Day 117 - 27 Apr 95 - Page 29
lenient sentence after magistrates decided that she had
committed a criminal offence after being pressurised by
store management to do so or face the sack. The manager
was later jailed for six months for inducing her to make a
hoax bomb call claiming that there was a bomb in Burger
King in order to boost McDonald's profits." In fact,
I think Helen Caulderwood was given 120 days or hours ---
A. Hours.

Q. -- Community Service?
A. That is correct.

Q. The Manager was somebody Pattimer Heron?
A. Yes.

Q. There was a third person involved called Lance Green who
was, I think, acquitted in the Magistrates Court?
A. He was.

Q. The company was not prosecuted, was it?
A. No.

Q. First of all, were you aware of this incident at the time
when it happened, well, after it happened?
A. After it happened, yes, I was.

Q. What view did you take of it at the time?
A. Absolutely contrary to anything we would have
supported.

Q. What happened, apart from the fact that they were
prosecuted, to these three people so far as the company was
concerned?
A. All three were severally dismissed.

Q. Mr. Nicholson, thank you very much.

MR. JUSTICE BELL: Do you want to ask Mr. Nicholson anything
today? The sort of thing I had in mind was when you were
asking questions about that profit and loss document, if,
for instance, any of the documents he has referred to,
Mr. Nicholson has referred to or any others you know are in
the bundles which you would like to take the opportunity of
having explained today -- that is all I had in mind -- you
would be perfectly at liberty, of course, to ask
Mr. Nicholson to explain any other document when you come
back to it next week.

MR. MORRIS: Yes.

MR. JUSTICE BELL: But it occurred to me, I have to say, rather
late in the day that if you did want to take the
opportunity today then, of course, you were at liberty to
do so. There you are.

MR. MORRIS: It probably would have been useful if we had
prepared some questions but we have not.

MR. JUSTICE BELL: No, leave it there then unless you do want to
start.
