Day 312 - 11 Dec 96 - Page 49

Mr. Rampton has put: "Also inviting recipients to get
copies printed by Veggies or Arc Print", and he says:
"Note: The reference to parcel post". It should be noted
that if people are getting the copies from Veggies, that is
not the leaflet complained of. That is the leaflet that
       has been ---

MR. JUSTICE BELL: Yes, I understand that.

MS. STEEL: -- agreed to by McDonald's. Page 10, I have
actually got a question on this, which is that I did not
understand the point that joint enterprise is vividly
illustrated by the photographs of the 1989 demo.

MR. JUSTICE BELL: I think I understand what Mr. Rampton means,
but I will invite him to explain to you so you do
understand, if you do not mind, Mr. Rampton.

MR. RAMPTON: My Lord, it is quite simple. Even if it was not
perfectly obvious from the documents, which are earlier
referred to in this submission, that the activities, at any
rate so far as McDonald's are concerned, of the members of
London Greenpeace, including Ms. Steel and Mr. Morris, are
both collective and consensual and aimed at the same
target, which is McDonald's, that can be seen very clearly,
though Mr. Morris was not there -- it does not matter for
this purpose -- very clearly from the photographs of the
       1989 demonstration.

  MR. JUSTICE BELL: Thank you.

MR. RAMPTON: The whole focus of all the members of the group
that were there is to, as they put it, "smash McDonald's".

MS. STEEL: I am not sure -----

MR. JUSTICE BELL: That is the way Mr. Rampton puts it, so
I have to make of it what I will.

MS. STEEL: Can I just ask, then: Is it simply that because
there are a number of people altogether in one place shown
in the photographs, and it is a picket of McDonald's, it
must therefore follow that they are all concerned in a
joint enterprise? Is that what he means there?

MR. JUSTICE BELL: Not necessarily "must". It is another brick,
Mr. Rampton says, in the wall. Whether I think it is and
how much of a wall it is at the end of the day, if it is,
it is the sort of thing I have to decide.

MS. STEEL: Right. But is that all that is being said by that
       point?

MR. JUSTICE BELL: I think so, yes.

MS. STEEL: Right. OK. Just on page 18, it actually starts on
page 17, but it says that "AC knew the fact sheet and the
identities of those responsible for it were of special
interest, whereas RAP did not"; that is Mr. Clare and
       Mr. Pocklington.
