Day 187 - 13 Nov 95 - Page 28
I have one question to ask Mr. Lamti: to your knowledge,
has McDonald's France taken any action to ensure that the
laws are being perfectly applied in the Lyon restaurant?
A. No, because these problems do not only happen in Lyon.
At the moment within McDonald's France, there is a union
delegate like myself; we get together about every six
months; and the problems that we have encountered in Lyon
are the same as those encountered in Paris or elsewhere.

MR. MORRIS: I will just see if I have any further questions.
No further questions.

MR. JUSTICE BELL: Thank you.

Cross-examined by MR. RAMPTON Q.C.

MR. RAMPTON: Mr. Lamti, would you look, please, at your written
statement filed by the Defendants in these proceedings?
That is volume III, tab 9 -- the French one. It has no
date on it, I think am I right?
A. That is correct. It is not dated.

Q. Do you know when you made that statement?
A. During the time of 1994; I think in June 1994.

Q. Did you make that statement for this case or for some other
purpose?
A. For this case.

Q. You say, if I have understood it correctly, that you know
of no proceedings brought against you by Societe Vilpaix or
Mr. Antolinos?
A. Yes.

Q. Do you not know that on 3rd April 1995, a case under the
Penal Code was brought against you by Vilpaix for secret
earnings?

My Lord, these are technical French legal terms. I do not
know whether I should give them in French. I cannot
actually -- what I have just given and my English
translations of the legal French, but they are in technical
terms. I do not know if it would help the interpreter --
who I guess may not be a lawyer -- if I give what I know to
be the French?

MR. JUSTICE BELL: Take your own course. It seems to me we
should have both the French term and what you understand to
be the translation.

MR. RAMPTON: I will do that. In French, "remuneration au
coute"; and then perhaps the lady interpreter will tell me
whether illicit or secret earnings is a correct
translation?

THE INTERPRETER: Yes, I would accept that.

MR. RAMPTON: "Vol", which I take to be theft.
"Tentative" -----
