Day 137 - 19 Jun 95 - Page 22

MR. JUSTICE BELL: Sometimes it is less, I think.

MR. RAMPTON: That is not an exercise -----

MR. JUSTICE BELL: It is not just the same. (To the witness):
Is there a ready reason for that?
       A. See if I understand what my Lord is asking. When
I take a look at the 13.1, and then I add up the 5.4, 4.7,
       0.4, 2.6, I come up with 13.1.

MR. RAMPTON: Add the McDonald's figures?
       A. Oh, OK, add McDonald's figures.

  Q. I think that is what his Lordship is talking about. It is
       something I have not done.
       A. OK, let me do. That it would be 32.2.

  Q. 32.2?
       A. Yes.

  Q. Do you know why that error, if it be an error, has occurred
or, if it is not an error, how it is explained?
       A. No, I would say that the somebody or the person who did
this obviously added it up wrong. I , frankly, did not
check that. The specific numbers of 20 per cent and 7.6,
those are all, I know, very accurate. Someone in their
adding this up, it did not.

  Q. We had better just -----

MR. JUSTICE BELL: Sometimes the difference is obviously very
small but, in so far as there is a difference between the
total and the different specific minority columns, if it
turns out to be important, we should add up the specific
columns to get what the correct figure should be under
       minority, should we ---
       A. Yes, we should.

  Q. -- Mr. Stein?
       A. Yes we should. I can tell you that as relates to the
McDonald's numbers, they were taken from, as we talked, D2,
and we can check that and come up with the totals, as my
       Lord has suggested.

MR. RAMPTON: I think I am right that the categories in D2 have
been used by the person who made the table?
       A. That is correct. The categories are identical.

  Q. Except that Asian stands for Asian or Pacific Islander in
       D2.

MR. JUSTICE BELL: He may not have added up the little
individual ones, he may have done his percentage
calculation each time, both on the overall total and on the
little ones, and from time to time got his percentages
       slightly wrong.

MR. RAMPTON: If you look at the last page, Mr. Stein, of this
       D1?
