Day 198 - 08 Dec 95 - Page 36

MS. STEEL: Liverpool; Liverpool and Wolverhampton.

MR. MORRIS: And Warsaw. He is statement number 2 in the
bundle, but we have managed to speak to him but somebody
said where he might know he had moved to, or something of
that kind. It looks possible we will not be able to find
him, in which case we would ask his evidence to be Civil
Evidence Act notice evidence. If I just check down the
list. I think we have said we are not intending to call
Robert Chapman in the light of all the evidence we have
heard on that issue. He was the chap who witnessed the
death of Mark Hopkins. We are not calling Terry McDonald,
the expert witness.

MR. JUSTICE BELL: You told me that.

MR. MORRIS: Yes, or John Ridd.

MR. JUSTICE BELL: What is the position with Fiona Byfield?

MR. MORRIS: There are a number of witnesses who have expressed
to us that for personal reasons -----

MR. JUSTICE BELL: You do not need to explain. I have already
said -----

MR. MORRIS: I do not mind explaining.

MR. JUSTICE BELL: No, I have already said on a number of
occasions, I do not draw any inference one way or another
from the fact that someone is -----

MR. MORRIS: Some people are, you know, quite nervous about
coming to court generally and we do not want to put any
pressure on people -----

MR. JUSTICE BELL: Can I say not Fiona Byfield?

MR. MORRIS: I think you could cross off Fiona Byfield and
Vanessa Lebrasse, number 17. There are two or three others
I am not, still not quite hundred per cent sure on, so I do
not want to go into them; for example, Mr. Townsend, Mr.
Donehey and Mr. Blick.

MR. JUSTICE BELL: Where do I find the third reference you
mentioned?

MR. MORRIS: Mr. Blick is number 24. Kirsty Ann Pearson we are
not calling, that is for sure. I think I have mentioned
that before. Stuart Whittingham is untraceable and it is
arguable whether it is relevant -- not relevant, but it is
such a minor point in the light of your ruling about the
substantial matters that he could have raised that the
other matters are not worth calling him around.

Now, that leaves the Civil Evidence Act statements of
people, I think. Is that clear? Is there anyone you want
to ask about?
