Day 169 - 04 Oct 95 - Page 25

MR. RAMPTON: No re-examination, my Lord.

MR. JUSTICE BELL: Thank you. You may be asked to return to
court in the future, but you will just have to wait and
       see.

Insofar as Mrs. Brinley-Codd or one of her colleagues asks
you about matters to do with your evidence, then answer.
But I would like you, if anyone in the restaurant or
working for McDonald's in any capacity asks you about your
evidence or what you were asked in evidence, just to say
the judge has told you that you are not to discuss those
matters until it is known whether you are to be recalled
and if you are recalled you have completed your evidence?
       A. I understand.

MR. JUSTICE BELL: Mr. Rampton, I say that as much for the
witness's protection as for any other reason

  MR. RAMPTON: Yes.

MR. JUSTICE BELL (To the witness): Thank you.

                       (The witness withdrew)

MR. RAMPTON: My Lord, Mrs. French is here. Mr. Atkinson will
call her. I will say this now: At some stage today I
would appreciate being able to mention two things to your
Lordship, one is Mr. Cesca's dates that your Lordship asked
       us to find out about.

  MR. JUSTICE BELL: Yes

MR. RAMPTON: We now have that information. The other is the
       matter of the French witnesses.

MR. JUSTICE BELL: Why do we not do that now?

MR. RAMPTON: If your Lordship wishes, yes. Can I take
Mr. Cesca first? That is very simple. Your Lordship
indicated a strong preference -- I think were your
Lordship's words -- that he should be called on Monday,
11th December to go through, if necessary, to the end of
       Thursday, the 21st.

My Lord, the position is this: He is chairing an
international conference in the People's Republic of China
for the preceding week, the one beginning 4th or, at any
rate, some part of that week. He has found out that he can
get an aeroplane from Beijing, I think it is, to this
country on Sunday, 10th. Because of the way the time
works, what is, I think, an 11 or 13 hour flight, I forget
which way round it is, he would not arrive in this country
       until Sunday evening on 10th.

What I would ask is that he could be given Monday, 11th to
recover before he has to give evidence, and that he should
start his evidence on Tuesday, 12th.
