3 MR. JUSTICE BELL: We should go on to Mrs. Farrer. Hopefully,
4 we will start her tomorrow afternoon. In my view, we
5 should then go to Mrs. Antenni. I will hear anything that
6 has to be said on nutrition, if we have time this term;
7 otherwise, we can come back to it on 25th September, or
8 some time soon after that.

10 Without in any way prejudging the matter, I find it very
11 difficult at the moment to see how an application to strike
12 out the case in relation to nutrition could possibly
13 succeed. I will keep an open mind, because I do not know
14 what is going to appear in the skeleton argument, but
15 I cannot at the moment, on all the evidence I have heard on
16 the leaflet which I have read, see that it is a strike-out
17 situation at all, certainly at a stage when we are halfway
18 through the evidence.

20 As I have said, no matter how strong the evidence was one
21 way or the other, I find it very difficult to see that a
22 strike-out application is appropriate at this stage of the
23 proceedings.
