Day 135 - 15 Jun 95 - Page 24
forecast of it in the disclosable statement -- Mr. Rampton
has either got to shrug his shoulders and say: "Well, there
we are" and not bother about it, or he has to say to
Mrs. Brinley-Codd: "Please have enquiries made about
that". If a witness who has already been called or someone
who is not even on the witness list can give an answer
which Mr. Rampton thinks relevant he has to ask me:
"Please, I would like to call a witness about that".

It is all inconvenient and it all takes time. It is for
those practical reasons only at the moment that I am making
the comment which I made a few minutes ago. It is for
those reasons that I made the comment a few weeks ago which
Mrs. Brinley-Codd picked up and repeated in the letter to
which you have referred.

Quite apart from any question of fairness between the
parties (which, of course, runs both ways), it is just an
attempt to be efficient about how we get through the
evidence. There is no more to it than that.

You have been helpful in a number of respects in this
case. I have particularly in mind agreeing to send out
that form to your potential witnesses, and I am asking you
to be helpful in this respect as well.

MR. MORRIS: Yes, I mean, we certainly will do the best we can.
It is just that it is very difficult for us because we do
not meet our witnesses, we do not have a chance to meet
them before they turn up.

MR. JUSTICE BELL: No, here you have ---

MR. MORRIS: Yes, I understand that.

MR. JUSTICE BELL: -- Mr. Sutcliffe, so please do it with him.
It is in your own interests to do it because it focuses
your mind as well on what extra evidence, if any, of
relevance he can give. So, you will want to do it for your
own purposes, or should want to, and having done it you
should give Barlow Lyde and Gilbert notice of it.

We will adjourn now, unless there is anything else which
must be dealt with, and we will resume tomorrow with
Mr. Newton-Brown. I would like you to use the experience
of how long Mr. Sexton has taken and how long
Mr. Newton-Brown takes, however long it may be tomorrow, to
help you when it comes to making estimates as to how long
other witnesses will probably take once they get into the
witness box in the future, for scheduling purposes.
