Day 113 - 03 Apr 95 - Page 65

MR. RAMPTON: My Lord, the only thing that is not, in my belief,
entirely in the Defendants' hands is the question of their
employment witnesses, because our scheduling for July,
which is holiday time for some, depends to a large extent
on that. I would say that I would invite your Lordship to
get an update from the Defendants before we all go away for
Easter so that we can get on with it.

MR. JUSTICE BELL: At the moment, on what I have been told by
you, what I would like to do is, supposing we finish
Dr. Long tomorrow, if you can call Mr. Bruton on Wednesday
morning, well and good. If you can give me some
information about the response to the questionnaire on
Wednesday, I would like you to do so. Otherwise, I would
like you to give me the information when we resume right at
       the beginning of next term.

The first witnesses anyway next term are going to be
called, whatever the position is with your own employment
witnesses. There is no question of them not being called,
as I understand it, dependent on the response, or lack of
it, to the questionnaires -- not questionnaires, the form
of enquiry which was sent out.

I would like some information on Wednesday if Mr. Bruton is
called then, and a pretty comprehensive assessment of the
situation in any event at the beginning of next term. If
you cannot get hold of Mr. Bruton in order to get him here
on Wednesday, then it looks at the moment as if we will
have Wednesday as a preparation day and deal with
Mr. Bruton on Thursday, and also anything you can help on
       with regard to employment witnesses.

Is there anything else which must be dealt with?

MR. RAMPTON: No, my Lord, there is nothing that needs to be
dealt with urgently, as far as we can see.

MR. JUSTICE BELL: It is just that it is tidier and probably
helps you better if we can be done by Wednesday afternoon
and you have an extra two days added to the break in any
event rather than having a preparation day on Wednesday,
       coming back on Thursday.

MR. RAMPTON: I would like to be told if Mr. Bruton is coming on
Wednesday and not to arrive here to find that he has turned
       up unexpectedly.

MR. JUSTICE BELL: What it seems to me is if you have not
managed to get hold of him by, say, 2 o'clock tomorrow
afternoon and ascertained that he can come on Wednesday,
then we will leave him to Thursday rather than have a late
       change of plan tomorrow evening.

We will resume at 10.30 in the morning.

(The court adjourned until the following day)
