Day 155 - 14 Jul 95 - Page 63
MS. STEEL: I just think that Mr. Rampton implied that the
reason Mr. Magee was not getting any pay rises or whatever
was because he was behaving like this, but if you actually
read it in context, it reads that he started behaving like
that because he got fed up with the way he was being
treated.

MR. JUSTICE BELL: You may be right about that, but I wonder to
what extent Mr. Giardina can help you?

MR. MORRIS: I would think probably nothing, but Mr. Rampton
seemed to think he could help with their case on that
subject.

MR. RAMPTON: He can help about the attitude of the management
to a staff member that behaves in the way that Mr. Magee
accepts that he behaved, of course he can deal with that.

MR. JUSTICE BELL: There we are.

MR. MORRIS: I am quite happy not to continue this line of
questioning as long as all the conclusions that Mr. Rampton
was aiming for when he brought it up, because it was him
that brought this up, are also disregarded. For example,
Mr. Rampton was encouraging the conclusion that that kind
of person should be got rid of because, you know, they are
obviously a liability. I could ask you to conclude, could
I not, Mr. Giardina, that disciplinary action should have
been taken against the management for creating such
disgruntled employees?
A. If I was aware of the situation and that was the case,
that is what I would have dealt with. I would have dealt
with the managers as well.

Q. You said in answer to Mr. Rampton's question about
Mr. Magee's comment about the five star people having lousy
wages, "Well, they are some of the highest paid". But even
for some of the highest paid in McDonald's, it is still
lousy wages, is it not?
A. Not as far as I am aware.

MR. JUSTICE BELL: See if you can help me a bit on that because
Mr. Magee said he started as a green badge in November 1986
at œ2.19 an hour. If you got your five stars, would you
automatically be on the training squad?
A. No, because some people did not really want to go into
that field.

Q. Into training at all?
A. Yes.

Q. But suppose you had worked well and been there for about 18
months and got your five stars, could you get five stars in
18 months?
A. Yes.

Q. Can you give me, from your recollection, any idea of what
someone might then be earning, been there about 18 months,
got their five stars, a time when the basic rate is about
œ2.20 an hour. If it is all too long ago and you cannot,
