Day 186 - 10 Nov 95 - Page 28

MS. STEEL: Yes, I do, yes.

MR. JUSTICE BELL: If it read as follows: "McDonald's food is
unhealthy because", and then let us insert some words "it
is high in", etcetera, and "low in", etcetera -- this is
really just elaboration -- "McDonald's food is unhealthy
because it is high in", etcetera, and "low in" etcetera,
I will not repeat all the words, "and eating it may well
make your diet high in fat, sugar, animal products and salt
(sodium) and low in fibre, vitamins and minerals, with some
risk that you will suffer cancer of the breast" and then
onto the end, would you really ---

  MS. STEEL: I think.

MR. JUSTICE BELL: -- join any issue with that as a meaning?

MS. STEEL: Also "will" to "may".

MR. JUSTICE BELL: There was some risk that you might suffer --
I mean, I am not doing this as bargaining, you understand
it, just make sure I understand how big the issue is, you
       see?

  MS. STEEL: Yes.

MR. JUSTICE BELL: So just take a moment to think about that,
because it occurs to me that if altered in that way, it is
very much the same as the meaning equivalent of F which you
       put forward.

  MS. STEEL: Right.

MR. JUSTICE BELL: You have put the portrayal of the food as
useful and a nutritious part of the diet first, and the
possible risks of it second, but that does not matter.
That is just the way it is expressed.

MS. STEEL: Can I just say, in some ways it does not matter but
in other ways it is actually the key because it is
rebutting. The purpose of the section that says: "What
they do not make clear is that a diet high in", etcetera,
"is linked", etcetera, is to say that their products are
not a useful and nutritious part of any diet. They are the
part that we are being advised to cut out because if you do
not cut out products that are high in fat, etcetera, you
are going to, you know ---

MR. JUSTICE BELL: Yes, I understand.

MS. STEEL: -- you are running the risk that you are going to
       make your diet high -----

MR. JUSTICE BELL: I understand the point you are making in that
       respect.

MR. MORRIS: I think the word "high" should be "higher" in the
second line. If you are going to link McDonald's food with
the diet issue, because we believe it is all about the diet
