     5        A.  I cannot remember; I do not know whether they did.  I
     6        remember the incident but I cannot remember the detail of

    10        A.  -- and I did not deal with it.  It was dealt with by
    11        the regional office.

    13   Q.   So you would not have been concerned to find out?
    14        A.  Oh, yes, I would be concerned.  I saw the report but
    15        I cannot remember now what happened.

    17   Q.   Do you know, I know it is not in your present capacity, in
    18        Southend, 1992/3, I think it was actually New Year's Eve,
    19        raw sewage was discovered in the food preparation area and
    20        an Emergency Prohibition Notice for Insanitary Premises was
    21        served on the store?  Do you know about that incident?
    22        A.  I heard about it.  I am aware that it occurred.

    24   Q.   Do you know what action was taken against the management?
    25        A.  No, no, I have no idea.

    27   Q.   Are you aware of sewage on floors or breakdowns of sewage
    28        systems or sewage appearing in McDonald's stores happening
    29        from time to time?
    30        A.  No.  To my knowledge, that was the only time it had
    31        ever occurred and, no, I do not think I should really say
    32        anything further about it because I was not involved in it.

    35        A.  Yes.

    37   Q.   But if that kind of problem was cropping up from time to
    38        time, you would expect to hear about it, would you?
    39        A.  Well, I heard about that one.

    42        A.  Yes, I would expect -- I mean, everybody would ---

    48        would get to find out about it?

    51   Q.   What action would you expect the management to take if they 
    52        were aware that sewage was present in the store, whether in 
    53        the customers' area or the kitchen area?  What immediate
    54        action would you expect them to take?
    55        A.  Yes, I have to be careful here because -- this is
    56        hearsay my Lord -- I heard that you could not identify it
    57        as sewage, it was just water.

    60        A.  Well, they did not know.  It was water but they did not
