Day 119 - 02 May 95 - Page 50

total is 83.28, so again she is "satisfactory".

  Q. You do not need to go through it. Fair enough. If we move
on from that particular document? If people transgress any
of the examples of gross misconduct quoted in the Crew
Handbooks, it says: "Gross misconduct which will lead to
dismissal is defined as any act which is detrimental to the
good conduct of the Company's business".

We can refer to the document, I was just going to ask you,
it is in the Crew Handbook, just for the record, volume XI
tab 1, page 32 of the bundle. Then there is A to N which
I am sure you are familiar with in any event. When it says
"gross misconduct which will lead to dismissal", do those
points always lead to summary dismissal?
       A. Can I refer to it?

  MR. JUSTICE BELL: Yes, do.

MR. MORRIS: Yes, maybe you should get the document out.

MR. JUSTICE BELL: Pink XI, tab 1, page 32.

THE WITNESS: If I could take them one at a time to help you? A
is almost certainly yes; B is certainly, yes; C is
certainly yes; D is yes; E is probably yes, but I can think
of circumstances where the manager might be inclined not
to; F is yes; G is yes because that amounts to theft; H,
not necessarily, I think managers may, it depends upon the
circumstances; I is almost certainly yes; J is yes; K is
yes; L is yes; M, I think most certainly, in most cases
yes, I could possibly imagine -- no, falsifying, that would
be; N, oh, yes to customers.

MR. JUSTICE BELL: To customers, yes?
       A. Yes, that would most certainly be, yes.

MR. MORRIS: Then that would lead to summary dismissal?
       A. Yes.

  Q. Where you are not entitled to pay in lieu of notice or
       accrued holiday pay?
       A. That is right.

MR. RAMPTON: My Lord, I am sorry. This is supposed to be
helpful. One should notice that is the Handbook for 1986,
I think, that Mr. Morris is looking at.

  THE WITNESS: Yes.

MR. RAMPTON: It does develop, in fact, this section as one goes
through the years. I am not suggesting one should look at
it now but I mention that now.

MR. JUSTICE BELL: If there may be any significant difference in
1989, perhaps we should look at it but not otherwise.

MR. RAMPTON: By the time one gets to 1992 one has an additional
       three categories.
