Day 195 - 04 Dec 95 - Page 57
Q. "At some times of the year, this would occur as regularly
as two or three times a week."
A. Yes.

Q. Is that true?
A. Yes.

Q. "Late finishes like this also occurred wherever there was
going to be a visit from the Head Office or Area
Supervisor. Somebody from Head Office often came once
every two weeks and the Area Supervisor might appear as
often as three or four times a week."
A. Yes.

Q. So are you saying there that these very late closes, 3.00
or 4.00 in the morning, sometimes even 6.00 or 7.00,
occurred as often as once every two weeks or more often?
A. No, at certain times of the year they would occur at,
yes, those frequencies, certain times of the year.

Q. Then, finally, can we have a look at page 11 where there is
a bit more about your hours?

MR. JUSTICE BELL: Just pause a moment. Where did you get the
"sometimes 6.00 or 7.00", Mr. Rampton?

MR. RAMPTON: My Lord, I got it by inference from page
4: "Regularly, I would not finish until 3.00 or 4 a.m. or
even 6.00 or 7 a.m." The evidence of the witness was that
those all night closes took place in advance of visits from
the Area Supervisor or from Head Office.

MR. MORRIS: That is not the evidence.

MR. JUSTICE BELL: I have misunderstood it then. Not from the
Area Supervisor?

THE WITNESS: No. All night closes usually took place, yes, not
for Area Supervisors.

MR. RAMPTON: This is page 6: "Somebody from Head Office often
came once every two weeks". I take you to be suggesting
that, therefore, there were all night closes once every two
weeks?
A. Well, it might happen in a month, you know, that you
get two visits.

MR. JUSTICE BELL: I am sorry.

MS. STEEL: I did bring this up in-chief. There is a difference
between the late night closes and the all night -----

MR. JUSTICE BELL: I think we are completely at odds because I
had not interpreted the top of the page as saying that.
I had interpreted it as saying that the 3.00 to 4 a.m.
finishes at some times through the year would occur as
regularly as two or three times a week.

MR. RAMPTON: That, I understand, my Lord, of course. I have
gone on to the Head Office visits which, I take the
