Day 067 - 15 Dec 94 - Page 34

did not have any animal welfare policy?

MR. JUSTICE BELL: You had better put the word "written" in, had
you not? I mean, maybe you are saying general but at the
moment you are written, you see.

MR. MORRIS: You would agree ----

MR. JUSTICE BELL: Take it in stages. Take "written" first and
       then go to "any".

MR. MORRIS: Is there any written animal welfare policy of the
McDonald's Corporation apart from that mention or by
       implication there?
       A. I need to -- I think -----

MR. RAMPTON: Maybe I can take it this far in aid of Dr. Gomez
Gonzalez' deliberations over lunch, if one looks at page
21, one sees the international product specification
addendum, and one looks at paragraph No. 3 at the bottom of
the page, I do not think know if that helps or not?

MR. JUSTICE BELL: I am going to break off now. I would like
you to take that pink volume away with you. You have a
number of things to do. I want you to look in the pink
volume. What we are looking for at the moment really (and
then you, no doubt, will be asked more questions if we have
an answer to that question) is whether there is any
reference in any document that we can find to the Humane
Slaughter Act seems to me to be the first step. We have
other references which at best might be said to be more
oblique. It sounds to me as if you have in mind that there
was a reference to the Humane Slaughter Act?
       A. Yes, I seem to remember that part.

  Q. Right, I will come back at ten past two.

MR. MORRIS: Can we ask if the witness can be reminded that he
is not allowed to discuss this with the -----

MR. JUSTICE BELL: No. All you are going to do over lunch-time
is draw to Mrs. Brinley-Codd's attention any other
documentation in your briefcase which may be relevant to
the issues. Mrs. Brinley-Codd will make sure that any such
discussion does not embark on to fact-finding or search of
this bundle of the kind I have referred to. What I would
like you to do is think and look to see if you can find any
reference to the Humane Slaughter Act as well.
       A. Yes, OK.

MR. JUSTICE BELL: I will come back at ten past two.

                      (Luncheon Adjournment)
                                                    2.10 p.m.

MR. RAMPTON: My Lord, before we start again I have looked at
this document signed by Dr. Mark Pattison, dated March
       1993, Presentation of McDonald's staff, 1st April 1993.
I have no reason to suppose that it is in any sense
privileged. It seems to have come into this court via
