Day 206 - 22 Jan 96 - Page 68

MR. JUSTICE BELL: What I suggest is, first of all, put your
       point to the witness ---

  MR. MORRIS: Yes.

MR. JUSTICE BELL: -- if you can do that quite shortly and then
we will see whether it is necessary to go into the pink
bundles. Just listen to Mr. Morris for a moment, please,
       Mr. Henden.

MR. MORRIS (To the witness): Would you say there is a criticism
of people practices at the store, i.e. infringements of the
rights of crew members, delays in performance reviews and
other matters to do with personnel? Would you say there
are criticisms both from crew themselves and also from
higher level of management outside the store?
       A. From reviewing the rap sessions, you do get criticism
       of performance reviews.

  Q. Yes. I do not mean just performance reviews. I mean the
personnel matters, in general; you accept there is a lot of
       criticism about performance reviews?
       A. I accept there is criticism about performance reviews.

  Q. Do you accept that there is or there was an on-going
problem of performance reviews being done late?
       A. Some performance reviews were done late, yes.

  Q. But it was an on-going problem for a number of years?
       A. Yes, some of the performance reviews had been done
       late, yes.

  Q. For a number of years?
       A. Yes, I would say some of the performance reviews were
       behind time, yes.

  Q. I am taking that as an agreement.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: No, you should not do that.

MR. MORRIS: He said, "yes". I could put all the performance
reviews that are in this document but I think, on the basis
of that answer, I will leave that for Mike Logan to go
through. This is the point I was making before. Do I need
       to go through?

MR. JUSTICE BELL: I know. My hesitation is just that it is
difficult -- you see, I do not know what material you have
got in there which you particularly want to rely on, so it
is difficult for me to offer a comment on whether you
should put items from the papers or not.

MR. MORRIS: If I maybe put a couple as an example then?

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Can we go to those documents?
