Day 153 - 12 Jul 95 - Page 34

three or four years prior to making the statement.

MS. STEEL: Just while we were on clock cards, the clock cards
at the Colchester store were kept in a loft, were they not?
       A. They were kept above the freezer in the loft space,
yes, or the longer, sort of, older clock cards were, yes.

  Q. Was that a loft that you can actually walk into?
       A. No, there was a -- I cannot remember whether there was
a ladder or you have to get a ladder to go up there.

  Q. But could you actually step inside it?
       A. Yes, with the help of a ladder you could, yes.

  Q. OK. Were they filed up there or were they just put up
there to get them out of the way?
       A. The more recent ones, the last sort of three to six
months would probably be kept down in the filing cabinets
in the office downstairs, and the ones that we would put up
in the roof would be the older clock cards and they would
be, sort of, put in boxes and labelled, you know, "May 83"
       or whatever it was.

  Q. They were basically kept up there for several years?
       A. I do not know how long they were kept up there. They
were there when I left Colchester three or four years ago.

  Q. Right. You were not aware of any mass clear out when the
       whole lot were thrown out?
       A. There may well have been when the franchisee took over
the restaurant two or three years ago.

  Q. What year was that?
       A. I am not aware of that. I mean.....

  Q. You do not know whether that happened?
       A. I do not know.

  Q. No. When was that that the franchisee took over?
       A. Two or three years ago, I believe, may be a bit longer.

  Q. 1992?
       A. I am not sure. I was not involved with the restaurant
when he took over. Possibly 1992.

  Q. Have you had responsibility for other stores that have been
       taken over by franchisees?
       A. Yes.

  Q. But you did not have any responsibility for this one at the
       time?
       A. No.

  Q. What happens to all the personnel records and things like
that? Are they just thrown on a rubbish tip when a
       franchisee takes over?
       A. I believe, you know, they maintain any records that
they need to by law, and then I would assume that there is
some means of getting rid of the stuff that they do not
       want.
