Day 115 - 06 Apr 95 - Page 58
MS. STEEL: I do not know whether I should have brought this up
when Mr. Bruton was in the witness box, but perhaps
I should bring it up now just in case. These were given to
him while he was working there. I mean, as I see it there
are a lot of documents in this case where McDonald's say,
"Oh, this is our policy on this" or "This is our policy on
that", and they are not the be all and end all of
everything but they are useful to see how they say they are
going to be working.

MR. JUSTICE BELL: I think the first step, if I might suggest,
is that you should recall Mr. Bruton and just ask him how
and in what circumstances these came into his possession,
because at the end of day that may turn out to be enough
for your purposes for all I know. I am not being too
technical when I say it is not enough for you to state
that. It may well be that no-one will dispute but you had
better have Mr. Bruton back and ask him one or two
questions about it.

Mr. Bruton, Recalled
Further Examined by the Defendants.

MR. JUSTICE BELL: I suggest you take him through each one
individually.

MS. STEEL: The first document is a proposal form between the
catcher representatives and the management on Monday 21st
October 1991.

MR. JUSTICE BELL: Where did you first see that? Did you give
these today to or recently to Ms. Steel or Mr. Morris?
A. Yes.

Q. Well, how did the proposal first come into your possession,
when and in what circumstances?
A. When he was making all the cutbacks for the contracting
teams to come in, where they were going to cut men down lay
men off, do whatever with the men, these were all proposals
made, I think I am right in saying this, I stand to be
corrected on this, by Jeff Bowells originally.

Q. Who gave you the document?
A. It would either have been given to us but a member of
the management, being Ray Styles, or a trade union
representative.

Q. Very well. Can you remember when that was?
A. To be exact I cannot, sir.

Q. Do you think it was soon after Monday, 21st October 1991?
A. Round about the dates that are on these documents, not
long after we would have had them.

Q. If you look at the letter of 26th January 1993, which is
actually signed by Mr. Bowell, do you see that?

MS. STEEL: "To all catchers, expansion of contract catching".

MR. JUSTICE BELL: The one with the Sun Valley logo in the top
