Day 042 - 31 Oct 94 - Page 67

MR. RAMPTON: Meanwhile I ask pointedly when these documents
were given to the Defendants and why it is only now that
they are being produced in the middle of cross-examination?

MR. MORRIS: We were given a large number of documents on
Friday.

MR. RAMPTON: On Friday!

MR. MORRIS: I am sorry I spoke, Mr. Rampton.

MR. JUSTICE BELL: Let him finish first, Mr. Rampton. Yes,
Mr. Morris?

MR. MORRIS: And I did not even have a chance to look at them
until the weekend, so that is the fact of the matter.

MR. RAMPTON: But it is now 4 o'clock.

MR. JUSTICE BELL: Yes, Mr. Rampton. Wait for your turn,
Mr. Rampton.

MR. RAMPTON: I am sorry, my Lord.

MR. JUSTICE BELL: Yes, Mr. Morris?

MR. MORRIS: The first document I want to serve on the
Plaintiffs is called Responsible Food Advertising, Proposal
for the Review of Advertising Codes of Practice. It is
published by the National Food Alliance.

MR. JUSTICE BELL: How many copies have you?

MR. MORRIS: I cannot remember whether we have two copies -- we
did not have time to photocopy them.

MR. JUSTICE BELL: No. All I am asking you to do at the moment
is identify the documents which you will wish to put to
Mr. Hawkes. Then, I anticipate, when you have identified
them and we know how many copies you have, we will break
off until the morning and make sure one way or another that
Mr. Rampton at least has a copy, I have a copy and there is
a copy available for the witness.

MR. MORRIS: I am just getting very confused. What I would like
to do is start asking a few questions, having alerted the
witness to the subject matter. I would like to ask a few
questions before we retire for the day.

MR. JUSTICE BELL: He really should have an opportunity to read
the documentation as he had an opportunity to read the
document which had already been produced before he came
into the witness box. Mr. Rampton should have an
opportunity to read it as well.

MR. MORRIS: Yes.

MR. RAMPTON: And, with your Lordship's leave, to speak to the
witness about it.
