     5   MR. JUSTICE BELL:  That was not quite the tone -----

     7   MR. RAMPTON:  That is not evidence, what you say, Mr. Morris,
     8        not at this juncture.

    10   MR. JUSTICE BELL:  I do not think I can help you any further on
    11        that.

    13   MR. RAMPTON:  My Lord, can I just add, if there should be a
    14        problem in this area, again I heartily endorse your
    15        Lordship's suggestion that it might be heard in chambers,
    16        but I would go further.  I would require -- I hope your
    17        Lordship would require -- that it should be in proper form,
    18        that is to say, there should be an affidavit, preferably
    19        with the attendance in person, but certainly an affidavit
    20        if possible from the person concerned.  I do not want
    21        Mr. Morris standing up and giving evidence upon which, for
    22        obvious reasons, I place no reliance whatsoever.

    24   MR. MORRIS:  I was not giving evidence.  I was saying I have a
    25        problem in communicating with a potential witness on the
    26        concerns that he has expressed to me -- that is all -- and
    27        I would like some guidance from the court.  I am grateful
    28        to the court for giving some guidance on that.

    30   MR. JUSTICE BELL:  Right.  Let us leave it there.  If you want
    31        to raise a similar topic in the future, do so.  We will
    32        deal with any such case specifically on the basis of any
    33        material which is put before me on either side in relation
    34        to that case.
