Day 126 - 17 May 95 - Page 11

they are; will you do that?
       A. Yes, OK.

  Q. The first two you are going to look at, I believe the Judge
       does not have?

MS. STEEL: I did not bring my documents today.

MR. JUSTICE BELL: Let us take it.

MS. STEEL: There are no trial bundles, so .....

MR. RAMPTON: Yes. Tell us what the document is. Read out the
title and explain briefly what it is.

MR. JUSTICE BELL: Right at the very back immediately before
       tab 4?
       A. The first document I have is what we have called a "Who
Eats What?" study. It was conducted in 1992 by ourselves
to help give us a profile of the eaters, of what our
customers eat when they come to McDonald's and, basically,
what type of person is eating each particular product.
That document was part of the original submission before
       I gave evidence previously.

  Q. The thing I have immediately before tab 4 is one sheet of
paper, the fax date is 26th October last year, and it is
headed: "Number of people eating at McDonald's by
frequency break 1993 to 1994 data". It is the very last
       sheet before tab 4?
       A. The very last sheet is part of the document I have just
described which says: "Analysis of items not detailed due
       to small base size".

MR. RAMPTON: Can you find, please, Mr. Fairgrieve, that one
sheet of paper that his Lordship was talking about? I have
one too. It looks like that. I had mine immediately
before AF3. That may not help anyway.
       A. The sheet which I have before AF3 starts with:
       "Influence of children on visit".

  Q. I am asking you -- I am sorry about this -- to scurry
through the file and find that single sheet, if you
possibly can. Mrs. Brinley-Codd says it is at the very end
of Appendix 5 in her bundle.
       A. The sheet I have does not resemble the one there. It is
       "McDonald's Persuasive Powers Verbatim".

MR. JUSTICE BELL: I wonder if the best thing, Mr. Rampton, is
if you can hold up the document you are going to ask about,
the first one. I am going to put a "1" on that. In other
words, it is the first document you have asked about.
Would you have a look at it, please, Mr. Fairgrieve?

MR. RAMPTON: It is called: "Number of people eating at
McDonald's by frequency break 1994 data", three columns:
"Frequency, of number of people eating at given frequency,
percentage of McDonald's use". Is that right,
       Mr. Fairgrieve?
       A. That is the piece paper I have, yes.
