Day 021 - 29 Jul 94 - Page 43

1 MR. RAMPTON: Why was this not disclosed beforehand?

2 MS. STEEL: This is a matter of credit.

3 MR. RAMPTON: Does this go to the issue in the case, my Lord?
I do not know if it -----
     4
MR. JUSTICE BELL: Let us see where we get to.
     5
MS. STEEL: Can we just look at page -----
     6
MR. RAMPTON: No. I want to know, first of all, which issue it
7 goes to. If it does go to credit alone, then I have no
complaint. If it goes to an issue, then I will have, in
8 the light of what your Lordship said yesterday, the most
              vigorous complaint to make.
     9
MR. JUSTICE BELL: I would like it put anyway. You put it and
10 I will decide afterwards what, if any, attention I pay to
              it.
    11
MS. STEEL: Right. If we go to page 11 at the end of the first
12 paragraph: "The strategies recognised as effective in
reducing fat intakes include the following". There are
13 various ones there about reducing the consumption of fats,
meat fats, substitution of fat reduced varieties, reducing
14 consumption of high fat meat products, reducing
consumption of fried foods in general. Then it actually
15 jumps over to page 16, and the second one on that page
is: "Avoid consumption of snack foods which are high in
16 fats". So, how does that square with what you have just
              said to us?
17 A. First of all, I might point out, this was written in
1985 and one's views can evolve over a period of years.
    18
MR. JUSTICE BELL: Has your view changed since 1985 on that
    19 point?
              A. Well, I suppose in retrospect it is a bit strong to
20 imply to avoid completely consumption of snack foods.

21 MS. STEEL: Then could we also look at page 5: "However, it
was recognised that to achieve a change of diet requires
22 not only education, but also information about
foodstuffs. The following quotations were directed at
23 food producers, food manufacturers, food distributors and
caterers, and are particularly pertinent" -----
24 A. Sorry, where are you, please?

    25 Q. Page 5 at the top.

26 MR. JUSTICE BELL: We have to find it. I appreciate you are
trying to save time, but let us find it. Where was it on
    27 that page?

28 MS. STEEL: Right at the top, yes.

29 MR. JUSTICE BELL: What is the particular part, just that first
              two lines?
    30
MS. STEEL: No. It is saying that the following quotations
