Day 117 - 27 Apr 95 - Page 30

(To the witness): Thank you, Mr. Nicholson. You will be
asked to come back at 10.30 on Monday. Unless Ms. Steel or
Mr. Morris make any objection, I am content that you should
talk to Mrs. Brinley-Codd, Mr. Hill, Mr. Rampton or
Mr. Atkinson about anything to do with the conduct of the
case generally or anything to do, I do not suppose it will
arise, with the publications aspect in this case, but not
in relation to the evidence you have given or any question
you think you might be asked by Ms. Steel or Mr. Morris
about the various employment matters.

THE WITNESS: Yes, I fully understand that.

(The witness withdrew)

MR. RAMPTON: My Lord, as far as I am concerned, there are three
things which I should like to mention, two of them your
Lordship is already aware of. Can I deal with one that
your Lordship mentioned when we were last here ---

MR. JUSTICE BELL: Yes.

MR. RAMPTON: -- last term which is the question of Miss Hovi
and Jarretts? I said that I would try to tell your
Lordship what my intentions were today or by the end of
this week; since we are not here tomorrow, I will do it
now. I would wish Ms. Hovi to be recalled for further
cross-examination whenever it is convenient to her and to
your Lordship.

I would also invite your Lordship to give me leave to call
evidence in rebuttal of the allegations that she made
without notice when she gave evidence-in-chief. I will
serve, of course, in due course as soon as I can a witness
statement setting out the evidence which I would wish to
give in rebuttal.

MR. JUSTICE BELL: It seems to me, obviously, it is important
that Ms. Hovi be recalled as soon as possible, so that the
matter is out of her way, quite apart from anything else,
but that the first thing to do is to have the statement or
statements of any witness or witnesses whom you would seek
my leave to call in rebuttal. If there is any issue as to
whether you should have leave, then obviously one wants to
know what topics it is proposed that any witness would
cover. So, what is the timing in relation to service?

MR. RAMPTON: That is not entirely in my hands. We have said
that it is urgent. We will do it just as soon as we
possibly can. One of the things I will reveal now which is
taking a little bit of time that I want to have done and
can be done is being done, is that the plan we have of the
Jarrett layout is, apparently, in some important respects
defective. We are having a new one done by the people who
did the original one to scale which we will be
comprehensive. That has taking a little bit of time since
it is a professional drawing, but it is being done
specifically in order to deal with some of the assertions
made by Ms. Hovi of which we have not had notice. That is
