Day 079 - 27 Jan 95 - Page 65

MR. RAMPTON: Mr. Morris had better make good the allegation.

MR. JUSTICE BELL: It is a serious allegation to make and we
will see what we come to.

  MR. MORRIS: Well ----

MR. JUSTICE BELL: You have sued someone for calling you a
liar. Carry on with your cross-examination as to the
       facts.

MR. MORRIS: If someone can help. I am sorry that you are in
the witness box all day and you are tired.
       A. If you give me a calculator I will tell you.

MR. RAMPTON: My Lord, I do not really think this is a relevant
       enquiry.

MR. JUSTICE BELL: I am minded to agree, but let us get the
       question answered.

THE WITNESS: Your question was how many pallets a day?

  MR. MORRIS: Go through McKey's.

MR. JUSTICE BELL: We want to know how many boxes on a pallet.

MR. MORRIS: Well, it is how many pallets a day -- how many
       pallets ----

MR. JUSTICE BELL: No that is not what set him off on his
calculator. You did ask that question but before that you
were asking him how many boxes there were on the pallet.
       A. It is about 182 pallets a day.

  Q. How many boxes on a pallet?

MR. MORRIS: From the picture it looks like there are -- I do
       not know.
       A. 58, my Lord.

  Q. But I think Mr. Walker said he only tested the top layer,
so how many are actually on the top layer?
       A. Six. I remember saying in evidence a few minutes ago
       six. Thank you.

  Q. The test that is done on a patty that is removed from a
box, what is the actual test? Just explain very briefly
how the test is actually done?
       A. The test is the patty is taken to the laboratory. It
is emulsified. Then that is spread on to a plate and
injected into sugars to grow bacteria to see what grows.

  Q. That is the E.coli test, is it?
       A. No. That is the general bacteriology test.

  Q. The general bacteriology; not the E.coli?
       A. No. The E.coli is on a special oxicoli agar.

  Q. That is not the end of the line test?
