Day 059 - 01 Dec 94 - Page 66
because at that stage nobody had agreed to establish a
recycling plant.

MR. MORRIS: Bearing in mind that experiment, would you describe
your packaging as recyclable?
A. All packaging?

Q. The customer packaging, would you describe that as
recyclable?
A. Are you talking of anything in particular?

Q. Well, the paper and the polystyrene cartons, would you
describe would you say your packaging is recyclable?
A. I think if the cardboard or the paper does not have a
laminate or a coating on it, generally it is recyclable.
If it has a laminate or coating it may not be possible to
separate that laminate or coating, therefore, that would
not be recyclable.

Q. Are you aware that you had a dispute with the Advertising
Standards Authority over an advert about recyclability,
made claims about the recyclability of your products, and
they ruled that the advertising was misleading?
A. But not significant, if I remember.

Q. Were you aware that you referred to your Nottingham scheme
as an example of how you were recycling paper? Are you
aware that the Advertising Standards Authority said that
you could not make claims about the recyclability of your
packaging if you were not doing it yourself, and that you
said that you were; although it was only a pilot scheme, it
was being done?
A. I am not informed of the details. I understand that
John Hawkes in marketing was dealing with that issue.

MR. JUSTICE BELL: Do you know yourself whether plant pot, coat
hanger, insulation material or filling for duvet has
actually been made from plastic which has come out of the
plant in the Manchester area?
A. No, I do not. I do know that this happens in the
United States and I have seen the products there. I do not
know that anything has come out of the UK plant as yet,
which is why the scheme currently is only just about
viable.

MR. MORRIS: Maybe we should go to this document, the
Advertising Standards Authority document, Defendants'
documents No. 45, kingfisher blue, whatever that is.

THE WITNESS: Is that volume two?

MR. MORRIS: It should have the numbers on the outside.
A. 26 to 59.

Q. Yes, that is the one.
A. Which tab?

Q. 45. Do you have it?
A. What is it headed?
