     1        A.  I guess it would tend to how the problem developed in
     2        the mind of the Manager, the shift running Manager.  I do
     3        not necessarily have to know every intimate detail that is
     4        going into the restaurant.

     6   Q.   If it was a recurring problem would you expect to know
     7        about it?
     8        A.  I would hope so.

    10   Q.   Who would you have expected to be informed by?
    11        A.  The Store Manager.

    13   Q.   Mr. Davies?
    14        A.  Yes.

    16   Q.   But not if it was just a one-off?
    17        A.  He may still mention it to me in terms of my
    18        conversations with him, either in person or on the
    19        telephone.

    21   Q.   But if it was just a one-off would you be concerned if you
    22        later found out about it but you had not been told at the
    23        time?
    24        A.  I would trust the Manager's judgment on all matters.

    26   Q.   To make his own decision?
    27        A.  To make his own decision.  I am not saying it did not
    28        happen.  I just do not recall it.

    30   Q.   You say in your statement on page 230 that a Store Manager
    31        would not make the crew work through the night in
    32        anticipation of such a regular visit, a regular visit being
    33        one from the Area Supervisor, I think; yes, that is right,
    34        if you read a bit earlier on.

    36        Then you go on to say, "This contrast as mentioned above
    37        with a visit by a more senior member of management such as
    38        the Operations Manager or Market Manager."  So when
    39        Operations Managers and Market Managers and, presumably,
    40        anyone above them was visiting, the Store Manager would
    41        make crew work through the night in anticipation of the
    42        visit?
    43        A.  He would ask if anybody would wish to, but he would not
    44        make any crew work through the night.

    46   Q.   But whether or not the crew were made to work, there would
    47        be a shift scheduled in those circumstances?
    48        A.  In anticipation we would probably put four people on at
    49        12 midnight to six, or whatever, five or six shift
    50        certainly; but that would not be because no one is needed 
    51        to work those hours normally; therefore, there is no 
    52        obligation on their part to work those hours.  It is purely 
    53        voluntary.

    55   Q.   So what would happen if you had some kind of senior
    56        management coming down and everybody said, "Oh, we do not
    57        feel like working tonight"?
    58        A.  It never happened.
