Day 182 - 02 Nov 95 - Page 60

down. (Pause) It relates to Portage, Indiana.

MR. MORRIS: Statement of David A. Dudley-Boyden of 1225 West
Greenleaf Avenue, Apartment 306, Chicago, Illinois,
headed: "Anti-union sentiments observed at McDonald's".

"I was employed by McDonald's in Portage Indiana, USA, from
September of 1984 through July of 1989. During this time
I spoke with fellow employees (in a jocose manner, although
in my own mind I actually took the matter quite seriously)
about organizing ourselves and forming a union at
McDonald's. I was overheard by a manager and warned very
sternly, in no uncertain terms, that such talk (even if
conducted in a tongue-in-cheek fashion) would lead to the
termination of my employment. In fact, the manager made it
clear that a person had been fired in the past for
enunciating union sympathies." That is dated
       April 15th, 1995.

MR. JUSTICE BELL: Then the next one I have is
Mr. Anthony Brian. Do you want to read Mr. Brian now, or
do you want to read him when you come back to your Irish
       witnesses?

MR. MORRIS: We might as well read it now, yes. There is no way
we are going to call him, because in fact we cannot even
       trace him.

MR. JUSTICE BELL: He is number 17 in what is now pale blue
volume III. It reads now: 14 Mr. Duncan, 15
Mr. Jenssen -- I have not bothered to move him across,
because I remember that he was called --
16 Mr. Dudley-Boyden, and then 17 Anthony Brian.

MR. RAMPTON: I am afraid I did not anticipate this, and I am
afraid I do not have him here. The reason it matters is
that I notice one or two of the others I have made markings
that there are passages I object to. It is not even -----

MR. JUSTICE BELL: If I can remind you, Mr. Anthony Brian's
statement takes the form of -- is on what I take to be an
Irish standard unfair dismissals claim form, like that.

MR. RAMPTON: I do not know -----

MR. MORRIS: It is in a tab that is headed "dismissal papers of
Anthony Brian" in one of the bundles.

MS. STEEL: I think it is volume 3E.

MR. MORRIS: Volume 13B, pink, we think.

MS. STEEL: I think it is page 61.

MR. JUSTICE BELL: I do not think there is anything which is
obviously hearsay, but there may be some doubt about the
source. Do you want to borrow mine, Mr. Rampton?

MR. RAMPTON: I have now find it, my Lord, thank you very much.
