Day 153 - 12 Jul 95 - Page 50
A. I would not assume, I would think it likely though.

Q. Do you remember Mr. Alimi and several other crew members
tried to organise a staff walk out because it was so
unpleasant to work in these conditions and this was not
successful? Do you remember something like that?
A. Do not remember that at all.

Q. Do you remember the ring leaders of any revolt about these
conditions being penalised for their activity or being
given warnings?
A. Certainly do not.

Q. You do not remember a great deal about this incident
really?
A. I can remember it reasonably well, actually.

MR. MORRIS: I hope that has satisfied Mr. Rampton.

MR. JUSTICE BELL: Yes. Put the penalties.

MR. MORRIS: He said there were not any penalties given out.

MR. JUSTICE BELL: I know, but on the "might jog your memory"
basis I think you had better put it.

MR. MORRIS (To the witness): Does it jog your memory if I was
to say that the people that had complained about this cold
temperature were shouted at, or may have been shouted at,
and given bad jobs, i.e. cleaning the toilets, or life was
made unpleasant for them? Does that refresh your memory at
all?
A. That is -- that does not concur with my memory of it in
any way, shape or form.

Q. Right. You talked about not having concerns about slipping
accidents in the grill area -----

MR. JUSTICE BELL: Let me just put the rest very quickly for
you. (To the witness): What may be suggested is that
Mr. Alimi was just there for one day while the problem
existed; in fact, it lasted for several days and he was on
holiday the other days.
A. As I remember it, on this occasion it lasted one,
possibly two days. We actually had an arrangement with the
service Company who were first in service and part of their
contract was that they would get to the restaurant within
four hours if there was a problem. The only reason that I
remember it stretching on for longer than one day on this
particular occasion was because they needed to have a part
couriered from the manufacturers in order to fix the air
conditioning unit.

Q. It may be suggested that management at the store refused to
repair the fault.
A. I cannot see any benefit at all to anybody, including
the store management, in not fixing the air conditioning.
(1) The management team had to work in the restaurant as
well, and I am sure they, you know, we would not have been
particularly happy about working in cold temperatures, that
