Day 174 - 17 Oct 95 - Page 41
his employees; he was responsible for them.

Q. So was the reason, then, that he was the only one who would
have been able to give any evidence about the situation?
A. Yes, that would be correct. He had dealt with the
employees.

Q. Right -- apart from, of course, the employees themselves?
A. Sorry, I am not sure I understand your question.

MR. JUSTICE BELL: He has agreed with you, Mr. Morris.

MR. MORRIS: Right, OK. Can we have a five minute break, to see
if we have any further questions?

MR. JUSTICE BELL: Yes. I will come back at quarter past.

(Short adjournment)

MR. MORRIS: Sid Nicholson said in his evidence, which is on
page 32 of day 120 -- I am sorry, I have not got the actual
date of that -- line 19 down to lines 50, I asked him:

"When did you have any responsibilities for anything to do
with Ireland? We are talking about southern Ireland here."

He answered: "I think we took over responsibility for it in
1985. Up until that time it had been administered by an
organisation called McDonald's Development Corporation."

Is that your understanding of the situation, as well?
A. Yes, that is correct. McDonald's Development
Corporation had responsibility prior to McDonald's UK
taking over responsibility.

Q. Right. Then on line 42 I asked: "When you say you took
responsibility, it was like a legal transfer, was it?

Answer: "No, we just assumed responsibility for it. We
serviced it. It was an entirely franchised operation, so
Field Services Department checked on the running of the
restaurants. I did the personnel on it."

That is all accurate? That is what Sid Nicholson said. Is
that all accurate?
A. That McDonald's UK took over responsibility for
servicing?

Q. Yes.
A. Yes.

Q. Do you remember the date that Sid Nicholson became
responsible for Ireland as part of his responsibilities?
A. No, sorry, I cannot remember.

Q. He could not remember; he thought it was in 1985, but he
could not remember when in 1985.
A. No, I am sorry. I can remember McDonald's UK taking
over responsibility from MDC, but I am sorry, I cannot
remember the dates.
