Day 099 - 08 Mar 95 - Page 32

       A. Oh, yes. We have a copy in the office.

  Q. Do you know whether -- this is really following up what his
Lordship asked about -- one can obtain these things from
HMSO up in Holborn or somewhere like that?
       A. Yes, you can.

  Q. My Lord, perhaps we had better do that.

MR. JUSTICE BELL: Yes. The last thing I want to do in this
case is encourage darting off down side roads, but I am
still not clear of the relationship of one standard to
another. It might be worth looking at the Directive itself
because it may give some reasoning behind the figures.

MR. RAMPTON: Then, my Lord, if one has that in one's hand your
Lordship does not need any evidence about it because it
would be part of English law.

MR. JUSTICE BELL: No, it speaks for itself.

MR. RAMPTON: Yes, it speaks for itself. (To the witness):
Before we rush off to chicken which we will do in a minute,
Mr. Kenny, can we then look at the first appendix to your
       statement, tab A?
       A. Yes.

  Q. This is before we leave McKey and go off to Sun Valley.
"Quality control checks carried out at McKey Food Service
during the production of McDonald's hamburger patties".
I hope you have a legible copy, have you?
       A. Yes, I have.

  Q. If you turn over the page you see that in addition to the
38 checks originally listed, it says: "Since 1989 the
above checks have been supplemented with the following:
Meat traceability checks, raw materials checked for the
presence E.coli 0157, internal temperature checks on cooked
hamburger patties". Have you seen this before?
       A. Yes, I have.

  Q. Would you have copy of this in your office?
       A. Yes, I do.

  Q. Supplied by McKey's?
       A. Yes.

  Q. Does it change from time to time?
       A. It does, yes.

  Q. He says or McKey's say (and I am only going to draw your
attention to a selection of these): "1. Delivery vehicle
condition and temperature checks. 2. Meat temperature on
arrival". Are you satisfied in your own mind that those
       two events take place?
       A. Yes.

  Q. Have you seen it being done?
       A. I have seen it being done, I have, yes.
