- Eagle Performance Software is glad that you had the opportunity to test this
- high quality software! If you have decided to use the routines or the
- documentation for your benefit, you are expected to register. It will
- assure you that you have up to date products and access to customer service.

- LEVELS OF REGISTRATION:
-
- Two Levels - If you want to register, you can choose one of two levels of
- registration - (1) private user or (2) commercial user. All registrants
- will receive the complete source code.

- PRIVATE USER - For a private license, registration may be for private or
- non-profit Shareware use. As a restriction, you may NOT produce executable
- code programs for profit.

- COMMERCIAL USER - For this level, a corporation, company, institution,
- organization, or individual can use the software to DIRECTLY or INDIRECTLY
- make a profit from in-house use of programs produced from this software or
- programs released as Shareware. No direct sales are permitted. No
- royalties are required.

- NO COMPETITION - In no case shall any user use the code or documentation to
- commercially compete with Eagle Performance Software.

- UPGRADING - All registrants of previous versions can get upgrades for a $7
- charge per program per license plus postage of $4.

- PRICING:

- Mailing in License - The License Agreement, LICENSE.LIC, has the pricing
- data for each level of registration. It should be signed and mailed to the
- author for the registration. The terms for future licensing may change.
- With any order, please include $4.00 for diskettes, mailer and postage.

- Distribution - The distribution of the publically released software is
- encouraged and can only be distributed without profit. ASP approved vendors
- may distribute the software if the price does not exceed $5. Permission is
- required otherwise.

- Texas Orders - Only orders in Texas need to add the Texas sales tax.

- Foreign Orders - For checks not drawn on U.S. banks, add $3 to the total.
- Add $3 for shipping. Only U.S. dollars accepted.

- Accounting - If you are in a profit making organization, you can usually get
- the funds from petty cash accounts rather than going through major
- approvals.

- BASIC TERMS:

- 1. This license applies to the Turbo Pascal and assembly source code for
- each product.

- 2. You must treat the software just like a book - ONLY ONE CPU PER LICENSE
- can use the software at the same time in the original or modified forms.
- However, you are authorized to make archival copies for safekeeping.

- 3. You may not modify the code and redistribute it to other users without
- permission of the author.

- 4. The license applies to the original copy of the code as well as updated
- versions which are available on CompuServe's Borland Forum. The author
- is neither obligated to provide updated versions nor notices of error
- corrections.

- 5. Customer support will be provided as outlined in the introduction of the
- software documents.

- 6. The user agrees to conscientiously respect the copyright to the author of
- the code and not to illegally, unethically, or neglectfully exploit the
- services provided by the author.

- 7. This code is provided "as is" without warranty of any kind, either
- expressed or implied, included but not limited to the implied warranty of
- merchantability and fitness for a specific purpose. The entire risk as
- to the quality and performance of the coding is with you. Should the
- code prove defective, you assume the entire cost of all necessary
- servicing, repair or correction.

- 8. In no event will the author be liable to you for any damages, including
- any lost profits, lost savings or other incidental or consequential
- damages arising out of the use or inability to use this code.
