Day 195 - 04 Dec 95 - Page 20

MR. JUSTICE BELL: I am going to cross "he told me this" and "he
did not give me any details" out because, it seems to me,
it is the draftsman of the attendance note who is saying:
"This is what Mr. Alimi told me who not give any details".
Anyway, it is clearly not part of what Mr. Alimi said.

I think what you should do in relation to the matters in
the rest of that paragraph, I suggest, Ms. Steel, there is
no harm Mr. Alimi having it in front of him, but, as
Mr. Rampton has, in effect, suggested, you ask him what, if
anything, he said about his hours being cut because the
bits before that, I do not know whom he was told this by,
I am crossing out because I take them to be part of what
the maker of the attendance note is saying rather than
       anyone else.

MS. STEEL (To the witness): Were your hours or were anybody
else's hours cut after this incident that you remember?
       A. I do not remember but they could very well have been.

MR. JUSTICE BELL: I will cross that out as well. Ask about
       promotion.

MS. STEEL: Do you remember anyone not being promoted after
this, even though they should have been, and leaving two
       months later?
       A. No, I do not remember.

  Q. You do not remember?
       A. After all, it was 10 years ago nearly.

  Q. So it may have happened but because of the distance of time
       you do not remember?
       A. That is right. I mean, that kind of thing happened
regularly, but in this particular incident I could not
really tell you for sure who it was.

  Q. "11. Joining the Union. There wasn't actually a
conversation", now perhaps you just want to explain this
       part as well?
       A. Yes. There was not a conversation about the union.
I talked about the union. I brought the issue up in the
crew room on my break and -----

  Q. That was just with crew, not with management?
       A. With the crew at that stage, and I just wanted to test
the crew members' reaction to it. Everybody seemed to be
scared talking about it, and the conversation was that it
did not develop at all because of the fear. The word got
back to the management that somebody has mentioned,
obviously, trade unions in their break and Trudie came and
warned me against speaking about those sorts of matters.

  Q. That was in about April or May 1987. Perhaps you do not
remember when it was now, but -----
       A. I do not remember when it was now, but I would say, you
know, it is -- the date is really immaterial here but it
could have been at that time.
