Day 293 - 04 Nov 96 - Page 42

packaging if they themselves were not engaged in recycling
material. And McDonald's had admitted that it only had a
small and temporary recycling scheme at four Nottingham
stores. So they were still giving the impression then that
they had a recycling scheme, even though it was only
       whatever it was.

  MR. JUSTICE BELL: April 1991?

MR. MORRIS: April 1991 it was. I think that is basically it,
really. Yes. I just want to have one final check.
(Pause) We conclude that we have demonstrated that
McDonald's packaging use is damaging to the environment
basically, and that they have tried to give the impression
that they are concerned about the environment without any
kind of real commitment to it.

MR. JUSTICE BELL: Yes, thank you. Right. Where are we going
       to go next?

MR. RAMPTON: Can I just draw your Lordship's attention to one
thing about which there was a short discussion earlier on?

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: Mr. Morris's attempt to quote what I said. He
and I both got it rather completely wrong. My Lord, it is
on page 2 of day 58. There is unfortunately a misprint.
What I actually said was, at line 44: "I prefaced this
topic with the observation that that interpretation - that
is the one Mr. Morris has been batting for today - of the
leaflet might be appropriate had it been a specialist
       forestry publication."

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: The word is written as "application", but plainly
       that is a misprint.

MR. JUSTICE BELL: Right. What are you going to go on to next
       then?

MR. MORRIS: Well, I am hoping to do food poisoning tomorrow.
I think, I don't know, because in some ways, if I thought I
could do it in the time allotted easily, it would be better
to start later so I would have the morning to prepare,
because effectively I am starting my preparations on it
tonight. But we have had some help on the food poisoning
issue in terms of some people have been through some of the
       transcripts.

MR. JUSTICE BELL: What do you want to do?

MR. MORRIS: Maybe if we could apply to start at 12 tomorrow,
       that might be helpful.

MR. JUSTICE BELL: And how long do you think you will take?
Would it positively help you to start at 12? I mean, are
there things you can do which will help you get through it
       more efficiently?
