     2   Q.   Problem or not, you do not remember it happening at all?
     3        A.  That is correct, sir.

     5   Q.   Yes.

     7   MR. MORRIS:  You were area supervisor, you were not the Manager.
     8          The Manager presumably would know the fine details of
     9        every schedule hour -- he might not remember it now
    10        but----
    11        A.  At the time.

    13   Q.   His job was to know the details of everybody.  Your job, is
    14        it fair to say, was to check the overall situation to make
    15        sure things were basically running along smoothly?
    16        A.  One of the things I would look out for when I checked
    17        the schedule was to ensure that when the schedule was
    18        prepared that nobody had inadvertently been put down for a
    19        wrong shift either past 10 or past midnight if they were
    20        unable to work it because they were under 18.

    22   Q.   Did you check every person every day who was under 18 to
    23        ensure that never once could one person have worked past or
    24        did you basically check a sample amount?

    26   MR. JUSTICE BELL:  Spot checks or total checks?
    27        A.  I think I mentioned earlier on part of my job was to
    28        maybe take spot checks, so in terms of doing that quarterly
    29        audit for the human resources requirement, I would
    30        certainly take clock cards, and I think again we may well
    31        have had a section on the audit which asked me to, or made
    32        sure that I checked it, so then I would then pull out the
    33        clock cards from those under 18 people.

    35   MR. MORRIS:  Would you check everyone or would you do 25 per
    36        cent?
    37        A.  No.  I think I would check everyone because it was a
    38        legal requirement.  It was not just to make sure broadly;,
    39        it was requirement, so not only would I do spot checks in
    40        terms of coming into the restaurant either at 11 o'clock or
    41        on the close, but I would certainly have had to check it as
    42        part of my HR audit to be submitted quarterly and as I said
    43        about an on-going basis, given the fact that it was a legal
    44        requirement, I would say with a certain amount of certainty
    45        I would have had to check all the under 18s because one is
    46        no good:  One out is all out, is it not?

    48   Q.   That may be the case, yes.
    49        A.  I think if you had one requirement, you may well have
    50        scored an F with the audit.  There was not any leeway in 
    51        terms of "98 per cent is acceptable".  I think it had to be 
    52        a 100 per cent or nothing otherwise the whole audit, 
    53        irrespective if everything else was correct, was graded an
    54        F, but I would have to take advice on that again if my
    55        memory is not wrong.

    57   Q.   Every 3 months an audit was done.  You did the audit, did
    58        you?
    59        A.  Yes.
