3 number of documents to be looked at as well as to re-read.
4 I am not against doing Mr. Fairgrieve as soon as possible;
5 it is just that without any breaks it is difficult to do
6 that fairly. I do not know why he was put in there really.

8 MR. JUSTICE BELL: Do you have an employment witness who could
9 go at, let us suppose, who you think would not take more
10 than part of Friday and the whole of Monday?

12 MR. RAMPTON: Yes, I have. My Lord, the problem really is
13 this. I do not mind who it is. I have certainly, yes.
14 I can put Mr. Gardina in on Friday and will do so, but the
15 problem is that they need to be told.

17 MR. JUSTICE BELL: Yes. In fact it does not have to be someone
18 whom we can guarantee finishing on Monday, because we can
19 do the interlocutory work and then come back to a witness.
20 It is just obviously more convenient if we can have a
21 witness who can be completed in, say, a day and a half to
22 two days.

24 MR. RAMPTON: My Lord, at the moment I have Mr. Gardina -- this
25 is an old schedule now -- on Tuesday and Wednesday. If he
26 were not finished on the Monday perhaps he could complete
27 on Tuesday then we could use Wednesday for interlocutories.

29 MR. JUSTICE BELL: You say you have him on Tuesday and
30 Wednesday?

32 MR. RAMPTON: On this other schedule, yes.

34 MR. JUSTICE BELL: I do not think I have a copy of that, have I?
35 Are you suggesting he could start on Friday?

37 MR. RAMPTON: I am suggesting we take away Mr. Fairgrieve and we
38 put Mr. Gardina in on Friday in the hope we would finish on
39 Monday. If he does no finish on Monday, he could finish on
40 Tuesday. We could then go straight on to deal with the
41 interlocutories, perhaps beginning on Tuesday and into
42 Wednesday. After that then I would probably call Florence
43 Farrer who at the moment I have down for Tuesday but
44 obviously would not then be heard on Tuesday. If
45 Mr. Gardina should be finished on Monday, then we could do
46 the interlocutories on Tuesday and I would call Mrs. Farrer
47 on Wednesday.

49 Also I know at some stage your Lordship will want to give
50 rulings on those matters we argued the other day. I do not
51 know whether you will keep them until all the interlocutory
52 argument is finished.

54 MR. JUSTICE BELL: I will just have to wait to see. I may well
55 manage that before the end of this week, but I will give my
56 ruling on those as soon as I am ready and it can
57 conveniently be fitted in. What I have literally pencilled
58 into my notebook is Mr. Davis to continue for the time
59 being; Mr. Gardina for Friday; interlocutory matters
60 Tuesday or Wednesday; Mrs. Farrer Wednesday or Thursday.
