Day 166 - 28 Sep 95 - Page 27

MR. JUSTICE BELL: One wonders why it went back to 60.

MR. MORRIS: On that point, rather than have to bring it up
again, if they clocked in and out on breaks by watching the
clock, knowing how long they have got, they would also have
to calculate in their minds how many units that was when
they were calculating. If they had worked five hours 20
minutes, they would have to deduct -----

MR. JUSTICE BELL: That is not realistic, is it, really? At the
end of the week they should have a picture in their own
mind of how many hours they have actually worked, whether
they do it to a second decimal place or a quarter of an
       hour ---
       A. For the end of each shift

  Q. -- they, presumably, should be able to tell if they are as
much as, say, half an hour out or something like that?
       A. At the end of each shift the managers would put three
figures, basic, evening and premium, along that, say,
Monday, for instance. So on Monday, if somebody has
clocked in and out four times, you would have next to it
some figures, basic rate, evening rate and premium rate.
So if you had five, to answer the question, if you had five
hours and 23 minutes, whatever, it would be in those
sections. If it was all done on the day shift, you would
have 5. whatever for the day shift hours -- are you
       following?

MR. MORRIS: I could probably work it out if I was working at
McDonald's for three month. Do you happen to know, in your
experience, of any other company that ever used this 100
       unit system?
       A. No, but, I mean, I had only worked in Debenhams before
that could be of a similar nature, shall we say.

MR. JUSTICE BELL: Did you clock in and out at Debenhams at all?
       A. No, I think we wrote it in a book when we got there.

  Q. You were just expected not to arrive late or not too late
and not to leave too early?
       A. Yes.

MS. STEEL: The documents that you brought to court this
morning, have you got them there in front of you?
       A. Yes.

  Q. The Budget Report which is dated 22nd December 1986 is the
       budget for 1987, yes?
       A. That is right.

  Q. So, who drew up this budget?
       A. That would have been finished off by the Accounts
Department. There would have been considerations from
myself, as the Store Manager, my Supervisor, my Senior
Supervisor. We would use history; we would use previous
year; we would take other things into consideration such
as, for instance, if February had a leap year in it, it
would be one more day to consider in terms of sales; we
would consider where Easter was, whether it was in March or
