     4   MR. RAMPTON:  Yes, the application comes first.  If leave is
     5        granted, then the Appeal subsequently.

     7   MR. MORRIS:  Well, I never knew that Mr. Rampton.  Thank you
     8        very much.

    10   MS. STEEL:  If I might add we got the hearing brought on
    11        speedily, despite Mr. Rampton writing a letter asking for
    12        it to be put back until after our witnesses.

    14   MR. JUSTICE BELL:  So it is for that one day, is it?

    16   MS. STEEL:  Yes it is, but that does mean -- I do not know how
    17        long Professor Crawford is going to take but bearing in
    18        mind the Appeal, if it is going to take place, it will be
    19        on Thursday.  We would obviously prefer not to call any of
    20        our publication witnesses before that time.  I have mean,
    21        it may well be an academic question anyway.

    23   MR. JUSTICE BELL:  I think it probably is, is it not?  Yes.  Do
    24        you have anything to say as far as scheduling?

    26   MR. RAMPTON:  Yes, I do.  Rather a lot, I am afraid.  I will say
    27        it now if your Lordship wants me to?

    29   MR. MORRIS:   Shall I?

    31   MR. RAMPTON:  Was your Lordship addressing the defendants?

    33   MR. JUSTICE BELL:   Did you have anything more to say or should
    34        I hear what Mr. Rampton has to say about it?

    36   MS. STEEL:  You could hear what Mr. Rampton has to say about it.

    38   MR. RAMPTON:  Very gracious.  The problem is I foresee and I do
    39        not say necessarily; there may be several problems.  The
    40        first is that I have not yet seen Professor Crawford's
    41        report.  It is no good giving to it me now.  I am not going
    42        to look at it now.

    44   MR. MORRIS:  OK.

    46   MR. RAMPTON:  If it is detailed and imaginative in the way that
    47        his last report was and if I should require help with it, I
    48        do not know that I will be able to get that help before
    49        next Tuesday.  I hope I will be.  I am going to be in Court
    50        all tomorrow as we all are because we have got Mr. Olive
    51        and Mr. Clare coming back.  I see a distinct possibility
    52        that Mr. Clare will not finish tomorrow given the pace of 
    53        things, which means we will be in Court again on Monday.
    54        If I do not have time to prepare for Professor Crawford and
    55        I will not know that until I have read for his report, it
    56        may be I should have to ask your Lordship not to hear him
    57        on Tuesday.

    59        The second thing I would like to say is this.  The
    60        defendants have got Lord Vesty subpoenaed for Thursday.
