3 MR. RAMPTON: Yes, he will be. That is Europe and the UK. That

6 MR. JUSTICE BELL: What I would very much like is if Mr. Stein
7 and Mr. Cesca -- why I am unhappy about Wednesday, subject
8 to asking Mr. Morris and Ms. Steel about it, is if they are
9 served on Wednesday and there is something obvious, are
10 they likely to be very long?

12 MR. RAMPTON: I have not seen them.

14 MR. JUSTICE BELL: Even if they are served on Tuesday they can
15 be read through before the last day of term, which means
16 that if there is any obvious comment to make at least it
17 can be raised then before everyone goes off for the break.

19 MR. RAMPTON: My Lord, I understand that.

21 MR. JUSTICE BELL: I must say my recollection is extremely
22 tenuous, but I think I picked on Friday 16th because that
23 did mean there was a court day or two left after that in
24 case there was any query which could then be raised before
25 people went their separate ways.

27 MR. RAMPTON: That is absolutely right as far as I recall. All
28 I can say is we will do the best we possibly can. We
29 understand the Defendants' desire to have these affidavits
30 before the end of term. If we are having any difficulty
31 then we will simply have to serve drafts come what may and
32 see whether there needs to be any correction.

36 MR. RAMPTON: I do not honestly know what I can do. Mr. Cesca
37 is in South America at the moment. One of the things he is
38 doing, I am instructed, and again I do not guarantee it is
39 right, is verifying the contents of the affidavit, as well
40 as doing other things.

42 MR. JUSTICE BELL: Mr. Nicholson will be served on time we are
43 told. What I have in mind to say is that Mr. Stein and
44 Mr. Cesca's affidavits should be served, if possible sworn,
45 by 4 p.m. on the Tuesday, by which I mean given to you
46 before you go away from court; if not sworn should at least
47 be given to you in draft and then, hopefully, you can be
48 told if there are any differences the following day.

52 MR. JUSTICE BELL: Mr. Nicholson's sworn by the end of the week,
53 so put him on one side. Mr. Nicholson's affidavit in
54 relation to Europe and the UK you will receive on time,
55 albeit at the last moment. Mr. Stein and Mr. Cesca will be
56 served on you sworn, as I understand it, Mr. Rampton on
57 Wednesday 21st?
