Day 165 - 27 Sep 95 - Page 24

MR. RAMPTON: I could not find that.

MR. JUSTICE BELL: It is page 29 but that may not be the whole
document.

MR. RAMPTON: No, that, my Lord, is not, no. The Fort Wurt(?)
Inc. who are somewhere in America are the people who
wrote ---

MR. JUSTICE BELL: That is the software firm, is it not?

MR. RAMPTON: -- the software people. I am sorry, I do not
actually know the date of this particular document. It is
1991 or later because it was not until that date that the
computer came on line and was used experimentally.

MR. JUSTICE BELL: Was that the first time it was used?

MR. RAMPTON: Yes. That was the first time it was used. The
confusion arose because the old document that was used
before 1991 does no longer exist.

MS. STEEL: Can I just ask -----

MR. JUSTICE BELL: Just pause a moment and let me make my note.

MR. RAMPTON: That is all I have to say.

MS. STEEL: Mr. Rampton has explained why they said this did not
exist in the first place, but yesterday he actually said:
"That did not exist. There is now a document with a
different title advising on how to schedule", which he had
seen. So, I think it would be helpful if that was
disclosed as well.

MR. RAMPTON: No, Ms. Steel has it completely wrong. The
document which I have seen is the one which I have
produced. If I said it had a different title, that is my
mistake. I told your Lordship about the other document
which I have seen and those are the only two documents.
That is the end of it.

MS. STEEL: He distinctly said yesterday and made it quite
plain that it had a different title.

MR. JUSTICE BELL: Yes, he is saying now this is the document
which he has seen and I am not going to disbelieve him.

MS. STEEL: OK, I am prepared to accept that, but if Mr. Rampton
has seen this before he should have disclosed it before
when we were asking for it.

MR. JUSTICE BELL: We are having a debate now as to just what
should be disclosed. What do you want to do about this?
Do you want to put this over while you have an opportunity
to look at this? Leave it on one side for the moment, this
particular matter? You would be well advised to.

MR. MORRIS: As far as we can see, it is the document that we
