Day 114 - 04 Apr 95 - Page 69

those figures are proved. I will hear any argument there
       is in relation to that.

MS. STEEL: Are those documents in actual fact admissible, given
that they are prepared by the Meat and Livestock Commission
       rather than by Bowes themselves?

MR. JUSTICE BELL: I have to say I do not like making rulings --
it is not meant to be an awful pun -- "on the hoof" like
this. I prefer, if there is some dispute about it, to hear
argument and then make a much more considered decision.

All we are dealing with tomorrow, all we are concerned at
the moment is cross-examination of Mr. Long and whether it
is not more convenient that since the figures are written
down on a bit of paper he actually sees that bit of paper.
Apart from anything else, he does not have to keep them in
his mind and he can look at them and think about it.

THE WITNESS: Excuse me, my Lord, you said "tomorrow" ----

MR. JUSTICE BELL: I meant Thursday.

MR. RAMPTON: Thursday, yes. My Lord, what I had anticipated
doing when Dr. Long has had a chance to look at those
transcripts, and I do not think it will take him very long
-- and that is not meant to be a pun either (I really do
not think it will take him very long) -- then I can just
say, "Have you read what he said about that? Do you not
accept that is very good animal husbandry", or whatever,
instead of going through it all in detail.

MR. JUSTICE BELL: What I think would be helpful is if you can
find time to read them. Do not sit up into the middle of
the night doing it, Dr. Long. If you do not have the time,
come back and you are perfectly free on Thursday morning to
say that you did not have time.

THE WITNESS: I will certainly do what I can, my Lord. I did
try to anticipate some of these problems by offering to go
       on site.

MR. JUSTICE BELL: Do not worry about it. If you are prepared
to do your best to get through without wearing yourself
out, then it may save time when we come back on Thursday.
Were you going to ask anything more about pages 97 and 98?

MR. RAMPTON: Not at the moment.

MR. JUSTICE BELL: I wonder if I could just mention this,
because one notices things when they are there and it is
silly not to mention it. Percussion stunning mushroom
headed guns, it is page 258 in section C?
       A. Yes.

  Q. That is something different, as I understand it?
       A. Yes.

  Q. To penetrating captive bolt stunner?
       A. Yes.
