Day 209 - 25 Jan 96 - Page 75
there on the side.
A. It must be this one. I have got it, yes.

Q. Thank you.

MR. RAMPTON: I understand that you are not saying that Paul
Scot Shepherd was in any way mistreated?
A. No.

Q. So we can forget about him, can we? If he wanted to work a
lot of shifts in a row that is up to him, is it not?
A. You could say that but, you know, if he -- if he had
been paid a reasonable page he would not have had to do 60
hours a week.

Q. That may be a matter of opinion, Mr. Logan.
A. That is what I was getting at.

Q. Mr. Gore, I think you described this afternoon what you say
about him. Is that all that we need to know, from your
point of view, about Mr. Gore or do you want to add
anything now?
A. No, he was -- yes.

Q. Do you assert in relation to Mr. Gore that he did an undue
number of night closes, or not?
A. What I say is that he complained to me directly of
doing too many closes and then when I did the schedule
I tried to make an arrangement with him to do less closes.

Q. That I understand. What is your case about Mr. Stoakes
treated badly by scheduling?
A. Similarly to John Gore; he did not like doing many
nights and he seemed to be getting a lot of nights at one
stage.

Q. Right. Can you tell us which stage? The date I have here
is 93/4ish. I am very interested in the dates, Mr. Logan.
A. Right. Well, it is not a specific time he was badly
treated. I would say because he was not considered to be a
high performer in the restaurant his shifts always tended
to be quite unsocial shifts.

Q. You are sticking to 1993/94, are you?
A. Yes. Could we know when he started in the Company,
because if he started in '92 I think it would probably
include '92 as well.

Q. Not offhand, but you are sticking to '93/94, are you?
A. Could I check his PRs?

Q. No, no. I would like to know what you say about his being
treated by scheduling, badly treated by scheduling?
A. I have come up with that date because it is just a day
I have come up with; he was treated badly from soon after
he started.

MR. MORRIS: He started in May '92, according to this.

MR. RAMPTON: Mr. Logan ---
