Day 167 - 02 Oct 95 - Page 36
We would hope that we could lay hands on them while
Mr. Richards is still in the witness box. But, obviously,
these new allegations, specific allegations, raised for the
first time mean that we have to do some urgent work to find
if the documents do still exist and where they might be.

MR. JUSTICE BELL: What about the document which I
have suggested Mr. Morris might talk to Mr. Atkinson
about? When do you do that?

MR. RAMPTON: That is a different matter. That can either
happen, and I would suggest now it is better that it should
happen after court today, rather than keep a witness
waiting again. It is only a question of whether there are
any bits of that scheduling document that are missing -- we
do not believe there are -- but if Mr. Morris knows what he
thinks is missing, then he could tell Mr. Atkinson after
court today. There is no reason why the witness should be
delayed while that happens this afternoon.

MR. JUSTICE BELL: What I suggest is that Mr. Richards goes into
the witness box now, that when whatever step is going to be
taken with his evidence-in-chief has been taken, he be
asked any questions which either you or Mr. Atkinson wish
to ask him about possible documentation. Then I would
suggest that Ms. Steel and Mr. Morris, supposing we have
got time, ask in a shorter form as possible any questions
they want to ask which are directed at possible discovery.

MR. RAMPTON: Yes.

MR. JUSTICE BELL: That we break off at 4 o'clock anyway which
will allow what would have been quarter hour or 20 minutes
of court time for Mr. Morris to talk to Mr. Atkinson about
the document.

MR. RAMPTON: Mrs. Brinley-Codd has passed me a note which says
that she has already spoken to Mr. Morris and has informed
him that there is nothing further we are able to do to help
him.

MR. MORRIS: That is a slightly debateable point, but she did
contact me, yes.

MR. JUSTICE BELL: You may ask a witness a question about that,
I do not know, but that appears to be your answer at the
moment. Let us see where we got to on that basis. We may
rise about 4 o'clock anyway if there are all sorts of
queries about discovery.

SEAN RICHARDS, sworn
Examined by Mr. Atkinson

MR. ATKINSON: Mr. Richards, give your name as Sean Richards;
is that your full name?
A. It is.

Q. You give your address as the McDonald's Head Office in East
Finchley?
A. That is right.
