     1        though it were a fact to Mrs. Barnes that Sarah Stibbards

     4   MS. STEEL:  I believe that to be the case.

     6   MR. RAMPTON:  Then it should have been asked as a question.

     8   MR. JUSTICE BELL:  I do not think we need get too uptight about
     9        it because it is all coming out in the wash.  It may be
    10        thought that there are two distinctions between what the
    11        documentation may reveal and what was put to Mrs. Barnes.
    12        First of all, whether there was any question of suing and,
    13        secondly, that it was put that it was in the first half of
    14        1990 but one, which would be when Mrs. Barnes was already
    15        Health and Safety Manager, when the documentation appears
    16        to relate to the middle of 1988.  What were you then,
    17        I have forgotten?
    18        A.  I was Quality Assurance Supervisor.

    20   MR. JUSTICE BELL:  But there we are.

    22   MS. STEEL:  I mean, I accept that the date I had was wrong.

    24   MR. JUSTICE BELL:  Just leave it there.

    26   MS. STEEL:  It was the fact I was accused of making up
    27        employees.

    29   MR. JUSTICE BELL:  Whatever happened, if it was the middle of
    30        1988, it does not look as if Mrs. Barnes could be
    31        expected to know about it.

    33   MS. STEEL:  When you make presentations to various
    34        courses -- which courses do you lecture on?
    35        A.  I do not lecture on any at the moment.  I lectured on
    36        the Advanced Operations course until about 18 months ago.

    38   Q.   When you lectured on that course, did you give advice or
    39        give instructions on how long accident books were to be
    40        kept for?
    41        A.  No.  The content of the course was (because it was to
    42        Restaurant Managers) more about health and safety
    43        management and systems and procedures they should have in
    44        place in their restaurant.

    46   Q.   So if Mr. Nicholson thought that you did that, then he
    47        would be wrong?
    48        A.  It is one of the things that was not included.  He was
    49        correct that I teach on courses, but on the accident book
    50        it very clearly states it should be kept three years 
    51        anyway.

    53   Q.   There is no separate instruction that comes from the
    54        Company, though?
    55        A.  If it is anywhere, it would be in the Health and Safety
    56        manual.  If it is in there, it is something that has only
    57        quite recently been introduced.
