  5.           END-USER LICENSE AGREEMENT FOR SOFTWARE
  6.                 Important - read carefully:

  8. This End-User License Agreement ("EULA") is a legal agreement
  9. between you (either an individual or a single entity) and Kinook
  10. Software, Inc. for the software product identified above, which 
  11. includes computer software and may include associated media, 
  12. printed materials, and "online" or electronic documentation 
  13. ("SOFTWARE PRODUCT").  By installing, copying, or otherwise 
  14. using the SOFTWARE PRODUCT, you agree to be bound by the terms 
  15. of this EULA. If you do not agree to the terms of this EULA, 
  16. do not install or use the SOFTWARE PRODUCT.

  18. SOFTWARE PRODUCT LICENSE
  19. The SOFTWARE PRODUCT is protected by copyright laws and international
  20. copyright treaties, as well as other intellectual property laws and
  21. treaties. The SOFTWARE PRODUCT is licensed, not sold.

  23. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  24. Software.
  25. You may install and use one copy of the SOFTWARE PRODUCT on a single 
  26. computer, including a workstation, terminal or other digital 
  27. electronic device ("COMPUTER"). If multiple licenses have been 
  28. purchased, the computer software portion of the SOFTWARE PRODUCT may
  29. be installed and used by the the same number of people as licenses
  30. purchased. If a Site License has been purchased, an unlimited
  31. number of people at a single physical location may install and use
  32. the SOFTWARE PRODUCT.

  34. Storage/Network Use.
  35. You may also store or install a copy of the computer software portion 
  36. of the SOFTWARE PRODUCT on the COMPUTER to allow your other computers 
  37. to use the SOFTWARE PRODUCT over an internal network, and distribute 
  38. the SOFTWARE PRODUCT to your other computers over an internal network.  
  39. However, you must acquire a license for the SOFTWARE PRODUCT for each 
  40. computer on which the SOFTWARE PRODUCT is used or to which it is 
  41. distributed.  A license for the SOFTWARE PRODUCT may not be shared or 
  42. used concurrently on different computers.
  43.  
  44. Backup Copy.
  45. You may make a single backup copy of the SOFTWARE PRODUCT.  You may 
  46. use the backup copy solely for archival purposes.
  47.  
  48. Evaluation Use.
  49. You may use the evaluation version of the SOFTWARE PRODUCT for the 
  50. for evaluation purposes without charge for a period of 30 days.  
  51. If you use this software after the 30-day evaluation period, a 
  52. license for the non-evaluation version must be purchased.  When 
  53. payment is received you will be sent a registration code to enable
  54. the full functionality of the SOFTWARE PRODUCT.

  56. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  57. Limitations on Reverse Engineering, Decompilation, and Disassembly.
  58. You may not reverse engineer, decompile, or disassemble the SOFTWARE
  59. PRODUCT, except and only to the extent that such activity is expressly
  60. permitted by applicable law notwithstanding this limitation.

  62. Separation of Components.
  63. The SOFTWARE PRODUCT is licensed as a single product. Its component
  64. parts may not be separated for use on more than one computer.
  65.  
  66. Single Computer.
  67. The SOFTWARE PRODUCT is licensed with the COMPUTER or to a SITE as a 
  68. single integrated product.  Unless a site license is purchased, the 
  69. SOFTWARE PRODUCT may only be used with the COMPUTER.

  71. Rental.
  72. You may not rent or lease the SOFTWARE PRODUCT.
  73.  
  74. Software Transfer.
  75. You may not transfer your rights under this EULA.
  76.  
  77. Termination.
  78. Without prejudice to any other rights, Kinook Software, Inc. may 
  79. terminate this EULA if you fail to comply with the terms and conditions 
  80. of this EULA.  In such event, you must destroy all copies of the 
  81. SOFTWARE PRODUCT and all of its component parts.

  83. 3. COPYRIGHT.
  84. All title and copyrights in and to the SOFTWARE PRODUCT
  85. (including but not limited to any images, photographs, animations,
  86. video, audio, music, text, and "applets" incorporated into the
  87. SOFTWARE PRODUCT), the accompanying printed materials, and any
  88. copies of the SOFTWARE PRODUCT are owned by Kinook Software, Inc.
  89. The SOFTWARE PRODUCT is protected by copyright laws and 
  90. international treaty provisions. Therefore, you must treat the 
  91. SOFTWARE PRODUCT like any other copyrighted material except that 
  92. you may install the SOFTWARE PRODUCT on a single computer
  93. provided you keep the original solely for backup or archival
  94. purposes.

  97. DISCLAIMER OF WARRANTY

  99. NO WARRANTIES.
  100. Kinook Software, Inc. expressly disclaims any warranty for the 
  101. SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related
  102. documentation is provided "as is" without warranty of any kind,
  103. either express or implied, including, without limitation, the
  104. implied warranties or merchantability, fitness for a particular
  105. purpose, or noninfringement. The entire risk arising out of use
  106. or performance of the SOFTWARE PRODUCT remains with you.
  107.  
  108. NO LIABILITY FOR DAMAGES.
  109. In no event shall Kinook Software, Inc. be liable for any damages 
  110. whatsoever (including, without limitation, damages for loss of 
  111. business profits, business interruption, loss of business
  112. information, or any other pecuniary loss) arising out of the use
  113. of or inability to use this product, even if Kinook Software, Inc.
  114. has been advised of the possibility of such damages.
