1 the packaging item prior to use and it meets all of our
guidelines, so we do not go beyond that -- meets all of
2 FDA's guidelines. If you recall, the FDA does approve
styrene ---

MR. MORRIS: But there has been -----
4 A. -- an additive to food.
5 MR. JUSTICE BELL: The position is this, that Mr. Lipsett has
put this up. When he comes we will find the support for
6 it, if there is any support. If there is support and good
support, the point will have been made. If it is not, it
7 falls away. This witness has said: "We abide by such
regulatory provisions as they are" and it obviously does
8 not concern him. So the ball is at the moment ---
9 MR. MORRIS: In our court.
10 MR. JUSTICE BELL: -- in Mr. Lipsett's court, is it not? And
we just do not know to what extent he will elaborate on
11 what is in his statement. We will have to wait and see.
12 MR. MORRIS: There was the other matter of incineration of
styrofoam, polystyrene. I am a bit thrown off course.
13 I did not know whether to go into these or not, but an
assertion was made that it would not apply to McDonald's.
14 I wanted to probe into that whole area really.
15 MR. JUSTICE BELL: What was the assertion you had in mind?
16 MR. MORRIS: Mr. Kouchoukos said that the National Bureau of
Standards Centre for fire research when they identified 57
17 chemical by-products released during combustion of
polystyrene foam during laboratory tests, "identify a
18 number of ... (reading to the words) ... or burnt".
I believe he said that that was something to do with a
19 house fire.
20 MR. JUSTICE BELL: My word is "uncontrolled," but effectively
uncontrolled combustion as opposed to the way things are
21 incinerated for waste disposal.
22 MR. MORRIS: Mr. Kouchoukos, you are familiar with that report
then?
23 A. No, I have not seen the report. I have talked to
people about that report and that is what I have been told
24 also.
25 MR. JUSTICE BELL: He has seen the title of the report or the
description of the report as given in Mr. Lipsett's
26 statement.
27 MR. MORRIS: You must have seen something about that report to
know that it related to a house fire?
28 A. The way I do my research is I talk to the experts, our
converters, again and they have PhDs on staff, and say:
29 "Have you ever heard of this report?" "Yes, that report
is a report that the Bureau", who was it again, the
30 Bureau of National Standards or somebody?
