sincerely Professor Vogel's signature and he has enclosed
an abstract of his research. There are two other ones that
I could read. There is the statement of Ross Gardner, who
       is in ----

MR. JUSTICE BELL: Say who they are first, because they are not
on my list. Then I will ask Mr. Atkinson whether he is
content that they be read or not. Let us see what they
       are.

MR. MORRIS: Ross Gardner is -- he should be publication.

MS. STEEL: It should be in the CEA section.

  MR. JUSTICE BELL: What area?

MR. MORRIS: Civil Evidence Act Notice, publication witness, and
he is from New Zealand and this was dated 16th November,
1993. Originally, it was in section K under the Civil
Evidence Act statements. In fact, he has got a section all
to himself, section K. He may have been reorganised. I do
not know if Mrs. Brinley-Codd knows. (Pause).

MR. JUSTICE BELL: Do you have anything to say about that?

MR. ATKINSON: I did not realise it was coming up but, looking
at it, I do not think it amounts to very much. The only
thing I would say is that, insofar as it is being adduced
on behalf of the Defendants, I suppose it is being adduced
for the purpose of saying that this particular

MR. JUSTICE BELL: Just let me read it first.

MR. ATKINSON: My immediate problem, my Lord, is just seeing the
relevance of it, quite apart from the question of
       admissibility.

MR. JUSTICE BELL: What I suggest is, let it be read and we will
see what part it plays in the enormous jigsaw in due
course. Let me just make a note. Are you going to read
       it?

MS. STEEL: Yes, I will read it:

"Ross Gardner. New Zealand, 16th November, 1993.

In 1990 McDonald's Systems of New Zealand Limited began to
employ 'Environmental Affairs Officers'. The Managing
Director of McDonald's at that stage was Gary Lloyd. The
job of the 'Environmental Affairs officer' was to talk
about McDonald's environmental policies to various
audiences, usually school children. One such occasion was
at Selwyn College in Auckland. The Environmental Affairs
Officer based most of her talk on the advertisements placed
by McDonald's in all the University newspapers in New
Zealand. However, she took things one step further by
claiming her knowledge of Greenpeace London came not from
reading these adverts but from once being a 'member of
Greenpeace London'. She became uncomfortable once
