Day 168 - 03 Oct 95 - Page 25

MR. RAMPTON: They need to know that.

MR. MORRIS: Unless he has direct knowledge of it.

MR. JUSTICE BELL: No. You cannot call evidence in rebuttal on
matters of credit, save for certain limited exceptions
which you must look up before you call anyone to that
       effect.

MR. RAMPTON: It is not in Mr. Logan's statement.

MR. MORRIS: It is not strictly just credit.

MR. RAMPTON: Then it should have been in Mr. Logan's statement.

MR. JUSTICE BELL: When we come to Mr. Logan, if you intend to
ask questions about it, raise the matter, tell me the basis
upon which you say you are entitled to ask questions. I
will hear argument from you, Ms. Steel and Mr. Rampton or
Mr. Atkinson and I will rule on the matter then.

MS. STEEL: We had evidence from Mr. Horwitz about whether
Mr. Gardner was a vegetarian or not.

MR. JUSTICE BELL: I am concerned with this witness at the
moment and Mr. Logan. Raise it at the appropriate time.

MR. RAMPTON: My Lord, I am very concerned about this because
       I do believe -----

MR. JUSTICE BELL: Leave it there, Mr. Rampton.

MR. MORRIS: Just going back to the rap sessions, you said
something like once every six months?
       A. That is right.

  Q. Is it true that some sessions which you had scheduled,
given notice of, were cancelled because nobody turned up?
       A. They were extra sessions organised at the request of
the Supervisor or the crew, but the records will show we
have a rap session at least every six month.

  Q. Some were cancelled because people did not turn up?
       A. Yes, some were cancelled because the crew, for
instance, turn round and said that they could not make it
on a Wednesday night or on a Tuesday morning or whenever.

  Q. What, all the crew?
       A. Not every single crew member, no, but ---

  Q. The general feeling was -----
       A. -- a number of crew came out -- would, for instance,
come up to us and say they would have difficulty making the
time. We would attempt to reschedule the time and it would
be impossible. We would say: "OK, we will organise one
for you next month" and we would put up a notice to the
effect that if anyone still wanted to come, could they
please come and tell us in some numbers and then we would
be able to organise it again.
