     2   MR. JUSTICE BELL:  I would rather they were fitted in any time
     3        when we find we have an hour.  What I do not want to do is
     4        find that there is something we must argue about tomorrow
     5        and risk it making the difference between Dr. Arnott
     6        finishing his evidence and not finishing his evidence.
     7        I do not know whether he will finish his evidence anyway,
     8        but I do not want to have to stop at half past 3 when we
     9        could finish him at half past 4 because we have to argue
    10        about some interlocutory matter.

    12   MR. MORRIS:  Right.  It is not possible we will finish Mr.
    13        Nicholson today, so there should not be any danger in
    14        allowing whatever time.  We will have a talk over lunch how
    15        much time we may need for the urgent matters.

    17   MR. JUSTICE BELL:  If Ms. Steel wants more time I will say we
    18        resume at 2.15.  I would like you to come back prepared to
    19        continue cross-examination of Mr. Nicholson and allowing
    20        something like five or ten minutes to argue, if there is
    21        still an argument, about whether Mr. Rampton should be able
    22        to talk to him between the end of this afternoon and when
    23        he comes back.  Add to that, if you want to dispute that
    24        matter -- if you do not want to dispute it you need not
    25        allow any time -- something like five or ten minutes for
    26        that, and make an estimate of how long your other matters
    27        will take.  Subtract it from quarter past 4 and tell me
    28        when we should start those matters.  We will resume at
    29        2.15.

    33   MS. STEEL:   Can I just say, over the lunch break we remembered
    34        we were supposed to be doing an interrogatory, so we have
    35        done that, and hopefully that is in front of you now.

    37   MR. JUSTICE BELL:  Yes.  Thank you.

    39   MS. STEEL:   We would like to deal with that this afternoon,
    40        because obviously it relate to things that we have to sort
    41        out over the break.  We are trying to get witness
    42        statements at the moment from other witnesses, and also
    43        supplementary statements from ourselves.

    45        The other thing is that we are trying to deal with the
    46        appeal, and despite the fact that on the very day that we
    47        got the sealed judgment I took it up to the appeal office
    48        and handed it in with the correct form, so that appeal
    49        forms would be sent out straight away for us to fill in, we
    50        have not actually received anything from them.  Bearing in 
    51        mind the deadline is this Friday we would like to be able 
    52        to go up there before the office closes at 4.30 this 
    53        afternoon to sort it all out.  I do not know what the
    54        problem is, but it seems ridiculous it is taking 3 and a
    55        half weeks to get forms sent out.

    59   MS. STEEL:   I do not know if the best course is that we deal
    60        with all the legal matters that are outstanding.
