3 MR. JUSTICE BELL: Do not forget, Mr. Morris, that at the end of
4 the day, as I understood it, looking at pages 5 and then 13
5 and following of tab 3 of the Extract, what you are seeking
6 to establish is that "in order to ensure the food looks and
7 tastes the same, etcetera, the Plaintiffs use a number of
8 chemical additives in the preparation of their food. 43
9 were listed. A number of these are believed", that is
10 amended from "known", "to have undesirable side-effects.
11 Some of the listed additives are specifically listed by the
12 Hyperactive Children Support Group as unsuitable for such
13 children".

15 Then a little later on, giving further and better
16 particulars really of that, you asked for the identity of
17 each of the additives listed in the booklet published by
18 the Second Plaintiffs in or around 1989 which are known to
19 have indesirable side-effects, specifying the said
20 side-effects, and those listed additives which are alleged
21 to be unsuitable for hyperactive children. Then the 10 or
22 so are actually listed with alleged details of the adverse
23 reactions which it is said that they can cause.

28 is not relevant to that, but you have to tie it into that
29 really.

35 note is the relevance of this, so that I do not just accept
36 that they are safe because they have been passed by one of
37 these bodies.

44 had a chance to amend the pleadings, as you indicated, to
45 include specific things that may have been missed out, but
46 are included in the statements that we have. So, we are
47 still in that sort of vague area where our statements are
48 taken as part of our pleadings.
