END-USER LICENSE AGREEMENT FOR BoDetect v3.01

NOTICE: This End-User License Agreement ("EULA") is a legal agreement between you and the AUTHOR (CBSoftSolutions) for the software product identified above. By installing or using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you may not use the SOFTWARE PRODUCT. This agreement shall be governed by the laws of the State of Oregon.

This agreement overrides and takes precedence over any other agreements which may have been included in a previous version of the SOFTWARE PRODUCT. 

GENERAL TERMS OF THE AGREEMENT:

The SOFTWARE PRODUCT is protected by copyright laws, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE. This EULA grants you the following rights:

· Software. 

You may evaluate the SOFTWARE PRODUCT for a period of 30 days. After 30 days, the SOFTWARE PRODUCT will cease to function and you must either purchase a license for the SOFTWARE PRODUCT, or destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

You must purchase of a license for each computer on which the SOFTWARE PRODUCT is installed. Each license grants you the right to use the SOFTWARE PRODUCT on ONE computer. You may archive or store an additional copy of the SOFTWARE PRODUCT on devices such as network servers or backup media for distribution, provided the number of copies of the SOFTWARE PRODUCT installed at any time does not exceed the number of licenses you have purchased.


2. RIGHTS AND RESTRICTIONS. 

· Distribution. You may make the NON-REGISTERED SHAREWARE version of the SOFTWARE PRODUCT available for public download from any web or ftp site provided that you make a reasonable attempt to only offer the latest version of the SOFTWARE PRODUCT and you do not modify, add, or delete the contents of the zip file containing the SOFTWARE PRODUCT.  If you are notified by the AUTHOR that the version of the SOFTWARE PRODUCT you are offering for download is not the most current, you agree to obtain and post the most current version of the SOFTWARE PRODUCT.   You may NOT under any circumstances distribute any registration codes for the SOFTWARE PRODUCT. 

· Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law.

· Transfer of License. Licenses may not be transferred.

· Sale. The SOFTWARE PRODUCT may not be sold, bundled with other 'for sale' products, or made available for download from any site that requires any payment for access without the WRITTEN PERMISSION of the AUTHOR.

· Termination. The AUTHOR may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

3. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT and any copies of the SOFTWARE PRODUCT are the intellectual property of and are owned by the AUTHOR. The SOFTWARE PRODUCT is protected by copyright laws.


MISCELLANEOUS

The AUTHOR reserves the right to modify the terms of this agreement at any time.  

LIMITED WARRANTY

NO WARRANTIES. The AUTHOR expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.

NO LIABILITY FOR DAMAGES. In no event shall the AUTHOR be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other incidental loss) arising out of the use of or inability to use this product.
