Day 099 - 08 Mar 95 - Page 83

MR. MORRIS: We would certainly like the ones for Jarrets as
       well.

MR. RAMPTON: There are not any for Jarrets. I have already
       said that twice.

MR. JUSTICE BELL: He said there were not any for Jarrets. I
want you to think about that overnight. If it helps, it
occurred to me that whatever I decide, whether the blanked
names should come in or not, and the main point on that is
whether the name of the supplier is relevant so far as the
microbiological testing is concerned, it had already
occurred to me that a reasonable approach might be because
it would limit the numbers of documents on the one hand but
give you some insight on the other, would be to concentrate
on the Midland Meat Packers documentation which is what
Mr. Rampton has suggested. I see that there are two tests
in relation to that out of 17 at Milton Keynes and none out
of 12 at Scunthorpe so far as beef is concerned. I assume
that the pork has come from other than Bowes.

MR. RAMPTON: Yes, it did not come from Bowes on that day. It
came from other places. I will confirm to your Lordship
that Midland Meat did not supply any beef to Scunthorpe on
       that day.

MR. JUSTICE BELL: If I thought that the identity of the
supplier on the basis that you have identified Midland and
said that there is no Jarret was not significant so far as
the reason for producing microbiological testing documents
are concerned, so -- can the name of the supplier still be
blanked off the original document with ease or not?

MR. RAMPTON: For what, my Lord?

MR. JUSTICE BELL: The five, 10 or 15 documents for each test
may or may not have the name of the supplier on them.

MR. RAMPTON: I do not know.

MR. JUSTICE BELL: I would like an enquiry to be made as to
whether they do; if they do not, there is no concern,
whether justified or not, about disclosing them, subject to
restricting numbers to a reasonable amount.

  MR. RAMPTON: That is right.

MR. JUSTICE BELL: If the name of the supplier does appear on
them and if your reluctance to disclose the name of the
supplier is justified, I want to know whether it is easy to
blank them out because what I have in mind is since there
are but two out of 17 Midland Meat Packers, for Milton
Keynes beef, none for Scunthorpe beef and none for Milton
Keynes -- no Bowes for Milton Keynes pork, one might take,
say, five of the A1, including the two Midland, and
Ms. Steel or Mr. Morris could stick their pin in the list
to decide which they should be. One could take five or,
say, four of the 12 Scunthorpe and one of the Milton Keynes
pork and that might be thought to be a reasonable sample
