Day 123 - 09 May 95 - Page 57
tell you, that is a real shock. I mean, things like that
just happen very rarely.

We have close to 1400 franchisees in the United States, and
at the time, back in the 80s, maybe 800 franchisees and a
very, very small percentage of them, I would say, from time
to time would have, you know, violations. I do not know
what the statistics would indicate. We do not collect any
statistics along those lines, but it is just rare. I mean,
that is a rare situation, a very rare situation.

Again, whether we found out first or whether the
authorities did, the actions that we took in that regard
would have been the same. So, to give you efficient
clarification or provide the court with further
clarification maybe in later testimony by Mr. Stein, he
might shed a little more light on the elements of that, if
that is helpful.

Again -----

MR. JUSTICE BELL: Leave it there, Mr. Beavers. Mr. Morris will
ask another question.

THE WITNESS: My Lord, I was just going to make the point that
we are not perfect. We strive for perfection and from time
to time we make mistakes, but I think the important thing
is that when we make mistakes we admit our mistakes, we
clean them up and go on.

MR. MORRIS: So that was one of your mistakes, yes?
A. Speaking generally?

Q. Yes.
A. If you talk about the McDonald's system?

Q. Yes.
A. Yes, that is a mistake. It was not, you know, a
Company operation but our consumers, our customers, did not
know that.

Q. So you do not keep statistics about violations of the law
that you are supervisors discover in the operations of your
stores? "No", you said?
A. Statistics, you know, no. We probably, if we have
knowledge of violations of law, we will keep records of
that -- for how long, I do not know, but certainly long
enough for us to monitor the progress the operator is
making or a particular manager is making.

Q. Maybe that would be a good time to break?

MR. JUSTICE BELL: If you want to, yes. We will resume at
10.30.

(The court adjourned until the following day)
