Day 010 - 11 Jul 94 - Page 75

1 this week. What is your position, Mr. Lipsett? Do you
have a deadline for going back?
2 A. I do not have a deadline for returning. I would as
soon as you were ready to proceed.
     3
MR. JUSTICE BELL: Does it concern you if we press on for
     4 another 10 minutes?

5 MR. RAMPTON: It does not worry me in the slightest.

6 MR. MORRIS: I do not think we will be re-examining for any
              great length of time.
     7
MR. RAMPTON: I do not mind. I will go on, my Lord, until your
8 Lordship should ask me to stop.

9 Can I ask you about another paragraph in your report? It
is on the same page headed: "Issues surrounding
10 polystyrene foam packaging disposals". Do you see that?
              A. Yes.
    11
         Q. It reads: "The National Bureau of Standards Centre for
12 Fire Research identified 57 chemical bi-products released
during the combustion of polystyrene foam during
13 laboratory tests. These findings identified a number of
dangerous cancer causing chemicals that are released
14 when foam products are burned." Now that, perhaps you
would agree with me, is a fairly alarming statement, is it
    15 not?
              A. I would say that it is pretty straightforward. I do
16 not know if it is alarming.

17 Q. It would put the fear of God into all of us if we thought
we were going to be given cancer by passing an incinerator
18 with polystyrene foam being burnt on it, would it not?
              A. You are asking me?
    19
         Q. I am asking what you intended, what impression you
20 intended to create by this paragraph?
              A. The intention is to note that there are 57 chemical
21 bi-products that are identified by the National Bureau of
Standards Research, and that some of those chemicals have
22 been identified as cancer causing chemicals.

23 Q. I will come back to a question I asked you earlier,
Mr. Lipsett. Do you agree that when one is preparing a
24 report of this kind for use in a court of law and if one
has the sort of academic background you have, it is
25 important to be fair and accurate and not to misrepresent
or distort that to which you refer, is it not?
26 A. I would say that it is important to state clearly the
issues that are of concern to you and to state them as
    27 accurately as possible.

28 Q. Carbon monoxide and carbon dioxide do not cause cancer, do
              they?
29 A. I am not aware of anything that says that they do.

30 Q. You brought to court this morning a copy of the article to
which that paragraph in your report refers, did you not?
