Day 248 - 13 May 96 - Page 17
A. Well...

Q. Also Mr. Love says in the final sentence, "you should be
aware that we are unable to discuss the details of evidence
while the case is before the court". Is that true, as the
Corporation?
A. I think.

Q. Not talking about you in the middle of your evidence?
A. I think we are permitted to discuss things that have
become public. I do not think we are permitted to talk
about anything going forward. I am certainly not allowed,
nor is any other witness allowed, to confer with our legal
counsel while we are giving testimony.

Q. But you have Mr. Nicholson in court every day, you are
buying transcripts, you do not need to talk to the
solicitors, and you have discussed details of the evidence
with the media whilst the case is on going have you not?
A. I have not.

Q. Your company has?
A. We have discussed nothing about the case except that
which is public.

Q. It is all public because it is a public trial. You have
discussed details of the evidence?
A. You will have to give me an example.

Q. OK. If you want an example, then, if you get the
supplementary list of documents which were served last
week, bundle 9.

MR. JUSTICE BELL: It should be on the bottom right-hand corner.

MS. STEEL: If you turn to tab 14 in that document. Mr. Love is
referring to some of the evidence in detail there is he
not?
A. I have read the article.

Q. So, on your company's behalf Mr. Love has discussed details
of the evidence?
A. Well...

Q. While the case is going on?
A. Looks to me like you wrote somebody a quote clarifying
or speaking in response to something they had published
previously, trying to correct inaccuracies. I do not know
that he spoke to anybody.

Q. Well, whether it was spoken or written is beside the
point.
A. No, I think it is exactly the point. It is in response
to something which appeared first, he responded to
something which had appeared, he did not go out and create
this, he responded to somebody else.

Q. But he discussed the details of the evidence?
A. No, not at all.
