Day 173 - 16 Oct 95 - Page 62

were and what conditions they wished to discuss. I did not
receive a reply to my letter."

The letter that you wrote, is that the one we were looking
at which is on page 969 of the pink bundle?
       A. Yes, I believe it would be.

  Q. Then, going on to paragraph 9, you have made all kinds of
allegations about violent pickets. Was any of that
       witnessed by you?
       A. Yes, yes, much of it.

  Q. Much of it?
       A. Yes.

  Q. It just so happened to occur on the days that you were at
       the store?
       A. It was occurring from the time the first picket went
on, basically, and on the premises. It was continuous; and
I spent quite a bit of time going to the restaurants to
       observe what was going on.

  Q. You have already said that you went there less than -----
       A. I would go there at nighttime, in the evening, as well
as when I would go during the day.

  Q. We have got your evidence earlier about how much time you
spent at the store. Now, I think we should have raised
this earlier, actually, but it says here about some
employees being visited at home. Presumably, you were not
at the homes of these employees when these so-called visits
       were made?
       A. No, no, I was not.

  Q. So that is entirely hearsay?
       A. Well, I do not think it is hearsay. The employees
       stated that is what happened.

MR. JUSTICE BELL: Let me -- yes.

MS. STEEL: The incident that you relate about four to five
masked pickets entering the restaurant, were you present?
       A. No, I was not present immediately when it happened.
I rushed to the restaurant as quickly as I could.

  Q. Was there anybody there when you got there?
       A. By way of the people who came in and attacked the
       restaurant?

  Q. Who was there; were there just crew members and management
       there?
       A. There were crew and management in the restaurant, and
the restaurant was closed because equipment had been
damaged and we could not operate.

  Q. But you did not see any of that happen?
       A. No.

MR. MORRIS: Just on this subject, was anybody ever taken to
court and found guilty of assaulting a customer or staff?
