Day 208 - 24 Jan 96 - Page 30

unconscionable, but they are prepared to break the law as
well, then it may well be relevant to take on board that
       possible distinction.

MR. MORRIS: Yes. Let us just see where we are.

MR. JUSTICE BELL: Yes. Take a seat if you want to, Mr. Cox,
       for a moment. (Pause)

MS. STEEL: Just still on breaks, when you say that -- maybe
I will not bother. You said you have had no problem with
performance reviews. Do you think you are lucky then --
because other people have, have they not?
       A. I do know of people that have had late PRs. The back
pay is always added, so it does not really cause a
       problem.

  Q. They might have left the Company by the time the back pay
       gets added, might they not?
       A. It is very unlikely.

  Q. If someone has a PR review that is a year late, they have
been going without their extra pay for a year, have they
       not?
       A. Yes. Again, I have not heard of anybody that has had
their PR a year late. I mean, I may be wrong. I do not
       know.

  Q. You do not really know what the situation is with other
people's PRs, other than you have heard that people have
had problems that they have been delayed; beyond that, you
       do not really know?
       A. PRs are confidential; so, no, I do not.

  Q. You say in the last sentence of the paragraph about
performance reviews that you believe the pay to be
competitive and you have been content with it, even though
you had to ask to work more hours because you wanted more
       money.
       A. Sorry, where -----

  Q. On page 5.
       A. Yes, I would agree with that statement. But that
happens in any job; you are never going to have enough or
as much as you would like, no matter how much you get paid.

  Q. When you go to the pub with your friends and talk about
your pay, is that what you say: "My pay is competitive"?
       A. At the moment, I am probably earning more than most of
       my friends.

  Q. Because you have been promoted?
       A. I am talking about friends from outside of the store.
       I do not go out very often with people from in the store;
       maybe once a month.

  Q. Yes. But at the moment it is because you have been
promoted and so you receive a higher rate of pay, and you
have been there a long time?
       A. But, surely, it depends? That is the same in any job.
