Day 067 - 15 Dec 94 - Page 35

Mr. Simmonds and Dr. Gomez Gonzalez. I am quite content
that the Defendants should see it, and make what use of it
they would wish for today's purposes. I only ask that
I get it back at the end of the day today so that I can
       make copies.

The only other thing, Dr. Gomez Gonzalez trawled his
briefcase with Mrs. Brinley-Codd's attendance. The only
relevant document that was found, apart from that one, is
an article from some kind of a journal about BSE and its
possible effects or not on humans. Whether anybody wants
it now, I do not know, but we do have copies of that.

MR. JUSTICE BELL: Is not the easiest thing if someone can make
a copy of each of those and a copy just sometime during the
afternoon could be given to Ms. Steel and Mr. Morris so
that they can look at it.

MR. RAMPTON: They can certainly have that article now. As your
Lordship will probably see, we are a bit shorthanded today.

MR. JUSTICE BELL: What I suggest, Mr. Morris. Take the
Dr. Pattison document away at the end of the day. If you
think you may need it for cross-examination tomorrow, come
back with a number of copies. If you think it can be left
for cross-examination of Dr. Pattison in due course, or
make copies in time for that.

MR. RAMPTON: My Lord, it is our only copy which is why I am a
bit concerned it should not -- we can ask somebody to go
and take copies now. Would that be the best thing?

MR. MORRIS: I think so, yes.

MR. JUSTICE BELL: I think it is probably better. If someone
could make two copies. Ms. Steel can have a copy and
Mr. Morris can have a copy. It will either come back into
the case or it will not.

THE WITNESS: May I clarify just one subject, just for the
record? The article from which copies were made relates to
       use of hormones in beef.

  Q. Yes. Leave it there for the moment; you may or may not be
       asked about it.
       A. OK.

MR. RAMPTON: It is hormones -- not BSE, sorry.
       A. That is no problem.

MS. STEEL: I am curious as to why the only document that was
in the briefcase happened to be something saying that
hormones were supposedly safe, that was thought to be the
only relevant one to this case.

MR. JUSTICE BELL: In fact, I am not sure that is at all
discoverable because it is just an article. It has been
       discovered to you.

MS. STEEL: I just find it a bit strange that there was a big
