4 MR. MORRIS: I think my recollection is that (and it may be
5 biased, of course) Professor Walker accepted there was a
6 body of evidence for allergies from a number of these
7 compounds.

9 MR. RAMPTON: My Lord, it may be helpful, if Mr. Morris is going
10 to do things from recollection, if we try to avoid that
11 trap by turning to page 24 and following of the transcript
12 of Day 26 which is Monday, 19th September 1994.

14 MR. JUSTICE BELL: Yes. I have left my transcripts in my room.

16 MR. RAMPTON: I am sorry about that, because one can see what
17 Professor Walker says about every single one of these
18 substances seriatim, and that was at your Lordship's
19 urging. In this case, for example, he says that there is
20 an allergic reaction known so far as Sunset Yellow is
21 concerned. I asked (and perhaps it was a
22 leading question) -- no, he said "It is rare" and I said:
23 "It is rare?" He said: "It is relatively rare; it is not
24 serious and it is reversible." "Is it a bit like having a
25 stomach upset?" "Only in extreme cases. I mean, most
26 people would not have the gastric upset and vomiting,
27 although they may have hives." "Hives"" say I; "Yes", he
28 says, "nettle rash type", and so on.

30 One can find his account for each of these allergic
31 reactions in his evidence on those pages. So it is best
32 that Mr. Morris does not, as it were, try to do it from
33 memory.

35 MR. JUSTICE BELL: Can I just use that as an example?

39 MR. JUSTICE BELL: That is evidence which gives some picture, in
40 general terms, as to the prevalence or otherwise of a
41 reaction which the witness is accepting. What I need to
42 know is whether you are meeting that with some contrary
43 view expressed by, in this case, Dr. Millstone and, if so,
44 the extent of the difference and how particular
45 Dr. Millstone can be.

47 What I was trying to point out by referring to that
48 paragraph on page 9 of Dr. Millstone's statement, which
49 ends up with the one referring it to the footnote, is how
50 often and to what extent it has been shown. Then I can
51 match it with Professor Walker's evidence. This is not
52 meant as a criticism of Dr. Walker. I do not know yet of
53 course what I will say about his evidence. But "certain
54 azo-dyes, including Sunset Yellow and SCF, have been shown
55 to be associated with hypersensitive reactions in man" does
56 not tell me at all whether that is something someone of
57 ordinary sense and fortitude ought to be concerned about or
58 not. Do you understand? Sit down a moment and think about
59 it.
