17 MR. JUSTICE BELL: Yes, I appreciate that, but do you mean by
18 infestation that there were an awful lot of mice or just
19 that there were mice? That is the only reason I ask.

21 MR. MORRIS: You have said that you saw them running around?
22 A. Yes. As I recall, it was only about four that Rentokil
23 caught in total.

25 MR. JUSTICE BELL: When you said Rentokil only came once, do you
26 mean actually personnel once in the store or there was only
27 one situation which they dealt with by coming over a period
28 of two weeks?
29 A. There was one situation and Rentokil came in several
30 times during that time.

36 A. Danley, Lucas Danley?

38 Q. Danley at the time; do you remember that during an
39 inspection from Headquarters, a general inspection from
40 McDonald's Headquarters, he killed a mouse with his clip
41 board? Do you remember that incident?
42 A. No, I do not.

44 Q. The lights were on in the kitchen area and the front
45 counter -- they are on all 24 hours, yes?
46 A. Probably at the time, yes.

48 Q. You said there were three or four people doing the night
49 closing so there were always people around?
50 A. There would have been at that time, yes.

52 Q. The bun trays, they are sealed. Could you describe the bun
53 trays, what exactly -----
54 A. A plastic tray, holds about 60 buns. They come in two
55 packs, sealed up in plastic.

57 Q. So how did the mouse droppings get inside the bun trays?
58 A. Presumably from the mice.
