Day 245 - 07 May 96 - Page 26

stop. In fact, 3 people on whom writs were served did
       stop.

  Q. So what you are referring to then is that in September 1990
you served writs on 5 people?
       A. Yes.

  Q. And you count that as ignoring several requests?
       A. Well, that was one I cited here and now. I am sure
       there are others but ----

  Q. You have not got any evidence of any others because there
is none in the bundles and you would have found it if they
       existed?
       A. I assume so.

  Q. Yes, so it is basically a lie and you are lying to the
       public, are you not?
       A. I am not lying to the public.

  Q. You authorised this leaflet?
       A. Yes.

  Q. Did you verify it before you authorised it?
       A. I verified it with the people who wrote it. We went
       through it.

  Q. You did not check to see whether you had any evidence
       whatsoever that it was true?
       A. Well, I am sorry. The dates, the times, the leaflets
which involved the damaging statements are certainly true.

  Q. You lied to the public by saying that the group has ignored
several requests from McDonald's to stop publishing the
leaflet and then you went on to say: "As a last resort,
McDonald's is going to court to prove that the contents of
the leaflet are untrue and stop its publication".

Again, you are trying to paint a picture, are you not, that
really McDonald's is at the end of its tether, it has been
completely reasonable, it has tried to settle the matter
amicably, and it really did not want to go to court and
that is a pack of lies, is it not?
       A. It is not so.

MR. JUSTICE BELL: Are you going to go to another sheet?.

  MS. STEEL: Yes.

MR. JUSTICE BELL: We will have our 5-minute break there.

                           (Short adjournment)

MS. STEEL: While you have got this press release, the one at
number 1. This is a press release I think that was sent to
one of the newspapers, I cannot remember off-hand which one
it was but I could find out.

At the bottom it is dated 14th March 1994, and the fax
number, if you could confirm this, appears to be from the
