     1        but not the truth of what the Wages Inspector said to her.
     2        How much, if any weight, I attach to her evidence is
     3        another matter.

     5        Mr. Howes has not been mentioned, but it seems to me only
     6        right I should hear his evidence, for whatever I make of
     7        it, with regard to alleged publication of the leaflet to
     8        visitors to court on 13th June 1994.

    10   MS. STEEL:   I just realised I have not got his statement in
    11        front of me and I had forgotten about him.

    13   MR. JUSTICE BELL:  That is what he dealt with.  Did you want to
    14        say something about that?

    16   MS. STEEL:  Because I remember the Plaintiffs bringing it up at
    17        the time and seeing as it is a solicitor from their own
    18        offices, I do not see why they could not have got a
    19        statement at the time which we then could have got advice
    20        about and maybe got statements if necessary.  Now
    21        basically, I cannot even remember who was sitting anywhere
    22        in the court two years ago.  Well just the point, you know
    23        he was from their offices and they could have served this
    24        statement two-and-a-half years ago.

    26   MR. JUSTICE BELL:  I think it is a matter I should hear if the
    27        Plaintiffs want to put it before me.  Better, it seems to
    28        me, that the evidence be heard before anything is put in
    29        cross-examination to either Ms. Steel or Mr. Morris along
    30        those lines if, in fact, they give evidence.

    32        Either now or fairly shortly I would like you to take stock
    33        of who you need leave for.  No objection has been actually
    34        made so far with regard to the witnesses who have been
    35        served, so it is highly likely I will grant you leave but
    36        for the avoidance of doubt it is better they should be
    37        listed.

    39   MR. RAMPTON:  Your Lordship spotted one of my rare descents into
    40        the playground whenever we last discussed this and called
    41        it tit for tat and, indeed it was.  I have no objection to
    42        any of this.

    44   MR. JUSTICE BELL:  What I think though so there is no
    45        misunderstanding, in the light of that you need not
    46        actually make the application today, if you have not got
    47        your list, but I think some time pretty quickly you had
    48        better.  Just in case there is any misunderstanding.

    50   MR. MORRIS:  Yes.  Can we just -- it is just that all our 
    51        witness statements -----

    53   MR. JUSTICE BELL:  If you like what I will do, I will give you
    54        leave for you to call any of the additional witnesses whose
    55        statements you have handed to me in open court.
