Day 155 - 14 Jul 95 - Page 44

       that, would they?
       A. Yes, in some cases, yes, but some individuals, whether
it is was announced or unannounced, still achieved the same
       standards.

  Q. I am just trying to see if it is -----

MR. JUSTICE BELL: I do not think you need pursue it any
further. I can see that if a restaurant is top notched it
may be as good or just about as good when it is
unannounced. What I would have thought might be most
significant is if there is a significant disparity between
unannounced and announced, then you can probably work out
for yourself that, save when the Manager knows you are
coming, things are not too hot in the store. I mean, this
is all common sense, is it not, nothing to do with
McDonald's procedures; it is just a fact of life.

MR. MORRIS: But did you have a significant disparity between
the announced and unannounced audits at your store?
       A. No.

  Q. There was some disparity, was there?
       A. Very minimal.

  Q. Minimal?
       A. Yes.

MR. JUSTICE BELL: Try to concentrate on the things which are
particularly relevant to Mr. Giardina. We have had a lot
of people talking about general McDonald's practices. We
really are now getting on to witnesses who have something
to say about particular incidents or allegations which were
made. It is fair enough for you to make some points about
the general run of things, but a time has to come when it
is not helpful, even to your own case, to go over them
again with every witness as they stick their head above the
       parapet.

MR. MORRIS: The last point on this subject, you were actually
cleaning up yourself because you knew that the Area
Supervisor was coming, is what you said, yes?
       A. Not "cleaning up" in maybe the sense I think you are
talking about. I saw a piece of environment/index.html">litter on the table.
I put it in the bin.

  Q. But you said that because you knew the Area Supervisor was
       coming?
       A. Also because I am good at housekeeping. That is what
       I would normally do anyway.

  Q. The point is, Mr. Giardina, that you called the Area
Supervisor down for an unannounced visit because of the
       union leaflets.

  MR. RAMPTON: My Lord -----

MR. JUSTICE BELL: That is a contradiction in terms, is it not,
calling someone down for an unannounced visit?
