  6.   Eagle Performance Software is glad that you had the opportunity to test this 
  7.   high quality software!  If you have decided to use the routines or the 
  8.   documentation for your benefit, you are expected to register.  It will 
  9.   assure you that you have up to date products and access to customer service.

  12.   LEVELS OF REGISTRATION:
  13.  
  14.   Two Levels - If you want to register, you can choose one of two levels of 
  15.   registration - (1) private user or (2) commercial user.  All registrants 
  16.   will receive the complete source code.
  17.  
  18.   PRIVATE USER - For a private license, registration may be for private or 
  19.   non-profit Shareware use.  As a restriction, you may NOT produce executable 
  20.   code programs for profit.
  21.  
  22.   COMMERCIAL USER - For this level, a corporation, company, institution, 
  23.   organization, or individual can use the software to DIRECTLY or INDIRECTLY 
  24.   make a profit from in-house use of programs produced from this software or 
  25.   programs released as Shareware.  No direct sales are permitted.  No 
  26.   royalties are required.
  27.  
  28.   NO COMPETITION - In no case shall any user use the code or documentation to 
  29.   commercially compete with Eagle Performance Software.
  30.  
  31.   UPGRADING - All registrants of previous versions can get upgrades for a $7 
  32.   charge per program per license plus postage of $4.

  35.   PRICING:
  36.  
  37.   Mailing in License - The License Agreement, LICENSE.LIC, has the pricing 
  38.   data for each level of registration.  It should be signed and mailed to the 
  39.   author for the registration.  The terms for future licensing may change.  
  40.   With any order, please include $4.00 for diskettes, mailer and postage.

  42.   Distribution - The distribution of the publically released software is 
  43.   encouraged and can only be distributed without profit.  ASP approved vendors 
  44.   may distribute the software if the price does not exceed $5.  Permission is 
  45.   required otherwise.

  47.   Texas Orders - Only orders in Texas need to add the Texas sales tax.
  48.  
  49.   Foreign Orders - For checks not drawn on U.S. banks, add $3 to the total.  
  50.   Add $3 for shipping.  Only U.S. dollars accepted.
  51.  
  52.   Accounting - If you are in a profit making organization, you can usually get 
  53.   the funds from petty cash accounts rather than going through major 
  54.   approvals.

  57.   BASIC TERMS: 
  58.  
  59.   1. This license applies to the Turbo Pascal and assembly source code for 
  60.      each product.
  61.  
  62.   2. You must treat the software just like a book - ONLY ONE CPU PER LICENSE 
  63.      can use the software at the same time in the original or modified forms.  
  64.      However, you are authorized to make archival copies for safekeeping.
  65.  
  66.   3. You may not modify the code and redistribute it to other users without 
  67.      permission of the author.
  68.  
  69.   4. The license applies to the original copy of the code as well as updated 
  70.      versions which are available on CompuServe's Borland Forum.  The author 
  71.      is neither obligated to provide updated versions nor notices of error 
  72.      corrections.

  74.   5. Customer support will be provided as outlined in the introduction of the 
  75.      software documents.

  77.   6. The user agrees to conscientiously respect the copyright to the author of 
  78.      the code and not to illegally, unethically, or neglectfully exploit the 
  79.      services provided by the author.

  81.   7. This code is provided "as is" without warranty of any kind, either 
  82.      expressed or implied, included but not limited to the implied warranty of 
  83.      merchantability and fitness for a specific purpose.  The entire risk as 
  84.      to the quality and performance of the coding is with you.  Should the 
  85.      code prove defective, you assume the entire cost of all necessary 
  86.      servicing, repair or correction.

  88.   8. In no event will the author be liable to you for any damages, including 
  89.      any lost profits, lost savings or other incidental or consequential 
  90.      damages arising out of the use or inability to use this code.
