     1        have had a fair opportunity to see that through.  If it
     2        means that Ms. Tobin has to be called after the rest of the
     3        employment witnesses have been called and interposed, as it
     4        were, in another part of the case, then so be it.

     6   MR. RAMPTON:  My Lord, the employment evidence is now in such a
     7        pickle anyway, as your Lordship will see tomorrow, or the
     8        order of witnesses is, but perhaps that does not matter
     9        anyway.

    11   MR. JUSTICE BELL:  No.  We will see when we come to scheduling.
    12        The nearer we get to the end of the case the less I am
    13        concerned about trying to keep the evidence in
    14        compartments.  I am convinced that it was a good idea to
    15        try to keep the evidence in compartments from the
    16        beginning, so that we would all have a better chance of
    17        coping with the issues, but now we have got through most of
    18        the topics, I think that has that is far less important.

    20   MR. RAMPTON:  I am very relieved it hear that.  I shall also be
    21        inviting your Lordship to say that so far as even indeed as
    22        the employment witnesses are concerned, it is not sensible
    23        to try, because it is not going to be possible, to have the
    24        Plaintiffs' and the Defendants' witnesses tried strictly
    25        back to back.  I am not telling your Lordship that I am
    26        going to make an application to call rebuttal evidence.
    27        That is not what I mean.  But there may be cases in which
    28        I have to ask your Lordship's permission to interpose, so
    29        as we do not lose time, some of my witnesses during the
    30        course of the Defendants' evidence on employment.

    32   MR. JUSTICE BELL:  We will talk about that tomorrow.

    34   MR. MORRIS:  That does not sound as if it is going to be a very
    35        pleasant experience for us.

    37   MR. JUSTICE BELL:  We will talk about scheduling tomorrow and we
    38        will see if we can make some useful decisions on that then.
