Day 074 - 16 Jan 95 - Page 58
A. No, it is private property.

MR. JUSTICE BELL: They will go down into someone's, I have to
say, front basement at their peril, would they not?

MR. MORRIS: Yes, and if it is outside the range of your
patrols, however frequently they may be or the distance
covered, there is nothing you can do about it, is there?
A. No. You can go up to a limit where you can, but in
private property every employee was restricted not to go
into ----

MR. JUSTICE BELL: What you say is to some extent it is
impracticable. Even if you go around every half hour
someone is bound to go and drop their clamshell two minutes
after you walk past; someone else is going to drop it into
a front basement area, and someone is going to drop it in
the next street beyond the bounds of the walk. Someone is
going it to be upset about it. The question, in so far as
it is relevant to the case as a whole, is just how bad, if
bad at all, was it in Chelsea?

MR. MORRIS: Then on page 776, back to the Nicholas Scott MP
letter, it was clear, it says here, other concerns are the
environment/index.html">litter in the middle of the paragraph, that Dr. Taylor was
taking up environment/index.html">litter issues; although he did not take them up
at that meeting with McDonald's, he was taking it up with
his MP?
A. That letter I am not aware of because I was not sent a
copy of it.

Q. OK. Did Paul Preston contact you having received this
letter, do you remember?
A. Paul Preston never contacted me, but most of the time
what happened is that we go through the hierarchy of the
structure.

Q. Then just for the record, on page 777 there is the reply
from Mr. Preston to Nicholas Scott MP. This meeting on
778, the memo, this is another meeting, is it, in
February? So there was a meeting in February also, was
there, at the store? That is following -- sorry, I am
getting really confused here. Is it the same meeting that
you attended before? It is a different meeting.
A. The first meeting then must have been at the head
office. I am referring to one which was held at Kings
Road.

Q. Is that the one that is on 778, page 778?
A. I think this is a memo which was sent, yes, after the
meeting where all of us were present.

Q. So, Dr. Taylor at that meeting did bring up about the
environment/index.html">litter situation, yes, because on point two, "We agreed to
look into and, if necessary, intensify the number of environment/index.html">litter
patrols." So it was on the agenda, yes?
A. As I recall it there was discussion on environment/index.html">litter but -----

MR. JUSTICE BELL: I would be surprised if it did not because
Mr. Scott mentioned environment/index.html">litter among the concerns on 12th
