Day 142 - 26 Jun 95 - Page 38

MR. MORRIS: I will just have to collect my thoughts.

MR. JUSTICE BELL: Sit down and take stock.

MR. MORRIS: I could not find the pleading for Norway. It is
       No. 14?
       A. I have up to 10.

MR. JUSTICE BELL: Divider 7 and then page 5, please, Mr. Stein,
       item 14.

  MR. MORRIS: "Norway 1993. On October 28th 1993 McDonald's
finally conceded a 'collective agreement' with the HRAF
Union after many years of hostility to Union rights. A
previous attempt by the Union to achieve this resulted in
union members getting special treatment to discourage
membership and activity. The agreement was only signed
after the HRAF had prepared for a strike. Around this time
some 18 year old staff had worked illegal hours."
I think, if I am right, we have a statement by Theo Holm?
       A. He would be the Managing Director.

  Q. Is it true that a collective agreement was signed around
that time, October 1993, with the Union?
       A. I have some general information on that. There are
some stores that are unionised there and I believe there is
a collective agreement in some of the stores, but as to
dates or -- that has been that way for a few years,
I believe, but I am not sure of the timing or the dates.

  Q. If I just quote from Mr. Theo Holm's statement, his
paragraph 4: "It is correct to say that there was a debate
with the HRAF Union over" -----

MR. JUSTICE BELL: I think if you are going to refer to an
extract of any length, it is yellow XIII, is it divider 23
       or 24?

  MR. MORRIS: 24.
       A. I have it. Where do you want me to turn to?

  Q. It is paragraph 4: "It is correct to say that there was a
debate with the HRAF union over union recognition and the
union did threaten strike action. Consequently, it was
agreed with the Union and with the staff that there would
be union organisation in the four restaurants where the 14
people who wanted union organisation were employed", he
       says.
       A. OK.

  Q. You do not have any personal knowledge of this?
       A. No, I do not. I have never been there and I have never
participated in whatever he is referring to here. I have
just had some general conversations with him over the
       years.

  Q. I will not ask any questions. You can leave that. Thank
you. If we move on to Germany, the thing about Germany,
there is quite a lot of difference?
