Day 259 - 10 Jun 96 - Page 51

       looked at?
       A. No, I certainly cannot, no.

  Q. Right. OK. What specifically did he look into on one of
       these visits?

MR. JUSTICE BELL: Can you remember?
       A. Well, he looked to make sure that the correct rate of
pay was being adhered to for the age or the level of the
crew member and that we were adhering to the minimum rates
       at that time.

MR. MORRIS: To do that, he would have to look at specific
things, check the hours worked, check the age of the
employee, check the timings the person worked, check
whether they were getting the social, anti-social increase?
       A. It was not difficult. All the information was there
for him within the office. It was not a difficult job for
       him to do.

  Q. But he had to check all those things for a dozen
employees,? When he looked at crew, he looked at about a
dozen crew members, did he, or more than that?
       A. No, I would not have said more than that; possibly
       about a dozen.

  Q. Yes, a dozen. Was checking overtime part of your
       responsibility?
       A. No. I have already said it was not.

  Q. If you looked at a chart, would you be able to look at that
chart and say fairly easily, in your expertise, when you
are chatting with Mr. Mills, "Oh, yes, it looks like there
is a bit of a discrepancy there. This person worked
43 hours and only", whatever -----
       A. If I had been asked to at that time, I would have been
able to, but it was not my specific role to do so.

  Q. So, it was not your specific area, but did you have an
overall grasp of what the laws were on overtime,
       specifically?
       A. I had an overall grasp as to the company policy and
       company procedure, yes.

  Q. Company policy was not that people should not work over
39 hours; and the Company did not pay overtime, did it?
       A. Again, it was not my area. My area was on the tax
side, the calculation of the wages, right through to the
net pay. There were other people who were responsible for
making sure that people, if they should not work over
39 hours, did not do so.

  Q. Right.
       A. That was not my area.

  Q. If the Company did not pay specific overtime payments,
which was the policy, not to pay overtime, then so far as
you were concerned, that is the end of it; it did not come
into your remit; you did not have to do overtime
calculations, because the Company's policy was not to pay
