Day 005 - 04 Jul 94 - Page 68

     1
MR. MORRIS: He is a manager.
     2
MR. JUSTICE BELL: Not a franchisee?
     3 A. Yes.

4 Q. What it would appear to me is happening (but correct me if
I am wrong) is it has been suggested he is not up to much
5 in a number of areas; that includes cleanliness but it
also means that he is not getting the turnover for the
6 cost of labour he is employing because his percentages are
              higher than they should be?
7 A. It could very well be. There are some bits and pieces
I would want to know about before I went that far.
     8
         Q. That is what might seem to come from the letter. What is
9 the position with franchisees? Can they pay what they
              want?
10 A. In terms of pay rates, Sir.

11 Q. If you have a franchisee who felt very strongly people
ought not to be paid less than X pounds?
12 A. He can do as he pleases.

13 Q. He can pay them a bit more and take less profit for
              himself?
14 A. As he sees fit.

15 Q. Does McDonald's interfere with that happening?
              A. We do not interfere with his pay rates. We do not
16 interfere in anything other than maintenance of quality,
              service, cleanliness standards.
    17
MR. MORRIS: So if we move on from Clive Williams, if we go to
18 the -- I hope the tribunal statement of Hatima Heron
which, if someone could help me -- But I think it is 105
19 in section G, No. 5 in that bundle. The problem is I have
some photocopies; I am not sure which pages we are looking
20 at here. This was the situation, was it not, when a
manager was sacked -- in fact, jailed -- for pressurising
21 a staff member to make a bomb hoax to Burger King. Do you
              recall the situation?
22 A. The incident has been well documented.

23 Q. If we go through this document, if we look at the -----

24 MR. JUSTICE BELL: Have you got a reference for that?

25 MR. MORRIS: Let us see, page No. 19, to start off with, pages
19 and 20 of that tab.
    26
         MR. JUSTICE BELL: Which tab?
    27
         MR. MORRIS: It is G5.
    28
MR. JUSTICE BELL: In the same bundle?
    29
MR. MORRIS: G5 of that last bundle.
    30
MISS STEEL: The number is 105, but it only has 5 on the tab.
