Day 064 - 08 Dec 94 - Page 49
the source is of your information. Do you have any
foundation for that statement and if so what?
A. Not beyond what I have said, no.

MR. MORRIS: It is just something that you have heard?
A. No, I have never seen any before.

Q. It is based on your personal experience of not seeing
physically any other guides in other stores?
A. That is right.

MR. RAMPTON: If Mr. Morris is going to suggest that there was
some predecessor -----

MR. JUSTICE BELL: Let us just wait and see. He has established
the basis of it.

MR. MORRIS: A lot of McDonald's witnesses have said this but
no-one has produced any evidence on it as yet.

MR. RAMPTON: It is not capable of being contradicted then, is
it?

MR. MORRIS (To the witness): So when you went on to say:
"These nutrition guides were introduced in the UK in about
1984", if it is based upon that first sentence, "nutrition
guides which are available in all stores and which give
nutritional information and a complete list of ingredients
used in the food we serve", you can revise that now to be
1989, yes, was the first time you had leaflets available in
stores with actual ingredients in?
A. Yes, nutritional information in 1984, ingredients in
1989.

Q. So what I am saying is, that based upon your statement
there, do you know for certain that there were no other
stores before 1989 giving nutritional information and
ingredients?
A. Not for certain. I believe in one of the leaflets the
foreword was written by Paul Preston which said that we
were one of the first companies to produce this information
for our customers, and it would be good if other companies
could follow suit. Now, nobody has ever contradicted that
statement.

MS. STEEL: Have you still got that Nutrition Guide open?
A. Volume VI?

Q. Yes. The one we were looking at just a moment ago?
A. Yes.

Q. You were asked about getting advice from, I think it was,
the British Nutrition Foundation and the British Diabetic
Association, yes, you remember that?
A. I am sorry, I was asked what?

Q. The British Nutrition Foundation, you were asked about it
during your examination in-chief?
A. Yes.
