Day 285 - 23 Oct 96 - Page 40

MS. STEEL: The undertaking was to censor ourselves in a way
that McDonald's have not yet succeeded in doing.

MR. RAMPTON: We've said before that we are not going to be
blackmailed. If that undertaking had been given then the
difficulties to which Miss Steel has just alluded would
not arise because they and their legal advisers would have
the transcripts.

MR JUSTICE BELL: I do not actually think there is any
difficulty anyway, because, as you said yesterday, the way
you would put the law is set out in your submissions.

MR. RAMPTON: Yes, it is.

MR. JUSTICE BELL: I think, when you get to them, there may
well be various questions I want to ask you in elaboration
of that, and we touched on some of those yesterday. But
essentially, I think you should be able to get advice, if
you want it, on the matters of law by giving whoever you
seek the advice from a copy of the legal -----

MR. RAMPTON: My Lord, I also said yesterday in response to an
inquiry from your Lordship, if there were any legal
discussions of that kind the relevant pages of the
transcripts would be supplied in any event.

MS. STEEL: We have not received any.

MR JUSTICE BELL: No, I think you have to ask for them.

MS. STEEL: We do not know what pages they are on, so we
cannot.

MR. JUSTICE BELL: If you say what the topics are, surely
Barlow Lyde and Gilbert will be able to find them.
Mr. Rampton has just said if you ask for particular pages
where matters of law have been referred to either by you,
by me or Mr. Rampton, he said he will supply those. So if
your concern in getting transcripts is that when you seek
legal advice you can give a word perfect account of what
has passed in court to whoever you seek it from, I suggest
you write a note to Mrs. Brinley-Codd or Mr. Hill or ask
them at close of play each day, can we have the pages
which covered what was said about the law on those
topics. Mr. Rampton has said you will then get them.
Anyway, we will resume at 10.30 in the morning.
