Day 075 - 17 Jan 95 - Page 44
was set up and the way it was intended to operate, yes, it
would.

Q. So the customers were recycling into various bins in the
store and what was McDonald's doing?

MR. RAMPTON: This witness is a witness of the fact in some
respects and an expert witness in others. For Mr. Morris
to put to this witness (and I have got my eye very firmly
on the clock) a whole lot of hypothetical questions about
evidence which may or may not have been given in this case
and expect him to answer, really, to my way of thinking, is
absurd.

MR. JUSTICE BELL: The point is, Mr. Morris, I think you have
lost your route a bit and I am going to have much more
information about this than ----

MR. MORRIS: I will get straight to the point.

MR. JUSTICE BELL: --- the Professor. Just put the point.

MR. MORRIS: Straight to the point. What did the McDonald's
tell you they were doing with the recycled material?
A. I know no more than that which is contained in the fact
sheet that you have alluded to and which we have looked at
just now.

MR. JUSTICE BELL: Was your source of information the fact
sheet?
A. No. I discussed the matter with Mr. Preston.

Q. You do not know any more than appears there?
A. No.

MR. MORRIS: Evidence has been given in this court that in fact
McDonald's did not do any recycling whatsoever with that
material.

MR. JUSTICE BELL: This is where you go off the path again
because you are not here to educate the witness about what
the facts may or may not be. I am not stopping you ----

MR. MORRIS: If it is true that they did not in fact recycle
that material, do you not think that would be evidence that
they are getting publicity when, in fact, they are not
really committed to concerns over environment/index.html">litter and waste?
A. I do not think I can answer that question.

MR. JUSTICE BELL: I was going to say, I am not stopping you
making a point of fact with the witness or something within
his particular expertise, but ----

MR. MORRIS: I was hoping he might have heard something.

MR. JUSTICE BELL: --- that is really a question you are going
to be asking me in a few months time.

MR. MORRIS: I was hoping he may have heard something about it.
