Day 313 - 13 Dec 96 - Page 31
and, I have to say, I do not think this is pointing out
that something is wrong, it is just repeating an argument
you put about six or seven weeks ago now on the ten per
cent point.

MR. MORRIS: Yes. OK.

MR. JUSTICE BELL: Now, if you have a genuine point of law,
please do it, but I am afraid I am not going to let you
just go through Mr. Rampton's submissions, turning over
pages to look for a marker where you want to make a point
like that. You have made it before.

MR. MORRIS: Most of my marks I have not referred to at all.
I did refer to table 1, that is about soya, and the same
applies to soya as applies to beef when calculating the
percentages, if I can say that.

MR. JUSTICE BELL: These are not points of law, Mr. Morris.

MR. MORRIS: OK. Mr. Rampton refers to Lord Vestey on page 30,
about what happens to cattle in Brazil. The point is Lord
Vestey is not an expert, that was quite clear, he did not
claim to be. But the only significant point, therefore,
that he can rely on, Lord Vestey just did not know what was
going on.

MR. JUSTICE BELL: Look, if you make one more point which is an
argument of fact I am going to make you sit down because
you are using the indulgence I have given you so far as
this is concerned.

MR. MORRIS: I am saying that he is trying to rely on something
that Lord Vestey said that he -- I am just making the point
that Lord Vestey stated he was not an expert on beef
production or on-----

MR. JUSTICE BELL: That is a comment on the evidence, not on a
matter of law.

MR. MORRIS: OK. That is all I have to say on that then.

MR. JUSTICE BELL: Thank you.

MR. MORRIS: I was trying to make what I thought were points of
law.

MR. JUSTICE BELL: Well, the first one you did not start off too
badly but you certainly got into matters of fact and
evidence after that.

MR. MORRIS: Right.

MR. JUSTICE BELL: Have you got any more points of law or
anything in relation to counterclaim or damages?

MR. MORRIS: Helen is going to do --

MR. JUSTICE BELL: In fact, have you got anything more you want
to address me on at all?
