  1.                 LICENSE AGREEMENT
  2.  
  3. This is an agreement between _______________________________________,
  4. hereafter Licensee, and Ralf Brown, hereafter Author, regarding a
  5. nonexclusive license to use the source code to the product known as
  6. SPAWNO.  Unless otherwise noted, the term "Source Code" shall refer to
  7. those portions of the complete source code which are not included in
  8. the public distribution of SPAWNO; all files which fall into this
  9. category are marked with the Licensee's name and a unique serial number.
  10.  
  11. The Licensee agrees to abide by the following terms and conditions
  12. upon the use of the Source Code:
  13.  
  14.    1. The Source Code is licensed to the Licensee and neither the
  15.       Source Code nor any derivatives may be redistributed or
  16.       transferred without prior written permission.  The sole
  17.       exception shall be distribution to multiple programmers
  18.       actively working on the development of a single product.
  19.  
  20.    2. Object code created from the Source Code or derivatives of the
  21.       Source Code may be incorporated into the Licensee's own works
  22.       and distributed provided that
  23.         a) the copyright notice embedded in the object code is
  24.            not altered or removed; the addition of the Licensee's
  25.            own copyright notice is permissible.
  26.         b) such inclusion is acknowledged in the documentation; a
  27.            statement of the form
  28.            "This program uses a customized version of Ralf
  29.             Brown's SPAWNO routines to minimize memory use
  30.             while running other programs or shelling to DOS."
  31.            is sufficient.

  33.    3. Object code created from the Source Code, or any derivatives
  34.       thereof, which is not incorporated into the Licensee's own
  35.       works may be distributed provided that
  36.         a) the copyright notice embedded in the object code is
  37.            not altered or removed; the addition of the Licensee's
  38.            own copyright notice is permissible.
  39.         b) the complete original publicly-available version of
  40.            SPAWNO is included in said distribution.

  42.    4. The Licensee acknowledges that the Source Code (both public
  43.       and licensed portions) is provided AS IS with no warrantees,
  44.       express or implied, including (but not limited to) correctness,
  45.       merchantability, or fitness for use.  The Author disclaims all
  46.       liability for damages, both consequential and incidental,
  47.       resulting from the use or misuse of the SPAWNO package.  Sole
  48.       responsibility for determining the fitness of SPAWNO for a
  49.       particular application rests with the Licensee.
