     1        about having -- not having had prior notice of late night
     2        shifts, and that sort of thing.  I used to complain to any
     3        Manager who was on the shift at the time.  So, if Mark was
     4        there I would probably have complained to him.

     6   Q.   Was he on that shift sometimes?
     7        A.  Yes, he was.  Every now and then he was on late shifts.
     8
     9   Q.   He says in the bottom of 33:  "We would never know when the
    10        Area Supervisor was scheduled to visit."
    11        A.  Yes.

    13   Q.   Could you tell anything from the attitude of Mark Davis
    14        about when a Supervisor was coming down?
    15        A.  Yes, we could guess.  I mean, Mark Davis is a person,
    16        as far as I can remember, he was the type of person to get
    17        nervous about visits.  Whenever he was feeling particularly
    18        flustered or felt under pressure to keep things in order,
    19        we could guess that somebody will be coming for a visit,
    20        either Area Supervisor or someone else from the Head
    21        Office.

    23   Q.   He says in 34:  "I have no knowledge of anyone working as
    24        long as 26 hours in a row".  Do you have any comments on
    25        that?
    26        A.  Well, I cannot remember -- I do not know how he cannot
    27        have any knowledge because he must have checked the time
    28        people worked.  All I can assume is that he either does not
    29        remember or he does not tell the truth there.

    31   Q.   He says in 36 at the bottom of page about breaks not being
    32        allotted and under 18s worked beyond hours they should have
    33        done:  "I have no recollection of either of these things
    34        happening.  With regard to breaks, it is most unlikely it
    35        would be completed by 4 p.m.."   Did you claim they would
    36        be completed by 4 p.m.
    37        A.  No, I think it must be a typing mistake because I have
    38        said 6 p.m., and it is very unlikely that you start your
    39        shift at 3.45 and have your break finished by 4 o'clock.

    41   Q.   "Breaks were deliberately staggered throughout the
    42        evening".  Have you got any comment about -----

    44   MR. JUSTICE BELL:  What is the point about asking about that,
    45        because I have had his evidence that they were not
    46        deliberately staggered throughout the evening ---

    48   MR. MORRIS:  OK.  Mr. Davis not knowing about that.

    55        suggest, as I have done already, just if there is something
    56        which particularly affects Mr. Alimi which you think it is
    57        only fair to give Mr. Alimi the opportunity to deal with;
    58        there may be nothing which falls into that category, but if
    59        there is ask Mr. Alimi about it.
