Day 094 - 01 Mar 95 - Page 21
no-one is doing that. I might think that is pretty over
the top, but look at the second one.

MS. STEEL: Sorry, I think it is an example rather than it is
meant to be exactly what has happening.

MR. JUSTICE BELL: Yes, I know but it might be thought that it
is a rather extravagant metaphor. (To the witness): Look
at the second one, about being told to save the breast meat
off them. What is being put to you is that there is an
allegation that someone which the publication purports to
name, give the age of and the job of, reporting it to,
presumably, a reporter interviewing inspectors, a practice
which, if it existed, I assume you would not approve of?
A. That is correct.

Q. Taking the point that it is not in a plant which supplies
you or, if it is in the same plant, it is not on a line
which supplies you, you are being asked whether the report
would make you sufficiently anxious to think: Well, if
that is happening in a Tyson's plant somewhere, might it be
happening on a line which concerns us, we had better look
into it. What do you say to that?
A. That is correct. Under that context I would be
concerned, yes.

MS. STEEL: Did you read this article at the time it was
printed?
A. No, I did not.

Q. In the right-hand column of that page?
A. I have only half.

Q. You have only one page?
A. I have the one page but the copy is cut off.

Q. There should be a second page behind that?
A. Yes.

Q. In the right-hand column it says: "Industry executives and
US DA officials point out that today less than one half of
one per cent" -----
A. Excuse me, can you direct me?

Q. It starts on the last line of the second to last column
actually: "Industry executives and US DA officials point
out that today less than one half of one per cent of the
chickens are condemned from detectable disease, down from
10 per cent several decades ago".
A. Excuse me -- could you give me a second to find it?.

Q. Right at the top of the end column.

MR. RAMPTON: The thing was done in such a clumsy way. I will
pass mine up. I have sellotaped mine together.

MR. JUSTICE BELL: Is it the extreme right-hand column?

MR. RAMPTON: Yes, it is the second page but it is, in fact, in
one page
