Day 298 - 11 Nov 96 - Page 31
I am just seeing if I have got anything else.

MR. JUSTICE BELL: Sit down and take stock.

MS. STEEL: I have Miss Brophy to do. I was seeing if
Mr. Morris had anything left at all.

MR. JUSTICE BELL: Yes.

MR. MORRIS: I might as well finish off anything I have to say
on the subject.

I think that we believe that it is significant that
McDonald's put up a very fierce case on the links between
diet and disease, in terms of they had sought to challenge
the defence case in a number of respects while at the same
time having to gradually concede, make admissions formally
and informally, throughout the evidence, and I think that
only shows the strength of the defence case on the
subject.

I would say my last final point is that there is a number
of issues in this part of the case, which we think we have
established all of them, the links between diet and the
diseases that we have heard about referred to in the
leaflet. We think that is conclusively established. In
fact, most of them were made by admission, formal
admission, by McDonald's.

Then we have said that these links were causal, which was
the result of a later admission. And, in any event, all
the evidence shows that on all the relevant diseases
mentioned in the fact sheet. We have shown that McDonald's
food is of the kind which contributes negatively rather
than positively to the diet, and that they promote such
foods on a world scale and that they promote them
deceptively.

On top of that, as regards McDonald's own customers, we
have shown how they eat regularly, some of them,
substantial numbers, hundreds of thousands, millions, in
America, eat regularly at McDonald's, a substantial part of
their diet, and we have shown that they eat at other fast
food places; those kind of customers, McDonald's
specifically accepted, eat at other fast food places as
well. And McDonald's target them to increase their usage
at McDonald's.

I did not put those in necessarily the right order, but
I think that, as a whole jigsaw, we feel we have proven our
case.

MR. JUSTICE BELL: Yes.

MS. STEEL: If I just go through some of the more important
points of Jane Brophy's evidence now. This is all day 266,
so I will not keep reading out that. You may remember that
Jane Brophy was employed ----

MR. JUSTICE BELL: I remember her very well.
