Day 074 - 16 Jan 95 - Page 73

MS. STEEL: It is only the next legal day, so it is not that
       surprising.

MR. JUSTICE BELL: The point being that his statement is really
needed in good time before Dr. Jackson and Mr. Clark, it is
       suggested.

MS. STEEL: Yes. I understand the problem. We want to speak to
Mr. North again before the statement is served and we will
try to serve it on Wednesday but we will promise -----

  MR. JUSTICE BELL: This Wednesday?

MS. STEEL: If we promise Thursday at the very latest.

MR. JUSTICE BELL: What I think, unless Mr. Rampton wants to say
anything, you should serve it not later than Thursday,
because that gives a week and a bit including the
       preparation days.

MR. RAMPTON: My Lord, there is another problem which, I am
afraid, as usual, I had not appreciated. I would
respectfully make it a plea for Wednesday for this reason
-- there are two -- first of all, Clark and Jackson are
coming down to London on Monday which is a free day,
Monday, 23rd, to see me, so that we can discuss Mr. North's
report. The other is that Mr. North has been to McKey's
and Mr. David Walker, the head of McKey's, is coming to
       give evidence on the 25th.

MR. JUSTICE BELL: What Ms. Steel said was they hoped to serve
it on Wednesday, and so I will say not later than Thursday
but do your very best to serve it on Wednesday.

MR. RAMPTON: If it is not later than Thursday, that is probably
going to mean 5.30 or 7.30 on Thursday.

MR. JUSTICE BELL: It may be, it may not be; not later than
Thursday during reasonable office hours. Try to get it
over early Thursday afternoon at the very latest.

MR. MORRIS: There was going to be some time if it could be put
aside for any outstanding legal matters but we have not
managed to fix a time. Hopefully, Mr. McIntyre does not
take all day but he might do, it could be done at the end
of that day, but it does not look like -- obviously,
Mr. Ashworth, it is important we try to finish him, if
       possibly, on that day.

MR. JUSTICE BELL: Yes. What I suggest, if you do one of your
lists again of matters you want to raise and give me a copy
and give Mrs. Brinley-Codd a copy. If you can expand on
your topics -- you sometimes have done; you have just put a
title, as it were, but added a few words to say what you
have in mind -- if you can do that, it is easier for me and
possibly those who represent McDonald's to get the measure
of how long it might take.

  MR. MORRIS: Yes.
