Day 207 - 23 Jan 96 - Page 53

If we just go back to 434, something I have just noticed,
Jason Dixon, another person who has been mentioned in the
case. If we look on Friday in that week, starting
29th May, he is scheduled 12.00 to 8.00, and then 4.00 to
close, 4.00 to close; that is three days in a row. If you
look at 436, which is the following week, 5th June, he is
4.00 to close, 4.00 to close, 4.00 to close, 4.00 to close,
4.00 to close and 10.00 to 4.00. So he has been scheduled
nine days in a row. You accept that is what the
       scheduling -----
       A. That is what it says in the schedule.

  Q. OK. That was something that was raised by the judge.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: I think we can close that file for the moment,
       then.

MS. STEEL: Can I just ask, the green badges and the yellow
badges; people move on to a yellow badge after they have
had their probationary review, do they not?
       A. Yes, that is correct; after they have had the
probationary review, they move on to a yellow badge, even
though some stores in the Bristol area I used to work in
have basically done away with the green badge system; they
just incorporate people into a yellow badge.

  Q. But at the Bath store, people are green badges until they
have had their probationary review, and then if they
       pass ---
       A. Yes.

  Q. -- they become yellow badges; if they fail -----
       A. Their employment would be terminated, so far as I am
       aware.

  Q. Right, OK. There is a complaint in one of the rap sessions
-- in fact, I read it out this morning -- about some green
badges remain green badges for five to six weeks in the
summer. Do you remember that from this morning?
       A. I think I remember the comment, yes.

  Q. Do you remember that happening at times?
       A. No, I do not specifically remember that happening at
       the time.

  Q. Green badges are supposed to remain that way for three
       weeks; is that right?
       A. Yes, three weeks up to, I believe, the last limit is
four weeks, if they wish to terminate their employment.
       That is my understanding.

  Q. What happens if they do not get a performance review --
once they had had a performance review, they would not
remain a green badge, would they?
       A. Initial probationary performance, once they had their
probationary review, they would go from a green to a yellow
       badge.
