Day 311 - 06 Dec 96 - Page 17

MR. RAMPTON: I do not know whether it is in a different
format. That I do not know. What I do know it is a
distinction of substance, because the one that he was shown
in the witness box was the amended Veggies leaflet.

MR. JUSTICE BELL: Yes. But my impression was that he was
saying, particularly when he looked at the back, which has
the Veggies Veggies striking page, that he had never seen a
leaflet like that before, never seen that leaflet before.

MR. RAMPTON: That may very well be true, because I have no
       idea.

MR. JUSTICE BELL: It is because I have got to decide about
       that, that -----

MR. RAMPTON: What I do not know is what format the original
       Veggies leaflet was in.

MR. JUSTICE BELL: It was always in that -- unless I disbelieve
Mr. Smith, and on that point it seems I have no reason to
-- it was always eight page with the Veggies Veggies back
       page and the additional page.

MR. RAMPTON: What I do not remember -- and, again, it is my
fault for not remembering -- is whether the evidence was
that it was folded in a completely different way from the
       London Greenpeace leaflet. (Pause)

My Lord, I can tell your Lordship this: there is a pink
file called "words complained of" ---

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: -- and in that file are collected the documents
which Barlow's had issued by people against whom the
complaints about McDonald's have been made. Number 6 in
that file is a Veggies leaflet. I do not say it is the
Veggies leaflet. It looks like that. It is a single
       sheet.

MS. STEEL: That is not the fact sheet. That is a leaflet that
they put out about the case.

MR. RAMPTON: Ms. Steel has had her chance to give evidence.

MS. STEEL: All right, then. I will not try and be helpful
       then.

MR. RAMPTON: What I do not believe there is in this file -- and
it may be an oversight, I do not know; it may, however,
lead to a negative inference -- what there is not in this
file is a copy of what Ms. Steel would have us believe is
       the Veggies fact sheet.

MR. JUSTICE BELL: I had better look at that, I think.

MR. RAMPTON: Your Lordship had better look at it, I agree.
Beyond that, I am afraid I am not able to help. In any
       event -----
