Day 251 - 17 May 96 - Page 40

memory on his evidence, rather than him being brought in at
3 o'clock on Tuesday afternoon or, indeed, 11 o'clock on
       Tuesday morning.

If there is going to be a witness put back in the witness
box after Naismith, it should be Mr. Nicholson.

MR. JUSTICE BELL: Do you have anything to say about that?

MR. RAMPTON: No. What I am not willing to contemplate is that
Dr. Arnott should come on the morning of Wednesday, 22nd,
and not finish, considering that he is available on 21st
and considering that his evidence will be quite short,
because I think all he is going to do is to say: "Well,
what Naismith has said about cancer is entirely right.
Here is some new material which shows him to be correct".
I think that is what he is going to say.

We have spoken to him on the telephone and that is the
       impression we have.

MR. JUSTICE BELL: All I will say at the moment is that if
Professor Naismith finishes on the Tuesday, we will hear
more of Mr. Nicholson, but we will not go to Dr. Arnott
before 10.30 on the Wednesday morning and we must just do
our best to finish him on that day.

MR. RAMPTON: I will not ask him any questions in-chief, now
       will I ask him -----

MR. JUSTICE BELL: There we are. Let us hope we get through
him, but I am not prepared to make any rulings now; I do
not think it is necessary to do so as to what should happen
if we do not finish Dr. Arnott on Wednesday, I just hope
that we will. We will resume at 10.30 on Monday morning
       with Professor Naismith.
