       A. Investigate it, report it to my hierarchy, and much,
much more than likely he would be dismissed.

MR. RAMPTON: There is only thing left now which is the union
       leaflet incident.

MR. JUSTICE BELL: I was giving an opportunity to see if you
completed examination-in-chief and then we will have the
       break.

MR. RAMPTON: No, I will stick to my two hours or slightly less.

MR. JUSTICE BELL: I think you had better have the five-minute
break there. Can someone tell me, the Civil Evidence Act
notice in respect of Mr. Magee, what was the ground there?
       Was it a formal notice?

MR. RAMPTON: Abroad, beyond the seas, my Lord.

                      (Short Adjournment).

MR. RAMPTON: Mr. Giardina, you have read, I take it, what
Mr. Magee had to say about a supposed incident with union
       leaflets?
       A. I have, yes.

  Q. Do you remember anything about union leaflets while you
       were Manager at Seven Sisters?
       A. Vaguely, yes.

  Q. Tell us what you remember about it?
       A. On one particular incident I went into the crew room
and there were leaflets lying face up scattered all over
the desk, all over the tables, like any other bit of environment/index.html">litter
or anything that I would see in the crew room I threw it
       away.

  Q. You threw it away?
       A. Just put it in the bin.

  Q. Did you bother to read it?
       A. No.

  Q. Were you conscious that it was in some sense concerned with
       trade unions?
       A. Yes, I mean it had some large lettering on the front
related to union. I cannot remember what it was, but
I just did not stop to read it.

  Q. My Lord, I am not asking the witness to fetch it, but it is
volume pink XI, tab 1, page 25 of the file number.
Mr. Giardina, this is the Crew Handbook for June 1986 which
was during your time only just, but I have one for 87 but
I am sure it is the same one. It says, Mr. Giardina, this,
under basic guidelines and responsibilities: "Crew or
outside persons cannot seek custom money or subscriptions
or distribute literature in the restaurant. Please tell
your Manager if you see this happening". Then it says --
my Lord, I have read K and I am now reading L -- "You
cannot use the restaurant for your external interest or
