Day 094 - 01 Mar 95 - Page 20

       A. I do not want to speculate, but I will tell you that
there are, that is the primarily -- I do not know what he
means by, I was told by whom. They do not let -- they have
the responsibility and they have the authority to prevent
that from happening. We do not relied absolutely into the
US DA in this case. We have our own people that do that.
We will not let that happen into our products.

  Q. So you would not take any action if you heard a comment
like that? You would assume that it was not true.

MR. JUSTICE BELL: Can I just make what seems to me to be a
common sense suggestion? There may be a difference between
reading a report of something in a newspaper and actually
having it said to you. Dr. Gomez Gonzalez' reaction might
be different reading about something which is alleged to
have been said by an unidentified person in a newspaper, on
the one hand, and actually while walking around the plant
having a Tyson's inspector saying: "This is what is
happening here". So, if you are saying: "If this was
said, what is your reaction?" you have to make sure he
understands the context in which you are putting it.

MS. STEEL: Have you got the report there?
       A. What report?

  Q. The newspaper report.
       A. Yes, I do.

  Q. In the section: "The price of cheap chicken"?
       A. Yes.

  Q. You see there are two Tyson plants ringed there. The
quotes are just above them. In fact, the inspectors are
named there. If you read that in the newspaper, would it
concern you enough to take any action to investigate
whether it was true, or would you just make the assumption
       that it was not true?
       A. OK. This is not one of our facilities. I cannot
       comment on somebody else's business.

  Q. It is the same company, though, is it not?
       A. It is a different -----

  Q. It might be thought they had the same standards?
       A. While it is the same company, we have a McDonald's unit
that is totally separate from the Tyson facilities to
prevent our competitors from gaining our technology, and
everything else, and the confidentiality of our products.
It is totally separate. Our people are totally separate.
Their management is totally separate from the Tyson
       facility.

  Q. So do Tyson work different standards then in the kind of
       birds that they will use?
       A. I cannot tell you that. I have not -----

MR. JUSTICE BELL: Can we take them separately because I have to
say I am not much moved by the first one about dropping the
chicken in a fresh manure pile and eating it, because
