3 What I should like to do now, with your Lordship's leave,
is show your Lordship, without comment, a number of video
4 recordings which were taken of demonstrations following
the one in 1989 at the plaintiffs' head office in East
5 Finchley. The dates in question are 16th October 1990,
21st May 1991, 16th October 1991, 16th October 1992 and
6 15th October 1993.
7 My Lord, I invite no comments about those. If your
Lordship would like the tape to be stopped so that your
8 Lordship can see it more clearly, or anything like that,
perhaps your Lordship would indicate to Mr. Hill. He,
9 I hope, will be able to control it. May I sit?
10 MR. JUSTICE BELL: Yes, please do. I think it is unlikely
I will want to stop the tape. Once they have been shown
11 in public in the presence of all parties, if I wanted to
look at one again, presumably, I could just take it home
12 with me?
13 MR. RAMPTON: My Lord, they are evidence in the case.
14 MR. MORRIS: Could we pause for one minute?
15 MR. MORRIS: It is just that we believe that for a video to be
brought in as evidence, there has to be a section 9
16 statement of the photographer or film maker. We want an
indication that will happen.

MR. JUSTICE BELL: I assumed they will. If there is any
18 dispute about it, may be when you see them -- I do not
know what they contain at all -- there will be an element
19 of agreement about them, I do not know.
20 MR. RAMPTON: My Lord, they were served as part of a list of
documents. There is no counter notice challenging their
21 authenticity. Evidence will be given about why and when
they were taken during the course of the case. If your
22 Lordship prefers to wait until later on, I do not mind.
23 MR. MORRIS: We are not objecting to them being shown; I am
just indicating for later on.
