     4        necessarily visible.  If you were a customer unwrapping the
     5        a Big Mac, I am not sure that the lettuce would be
     6        necessarily visible.

     8   Q.   So, according to your account, at least 18, and maybe 24,
     9        customers got Big Macs with rotting lettuce in; is that
    10        right?
    11        A.  Yes.

    13   Q.   If the whole bag was rotting, that must be so, must it not?
    14        A.  Yes, that is correct.  Well, I say rotting.  I mean,
    15        you are saying rotting; I say it was going brown at the
    16        edges and very soggy.

    18   Q.   Miss Tobin, your words: "Thus a whole bag of rotting
    19        lettuce was used up in the Big Macs"?
    20        A.  I think it is how you interpret "rotting", but I think
    21        -- I mean, you can interpret "rotting" as being brown and
    22        stinking.  I think my description of going brown at the
    23        edges and very soggy is rotting, but it is not -- I mean,
    24        it was not a kind of pile of rot being put on the bun.

    26   Q.   Do you just mean slightly tired?
    27        A.  No.  I mean brown at the edges and very soggy.  So it
    28        was not that it was limp; I think there was brown at the
    29        edges, it was very specific, but it was not, you know, a
    30        pile of brown, soggy rot.

    32   Q.   If the whole bag was in this condition, there would have
    33        been rot, would there not, because that is what happens
    34        with lettuce; if you put rotting or going rotten lettuce in
    35        a bag with other leaves, the whole lot becomes -----
    36        A.  There may be some bits that were more rotted than
    37        others, yes.

    39   Q.   A Big Mac, you say, is wrapped; is that right?
    40        A.  Or it is put into a carton.

    42   Q.   Yes.  So when the customer opens the carton, he can see
    43        what is inside it, can he not?
    44        A.  He can see the Big Mac.  What I am saying is, it is not
    45        necessarily obvious.  The lettuce may be contained within
    46        the circle of the bun, rather than spilling out over the
    47        edges, particularly in the peak hours, when it is not
    48        totally possible to present the bun as it is supposed to be
    49        presented.

    51   Q.   In the next paragraph, you write: "On a another occasion, 
    52        also at the Strand store, I was passed a tray of toasted 
    53        buns to dress.  At least four of the buns were mouldy
    54        blue."
