1 thrust of it -- forget the 2.5 per cent -- is that there
is nothing in it one way or the other is what he said.
     2
MR. MORRIS: We do not accept that.
     3
MR. JUSTICE BELL: No, I know you do not, so you look through
4 it again and see whether you think that holds up.

     5 MISS STEEL: Yes.

6 MR. JUSTICE BELL: If you think it holds up on Mr. Kouchoukos'
figures, but there is an argument that he has approached
7 it from the wrong direction, do you see what I mean, then
that is all, you can produce that in argument.
     8
         MISS STEEL: OK.
     9
MR. MORRIS: Yes, it is something really not to bring up in
    10 evidence and in cross-examination.

11 MR. JUSTICE BELL: No, you do not have to do that. I mean, the
facts is if you thought you were on to a good point but
12 you were you not sure you understood, then obviously it
might be advantageous to put that to Mr. Kouchoukos to
13 make sure you did it. But you have the material there to
make an attack in the future, if you want to.
    14
MR. MORRIS: Let me just check my notes on that.
    15
MR. JUSTICE BELL: Can you just help me on that? Was there
16 anything built into your calculation which relied on how
many people were eating the meal?
17 A. Was to prepare one sandwich.

18 Q. So would the figures be affected if you had a couple and
              three children?
19 A. No, the scale would have to go into the hundreds or
thousands before you would be able to appreciate the
20 packaging efficiencies that are exemplified there.

21 Q. But it is all based on the premise that they would all
want to have the home equivalent of a Big Mac rather than
22 a roast joint, or something like?
              A. Right, and it would have to be prepared exactly the
23 same with the same amounts, tartar sauce, pickles and
              lettuce, tomato sauce.
    24
         Q. We can put that completely on one side as having any
25 significance whatsoever unless they are choosing to have
two Big Macs and three little ones?
26 A. It would be your choice, if you want to make it at
              home or not.
    27
MR. MORRIS: There were some matters -- maybe we will ask for
28 your guidance on this because we are not under pressure to
finish him this second, but there were matters brought up
29 under the Brian Lipsett heading which were matters of
evidence, not about whether Brian Lipsett can spell a word
30 or cannot spell a word, or whatever.
