Day 005 - 04 Jul 94 - Page 32

     1
         MR. MORRIS: Five minutes.
     2
MR. JUSTICE BELL: I will come back at 25 past 12.
     3
                             (Short Adjournment)
     4
MR. MORRIS: Yellow, volume 3. Witness statements recycling
     5 and waste.

6 MR. JUSTICE BELL: Whether it be done at lunch time or at close
of play, it seems to me if we can devise a system whereby
7 the whole lot is up there, if the witnesses do not mind
being their own ushers, just getting the bundles off and
8 putting them back, it might be more efficient. (Handed).
              A. Yellow 3.
     9
         MR. MORRIS: Tab 3.
    10 A. Tab 3.

    11 Q. Yes.

12 MR. JUSTICE BELL: Mr. Kouchoukos' first statement.

13 MR. MORRIS: Yes. On page 37 it talks about the use of CFCs?
              A. 37, yes.
    14
         Q. Just bear with me one minute while I check something. Is
15 it true that it says two-thirds down the page:
              "McDonald's Packaging: About one-fourth of McDonald's
16 foam uses Formacel-S as a blowing agent"?
              A. Yes, it says that.
    17
         Q. This is in August 25th, 1989 at the top of the page?
    18 A. August 25th, 1989, yes.

19 Q. I believe, unless I am contradicted by anybody in the
court, that Formacel-S is CFC blowing agent, which is what
20 this whole page is about.

21 MR. RAMPTON: That is not correct. It is HCFC-22, if one looks
at the front page of that document.
    22
         MR. MORRIS: Yes.
    23
MR. RAMPTON: HCFC-22; it is a trade language.
    24
MR. MORRIS: Yes, HCFCs are part of the CFC family. Is that
25 not the case? HCFCs are part of the CFC family of blowing
              agents?
    26 A. I am not a technician. I guess they are, but I really
              I do not know.
    27
MR. JUSTICE BELL: Mr. Morris, you are perfectly entitled to
28 ask Mr. Preston questions like this, and if you want to
get in, as it were, some of the matters in your
29 cross-examination early in the case by asking Mr. Preston,
then so be it. I am not going to stop you. But
30 obviously, as the case develops, we are going to have
witnesses on specific areas. Mr. Preston, I anticipate,
