Day 203 - 12 Jan 96 - Page 37
A. Yes.

Q. Behind two pages of notes or an embryo statement of
Tracey Milleine, there are some printouts, and if you turn
to the third page of those, we see a date, 29th November
1990, clock card file. Do you have that?
A. Yes.

Q. Then adjustment audit report and then clock card file,
again; and I do not want you to pore over those, but I just
want you to see what kind of documents they are, that the
date is at the end of November 1990 ---
A. Yes.

Q. -- and to take it from me for the moment that they were
used to demonstrate how people's hours were reduced for the
purposes of their payslips, so they got paid for less hours
than they had actually worked.
A. Can I just ask where they came from?

MR. MORRIS: Have you ever seen them before?
A. I do not know.

MR. JUSTICE BELL: Just pause. Let me just take it a little
further. All I am asking you to grapple with at the moment
-- you may well be asked more questions by Mr. Morris and,
for all I know, by Mr. Rampton in re-examination. But all
I am pointing out to you at the moment is that those are
matters occurring at or about the end of November 1990 and
that, if you are right in your recollection that the
information came to you in about May or June and went back
for eight weeks at the most, we do not get back past March
1991; and, even if you are wrong in your recollection of
when you were investigating, you investigated as earlier as
February 1991, when you first took over as Area
Supervisor. If you went back a maximum of eight weeks, one
is unlikely even to get back to the end of November. Do
you understand?
A. Yes.

Q. So there is some documentary evidence here of the sort of
thing you are talking about happening the previous autumn.
Yes, Mr. Morris.

MR. MORRIS: You mentioned that Tracey Milleine was one of the
people that was involved in this, giving you information,
was it?
A. Well, I mean, I think I seem to recall an earlier
incident -- exactly whose name is involved, I cannot
remember -- but when I was speaking to the crew, they did
refer -- I asked them this question about how long this had
been going on and so on, had they been aware of this, and
they said, yes, it had happened before; and then it all
boiled down to one incident which had happened in the past
and which, when I investigated, had been resolved, to my
recollection. So, I mean, I think that it may be wrong of
me to use names. That is what I remember from the time.

Q. Well, the evidence that has been -- well, what the court
has been told by the Plaintiffs is that Tracey Milleine is
