MR. MORRIS: Sorry. I am trying to save time, but maybe it does
not save time. Have you got your statement in front of
       you?
       A. Sorry, what -----

MR. JUSTICE BELL: It is yellow X.

MR. RAMPTON: It is XIII, I think, my Lord.

MR. JUSTICE BELL: I would like it to be moved. I was told that
it was now 19 in yellow X, so I faithfully moved it across
and changed my index. It is totally trivial, but it is
irritating. (To the witness) Have you found it now?
       A. Yes.

  Q. If you look at page 6, there is a reference there in
paragraph 16 to an informal meeting with the union. In
paragraph 17, this last telephone conversation,
21st September. Have you found it?
       A. Excuse me, my Lord, tab 41?

  Q. Tab 19.
       A. Sorry.

MR. JUSTICE BELL: Which tab is it?

  MR. RAMPTON: 41.

MR. JUSTICE BELL: 41, yes. If I can just take you through what
I get as the chronology: page 6, paragraph 16, the court
gave its recommendations on 5th September.
       A. Yes.

  Q. You had an informal meeting with the union on
       7th September?
       A. Yes.

  Q. Over the page, paragraph 18, you say: "My meeting with the
union on 10th September". Do you mean 10th September, or
did you mean 7th September -- because you say it is the
only time you met with him?
       A. I must have meant 7th September.

  Q. You had a telephone conversation on 21st September. That
       is paragraph 17.
       A. Yes.

  Q. I have got the picture, rightly or wrongly, that before the
Labour Court, you had spoken to Mr. Mullen on the phone
anyway. Is that right or wrong?
       A. I spoken with him personally, my Lord.

  Q. Mr. Mullen?
       A. Yes.

  Q. On the telephone. Before the Labour Court meeting or not?
       A. No. I had spoken with somebody in the union, if it was
Mr. Mullen, before the Labour Court; but if it was
Mr. Mullen, I cannot recall. I cannot recall at this
