     1   MR. RAMPTON:  No.  I am suggesting that I might be given all of
     2        these things, let us say, a week before, not just for my
     3        benefit but for the benefit of my experts, a week before
     4        Mr. Cannon comes back to complete his evidence.  When that
     5        will be of course I do not know.
     6        A.  It is relevant to my reply, when might that be?  Would
     7        it be in the next two months, for example?

     9   MR. RAMPTON:  Mr. Cannon, that is not in my hands.

    11   MR. JUSTICE BELL:  It is a bit, I think, Mr. Rampton, because
    12        it seems to me important that Mr. Cannon comes back as
    13        soon as possible.  Can I make a suggestion?  It may be
    14        completely impossible, but having read your skeleton
    15        argument about relevance, admissibility, one thing I was
    16        going to suggest to Ms. Steel and Mr. Morris is that they
    17        consider calling Miss Bundy after Dr. Millstone because,
    18        quite apart from any technical argument which you have,
    19        since Dr. Millstone is their major witness on additives,
    20        they would then be better able to judge whether, in fact,
    21        they want to call Miss Bundy and, if they do, what they
    22        want to ask her about.  If they saw some sense in that, we
    23        might be able to ask Mr. Cannon whether he could come back
    24        on Monday, 17th which is but a fortnight away.

    26   MR. MORRIS:  Can I just make a point on this?  I neglected to
    27        mention it when we broke up last time.  If you remember, I
    28        had been asked to shift Dr. Millstone from the Tuesday so
    29        that Professor Ashworth can come in, and I did inform the
    30        Plaintiffs at the time, but I forgot to mention it in
    31        court.  Dr. Millstone agreed to come on the Wednesday and
    32        Friday, rather than the Tuesday and the Wednesday.

    34   MR. JUSTICE BELL:  All I am saying at the moment is if
    35        Mr. Cannon were able to come back during the week
    36        beginning Monday 17th, is there any possibility you would
    37        be ready then?

    39   MR. RAMPTON:  I hope so.  As far as I am concerned, yes,
    40        personally, of course, provided I get the documents.

    42   MR. JUSTICE BELL:  Do you know what your position is, Mr.
    43        Cannon?

    45   THE WITNESS:  I would be available in that week but not the
    46        week after.  I shall be in India the week after.

    48   MR. MORRIS:  I would have thought Thursday would be the
    49        appropriate day for us.

    51   MR. JUSTICE BELL:  We can talk about the actual day because 
    52        Mr. Cannon is entitled to go away and see which day might 
    53        suit him best.  Let us work on the basis that Mr. Cannon
    54        may be coming back during that week.  Do you need that
    55        book for what you are writing at the moment?

    57   THE WITNESS:  What I would like to do, as with the date, if I
    58        might, my Lord, is to go away and consider what days I can
    59        work on these books.  I am working on a particular
    60        document at the moment for other purposes, of course.
