     2   MR. JUSTICE BELL:  What Mr. Rampton was suggesting to you was
     3        that McDonald's previous system of a starting rate but then
     4        performance related increases was as good as or better than
     5        just a basic rate agreed by the union plus overtime, do you
     6        see, without performance related increases?
     7        A.  Well, the only performance related increases that were
     8        established before the agreement was, I believe, one kroner
     9        for crew trainers and two kroners for floor managers, and a
    10        little bit of mathematics, I think you would find out that
    11        is not very much.

    13   MR. RAMPTON:  Are you saying there were not in Norway -- I am
    14        not in a position to contradict you, Mr. Jenssen, at the
    15        moment -- periodic performance reviews for every member of
    16        the hourly paid staff?
    17        A.  Who had the normal SOC, that is, Station Observation
    18        Checklist, which is part of the training system, everyone
    19        goes through that, but the only effect they have on your
    20        pay is that in order to become a Floor Manager, a host, a
    21        crew trainer -- yes, I forgot to mention a host also has
    22        two kroners extra -- the only connection they have with
    23        that is that you have to have all your SOCs in order, which
    24        means you have to have two or three SOCs in every station
    25        in the restaurant a hundred per cent correct and before you
    26        can be promoted so .....

    28   Q.   Can I understand?  It is probably a possibility that a
    29        different system operates, I just do not know.  Are you
    30        telling us (because one must be clear about this so that
    31        I can find out about it) that the ordinary crew member
    32        cannot get a pay rise under the old system unless he or she
    33        is promoted?
    34        A.  Yes, I have never heard about an instance where someone
    35        has been given a performance related pay that has not been
    36        connected with a promotion.

    38   Q.   I see.  Can I ask you this in relation to pay as well,
    39        Mr. Jenssen?  Was it or is it the case in McDonald's,
    40        Norway, in the restaurant where you worked, that you get
    41        paid or you got paid a different rate for different times
    42        of the day?
    43        A.  The only difference in the rates were for regular crew
    44        members and closers, those who clean the restaurant during
    45        the night.  They received 77 kroners per hour.  It says in
    46        the No. 4 letter we have here that they received 77 kroners
    47        an hour, the closers that work in the night.

    49   Q.   Leave closers on one side, please.  If an ordinary crew
    50        member worked, let us say, from 7.00 in the evening until 
    51        11 o'clock at night, would he get the same as or more than 
    52        somebody who worked from 7.00 in the morning until, let us 
    53        say, 2.00 in the afternoon?
    54        A.  He would get exactly the same.

    56   Q.   Can I ask you one final thing -- this is borne of, I am
    57        afraid, my ignorance of Norwegian -- I do not know if you
    58        have amongst those documents there a document which I know
    59        his Lordship has which is dated 26th August 1993, which
    60        comes from the HRAF?  My Lord, I think it may be the second
