Day 204 - 15 Jan 96 - Page 16

out of them was, in my early days, a bit of a problem, but
it was a new job, a new experience for me.

  Q. Cleanliness as a store was something that you let slip?
       A. No, I would not say so. I feel it was -- the four
month PR that was actually done, it was over the summer and
the sales increased dramatically, and it caught me a bit on
       the hop.

  Q. You have agreed in your statement with the summary, so you
agree that the store was not as clean as it should be and
that the quality of closes was poor? (Pause) That was a
       "yes", sorry?
       A. Yes, sorry.

  Q. It is just because "mm" does not come out.
       A. I do apologise.

  Q. Then on the following page under the profit section, the
third sentence says: "Control of the food account could be
better. Find out why problems occur." What were the
       problems?
       A. With my food account?

  Q. Account, yes?
       A. I would say too much waste. The deliveries from our
suppliers were being -- like, fries were being mishandled.
       Fries being mishandled would reduce the yield on the fries;
thus, you get smaller fries, so the quality is not so
good. We had a few major problems with the raw product.

  Q. So your Supervisors were asking you to improve on the
yields of the food that came in through the back door?
       A. He was looking at them, yes.

MR. MORRIS: Could we just have a minute to prepare some
       questions?

MR. JUSTICE BELL: Yes. We will have the five-minute break,
       then.

                        (Short Adjournment)

MR. MORRIS: Do you remember a time when, under Mark Davis,
Simon Gibney did a period of a shift all on his own and the
rest of the crew took an extended break in the crew room?
       A. No.

  Q. You cannot recall that?
       A. No, I am afraid not.

  Q. Including yourself?
       A. I do not understand.

  Q. You were one of the other crew?
       A. As a Floor Manager?

  Q. I do not know whether you were Floor Manager or crew,
       ordinary crew.
       A. I cannot honestly say that as a crew member or a Floor
