Day 001 - 28 Jun 94 - Page 61

1 not have that power and it is no part of my function. But
quite apart from that, I think just justice will be
2 perfectly well served if they are available at a given
place to be collected by the defendants, or either of them
3 or any one who they choose to send to collect them on
              their behalf.
     4
I think that it is asking too much if the defendants ask
5 for more than that. If, as a matter of grace, the
plaintiffs are prepared to do more than that, so be it,
6 but I do not think it is more me to order them to.

7 MR. RAMPTON: If it would help the defendants, the transcripts
can be made available at East Finchley, the head office of
8 McDonald's rather than the offices of the solicitors.
Perhaps they would write to us and tell us which they
     9 want.

10 MR. JUSTICE BELL: I do not think these are matters for the
judge, in any event, quite frankly. We will resume at
11 10.30 in the morning. Are you proposing to make separate
              openings?
    12
MR. MORRIS: Yes. Helen will be first.
    13
MR. RAMPTON: One administrative matter. Would your Lordship
14 say that whatever happens tomorrow Mr. Preston will not be
              needed before Thursday?
    15
MR. JUSTICE BELL: That is why I asked Mr. Morris how long it
    16 would take.

17 MISS STEEL: There was another matter. When we looked at the
indices to the trial bundles last night they had been
18 changed quite substantially. We are in an extremely
difficult position of having the trial bundles at home
19 being totally unrelated to the trial bundles in court. We
were going to ask if we could have Thursday before we go
20 into evidence to put our trial bundles in the same order
as those that are being used by the court, because
21 otherwise we are not really in a position to prepare -----

22 MR. JUSTICE BELL: Are you going to cross-examine Mr. Preston?
Do you remember, we said or you thought there might be
23 parts of the cross-examination of Mr. Preston which you
              would want to put over.
    24
MISS STEEL: We will be cross-examination him. We may wish to
25 say something further at a later date, yes.

26 MR. JUSTICE BELL: You wish to start cross-examining him, do
              you?
    27
MISS STEEL: Yes. We were only served with this new file of
28 indices yesterday. So we have not had time to put our
              files in order.
    29
MR. JUSTICE BELL: I was going to ask how long Mr. Preston's
30 evidence-in-chief is likely to last?
