1 MR. JUSTICE BELL: It is funny because if we look at -- there we
2 are. I mean, one can see that, generally speaking, the
3 dates in the second column are a month later than the ones
4 in the first, save that when one gets on to page 19 they
5 have to be opened three days before they are packed. It
6 does not make a lot of sense. One wonders whether someone
7 has just put the wrong month in or not.

11 Mr. Bennett, those temperatures on page 19, do you agree
12 that they are satisfactory or not?
13 A. Yes, the temperatures are satisfactory.

15 Q. We looked at page 20, no faults noted. Page 21, under
16 "Visible Contaminants", the third item, there is a cross
17 against "Hide", do you see that?
18 A. Yes.

20 Q. Then in "Defects Noted" somebody has written "hair on
21 hindquarter", have they not?

24 Q. Action taken by that person was "informed slaughter"?
25 A. "Supervisor".

31 What action on receipt of that information do you expect
32 that the slaughterhouse supervisor ought to have taken?
33 A. He will go and check the particular operation which
34 involves removal of the hide, and have a word with the man
35 who is doing it to make sure that he does not leave any
36 hide or hair on the carcass.

38 Q. Hair, I suppose, might be contaminated with pathogenic
39 bacteria, might it not, hair from the hide, I mean?
40 A. The theoretical answer has to be "yes".

42 Q. I am going to ask you at the end of all this a question
43 about reality rather than theoretical possibilities,
44 Mr. Bennett, but there is a theoretical risk of
45 contamination from hair, is there not?
46 A. Yes.

48 Q. Then over the page at page 22, 28th March 1994, it appears
49 that there were no comments to be made about the
50 cleanliness inspection on that date. Do you see that?
51 A. Yes.

53 Q. Now we come to the 29th April 1994 which I think -- I will
54 just check this for you -- was Ms. Hovi's last day, as it
55 happens, 29th April 1994. Again it looks like half hour
56 temperature checks on that day in the boning room. There
57 is one of 4.5 degrees on that page and one of 4.5 degrees
58 on the next. Do you see them? There is one at -----
59 A. On page 23 there is a 4.5.
