Day 161 - 24 Jul 95 - Page 18

MR. MORRIS: Can we have a ten minute break?

MR. JUSTICE BELL: Yes. I will come back at half past 11.

                        (Short Adjournment)

                    Cross-examined by the Defendants

MISS STEEL: The store which you run now, has it always been a
       franchise store?
       A. No.

  Q. It has not?
       A. It has not.

  Q. When did it become a franchise store?
       A. As I said earlier, 1993.

  Q. So it was when you became the franchisee?
       A. Yes.

  Q. Do you know how long the store had been open -----

MR. JUSTICE BELL: Just pause a moment, please, Ms. Steel.

MR. RAMPTON: My Lord, I would invite Ms. Steel to state the
purpose of these questions. It looks to me as though it is
a roundabout way of trying to find out where the store is.

MR. JUSTICE BELL: I may well allow her to find out where the
store is, despite what is in the first paragraphs. What
I suggest is, if you say -- I mean, I see no difficulty so
far, anyway. Would you like to just sit down, please,
       Miss Anteneh.

Why do you not tell me, if you do actually want to know
where the store is, tell me why, and also tell me whether a
way of dealing with it would be to write down the name of
the store, so that you can see it, Mr. Morris can see it,
Mr. Rampton can see it and I can see it.

There are two aspects; there are three, really: whether
you need to know the identity of a store; whether there is
a good reason why it should not be identified in open court
for any reason; and, in any event, specifically, whether
the witness has a genuine anxiety about it.

  MISS STEEL: Right.

MR. JUSTICE BELL: Because it does not necessarily end the
answer to say the reason is not a good one, if the person
has a genuine anxiety about it which can be alleviated or
       avoided in some way.

MISS STEEL: Right. On the subject of a genuine anxiety, it is
clear from the statement that what is outlined in there was
absolutely nothing to do with this case.
