     1        1988 and 1991 surveys which Mr. Fairgrieve said were done.
     2        He drew reservations about their comparability with the
     3        Taylor and Nelson and Fast-Track Harris Research ones.
     4        There was the question of a hard copy of the questionnaire
     5        used for the Taylor and Nelson survey which he thought was
     6        about 10 sheets of A4 and a hard copy of the Fast-Track
     7        Harris Research questionnaire which was said to be twice as
     8        long.  He also said, although this might be less clear
     9        reading the transcript, that in some respects anyway he
    10        ought to be able to work out what the percentages of
    11        frequency of eating at McDonald's meant in numbers of
    12        people.  I think the phrase we used was "literal numbers".

    14   MR. RAMPTON:  I have not spoken to him this morning.  I cannot
    15        remember, because it is a very long time ago in the course
    16        of a case like this, September of last year, I cannot
    17        remember whether he has done that calculation.  I think
    18        that he has.  What I can tell your Lordship is that the
    19        questionnaires have been disclosed, the two questionnaires,
    20        so has the 1991 survey.  At the moment the 1998 survey is a
    21        mystery to me.  I do not know to what it refers.

    23   MR. JUSTICE BELL:  They were both mentioned together in one and
    24        the same breath really.

    26   MR. RAMPTON:  I will make enquiries about that as well as

    29   MR. JUSTICE BELL:  You may remember there was some discussion
    30        between you and me.  I said I might be particularly
    31        interested in them, although in fact Mr. Fairgrieve did say
    32        that they did not include frequency of eating information.
    33        They might be of interest, one would have to look at them,
    34        because they really straddled the years of alleged
    35        publication of the leaflet.

    37   MR. RAMPTON:  He is here; perhaps we could deal with this on the
    38        spot.  That is right.  1988 had been shredded, he found,
    39        because of a filing space problem.  We have had disclosed
    40        1991 and 1993 for the sake of comparison, really.  He has
    41        done the numbers calculation as well, my Lord.  Your
    42        Lordship should find the 1991 and 1993 surveys now as
    43        appendices 6 and 7 to Mr. Fairgrieve's statement in yellow
    44        file V.  The witness bundle has it, I know that.
