       looking at environment/index.html">litter.

  Q. In those times that you have been down there, despite the
fact that was the purpose of your visit, you do not
remember more than once or twice whether there was any
McDonald's environment/index.html">litter down there or not?
       A. That is a guess. I would not want to be committed to
that. I am not sure I have seen McDonald's environment/index.html">litter in a lot
of places, not just around my restaurant. I mean, I cannot
-- sorry, I cannot commit myself on that. I am not 100
per cent sure how many times I have seen environment/index.html">litter in that or
how much environment/index.html">litter I have seen in that street.

  Q. You have seen McDonald's environment/index.html">litter in a lot of places. Are
you talking about in your patch or are you talking about in
       London generally or what?
       A. I have seen McDonald's environment/index.html">litter outside McDonald's
restaurants on occasions, you know, walking past
       restaurants.

  Q. Not just your own one, not just the Kings Road one?
       A. No, because I have seen customers drop it, actually
throw environment/index.html">litter on the ground in front of me, you know -----

MR. JUSTICE BELL: Could you just tell me because it is not at
all clear on my copy, beneath Mr. McIntyre's signature
there is a date, what is it, in fact?

MR. RAMPTON: 27th January 1994, my Lord. 27.1.1994.

MR. JUSTICE BELL: Thank you. I am not going to stop you asking
any more questions about Smith Street, but since Mr. Stump
clearly did not make a record of occasions when he has gone
on a environment/index.html">litter inspection of Smith Street, and you are hoping
to call someone who actually lives there and, I assume, is
going to give some positive evidence about it, you have to
think about how far you need to go in testing Mr. Stump's
       recollection.

MS. STEEL: Yes. It is more a case of Mr. Stump has a
responsibility and finding out whether he has discharged
that responsibility, whether he takes it seriously.

MR. JUSTICE BELL: I have said I am not going stop you.

MS. STEEL (To the witness): What were the conclusions of these
checks that you made? What were your conclusions?
       A. Personally, I know environment/index.html">litter is a problem, not just
McDonald's environment/index.html">litter, and it just reinforced the fact that we
have to continue to maintain what we were already doing.
There was no point in stopping or reducing what we were
doing or increasing the area that we cover on the trash
       walks ---

  Q. You say -- sorry?
       A. -- or to basically, well, basically I did not feel
there was a need for change in the system.

  Q. You say not just McDonald's environment/index.html">litter is a problem; you would
recognise that McDonald's environment/index.html">litter is part of the problem?
