     1        practise of using foam packaging a paper base alternative
              would not be 'Fully recyclable'.  The authority also found
     2        that it was misleading for McDonald's to refer to the
              'recycleability' of their packaging if they themselves
     3        were not engaged in recycling the material, and (d)
              McDonald's admitted that they had only a small and
     4        temporary recycling scheme at four Nottingham stores".  Is
              it accepted that is part of your admission?
     5        A.  If it is an admission I accept it.
 
     6   Q.   Are you aware that on your packaging you still say on some
              of it that it is recyclable?
     7        A.  Yes.
 
     8   Q.   Does it not concern you that the advice you were given by
              the Advertising Standards Authority about not using the
     9        word "recyclable", unless you are doing it yourself, is
              something that you have not heeded?
    10        A.  I am sure if the symbol is continuing to be used there
              is a justifiable reason for doing so.  We are entitled to
    11        use that symbol.  I suggest again you ask the people who
              are directly related to the project as to their answer.  I
    12        do not know what the answer is; just as I do not remember
              the ad.

         Q.   But the Advertising Standards Authority ruled ----
    14        A.  They were apparently ruling on an ad.
 
    15   Q.  - that it was deceptive to use the word "recyclable" when
              you yourself were not engaged in recycling that material
    16        and yet you are still using that word.  Does it not bother
              you?
    17        A.  No.
 
    18   Q.   Do you accept that on the streets of this country there is
              a great deal of environment/index.html">litter which has originated in McDonald's
    19        stores?
              A.  Sorry, would you say that again.

         Q.   Do you accept that on the streets of this country there is
    21        a great deal of environment/index.html">litter which is packaging that has
              originated in McDonald's stores?
    22        A.  I accept that environment/index.html">litter is a social problem caused by
              people.  McDonald's is certainly a source of packaging, as
    23        is the local newsagent or the tobacconist or the grocery
              store.  It is really rather an unfortunate thing we have a
    24        small minority of the population who choose to dispose of
              their waste in an unthinking, uncaring way.  That is all
    25        I accept.
  
    26   Q.   Just bear with me.  I am looking for a particular 
              document.  Are you a member of the Tidy Britain Group? 
    27        A.  Me personally or my company?
 
    28   Q.   Your company.
              A.  We are involved and have been for years with the Tidy
    29        Britain Group, yes.
 
    30   Q.   Are you aware that the Tidy Britain Group produced a
              document called "Litter and the Law"?
