Day 012 - 18 Jul 94 - Page 27

     1
         Q. Then I will ask you a question about it. You will see in
2 the right hand margin your name appears in manuscript,
along with Rensi, Yastrow, D. Horwitz and J. Horwitz.
3 Just please read it through.
              A. OK.
     4
         Q. I want to ask you this first: Did you ever receive that
5 letter -- it calls itself a letter -- it is described as
              being released on April 24th?
6 A. I do not recall having received a copy of this from
              the Attorney General's office, no.
     7
         Q. Turn over the page to 125 -- that is two pages -- we see
8 what is likely the same thing in a different form, do we
              not?
     9 A. Yes.

10 Q. It says: "The Attorney General of Texas. For immediate
release. Contact: Elna Christoffer or Ron Dusek". The
11 second question: If you look at page 124 you will see
that it says in the last two lines: "Assistant Attorney
12 General, Steve Gardner of Mattox's Dallas Consumer
Protection Office is handling the case". Prior to seeing
13 this, had you any knowledge of Mr. Gardner's involvement
in this matter of the advertisements?
14 A. My recollection is that this was the first time we had
heard about this, although this is the sort of thing that
15 we know from experience that Mr. Gardner has been involved
              in.
    16
         Q. Go back, please, to page 123, the first paragraph of text:
17 "A group of school children studying nutrition and diet
has started a campaign against fatty, salty meals from the
18 nation's largest fast food chain". I take it -- it is not
disputed that McDonald's is the nation's largest fast food
    19 chain in 1987?
              A. That is correct.
    20
         Q. Do you know anything about a campaign at that time against
21 McDonald's food by a group of school children?
              A. Certainly nothing formal. When this was received the
22 Attorneys General Office placed a great deal of material
both in the press, and I recall having seen a video that
23 was run in Texas of these school children.

24 Q. On page 127 we find a letter to Mr. Rensi of McDonald's,
dated April 24th 1987, from the Attorney General of New
25 York, Robert Abrams, as we can see at the bottom of page
              128, yes?
    26 A. Yes.

27 Q. If we look at page 129 a transcript of a recording of a
telephone call from Stephen Gardner; then page 131, a
28 letter signed by Jim Mattox, the Attorney General of
Texas, dated April 24th 1987 to Mr. Rensi; then 133, a
29 letter of the same date to Mr. Rensi from the Attorney
              General of California, yes?
    30 A. Yes.
