Day 263 - 14 Jun 96 - Page 64
when you answered what Mr. Rampton asked you earlier on?
A. What, Geoff from Stamford -----

Q. Jonathan, the Chair, who was actually, you say, the Chair
of the meeting, and the man who was from Kings Cross who
had a New Zealand accent or Australian accent, 45 to
50 years old; you have mixed those two up, would you
accept, in your recollection?

MR. JUSTICE BELL: Why do you say that?

MR. MORRIS: Because he said he thought Jonathan might have a
New Zealand accent, and he said one of them had a
New Zealand accent.

MR. JUSTICE BELL: But he only said "might".

THE WITNESS: I had not refreshed my memory with looking at the
report then. Certainly, somebody there had a New Zealand
accent.

MR. MORRIS: So is it that this report forms the basis -- the
statement was written from this report; this is what the
solicitors had, was it?
A. Yes, certainly.

Q. And they typed up the statement based upon the notes or
based upon this report?
A. Yes.

Q. Then they put it in front you to sign, and you said, "It is
fine, but I will cross off the thing about the
contemporaneous notes"?
A. Yes. There was consultation about this statement.

Q. They had drafted it, and then said, "Come and sign this if
you agree with it"?
A. Yes.

Q. That was the only disagreement you made with it, was the
bit at the end?
A. Correct.

Q. You said about this report refreshes your memory, but,
despite reading this report, you are still confused about
which person was which?

MR. JUSTICE BELL: Well, are you? Now you have read the report,
are you -- if you do have a doubt, please say so.
A. I am not confused now, my Lord. I realised Jonathan
was the Chairman, and there was a separate individual
there, a man who was aged 40 to 50, who might have been
Australian or a New Zealander -- two separate people,
presumably. I am now reminded, or my mind is refreshed
that we are talking here about two separate people.

MR. MORRIS: Are you good at remembering faces?
A. Reasonably good, I would say; reasonably good, yes.

Q. So if, for example, Jonathan was sitting in this courtroom,
