     1        embark on Professor Walker next week, because what I am
              reluctant to have with a scientific expert, as opposed to
     2        one of the executives who may cover a number of grounds,
              is have a gap of several weeks in the middle their
     3        evidence.
 
     4   MR. RAMPTON:  The trouble is that is likely to happen to
              Dr. Arnott anyway.  Professor Walker is one problem and,
     5        of course, Professor Keen is another.  He came but we did
              not manage to catch him in time; he came to court today
     6        only to be sent away again.  He, I think, will have to
              come back in the autumn, again before any of the
     7        defendants' witnesses give evidence.
 
     8   MR. JUSTICE BELL:  What I would like to do next week is to have
              Dr. Arnott in-chief -- it looks as if you will then have a
     9        very considerable time to plan your cross-examination of
              him -- have Mr. Gregory completely; finish Professor
    10        Wheelock.  I have to say I think we would be fortunate if
              we then disposed of one complete substantial witness in
    11        what was left of the week, wherever we have got to.  From
              my aspect, I think you are looking at what shorter
    12        witnesses you could get in or whether you would recall Mr.
              Preston, for instance, or anybody like that.

         MR. RAMPTON:  And Professor Ashworth ----

         MR. JUSTICE BELL:  He is the Tidy Britain.

         MR. RAMPTON:  He is very short.  He is quite short.  He cannot
    16        go on for two days -- he cannot conceivably -- at least,
              not by my reckoning.

         MR. JUSTICE BELL:  He cannot be very long.  I think we should
    18        concentrate on having Dr. Arnott in-chief, Mr. Gregory
              completely, Professor Wheelock finished, Professor
    19        Ashworth and, if there is anything left in the week, time
              to get in any witnesses and finish them, try to do that.

         MR. MORRIS:  So Mr. Walker is removed then?

         MR. RAMPTON:  I am not giving any undertakings, guarantees or
    22        anything else.  I am stating what is.  I am stating what I
              will try and do.  If, for example, Professor Walker has
    23        difficulties in the Autumn, then I shall have to try to
              bring him in next week, but we will do the best we can.

         MR. JUSTICE BELL:  In making that decision, I think everyone
    25        has to accept that where they call a scientific witness
              there can be no question of him being released before 
    26        cross-examination and re-examination have been fully dealt 
              with.

         MR. RAMPTON:  I accept that.

         MR. MORRIS:  It is just that for next week, if you remember,
    29        Dr. Millstone came up to see Dr. Walker last week and he
              is going to come up next week.  It would be better if we
    30        could say to him -----
