MR. JUSTICE BELL: I just do not accept that, I am afraid,
however you may keep declaring it. What I am looking at is
the clock; it is five to three. All I want to know is
whether you would like a break now to help organise
yourselves or whether you would like to keep going. Which
would be the most efficient approach to the matter?

MR. MORRIS: I think a break would be very helpful.

MR. JUSTICE BELL: I will come back at three o'clock.

(Short Adjournment)

MR. MORRIS: What guarantee is there that people who express
opinions in rap sessions will not be victimised by
management?
A. The managers would not know who had voiced what opinion
in a rap session.

Q. Is that the guarantee then? Is that the reason why names
are not taken?
A. Well, that is probably the main reason, I would
suggest, yes.

Q. But the management get a list of the names, you said, of
all the people that attend?
A. They will know there are ten people and they will get a
list of names of people who attend in order to make sure
they get paid for the rap session, yes. They will not know
who said what within that rap session.

Q. There is a management -- there is a McDonald's official
present at every rap session, is there not?
A. Yes, a supervisor from another group would usually
come.

Q. Usually, yes?
A. Well, 99.9 per cent of the time, would come along to
conduct the rap session.

Q. Of course, he will know or she will know the area
supervisor in that area where the store is based?
A. Yes, generally.

Q. I have very few questions left, myself. You said that when
you were a supervisor you told a managers that he must not
lock the crew room?
A. That is correct.

Q. That he could not do such a thing?
A. Yes.

Q. Why is that?
A. I believe you have got to provide a place for people to
sit and eat their meal during the breaks. So -----

MR. JUSTICE BELL: They have nowhere else to go at all, apart
from leave the restaurant, if the crew room -----
A. I think they could have gone and sat on the dining area
