Day 061 - 05 Dec 94 - Page 58

not matter too much what the fine construction is. They
have bothered to mention some kinds of chickens, you say,
       but not the others.

MS. STEEL: Have you ever terminated a contract with any of your
       suppliers?
       A. Yes.

  Q. Who was that?
       A. One was Caroft (?) in Ireland who were unable to meet
our standards for supplying shortening to the restaurants.

  Q. Shortening?
       A. Yes. The other was a small source supplier in the
North of England who was unable to meet our future
       expansion growth.

  Q. So have you ever terminated any contracts because of animal
       welfare reasons?
       A. No. I would not hesitate to do so if I had to.

  Q. Before we leave that page, you have said there that
chickens have the freedom to move around at will, but would
you recognise that towards the end of their lives in the
broiler sheds they cannot move around at will?
       A. Yes.

  Q. The animal welfare and husbandry position about beef which
is in the other bundle we were looking at.

MR. JUSTICE BELL: It is tab 1 of pink IX, the rearing and
       slaughter volume.
       A. Right.

MS. STEEL: Find page 2 of that.
       A. "Beef - McKey", yes.

  Q. Yes. This is your animal welfare and husbandry summary of
       supplies positions?
       A. Yes, and it is a summary because the actual position is
       a rather lengthy document.

  Q. Oh, right. There are six points there, are there not?
       A. There are.

  Q. Would it be right to say that only one of them actually
relates to animal welfare and husbandry?
       A. On what is listed here that would be correct, but I do
caution you that the animal welfare and husbandry document
for beef is a lengthy document. It is something Mr. Walker
can deal with from McKey. The same would be true of Sun
       Valley.

  Q. So where this says "Summary of Supplier Positions", is that
different to your own position then?
       A. No, of course it is not.

  Q. It is not?
       A. No.
