Day 108 - 27 Mar 95 - Page 42

       implications of these photographs.

  Q. Do you remember that 'phone conversation?
       A. Yes, I made notes at the time, and I have looked at
them since, and it had been an item that had been on the
Welsh news, I think several times during a certain day in,
I think, December 1992. I think I spoke to him in January
1993. He said 1994 but it was 1993, according to my diary,
and he did express concern and he said that welfare was
dear to his heart and he did, at the same time, tell me
that infections were very, very common in the turkey
flocks, like 50 per cent he quoted me.

The thing that concerned me in the photograph was the
turkey with a closed up eye. It looked like sinusitis. He
said, yes, this was very common as a secondary infection
and these things would be treated with a range of
antibiotics. I had the impression that antibiotics were
very widely used and that there was a very high incidence
of infectious diseases in the turkeys and I was very
concerned of course about this bird being transported in
       such a state.

  Q. These were the photographs that you were sent?

MR. RAMPTON: I do not think we need to see photographs.

MR. JUSTICE BELL: Is this the conversation which Dr. Pattison
       referred to?

  MS. STEEL: Yes.

MR. JUSTICE BELL: I have already ruled in relation to the
turkeys. By all means since Dr. Pattison was led to deal
with why he did not ----

MR. RAMPTON: He was not led, my Lord. It was introduced by
       Mr. Morris in cross-examination.

MR. JUSTICE BELL: It came out one way or another. I am quite
prepared to hear what Mrs. Druce has to say about that but
       not the turkeys.

MS. STEEL: We are not going to go into detail about the turkeys
but the 'phone call has to be put into context about what
        ----

MR. JUSTICE BELL: You do not have to show me photographs for
       it.

MS. STEEL: It is to show genuine concern and why the 'phone call
       was made.

MR. JUSTICE BELL: I am not going to doubt Mrs. Druce's concern
on these topics at all. If you want to -- it is entirely a
matter for you -- all you need do is ask her whether it
became clear that she did not, or questions directed about
whether it became clear that she was not interested in
Dr. Pattison's point of view and she knew about the
       demonstration.
