Day 209 - 25 Jan 96 - Page 78

MR. JUSTICE BELL: What I suggest is that we go over to the
question of the interrogatories tomorrow. In case we
finish the argument on that before one o'clock, I would
like you to be ready to read those two, Lynval and the
other witness whose name I have forgotten.

MR. RAMPTON: My Lord, in those circumstances, it might be
helpful if I indicate now -----

MR. JUSTICE BELL: I am going to talk to Mr. Logan first ---

MR. RAMPTON: I am sorry, my Lord.

MR. JUSTICE BELL: -- since we are clearly not going to go on
       with him tomorrow.

Mr. Logan, I am afraid you will have to come back at some
stage in the future because you are only part way through
your evidence. I do not want you to talk to anyone about
the evidence which you have given. Keep it to yourself
until you come back to complete it.

Mr. Morris or Ms. Steel may, however, telephone to speak to
you to suggest days when you do come back.

  THE WITNESS: Right.

MR. JUSTICE BELL: Thank you. Certainly you may go now. There
is nothing more to keep you in court. There is no reason
why you should not talk to Ms. Steel or Mr. Morris about
everyday things but do not talk to anyone about the
       evidence which you have given.

  THE WITNESS: Right.

MR. JUSTICE BELL: If you want to stay in court, because we will
only be here for five more minutes, please do so.

  THE WITNESS: OK.

                      (The witness withdrew)

MR. JUSTICE BELL: What we will do tomorrow, then, is have the
argument in relation to the Brazil interrogatories. Be
prepared to read those two Civil Evidence Act witnesses.

  MR. MORRIS: Right.

MR. JUSTICE BELL: There is no problem from your point of view.
The only possible argument about them is that if Mr.
Rampton is going to object to part of Lynval, I think it
was, we may have to have some argument about that.

MR. RAMPTON: What I was going to say was I am willing to
indicate now the two passages in Lynval to which I object,
but I can easily leave that until tomorrow.

MR. MORRIS: We can leave that until tomorrow.
