     1        departments, presumably, have to work pretty closely
     2        together; if you are going to get a certain amount of
     3        packaging, the machines have to be the right size for it to
     4        fit into or whatever, yes?
     5        A.  Yes.

     7   Q.   So is it a part of your department or is it -----
     8        A.  No, it is not a part of my department, no.  I have no
     9        involvement other than the occasional negotiation on price
    10        or quantity.

    12   Q.   But you would be aware of all the equipment issues to do
    13        with the type of equipment?
    14        A.  Not necessarily, no.  The equipment is specified by the
    15        headquarters in Chicago, as are the packaging items, as are
    16        the food items.  They make sure that the cups would fit the
    17        tubes that go alongside the shake machines or the drink
    18        machines.  It would not be the UK company's responsibility
    19        to do that and certainly not mine.

    21   Q.   So when you say the equipment specifications are specified
    22        by Chicago, would that apply also to the European
    23        countries, say, for example, the European countries that
    24        you have responsibility for?
    25        A.  By and large, unless they are using a different size
    26        cup to the UK company or a different type of packaging for
    27        some reason or another.  But, by and large, the equipment
    28        would be specified by Chicago for all markets other than
    29        where there is an exception for some reason or other.

    31   Q.   Does that apply to both the machinery that, you know, the
    32        consumers can see in the store, customers can see, that is
    33        being used for the preparation of food and also to the
    34        storage equipment as well, such as refrigeration or the
    35        storage areas?
    36        A.  I do not handle equipment, so it is difficult for me to
    37        answer you exactly, but it would certainly apply to the
    38        restaurant kitchen equipment that the customer can see; it
    39        may not apply to the backup storage equipment which I think
    40        might be different, based on different shapes and types of
    41        buildings.  But I cannot be specific in that area because
    42        it is not my area.

    44   Q.   But the overall policy guidelines on equipment would be
    45        there would be specifications emanating from Chicago about
    46        that?
    47        A.  Certainly, as far as I am aware, for the restaurant
    48        kitchen equipment.  I am not sure that there is for the
    49        backup storage equipment.

    51   MR. JUSTICE BELL:  If you have particular items of equipment 
    52        which you are interested in for some reason, if it is 
    53        important where the specification comes from, why not raise
    54        those?

    57        order we are doing things.
