1 I think he is available to come after Professor Naismith in
2 the week beginning 20th May. Mrs. Brinley-Codd hopes to
3 speak to him again tomorrow morning. I think Mr. Hill has
4 spoken to him. But he has been sent the relevant part of
5 Dr. Naismith's statement. He says he is familiar with the
6 new material anyway. So it should not take very long for
7 him to do a statement.

9 MR. JUSTICE BELL: No. I, obviously, do not need to stress that
10 time is important, because the sooner the witnesses can
11 come in the better and some notice has to be given. For
12 the time being, I advise you to treat what is in Professor
13 Naismith's report, giving what he says is an update in
14 relation to cancer, as some indication of what Dr. Arnott
15 may say, because it may turn out to be so.

17 MR. RAMPTON: My understanding is that it is more than some
18 indication; it is a pretty fair indication of what
19 Dr. Arnott will say.

21 MR. JUSTICE BELL: Yes. Treat it as that, but you will get a
22 statement in due course.

25 in due course.

27 There is only one other matter I need to mention. We
28 originally fixed Denise Pearce as our first witness on
29 Monday, 10th June, my Lord, to be followed immediately by
30 the publication witnesses. Whether Mr. Nicholson has
31 already given evidence by then, of course, rather depends
32 on what else happens in the meantime.

37 and Fridays. She cannot do the 17th.
