Day 197 - 07 Dec 95 - Page 35
or not.

But there are certain things, looking back with hindsight,
that obviously we should not have been doing, but the
pressure was always there to achieve the figures, hit the
targets, be profitable and, therefore, you cut performance
to achieve that aim. That is the really the way of
summing it up.

MR. MORRIS: We have no further questions.

MR. RAMPTON: Can I just say this, since I will probably not
start cross-examining now until 2.00, I am not at all
certain that I shall finish this afternoon.

MR. JUSTICE BELL: I was going to ask what the -- I do not
think you should feel under any pressure as to time.

MR. RAMPTON: No, because I will be asking Mr. Coton to look at
quite a lot of documents, I am afraid.

MR. JUSTICE BELL: I wanted to ask now because of the witness
who otherwise would be coming up from Wales.

MR. RAMPTON: That is why I mentioned it now because it would
not be sensible for her to come in readiness for anything
much before 2 o'clock tomorrow.

MR. JUSTICE BELL: Is there any point in bringing her up at
all?

MR. RAMPTON: Probably not, because I am sure -- I will not
then feel under any pressure. If I know there is a
witness waiting in court, inevitably, one feels one has to
hurry along a bit. If we finish with this witness
mid-day, then there is always something else we can do,
I am sure.

MR. JUSTICE BELL: What I suggest you do, Ms. Steel, is call
off your witness. Make some arrangement with her for
another date which is convenient with her or get one or
two dates from her and we will fit her in on a date which
is convenient to her. But tell Mrs. Brinley-Codd some
time in advance in case there is a question of McDonald's
calling any other witness whose evidence relates to her
evidence.

MS. STEEL: I do not have a burning desire to call her
urgently, it was because we wanted someone to fill -----

MR. JUSTICE BELL: No, you only did it in response to my
request to find a witness for tomorrow.

We will adjourn now. I would like to deal with the
question of calling of any further witnesses on behalf of
the First and Second, well, it is really the Second
Plaintiff in relation to Colchester as soon as possible
and definitely before we go away at the end of this term.

MR. RAMPTON: Yes.
