3 MR. MORRIS: I think it should be explained what the law is,
4 that things told to a person can be evidence of a fact that
5 they were told that, not necessarily that it was true that
6 they were told.

8 MR. RAMPTON: Mr. Whittle, tell me again: What information do
9 you say was given by a management sneak to management by
10 crew members that resulted in those crew members being
11 rewarded with favours? First of all, if you can, tell me
12 what the information was that you actually know was
13 imparted in that way?
14 A. Well, the only sort of instances I could remember were
15 where a discussion would have taken place between Lynn and
16 Sue and then Sue would have come and asked a member of
17 staff about something. For example ----

19 Q. Give me an example, please.
20 A. For example, Lynn went off to talk to Sue on one
21 particular occasion. Sue came back with three trainees,
22 and asked me to explain to the trainees how I was cleaning
23 a piece of equipment, and the reason she obviously asked
24 Lynn to do this was because I was using a method that Sue
25 believed to be incorrect. So she asked me to explain how I
26 was Ajaxing a piece of equipment. I mentioned that I was
27 using soapy water, which you were not supposed to do. She
28 asked the trainees to explain how they believed the job
29 should be done. They all mentioned how to do it with the
30 omission of the use of detergent. She then attempted to
31 use this to ridicule me as a member of the training squad
32 who should know how to use the job, do the job.

34 Q. I see. So on that occasion your inference is that Lynn had
35 told Sue that you were using the incorrect method and that
36 Sue had sent back this party to humiliate you and that, in
37 consequence of that, Lynn was promoted to lobby hostess; is
38 that the size of it?
39 A. That is not the size of it. That is an example of the
40 sort of thing that ----

42 Q. Give me some more that you actually know about; not that
43 you heard about or would like ----
44 A. I do actually know about that one. I have given you an
45 example of one that I actually knew about.

47 Q. No, I would like you to give me any and all other examples
48 that you actually know about that you witnessed or
49 experienced yourself?
50 A. Bearing in mind that these activities took place
51 nine/ten years ago, I cannot remember every individual
52 opportunity of someone going and speaking to the Manager
53 and telling them they had seen someone do this or that.
54 I just have a memory of that taking place, and being the
55 norm and also the atmosphere in the workplace being like
56 that; people being encouraged to do that, and that was the
57 norm and it was not just one individual with the Manager;
58 that was the way the store operated.
