Day 197 - 07 Dec 95 - Page 48

Q. I want you now, if you will, to have a look at some of
your performance reviews. You will find them, I hope,
behind your statement.

MR. JUSTICE BELL: It is divider 31 right at the back.

MR. RAMPTON: Can you look, first of all, at page 3? I do not
know whether it is 3 at the bottom or 2 at the top.
A. Yes.

Q. "Hours of employment. The employment is full-time. There
are no fixed weekly hours for restaurant management.
However, the Company operates a six days on with two days
off rota" -- later changed, do you agree, I think, to five
to two,"where this is possible", yes?
A. Yes.

Q. You told us this morning that the pressure exerted on you,
presumably by Mr. Mark Davis, amongst others, as Manager,
meant that, although that is what your contract said or
suggested, you were, in fact, working six days a week?
A. That is correct.

Q. Can you turn to page 14, please?
A. Yes.

Q. This is your performance review as a Second Assistant. I
remind you that were appointed Second Assistant in March
of that year, 1985. This is dated 21st November 1985. It
is headed: "Ray Coton", misspelt, I apologise for that,
"Second Assistant". Are the signatures at the bottom
yours and Mark Davies?
A. They look correct, yes.

Q. Please look at the paragraph headed at the top of the page
"Reliability", yes?
A. Yes.

Q. "Excellent. Remember to balance the needs of the store
with your personal needs. Sometimes an extra hour can
save two on another night.

Self-motivation. Being a married man" --- were you
married at this date, Mr. Coton?
A. I was, yes.

Q. -- "it is your duty to spend as much time at home as
possible. This could be turned to your advantage. If the
store is running to its full potential, then there is no
reason why two days off a week should not become the
norm. What better incentive to get the place running on a
surer footing. So, do not get despondent, think
positively and things will definitely get better". That
comes from the Manager of the store, does it not,
Mr. Coton?
A. It does, yes.

Q. He is telling you not to work so hard, to pay attention to
your personal life and make sure by organising your work
