Day 087 - 10 Feb 95 - Page 33

MR. MORRIS: That is what we are going to do, and we have done
that but we do not want to -----

MR. JUSTICE BELL: If you can possibly get any help -- there is
no harm in mentioning a name in this context -- if there is
someone just, for example, like Mr. Fitzgerald who can help
you, then do go to that person and see whether you can be
given some assistance. I am not necessarily suggesting him
-- he is a very busy man -- but if there is someone like
       that, then do.

  MR. MORRIS: OK.

MR. JUSTICE BELL: I really think we have to -- if we are going
to make any progress at all, we have talked about this more
than enough, I think we should break off now and come back
at 2 o'clock and get on with any other aspects which you
       usefully can do.

MR. MORRIS: Can I just say so that Mr. Rampton can consider
this over lunch-time that we would like a Civil Evidence
Act Notice on the Health & Safety Executive report as
well? That was the Employee Safety report.

MR. JUSTICE BELL: That is the electrocution one?

MR. MORRIS: No, no. That is the substantial one with 50
recommendations by the Health & Safety Executive.

MR. JUSTICE BELL: I remember, yes. I think someone should make
a note, in case we come back to it, unless there is any
objections to the validity of the Notice in itself, that
that was done on 10th February.

  MR. MORRIS: Yes.

MR. RAMPTON: Mrs. Brinley-Codd is writing these things down.

MR. JUSTICE BELL: Yes. 2 o'clock.

                      (Luncheon Adjournment)
                                                    2.00 p.m..

MR. MORRIS: To be honest, we are feeling a bit exhausted, so we
do not feel that we can get through all the matters we want
       to deal with.

MR. JUSTICE BELL: I was thinking that we would not go on beyond
4 o'clock this afternoon. If you reach a stage where you
just, quite frankly, have had enough, let me know and we
will adjourn to first thing on Monday and go on with
       Mr. Bowes.

MR. RAMPTON: My Lord, before Mr. Morris starts, there are two
matters on behalf of the Plaintiffs which I will wish to
raise at some stage in the not very distant future. I am
not saying I need to raise them this afternoon but they do
relate -- I will tell your Lordship what they relate to.
I am not raising them now, but just so that it is known
