Day 023 - 13 Sep 94 - Page 24

MR. JUSTICE BELL: I will come back at half past and you can
       tell me the position then.

                      (Short Adjournment)

MR. MORRIS: We would like a little bit of guidance because we
would like to comment on reports, but would it better just
to come back if Mr. Rampton brings something new up or
leaves something out that is significant after he has
given his -- or do you want us to comment on them first?

MR. JUSTICE BELL: Make comment yourself, do you mean?

MR. MORRIS: Yes, just on those particular things that have
       been identified.

MR. JUSTICE BELL: No. You reserve that until the speeches at
the end of the case, but if you have a witness yourself
who you think can express a useful view on any of the
reports, obviously you can ask him or her. But what you
do not do at this stage is say, for instance: "Dr. Arnott
said this but if you look at paragraph X in the report
that does not make much sense for this reason". Do you
see what I mean? All that comes at the end in your
       speeches.

  MR. MORRIS: OK.

MR. JUSTICE BELL: Give me an example if it helps.

MR. MORRIS: As Mr. Rampton has focused on a couple of
documents, especially a couple of them we only got
yesterday anyway, it may be the best thing is to ask Dr.
Arnott any particular points before Mr. Rampton.

MR. JUSTICE BELL: It would be, but bear in mind this is
       cross-examination, not comment.

  MR. MORRIS: No, OK.

MR. JUSTICE BELL: I should say that I have not actually read
those parts myself, because I will look at whatever my
attention is directed to either in the course of
cross-examination or in any comment made at the end of the
       case.

MR. MORRIS: Yes. I just want to draw your attention to the
"Can you avoid cancer?" which you have had a look at. I
cannot remember the pages we were meant to look at, 18, 19
       and something else.

  MR. RAMPTON: 27.

MR. MORRIS: 27. Do you have a copy?
       A. Yes, I do, thank you.

  Q. Just on page 19, just ask you that ----

MR. JUSTICE BELL: Which volume are you in now?
