1 Q. Well, they are talking about problems. You must have had
2 some problems?
3 A. To be set a goal and objective is not just because it
4 is a problem; it is to better yourself and to improve the
5 whole smooth operation. It might have been to just
6 actually attack the deficiencies in the restaurant.

8 Q. But these are grades that you would be expected to get;
9 yes?
10 A. And I did. I had a full field the following year,
11 I believe. I got two As and a B, which the Ops Manager was
12 very happy with.

14 Q. If we can go to the Mark Davis performance reviews. Again,
15 I am not sure if they are behind Mark Davis or if they are
16 in a separate file.

19 bundle, please, Mr. Harney. After Mr. Davis' statement,
20 there are a number of performance reviews which have
21 numbers stamped at the bottom of the page.

26 Q. This is before you were at Clacton. I think it is 1988.
27 Yes, it is. November 1988, Clacton achieved quality,
28 C grade, service B, and cleanliness B, while Colchester
29 achieved B, A, B for the same; yes?
30 A. That is what it says, yes.

35 Q. It says at the end of that first paragraph on that
36 page: "You must redress Clacton on their quality within
37 30 days." We then just note that. If we go to page 9,
38 yes, in the middle there is a little chart there and it
39 says crew numbers, 1st April 89, for Clacton there were
40 48. The target by 7.89 was 80; is that correct, yes?
41 A. I see that, yes.

43 Q. This is in March 89. If we then turn to page 5, yes, the
44 chart at the top has: "Clacton crew numbers, 1489, 48,
45 target set 80, crew numbers 9989, 60", was what you
46 achieved. This is one with you, is it not, as Manager?
47 A. As my first few months as Manager, yes.

50 A. Over the summer period, yes.

52 Q. So you had failed to reach the target, had you not?
53 A. The target, yes, the target set by Mark Davis and
54 myself and John Atherton was not achieved but, as a
55 Manager, I was -- I took the responsibility and decision to
56 actually crew my numbers to 60. The productivity of the
57 staff were exceptional, and so the numbers of 80 were not
58 necessary. It is no good having 80 crew if you cannot give
59 them any hours. That is a pure business decision and it
60 was taken by me.
