Day 147 - 04 Jul 95 - Page 29
is that it is a lot of money on a daily basis.

MR. JUSTICE BELL: Provided it is not an insubstantial amount,
then -----

MR. RAMPTON: All I will say is that it is well into the
hundreds per day.

MS. STEEL: That is not the information that we were seeking.
We were seeking the cost of a copy, as in how much
journalists would be charged if they asked to purchase a
copy.

MR. RAMPTON: That is information which the Defendants may seek
quite separately from Barnett Lenton or anybody else.

MS. STEEL: Which is what we were seeking. I do not understand
why -- if the Plaintiffs know how much it is, perhaps they
can tell us in private.

MR. JUSTICE BELL: Tell me what difference it makes in
principle, because I am not going to rule on or advise
McDonald's about what they should or should not do in this
case. If I have a power to order them to do something,
then I will consider whether I should. If I reach the
conclusion that I do not have any power, then I do not have
to look. It obviously follows as to whether I would
exercise it if I did have the power.

MS. STEEL: It has a bearing on whether we are able to afford
to pay for copies of transcripts.

MR. JUSTICE BELL: Whether you would?

MS. STEEL: Yes.

MR. JUSTICE BELL: You could have asked about that yesterday
evening or this morning.

MS. STEEL: We were told a specific figure which, obviously,
I will not say, but it was a lot more than we could
afford. However, that was, I think, for provision --
I think that is different to what journalists are charged
when they just want to buy a copy of it; and that was what
we were specifically trying to find out today.

MR. JUSTICE BELL: I will hear what Mr. Rampton says, and then
I will give you an opportunity to make a telephone call to
Barnett Lenton, and see if you can find information before
I make a decision.

MR. RAMPTON: My Lord, I no longer have very much to say. I do
not really feel involved in the question of whether
Order 68 provides your Lordship with any power or
discretion to provide the funds for the Defendants to have
the transcripts.

If your Lordship wanted help from me, I would merely say
that it is quite apparent from the construction of the rule
that rule 5 applies to appeals, rule 1 applies to trials at
