     3        That is the purpose of the survey, to highlight things like
     4        this because, by the same token, over 70 per cent said
     5        "yes" and 12 per cent were unsure.  So, clearly, the
     6        system is happening; it is operating.  It is not operating
     7        100 per cent of the time but it is in place.

     9   MR. MORRIS:  We do not know how often they happen.  We only know
    10        that for at least four months 18 per cent, well, OK.
    11        A.  I suspect ------

    13   Q.   At least 70 per cent within four months.  Halfway down
    14        that, H3:  "We have enough crew to deliver consistent
    15        quality, service and cleanliness".  Only 61 per cent
    16        possibly agreed with that.  Obviously, that does not
    17        mention safety as well.  It seems there that the
    18        implication is that your only concern is that staffing
    19        covers customer needs rather than employee safety in terms
    20        of your monitoring of the crew' opinions on that matter?
    21        A.  No.  I think the reason why the questions are worded
    22        like that is to recognise that crew also understand what is
    23        important about how customers should be served, at what
    24        speed and so on, that they understand, because they work
    25        closely with the customers, that they know they have a view
    26        about what is needed.

    28   Q.   Do you know what an OCL -----
    29        A.  Observation Check List.

    31   Q.   Below that one:  "I have received an OCL in the last
    32        month"?
    33        A.  Observation Check List.

    35   Q.   Yes, what is the purpose of that?  I understand what the
    36        purpose of the Observation Check List is, but why should
    37        they receive it within a month?
    38        A.  It will be to do with the ongoing assessment of them
    39        operating on stations.

    41   Q.   How would that benefit the employee?  Is it part of the pay
    42        review?
    43        A.  Yes, it goes towards the performance review.

    45   Q.   So if people are not receiving their OCL in the times set
    46        down, then they are missing out on a chance of a pay rise
    47        or they could be missing out on chance of pay rise?
    48        A.  They could be, but what actually happens is we do have
    49        a guideline, a very clear one about that.

    51   MR. JUSTICE BELL:  If they have not had an OCL, they get a 
    52        certain percentage anyway --- 
    53        A.  That is right.

    56        A.  Yes.
