Day 241 - 26 Apr 96 - Page 07

long time before I made any of these telephone calls, and
I think I had seen a leaflet at some early stage before
that. I certainly saw a copy on the day that I made the
telephone calls. It was among the papers I had in front of
       me when I did so.

  Q. It is accepted you said earlier when you were answering
Ms. Steel's questions something to the effect that it was
your impression that McDonald's had only formulated their
rainforest policy in response to that leaflet and other
       similar publications; is that right?
       A. That was my understanding.

  Q. I wondered how you gained that impression?
       A. It was an inference I drew, because I was being told
that there had been a policy of not using deforested land
before 1988, and yet in response to insistent questioning
from myself no, if I may use the phrase, further and better
       particulars could be supplied.

  Q. I would rather you did not. Mr. Rose then is it right that
is an inference you drew in the course of your conversation
       with Miss Bensilum?
       A. It was an inference, yes.

  Q. Thank you very much. Can I have that back? We have
preserved as many of these as we can. (Same handed)

  MS. STEEL: No questions.

MR. JUSTICE BELL: Thank you. Thank you, Mr. Rose. Leave the
folder there. There is no need for you to stay unless you
       wish to do so.

                       (The witness withdrew)

MR. MORRIS: Can we have a couple of minutes with the witness
       before we move on?

MR. JUSTICE BELL: No. You can say goodbye to him and thank
him, but I am not going to rise.

  MR. MORRIS: Right.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Can I just bring up something which we forgot to
bring up on Wednesday, which was that after Mr. Secrett
left the witness box he was looking through a pile of
papers which he had with him to do with Costa Rica and
deforestation. When he was looking at a list of names of
people who had written on it, he saw, I think it is, Mr.
Tosi's name. In the witness box he said he knew Mr. Tosi
senior. When he saw the list, he said he had made a
mistake; he actually knew Mr. Tosi junior, and he asked us
to bring it up in court that he had made an error when he
was giving his evidence on that.

  MR. JUSTICE BELL: Very well.
