Day 134 - 13 Jun 95 - Page 46

       A. Yes.

  Q. Indeed, it is compared also with an international norm as
well, the national figures compared with an international
norm, and each store's results are compared against the
       national norm?
       A. Yes.

  Q. Yes. So, effectively, it is a way of getting information
really about the management of a particular store?
       A. It tells you quite a lot about the way the restaurant
is managed, yes, that is right.

  Q. That is really the purpose of it?

MR. JUSTICE BELL: Why do you say that?

  MR. MORRIS: Because ----

MR. JUSTICE BELL: It may well serve that purpose, but it serves
comparison of the operation in this country compared with
elsewhere, does it not? You can see if the operation in
one particular country seems to be slipping below the norm
       to a significant degree.

MR. MORRIS: Yes, so the norm -----

MR. JUSTICE BELL: It can only be compared with other McDonald's
countries , I assume , because McDonald's have got no right
to tell industrial relations internationally to start
enquiring of employees of other companies. So it may have
its limitations. That is bound to be so, is it not?

For one way or another, the reason this is put in -- I will
in the say the reason it is put in , it may or may not give
me some help as to what proportion of McDonald's crew are
satisfied or otherwise with their situation. I say "it may
or may not" because I have to hear a lot of other
evidence. It is three sheets of paper in the whole of this
case. As I have said enumerable times today already, you
can make your comments on it in due course. You do not
have to put them to the witness. The more you put it to the
witness, the more I begin to wonder why you are.

MR. RAMPTON: My Lord, can I say why it was, in fact, put in and
your Lordship might want to draw that inference. The fact
is it was put in, not as a representative of the state of
mind of crew members (though it may well serve that purpose
and I shall be happy if it does), but because it was
mentioned three times, I think, in the evidence of
       Mr. Nicholson in various contexts.

MS. STEEL: Can I just check something? The figures are
compared against other companies, are they?
       A. No.

  Q. It is just within McDonald's?
       A. Yes.

MR. JUSTICE BELL: That is what I have just said.
