     1   MR. MORRIS:  If it is possible to keep an open mind on our
     2        request rather than close the door on it?

     4   MR. JUSTICE BELL:  We will discuss it again.  I appreciate you
     5        may be very anxious about it as an ordeal and whether you
     6        will cope with it, but worrying about it at this stage,
     7        quite frankly, is not going to help you.

     9   MR. RAMPTON:  The other idea which had occurred to me -- it is
    10        premature to mention it now perhaps -- is whether, in fact,
    11        it might be advisable to make submissions about meaning,
    12        get rulings on those questions before making any kind of
    13        submission or address about the evidence, because it is
    14        clear that in certain circumstances much of the evidence
    15        could be ignored. It would certainly shorten things a good
    16        deal.  I merely float that as an idea for your Lordship to
    17        consider.

    19   MR. JUSTICE BELL:  We will see.

    21   MS. STEEL:   This is not on the schedule, but we wanted to ask
    22        about it, if we could have Dr. Gregory's address from the
    23        Plaintiffs so that we could contact him about those
    24        documents that we brought up.

    26   MR. JUSTICE BELL:  He was going to get some figures such as
    27        timings from Bristol or he was going to suggest a way that
    28        they might be obtained, were those the ones?

    30   MS. STEEL:  Yes, that is right.  We were asked that we should
    31        contact him if we wanted that information.

    33   MR. RAMPTON:  I think I said this before.  I have no objection
    34        to the Defendants contacting Dr. Gregory.  They can
    35        probably reach him through Bristol University.
    36        Mrs. Brinley-Codd does not know where he is.  I cannot even
    37        remember the name of the place in New Zealand that he is
    38        going to, but I expect that is on the transcript.  What he
    39        said was that he would look and see if he had any figures.
    40        I am told that he did look and he has not.   That does not
    41        stop the Defendants asking him again.

    43   MR. JUSTICE BELL:  Did he not at the beginning of his evidence
    44        say where he was going in New Zealand to take up his chair,
    45        what the chair was?

    47   MR. RAMPTON:  I think he mentioned the place, yes.  I do not
    48        think he gave an address.  It should not be difficult; he
    49        is known as Professor Gregory and he is known to be in a
    50        place in New Zealand.  I know it is not Aukland and, 
    51        therefore, it is not a huge place.  He probably also said 
    52        what the university was that he was going to.  The 
    53        information could be obtained from Bristol University.

    55   MR. MORRIS:  We will try to do that anyway.

    57   MR. JUSTICE BELL:  Raise it again if you have any problem.

    59   MR. MORRIS:  The last point, going back to the schedule, is that
    60        this is turning out to be a quite exceptionally long case
