Day 190 - 23 Nov 95 - Page 37

MR. JUSTICE BELL: Are we talking about the same thing?

MR. RAMPTON: I do not know -- or Lynval said.

MR. JUSTICE BELL: Because on page 11 -----

MR. RAMPTON: I am sorry, I am on page 9 still.

  MR. JUSTICE BELL: Well -----

MR. RAMPTON: This is Mr. Alimi, who says it on page 11. He is
going to be a witness. If he is going to say it in the
witness box, and it may be admissible for the limited
       purpose -----

  MR. JUSTICE BELL: No -----

MS. STEEL: It is speaking of -----

MR. JUSTICE BELL: As I understand it, Harriet Lamb is saying to
the solicitor that they had heard the same story about the
closing of a McDonald's store from several McDonald's
       workers.

MR. MORRIS: Yes, it is the second sentence.

MR. RAMPTON: I had not actually got to that. As it happens, I
       am still on page 9.

MR. JUSTICE BELL: Yes, that is my fault, Mr. Rampton, because
that is what I thought you were referring to.

MR. RAMPTON: I do not mind. Of course, it does not matter but,
again, one has one's doubts about its admissibility anyway
for reasons of relevance. Again, the question arises
whether she did, in fact, hear it from several McDonald's
workers or whether, in fact, all she is doing is reciting
what she was told by Lynval.

MR. JUSTICE BELL: We will have to see when she gives her
evidence. Sorry, could you go back to 9?

MR. RAMPTON: Back to 9, yes. Your Lordship has already got the
point about the first paragraph on 9. It looks as though
it comes from Steve Percy -- no, I have got the wrong one.
It looks as if they come from the employees themselves and
not a matter of direct observation but, again, we will have
       to wait and see.

MR. JUSTICE BELL: That is query from Maria.

MR. RAMPTON: Yes, and query from Julie, whose real name is
Anna. Then there is mention of the boy, Ian, as well. The
next paragraph, the third paragraph, is all taken from
Lynval and is, therefore, objectionable on that ground.
The last paragraph (incomplete) going over to the top of
page 10, I do not see any particular problem with that.
That is probably mostly a direct experience, though not the
employment of 80 people, but it does not matter.
