Day 084 - 07 Feb 95 - Page 10

       testing.

MR. MORRIS: Right. If we can have the original documents on
which he based that? Can I make a general point about we
are not happy with documents that are created just for the
purposes of this case in terms of statistics and records.
We want to see original documents which we are not going to
go into now, but that applies to the UK and US accident
statistics, workers' accident statistics. I have not gone
into it in detail but I think there can be a problem with
those kind of documents. It depends, of course, what they
       are based on.

The next is Jarrets: Obviously, our position on McDonald's
suppliers is those that have signed the food specifications
document, basically, give McDonald's the right for access
to their documents which must include copying. The word
"inspection", I believe, is a legal word that covers the
right to have a copy. But, in any event, that is what in
terms of McKey's Mr. Walker said. He said also that
McKey's would have a right to have a copy of any document
at Jarrets. That could be checked out.

I am sorry about this, but I have not actually had time
check the statement of Ms. Hovey. Professor Jackson did
say he had seen documents at Jarrets which he relied upon.
I know we have had some documents from Jarrets. They may
be ones that Professor Jackson saw or exactly equivalent
ones on different days. But, basically, it is the ones
that he referred to. I am trying to do this quickly, so it
may be if it can help you, I can check that out.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: If it be helpful, I can be more specific on both of
those in the next few days.

MR. JUSTICE BELL: Yes. I think the main thing now is to get
through your heads. I would, in any event, as soon as you
can specify precisely which ones they are for any further
argument which arises, but for the moment carry on as you
       are now.

MR. MORRIS: Yes. The other one is documents that Dr. Clark saw
in his visit to McDonald's stores. I can remind the court
that, of course, our witness was not able to see documents,
       Mr. North.

MR. JUSTICE BELL: No. What kind of document was it? Can you
remind me? What area was it in, what field?

MR. MORRIS: He visited three stores in Scotland.

MR. JUSTICE BELL: Yes, I remember that.

MR. MORRIS: He took temperatures of all the freezing units and
chillers. He took samples, a temperature check on the
finished products. If we are able to identify those in the
next couple of days, just to be absolutely clear, but it
would include on page 4 of his statement customer
