  1. Until recently, the various versions of HDTEST and DIREDIT were 
  2. distributed in "archived" form, using (and, in the case of the 
  3. Registered versions, together with) Phil Katz's excellent PKARC 
  4. program. Unfortunately, SEAware, the distributors of the original ARC 
  5. programs, chose to sue Phil for Copyright and Trademark infringement, 
  6. and obtained an undertaking from him to cease using or supporting 
  7. SEAware's allegedly proprietary file formats. Many people, myself 
  8. included, felt that SEAware's action was part of an undisguised 
  9. attempt to create a monopoly over a technology which had become almost 
  10. essential for the distribution of Shareware and Public Domain 
  11. software. If this interpretation of SEAware's intentions is correct, 
  12. it can be assumed that their legal action against Mr. Katz was only a 
  13. prelude, designed to "clear the decks" for a future attempt to claim 
  14. royalties from anyone who used "their" file formats (or, at least, 
  15. from anyone who used them in a way that could remotely be described as 
  16. commercial). Although it is likely that such an attempt would 
  17. ultimately be found to be in violation of Federal anti-trust 
  18. legislation, few, if any, Shareware or PD authors have the resources 
  19. which would be needed to mount a fight against it. Under the 
  20. circumstances, I decided to cease using any program or file which uses 
  21. the .ARC format for the distribution of any version of my programs. 
  22. Phil Katz has now developed a completely new (ZIP) format for 
  23. compressing and archiving files and has placed it in the public domain 
  24. (though he does, of course, expect people to Register his PROGRAMS, 
  25. which create and modify the new files). Under the terms of a License 
  26. from Phil Katz, I am now distributing the Shareware versions of my 
  27. programs as self-extracting .EXE files - to unpack one of the 
  28. "package" files, just copy it to a disk with a reasonable amount of 
  29. free space (at least three times the size of the "package" file) and 
  30. run it as if it were a normal program.
