     2        A.  To be more accurate -----

     4   Q.   Normally an outside agency conducted the tests, so they did
     5        not always?
     6        A.  I should say, I should have said "always".  To my
     7        knowledge, in all the cases that I was aware of, an outside
     8        agency did it.  As far as I know, today, lie detector tests
     9        are still given, not in McDonald's -- it is not a part of
    10        McDonald's system -- but they are given for certain jobs.
    11        It is used as a security screen, and, to my knowledge, the
    12        employer is not present when the test is given.  If a
    13        person is interviewing for a US Marshal's job or a job
    14        requiring a high security clearance, the member of the
    15        agency, government agency is not present when that is
    16        given.  That was also the case with us back in the 60s when
    17        that was, when lie detector tests were being used.

    19   Q.   So the ones in the stores where you had control over, you
    20        were never present?
    21        A.  I was never present, and that was the case for all of
    22        my peers.  I want to say it is a policy that you cannot be
    23        present, but I could be wrong on that.

    25   Q.   You said that really they were only used where there was a
    26        suspicion or question of possible dishonesty.
    27        A.  That was in the case of existing employees.

    29   Q.   Right.
    30        A.  But, from time to time, we would recruit individuals
    31        that had previous experience in management for other
    32        companies.  We were interested in bringing them abroad as a
    33        manager trainee.

    35   Q.   In McDonald's?
    36        A.  To McDonald's right.  So we would have ask them to take
    37        a lie detector test to see if there had been incidents of
    38        dishonesty in their work history.

    40   Q.   That was only for people -----
    41        A.  Management candidates.

    43   Q.   But was it for management candidates coming up from being
    44        crew members or -----
    45        A.  Sometimes they had to do that, yes.  Some franchisees
    46        were required -- required their swing managers to do that,
    47        yes.

    49   Q.   Because on those occasions you would not have a suspicion
    50        of dishonesty, would you, or you would not be thinking of 
    51        promoting them? 
    52        A.  That is correct.

    54   Q.   So on those occasions what would you have been asking them
    55        about?
    56        A.  General questions about, you know, similar questions to
    57        the questions that would be asked of those management
    58        recruits:  "Have you ever taken any money before?"  That
    59        sort of thing.  But, generally speaking, when a person
    60        reached that point of being a swing manager and was ready
