Day 056 - 28 Nov 94 - Page 64

location to that of the sawmill.

  Q. So some will be transferred to the panel making and some
will be transferred to the pulp making?
       A. That is correct.

  Q. That is the point when it becomes what they call "post
       industrial waste", is it?
       A. It could be described as -- but it is still industrial.

  Q. Yes, but what I am saying is that could be categorised as
       recycled ---
       A. It could, yes.

  Q. -- material?
       A. And this is one of the things where it depends how that
calculation is done. I think what would be said by a panel
maker who is making particle board or chipboard or is
making medium density fibre board, is that his raw material
is already something which otherwise, if his factory did
not exist, would be burnt or in other ways disposed of, so
he is actually a contributor to recycling. However, I am
not sure that is relevant to this particular point because
in our calculations here we have excluded recycling in the
context we are talking about virgin fibre.

MR. MORRIS: I do not know whether that might be a suitable time
       to finish tonight?

MR. JUSTICE BELL: Yes. Has an arrangement been made for
Mr. Mallinson to come back on Wednesday?

MR. RAMPTON: Yes, my Lord, it has.

MR. JUSTICE BELL: When we do start on Thursday, I would urge
you to bear in mind what I said earlier in the day.
I cannot see it doing you any harm at the end of the day
(and it will help you as well as me) if what we basically
have is material which goes to the issues, the important
issues, so our minds are not clouded with lots of other
information which may be interesting but is not going to
affect the resolution of the case one way or the other at
       the end of the day.

So, if you would be kind enough to concentrate on going
through, perhaps, the questions you have clearly written
out to help yourself in your cross-examination and topics
and decide which really are essential and which are not.

We will resume at 10.30 tomorrow morning with amendments to
the Statement of Claim and as many other of the procedural
matters as we can hear argument on.

(The court adjourned until the following day)
