Day 069 - 19 Dec 94 - Page 10

       A. One of them -- they are divided into two different
types of McNuggetts that are McNuggetts; one of them is,
       one of them is not.

  Q. Have you also spoken to Tysons about this alleged incident?
       A. Yes, I have.

  Q. What was their response to that?
       A. That there was no -- they look at the piece of metal.
They do not have that kind of metal. They look at all of
the possibilities. We do have records that the metal
detectors are functioning properly. They are monitored
routinely. They found no evidence that that clip came from
       their plant.

  Q. Do you happen to know -- it does not say on the form --
whether any action was taken in response to this complaint
       about a metal ring?
       A. No, no action was taken.

  Q. Either against McDonald's or against Tysons?
       A. That is correct.

  Q. The third one, which is the last one concerning McDonald's,
is dated 29th March, 1993; again, Chicken McNuggets; this
time the restaurant was in Modesto, California and, again,
it was the same Tysons plant who had supplied the product
in Nashville, Arkansas. This time the allegation was that
the compliance officer, Tina Nader, contacted Ms. Pamela
Delorie, a consumer, who said that her three year-old son
bit down on a bone fragment approximately 1.5 centimetres.

Can you quickly tell us, from your head, how much of an
       inch 1.5 centimetres is?

  MR. JUSTICE BELL: Three-fifths.

MR. RAMPTON: "Ms. Delorie returned the bone fragment to the
owner of McDonald's Modesto, CA, Mr. Emerson Johnson. On
30th March, 1993, CO Nader contacted Mr. Johnson, who said
there were no other complaints. On 31st March, 1993,
Mr. Shannon Driggers, Quality Control Manager, Tyson Foods,
called regarding the incident and informed CO Nader that
inspection had been notified and Tyson would contact
       consumer directly."

Then over the page there is a photograph which, I am
afraid, in my copy at least, shows everything but the
supposed bone fragment -- unless that black thing in the
middle is the bone fragment. What do you think, Dr. Gomez
       Gonzalez?
       A. If you let me read it?

MR. RAMPTON: Actually, this document, I think, comes from one
of the earlier -- I think the pages have got muddled.

MR. JUSTICE BELL: It has "Mr. Terry" on it.

MR. RAMPTON: Yes. It is the earlier one; your Lordship is
       quite right.
