         Q.   You think he was not representing McDonald's?
     2        A.  He certainly was representing McDonald's.  I cannot
              tell you whether it was a major concern.  What I can tell
     3        you is that the form of the food facts booklet and the way
              we dispersed nutritional information has pretty well
     4        remained constant since the first time we put it in place
              until today, and has been sufficient under all laws.

         MR. JUSTICE BELL:  Who is Tom Dentice?  You probably told me
     6        this morning.
              A.  I am not sure that I did, my Lord.  He is one of our
     7        executive vice presidents in McDonald's, senior officer of
              the corporation.

         Q.   He is an administrator rather than of one particular
     9        discipline or professional background, is he?
              A.  He is a senior administrator with -- at that time,
    10        I believe, he had responsibilities over operations.
 
    11   MISS STEEL:  Would you agree that reading this memo of 3rd July
              1986, which was sent to all owner operators, all zone
    12        regional and district managers and all regional operations
              marketing personnel and all officers, that it is quite
    13        apparent that the major reason or a major reason for the
              introduction of these ingredient brochures was to, as it
    14        is put there, blunt the growing interest of state and
              federal law makers for ingredient labelling legislation?
    15        A.  It is stated in this memo as a reason.
 
    16   MR. JUSTICE BELL:  Is there any other reason given there in the
              memorandum?  That is the only reason I -----
    17        A.  I did not realise you were addressing me.  Let me just
              take a minute and look at this again.

         Q.   To be fair, in the second paragraph it says:  "Customers
    19        feel good about our making this information available".
              A.  Those are only the two reasons that I see here.  Let
    20        me just say that when I am giving an answer, I am giving
              it from the perspective of a lawyer in the corporate legal
    21        department as opposed to a senior manager of the
              corporation.

         MR. MORRIS:  Just one question on this document, Mr. Horwitz:
    23        It also says that there are only going to be 100
              distributions to local stores, is that not correct, in the
    24        third paragraph?
              A.  That is correct.

         Q.   Then they would have to pay for any future ones after 
    26        that? 
              A.  That is correct.

         Q.   I think this is coming up later on, but one of the demands
    28        of the Attorneys General was that the brochures should be
              provided at no cost to local stores; were you aware of
    29        that as being one of the demands?
              A.  I do not have it in front of -- I do not recall it but
    30        if it is there, it is there.
