     9        may be even possibly earlier.  (To the witness):  Page 12,
    10        you say at the top -- these are all commenting on our
    11        witnesses' statements -- "Reference is made to slippery
    12        floors and loose electric plug sockets.  As stated, there
    13        are provisions for such repair.  These items would be
    14        picked up on the Unit audit sheets"?

    17   Q.   When you say "these items would be picked up on the Unit
    18        audit sheets", you do not know that for a fact, though, do
    19        you?
    20        A.  Obviously not.  What I am saying is there is a
    21        system  -----

    24        A.  Can I finish?  What I am saying is there is a system in
    25        place to deal with that.  I cannot pretend (and I would not
    26        pretend) that it is going to work on each and every
    27        instance.

    29   Q.   So, really, more accurate would be "should be picked up on
    30        the Unit audit sheet"?
    31        A.  No, I think "would" is right.  Under normal
    32        circumstances, they would be picked up.

    34   Q.   OK.  Underneath that:  "In common with the rest of
    35        industry, there can be a problem with radiant heat from
    36        grills", etc.  Do you agree with that?
    37        A.  I am sorry -- yes, I have it.  Yes, indeed.

    40        A.  Yes.

    42   Q.   The next point, underneath that, the middle sentence:  "At
    43        no time during my involvement with McDonald's has capital
    44        been denied" ---
    45        A.  Yes.

    47   Q.   -- "for a Health & Safety project"?
    48        A.  Yes.

    50   Q.   That is assuming, of course, that managers are asking for 
    51        money or prepared to spend some of their budget on health 
    52        and safety matters? 
    53        A.  Indeed.  What I am saying is, as far as I am aware,
    54        I have never come across an instance where capital has been
    55        denied.  I cannot speak in the generality, obviously.  I am
    56        saying within my experience.

    58   Q.   Yes.  The comment that you based that as a response to was:
    59          "Nothing was done to fix it because of expense"?
    60        A.  Yes.
