Day 186 - 10 Nov 95 - Page 18

hamburgers are made" -- hamburgers in general.

In the next page, under "What's your poison?" it talks
about the health of people on a meat-based diet; that is
the very last phrase. Here we have diet again.

Obviously, the whole employment section is talking about
the catering industry. I will not go into that.

"Everything must go". I think the "Everything most go"
box is very important, where it clearly cites McDonald's
as, effectively, no different from all the other junk food
chains. It talks about them as: "They are one of the worst
examples of industries" (in general) "motivated only by
profit and geared to continual expansion and. This
       materialist mentality", etcetera.

If I can just say something which has very rarely been
looked at in this case, the actual back page of the fact
sheet, which has not been -- it is not part of the
       Statement of Claim -----

MR. RAMPTON: My Lord, I hesitate to interrupt again.

MR. MORRIS: It is part of the context.

MR. RAMPTON: No, I am sorry. There is a legal difficulty (in
Mr. Morris' words) here. If either side wants to rely on
any part of the context, they have to plead it. That
applies equally to Defendants as it does to Plaintiffs.

MS. STEEL: We have pleaded it.

MR. JUSTICE BELL: I think this argument is turning arid.
I want to know what in the text -- since you say
concentrate on the text -- I want to know your points about
that so far as meaning is concerned. At the moment, the
business about involvement of multinationals and everything
along that line seems a complete red herring so far as the
text in relation to nutrition is concerned.

  MR. MORRIS: OK.

MR. JUSTICE BELL: You do not have to go through bits. All you
need to say is that the leaflet is clearly directed at
multinationals as well as McDonald's and the effect they
may have on our lives. OK. Now -----

MR. MORRIS: All the references on the back page to "food" talk
about diet; every single reference is talking to
-- "Liberation begins in your stomach. There are loads of
cheap, tasty and nutritious alternatives to a diet based on
the decomposing flesh of dead animals: fresh fruit of all
kinds, a huge variety of local & exotic vegetables,
       cereals", etcetera.

What I am saying is, the context of this section
specifically is that McDonald's is just one of a whole
industry and it is diet that is the key to this whole
issue. Then we come to the actual text of this section.
