Day 068 - 16 Dec 94 - Page 59

therefore, they could not export it.

MR. MORRIS: No. We are not talking about patties, are we? We
       are talking about raw materials.

MR. RAMPTON: My Lord, perhaps I can help? I believe that the
assertion is, the suggestion is, that Latchley Meats in
Australia export meat for the use of McDonald's in the
       United States.

MR. JUSTICE BELL: I thought that is what I said.

MR. RAMPTON: I do not think the witness picked it up.
       A. No, that is incorrect.

MR. JUSTICE BELL: You said that is not incorrect. I was just
making sure that you understood. It is just as well you
       underlined it as well.

MR. MORRIS: So, on the face of it, that is what it says there.
Did you contact them when you received this form to
       clarify?

MR. JUSTICE BELL: You assert that.

MR. MORRIS: I am asserting that.

MR. JUSTICE BELL: I am certainly not going along with that at
the moment. I withdraw the inference that it means that
they export meat to Japan, USA -- beef to Japan, USA and
Taiwan. I would not assume that it means they export it
for McDonald's use in those countries -- maybe you are
right, maybe you are wrong -- but I would not read that off
       the face of the questionnaire.

MR. MORRIS: So did you contact them to try to clarify the
       situation after receiving this form?
       A. No, I did not because I know the situation.

  Q. The fact is that they actually export to quite a few, you
said ten or more countries, you said that?
       A. Are you referring now Australia?

  Q. Yes. Latchley Meats to export to -----
       A. They have the potential to export and they do,
Australia as the Australia meat -----

  Q. If they have specified on this form Japan and the USA ----

MR. RAMPTON: My Lord, once again I think Mr. Morris is going
too fast because he does not listen to the answer. The
answer was that Australia has that capacity. The question
should be confined to Latchley Meats and then the witness
can have a chance to answer.

MR. JUSTICE BELL: You went straight on. You did not give him
an opportunity to agree or disagree. That is all that is
being said. Do you know whether Australia exports to more
than nine or 10 countries, he said?
       A. Yes, I do.
