Day 036 - 13 Oct 94 - Page 58
which, as you have noted, cancer is one of them. They do
not say "may be" or "could be" or whatever; they seem to
quite accept that, in fact, dietary factors are important
in the causation of cancer, yes.

MS. STEEL: OK. Thank you.

MR. MORRIS: No further questions.

MR. JUSTICE BELL: Thank you, Dr. Barnard. You are released
from further attendance. Thank you very much.

(The witness withdrew)

MR. JUSTICE BELL: Yes.

MR. MORRIS: Just in terms of what is happening next from our
side: First of all, there was a strong possibility that
Dr. Barnard would continue until tomorrow. Jane Brophey
lives outside London and she has a young child. We said
to her that it would be risky to come tomorrow and she may
not have been completed tomorrow. So, we asked her not to
come tomorrow and we will arrange a new time for her.

Secondly, I did contact Mr. Peter Cox but he was not there
and I left a message for him. He is actually in the
middle of moving house. I said that he may be needed
tomorrow instead of, as he would have been, I believe it
was, today and yesterday. So, I actually do not know
definitely whether he has got the message.

MR. JUSTICE BELL: Was there any possibility of you getting in
touch with him this evening?

MR. MORRIS: Yes, the trouble is because he has moved house he
can only be contacted through a message answering service
, so it is a bit complicated. But we will certainly
contact him and, as for Dr. David Ride, we would like to
ask -- we have asked him and he is happy to defer to
Dr. Neil Barnard.

MR. JUSTICE BELL: Is there someone you can be confident of
calling tomorrow?

MR. MORRIS: On the Dr. David Ride subject -----

MR. RAMPTON: I think the suggestion is he is being dropped.

MR. MORRIS: We want to drop him, but in terms of, as far as we
are concerned, his evidence is covered by Dr. Barnard, so
it could be superfluous.

MR. JUSTICE BELL: Right. You do not wish to call him?

MR. MORRIS: No. Can we take it then that he is officially
dropped?

MR. JUSTICE BELL: Yes. The question is what we do now.
Obviously, if you could call Mr. Cox tomorrow that would
be better but ......
