Day 119 - 02 May 95 - Page 34

MR. MORRIS: You do not know whether this kind of thing was
happening regularly throughout the country?
A. I would be surprised if it was because we were very,
very strict about the enforcement of employment law,
particularly regards young children.

Q. Yes, but however strict you were, the reality is that it
happened at this period?
A. And the reality is it was picked up. Someone has
written on there.

Q. No, we picked it up, I am afraid to say.

MR. RAMPTON: No, no, somebody has written on the sheet, not the
Defendants have written on the sheet.

THE WITNESS: Someone has written on the sheet "this is an
offence".

MR. RAMPTON: A McDonald's employee has written on the sheet.

MR. MORRIS: The handwriting on it is not from McDonald's
management.

MR. RAMPTON: Could Mr. Morris please make his position clear,
my Lord? Is he alleging that he and Ms. Steel filled in
this sheet or is he accepting that it was done by a
McDonald's employee, which is what Mr. Nicholson was
telling him and he was not listening.

MR. MORRIS: I am saying that the comments were added
afterwards.

MR. JUSTICE BELL: Let us isolate it, first of all. In a
situation like this if you either think you know an answer
or you have a positive case to put, it is often simpler
just to put that to the witness.

MR. MORRIS: The comments that have been written on the sheet
were added afterwards, not by McDonald's.

MR. JUSTICE BELL: Do you know anything about who wrote the
comments on the sheet?
A. No, I do not, but I take it that it is our sheet. It
is our property, it is our comments.

MR. MORRIS: It is disclosed by the Defendants in this case.

MR. JUSTICE BELL: You do not know who wrote it?
A. I have know idea.

MR. MORRIS: I can assure the court -----

MR. JUSTICE BELL: No doubt in due course we can deal with that.
You have done pretty well nearly all the time. You have
to concentrate on what the witness in the witness box can
usefully say, and what has to come from another source or
is comment rather than evidence in any event.
