Day 263 - 14 Jun 96 - Page 72
very summary form, and there is absolutely no point in
bringing a witness back if what remains are the challenges.

MR. MORRIS: I can carry on, but it is not going to take 10
minutes; it is going to take longer than 10 minutes.

MR. JUSTICE BELL: I would like you to put the challenges now,
and then I can see where you are going on the rest of it,
the rest of what happened there or in relation to any other
occasions. I cannot sit very late, but if I hear you put
the challenges, then I will be able to judge whether it is
worth bringing the witness back on Tuesday afternoon. So
please do that. You have laid your ground.

MR. MORRIS: I do not mind carrying on. I would like to go and
make a phone call for childcare arrangements, because
I find it very difficult to get back in time if I do not
leave by half past; that is all. I am happy to continue
otherwise.

MR. RAMPTON: Well, can I -----

MR. JUSTICE BELL: Please put your challenges now. You can do
that by half past four, and then we will see where we are.
You can do it very quickly, indeed.

MS. STEEL: I have got some more questions, as well.

MR. JUSTICE BELL: How long are your questions?

MS. STEEL: Not a massive amount, but it is just that, I do not
know, between us there is probably at least half an hour.

MR. JUSTICE BELL: We will have to adjourn then. But you must
-- and bear it mind with Mr. Clare -- you must put your
challenges. It is only good advocacy. If you think you
have made some ground on reliability, then you can put your
challenges -- bang, bang, bang -- and get on before you ask
a question too much and muddy the water. That is the way
the pros do it.

MR. MORRIS: If I can just comment on that, which is that we
obviously have a certain way of doing our
cross-examination, which we have done throughout the case,
which we believe has been very effective. It may not be
what normal solicitors do, but, you know, we have to trust
the kind of methods that we have been using up to now.

MR. JUSTICE BELL: For better or worse, I am the judge, and it
has to be effective with me; and I can only tell you what
is likely to be effective with me. We will resume at
two o'clock on Monday.
