Day 184 - 06 Nov 95 - Page 46

       in?
       A. What I understood was that we would start from scratch
and we would negotiate everything, i.e. our gold card --
like, this is afterwards, this is after I talked to Chris
Broom -- i.e. our gold card, i.e. our free uniforms, our
paid breaks, our vacation pay. I mean, there is tons and
I was told we would start from scratch, that we would not
       start with -----

  Q. Told by a union?
       A. No.

  Q. I am just asking.

MR. JUSTICE BELL: She has just said, she was told by Chris
       Broom.
       A. Right. He said that we (and this is what I understood
from Chris Broom) we would have to start from scratch; we
would not start with everything we had and then get bonuses
on top of that; we would have to start from scratch and
       negotiate everything.

MR. MORRIS: Right. That is what you mean by "Sarah did not
inform us that we could lose the benefits we have"?
       A. Right.

  Q. But you mean that McDonald's might cut the benefits that
       you have?
       A. No.

  Q. It would have to be McDonald's, would it not?

MR. JUSTICE BELL: No, it does not .....

MR. MORRIS: Yes, it does. Why would you lose -------

MR. JUSTICE BELL: If you negotiate terms of employment, you
start with a clean sheet, that is all. If you press on
what the witness is saying rather than what you think, you
may find you are getting somewhere.

MR. MORRIS: So, all right. OK.

MR. JUSTICE BELL: You are given the impression by Cam
Ballantyne or for Chris Broom -- remind me of what his
       position was.
       A. As like his position in the store?

  Q. Yes.
       A. He was a Store Manager.

  Q. Right. Did you think he was speaking on behalf of Cam?
       A. No. From what I understood, he was just telling us
what his father had told him. After we had told Cam about
the unionisation attempt, Chris Broom said that he was
told, so, I mean, I guess it could be considered hearsay,
but he said that he was told that we could not talk to Cam
very much about what we are doing and all that, because it
was just basically employees, he had no vote, no say.
