Day 147 - 04 Jul 95 - Page 37

remainder of the day. I will rise until quarter to four,
so that you have time to collect your thoughts, and then we
will go on for about half an hour this evening. It is
entirely up to you whether you begin by answering
Mr. Rampton's other matters or go straight to your own
applications and then come to Mr. Rampton's matters later.

                      (Short Adjournment)

MR. MORRIS: Just regarding number 1 on the Plaintiffs' list,
Employment witnesses, the Plaintiffs list that they gave of
witnesses is mostly accurate. On the second page of their
list, they have listed five Civil Evidence Act Notice
witnesses, and of course all our Civil Evidence Act Notice
witnesses are already Civil Evidence Act Notices and,
hence, are already evidence in the case, as far as we are
concerned. We do not have to confirm of those, because
they were already served and accepted. I just do not
understand why they put five down. Maybe it is because
they are ones I happened to mention or something, but they
are all evidence in the case.

MR. JUSTICE BELL: I think the point is that Mr. Rampton was not
querying that. What he was saying is that he was inviting
you -- and it would be helpful for you to do so -- to
confirm whether Sarah Ingliss is actually going to come and
give evidence here and to say whether the French witnesses
were also going to come, because that might affect who he
actually called into the witness box himself.

MR. MORRIS: I do not know if you have got his handwritten list
       of the Employment -----

MR. JUSTICE BELL: Yes, I have.

MR. MORRIS: Our general intention, of course, is that we are
relying on all our Civil Evidence Act Notice witnesses.
Secondly, we would call them all, if we could; and we would
certainly call the ones abroad in order of priority,
depending on our funds; and, certainly, Sarah Ingliss and
the French witnesses would come near the top of our list of
       priority.

MR. JUSTICE BELL: All you are being asked to do, and it would
be helpful if you would do it -- I appreciate there may be
maybe financial ramifications -- is not to indicate, just
to say: "We would call them if we managed to raise their
fares", but, taking that into account, by all means, say
whether you actually are going to get Miss Ingliss,
Miss Villeneuve and M. Lamti to come.

MR. MORRIS: Yes. I would say yes. We intend to call Sarah
Ingliss, Hassan Lamti and Chantel Villeneuve.

MR. JUSTICE BELL: Have you sent them their fares yet, for
instance, and arranged when they are going to come?

MR. MORRIS: No. We are waiting to see when our section is
going to start, which it looks like now is likely to be,
effectively, in October. So we can start preparing the
