MR. MORRIS: But if they were taken from inside they would
       concern you?
       A. If it was the actual temperature in there, but the
thing with the, what is it, the counter refrigerator, which
is where the salads have been kept before they are served,
that product is going to be served within a couple of
hours, so that is not of a great concern. It would be
great if we could maintain the temperature down at four,
but it would fluctuate as the door opens and closes. It is
the Main Chiller and Freezer which are the priorities for
       us.

  Q. That depends on whether the temperature has been taken
inside or on the dial outside?
       A. The thing is the dial outside is not -- is very
sensitive to opening and closing of the door. It is the
product temperature rather than the air temperature, and
that measures the air temperature. It is one of the
reasons why we take the temperatures of the product is that
we get a better indication. So, to answer your question,
these figures do not cause me undue concern because they
are very close and they are in -- I believe they are from
       the outside of the door.

  Q. But if you have standards, recommended temperature,
presumably, that applies to what it reads on the dial, does
       it not?
       A. No. Temperature of the product. They are guides for
       it. It will -----

  Q. Are you telling me that you measure the temperature of
       frozen products?
       A. I am.

  Q. That is what the average staff will be doing to ensure that
the freezers and chillers are working every day? They will
       be testing the products?
       A. Put it between two, between two bags of Nuggets to
check the temperature -- to a box of Chicken McNuggets, you
put a temperature probe between two bags of Nuggets will
give you a temperature of the product. You do the same
between two bags of lettuce on chilled product, and when
the product arrives in the restaurant that is our check on
the product that comes off the back of the truck. The
guide to the chillers and freezers are useful so you have a
catastrophic break-down, you see it ------

MR. JUSTICE BELL: Where you might see troubles coming?
       A. You will see trouble that it is way up, but throughout
the day it will fluctuate up and down as the door opens and
closes, similar to your fridge at home. If you keep it
closed, it will maintain its temperature, but if you open
and close it, then it will be fighting to get back down
again. So, the temperature between two bags of Nuggets
will not change with opening and closing the main freezer
door, but the dial will change. So, to answer the question
again, these would not particularly concern me.

MR. MORRIS: It maybe a good opportunity to finish there.
