Day 195 - 04 Dec 95 - Page 19

MR. JUSTICE BELL: I will cross that out. If Mr. Rampton wants
to ask about it, he can, but it is pretty unilluminating
       anyway.

MS. STEEL: "10. Joining a Trade Union. In the winter of 1987
the air conditioning broke down. Crew members measured the
temperature at the back of store which was 11 degrees
Centigrade and at the counter it was 8 degrees Centigrade"?
       A. Can I just make a correction there? In my first
statement I am giving different temperatures, and I think
the temperatures should be taken out of this, specific
temperature measurements should be taken out of this
statement, because I am not really sure now looking back at
it which one was correct, but I expect my first -- the
temperature I was giving in my first statement could be
more reliable because it was closer to the date than these
temperatures here. So we could just cross out the
       temperature measurements.

  Q. So you are not 100 per cent what the temperature was, but
do you remember it was under the regulations?
       A. It was very cold and I remember it was so cold that we
decided to measure the temperature. I mean, it was just
freezing cold. It was one of the coldest winters in East
       Anglia on record.

  Q. "Someone tried to organise a walk-out."
       A. OK. That should be -- again in my first statement I am
talking about myself and a few others specifically in the
grill area prior to open -----

  Q. So that was you and other people?
       A. And other people, yes.

  Q. Then I think there is a correction to the next sentence?
       A. That is right. Instead of "Ray Coton cotton, the Area
Supervisor", it should read "Ray Coton informed the Area
       Supervisor" about this.

  Q. "Sally was the Floor Manager and T-shirts were given out.
The person who had organised this was warned against
       collective activity"?
       A. That should read: "I, myself and others in the grill
       area".

  Q. So: "I, myself and others who had organised this were
       warned against collective activity"?
       A. That is correct. This should -- I think the next one
should read: "One of the people who was involved in the
       incident".

MR. RAMPTON: My Lord, may we know what the evidence is because
plainly there is a huge inconsistency.

MR. JUSTICE BELL: The difficulty is that Mr. Alimi has not seen
this statement before. It has been served as part of his
evidence when he has not actually seen it.

MR. RAMPTON: I just want to know what the evidence is of this
       witness because this statement -----
