Day 021 - 29 Jul 94 - Page 70

1 throughout the rest of the trial where any documents
served are served in court, on the record, in sufficient
2 numbers. That is on both parties, an obligation on both
parties to serve documents efficiently, so that as we go
3 along our bundles do not wildly differ or whatever.

4 MR. JUSTICE BELL: Can we take it in two stages? Presumably,
Mr. Rampton, there is a list somewhere or one could easily
5 be made of the additional documents which have been handed
              to me?
     6
MR. RAMPTON: My Lord, I do not know -----
     7
MR. JUSTICE BELL: From your side?
     8
MR. RAMPTON: I do not know that I could say there was a list.
     9 I do not know.

10 MR. JUSTICE BELL: There have only been about a couple of
dozen. What I have done when I put them in is I kept Mrs.
11 Brinley-Codd's Post-its on them, so that if I come across
them I will know it was something which was handed in at a
    12 later stage.

13 MR. RAMPTON: What we ought to do on our side is to go away and
try to remember by looking at our bundles probably what
14 new documents we handed in. I believe it right that the
              defendants should do the same.
    15
MR. JUSTICE BELL: I will come to them in a moment. What
16 I would like is the plaintiffs to make a list of the
documents which have been handed in and copies of which
17 I have kept somewhere in my bundles, I would like next to
them where they were put. If, for instance, as I think it
18 happened with most of them, there was a Post-it of
Mrs. Brinley-Codd's with volume this, tab that, next to
19 it, so we know where they are, a copy of that list should
be given to each of the defendants. By the same token,
20 I would like to you make a list of the papers which you
handed in. It should not be too difficult for you because
21 you have kept at least one copy at least yourself, and you
should be able to go through it. If you can remember that
22 it was put at a certain tab in a certain bundle, then put
that on. If you cannot remember where that is we will
23 just have to find it in September.

24 MR. RAMPTON: The other of way doing it is to go through the
              transcript ---
    25
MR. JUSTICE BELL: However it may be but -----
    26
MR. RAMPTON: --- by reference to the index which is jolly
27 helpful in the transcript because you can find your way
              around.
    28
MR. JUSTICE BELL: If you can do that, well and good, but the
29 first thing to concentrate on is to try and make a list of
each of the papers you have handed in? It is basically in
30 your case just been over about the last week.
