Day 039 - 20 Oct 94 - Page 27

  Q. OK. Is there anything else?

MR. JUSTICE BELL: That is so, is it, Mr. Morris?

MR. MORRIS: As far as I know, that is one of the reasons we
hoped to call Sally Bunday, but she is no longer coming.
I do have some documents somewhere. Is there any
particularly strong reference you want to draw the court to
for the nitrites? You have quite a number. That is all
common ground, you are saying, yes, the dangerous
       properties of nitrosamines?
       A. Oh, yes. I cannot recall ever encountering in a
meeting or a document the suggestion that nitrosamines were
       not very undesirable.

  Q. Could you refer us to one paper that is particularly
strong? Obviously, if it is an official report -----

MR. RAMPTON: I really do think it is a waste of time.
Professor Walker, who is perhaps, at any rate in the eyes
of JECFA and the World Health Organisation, the leading
authority on this question and on whose work their latest
report was largely based, accepts without hesitation that,
at any rate, some of the nitrosamines are potent
       carcinogens.

MR. JUSTICE BELL: That is a fair summary, is it?
       A. I think it is. I would go a little further. I have
never heard anyone suggest there are any nitrosamines that
were not carcinogens, but I have not done an exhaustive
survey. But it is certainly true to say that at least some
       of them are.

MR. MORRIS: I am glad Mr. Rampton says we can rely -----

MR. JUSTICE BELL: That is sufficient for your purpose. It is
then a matter of argument where one goes from there.

MR. MORRIS: Yes. As I say, I am glad Mr. Rampton says we can
rely on Professor walker's evidence, which is slightly
different from what he said yesterday. (To the witness):
Is there any other further point you would like to make on
       this before we move on?
       A. On nitrate or nitrite, nothing over and above what is
in the text that I have provided. I believe that it spells
out my analysis as adequately as I can do now.

  Q. If we move on. The next on my list is BHA, 320?
       A. It starts on page 20 of my text.

  Q. I think we kind of did do them separately when we did them
before. I cannot remember now. This is the most extensive
part of your compound in terms of your evidence, so can we
just deal with -- the intolerances are the main problem,
       are they not?
       A. No, they are not.

MR. JUSTICE BELL: Do you want me to tell you which ones I have
       marked?
