     1        because at that stage nobody had agreed to establish a
     2        recycling plant.

     4   MR. MORRIS:  Bearing in mind that experiment, would you describe
     5        your packaging as recyclable?
     6        A.  All packaging?

     8   Q.   The customer packaging, would you describe that as
     9        recyclable?
    10        A.  Are you talking of anything in particular?

    12   Q.   Well, the paper and the polystyrene cartons, would you
    13        describe would you say your packaging is recyclable?
    14        A.  I think if the cardboard or the paper does not have a
    15        laminate or a coating on it, generally it is recyclable.
    16        If it has a laminate or coating it may not be possible to
    17        separate that laminate or coating, therefore, that would
    18        not be recyclable.

    20   Q.   Are you aware that you had a dispute with the Advertising
    21        Standards Authority over an advert about recyclability,
    22        made claims about the recyclability of your products, and
    23        they ruled that the advertising was misleading?
    24        A.  But not significant, if I remember.

    26   Q.   Were you aware that you referred to your Nottingham scheme
    27        as an example of how you were recycling paper?  Are you
    28        aware that the Advertising Standards Authority said that
    29        you could not make claims about the recyclability of your
    30        packaging if you were not doing it yourself, and that you
    31        said that you were; although it was only a pilot scheme, it
    32        was being done?
    33        A.  I am not informed of the details.  I understand that
    34        John Hawkes in marketing was dealing with that issue.

    36   MR. JUSTICE BELL:  Do you know yourself whether plant pot, coat
    37        hanger, insulation material or filling for duvet has
    38        actually been made from plastic which has come out of the
    39        plant in the Manchester area?
    40        A.  No, I do not.  I do know that this happens in the
    41        United States and I have seen the products there.  I do not
    42        know that anything has come out of the UK plant as yet,
    43        which is why the scheme currently is only just about
    44        viable.

    47        Advertising Standards Authority document, Defendants'
