Day 060 - 02 Dec 94 - Page 57

produced this year. Do you recognise it?
       A. I recognise the Fact Book but there is no date on it,
       no.

  Q. Anyway, if you could just read the part we were looking at
on page 39? Can you confirm that it is giving the figures
there for 1993 and it says 80 per cent recycled content for
       carry-out bags?
       A. It does, yes.

MR. JUSTICE BELL: What page is it?
       A. This is 39.

MS. STEEL: OK. Have you some reason for thinking that might
be wrong or any reason for thinking that might be wrong?
       A. It looks like it is.

  Q. You think it is wrong?
       A. This is written by the Environment Department based on
the knowledge and records we have in the Purchasing
Department. That would not be correct. That would be
       understated.

MR. JUSTICE BELL: You do not think you could be wrong about the
       100 per cent since 1991?
       A. I do not think so, no. We could certainly look into
       our records and check it.

MR. RAMPTON: My Lord, I was going to suggest -- I did not know
of its existence -- we ought to have a look at this
suppliers' file, or whatever it is, to see what basic
       information there is.

MR. JUSTICE BELL: There we are, if we can get to the bottom of
it. I might say it is not a jibe at McDonald's, but it
would be unlike them to underplay their hand on
       environmental matters such as this.

MR. RAMPTON: It may depend who got what information from where,
we just do not know. I am not going to start speculating
       at the moment.

MR. JUSTICE BELL: You have stirred up a number of points of
information which are different to the 100 per cent in
relation to paper bags from 1991 from Mr. Oakley's
statement. What I suggest is you leave it there.

MS. STEEL: I just have something else that I wanted to put to
       him actually.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Again, I am afraid it is something I have not got a
       spare copy of.

MR. JUSTICE BELL: Identify the document.

MS. STEEL: It is The Times, the eight-page pullout in The Times
       a couple of months ago.
