Day 149 - 06 Jul 95 - Page 40

out areas have a particular relevance in themselves,
whatever the text says, because they are relevant to what
was being discussed at the Health and Safety meetings.
That would apply to any document which has been partially
blanked out. If they should be allowed to blank out a
document, the sub-headings should be left in.

MS. STEEL: On the blanking out of the minutes and the other
matters, there are some aspects of customer safety that do
have implications for the crew as well. Obviously, our
argument still stands that as the document is about the
Health and Safety Task Force, then in its entirety it is
relevant but, in any event -- for example, there was some
discussion about the tiling in the customer areas.
Obviously, employees have to walk over that as well.

The other thing is that there is being a big fuss made
about customers being irrelevant. I know when this has
been brought up before, if someone has tried to ask a
question about customers or something, we have been
stopped, so it does not actually make any difference
whatsoever if parts about customers are in there.

We are aware that we cannot ask specific questions about
specific customer accidents and things like that where
there is no bearing on the safety of crew.

MR. MORRIS: We are going to go through these one by one and it
is easier if we deal with them at the same time.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: The next one was the trial bundles witness
statements, the mistakes or different versions of witness
statements being available in different bundles or at
different times. My understanding was that it applied to
the bundles that you had as well, and that you were not
sure if the witness statements that you had and had read
were the same as the ones which the Plaintiffs were now
working on. So it would be helpful if they were properly
       checked.

MS. STEEL: On the matter of the bundles, as far as I know,
there are far more than 18 witnesses still left to come.

  MR. RAMPTON: Plaintiffs' witnesses.

MS. STEEL: There are all the publication witnesses apart from
anything else and the rainforest ones.

MR. RAMPTON: My Lord, I can tell you who they are. Apart from
the employment witnesses, rainforest is Mr. Cesca,
Mr. Contana and Mr. Monroa. Paper, there is Mr. Bateman.
Publication, there are six witnesses. I make that,
       excluding the employment witnesses, ten.

MS. STEEL: There are more than six witnesses on publication.
       There are the four spies, or private investigators, sorry;
there is Mr. Nicholson; there is Mr. Caroll; there is
       Miss Bensilum.
