Day 207 - 23 Jan 96 - Page 24
Christopher Ryan started just before eight o'clock, went on
a break at 10.51, finished his break at 11.30 -- so, again,
he did not get the full 45 minutes -- and then worked until
four o'clock in the afternoon. So, again, that was
illegal, because the break was not between 11.30 and 2.30.
You would accept that?
A. Yes.

Q. Christopher Lewington started at nine o'clock, went on his
break at six minutes past 10, back from his break at 10.49,
and carried on working until four minutes past three. It
is the same again, is it not?

MR. MORRIS: That was only a 43 minute break, as well.

MR. JUSTICE BELL: Do not worry too much about one or two
minutes short of 45 minutes.

MR. MORRIS: As far as I am concerned, that is the minimum by
law.

MR. JUSTICE BELL: I dare say, but you may have stronger points.

MR. MORRIS: Well, if it is breaking the law, then I think it is
significant.

MS. STEEL: Then Michael Stokes started at 9.57, went on his
break at 11.04, came back from his break at 11.32; so he
only got 28 minutes. Then he worked until three o'clock in
the afternoon; so, again, there was no break between 11.30
and 2.30.

MR. JUSTICE BELL: Which one is he?

MS. STEEL: The next one down.

MR. JUSTICE BELL: Stokes?

MS. STEEL: Yes. Then the next one I have got marked is
Shelley Smith, who started at 10.02, went on a break nine
minutes later until 10.48, and she only got 37 minutes, and
then worked until 14.52; so, again, not complying with the
legal requirements on two counts. Then there is Joseanne
Stapeley, who started at -- that is two down.

MR. JUSTICE BELL: What I suggest you do, just give me the
names, and then I can work out whether they were early
breaks, less than 45 minutes, and not between 11.30 and
2.30.

MS. STEEL: OK. I did not do the teatime ones, though.

MR. MORRIS: If we just add Jonathan Gore, the one above Shelley
Smith, because he got his break less than an hour after he
started at 16.01.

MR. JUSTICE BELL: Just give me the names. You need not go
through the -----

MR. MORRIS: Just to check, on page 314, he worked in fact until
