Day 060 - 02 Dec 94 - Page 74

Q. This was in 1990, and you still have not done it.
A. But I told you ----

MR. JUSTICE BELL: There may be another aspect. Was the foam
packaging used by McDonald's in the middle of 1990 being
stored somewhere against the day when technology would
allow it to be recycled?
A. Was there a foam packaging?

Q. Yes.
A. No, there was not.

Q. So the foam packaging used by McDonald's in the middle of
1990 was not actually recyclable?
A. We have not said that foam packaging used by McDonald's
is recyclable. We have said ----

MR. MORRIS: "The foam packaging used by McDonald's" ----?
A. Is CFC free.

Q. - "is completely CFC free. It is recyclable".
A. And it is. It was not being recycled, but it is
recyclable.

MR. JUSTICE BELL: Where was it recyclable in June 1990?
A. It was not, but you cannot say it is not recyclable,
because it is recyclable.

MR. JUSTICE BELL: There we are. I am well aware of the
arguments on both sides. I will form my own view of it.

MR. MORRIS: I put it to you that this Fact Sheet is not, in
fact, a fact sheet because it has errors in it. In fact,
it is a propaganda document extolling the virtues of your
packaging; is that correct?
A. You put that to me several times yesterday too, and
I did not agree with you then, I do not agree with you
now. I have said that if we had had further information on
polystyrene, that statement would have been changed.
Nothing else in there would I have changed.

MR. MORRIS: May it be a suitable time to finish?

MR. JUSTICE BELL: Do you have any further questions on that
page 684 that comes to mind at the moment?

MR. MORRIS: No.

MR. JUSTICE BELL: Because if you do not, we will break off
there for today.

THE WITNESS: My Lord, can I just ask, this cross-examination
has been painfully slow. I did not think -----

MR. JUSTICE BELL: You must not say things like that because,
quite frankly, that is not your function, Mr. Oakley. Go
and sit down, please, in court and I will make some
enquiries about the immediate future.
