Day 151 - 10 Jul 95 - Page 30

       person out of 55 -----

  Q. Were you still the supervisor in -- you were still the
supervisor in 1987, were not you?
       A. Up to about August; so I think up to July, some time
       like that.

  Q. So, after you say you may have sorted out a problem, would
it bother you if there were more instances where Mr. Alimi
had worked more than 39 hours a week?
       A. You are asking me to make a judgment in terms of
       somebody else's requirements.

MR. JUSTICE BELL: Quite frankly, if I were you, I would put
what you have to put and then ask what conclusion -----

MISS STEEL: We have not got the payslips for the whole time
that Mr. Alimi was there; there are some missing. But of
the ones we have, there are another four instances where
Mr. Alimi worked more than 78 hours in a fortnight. Would
       that concern you?
       A. You are asking me whether or not, as a supervisor of
Colchester, I blatantly ignored any working -----

MR. JUSTICE BELL: No, that is not the question you are being
       asked at the moment.

Quite frankly, if I were you, I would put the other
payslips for later on, so that the witness has the picture
which is shown by it. Then you ask a question on the basis
of that. You can ask supplementary questions about:
"These are the only payslips we have got; there might have
been others", if you wish. But let him have the whole
picture and then ask your questions.

MISS STEEL: There is one on 18th October, 1986 ---
       A. Right.

  Q. -- where Mr. Alimi is recorded as having worked
94.02 hours. There is one on 21st February, 1987, where
Mr. Alimi is recorded as having worked 79.89 hours.

MR. JUSTICE BELL: Let us find that. I am just adjusting to the
different -- does that actually appear on that?

  MISS STEEL: It does not.

MR. JUSTICE BELL: You have to add them up. What was the figure
       again?

MISS STEEL: 79.89. Then on the following page,
       7th March, 1987, there is 87.24 hours.
       A. Right.

  Q. Then between this one and the next payslip -- there is
actually one payslip missing, but the next one is 78.39.
So there are four instances where, even with the
fortnightly payslips, you can tell that on at least four of
those weeks he must have worked more than 39 hours a week?
       A. Right.
