Day 124 - 10 May 95 - Page 56

MR. MORRIS: Are you aware there was controversy over publicity
where he condemned his former role and said: "I apologise"
        -----

MR. RAMPTON: My Lord, this again is being presented as though
there has been some evidence in this court; there has not
been any at all. The question is: "Are you aware whether
there is" not "that there was" and -----

MR. JUSTICE BELL: I think it is just Mr. Morris' use of
       language.

MR. RAMPTON: I know it is, but it is not very fair on the
witness because the witness may be misled into thinking
there was some evidence of it.

MR. JUSTICE BELL: No, he has been asked whether he was aware of
it. You start again because we have got this potential
difficulty that he has not heard of someone called Geoffrey
       Juliano.

MR. MORRIS: Yes. If I can maybe jog your memory, that ---

MR. RAMPTON: My Lord, I am sorry.

MR. MORRIS: -- was there controversy ----

MR. RAMPTON: No, I am sorry, my Lord, Mr. Morris must -----

MR. MORRIS: Why do you not just tell the witness what to say?

MR. RAMPTON: No, my Lord, I must make an objection. Your
Lordship will recall, in fact, that this part of the
Defence the Defendants were compelled to amend into the
direct allegation put into reported speech, as it
originally was, in the mouth of Geoffrey Juliano of whom,
of course, nobody has ever heard.

MR. MORRIS: People have heard of him because we have talked to
       him.

MR. JUSTICE BELL: We have not had a witness yet; we may have
many more witnesses to come. Just pause a moment.

MR. RAMPTON: Your Lordship will remember that my
       objection -----

MR. JUSTICE BELL: I am just looking into the Abstract to find
how it stands at the moment.

MR. RAMPTON: I do not know how it stands at the moment but I do
recall your Lordship's ruling which I may be able to find.

MR. MORRIS: With respect, it is all completely irrelevant
because I am trying to ask the witness -----

MR. JUSTICE BELL: No, do not worry you will have plenty of
opportunity to ask what you want to. For my own
education, I am not going to read it out, I just want to
