Day 032 - 06 Oct 94 - Page 32
Dr. Lobstein so I will read it. You can make up your mind
whether you want to call Miss Carruthers or not when you
have heard Mr. Rampton's cross-examination of
Dr. Lobstein. You know what, if any, issue there is about
the taking of the information.

MR. MORRIS: Yes. There is another survey -- maybe we could
get that out of the way -- which is referred to in your
statement, Dr. Lobstein, the Gordon Simmons Research
Limited Survey 1987, which is roughly in the same
territory we have just been discussing, regularity of
using fastfood outlets.

We could not trace -- again this survey served and
authorised the press release from the organisation Gordon
Simmons Research Limited -- I actually approached Gordon
Simmons Research Limited. There is a letter that the
conclusions would cost us £50; the rest of it, I think,
was some enormous sum like £1,000 or something. Do you
want to -----

MR. JUSTICE BELL: That is ----

MR. MORRIS: This is (5) in the list of expert references. Do
you have those Dr. Lobstein? Do you have the press
release?
A. I have the press release. I think that is probably
all we ever did have because we too were not prepared to
pay large sums of money for more than this.

Q. If I just give an introduction in the part B, it says:
"The research is based on personal interviews with a
national sample approximately 2,000 adults aged 16 years
and over to assess awareness, penetration, usage, image
and to provide an overall assessment of each major
restaurant chain. Interviews were conducted in June/July
1987". It mentions the various chains, including
McDonald's. "The current research is a repeat of work
carried out in May and June 1985, with some minor
differences". Then it has the actual contents of the
report. You have not got that?
A. No.

Q. The rest of the people in court do have that. I mean,
that does not give any details; that is just really for
the benefit of the court so they can see the type of
survey it was, contents overall. But if you just refer us
to the press release and anything you want to draw our
attention to in that particular press release. If it
becomes an issue, then we will have to deal with it.
A. Yes. The point I was trying to make in my expert
witness report was the frequency of visits to these
fastfood chains identified, I think, in table 5, which, at
that time, showed that McDonald's, as they say in their
own statement, McDonald's and Kentucky Fried Chicken are
reaching over half the population. Then the following
page.

Q. Which page are we on?
A. Mine are not page numbered, but it is paragraph 5.
