    14        products for long enough before they eat them for that to
    15        actually make much difference?
    16        A.  Well, you can put it to me.

    19        A.  No, because everybody is different.

    21   Q.   So do you think that a lot of people actually keep their
    22        burgers for a long time before they eat them?
    23        A.  I do not know.

    28   Q.   The same point applies to heat, does it not, although less
    29        so, but in terms of in the restaurant, it is highly likely,
    30        is it not, that the vast majority of customers are going to
    31        get their burger, sit down at the table and eat it there
    32        and then?
    33        A.  I would not agree with you.  The same point applies to
    34        heat but more so, not less so.  If you serve a hotter
    35        product, it is going to stay hotter longer after the
    36        customer has purchased the product.

    38   Q.   I think we are at cross-purposes on more so and less so.

    42   MR. JUSTICE BELL:  Is what you are trying to put that, granted
    43        that the reasons Mr. Oakley has given for sticking with
    44        clam shells for certain products apply to take away, they
    45        do not apply, you would suggest, if the purchaser is going
    46        to eat them in the restaurant, and so you could have a
    47        different packaging.  For instance, for a Big Mac according
    48        to whether it is going to be taken away or eaten there, is
    49        that what you are getting at?

    51   MS. STEEL:  Not exactly, because I would not actually accept 
    52        that they could not manage without foam for take-aways 
    53        either, but particularly in the case of in-store eating,
    54        customers could actually manage perfectly well without foam
    55        packaging, could they not?
