23 MR. MORRIS: The reason is that, obviously, we are not satisfied
24 that our experts were not able to visit abattoirs.
25 McDonald's have given the excuse, they have claimed that
26 their abattoirs did not want any one from "London
27 Greenpeace" (although no-one from London Greenpeace was
28 suggested) to visit their abattoirs. We have not seen any
29 evidence that they wrote to the abattoirs. We have not
30 seen any evidence that they wrote to all 59, or whatever it
31 is, and that they got replies or whatever. So, I am trying
32 to establish whether, in fact, the abattoirs would be
33 expected to comply with McDonald's wishes if it was an
34 important matter, which we believe this case is an
35 important matter.

37 MR. JUSTICE BELL: Yes. He has said that he would expect to be
38 able to go into any abattoir. What I suggest you do is ask
39 him -- you need not refer it to the USA or anything like --
40 would he expect any abattoir to let him take in anyone whom
41 he wished? Then we will see where we get there, but when
42 you have that answer the rest is a comment you can raise
43 with me. It is not for Mr. Walker. Whether it is a valid
44 comment or not is something we can argue, if need be.

46 MR. RAMPTON: My Lord, I think it may be simpler than that
47 because -- I do not know at the moment; Mrs. Brinley-Codd
48 is looking at the correspondence files -- I think the
49 position is that the Defendants were told that Mr. Walker
50 was not willing to ask the abattoirs to entertain a
51 so-called expert on behalf of the Defendants.

53 MR. JUSTICE BELL: By all means ask a question about that if you
54 want. By all means preface it, if you want, with the kind
55 of question which I suggested a moment or two ago, would he
56 expect an abattoir to allow him to take in anyone or would
57 there be any restriction on it?
