Day 193 - 28 Nov 95 - Page 34

       A. Yes.

  Q. Mr. Rampton did not ask you to read -- well, he asked you
only to read one particular part. So if you could just
look at number 2 and the bit under that in A, but
especially number 3 and number 6 for a moment.

Number 3 says that: "64 of the 102 persons in the proposed
bargaining unit are under the age of majority as defined in
the Age of Majority in the Accountability Act."

Number 6: "The respondent admits that any membership cards
signed by any of the persons described in paragraphs 3 or 5
       are invalid."

Looking at what is written there, and also going on your
recollection of the first day of the hearing, what do you
consider was Cam's position in respect of under
18-year-olds and union membership? If you feel the
document is too legalistic and you cannot comment, then say
       so.
       A. Can you just ask me that question again? Sorry.

  Q. Looking at what is written at number 3 and number 6
particularly, and also what you recollect of the first day
of the Labour Board hearings, what do you believe was Cam's
position with regard to whether or not under 18-year-olds
should be able to join a union?
       A. I believe that it was his position that people under
the age of 18 could not join a union and that people under
the age of 18 that had signed union cards could ask for
       them back.

MR. MORRIS: Can I also on that issue refer to another document,
which is the statement of Bonnie McLelland?

MR. JUSTICE BELL: If you are going to move on, let me ask a
       question.

(To the witness): What is said in paragraph 3 is that 64
of their 102 persons in the proposed bargaining unit are
under the age of majority, which I take to be 18.
       A. Mmm.

  Q. I have evidence that 67 people signed cards.
       A. Yes. You see -----

  Q. Do you accept that 64 of the 67 were under 18?
       A. No, I do not.

  Q. You do not?
       A. Can I ask who this document was written by? Was
       it -----

  Q. Well, I think it is part of the response on behalf of
Ballantyne Foods. So it is their, as I understand it,
submissions; and that is why I wanted to ask you about
whether you accepted or knew whether 64 of the 67 who
       signed were under 18.
       A. I do not accept that, because the management is not
