Day 074 - 16 Jan 95 - Page 26

       or is it cul-de-sac?
       A. It is a cul-de-sac. It actually runs behind Royal
Avenue, Smith Street, and there is one more street which is
next to Waitrose which is Walpole Street.

  Q. Yes, if I walk down Smith Street from the Kings Road and
turned left into Woodfall Street, would I be able to carry
on walking and get out in Royal Avenue or would I come to a
       dead end?
       A. No, you would be able to walk through. I do not know
in this map -- no, sorry, no, you would not. No, you will
not be able to go through it because I know the pub is at
the corner -- yes, it is a dead end. It is a dead end,
       sorry.

MS. STEEL: So, of the three or four complaints a year that you
got, you only remember making two visits to residents'
       houses?
       A. That is correct, apart from when I sent out the
invitations. At that time I visited Linda Wells and I also
visited the Secretary of the Royal Avenue Residents
Association -- I do not recall her name -- and that was it.

  Q. You just visited those two for the purposes of the
       invitations?
       A. Yes, regarding the environment/index.html">litter problem.

  Q. How seriously were you taking these complaints?
       A. Extremely seriously because you would not leave your
business in the busy time on Saturday when you are serving
the maximum number of customers and leave the restaurant
and go and try to investigate -- extremely seriously -- and
I do not think, you know, many people apart from
McDonald's, the restaurant manager, who will drive around
the street before they come to work and after they finish
work just to see how the work was carried out the night
       before or during the day.

  Q. But you did not take it seriously enough to visit the other
people who made complaints and ask them about what they saw
       the situation as?
       A. I do not remember and I do not know who you are
       referring to.

  Q. You said there were three or four complaints a year, the
       other people who made complaints.

MR. JUSTICE BELL: Are you assuming that he did not go and
       respond to those or what?

MS. STEEL: He said that he only visited two people. That is
       what I am asking.

THE WITNESS: Those were the immediate thing that somebody had
asked me to come in. If there was a problem like, for
example, like I am suggesting with Linda Wells, when I had
a meeting with Linda Wells, I immediately sponsored four
bins. I also put two bins outside in the Royal Avenue. Of
course, extremely seriously I have, and I actually remember
I even got four, three or four, bins designed and I put
