company would consider its position in the light of any
changes". Do you think it is likely that the company was
not aware of this newspaper report in a national newspaper?
       A. Not at all, and I have never said that. I said there
was not concern. What this statement says pretty much is,
       there was not concern.

  Q. Right, but this is March 1987?
       A. Yes.

  Q. This is before you took any action to speak to Lin Pac to
ask them to make the changes?
       A. Because there was not concern, yes.

  Q. But there was concern before you asked to make the changes?
       A. No.

MR. JUSTICE BELL: No. Where are you talking about? Might
I suggest that you are more precise about where you say the
concern was, because you are talking from either a public
perception or the concern of Friends of the Earth?
Mr. Oakley is talking about the concern of McDonald's. So
long as you are talking about concern in one place and he
is talking about concern in another, you are never going to
       meet.

MS. STEEL: OK, right. You would recognise that this indicates
some public concern by Friends of the Earth about the use
of CFCs in McDonald's packaging and the threat to the ozone
       layer?
       A. Certainly Friends of the Earth were concerned; whether
the public were concerned, I do not know.

  Q. This is before you approached Lin Pac?
       A. In July 1987.

  Q. In July 1987?
       A. Correct.

  Q. To ask them to make changes. So, would you accept that
what you said in your statement that there was no public
concern, or no concern, before you took this action is
       incorrect?
       A. I would not accept that because there was no concern in
       McDonald's.

  Q. On page 7 of your statement you have said, starting at the
very last word of page 6 and going on to page 7: "This
decision was taken shortly after the Montreal Protocol and
in advance of public concern and general awareness of the
environmental damage used by CFCs", I presume that is meant
       to be "caused by CFCs"?
       A. Yes, "caused".

  Q. That is wrong, is it not?
       A. Why?

  Q. Why? Because you have said that your decision was taken
"in advance of public concern and general awareness of the
       environmental damage caused by CFCs".
