Day 060 - 02 Dec 94 - Page 36

MR. MORRIS: How have they managed to survive in America with
wraps instead of foam packaging then?
       A. You must ask them.

  Q. 19 million people per day?
       A. I can tell you my experience in American, but you must
ask them, if that is your question. My experience -----

  Q. Have you monitored different systems?
       A. Let me finish.

MR. JUSTICE BELL: You must let him finish.

MR. RAMPTON: I do think, my Lord, the Defendants should obey
your Lordship's injunction and not, as it were, perform
       some kind of double act.

MR. JUSTICE BELL: Try to do a series of questions each. It
cannot help your own concentration and it is a bit unfair
on the witness. I appreciate you do not mean to be unfair,
but it can be a bit unfair if one person is asking a
question, then someone else is asking another. So, see if
you cannot string, one of you string a series of questions
together before the other comes in. You have now got to go
back and let him finish his answer.

THE WITNESS: My experience in America is that the food that is
served in a wrap is not as hot as it should be, not as
fresh as it should be, and I know the American organisation
is concerned about that and they are working on the next
       generation of packaging.

MS. STEEL: Are you suggesting that sales have slumped since
polystyrene has stopped being used in the USA?
       A. I do not think I said that. I think I gave you my
       experience.

  Q. As far as you are aware, have sales slumped as a result of
       that?
       A. Not as far as I am aware. That does not mean to say
       they could have been better.

  Q. We do not know, do we?
       A. No, we do not. Exactly.

  Q. But if sales had slumped as a result of that, I am sure you
       would be aware of that?
       A. If they had, yes.

  Q. What about Sweden? I think you said they do not use
polystyrene there. How do they manage there?
       A. They use a cardboard clam shell box, they do not use a
wrap; a cardboard clam shell box will keep the product
hotter than a wrap would, but not as hot as a polystyrene
       box.

  Q. Have sales slumped in Sweden?
       A. Not at all, no.

  Q. You said that you prefer to use polystyrene in this country
