Day 248 - 13 May 96 - Page 25

       A. I think so, but I do not remember the arrangements,
I do not know that I was even part of the arrangements,
       but...

  Q. Your company considered that the video was impressive did
       it not?
       A. I am sorry, I do not remember the terminology we used
surrounding it. I am not sure I saw it until I saw it in
here, but are you saying to me you have words from a
McDonald's person that said it was impressive?

  Q. Yes.

MR. JUSTICE BELL: Can you say who it was? I mean, does
       Mr. Preston necessarily know?

MS. STEEL: Edi Bensilum, I think.
       A. I think if Edwina thought it was impressive I would
have some believe-ability in her words. She is an honest
woman, one I have known for many years. I do not know that
it was her, of course, but if it was her I would believe
       it.

  Q. Despite the fact that your company thought that it was an
impressive video you chose to show it during the opening
speech made on your behalf as a means of criticising me and
       Mr. Morris?
       A. I do not know that that was the purpose of it being
shown. Again, the preparation of the case, the witnesses,
the documents, I have left that to the professional
       barristers I have retained.

  Q. If, for reference sake, the very impressive bit is in tab
37 of the counterclaim bundle. The final page of that
document. Obviously, a piece of scrap paper that was used
to continue what Miss Bensilum was writing about her
interview with CBS, and the part that is crossed out by two
lines contains that. July '94. The fourth -- you had a
complaint from a school after the video was shown did you?
       A. I think we did.

  Q. OK. The school was upset that McDonald's had tried to use
the video against myself and Mr. Morris?
       A. I have no idea why they were upset. I know there was
conversation between ourselves why I was not involved in.

  Q. Do not close it yet. I am not sure whether I have finished
with it. Now, moving on to publication things
specifically, one thing I am still not sure about is whose
       idea it was to take action against London Greenpeace;
whether it was yours or Mr. Nicholson's.

MR. JUSTICE BELL: He said quite clearly that it was... What do
you mean, to bring the legal action?

MS. STEEL: No, to start taking any kind of action.

MR. JUSTICE BELL: Very well. Ask a question about it.

MS. STEEL: Who was it in the Company, yourself, Mr. Nicholson
