Day 112 - 31 Mar 95 - Page 16

of figures for a week later, do you not?
       A. To page?

  Q. 102, sorry, 14th April. Similar sorts of temperatures, if
those are measurements of the contents of the octibins,
       4.4, 4.4, 3.7, 3.9, yes?
       A. Yes.

  Q. In the light of these figures which I have shown you, is
there any respect in which you would care to modify your
criticisms of the temperature in the boning room? This is
       after boning, is it not?
       A. Well, I would not want to modify my judgment on the
temperatures in the boning room because those were based on
measurements that I personally made. So there is no way
I can modify that. They stand as they are. I measured
them. That is what they were.

  Q. Sorry about this, but have you still your copy of your
       loose statement there?
       A. Yes.

  Q. Look, please, at the second page at the first bullet point
under 7. You assert here that this bullet point
constitutes a breach of the regulations, do you not?

MR. MORRIS: Sorry, which one are we looking at?

MR. JUSTICE BELL: Which one have we gone on to now?

MR. RAMPTON: My Lord, paragraph 7, first bullet point.

MR. JUSTICE BELL: Are you leaving boning temperatures for the
       moment?

MR. RAMPTON: My Lord, in a sense I am. I am still on them but
I going to the statement instead of the documents.

MR. JUSTICE BELL: Yes, I will let you complete what you want to
ask first, Mr. Rampton, then I want to ask one or two
       questions about that.

MR. RAMPTON: Very well. (To the witness): If you look at the
first bullet point under 7, you have written (and this is
supposed to be a breach of the regulations): "The
slaughterhouse and the cutting premises operated with a
considerable overcapacity causing the meat to be cut and
dispatched at temperatures higher than required, that is to
say, at 7 degrees centigrade", and I will leave the last
bit for a moment because I am coming back to that. You
have no evidence at all to suggest that the meat was being
dispatched at temperatures higher than 7 degrees, had you?
       A. Yes, I do have. I measured carcasses temperatures.
I am referring to the carcasses that were being loaded from
       there.

  Q. But you knew that this case was about McDonald's; it had
nothing to do with carcasses being dispatched, had it?
When you made this statement you made it for this case, did
       you not?
