Day 118 - 01 May 95 - Page 51

       A. No.

  Q. Is it true that at headquarters today you get daily or more
regular reports from all over the country on sales, sales
figures? You can press a button and immediately get what
the current sales figures are for each store, for each
       region, is that correct?
       A. I am not sure. I would imagine that information is
       available.

  Q. Yes.

MR. JUSTICE BELL: Daily this is?
       A. I am not sure. I cannot say yes, sir, because I am not
       an Information Services man.

MR. MORRIS: But you imagine it would be?
       A. I imagine all kinds of information is available to us.
I would not use that information. I would have no use for
       it.

  Q. No, I understand. Do you have weekly information available
about the hours worked by staff in any store or in any
       region?
       A. I would have thought that that information could be
retrieved from the computer. I have never had cause to
call for it. That is the report that I call for.

  Q. In the light of that answer I think if documents do exist
then the obligation is on the Plaintiffs to have disclose
them, because this is a matter of issue in the case "on a
weekly basis". I do not know if that can be seen as a
       formal application for the Plaintiffs.

MR. JUSTICE BELL: Do you know what the answer is? Do you know
what happens when the swipe card goes through, whether you
       can ----
       A. I can only give the answer that the Information
Services Director gave do me, and that is that that
automatically sends into the computer the time the crew
person clocked on the time the crew person clocked off and
       from that ---

  Q. At the end of each fortnight?
       A. -- they compile their pay sheets.

  Q. It will do a calculation at the end of the fortnight?
       A. Yes. Now I honestly believe, and I am not a computer
expert my Lord, but if you wanted to know weekly you could
could create a program that would provide you with that
information. I have never asked for it.

  Q. You must be able to do that because if someone only worked
three days that would be less than a week?
       A. Yes.

  Q. Less than a fortnight, and presumably you could print out
from that something which would turn into a pay slip and he
would get his £20 or whatever he had earned, but the
difficulty is that there is a difference between being able
