2 A. It may well be a manager or a crew member may undertake
3 it, whoever carries out the task should sign it. The tasks
4 vary in degree of difficulty.

6 Q. If, for example, a crew member was asked to do a particular
7 task, would a check be made to see whether they had done
8 it?
9 A. Well, we would check whether the thing had been
10 signed. I guess we train our employees and trust them to
11 carry out the task. If it is cleaning behind the back of a
12 grill, for instance, then it is probably self-evident
13 whether it has been done or not. We trust them to sign off
14 that they -- we trust their integrity that they have done
15 it if they have signed it off. I am afraid to say the
16 majority of the tasks would be done by managers;
17 occasionally they would be done by crew members.

19 Q. What about cleaning shake machines? Who would be
20 responsible for that?
21 A. In most instances, it is the restaurant manager; in
22 some instances it would be a training squad that does it.
23 There is a specific training process to go through to
24 enable you to clean a shake machine.

26 Q. How often is that supposed to be undertaken?
27 A. A shake machine is disassembled nightly. That is the
28 old style shake machine. We have some new ones which are
29 heat machines which do not need breaking down quite as
30 often. They go through a self-pasteurisation process on a
31 nightly basis. They are broken down fortnightly.

33 Q. Are you aware of instances of employees finding maggots in
34 shake machines after they have not been cleaned out
35 regularly?
36 A. I have never heard of employees finding maggots
37 in shake machines.

39 Q. What about managers?
40 A. I have heard a story -- I do not know where it is from
41 -- that maggots have been found in a shake machine.

43 Q. On more than one occasion?
44 A. Just one occasion.

46 Q. Was that when you were in the position you are in now?
47 A. No. This was while I was an Operations Manager. I do
48 not know if it is substantiated or not, but it was a
49 story. It has also been used as the reason why you should
50 clean it out; that is the result if you do not.

52 Q. When you heard the report of the maggots in the shake
53 machines, did you take any steps -----

55 MR. JUSTICE BELL: Was it a report or have you just heard it
56 when people have been training others saying something to
57 that effect?
58 A. It is just something -- there has not been a report.
