Day 134 - 13 Jun 95 - Page 36
cent of all leavers fail their probation?
A. I was going to add before, unless they fell into one of
these other small categories, like absenteeism or
misconduct or something like that, on probation, but,
broadly speaking, yes, they would be covered in those
dismissal areas, those involuntary codes, as they are
called.

Q. If we move on to H -----

MR. JUSTICE BELL: I suppose they could fall into (7) "mutually
agreed" which is seven and a quarter per cent as well, some
of them might; again just what the Manager thinks is the
most appropriate to their individual situation.
A. Yes.

MR. JUSTICE BELL: Yes, H?

MR. MORRIS: Have you got the one that is graded as to the
percentage that agree?
A. Yes.

Q. That one?
A. Yes.

Q. It is called H1 for the sake of ease.

MR. RAMPTON: For everybody else it is H3. For most people, my
Lord, it is the last page.

MR. JUSTICE BELL: It is the last.

MR. MORRIS: Only 82 per cent agree that they get paid for all
hours worked, that is the fourth one down. When you found
this out, what action did you take?
A. What happens is that -- what happened is that when the
results go out, they go to each restaurant and, as part of
looking into all of the areas highlighted, people, i.e. the
Supervisors and so on, look at the records and try to
establish, given that obviously one of the difficulties of
this survey being anonymous is you cannot ask the
individuals, and looked at why that might be and took
corrective action, where necessary, if they found anything.

Q. The Managers?
A. The Supervisor in conjunction with the Manager and so
on, the people at restaurant level.

Q. But the Managers, presumably, are going to be the problem,
they are not, because they are the ones who are in charge
of scheduling and payment for hours worked?
A. They are in charge of it, yes, but mistakes can be
made, and so then if corrective action is taken and
preventative action, that is what is important. Obviously,
if it is found that someone has not been paid, then they
would receive the back pay. It can be to do with things
like new people not clocking in and so on, that type of
thing.

Q. Before we look at any more individual things, this survey,
