Day 099 - 08 Mar 95 - Page 26

  Q. Mr. Kenny, if you look at the bottom of the page there is a
       table, is there not?
       A. Yes.

  Q. With "Organism", "n", "c", "M", "m", those Ms being "M" for
       mother ---
       A. Yes.

  Q. The first row in the table under those headings is for the
total colony count or viable count, right?
       A. The first?

  Q. The first row under -- it calls itself "Aerobic mesophile
       bacteria", otherwise known at TVC?
       A. Yes.

  Q. "n" means the number of samples to be taken?
       A. Correct.

  Q. "c" means the number of same proposal which are permitted
to fail within that larger sample, if I can put it like
that. In other words, you are allowed to fail twice out of
five times, it looks like, does it not?
       A. Two samples are allowed to be above the "m" count.

  Q. Above the "m"?
       A. Yes.

  Q. The "m" is 500,000, is it not?
       A. Yes.

  Q. The "M" which is unsatisfactory or fail is more than
       5,000,000?
       A. That is right, yes.

  Q. Do you know what those standards are derived from, what is
that table based on, do you know?
       A. I believe this comes, it says here, from the Minced
       Meat Directive.

  Q. Which we can see originated at least in 1988; is that
       right?
       A. That is right, yes.

  Q. Has there been any more restrictive directive come into
force since then, do you know?
       A. No, we are still waiting for the microbiological
       guidelines from the EU.

  Q. Keeping your finger -- I am awfully sorry about this but
there is nothing I can do -- in that appendix, could you
turn on, please, to I think it is "G", it is "7" of your
       appendices?
       A. Yes.

MR. JUSTICE BELL: I just want to think about that, if I may,
for a moment. I understand what you have said, but if we
take the first line, for instance, Aerobic mesophile
bacteria, two are permitted to fail, you say, two samples
are allowed to be above "m"?
