Day 261 - 12 Jun 96 - Page 77

startling, I may have to get instructions.

MR. JUSTICE BELL: The point of trying to get the statement is
that one does not know. It may be going over ground which
we have been over before with a different stress, in which
case it may not matter much that there is no notice. But
the whole point of trying to get the statement is just in
case Professor Crawford does produce something which is a
new point or produces some literature or wishes to refer to
some literature to support or underline a point he has
       already made.

MR. RAMPTON: The other thing was Mr. Cannon that I raised the
other day. I have not been able to think, myself, since
then, of any good reason why he should be recalled.

MR. JUSTICE BELL: Have you got a particular point?

MR. MORRIS: I forgot to phone him. I will phone him to get his
further statement. He said he would do it at the weekend.
It is possible he was not at home, but I will check.

MR. JUSTICE BELL: Do do that. Apart from anything else, we do
not want to have Mr. Cannon back just to find that he does
not have anything to add. You have it obviously in mind
that he does have something to add, so notice should be
given of it to the other side.

MR. RAMPTON: My Lord, I mention Mr. Cannon in particular
because I foresee, shall I say, some slight, perhaps,
substantial displacement to the present schedule. We have
reached the 2nd November with Mr. Pocklington. There is
likely to be an argument tomorrow morning which will take a
bit of time, perhaps an hour, perhaps three-quarters of an
hour -- I do not know -- and I still have Mr. Clare and
Mr. Russell to try and fit in this week. If one of them
was not finished, then I could see whether they could come
back next week on Wednesday, or possibly even Tuesday.

MR. JUSTICE BELL: I think we should talk about the schedule
before we stop any evidence which we are hearing a little
early on Friday afternoon, so we can talk about the
schedule when we know where we have got.

MS. STEEL: Is it Mr. Clare who is coming next, or is it
       Mr. Russell?

MR. RAMPTON: It is Mr. Clare. Mr. Russell will probably now
not be before Friday, I would guess.

MR. JUSTICE BELL: You are expecting Mr. Hall to be here first
       thing, are you?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: In case there is any difficulty about that,
and in the hope that we will get to Mr. Pocklington anyway
sooner rather than later, I think Mr. Pocklington ought to
be back first thing in the morning. If Mr. Hall is held up
for any reason, we can carry on with Mr. Pocklington for
