Day 066 - 14 Dec 94 - Page 80

Vicky Carroll, although generally not covering the areas
covered by Mr. Hopkins who was originally intended to
       be -----

MR. JUSTICE BELL: The area was paper processing and any
environmental factors arising out of that. That was the
particular area you were going to look for a substitute in.

MR. MORRIS: Yes. As for Mr. North, he says he is working on
his report. He was prepared to come down and listen to the
evidence of the hygiene witnesses which were originally
booked but they have now been cancelled, so he may not feel
that he has to complete his report under pressure.

MR. JUSTICE BELL: I think he is suffering from a misconception
if that is the way he feels. Can you say that although
those witnesses have gone off, it is still very important
that his report comes as soon as possible? What I want you
to do is to make your decision about whether you are
calling a witness at all in relation to the paper
processing in time to say by the end of the week -- get
some idea of how long it will take for a statement to be
produced so you can tell me about that at the same time.
The sooner the better so far as that is concerned.

MR. RAMPTON: My Lord, some indication should be given of the
areas to be covered because I have the question of whether
I have to reactivate Mr. Bateman or not. Maybe if this
person either is not covering relevant areas or obviously
is not an expert, then I need not bother with Mr. Bateman.

MR. JUSTICE BELL: What we need to know is (1) whether you have
a substitute; (2) who the person is and (3) with some
precision what topics, by which I do not mean to say what
he or she is going to say on the topics, but with some
precision what the topics are. If the answer to question
       (1) is, no, then there we are. If the answer is, yes, you
can give me the information on (2) or (3) and we can
consider whether there should be a date given for serving
the statement and, if so, what the date should be.

       We will resume at 10.30.
