Day 180 - 31 Oct 95 - Page 43

MR. JUSTICE BELL: The Inner London figure was June 1991 and
1992, so was the Outer London one. The provincial £3 for
2.65 was June 1992. That is what I have written in next to
       them.

  MR. MORRIS: Yes.

THE WITNESS: It would be difficult, my Lord, to under-estimate
the importance of this market intelligence to McDonald's.
The Catering Review Group, as I have indicated earlier,
undertakes these, what I understood to be, completely
confidential exchanges of information and, therefore, not
anticipating publication, I would like to suggest that this
is, perhaps, the most reliable of all the data you will get
and certainly more reliable than any of the New Earnings
Surveys or other general statistical survey data that even
I have quoted placing McDonald's in the range of catering
       pay rates.

MR. MORRIS: Where is their position, do you conclude ---
       A. Bottom quarter.

  Q. -- of catering workers?
       A. Of catering rates.

  Q. Which is the whole category which is in the low paid
category in any event, given the whole of the
       catering -----
       A. Within a low paid industry.

  Q. Within the low paid industry.

MR. JUSTICE BELL: When you say in the bottom quartile, it
places them on the bottom quartile?
       A. Yes, it does, my Lord.

  Q. The lower quartile?
       A. I accept -----

  Q. If you went up from 0 to 100, the notional person at 25
would be earning the £3.30, that is what the quartile
       means, does it not?
       A. Yes, and -----

  Q. The medium quartile would be 50 and the upper quartile
       would be number 75?
       A. It would be.

  Q. Do I not understand the terms properly?
       A. Yes, that is right, and in the Catering Review Group
the employers would have given their spread of earnings
across their organisations for the various job categories,
and in the entire Catering Review Group sample, which is
what we are talking about, market intelligence, the general
sales assistant is, as you have said, in the bottom -- is
on the bottom 25 per cent.

  Q. The Inner London person is on the bottom quartile and the
others are in the bottom quarter?
