     1        tomorrow.  He could come if I ordered him to come but I do
     2        not see the need to do that.  I received this morning a
     3        copy of the letter which I think was delivered to both of
     4        you yesterday which had enclosed with it agency reports of
     5        a number of occasions as a result of the ruling which I
     6        gave on Monday.

     8   MS. STEEL:  Yes.

    10   MR. JUSTICE BELL:  If either party wants those to go in the
    11        bundles they will go in the bundles, but things do not need
    12        to go into the bundles just because they have been
    13        disclosed and I will not put mine in the bundles until one
    14        party or other says: "We want them in the bundles."   So
    15        that is the first thing you have got to think about.  If
    16        they do go in the bundles I need to know where they should
    17        go.  I suggest each one goes after the notes I already have
    18        on a particular date with A, B, C or whatever after the
    19        last number in the bundle so far.

    21   MR. RAMPTON:  We have not had a chance to do that yet.

    23   MR. JUSTICE BELL:  No.  It needs some thought to be devoted to
    24        that.

    26   MR. RAMPTON:  We will put them in chronologically and we will
    27        put them in after the existing notes for the particular
    28        occasions.

    30   MR. JUSTICE BELL:  Right.  The next thing then is if either Miss
    31        Steel or Mr. Morris -- and I stress if because I am not
    32        encouraging it --  but if you feel that you require either
    33        Mr. Pocklington or Mr. Bishop -- I do not think it applies
    34        to Mr. Russell -- to return for any further questions in
    35        the light of the additional reports which have been
    36        disclosed, we have got to think about when they should come
    37        back, and the question arises is whether either one or both
    38        of them can come back tomorrow, if we are likely to have
    39        time after Miss Brophy has given her evidence.  If we can
    40        have a joint time estimate of how long Miss Brophy is
    41        likely to last, that would help.

    43   MS. STEEL:  Can I just say one thing on that?  I finally managed
    44        to get hold of Miss Brophy last night.  I was going to ask
    45        if Mr. Claire is not available we could start an hour later
    46        as she has to come down from Chester after getting her
    47        children up, and we have never met her.

    49   MR. JUSTICE BELL:  Right.  Well, the next thing applies also
    50        -- and I am really just going through these matters so you 
    51        can give a bit of thought and then we might talk about them 
    52        again at two o'clock or something of that kind -- is if we 
    53        are going have time to spare tomorrow, whether there is any
    54        of your reading we can usefully do.

    56   MR. MORRIS:  I have done a list.  I have not written it out but
    57        I have done a list of outstanding papers.
