Day 209 - 25 Jan 96 - Page 68

looked at these notes of rap sessions, have you not?
       A. Yes, sorry.

  Q. To save time, there is a number of references to breaks
being missed or people having to take them early?
       A. I think I noticed six out of seven or something, the
PRs and breaks were complained about.

  Q. Were you aware at the time that these complaints were being
raised by crew members at rap sessions or in the store
       generally?
       A. Yes, it was a general gripe of most people that PRs
were not, they were just never on time.

  Q. Right. Did people complain about breaks, to your knowledge
in rap sessions or in the store?
       A. I am not sure about breaks. They used to -- you would
have the, you know, did not get a long enough break, did
not take a break yesterday, I did not get, I did not get
paid for it, things like that, but they were only general
comments made to me in the crew room and stuff. I did not
have anything officially, people going: "I am not getting
enough breaks" but people were generally, in my opinion,
quite unhappy with the breaks they got.

  Q. Right.
       A. Just because they were all -- they tended to be at
       early or late times.

  Q. Right.

MR. JUSTICE BELL: Pause a moment.
       A. Pardon?

  Q. Just pause a moment, please?
       A. Yes. Yes.

MS. STEEL: So sorry, just to clarify, they did not actually
make a formal complaint but they generally moaned about it?
       A. They generally, well, yes, they generally moaned about
it. I do not see how they -- I do not know what a formal
       complaint would be.

  Q. I was just trying to understand what you were saying.
       A. Right, I see. I suppose they could go and see whoever
was the shift Manager, the scheduling Manager ---

  Q. Right.
       A. -- Or the Store Manager, but I just think they would
have been seen as being trouble makers so they would not,
you know, people did not openly complain to the Manager who
caused them to have an early or late break. They would
       complain to other Managers.

  Q. Generally, was something done about it when they did
       complain?
       A. No, it was just considered, you know, they were
       gripeing and moaning.

  Q. Right.
