4 that if people are getting the copies from Veggies, that is

10 MS. STEEL: -- agreed to by McDonald's. Page 10, I have
11 actually got a question on this, which is that I did not
12 understand the point that joint enterprise is vividly
13 illustrated by the photographs of the 1989 demo.

15 MR. JUSTICE BELL: I think I understand what Mr. Rampton means,
16 but I will invite him to explain to you so you do
17 understand, if you do not mind, Mr. Rampton.

19 MR. RAMPTON: My Lord, it is quite simple. Even if it was not
20 perfectly obvious from the documents, which are earlier
21 referred to in this submission, that the activities, at any
22 rate so far as McDonald's are concerned, of the members of
23 London Greenpeace, including Ms. Steel and Mr. Morris, are
24 both collective and consensual and aimed at the same
25 target, which is McDonald's, that can be seen very clearly,
26 though Mr. Morris was not there -- it does not matter for
27 this purpose -- very clearly from the photographs of the
28 1989 demonstration.

32 MR. RAMPTON: The whole focus of all the members of the group
33 that were there is to, as they put it, "smash McDonald's".

37 MR. JUSTICE BELL: That is the way Mr. Rampton puts it, so
38 I have to make of it what I will.

40 MS. STEEL: Can I just ask, then: Is it simply that because
41 there are a number of people altogether in one place shown
42 in the photographs, and it is a picket of McDonald's, it
43 must therefore follow that they are all concerned in a
44 joint enterprise? Is that what he means there?

46 MR. JUSTICE BELL: Not necessarily "must". It is another brick,
47 Mr. Rampton says, in the wall. Whether I think it is and
48 how much of a wall it is at the end of the day, if it is,
49 it is the sort of thing I have to decide.

51 MS. STEEL: Right. But is that all that is being said by that
52 point?

57 page 17, but it says that "AC knew the fact sheet and the
58 identities of those responsible for it were of special
59 interest, whereas RAP did not"; that is Mr. Clare and
60 Mr. Pocklington.
