Day 246 - 09 May 96 - Page 49

of these Government reports. For instance, one or two of
the ones I was being referred to 21 months ago or 18 months
ago, I know there have been Government publications since
which have changed the recommendations there. They have not
been introduced into evidence, but the only safe course for
me is to make my judgment according to the admissible
evidence I have heard in this court; I cannot make it
according to what appears in Government recommendations.

MR. MORRIS: Do you happen to know the reason why the Plaintiffs
in this case decided not to call Colin Clarke, their own
       expert on food poisoning?
       A. We talked about witnesses this morning being called.
That is a matter strictly for counsel. I have left that
       totally to them.

  Q. Right. Mr. Clarke is someone who has advised McDonald's
outside the court, has he not? He has given advice about
       food safety matters?
       A. I could not say that I know Mr. Clarke. The name is
not familiar to me. He may have consulted the Company, but
I do not personally know him.

  Q. You can put that last file away, please, thank you. I would
like to get out Defendants' list of documents bundle 3.

MR. JUSTICE BELL: This is the original one; is it?

  MS. STEEL: Yes.

THE WITNESS: This one we had this morning, are we finished with
       it for now?

MR. JUSTICE BELL: Put them all on one side. I will ask
Mr. Riley to put them away, if he would be so kind, and you
just concentrate on number 3, please?
       A. OK.

MR. MORRIS: If you can in that file to a document number 81.
It is a series of press reports?
       A. OK, 81.

  Q. Unfortunately, the page numbers are not numbered but I will
just see if I can find it. About a third of the way
through following grazing in Peckham and McDonald's moving
to hospitals, there should be a very large two page thing
from the Daily Mirror entitled "What Whoppers"?
       A. OK.

  Q. Everyone has got them.

  MR. JUSTICE BELL: Yes.

  MR. MORRIS: This one?

MR. JUSTICE BELL: It is about a quarter way through.

  MR. MORRIS: Yes.

MR. RAMPTON: I have only got one article in that tab.
