Day 037 - 14 Oct 94 - Page 34

MR. MORRIS: It seems to be the same; I do not know if it is
       identical.

MS. STEEL: It is not. That is the old version; there is a new
one. But I think they are by and large the same, apart
       from the actual nutrient content.

MR. MORRIS: They are difficult to get hold of. I have been to
three stores myself. They did not have any ingredients
       information at those stores.

MR. JUSTICE BELL: The point is, if I am going to be asked to
refer to the very up-to-date one, at some stage I ought to
have one. That is all. We need not get bogged down on it
       now, from some source.

MR. RAMPTON: My Lord, here is one, June 1993.

MR. MORRIS: Robert has got about 50 of them. No wonder we
cannot get them from the stores!

MR. JUSTICE BELL: You carry on.

  MR. MORRIS: Mr. Cox ----

MR. JUSTICE BELL: Are you going to ask him to look at these or
       can I put them away?

MR. MORRIS: I just want to say -- I do not know where that
       came up actually.
       A. I have seen it.

  Q. That was a side issue, but you did go on to say in your
statement that if the Plaintiffs -- I did refer you to a
bit in that document, did I not, sorry?

MR. JUSTICE BELL: Mr. Morris, sit down for a couple of
minutes. Find where you are, then we will move on.

MR. MORRIS: Yes. OK, I have got organised now. We were
coming on to "Nutrition: A Question of Balance", a
document that was, I think, put at the front of volume
VI. If you look, if you open it out and look at the
left-hand-side under the picture of the people on
       bicycles?
       A. A nice healthy picture.

  Q. Yes. It says: "At McDonald's we have a responsibility to
help our customers eat a healthy balanced diet".
       A. Yes.

  Q. Is that a responsible statement if it was true?
       A. The degree to which McDonald's have a responsibility
I think is something over which is possible to argue for a
long time. I have already explained my view.

MR. JUSTICE BELL: What you say is you do not think they would
have a responsibility as caterers unless they adopted it
       in some way?
       A. Precisely.
