     2   Q.   He was in charge of scheduling for some of the period which
     3        you were Manager at the store in Colchester?
     4        A.  I do not believe I said that.

     6   Q.   OK.  In his statement he said:  "For a period of about
     7        three months I was responsible for the staff schedule".
     8        Then he gives a chart in his statement.  Have you read his
     9        statement?  You must have read his statement because you
    10        have commented upon it?
    11        A.  Yes, I do not remember the chart being in there, to be
    12        quite frank, anyway, yes, I will take your word that it is
    13        there.

    15   Q.   You did comment on the various sections of his statement?
    16        A.  Yes.

    18   Q.   He says in his statement which you have read and commented
    19        on:  "When I was under 18 I regularly worked past midnight
    20        which would be illegal.  You were told to clock out at
    21        midnight and written by the side of that day on your clock
    22        card would be something like, 'Plus X hours bonus' or just
    23         'Plus X hours", and various bits and pieces.  Then he
    24        says:  "Under 18 year-old males working past midnight was
    25        the norm.  In my entire three years at McDonald's, in all
    26        the stores I worked, I doubt whether there was an under 18
    27        year old male full-timer who never worked past midnight",
    28        i.e. he is saying that illegalities were occurring on a
    29        grand scale at McDonald's.  You have said it did not
    30        happen.  Are you saying categorically it did not happen or
    31        it did not happen to your knowledge?
    32        A.  I am saying as far as I can be certain, of which I am
    33        fairly certain, it did not happen during my time at
    34        Colchester.  I certainly was never made aware of Simon
    35        Gidney specifically being asked to work past 12 o'clock
    36        when he was under 18, and I would be extremely surprised if
    37        he did.

    39   Q.   Can you think of any reason why Mr. Gidney should want to
    40        say all that if it was not true?
    41        A.  No.

    43   MS. STEEL:   Just before we leave the scheduling, perhaps you
    44        could get Mr. Gidney's statement out?  It is in the bundle
    45        with the pale blue label on it; I think directly in front
    46        of you it should be.
