is for me to say when they should, unless you can tell me
2 that it particularly inconveniences you or is unfair to
you in some particular way.

MR. MORRIS: Are they available in the first week?

MR. RAMPTON: No. The position is this, Dr. Arnott is, we
5 know, available on 12th and 13th September. We believe
that it is far more sensible to complete the nutritional
6 issue, then we can then put in Mr. Preston and/or
Mr. Beavers, if they should be available, at the end of
7 that discrete issue before we go on to the next one which
I think is additives.

MR. JUSTICE BELL: From my own point of view, I would rather
9 come back to the nutrition matters because I can do some
revision in the few days before we start again and then
10 pick up where, as it were, we have left off. It seems to
me that Mr. Beavers and Mr. Preston who have given
11 evidence on a multiplicity of topics can come back after
that.

But if there is some reason in which you say you are
13 inconvenienced if that happens, let me know -- that it is
unfair on you in some respect, puts you at a disadvantage,
14 let me know.
15 MS. STEEL: It was just, I mean, we did ask for this a couple
of weeks ago, we would like them to be got of the way,
16 particularly Mr. Preston. He is in this country, so it
should not be any great difficulty.

MR. JUSTICE BELL: Yes, but what is the disadvantage to you if
18 they come after the nutrition experts? We will have had
something like a seven or eight week break between them
19 last giving evidence anyway, even by 12th September.
20 MS. STEEL: We are just aware that we still have to finish off,
you know, all the cross-examination and everything like
21 that, and it would just be nice to get it out of the way;
that is all.

MR. JUSTICE BELL: There has been such a long gap, I think they
23 should come back when it is most convenient to them and
Mr. Rampton in the conduct of his case. I think I would
24 rather if we finish nutrition, if we can get them in then
before we start another topic, then I think there would be
25 some advantage in that.
26 MR. RAMPTON: That is my plan at the moment.
27 MR. JUSTICE BELL: Now we have embarked on nutrition, I would
like to get on with that. Do you know what your position
28 is, so far as your witnesses are concerned? I wrote some
pencilled notes on your list of witness which I wanted to
29 raise with you.
30 MS. STEEL: We have said that we wanted to call both Steve
Gardner and Mr. Barnard, so we are still intending to call
