Day 138 - 20 Jun 95 - Page 63

MR. JUSTICE BELL: You were actually there when Campbell was
       there, were you?
       A. Yes, sir, I was.

  Q. What were you doing there?
       A. He is a well-known personality and I sat in the back
seat and wanted to tour with him and be with him, frankly.

  Q. Were you not there with your Human Resources or employment
       hat on?
       A. No, sir, I was not. We were not doing any campaigning
whatsoever. I frankly stayed outside when he went into the
store because they clearly did not want to see me. All the
employees or the customers would be interested in is a
       football player.

MR. RAMPTON: Did you attend this disco or the crew meeting that
       preceded it?
       A. I was there, yes, I was.

  Q. In what capacity did you attend those events?
       A. I did not do any speaking. I was at best behind the
       scenes, if you will.

MR. JUSTICE BELL: How long was his visit before the election?
       A. It would have been a few days before. Are you talking
       about Mr. Campbell's visit?

  Q. Yes.
       A. It would have been a few days before. .

MR. RAMPTON: What about the disco?
       A. That could have been a couple of nights before.

  Q. Is it true that, "all workers eligible to vote were bussed
       to the disco"?
       A. I believe that there was bussing, yes, because it was
in a hall that could house all of the people. The store is
       not big enough.

  Q. There comes something which is perhaps a little bit more
serious by way of allegation next, Mr. Stein. There is an
allegation that people who missed shifts were paid as if
they had worked. Do you know anything about that?
       A. I am sorry?

  Q. There is an allegation that those who missed shifts because
they went to the disco were paid as if they had worked?
       A. Our crew meetings are paid, so for the time they would
be in the crew meeting they would be paid. As far as
attending the dancing after that, that is purely voluntary
and we do not pay for that.

  Q. Even if they should have missed a shift because they went
       to the dancing?
       A. What we would do is we would schedule so that they
would not be missing a shift, if you will.

  Q. Then comes what I a moment ago described as perhaps a
little more serious: "To substitute for these absent
