Day 119 - 02 May 95 - Page 32

preparation because I will get extremely angry the next
       time he brings it up.

MR. JUSTICE BELL: I think the point is if it is somewhere, for
the future, where we have actually page numbers on the
page, it is just easier to turn it up.

  THE WITNESS: Tab?

MR. RAMPTON: Tab 42, my Lord, of pink volume XII. It is the
Orpington time sheet for week ending 1st November 1987.

MR. JUSTICE BELL: If you do not have a page number, give us a
       date, Mr. Morris?

MR. MORRIS: Sorry, for this time record?

MR. JUSTICE BELL: It is the one sheet there, yes.

MR. MORRIS: It is the one sheet for 1st November 1987 -- sorry,
it is the second one, it is the under 18s one.
       A. Sorry?

MR. RAMPTON: My Lord, the only sheet in tab 42 is the under 18
       one.

MR. MORRIS: Because we were not aware that the Plaintiffs had
weeded out a lot of our documents before they -----

MR. JUSTICE BELL: As long as it is under 18s, week ending
       1st November 1987.

MR. MORRIS: That is the one.

MR. JUSTICE BELL: It is the same sheet.

MR. MORRIS: It is one that is headed "Under 18s"?
       A. Yes.

  Q. Just for the record, E. Southwood is the first name?
       A. That is right.

  Q. M. Harrison is the second name?
       A. Yes, the bottom name is Mary something or other, and it
shows there that she worked "4 to close" on three
consecutive days. "Close", I would take, is 11 o'clock in
which case they were in breach of the regulations and it
       should not have happened.

  Q. So this Manager would have been disciplined, would he, at
       that time, or she?
       A. Oh, I do not know. I do not know anything about this
so I would be hazarding a guess. I would be surprised if
he not had it brought to his attention.

  Q. So the law being broken on this scale. This is just a time
record completely at random that we have managed to get
hold of, and there are five breaches of the law on one
piece of paper. There is actually no reason to think that
was not happening on a quite regularly basis at this store.
