Day 291 - 31 Oct 96 - Page 31
transcripts, which could perfectly well have been done by
just writing down the left-hand side of the page, the day
and page under the name of the witness, and on the right,
topic, and then summarising what the nature of the
practices are or were which you say are inhumane and
cruel.

So I want you to come back in the morning with some kind of
schedule as to the order of the topics and how long they
are going to take, particularly how long you have set aside
for each of the topics. The order may be less important,
but how long you have set aside for each of the topics.

If I am content with that, so be it. If I am not content,
at some time before we finish tomorrow I will ask you to
address me on whether I should lay out a schedule of time
which will be available to you to address me on each topic,
either singly or in harness.

MR. MORRIS: What would be very useful is if Mr. Rampton gave
us a copy of his submissions, his closing speech, and then
it would save a lot of time.

MR. JUSTICE BELL: I do not think it would. I would have
directed Mr. Rampton to give you written submissions if you
had in fact produced written submissions yourself or said
you were prepared to do so and would do so before you
started. I do not think it would be right to direct one
party to give written submissions and not both parties.

MR. MORRIS: But the reality is, whether we gave our written
submissions at the beginning or not, the effect is that
Mr. Rampton has our complete case before he has to give us
any information. So if he has done his closing speech, and
I presume he has, because he has had a long time to do it
----

MS. STEEL: And the back-up.

MR. MORRIS: And the back-up. If he has that, it would be
helpful for us to have it, because then we know which of
the issues ----

MR. JUSTICE BELL: If Mr. Rampton is prepared to do it, then
let him do it. But you know what his case is, because you
have been listening to it on and off for the last two and a
quarter years.

MS. STEEL: It seems to change all the time.

MR. JUSTICE BELL: I do not accept that. That is just a
contentious argumentative remark.

I will need some help from you, Mr. Rampton, to tell me
what your very best estimate is of how long you will
actually want to address me, in addition to whatever you
give me in writing to read.

MR. RAMPTON: I hate to be ----
