Day 166 - 28 Sep 95 - Page 55
MR. RAMPTON: On the first page the third paragraph. He says it
happened nearly every day of the week, does Mr. Magill.

MR. JUSTICE BELL: One of the differences of continuation to the
statement is it is obviously Mr. Magill's response to some
kind of either questionnaire or list, schedule of possible
allegations or complaints of some kind, and when we do not
have the original document there may sometimes be some
doubt as to just what he was getting at. It is not his
fault. Can you think of any reason why Mr. Magill, who you
thought of as a decent lad -- you keep referring to him as
-- should want to blacken McDonald's?
A. No idea at all.

Q. Right.

MR. MORRIS: When he worked for you, you remember him as an
honest person, do you?

MR. JUSTICE BELL: That is the point of my question.

MR. MORRIS: Yes. I do not think that -- if I can make a
comment to the judge -- it should be as if someone is
trying to blacken McDonald's. He is just telling the
truth.

MR. JUSTICE BELL: What I meant by that -- let me put it this
way: Can you think of any reason why Mr. Magill should
have it in for McDonald's so he should want to tell lies
about them?
A. No, I cannot.

Q. Or mislead about his experiences?
A. No.

MR. MORRIS: You have worked in McDonald's stores in various
positions and as Area Supervisor for a long time yourself,
have you not?
A. Yes.

Q. Would you say that you are a loyal McDonald's person, you
are loyal to the Company that you have spent so much time
with?
A. I have been generally bought up to be loyal and honest
by my mother.

MR. JUSTICE BELL: It looks to me as if you are going to finish
Mr. Atkinson this afternoon, are you not?

MS. STEEL: Yes.

MR. JUSTICE BELL: Sit down and take your time, I think you are
clearly trying to and I think you should try to, apart from
anything else, it gives us all more time -- I am sure you
can use the time as much as anyone -- if we do not have to
come back just for a short time in the morning. So, sit
down and just think of what more you have to cover.

MR. MORRIS: Just one thing which I did not come back on from
what Ms. Steel said was about the people working over 39
