Day 149 - 06 Jul 95 - Page 32
will see that the date on the fax to me is
30th June, 1995. It relates to the credit of Mr. Stein and
discredit of Mr. Gallein, but I am not really concerned
about that at the moment.

MR. JUSTICE BELL: At some stage, I would like to be told where
to put that letter and where to put the 1995 meat
suppliers. It need not be now, but in due course. If
Mrs. Brinley-Codd tells Mr. Dudley, they will be put in the
appropriate place.

MR. RAMPTON: My Lord, the next thing was the Guatemala map,
which was then changed into a Costa Rica map, which
Mr. Morris says that Dr. Gomez Gonzales says that he saw.
I do not remember that, but I am sure Mr. Morris is right
about that.

The point about that is, as your Lordship knows, that
Mr. Hill went to Costa Rica at the beginning of the year to
look for any documents in the possession of the McDonald's
in Costa Rica which might be relevant to the issues in this
case. He came back with a few, I think, and that was the
end of it. It did not include the map.

There is a map, however, of Costa Rica, showing the
rainforest areas and the cattle rearing areas, and that is
to be found -- I do not know whether this is what
Dr. Gomez Gonzales was referring to or not -- at tab 72 of
yellow XIV, if anybody should be interested. It was sent
to Mr. Cesca, as a matter of fact, in May 1989, by somebody
called Alvaro Cofino, whose letter to Mr. Cesca was the
subject of Civil Evidence Act notice. He enclosed with
that letter the map of Costa Rica showing the two areas.
If that map were accurate, then it would be conclusive of
the fact that none of the beef in Costa Rica comes from the
rainforest area.

MR. MORRIS: That is a ridiculous statement. This is an
application, not a closing speech. That is Guatemala, that
map.

MR. RAMPTON: Sorry, that is Guatemala.

MR. MORRIS: It is not Costa Rica.

MR. RAMPTON: That is why I looked it up, because the
application was brought in the name of Guatemala. It is
Guatemala; Mr. Morris is quite right. Costa Rica, there is
no map. Mr. Hill did not find one, and that is that.

My Lord, the next item was another -----

MR. JUSTICE BELL: One of my anxieties there, which I will
merely repeat, is that it has been a feature of this case
to some extent that as witnesses have come into the witness
box there has been mention of documents which might be
relevant, which we then have discussions and, perhaps,
formal argument about. That may either be because there
has been reluctance in disclosure, or it may just be that
in a case which ranges as far as this it is bound to happen
