Q. OK. I think I have finished with that particular document.

MR. JUSTICE BELL: I have marked various parts of mine but
I assume I can keep it with my copy?

MR. RAMPTON: Yes, I am sure we can get more.

MR. MORRIS: Yes, just a few other bits and pieces on the
financial matters. We have a statement from James Marshall
from the USA on behalf of McDonald's. Maybe it would be
worth just having a look at it. It is a Civil Evidence Act
statement so he is not going to attend. I do not know
where it is put. Is he in the Civil Evidence Act volume?

MR. RAMPTON: My Lord, it is tab 43 of volume 13 of the yellow
file.

MR. MORRIS: It must be yellow 13.

MR. RAMPTON: Yes, I just said that.

MR. JUSTICE BELL: It is right near the back.

MR. MORRIS: It is only one question really about that. In
paragraph 8. I have not got the full statement in front of
me. Just in paragraph 8, fifth line, "I estimate that by
the end of 1994 there were approximately 1,052,027
employees in all of McDonald's US restaurants." McDonald's
are relying on that, yes, that is about accurate as far as
you can see.

MR. RAMPTON: I really do think if we are going to try to finish
today, which I hope we can, because we could fit some
witnesses in next week, to ask Mr. Preston to comment on a
statement which I proffer relying on it as counsel for the
Plaintiffs, both Plaintiffs in this case, whether he
confirms what Mr. Marshall says on my behalf on behalf of
both the Plaintiffs is a complete nonsense.

MR. MORRIS: I will assume then that is accepted.

MR. JUSTICE BELL: It is not.

MR. RAMPTON: It is not accepted.

MR. JUSTICE BELL: It is accepted if you agree. It is you are
the one who should be saying whether it is accepted because
it is the other side's evidence, that is Mr. Rampton's
point really.

MR. MORRIS: Right. OK, you can put that file away. Thank you
very much.

MR. JUSTICE BELL: What I would rather you did, at least you have
notes of all these references so you have them for when you
are going to make an argument to refer me to them. Anyway,
Mr. Rampton made the point. It is positively part of the
Plaintiffs' case in so far as it is relevant because they
