     2   Q.   Just to move on slightly, this may sound like a sillly
              question, but what is the purpose of ronald mcdonald's?
     3        A.  He is a spokesman to children.
 
     4   Q.   For what reason?
              A.  An advertising symbol.  It has been around for many,
     5        many years.  He is a character who has become known and
              loved with children on many fronts in an educational
     6        sense, synonymous with McDonald's, the food, the fun
              involved; it is multi-faceted.

         Q.   Is that a part of what is known as "the McDonald's
     8        experience"?
              A.  Is what part of McDonald's experience?

         Q.   ronald mcdonald's and, you know, that kind of thing?
    10        A.  I think for young children if three, four, five, six
              year old age group, I would say it is very much part of
    11        the experience. All you have to do is watch one of his
              magic shows, watch him entertaining a group of children at
    12        a school or conduct safety at swimming or bicycle safety
              class with the local police, it becomes blatantly clear
    13        what power he has in terms of an educational, influencing
              factor on young people.

         Q.   What about an influencing factor in terms of, you know,
    15        what those people might eat, those children, might eat?
              A.  Well, certainly he is a factor.  If he promotes
    16        McDonald's, he is obviously there to help promote the
              business.

         Q.   Right.  So you are selling, you are using McDonald's to
    18        sell your products directly to children -- sorry, you are
              using ronald mcdonald's to sell your products directly to
    19        to children?
              A.  ronald mcdonald's does not sell food.  Ronald
    20        McDonald's is seen in restaurants.  He does not sell large
              boxes of fries or Big Macs.  He never has to children.  He
    21        has never been seen in a McDonald's advertisement selling
              big sandwiches, big fries, drinks to  children ever once.

         Q.   No.  You said he would be a factor in promoting McDonald's
    23        business.
 
    24   MR. JUSTICE BELL:  Yes.  I think because you are using Ronald
              McDonald's to sell your products "directly" to children,
    25        you said in your question, which I think is why the answer
              came as it did.

              A.  ronald mcdonald's is a spokesman to children, yes, on
