFTWARE 
  8. CONTAINS CODE THAT DISABLES MOST OF ITS FEATURES WHEN 90
  9. DAYS PASS AFTER INSTALLATION. 
  10.  
  11. 2.  SONY MAKES NO REPRESENTATIONS ABOUT THE 
  12. SUITABILITY OF THIS SOFTWARE OR ABOUT ANY CONTENT OR 
  13. INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY 
  14. PURPOSE.  THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT 
  15. EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF 
  16. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR 
  17. NONINFRINGEMENT.  THIS SOFTWARE IS PROVIDED 
  18. GRATUITOUSLY AND, ACCORDINGLY, SONY SHALL NOT BE 
  19. LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY YOU 
  20. OR ANY USER OF THE SOFTWARE.  SONY WILL NOT SUPPORT 
  21. THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO THIS
  22. SOFTWARE.

  24. 3.  All content accessed through the Software is the 
  25. property of the applicable content owner and may be 
  26. protected by applicable copyright law.  This License 
  27. gives you no rights to such content.

  29. 4.  While Sony intends to distribute a commercial 
  30. release of the Software, Sony reserves the right at 
  31. any time not to release a commercial release of the 
  32. Software or, if released, to alter prices, features, 
  33. specifications, capabilities, functions, licensing 
  34. terms, release dates, general availability or other 
  35. characteristics of the commercial release.

  37. 5.  Title, ownership rights, and intellectual property 
  38. rights in and to the Software shall remain in Sony and/or
  39. its suppliers. You agree to abide by the 
  40. copyright law and all other applicable laws of the 
  41. Japan including, but not limited to, the foreign exchange
  42. and foreign trade cotrol law.  You acknowledge that the 
  43. Software in source code form remains a confidential trade
  44.  secret of Sony and/or its suppliers and therefore you agree 
  45. not to modify the Software or attempt to decipher, 
  46. decompile, disassemble or reverse engineer the 
  47. Software, except to the extent applicable laws 
  48. specifically prohibit such restriction.

  50. 6.  Sony may terminate this License at any time by 
  51. delivering notice to you and you may terminate this 
  52. License at any time by destroying or erasing your copy 
  53. of the Software.  Upon termination of this License, or 
  54. in any event within thirty (30) days following 
  55. Sony's release of a commercial version of the 
  56. Software, you agree to destroy or erase the Software.  
  57. In the event of termination, the following sections of 
  58. this License will survive: 2, 3, 4, 5, 6, 7 and 8.  
  59. This License is personal to you and you agree not to 
  60. assign your rights herein.  This License shall be 
  61. governed by and construed in accordance with the laws 
  62. of Japan, as to matters affecting 
  63. copyrights, trademarks and patents.
  64. This License sets forth the entire agreement 
  65. between you and Sony.

  67. 7.  You may not download or otherwise export or 
  68. reexport the Software or any underlying information or 
  69. technology except in full compliance with applicable
  70. laws and regulations of Japan. 
  71.  
  72. 8.  SONY OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR 
  73. (a) INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT 
  74. DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT 
  75. OR OTHERWISE, EVEN IF SONY HAS BEEN INFORMED OF THE 
  76. POSSIBILITY OF SUCH DAMAGES, OR (b) FOR ANY CLAIM BY 
  77. ANY OTHER PARTY.  THIS LIMITATION OF LIABILITY SHALL 
  78. NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO 
  79. THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.
