Day 115 - 06 Apr 95 - Page 48

  Q. Your first appeal was dismissed on 4th June, was it not?
       A. I cannot remember the dates but one was, yes.

  Q. You appealed again, did you not, a second stage in the
procedure and that too was dismissed?
       A. Yes.

  Q. You then took out an industrial tribunal complaint?
       A. Yes, that is right, yes.

  Q. With solicitors to help you; you had some solicitors in
       Wales?
       A. The start was yes, but .....

  Q. You then abandoned that complaint on 4th January 1994, did
       you not?
       A. I had not option but to abandon it.

  Q. Why?
       A. Because I never had the money to fund it.

  Q. You could have appeared in person; you are here today. Why
       did you not do that?
       A. Because I never had -- I have not got the education to
       appear.

  Q. Come, come. The allegation was by Sun Valley that you had
obtained the property by deception. I will explain what
       I mean by that.
       A. I know what you mean.

  Q. You do, but perhaps his Lordship does not. You asked the
       storeman -----

MR. JUSTICE BELL: Just listen to what Mr. Rampton puts to you.

MR. RAMPTON: You asked the storeman or the supervisor at the
equipment store repeatedly for new items of equipment for
your work which you did not need. You then kept them in
your house and did not use them. It was not your
property. You had no right to it, do you understand?
       A. What you are saying I understand, but I do not agree
       with that.

  Q. If you do not agree with it and you had a good reason for
having that property, you could have presented your case at
the industrial tribunal, could you not?
       A. Yes.

  Q. Why did you not do so?
       A. Well, there was no need because if there was a case
I stole this property, why did not Sun Valley after saying
they were going prosecute me for stealing this stuff,
namely, one, I was dismissed for having green overalls not
       blue overalls.

  Q. Can you shout? I am sure you are angry with me anyway. I
       did not hear that answer.
