yes; if it can be accommodated so much the better.

MR. MORRIS: I was not aware Mr. Oakley was going to be doing

4 MR. RAMPTON: No, it is in his statement. I am not going to
recall people unless I am made to.

MR. MORRIS: We will have to have time to prepare for
6 Mr. Oakley.
7 MR. JUSTICE BELL: Look at what you have. Once Mr. Langert has
finished tomorrow there is not a lot for you to prepare on
8 Mr. Stump and Mr. Siddiq.
9 MR. MORRIS: No, we were hoping to call Mr. McIntyre on the
same day.

MR. JUSTICE BELL: I do not think you have to, it is purely a
11 factual issue; it is not an expert issue. If you can call
him on Monday we will get him in on Monday as well.

MR. MORRIS: I did ask him to come on Monday because that was
13 the date originally fixed for him.
14 MR. JUSTICE BELL: If you can have him here on Monday so much
the better because we should be able to get through the
15 three environment/index.html">litter witnesses in one day. If you cannot call him
on Monday, we will slip him in -- that is no disrespect to
16 him -- we will fit him in at some stage somewhere along
the route, which is not too inconvenient for him. But you
17 do not have to do much prep for Mr. Stump, Mr. Siddiq, or
your own witness Mr. McIntyre if he is going to be
18 called. You have such time as you can find over the
weekend and such time as can you find on Monday evening
19 and such time as you can find on Tuesday evening before
you have to cross-examine Mr. Oakley.

MISS STEEL: I am not sure what the position is with Mr. Green
21 on Thursday. Only Mr. Lipsett is coming over this weekend
and he has to be heard next week really because he has to
22 go back to the States.
23 MR. RAMPTON: I am told that Mr. Green could come at a later
time; he could come in the week beginning 19th September.

MR. JUSTICE BELL: What I suggest is, it may not sound very
25 ambitious but it may be safe, that we have Mr. Stump and
Mr. Siddiq on Monday; Mr. McIntyre if he can come; we have
26 Professor Duxbury on Tuesday; we have Mr. Oakley starting
on Tuesday if there is time and continuing into Wednesday;
27 and Mr. Lipsett can start on Wednesday and, if time
requires, run into Thursday. I have to be away, as you
28 know, on Friday. I cannot sit on this case on Friday.
29 MR. RAMPTON: I understand that, my Lord, that is why we have
moved Mr. Horowitz to Monday. The problem is this.
