Day 079 - 27 Jan 95 - Page 48
MR. MORRIS: Yes. The witness can come back now.

MR. JUSTICE BELL: Would you ask Mr. Walker to come back,
please?

(The witness returned into court)

MR. JUSTICE BELL: Thank you, Mr. Walker. Yes?

MR. MORRIS: If you wanted to bring with you on an inspection an
important person ----

MR. JUSTICE BELL: Do not put in "important" unless you have to;
that really does muddy the water -- "any person".

MR. MORRIS: Yes -- any person, what would be -- I cannot
express it -----

MR. JUSTICE BELL: I will ask the question. (To the witness):
If you asked any abattoir which supplies you with meat to
let you bring into their abattoir or boning room anyone
whom you wished to take with you, or chose to take with
you, would you expect them to agree with that?
A. Unless they had any particular objection to the person,
yes, my Lord.

MR. MORRIS: So they would have to give you a particular
objection, some reason?
A. Yes, and, I mean, I would respect that reason.

Q. Going back to the McKey's visit, the visit of Richard North
to McKey, do you know Richard North?
A. I know of him, yes.

Q. You knew him beforehand?
A. Yes.

Q. What, you have met him socially or at conferences?
A. Yes, and I have read papers that he has written.

Q. Have you got respect for Mr. North?
A. Yes, I have got respect for him as a human being.

Q. So, why was not Mr. North allowed to visit abattoirs as an
expert witness on behalf of the Defendants as asked for by
the court?

MR. RAMPTON: My Lord, Mr. Morris must not mislead the witness.
The court never asked anything at all. The Defendants made
a request and the rest is history.

MR. JUSTICE BELL: I think that is right, in fact.

MR. MORRIS: I do not know if an order was made. It certainly
was suggested that both parties should have expert visiting
rights.

MR. JUSTICE BELL: My recollection is that I could not give any
direction or order any third party to provide facilities
for an inspection. There are certain circumstances in
