  3. Your first use of Barking Spider Software, Inc. Tree/List Control software 
  4. constitutes your agreement to the following provisions:

  6. What is the Barking Spider Software, Inc. Tree/List Control?
  7. The Barking Spider Software, Inc. Tree/List Control ("the Software") is a
  8. Windows DLL licensed by Barking Spider Software, Inc. ("BSS").  The Software
  9. is two controls.  The first provides management and graphic display of data
  10. in a tree format.  The second provides management and graphic display of data
  11. in a list format.  The Software is designed to operate on IBM PC and
  12. compatible computers under the Windows 3.1 operating environment.
  13.  
  14. Demonstration license.
  15. You are free to distribute the entire unmodified contents of the demonstration 
  16. package to anyone you wish. You may NOT distribute any other programs that 
  17. utilizes the Software without obtaining a Registered User License for the 
  18. Software from BSS. For a period of no more than 14 days, you may use, test 
  19. and duplicate the enclosed version of the Software for evaluation purposes 
  20. only  Thereafter if you wish to continue using the Software you must register 
  21. the Software with BSS, or else you must cease all use of the Software.  You 
  22. will be an infringer if you do not pay the registration fee and continue to 
  23. use this version of the Software for more than 14 days.

  25. Registered User License.
  26. If you pay the registration fee for the Software to BSS , BSS will grant a 
  27. non-exclusive license for one natural person to use one copy of the software 
  28. regardless if the owner of the license is a person or a business
  29. ("the Licensee"). In addition the Licensee may distribute the Barking Spider 
  30. Tree/List Control DLL ("the DLL") with one product that uses the DLL for each 
  31. License owned, with the exceptions that (a) the recipients of any such 
  32. program ("the Recipients") are not licensed to use the DLL or the Software 
  33. except with the products produced by Licensees, and (b) the Recipients may 
  34. not further redistribute the DLL, and (c) the product using the DLL cannot 
  35. enable the user to produce other programs using the DLL or other parts of 
  36. the supplied distribution package, and (d) the product using the DLL must 
  37. contain a notice stating BSS's copyright of the DLL. No purported transfer 
  38. of the license shall be effective until the licensee notifies BSS of the 
  39. name and address of the person receiving the license ("the Transferee"), and 
  40. transfers all copies of the Software to the Transferee, and removes or 
  41. destroys any other copies of the Software in the possession of, or under the 
  42. control of the Licensee.

  44. Limited Warranty.
  45. The Software is distributed and licensed under an "as is" basis. For a period 
  46. of 90 days from the date that you pay the registration fee, you may return 
  47. all materials provided by BSS, destroy any copies you have made and then you 
  48. will receive a refund of your registration fee minus a restocking charge, 
  49. provided that the returned materials are undamaged.  If the materials are 
  50. damaged your refund will be deducted for the replacement costs of the damaged 
  51. materials.

  53. Disclaimer of Warranties.
  54. BSS makes no claims as to the suitability of the software for any specific 
  55. purpose. EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, BSS DISCLAIMS ANY AND 
  56. ALL OTHER WARRANTIES EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY 
  57. WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR ANY SPECIFIC PURPOSE. The 
  58. Limited Warranty stated above gives you specific legal rights, but you may 
  59. have other rights which may vary from state to state.

  61. Limitation of Liability.
  62. In no event shall BSS be liable for any damages whatsoever arising out of 
  63. the use of the Software, including without limitation any direct, indirect 
  64. or consequential damages or any damages for business interruption, loss of 
  65. profits, loss of information, or any pecuniary  loss even if BSS has been 
  66. notified of the possibility of such damages. The limitation or exclusion 
  67. of liability for incidental or consequential damages may not be allowed in 
  68. some states, and in these states those particular prohibited limitations do 
  69. not apply.

  71. Limitation of Remedies.
  72. Should you have problems with the Software, BSS's entire liability and your 
  73. exclusive remedy shall be, at BSS's discretion, either (a) to repair or 
  74. replace the Software, or (b) to terminate the License and send you a refund 
  75. of your registration fee minus a restocking charge, provided that all 
  76. materials are returned undamaged. If the materials are damaged your refund 
  77. will be deducted for the replacement costs of the damaged materials.

  80. Copyright Information

  82. The Software is protected by the copyright laws of the United States, and 
  83. by the copyright laws of many other countries pursuant to international 
  84. treaties. The Barking Spider Software, Inc. Tree/List Control DLL and all
  85. other materials provided in the Tree/List Control distribution package are
  86. Copyright (c) 1993 Barking Spider Software, Inc.  All Rights reserved.  No
  87. portion of the Software, documentation or examples may be copied, stored, or
  88. transmitted except as provided by the license.
