Day 204 - 15 Jan 96 - Page 26
number of parts of transcripts you might wish to refer to,
it would help if you were able to provide a list of them,
purely and simply so that when the time comes I can bring
down and the Defendants can bring from home copies of the
transcripts in question.

MR. RAMPTON: My Lord, yes. They are being listed today. What
we will do is fax a copy to the defendants, Mr. Morris can
pass it to Ms. Steel, and we will send a copy over to
your Lordship's chambers.

MR. JUSTICE BELL: Yes. Thank you.

MR. MARK DAVIS, recalled
Examined by MR. RAMPTON Q.C.

MR. RAMPTON: He has been sworn, my Lord. I do not know
whether -----

MR. JUSTICE BELL: No. You were sworn on a previous occasion.
There is no need to take the oath again.

MR. RAMPTON: (To the witness): By your right hand, there is a
yellow volume XB. At tab 33, you should find at any rate
I think now three statements by you. Can you find the last
one, I hope it is the third or the second, which
starts: "This statement is supplemental to the first two".
Have you got that there?
A. Yes, I have it.

Q. Just check that it is signed, will you, at the back at
page 7?
A. It is not.

Q. It is not?
A. Do you want me to sign it?

Q. No. There is a signed version somewhere.

MS. STEEL: If I could just say -- I meant to bring this up
this morning -- neither me or Mr. Morris have signed copies
of the statement.

MR. JUSTICE BELL: It does not matter whether the statements are
signed or not, provided there is no difference between
them, if the witness is going to aver the truth of them.
Signing them merely helps the witness identify that that
was the statement which he or she read.

MR. RAMPTON: That is right. (To the witness): Can you just
flip through it. I am not asking you to read it in any
detail. Just flip through it. (Pause)
A. Yes.

Q. Mr. Davis, is that the statement you made recently in
relation to allegations made by Mr. Ray Coton in this
court?
A. Yes, it is.

Q. Were you here in court at any rate for most of the time
