     2        Managers who would have been more than amenable to look at
     3        anything that they felt was wrong with their hours.

     5   Q.   So, in fact, Siamak may have made a protest about his hours
     6        to anybody between his level and your level?
     7        A.  If he did, he did it extremely quietly and
     8        secretively.  If he had told me -----

    10   Q.   It may have been done but not come to your notice?
    11        A.  Very unlikely, I would have thought.

    13   Q.   So if anyone complained about their hours it would have to
    14        go to you?
    15        A.  No, they could go -- I just said, they could go to
    16        anybody -----

    18   Q.   No, it would come back to you?
    19        A.  It would -- they would probably pass it on to me, that
    20        so-and-so had had a problem with the schedule, could not
    21        work this day or that day or that night and, you know, what
    22        they had done about changing it.

    24   Q.   But crew members would know, would they, that if they made
    25        a complaint, a general complaint, it would get back to you?
    26        A.  They might know that I would find out about it.  I do
    27        not see why that would be a problem.

    29   MS. STEEL:  The close of the store did regularly not finish
    30        until about 3.00 or 4.00 in the morning, did it not?
    31        A.  Hardly -- I cannot remember it hardly ever getting
    32        late.  I mean, there may have been an odd circumstance
    33        where it went to 3.00 or 4.00, but there would have had to
    34        have been some problem, major problem, for it to cause it
    35        to be that late.

    37   Q.   Right.  You do remember it happening on occasions then?

    39   MR. JUSTICE BELL:  Can you actually remember it reaching 3.00 or
    40        4.00?  You said there might have been an odd occasion when
    41        it did for some reason, but can you actually remember?
    42        A.  I cannot remember an occasion where it would have
    43        finished at 3.00 or 4.00, apart from the odd occasion which
    44        would be once a quarter when we would do the all -- right
    45        through the night close.

    47   MS. STEEL:  There were odd occasions when it did not finish
    48        until 6.00 or 7 o'clock in the morning, were there not?
    49        A.  The only times it would go through to that time were
    50        when we had actually scheduled the all night closes which, 
    51        as I said, would be about once a quarter.  It would not be 
    52        the normal closes.

    54   Q.   You would not always be there, would you, for the close?
    55        A.  No, but I could quite easily see at what time the
    56        closes had got out from the clock cards.

    58   Q.   You are not in a position to categorically state, are you,
    59        that Mr. Alimi did not finish at 3.00 or 4.00 a.m. on a
    60        number of occasions?
