Day 201 - 15 Dec 95 - Page 16

As regards the heart disease issue, I think that is
something we will have to get advice on really. We did not
have our meeting yesterday, that was our legal advice
       meeting, because it fell through.

MR. JUSTICE BELL: I would like you to tell me what your
position is when you come back at the beginning of next
term as to just who has to be recalled. I have stressed,
though it is probably obvious to you, that it is
particularly important to get organised about that because
the nearer one gets to the end of the evidence, the less
room one has to manoeuvre. The time has to come,
obviously, when I say that is the end of the evidence.
There will not be any question, however important the
evidence may seem, of thereafter saying: "We would like to
call this witness". The same applies to the Plaintiffs.

Even though I made be in court listening to submissions or
you may be away preparing to make submissions, once I say:
"That is end of the evidence", I mean it because it is
obvious to everyone, in a case like this, potential
evidence may be appearing day by day and month by month on
       environmental topics.

I will ask Mr. Rampton to continue with regard to
scheduling. Mr. Rampton, all one can say is you will have
it make some allowance for a significant amount of
       nutritional evidence.

MR. RAMPTON: My Lord, I accept that. When I say scheduling for
next term, I am certainly not in a position to give an
indication at the moment of any certainties apart from
Mr. Cesca on 22nd February, the Colchester witnesses at the
beginning of term and I would suggest -- I do not know what
your Lordship thinks -- that they should be given at least
five days until your Lordship has to go to do something
else on 18th January, because it is not just our witnesses,
it is Mr. Logan as well and so that is -- not Mr. Logan,
       I am sorry -----

MR. JUSTICE BELL: There is Mr. Shafibeik,
Mr. and Mrs. Harrison, Mr. Brett.

MR. RAMPTON: That is right. There are, theoretically or
potentially, four Defendants' witnesses still to come from
Colchester and I cannot remember whether it is three or
four of mine. But one could, I would respectively suggest,
expect to finish that evidence within five days, if one
makes the effort, and everybody will have plenty of time
for preparation before they are called. Then your Lordship
has two days away on 18th and 19th. I would hope to be
able to start Bath on 22nd or very soon thereafter. The
Bath statements have now been served and, of course,
everybody has had the documentation now for a little time
       at least.

After that, I do not have any more employment evidence and
the question then is what witnesses the Defendants are
going to call and when in the remaining time before
       Mr. Cesca starts.
