Day 121 - 04 May 95 - Page 29

number of hours just on one time sheet?
       A. Well, I do not know that this is the complete time
sheet. This is just one page. I know nothing about this
       store.

  Q. This is all that your company disclosed so .....

MR. RAMPTON: No, my Lord. This was disclosed because of the
lady whose name is in bold in the middle of the page.

MS. STEEL: I know it was, but this was all that was disclosed.

MR. JUSTICE BELL: Yes. All he is saying is he does not know
whether that is the complete payroll for the stores; it may
       be, it may not.

MS. STEEL: Whether or not it is the complete payroll for the
store, there are a considerable number of people there who
       are working -----
       A. Well, I have not added those figures up and some of
them -- I will take your word for it on what you have
said. I do not find anything wrong with it.

  Q. You have not got a problem with that number of people
       working -----
       A. But I do not know what the size of the store is now.
The document on its own there is, to me, meaningless.

  Q. You do not know the Shirley store at all?
       A. No.

MR. JUSTICE BELL: What is being put to you -----
       A. Is there seems to be a lot of people working overtime.

MR. JUSTICE BELL: Have you added up the number of names,
       Ms. Steel.

MS. STEEL: I think it is nine.

MR. JUSTICE BELL: No, the number of names altogether.

MS. STEEL: Yes, 53, I think.

  MR. JUSTICE BELL:  Thank you.  There are 53 names on that page;
nine of them worked for more than 78 hours. In fact, if
one put aside the 78.2 and the 79.11, because they are
       pretty near the mark ---
       A. So there is seven.

  Q. -- seven of them worked more than 80 hours. Just hold on a
moment. Six of them worked at least seven hours above the
78 for that fortnight. What you are being asked is what
       you make of that.
       A. Right. I would expect that to come up on that report.

  Q. Yes, but would it concern you that the ---
       A. Not until I found out the reason.

  Q. -- the policy of not working more than 39 hours a week has
       gone to the wall?
