Day 038 - 19 Oct 94 - Page 33
to arrangements which relate to the care of children, but
what I would like you to do over the adjournment we will
now have until 2 o'clock is see what the prospects are of
making that arrangement, so that we could go on for
tomorrow or part of tomorrow if necessary. I do not know
how much longer -- if you have other general matters to
raise and individual additives to go to, for all I know
Dr. Millstone will be some considerable time further in
chief. But I do not want to enquire or press you about
that.

MR. MORRIS: It is just that Dr. Millstone is booked for
Friday. It sounds like at least he is definitely going to
be a maximum of two days.

MR. JUSTICE BELL: What I want to avoid, if at all possible, is
any possibility of not finishing Dr. Millstone this week.
If there is a gap either tomorrow or Friday, is there any
possibility of having another witness in? Is there any
possibility of Miss Brophy, for instance, coming then?

MR. MORRIS: We could not get hold of her.

MS. STEEL: The thing is, if there is a possibility of it going
over, then that means that Dr. Millstone cannot act on the
assumption that he is going to be away early tomorrow -- he
cannot assume he is going to get away early tomorrow, as
Mr. Rampton is suggesting.

MR. JUSTICE BELL: I do not think he should assume that. All
I am asking him to do is do his very best to make
arrangements for tomorrow so that he can come.

MR. MORRIS: I think it might be fair to say to Dr. Millstone
that if he is on tomorrow I think it is extremely unlikely
he will be needed on Friday, which may help him.

MR. JUSTICE BELL: I have only mentioned it now because it
seemed better to raise it now for the first time rather
than at quarter past 4.

(Short Adjournment)
2.00 p.m..

MR. JUSTICE BELL: How did you get on?

THE WITNESS: The position is that I think it is quite likely
that I will be able to come tomorrow, but I will have to
make another call to confirm -----

MR. JUSTICE BELL: We will have another break in the middle of
the afternoon anyway. Yes?

MR. MORRIS: Just a few more brief questions on generalities,
not necessarily in a sensible order. If a compound was
acting as a tumour promoter and not able by itself to cause
cancer, would that be of relevance in its safety
implications?
A. I would think it ought to be. I deemed that to be of
importance.
