Day 085 - 08 Feb 95 - Page 20
feet off the ground at any given moment, he has broken into
a run. That is what I am asking you.
A. That makes it a lot easier. With your definition
there, I have not seen anyone running with your definition.

MR. MORRIS: Can you explain why slips and falls are the most
common reported accident at McDonald's then, if people are
not running?
A. Walking around is the most commonly performed activity
within McDonald's. You will be walking and moving from
place to place much more often than you would be lifting a
box or doing many of the other activities. Therefore, it
seems logical that accidents would occur move often
undertaking that task.

Q. If they run, they are more likely to slip and fall, are
they not?
A. If they run but, as I have just defined with the
definition of having two feet off the ground, people have
not in my experience run in McDonald's.

Q. But that is, presumably, why you said that running would be
unacceptable because it is more likely to lead to further
accidents, is it not?
A. Yes.

Q. Even if you are walking, the faster you walk, the more
danger there is of slipping, is there not? Is that not
common sense?
A. Yes.

MR. MORRIS: Can we have our five-minute break?

MR. JUSTICE BELL: Yes. We will take five minutes now.

(Short Adjournment)

MR. MORRIS: If we look at 5.10 on page 863 it says: "There was
no safety inspection form, check list and associated
guidance for use routinely by restaurant managers". Is
there currently a specific safety inspection form and check
list?
A. I am unsure what it means by "safety inspection form".
There is not a form of a title but we have the audit
I referred to earlier.

Q. The audit is a general audit, is it not, on all aspects?
A. It is a safety audit, health and safety audit.

Q. A health and safety audit?
A. Yes.

Q. It says it conducts an internal audit. It says: "However,
there was no safety inspection form or check list". You do
not know what they mean by that?
A. I really do not know what they mean. It would be
helpful if I knew what area that was covering because for
electrical safety we have checks done on an annual basis by
outside contractors, and many other pieces of equipment we
have done that way. We have our internal safety audits
