Day 167 - 02 Oct 95 - Page 57

MR. JUSTICE BELL: So, your recollection is until about the
middle of 1994 it would be the two or three sheets per
       week?
       A. That is right. I cannot give an exact date because
I cannot remember exactly when we changed over. It was
       some time during 1994.

MR. MORRIS: Maybe by comparing one of those weekly schedules or
comparing -- if we had, say, six months of schedules,
weekly schedules, and we had, say, two weeks of time sheets
we could see, just from those two weeks, roughly how much
they diverted from the schedules like a general snap shot
       ----
       A. You would be able to do that, bearing in mind if we
actually had the schedules, we definitely have the time
sheets but we might not specifically have the schedules; we
are not required to keep them. We only keep them because
it gives us an idea of what kind of sales we were
projecting from the previous year and what kind of crew
levels we had, and they aid with the following year.

  Q. You did say you kept schedules for 18 months. You said
       that in your statement.
       A. That is right. We keep them between 12 to 18 months.
But there is no requirement for us to keep them. We keep
them purely as an aid for the following year, whereas the
clock cards we have to keep and so we do keep them.

  Q. But you knew you were going to be giving evidence and there
is a dispute over schedules, so you would not have got rid
of anything that might have been used as evidence, would
       you?
       A. No.

MR. JUSTICE BELL: He has known he is going to be giving
evidence, according to his statement, since about 11th
September. It may have been earlier, but not for very
       long.

MR. RAMPTON: My Lord, he was ----

MR. JUSTICE BELL: He was not one of the original statements.

MR. RAMPTON: No, he was activated when the Defendants told us
on the 31st August, I think it was, that Mr. Logan was
       coming to ....

MR. MORRIS: Just something I just, reading an extract from the
Management and Crew Scheduling Programme at the very end:
It does say -- I do not think it is necessary for everybody
to get it out -- the last paragraph: "Reports are in J and
K, which are print schedule by employee reports, print
Managers' report and print statistics must be filed
together and retained for legal reasons". Do you know what
the "print schedule by employee report" is?
       A. Yes. It is the report you get out from the computer
which would tell you what that employee will be scheduled
       for the following week.

  Q. For each individual person or for the whole store?
