     1        say, "Are you sure that is what happened?"  On the other
     2        hand, if you have any reason to suppose that there was not
     3        a pile of sheets of paper with that image on the front
     4        behind you, then you should put it to Mr. Howes.

     6   MS. STEEL:   (To the witness)  You did not see those where the
     7        elderly couple got their copy of the leaflet from; they
     8        were just sitting with it when you first saw them?
     9        A.  That is right.

    11   MS. STEEL:  OK.  I think we have dealt with it, because the
    12        witness has said what he has seen and what he has not seen.

    14   MR. JUSTICE BELL:  Let me put it this way:  if you challenge
    15        that there was a pile of documents with that appearance
    16        behind you in court on the third day of the trial, then you
    17        should put it to Mr. Howes.

    19   MS. STEEL:   There were all sorts of documents behind us.  Our
    20        legal advisers were sitting behind us, and they may have
    21        had a copy of the fact sheet on the top of their papers.

    23   MR. JUSTICE BELL:  I am merely suggesting that if you have
    24        reason to believe that it was not there, you should put it.

    26   MS. STEEL:   (To the witness)  You do not have any evidence, do
    27        you, that the pile of papers which you saw, with a copy of
    28        what you say was the fact sheet on top, was actually a pile
    29        of fact sheets as opposed to a pile of paper with the
    30        fact sheet on the top?
    31        A.  No, I have no concrete evidence, but I assumed, because
    32        it was a very neat little pile, they were all the same
    33        thickness of documents going down; it was not a random
    34        selection of papers with one different document on the top.

    36   Q.   You are telling me that you could identify how many pages
    37        were stapled together from right back there, about a pile
    38        of papers on there?
    39        A.  I could tell that it was a pile of identical documents,
    40        yes.

    42   Q.   I mean, I put it to you that is complete and utter rubbish?
    43        A.  No, it is not.

    45   Q.   You could not tell from that distance?
    46        A.  My impression was that they were the same documents.

    50        A.  I assumed from what I saw that they were the same 
    51        documents, yes.
