Day 139 - 21 Jun 95 - Page 38

       A. That is correct. The rest, by the way, in here is
gibberish, too, about a press campaign. There was no press
       campaign.

  Q. Did the management or the Corporation talk to the press
       about the issue?
       A. No, absolutely not.

  Q. If the press contacted you, you never made any statements?
       A. The only thing that I recall is that a neighbourhood
newspaper called my office one day, and I told them that it
was really a matter that they should contact the
owner/operator, because I could not speak for the
       owner/operator.

  Q. But the management of those stores, or the owner/operator,
they never made statements to the press?
       A. To my knowledge, no. The only inquiry was by a small
neighbourhood -- it is a one or two page weekly thing; that
was it. I believe -- if I can, as I am remembering -- that
occurred long after the NLRB had dismissed the petition.
It was not prior to that. They wanted a comment from me
after the entire matter was over, in fact, I think by two
or three months, and I just referred them to the
       owner/operator.

  Q. In there, there is a reference in the next paragraph to
NLRB accepting the employer's point of view as regards the
size of units, as they had done before in other states, and
it says in Hawaii, in New York, and probably elsewhere?
       A. Could you give me a chance to read it?

  Q. Sorry.
       A. (Pause) OK, I have read it.

  Q. As far as Hawaii and New York, and probably elsewhere,
would that be a reference to -- did you have restaurants in
       Hawaii at that time?
       A. There would be restaurants in Hawaii, yes.

  Q. Had you had some kind of similar petition in Hawaii and
New York regarding being the subjects of unit size, kind
       of -----
       A. Since I have been employed, there has been no labour
activity in Hawaii whatsoever -- nothing while I have been
       employed.

  Q. What about New York?
       A. New York? At this time, in 78, we are talking now --
       yes, about 78.

  Q. Or at any time in New York, had there been petitions filed
       in New York?

MR. JUSTICE BELL: Can you remember?
       A. No, I cannot -- not that I recall.

  Q. You see, one could read that -- and, obviously, it is
written with a certain slant, justifiably or not -- but
although they say the employer had found a "new dodge",
