Day 112 - 31 Mar 95 - Page 20

page 12. The next one is -----

MR. JUSTICE BELL: I am aware of that, but what I am asking is
whether we have the equivalents of -----

MR. RAMPTON: Is your Lordship asking for a predecessor of, for
       example, pages 102 and 103?

MR. JUSTICE BELL: Yes, the equivalent of page 12, for instance.

  MR. RAMPTON: For that date?

  MR. JUSTICE BELL: Yes.

  MR. RAMPTON: No, my Lord.

MR. JUSTICE BELL: And the equivalent of page 16 for that date?

MR. RAMPTON: No, we do not have anything for those dates, my
       Lord.

MR. JUSTICE BELL: Do you know why that is?

  MR. RAMPTON:  No, I have no idea.  I have got what I have got;
I can see whether we -----

MR. JUSTICE BELL: I would like you to; I would also like to see
       the originals of these documents.

  MR. RAMPTON: Certainly.

MR. JUSTICE BELL: I think they should be brought to court.

MR. RAMPTON: In so far as it is within our power to do so.

MR. JUSTICE BELL: Regardless of any point Ms. Steel has taken
about admissibility (upon which I will hear you in due
course), I have what at the moment appears to be an
absolute direct conflict between a witness who has taken
       the oath and these documents.

MR. RAMPTON: Yes, I agree. (To the witness): Leaving that
topic then for the moment or perhaps for good and all,
Ms. Hovi, please, would you look at the second bullet point
or black blob under 7 on the second page of your
statement? Again this is asserted as a breach of the
regulations. You say: "No hygiene checks or quality
control measures were carried out at the premises". You
know that to be wrong now, do you not?
       A. Yes, I do, if these documents are right.

  Q. No, no -- you mean if the Bristol Laboratory documents are
       right?
       A. Yes.

  Q. Also temperature checks are a kind of quality control
       measure, are they not?
       A. Yes, there are no regulations about these quality
control measures. They are not breaches of regulations.
