     1        grievances procedures which you have given evidence on in
     2        this court, about how fair they are and whatever, does this
     3        look to you as if this is an extract from -- I am sorry

     6   MR. JUSTICE BELL:  Mr. Shaw is the Supervisor; he sent it?
     7        A.  Yes.  He has had a communications day.  He has
     8        obviously sat down with some of his managers in his region
     9         -- if it was the Supervisor, he would only have three or
    10        four -- he sat down with them to cover, it looks like PR in
    11        that particular context, the personnel context.  He is
    12        talking about getting consistent performance reports.

    14   MR. MORRIS:  It seems to be related to this one particular
    15        store, does it not?
    16        A.  I do not know.  I have not had time to read it.

    18   MR. JUSTICE BELL:  I am not sure, it is all salaried.  Newcastle
    19        299, is that one particular store, do you know from your
    20        knowledge of the system such as it is?  Anyway, you put
    21        what you think it is, Mr. Morris, and then Mr. Nicholson
    22        can say whether he can help or not.

    24   MR. MORRIS:  You said there is nothing that gives you any cause
    25        for concern?
    26        A.  No.  I did not answer you.

    28   Q.   Sorry, can you say if there is any cause for concern in the
    29        way that this problem has been approached by the hierarchy?
    30        A.  No, no, I am sorry, I do not know what he is dealing
    31        with here.  He says:  "More communication between managers
    32        re: no shows and lateness, for more constructive and
    33        consistent PRs".  I do not know what that means, unless he
    34        is concerned that within his stores he feels he is not
    35        getting consistency of competing performance reports.  So,
    36        he is going over various points to clear those up with his
    37        managers.

    39   Q.   So in the way that he is dealing with what you feel is the
    40        problem there or possible problem, do you feel they are
    41        dealing with it in the correct way?
    42        A.  I think he is trying to get some consistency.
    43        Supervisors fairly regularly have these communications days
    44        with their managers.

    46   Q.   Mr. Nicholson, are you not concerned that there is no -- it
    47        says on point 5:  "Any illegalities to be signed and
    48        acknowledged in clock card file".  Then it says, possibly
    49        relating to that:  "Any discrepancies to be discussed and
    50        reviewed at weekly managers' meeting".  Do you not feel 
    51        that illegalities are something that should be reported to 
    52        the authorities? 
    53        A.  I do not know what he means by that.

    55   Q.   But if there are some illegalities?
    56        A.  If there are illegalities, I expect them to be
    57        corrected, but I do not know what he means by that.  I am
    58        not the author of this report.  I am not the author of this
    59        letter.  I have no idea what that means or what he was
    60        trying to get at.
