Day 296 - 07 Nov 96 - Page 27

addictive, in a way craving, those are the ingredients that
people who want to keep eating those kinds of foods are
attracted to, hence the 12 spoonfuls of sugar equivalent in
the milkshakes or high salt and sodium content.

Then I was questioning him about, I think, that very
extract that I referred to in the Annual Report at the top
of page 54, and he talked about replacing the lard in the
buns, and all that kind of stuff. He was asked at page 54,
line 15, "When those changes were made that meant your food
was healthier?" Answer, "Yes." So it was not healthier as
part of a balanced diet, or any of the other stuff, or part
of a diet. It was as a recognition of the fact, the common
sense view, that despite his best endeavours, and the
company's best endeavours, to try to put over a line the
       reality is that some foods are healthier than other foods;
some foods are healthy, some are unhealthy, it all depends
on whether there is excess or lack of certain ingredients.
Then he goes on at page 54 about Coca-cola being a good
       source of energy.

If I can just make an additional point, and I will come on
to this now. At the bottom of page 55 he was asked about,
did he know of any documents which the company produced
which explain the link between diet and disease, such as
the 1985 one. He did not know of any, and he would know if
there was any because he was in charge of the leaflets.

MR. JUSTICE BELL: Which the UK company produced, do you mean?

MR. MORRIS: Sorry, the UK. He was responsible for the UK
leaflet. We have heard the UK leaflet we were referring to
earlier, the Good Food Nutrition and McDonald's -- sorry,
that is a pamphlet. The one that points out the links
between diet and disease. Then at the top of page 56, he
was asked, "Why did they not specify the levels of fat
recommended by the government that people should keep?"

MR. JUSTICE BELL: Sorry, I have not understood what you were
saying. The '85 pamphlet does explain the links
       between...?

MR. MORRIS: Yes, that is the one we are relying on.

MR JUSTICE BELL: Diet and disease, you say. What are you
       saying Mr. Oakley accepted?

MR. MORRIS: No, what we said is, were there any current
       documents.

MR. JUSTICE BELL: Any current documents?

  MR. MORRIS: Yes, sorry.

MS. STEEL: I think also the fact that that pamphlet was not
available in stores, it was only available to the public if
they wrote in and asked for it.

MR. JUSTICE BELL: That may be so, but I did not understand what
Mr. Morris was saying Mr. Oakley had said.
