Day 115 - 06 Apr 95 - Page 66

he would not either, but he can go on into the week of
       26th.

MR. JUSTICE BELL: How long in-chief?

MR. RAMPTON: I am sorry, my Lord, two days I think. It might
be a day and a half.

MR. JUSTICE BELL: What would be helpful is if when you come
back at the beginning of next term you can give an estimate
of how long you think between you cross-examination of
       those witnesses will take.

MR. RAMPTON: My Lord, I would also like, please, a fax from the
Defendants confirming the names of those witnesses who are
definitely going to give evidence on the employment issue,
so I can fill up July with the witnesses I need to respond
       to.

MR. JUSTICE BELL: I will leave that where I did. When you come
back at the beginning of next term, whether it is done by
fax or you turn up with a sheet of paper or read it out in
court, I would like you to give me the names of those who
have made a positive response. If you can do that and give
time estimates for cross-examination, subject to the
reservations which you have just expressed, that would be
       helpful.

MR. MORRIS: The Plaintiffs have served another statement today
       of David Kouchoukos.

MR. RAMPTON: It is something your Lordship asked for clearing
up these figures. It will be, if not already, the subject
of a Civil Evidence Notice. He is in America. I do not
       propose to call him back.

MR. JUSTICE BELL: Have you had time to read it?

MR. MORRIS: Very briefly. Some of it is very difficult to
       read.

MR. JUSTICE BELL: Read it properly over the break. That can be
one of the things you talk to me about after Mr. Nicholson
has given his evidence-in-chief in the time we should have
over before the end of that week.

MR. RAMPTON: My Lord, I cannot remember where his original
       statement is.

MR. JUSTICE BELL: I will put it behind his existing statement.

We will resume at 2 p.m. on Wednesday the 26th.
