Day 012 - 18 Jul 94 - Page 38

1 saturated fat; only 9 mg of cholesterol and 4.6 g
saturated fat. Well within established guidelines for
     2 good nutrition.

3 You are trying to get a handle on cholesterol. So are
we"; then the information passage. Over the page again
4 the expanded information about cholesterol, "More about
cholesterol and McDonald's good food". Then: "First. How
5 much cholesterol is too much cholesterol?" Then, "What
about what our world famous french fries", do you have
     6 that?
              A. Yes.
     7
         Q. "McDonald's french fries are cooked in a blend of beef and
8 vegetable shortening. Anything else and they wouldn't
have that world famous taste. But you'll be happy to
9 know that a regular order of McDonald's golden fries
contains only 9 mg of cholesterol, only 4.6 g saturated
10 fat and a total of only 220 calories.

11 We use two kinds of shortening. In addition to the
blended shortening for our french fries and hash browns,
    12 we've recently switched to a 100% cholesterol-free
vegetable shortening to cook our chicken McNuggets,
13 filet-o-fish and pies. This change enabled us to lower
cholesterol in these items". Then on the right-hand side
14 we see another column of a kind we have seen before.
              A. Yes.
    15
         Q. Is this the advertisement to which that memorandum that we
16 looked at earlier about the cholesterol, is this the
advertisement that was being talked about?
    17 A. Yes, it was.

18 Q. Or I should say an earlier form of it?
              A. Yes.
    19
         Q. Then there is some more about a leaner hamburger,
    20         "Communicating with customers and the news media";
getting ready some reproductions of the sort of material
21 that one can get from McDonald's?
              A. Yes, nutrition information, that is correct.
    22
         Q. Then the last page, I think it is the last page, there is
23 the fact booklet, "McDonald's Food - the Facts" that we
looked at earlier, is it not? Have you got that?
    24 A. Yes, I do.

25 Q. It is on the back page of your document. I want to turn,
if I may, we looked at what the complaint was, we started
26 to, which we find or I did find -- starting at page 152 in
tab 7, that is the response -- 127; I had got down I think
27 more or less to the first numbered paragraph at the bottom
of that page. This is a letter from Robert Abrams in New
    28 York?
              A. Yes, I have it.
    29
         Q. He writes: "The advertisement discussing salt (sodium)
30 content in foods says, 'Our sodium is down across the
menu' (emphasis added). This is not true. That same
