MS. STEEL: We have a couple of things we wanted to bring up
5 legal.
6 MR. JUSTICE BELL: Just pause there for a moment. Dr. Arnott
will come back sometime in-----

MR. RAMPTON: My Lord, I am hopeful that he will be the first
8 event in September. I am told he can manage September
12th which would be entirely the logical thing to do.
9 I hope (though I cannot give any promises about this) that
he may be followed by Professor Walker and Professor
10 Keen. I know not at the moment in which order. So that
we can conclude plaintiffs' expert evidence on this issue
11 and then go directly on to their factual evidence on this
issue to be followed by the defendants' evidence.

Having said which, it would help me a very great deal if
13 I knew at any rate, roughly speaking, which of the
defendants' witnesses on this issue is going to come to
14 England to give evidence and, if so, in, roughly speaking,
what sort of order so that I can spend the so-called
15 holiday preparing my cross-examination.
16 MR. JUSTICE BELL: Yes. Unless you require Dr. Arnott to stay
-- we have to discover other matters, Dr. Arnott -- there
17 is no reason why he should stay in court, is there?
18 MR. RAMPTON: No. It means you can go if you want to.
19 MR. JUSTICE BELL: Thank you, Dr. Arnott.
20 MR. MORRIS: We were under the understanding that the best
course of events was to ask Mr. Preston and Mr. Beavers to
21 come back and finish their evidence as soon as possible in
September because, otherwise, if, as Mr. Rampton suggests,
22 the entire nutrition case is heard, it is likely to take,
I do not know, two weeks or something.

MR. JUSTICE BELL: Keep your voice up. What is likely to take
24 two weeks?
25 MR. MORRIS: The complete nutrition case.
26 MR. JUSTICE BELL: Yes. There is no reason why we should not
go on with that, is there?

MR. MORRIS: No, but we would prefer that Mr. Preston and
28 Mr. Beavers were heard first, because they really should
have been dealt with in the first week. You remember,
29 that did not happen. We would like to get them out of way
otherwise what will happen is that as before -----
