Day 174 - 17 Oct 95 - Page 45

cross-examined, it might become clear that these two people
have been sacked for union activity. What do you say about
       that?
       A. No, I cannot say "yes", because I do not know when
Mr. Trimble left our Company. I have indicated that a
number of times. If he was in our employment and was
available, he would have been asked by the Company to
appear at the hearing. But, you know, I think your
question was did we purposely not have him available; and
I have indicated a number of times that he was no longer in
my employment, but when he left I cannot say.

MS. STEEL: I have already asked if you did not make any
attempts to try and get him to come back, whether or not he
       was still in your employment.

There is just one other matter I wanted to ask about, which
is the letter on page 1153 from Dave Trimble. Have you got
       that there?
       A. Yes.

  Q. It is addressed to "Dear Tom". Who would that be?
       A. That would have been the supervisor, operation
       supervisor.

  Q. Operation supervisor. What was his full name?
       A. Sorry -- Tom Cullen.

  Q. Cullen? The same one that was involved in the 1979
dispute? I think there was a Thomas Cullen -----
       A. Well, he was working for me in 1979, yes.

  Q. I do not -- yes, sorry, I should not have put it like
that. The same Thomas Cullen that signed the same petition
       as Mr. Trimble?
       A. Yes.

  Q. As your supervisor had been informed of this matter, would
he not have brought it to your attention?
       A. He should have, but he did not.

MR. JUSTICE BELL: When was it that the supervisor knew, do you
       know?

MS. STEEL: The letter is dated 29th June, 1985.

THE WITNESS: I do not know.

MS. STEEL: It actually says "today", that Connor McCann -----

MR. JUSTICE BELL: Which page are you looking at?

  MS. STEEL: 1153.

MR. JUSTICE BELL: You have not so far -- and I have made a note
to that effect -- suggested that Mr. Mehigan had any part
in the decision to dismiss. So, unless you do put that,
I assume you are not making that allegation. If you are
making that allegation, you should put it. I have not made
any decision about it, but it may be one thing for a
