     1 for this action.

2 There is something else I would like to draw your
attention to: The last sentence of this introduction:
3 "When compared with other common materials used in
buildings and residences", sees those words,
4 "polystyrenes, in general, are among the least toxic"?
              A. Yes, OK, you are referring to the report?
     5
         Q. I am sorry, I will read it again: "When compared with
6 other common materials used buildings and residences,
polystyrenes, in general, are among the least toxic"?
7 A. I did refer to that in my testimony.

8 Q. Indeed you did, but it is not in your written statement,
              is it?
     9 A. No.

    10 Q. Why not?
              A. Because at the time that my written statement was
11 produced I did not have this document at hand, first of
all and, second of all, because this statement that I made
12 regarding the burning of foam is not based, is not simply
concerned with whether or not it is less of a problem to
13 burn foam than to burn other materials.

14 The question specifically that was raised by my research
is whether or not there was a problem -- there were
15 problems, there were emissions, other than the ones that
McDonald's asserted, associated with the burning of foam.
16 So the statement reads that indeed there is research that
indicates that these materials are released.
    17
         Q. Will you please turn to what I think is page 116 of this
    18 report?
              A. Yes.
    19
         Q. In the left hand column there is a reference to another
20 report by somebody called Potts and Lederer?
              A. Potts and Lederer.
    21
         Q. Yes. "... evaluated the toxicity of many synthetic and
22 natural materials". Have you got that?
              A. Yes.
    23
         Q. "... including polystyrenes and Douglas fir.". Then it
24 describes three samples which were tested and it gives
some figures. Then it says: "The data presented by Potts
25 and Lederer demonstrate that these polystyrenes were less
toxic than wood (Douglas fir) in the non-flaming mode in
26 this test. Under flaming conditions, the toxicities of
polystyrene samples and the wood were comparable."
    27
Do you think that it might have helped an understanding of
28 the significance of what you were saying in your statement
if you had added these two things?
29 A. I do not think that it would have added. I think that
those sorts of materials, those sorts items, are certainly
30 likely to come up, as they have here, and I think they
have added in that sense. My statement concerns the
