Day 241 - 26 Apr 96 - Page 20

any weight to it. So far as advertising is concerned you
have called witnesses you say are expert on that, who
descended particulars as to what they are criticised and
       why.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: I clearly do not want to be rude to
Mr. Mitchell but I cannot see that 3 helps me at all. It
is just a point of view. And 4 and 5 does seem to me to
fall foul of the point against evidence as to -----

MR. MORRIS: It seems 4 and 5 is about the interpretation, or
       the rights.

MR. JUSTICE BELL: I think it is. Quite frankly, I can tell you
now 3 is just not going to help me. For better or worst,
you have got much more focussed evidence on that that on
advertising which you have already called.

MR. MORRIS: Right. I mean, in the light of that we may not.

MR. JUSTICE BELL: I would invite you not to call Mr. Mitchell.
If you do, you have had warning there will be an objection
to admissibility when he comes to the witness box. You may
find he has wasted his time in coming, but you think about
       that.

  MR. MORRIS: Yes OK.

MR. JUSTICE BELL: We will have our 5-minute break. Quite apart
from anything else, that leaves the question of the
       voluntary particulars.

                         (Short adjournment)

MR. MORRIS: Clearing up some of the general environment
witnesses. First of all we are not going to call Piers
Corbyn, or read his statement out.

MR. JUSTICE BELL: Let me just find him.

MS. STEEL: We could not read the statement out because he is
       not abroad.

MR. MORRIS: We do not intend to call him. Piers Corbyn, that
is number 4 destruction of the environment.

MR. JUSTICE BELL: Yes, thank you.

MR. MORRIS: Now, the next one I was going to come on to was
just advice on this. The statement of Laura Waters; I do
not know what number it is in the bundle. It should be in
       section G.

MR. JUSTICE BELL: She is from Veggies, is not she?

  MR. MORRIS: Yes.
