Day 250 - 15 May 96 - Page 49

say, 'Hang on I want to check this' to see?
       A. No.

MR. JUSTICE BELL: You must stand up. In respect only to Mr.
Nicholson for the sake of our procedure.

MR. MORRIS: Sorry, you are relying entirely on what you saw in
the front cover as being the leaflet, basically?
       A. Yes, yes, that is true.

MR. MORRIS: Can we hand it up to the witness? (Handed).

MS. STEEL: That is the leaflet?
       A. No, that is not the leaflet. I am saying I have never
seen any of the leaflets with that frontispiece on it.
That is not the leaflet complained of.

MR. JUSTICE BELL: As I understand it, wherever this came from,
that is not the leaflet you were handed when you came round
the corner; that is what you are saying?
       A. That is what I am saying.

MR. MORRIS: But the leaflet that Ms. Steel was holding -----

MS. STEEL: The witness has said that he did not obtain a copy
from me of the leaflet -----

MR. JUSTICE BELL: I know. It is what I make of all the
evidence, the whole jigsaw when put together.

MR. MORRIS: For the record, that is the Veggies' version of the
       fact sheet.

MR. JUSTICE BELL: Yes, I am making a note of that.

MS. STEEL: Which is identical on its front cover.

MR. RAMPTON: My Lord, may we now be told, finally, whether it
is Ms. Steel's case that -----

MR. JUSTICE BELL: No, when she comes to the end of her
cross-examination, if she has not put it, I will ask her
       to.

MR. RAMPTON: Very well, my Lord.

MR. JUSTICE BELL: But she has an opportunity yet to do so.

MS. STEEL: Your first statement, Mr. Nicholson, what was the
       purpose of that?
       A. Well, the proof of evidence was taken in 1990.
I think, if I remember correctly, I signed it in 1993,
which was when Barlows were preparing the papers for court,
and that would be the purpose of my statement. I deal in
part with publication and in great depth with personnel
matters, employment matters, and that is what the statement
       was prepared for.

  Q. The purpose of the publication matters ---
       A. Yes.
