Day 167 - 02 Oct 95 - Page 51

Office Store Audit critical of the Bath store's performance
review practices with an apparent score of F. It is not
said when this was done, but do you know anything about any
       audit of that sort?
       A. We have audits regularly. The Head Office audit will
probably be a personnel audit and that would have come
quarterly, and if we did receive an "F" we would have done
something about it. I cannot say whether we do or did
not. I have no recollection of it.

  Q. Do you have any recollection about any memos sent to the
Bath store on the subject of performance review practices?
       A. No. It would not even be practice to send a memo if
there was a problem with a performance review, or a series
of performance reviews, then someone would come down. The
Personnel Department would inform someone, normally the
Supervisor or the Operations Manager. He would come down
and speak to us directly. There would be no need to send a
       memo.

  Q. You do not know of any memos critical with any other
practices? Would the same apply -- the Area Supervisor
would come and speak to you ----
       A. That is right. It would be very much sort of a people
based decision rather than a paperwork exercise.

MR. MORRIS: That line, "critical of other practices", it
applies to the store audit. That is my bad grammar there.

MR. ATKINSON: I will not ask you anything about the
temperature log of the kitchen freezers which shows on the
log the incorrect temperatures. I will leave that to
Mr. Morris. So far as Mike Logan is concerned, are you
aware of the circumstances in which he resigned in 1994?
       A. I am, yes. He ----

MR. JUSTICE BELL: We have just had your statement.

MR. ATKINSON: First of all, what year did Mr. Logan resign in?
       A. 1994; November 1994.

  Q. Are you aware as to whether or not he made any complaints
to the, I assume that is the Department for Employment?
       A. He did. He -- after leaving us he tried his sculpting
business for about three weeks; then contacted the store
again to ask for his job back and we refused. He then
applied for benefit and, whilst applying for benefit, had
to give them the details of why he left the Company.

  Q. Do you know that personally?
       A. Yes. We received the form in store which we then had
       to complete.

MS. STEEL: Can I have a few moments to get all that down,
       please.

MR. ATKINSON: Now, did you have any reason to challenge
anything that Mr. Logan had said to the Department of
       Employment?
       A. Yes. We challenged all of the points he raised, both
