Day 072 - 12 Jan 95 - Page 51

  Q. Since when?
       A. I would say the majority of 1994.

  Q. I will come back to that in a minute. I have not got any
       letters from the residents associations.

MR. JUSTICE BELL: No. I must say, I have said it more than
once now, I have been very reticent about trying to cut you
short. The reason for that in part is that on some
occasions when I have done that in the past you have gone
on a little longer, or Ms. Steel may have gone on a little
longer, and you have made a point which is relevant.
Whether at the end of the day it will a good point and
carry weight or not (I am not giving any specific example,
I do not have one in particular in mind), I just record
that on occasions when I have been minded to curtail
cross-examination you have gone on a bit and you have made
a valid point. But I must rely on you not to till the same
ground. If you tilled it once you plant your seed on it in
the future with your own witnesses.

MR. MORRIS: I am trying to finish off. It is just because of
the order I have written the notes down, I was trying to
       stick to that.

MR. JUSTICE BELL: What I would rather you did is if you think
you may be going back over something just say, "Can I have
a minute or two?" I will readily agree with that, sit down,
take stock and pick up on a fresh piece of ground, bearing
in mind that you both have put quite a lot to this witness
and a lot is going to depend upon what I make of the
evidence you have called now you have tested Mr. Stump in
       cross-examination.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Just pause for a moment and then pick it up
       again.

MR. MORRIS: You have spoken with people from the residents
       association, yes?
       A. I have on some occasions, yes.

  Q. They have expressed their concerns to you, have they not,
about the environment/index.html">litter, that they believe McDonald's are not
doing their job as far as environment/index.html">litter is concerned?
       A. The main thing we discuss is the problem with the
people who drop environment/index.html">litter. That is the main thing we discuss
and that is evident from some of the letters I receive,
that they understand that McDonald's cannot control
customers, as other retailers cannot control customers, or
trust them not to drop environment/index.html">litter on the streets. They have
expressed concern and I have reinforced their concern by
ensuring them that the trash walks will be completed. That
       would be general ----

  Q. Have they expressed concerns to you about the frequency of
       the environment/index.html">litter patrols?
       A. Verbally, no.
