Day 121 - 04 May 95 - Page 19

MR. JUSTICE BELL: We will have the five minute break now.

                           (Short Adjournment)

MISS STEEL: If you could turn to tab 3, which is the Crew
Handbook for 1989/1990, and turn to page 117 in the
       bundle.

MR. JUSTICE BELL: Which bundle are we in?

  MS. STEEL: Pink XI.
       A. Yes.

  Q. Under the "changes to your hours of work", the second
paragraph: "From to time you may be requested to come in
to work on a shift when you are not scheduled, but you will
be offered the minimum of three hours work. On occasions
you may be asked to continue working past your normal
finishing time. You will be released as soon as the need
       for your service has passed".
       A. Yes, OK.

  Q. You would now accept that it is in the Crew members'
contract that they have to stay on and work extra hours
whether they want to or not, if they are instructed to do
       so?
       A. It is possible under that to ask people to work past
the hours that they were scheduled to work, yes.

  Q. They can be instructed to do so?
       A. Yes, but any reasonable manager would use that very,
very sparingly. He would obviously attempt to meet the
extra hours work by people who wanted to work.

MR. MORRIS: If we look at paragraph 39 on page 14 of Mark
Davis' statement. That was tab 33 again.
       A. Yes, sorry the paragraph number?

  Q. It is tab 33, paragraph 39 on page 14?
       A. Yes, I have it.

  Q. Mark Davis, the last sentence says, he said actually: "As
I mentioned above there is no set policy as to when the
store closes if the crew had not been" -----
       A. Excuse me, I cannot see where you are reading.

  Q. In the middle of the paragraph he is talking about store
       closes?
       A. Paragraph 39.

  Q. Paragraph 39, the third sentence: "As I mentioned
       above ..."
       A. Yes, I have it.

  Q. "... There is no set policy as to when the store closes. If
the crew had not finished by midnight it was understood
that the crew were allowed to leave when the work was done?
       A. Yes.
