Day 195 - 04 Dec 95 - Page 73
and find out?

MR. MORRIS: We have not received anything from the Plaintiffs
yet in terms of any further documentation or indication
about what any further witnesses ----

MR. JUSTICE BELL: That does not answer my question.

MR. MORRIS: No, I understand that. I just cannot say unless
I contact him really. As I say, he does not live in
London.

MR. JUSTICE BELL: Do you have a phone number for him?

MR. MORRIS: I do.

MR. JUSTICE BELL: I will tell you why. How long is Mr. Coton
likely to last? You have got his statement and I can see
that rather than read out your notes in what I will call
the further and better particulars, you might want to ask
him about that.

MR. MORRIS: I did not propose to read out the statements of all
the witnesses, because it might be good to put them in
front of them and ask them to flip through and say, "Do you
agree with that, Simon Gibney's statement which he has
basically averred?"

MR. JUSTICE BELL: Quite frankly, I would not do that.

MR. MORRIS: Obviously, with the notes I would have to ask him
just to put it into sentences.

MR. JUSTICE BELL: He is not going to take more than an hour or
so in his evidence-in-chief, is he?

MR. MORRIS: I do not know. I would have thought on the second
statement that on my notes it might take a little bit
longer, but if the court seems to be moving towards
finishing him off in half a day or something, then we
can ----

MR. JUSTICE BELL: No. If he could complete his evidence in
half a day, so much the better, but I am not driving
necessarily at that. What I am thinking is if he does not
finish in half a day, let us suppose he starts on Wednesday
a 2 p.m., at the moment he will not run very far into
Thursday, so we have -- I do not know, Mr. Rampton, if that
is so or not?

MR. RAMPTON: My Lord, I will a wee bit longer with him than
I was with Mr. Alimi.

MR. JUSTICE BELL: I understand that.

MR. RAMPTON: It is not a day's cross-examination. That is
quite clear on my instructions.

MR. JUSTICE BELL: What crosses my mind is if it were possible
to start him tomorrow afternoon, he is unlikely to go
