Day 099 - 08 Mar 95 - Page 63

you think, if you are able to say, these complaints are
       fraudulent?
       A. Are you referring specifically to foreign objects?

  Q. Deal with them separately, foreign objects?
       A. All the foreign objects will come through my department
as a matter of routine, so we know exactly how many foreign
objects are returned. We do get a number of fraudulent
cases that we can actually prove so. But we normally take
the line that we treat them exactly the same as any other
complaint. With regard to food poisoning, I have -- I do
not know of any case of food poisoning relating to a
McDonald's product that has been proven, sir.

MR. RAMPTON: I was just looking to see whether Mr. Shaun Lynch
is a witness for the Defendants but it does not appear that
he is. One sees Mr. Shaun Lynch was given a free meal
voucher, something like that, in exchange for his three
inch worm. Do you remember reading that?
       A. Yes.

  Q. Does that suggest to you that McDonald's had accepted that
his complaint was valid or not?
       A. Well, as I said, we tend to, even if we feel that the
complaint is fraudulent, we tend to treat it in exactly the
same way so the customer was routinely was sent a meal
       voucher.

MR. RAMPTON: Thank you very much, Mr. Kenny. Would you please
       remain there?

MR. JUSTICE BELL: Do you want to start cross-examining
straightaway or do you want to have the break a little
       earlier to help get organised?

  MS. STEEL: Yes.

MR. JUSTICE BELL: How long do you want?

  MS. STEEL: Ten minutes.

MR. JUSTICE BELL: I will come back to at five to three.

                      (Short Adjournment)

MR. RAMPTON: My Lord, before the cross-examination begins,
I have received now from McKey not quite what we asked for,
in other words, they have not produced the few A4 sheets
mentioned by Professor Jackson. What they have done -- I
do not know, it is a matter for your Lordship, it is
secondary evidence obviously -- is produce a list of all
the tests with their results done on that day, 12th January
1994, at Milton Keynes and at Scunthorpe.
The total number of tests done on that day for total
bacteria counts E.coli 0157 and contact plates, or swabs,
       is 162 for that day.

I am not willing to give out copies of the list at the
moment because it names the suppliers. It is our intention
to blank out the names of all the suppliers except Midland
