Day 094 - 01 Mar 95 - Page 70

       A. Yes, we did.

  Q. All the stores used gas grills, up until what time?
       A. Not all the stores. We had gas grills and electric
       grills.

  Q. A mixture?
       A. In the last 20 years.

  Q. Was one of the problems with the gas grills that the
temperatures were not uniform over the grill?
       A. No, we have not been able to prove that.

  Q. You have not been able to prove it?
       A. No.

  Q. But is it not in specifications that there are different
temperatures that it is expected to reach in different
parts of the grill at that time?
       A. Yes.

  Q. So the temperature is not uniform all over the gas grill?
       A. It is -- in any piece of equipment, any cooking
equipment, you will not find the same temperature
       throughout the grill area.

MR. RAMPTON: My Lord, I do really think, if I may pick up what
your Lordship said earlier, I have some documents I would
like to deal with before your Lordship rises this evening.
I do really think if it is to be proposed to your Lordship
at the end of the case that the previous methods of
cooking, whatever they may be, constituted a significant
threat to human health, then it has to be put to this
       witness and, with respect -----

MR. JUSTICE BELL: That is what I am urging Mr. Morris to do.
I thought maybe you were getting close to it by -- please
listen to me. I will always give you time to talk to
Ms. Steel so she can say to you what she wishes, but if I
do choose to talk to you you must listen to me. I see you
might be getting close to that in saying that temperatures
might vary on the grill, but I am going to stop you now
just exploring into what the system was and what the
temperatures were, and ask you to put to the witness what
criticism you make of the cooking procedures at any time
relevant to the issues in this case. It may be that
I should have done that when you were asking Mr. Atherton,
but you must do it now.

MR. MORRIS: We did put it to Mr. Atherton. I am sure we put it
       to Mr. Atherton.

MR. JUSTICE BELL: Put it to this witness. Do not just ask
question about what did or did not happen. Put your
       criticism.

MR. MORRIS: The thing is if somebody puts their case before
they start asking questioning, you get radically different
       answers -----
