Day 256 - 04 Jun 96 - Page 88

MR. JUSTICE BELL: I will not add to it. What we will do is, we
will have a preparation day or a workday in relation to the
case. At least, we will not sit tomorrow on this. We will
start with Mr. Fairgrieve at 10.30, and when he finishes I
would like you to be ready to go on with Mr. Nicholson.

  MS. STEEL: Right.

MR. JUSTICE BELL: Until you complete your cross-examination.

MR. RAMPTON: The only other thing I ought to mention, as I am
getting a bit anxious is about it, is the Defendants'
supplementary statement -- when I say the Defendants, I
mean theirs and their witnesses -- in relation to
publication which we were promised at the end of the 10
days we have just had. I am getting a bit anxious about
it, simply because my witnesses are coming next week.

MR. JUSTICE BELL: Before we start Mr. Fairgrieve on Thursday, I
would like to talk a bit about the schedule which,
essentially, starts next week for the order of publication
witnesses; then, after a break, to deal with Professor
Crawford and Miss Brophy, going on with publication
witnesses, including your own, as to just what the
situation is with regard to service of any additional
statements either from yourself or any of your publication
witnesses, the general order Mr. Rampton proposes to call
his publication witnesses apart from Mr. Nicholson, and how
you are doing in setting up your witnesses to come to give
evidence. Do you understand what I am saying?

MS. STEEL: Yes, I think so.

MR. JUSTICE BELL: What I need is some reassurance from you as
to just when you expect to serve any supplementary
statements, if you have not served them by Thursday
morning, and some reassurance that you actually have got
your production witnesses set up to give evidence in the
       time scheduled for them.

MS. STEEL: At least some of them are provisionally set up.

MR. JUSTICE BELL: I would like you to tell me about that, so
I am reassured that really from ---

MR. RAMPTON: My Lord, could I say this -----

MR. JUSTICE BELL: -- from Thursday, with the exception of Monday
week, which may be a preparation day -- that is the day, is
it not, before Professor Crawford comes back?

MR. RAMPTON: At the moment, there is not a witness for that
       day, my Lord.

MS. STEEL: Hold on. I thought we did say that Professor
Crawford was now coming on Monday?

MR. JUSTICE BELL: Yes, that is right. He is coming on the
Monday. What I really want to do is verify that when we
