Day 297 - 08 Nov 96 - Page 37

32, page 38. Sorry, that they were taking that....

MR. JUSTICE BELL: He was saying they were processed with added
       salt and sugar.

MS. STEEL: They might be using basic products but they are
adding lots of extra fat, sugar and salt to those basic
products to make them more saleable and so it is misleading
to describe them as basic products.

I mentioned this yesterday, anyway, and you did say you
were not particularly attracted to it, but he said that the
phrase "balanced diet" was not a very meaningful phrase
because you could eat anything and he gave the example ----

MR. JUSTICE BELL: Did I say I was not attracted to it?

MS. STEEL: I thought you said that yesterday.

MR. JUSTICE BELL: I may have done, but I do not remember.

MR. RAMPTON: Your Lordship did say you did not think the
Sellotape example was particularly persuasive where
       balanced diet is concerned.

MR. JUSTICE BELL: I thought what I said was I took his point
but I did not think the reference to the Sellotape really
       advanced it very far.

MR. RAMPTON: No, it does not.

MR. JUSTICE BELL: I take the point absolutely. You can serve
up the most frightful rubbish, you say McDonald's do, and
then say a balanced diet is all, and that, you say, does
not solve the problem. In fact, you say it is an attempt
to get the best of both worlds, really.

MS. STEEL: Yes. Obviously the word Sellotape, there is no
       great significance about that.

MR. JUSTICE BELL: No. It was not meant to be the solution to
       the case.

MS. STEEL: Just you could describe anything as part of a
       balanced diet.

He suggested that the promotion of healthy foods -- well,
he said that the emphasis should be on the promotion of
healthy foods, which meant foods that have a high level of
nutrients per calorie, in particular, from ----

MR. JUSTICE BELL: I think you touched on this before.

MS. STEEL: Yes. Foods that have a high level of nutrients per
calorie, that was day 32, page 44.

Dr. Lobstein argued that as well as nutritional content
McDonald's need to focus on pricing, access and promotion
when considering whether sufficient attention has been
given to encouraging a healthier diet, and he gave the
