Day 129 - 25 May 95 - Page 21

Mrs. Barnes may be kind enough to take it away and, in due
course, the film will come back with a message as to
whether it is the same one or not.

MR. RAMPTON: My Lord, I think we have probably copies ourselves
of the ones we have disclosed, so we will let Mrs. Barnes
have this one, if we know which one it is.

MR. JUSTICE BELL: You need not pursue it any further, I am not
encouraging you to, but if you are anxious that you have
not got the right one, I suggest you bring it in. (To the
witness): Mrs. Barnes, you have a video recorder at home,
       have you?

  THE WITNESS: I have, yes.

MR. JUSTICE BELL: If Mrs. Barnes might take it home with her,
play it at her leisure, return it to Barlows with a
message: "Yes, this is the one in mind" or "No, this is
something completely different", in which case I hope you
will be given a copy of the one she has in mind.

  MS. STEEL: All right, OK.

MR. JUSTICE BELL: I would not have thought there was any need
for her to give evidence; we can accept her message one way
       or the other.

MS. STEEL: Right. So, if there was something that I wanted to
make a point on with the video, I would not need to show it
       to Mrs. Barnes?

MR. JUSTICE BELL: No, no, you show to me. What I suggest is
that you state in open court at any time, any day, what the
point is you want to make on it. If Mr. Rampton is not
happy with you just showing it to me in due course and
making the point, we will have to arrange some showing in
open court. But his reaction may depend entirely upon what
point you are going to make.

  MS. STEEL: Yes.

MR. JUSTICE BELL: It may be he may think it is covered by other
evidence or he may not think it is important enough to
bother to deal with or he may say: "No, this is really
rather important; we had better go about it in some formal
       way".

MS. STEEL: OK. I have nothing else to ask.

MR. JUSTICE BELL: Thank you very much.

                      (The witness withdrew)

MR. JUSTICE BELL: Mr. Rampton, unless you have any contrary
suggestions to make, what I propose to do is to adjourn now
and say we will start again at 10.15 in the morning, or so
soon as everyone is ready after 10.15 because Mr. Morris
has indicated that he will be here then. I have another
matter which has nothing to do with this case which I am
