Day 057 - 29 Nov 94 - Page 32
it can work out what the calorific value of the highlighted
meals are.

MR. JUSTICE BELL: 64 explains what it is: "We have developed
two sample meal plans to illustrate how McDonald's can be
part of a healthy lifestyle".

MR. RAMPTON: Yes, they are based on the average calorie
allowances for a 16 year-old male and a 46 year-old female,
according to the National Research Council. May I be
entirely clear, my Lord, on what it is that I am being
asked to find?

MR. JUSTICE BELL: You are being asked to try to find some
document or documents which would set out the nutritional
information with regard, for instance, to an egg McMuffin
or a sausage biscuit with eggs, so one can see how many
calories they were and what percentage of those calories
were fat and/or saturated fat, total fat and saturated fat
and so on.

MR. RAMPTON: I am just wondering -- I will obviously do that if
your Lordship asks us to, we will do it -- whether the
information is not, in fact, already there.

MR. JUSTICE BELL: It may be. If, in fact, it is among the
documents and they can be averted to, then there is no need
to look further. That is why I am suggesting it need not
be done today, but it seems to me it is sufficient if
I express a desire to see any documentation there is which
gives the figures.

MR. RAMPTON: It is not in all circumstances sufficient because
I might contest it, but not in this instance.

MR. JUSTICE BELL: All right, it may make a pretty thin
impression if McDonald's say that this illustrates how
their meals can be part of a healthy lifestyle, but have
not even bothered to try to find the supporting
information.

MR. RAMPTON: I said, not in this instance.

MR. JUSTICE BELL: Yes. We will break off there and come back
to your list. If you care over the adjournment to make
sure you have your bundle references for anything else you
want to raise ready?

MR. MORRIS: We will try.

(Luncheon Adjournment)
2.00 p.m..

MR. JUSTICE BELL: Yes?

MR. MORRIS: I believe we were moving on to advertising or
should we deal with the blanked out document in -----

MR. JUSTICE BELL: Why do you not deal with that?
