Day 118 - 01 May 95 - Page 54

for the work you do, you are paid more depending on high up
you are in the hierarchy, is it not? Is it not correct
that the higher up you are in the hierarchy?
       A. I would have thought that that applies to every
       business in the country.

  Q. We are not talking about every business, we are talking
       about McDonald's.
       A. It is the same with McDonald's. Of course higher up on
the hierarchy the bigger your basis wage will be.

  Q. So you are not paid on the basis of performance?
       A. Yes, you are.

MR. JUSTICE BELL: You have left me there. Whether or not it is
fair that an executive gets several times what a crew
member gets, part of what he does is bear considerable
responsibility, so that is part of what he does. You can
argue whether it is fair or not, but it is a matter to be
taken into account. Anyone who has done hard physical work
and very responsible worrying work as well knows which
leaves them most exhausted at the end of the week. But
this is all argument. You will say, no someone who works
hard physical work is working harder. Can Mr. Nicholson
       really help on this?

MR. MORRIS: It says here "an individual's rate of pay should
reflect their dependability, versatility, experience and
ability". So a crew member who is dependable, versatile,
experienced and able will not earn as much as someone who
is higher up in the hierarchy?
       A. He will earn what is commensurate with what is required
       of him.

  Q. His position?
       A. Yes.

  Q. His position at the bottom?
       A. He is not at the bottom.

  Q. Would you say that that is not performance-related pay?
       A. It is performance-related pay.

  Q. That is status-related pay?
       A. No it is performance-related pay.

  Q. If we move down to Labour Cost Analysis?
       A. Yes.

  Q. This is about labour percentages, "The first step is to
determine whether you have labour problem (high labour
costs)". So high labour costs are a labour problem, are
       they, according to this document?
       A. Well high labour costs would be a problem anywhere. It
depends upon what your high labour costs are.

  Q. It is a problem?
       A. High labour cost would be a problem anywhere.

  Q. Right, OK. If we move down the page it says, underneath
