Day 207 - 23 Jan 96 - Page 63
If this is going to be important, if it is not ------

MR. MORRIS: Could I just say, that one of the reasons for
having the documents is to give a general kind of snapshot
about the Company procedures, so I did feel it was worth
getting to grapple with this as it is an issue, and whether
------

MR. JUSTICE BELL: I think it will only be an issue if you have
a point to make on it or think you have a point to make on
it. If what you are saying is: "Well, I might have a
point if I understood what it meant", then it is fair
enough to ask the witness. But if all you are saying
is -----

MR. MORRIS: On these particular ones that have been disclosed,
I was going to make a separate point other than ------

MR. JUSTICE BELL: Carry on and make the separate point then.

MR. MORRIS: OK. (To the witness): If we just move on, 371 is
signed only by the Manager and that applies to all of
them. None of them have been verified or signed by any of
the staff, by any of the crew concerned. That is the first
point. I am sure the witness will accept that. But if we
look over to page 382, we get to Mr. Henden. You clocked
out two people there, yes -- sorry, you have adjusted the
timings, you have given them timings, of when they came in
and came out, yes?
A. Let me check ------

Q. On page 382. 382 we are on now.
A. Yes, I have the page.

Q. You are checking back?
A. Yes.

Q. Do not worry too much. I mean, the old times do not appear
on the clock cards any more, do they, because they have
been amended; is that correct?

MR. JUSTICE BELL: I cannot find the 049 one on the clock card.
It appears to me that that might be because the person
concerned did not clock in or out on that day and so they
do not appear on the clock card file, and the adjustment
audit report puts that right, but again that may be a
complete misunderstanding. Have you got a point you are
seeking to put on it?

MR. MORRIS: I was trying to understand the general procedure
with what is going on here.

MR. RAMPTON: My Lord, to some extent, Mr. Richards explained it
and I went through it in some detail with Mr. Coton,
because what it is clear is that if there is any cheating
going on, it is on the adjustment audit report where you
find it. If that is the case the Defendants make out,
really, it is up to them to get on and make it.

MR. MORRIS: I am just trying to ......
