Day 274 - 04 Jul 96 - Page 18

MS. STEEL: It was disclosed by them so it should have been.

MR. JUSTICE BELL: Just let Mr. Rampton see it, then let me see
it, then ask Miss Laporte about it.

MR. RAMPTON: We do not believe we did disclose that, my Lord.
No one seems to have ever seen it.

MS. STEEL: That is completely untrue. The Plaintiffs disclosed
       it in October 1993.

MR. JUSTICE BELL: Let me just look at it first. I put it to
Mr. Claire and he confirmed that he had taken it from
Caledonian Road. In fact, it is referred to in his notes.

MR. JUSTICE BELL: Yes. Just pause.

MS. STEEL: If anyone wants to check, it is on page 115.

MR. JUSTICE BELL: There is no need to check anything. What I
suggest is that you merely ask Miss Laporte at this stage
what you want to ask her about that letter.

MS. STEEL: Can I just say it is referred to on page 115 of
       Mr. Claire's notes.

MR. JUSTICE BELL: Yes, very well. What is the date on the
       letter again?
       A. It is February 16th 1990.

MR. MORRIS: Can you just read out the letter, please, and say
       who it is from?
       A. To whom it may concern.

  Q. I have not got a copy in front of me.
       A. It says, "To whom it may concern, we have a problem. A
McDonald's restaurant opened in Moscow on January 31st
1990. Another McDonald's opening means more problems on
all sides. I have enclosed an article from a children's
newspaper. What are we going to do about this? I would
appreciate a response. Thanking you in advance for your
cooperation, respectfully, Peter Taulk." And there is a
       picture of the Moscow McDonald's.

MS. STEEL: Where is he from?
       A. He is from New York.

MR. MORRIS: Do you remember this letter arriving at all?
       A. I cannot say that I do specifically. But--

  Q. If a letter like that arrived at the group, what would
       happen?
       A. Well, because it is a letter of interest as opposed to
a general inquiry, I would be brought along to a meeting
and read it out for discussion there. I mean, he said
"what are we going to do about this". Well, it would be
passed around the group and anybody's opinions would be
       asked for.
