Day 034 - 11 Oct 94 - Page 73

be able to say, "Well, elsewhere in the book I made this
point." So I think it is unlikely that he can be taken
       advantage of in any way.

It may not be purely as to credit, because it may be a
springboard to asking about matters of expert opinion or
fact as well, but we will have to wait and see.

MR. MORRIS: Yes. For the record I think ----

MR. JUSTICE BELL: Do you not have a copy of the book?

MR. MORRIS: No. I just have the extracts Mr. Rampton has given
us. I think, considering the amount of volume of
documents in this case and the lack of volume in my house,
it is helpful not to have necessarily copies of every full
document in the case. We will trust the Plaintiffs to
make sure that any relevant sections are given.

MR. RAMPTON: I hope, my Lord, that the whole of the section on
cancer and its references have been copied, because they
do go to the issue and are not simply on credit. I shall
be asking questions about those tomorrow.

MR. JUSTICE BELL: Yes. I would be surprise, Dr. Barnard, if
Mr. Rampton asked you about one page and you thought there
was something else in the book which ought to be referred
to, to put it in its correct perspective, you would be
able to remember that there was something elsewhere in the
       book, would you not?

  THE WITNESS: Yes.

MR. MORRIS: Is it possible for him to keep that file he has
got and he can check in case there are other
       sections -----

MR. JUSTICE BELL: There is absolutely no reason why
Dr. Barnard should not take that file away with him.

MR. RAMPTON: Not at all. I quite agree.

THE WITNESS: Thank you my Lord.

MR. RAMPTON: We wondered whether we might borrow your
Lordship's to make another copy tonight?

MR. JUSTICE BELL: Yes, certainly. What I am doing, as I have
done with all other documents, is I am just putting
underlining or putting marginal lines in the parts which
have been put to a witness.

MR. MORRIS: One final point, Peter Cox was going to be on
tomorrow but he is present in court so he is aware that he
       is going to be delayed.

MR. JUSTICE BELL: He knows as much about the schedule as we do
       now.

You talk to Mr. Cox about the schedule in case it
