Day 042 - 31 Oct 94 - Page 53

MR. JUSTICE BELL: When you say there are four, and they say
there is a different one each week, does that mean, for
instance, Week 1 of the campaign, one colour of car, or
whatever it may, will come with the Happy Meal, and that
the second week another colour, the third a third, and the
       fourth a fourth?
       A. Yes, that is correct, my Lord.

  Q. So you cannot go in four days in a row in the middle of the
second week and collect all four of your toys?
       A. That is not how it is supposed to be run. I am sure
some people do. We would not have an argument with them.

  Q. The point is: can they ask for colours, or do they have to
go for a McDonald's meal in each of the four consecutive
weeks in order to get the set?
       A. Yes. The way we would obviously like it to run would
be the way you put at the end, which was that they come in
in four separate weeks. If people come in, I mean, in
between times to get them, to collect them, we would not
wish to have an argument with the customer; we try keep the
customer satisfied at all times. Therefore, we would try
to honour their request, assuming we had all four in stock.

MS. STEEL: Can I just clarify? If people came in, you said you
would honour it if you had them in stock. Would that be if
they bought four Mac meals all at one go?
       A. It is really up to the discretion of the restaurant.
Some restaurants would say that if someone really wanted to
collect all four for a specific reason at one time, they
would sell them the premium separately from the Happy
Meal. That does happen. It is obviously not the way the
programme is set up, but it can happen.

MS. STEEL: Can we just show the last one again?

MR. JUSTICE BELL: Do we need to see it again, or can you ask a
       question about it?

MS. STEEL: I just wanted to check something.

MR. JUSTICE BELL: Yes, very well.

(The advertisement was shown once more)

MS. STEEL: In that advert, did you see any children's hands for
       comparison?
       A. It is interesting, because I remember this one, and the
ITC said that the scale of the box, the size of the box, is
a good enough balance between the size of the car and the
       box.

  Q. That would be all right; they thought they would be all
       right, did they?
       A. Yes.

  Q. Were they concerned about children who might never have had
a Happy Meal and might not know how big the boxes were?
       A. No, they were not. The Happy Meal is extremely well
established here now in the UK.
