Day 134 - 13 Jun 95 - Page 20

MR. MORRIS: The simple question -----

MR. JUSTICE BELL: Just pause and listen. I do not follow at
the moment how you can come to that, but no doubt at the
end of the case if you have not come across a witness who
can help you from their own experience and knowledge, you
will produce some arithmetic or mathematics to me which
will demonstrate whether it is right or not, but this is
not the moment to do that.

You must observe my ruling. You can ask Ms. Mead about
things which she may be able to help you on on her own
account, but this is not an arithmetic test. If you are
right, you will be able to demonstrate it as a matter of
mathematical proof in due course. Mathematical proof is to
a much higher standard than the balance of probability.

MR. MORRIS: It may be worth noting that the London Greenpeace
fact sheet only says 60 per cent turnover rate anyway for
the UK, but there you are.

MR. JUSTICE BELL: Carry on with your questions.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: If you want the five-minute break, we will
have it now or you can go on a little longer, if you wish.
We will have the five-minute break now. I have said this
more than once (and I think you accept the sense of it) and
that it does not disadvantage you in any way, in so far as
you want me to draw a conclusion from the figures which is
just a matter of deduction, be it mathematical or ordinary
sense, you can do that in due course. You should not
canvass it with Ms. Mead unless and in so far as you think
she can add conviction to it by her own experience, or you
think you ought to give her the opportunity of denying it
       from her own experience.

MR. MORRIS: That is why I did it. I wanted to give McDonald's
the opportunity to get their calculators out and deny what
I am saying. I am sure they will do that.

MR. JUSTICE BELL: We will see. It is up to them. Do you want
more than five minutes in the light of what I have just
       said?

MR. MORRIS: No, five minutes is fine.

                      (Short Adjournment)

MR. MORRIS: If you go to the document before, can I just say
something about the document before, E2, I have put as E2,
this is about average weekly hours worked by employees,
       yes?
       A. Yes.

  Q. Something like 43 per cent work -- actually, 32 per cent
work under 10 hours. If you count the 0 hours we have a
total 67 per cent work under 20 hours, yes ---
       A. Yes.
