Day 036 - 13 Oct 94 - Page 60

whether, if he is not finished tomorrow -- he may well be
-- he is available on Monday.

MR. JUSTICE BELL: If we did not finish your evidence tomorrow,
Mr. Cox, could you come back on Monday morning?

MR. COX: Yes, I would be pleased to come on Monday morning.
Monday afternoon might be more difficult for me.

MR. JUSTICE BELL: I would be grateful if you keep yourself
available for Monday morning as well. I think what you
need to do is find out from Professor Crawford certainly
if he can come on Tuesday; find out also if he would be
able to come at comparatively short notice, by which
I mean if he were told on Friday afternoon on Monday,
because if it was clear that Mr. Cox's evidence would be
completed tomorrow or fairly early on Monday, we might be
able to start Professor Crawford which would give so much
better chance of completing him on the Tuesday in good
       time for his appointment.

MR. RAMPTON: I do not believe, my Lord, that, in fact, he will
be even that long, but one wants to be sure about these
things. I would only say this. I do have a vague
recollection that he looked at his diary while he was here
and he could not do Monday.

MR. JUSTICE BELL: Very well. Perhaps someone could check on
       that?.

  MR. MORRIS: We will do.

MR. RAMPTON: That leaves the only loose end, the completely
loose end, to be the doctor of technician, Mr. Brown, and
of course Mrs. Brophey. I do not know whether the
Defendants any longer think Mr. Brown has anything to
contribute to this case. It is a matter for them and your
Lordship. Plainly, Jane Brophey does have something to
say; whether it is controversial is entirely another
question, but they ought, with respect, to be fitted in
       before we start advertising.

I do want to start advertising as it is listed at the
moment, that is to say, the end of the week beginning
24th October for this reason, amongst others, that
Mr. David Green, who is one of the American McDonald's
people, has been fixed to come, or has fixed himself to
come, at that time for some considerable time. He is
       arriving that weekend.

MR. JUSTICE BELL: Yes, you mentioned that before.

MS. STEEL: So, would it be possible to move John Hawkes so we
can fit in Jane Brophey? I do not actually know whether
she is available, to be honest.

MR. RAMPTON: I am looking at the blank week before it
actually, the tail ends of the Defendants' nutritional
evidence, should they want to call it; that is what I want
       to know.
