Day 136 - 16 Jun 95 - Page 12

MR. JUSTICE BELL: That is what I mean. I can see that although
you have had a number of Plaintiffs' witnesses, until
someone actually stands up in the witness box and says
something positive about floor covering, it may not occur
to you that there is anything significant in it, because
pennies drop, some more weighty than others, as time goes
on. But you have plenty of opportunity to ask your own
       witnesses.

All I want to know now is how long you want to consider the
tiles, the plan if you want to think about it, or anything
else Mr. Newton Brown has said. Do not take too long but
just tell me how long you want.

MR. MORRIS: Something like 10 or 15 minutes?

MR. JUSTICE BELL: Yes, I will come back at quarter past 11.

                      (Short Adjournment)

                 Cross-examined by the Defendants

MS. STEEL: How many stores were fitted with Altro flooring?
       A. There were, I do not know the precise number, but there
was quite a few in the three different regions.

  Q. Do you know what percentage of stores, roughly?
       A. No, I do not.

  Q. You have no idea?
       A. No.

  Q. Less than a quarter of stores?
       A. It could be less, it could be more than a quarter of
       stores.

MR. JUSTICE BELL: Can you keep your voice up, please?

MS. STEEL: What about less than a half of stores?
       A. I would say not.

  Q. Sorry, I am not quite sure what you mean by that?
       A. I would say not less than a half of stores within the
system had kitchen areas where there was not any non-slip
       materials.

  Q. Sorry?

MR. JUSTICE BELL: Yes. Are you saying that you think there
were more than half of the stores had non-slip or can you
       just not say?
       A. I would say more than a half of the restaurants had
       non-slip materials.

  MS. STEEL: But Altro -----
       A. Whether it was Altro or a non-slip tiles; from as long
as I can remember in joining the Company, and in the early
days I used to do the feasibility study of floor plans, we
used to designate an area in the kitchen to have non-slip
       material.
