Day 192 - 27 Nov 95 - Page 40
Q. Is there anything else on that side which you wanted to
draw the court's attention to?
A. (Pause) OK. Can I go to the other side?

Q. What about the section: "Everyone gets the same increases,
no matter how hard you work or how good an employee you
are"?
A. That is -----

Q. Was that part of the union's -----
A. No, it is not. But I just kind of grouped that one
with promotion, because it is the same idealogy behind it,
right.

Q. So it is not true?
A. No.

Q. OK. If you go down the other side and just take us to the
ones you feel are significant?
A. The second one down: "Employees will be dealt with face
to face with and problems solved promptly with an open door
policy"; we had had that, in effect, before the union
attempts, and, I mean, it did not work, it did not happen.
Like, when I -----

Q. In what way did it not happen?
A. When Rob told me to stand on the street corner and make
a few extra bucks, I went to Cam and I told him, I
said, "Listen, you know, I do not want anyone disciplined.
I do not want it to happen to me again, or anyone else in
the store, for that matter." He said to me, "Well, what do
you want me to do about it?" I mean, it is not my
authority to tell him what to do. Then it proceeded the
next couple of days. Rob took me into Cam Ballantyne's
office and yelled at me. He never apologised, just yelled.

Q. Is there any way that -- one of the criticisms, one of the
claims against the union was that they were making promises
they could not keep?
A. I am sorry?

Q. One of the claims made by the witnesses for McDonald's in
this case has been that the union was making claims which
they could not guarantee?
A. Claims?

Q. Were these intervening employees in any way able to
guarantee problems being solved promptly?
A. No.

Q. If you can take us down the list to any other significant
ones?
A. Fourth one: "You have the ability to acquire extra
hours as desired based on how well you work, not how long
you have worked there"; this is not true. In the
summertime, a lot of day staff, because they were making
above minimum wage because they have been there for longer,
were not allowed to take extra shifts; they were all given
to, like, the younger crew, the part-time -- almost all of
the crew there was part-time, but, you know, just to
