     3        were given to the Defendants and why it is only now that
     4        they are being produced in the middle of cross-examination?

     6   MR. MORRIS:  We were given a large number of documents on
     7        Friday.

    11   MR. MORRIS:  I am sorry I spoke, Mr. Rampton.

    13   MR. JUSTICE BELL:  Let him finish first, Mr. Rampton.  Yes,

    16   MR. MORRIS:  And I did not even have a chance to look at them
    17        until the weekend, so that is the fact of the matter.

    19   MR. RAMPTON:  But it is now 4 o'clock.

    21   MR. JUSTICE BELL:  Yes, Mr. Rampton.  Wait for your turn,
    22        Mr. Rampton.

    28   MR. MORRIS:  The first document I want to serve on the
    29        Plaintiffs is called Responsible Food Advertising, Proposal
    30        for the Review of Advertising Codes of Practice.  It is
    31        published by the National Food Alliance.

    33   MR. JUSTICE BELL:  How many copies have you?

    35   MR. MORRIS:  I cannot remember whether we have two copies -- we
    36        did not have time to photocopy them.

    38   MR. JUSTICE BELL:  No.  All I am asking you to do at the moment
    39        is identify the documents which you will wish to put to
    40        Mr. Hawkes.  Then, I anticipate, when you have identified
    41        them and we know how many copies you have, we will break
    42        off until the morning and make sure one way or another that
    43        Mr. Rampton at least has a copy, I have a copy and there is
    44        a copy available for the witness.

    46   MR. MORRIS:  I am just getting very confused.  What I would like
    47        to do is start asking a few questions, having alerted the
    48        witness to the subject matter.  I would like to ask a few
    49        questions before we retire for the day.

    51   MR. JUSTICE BELL:  He really should have an opportunity to read 
    52        the documentation as he had an opportunity to read the 
    53        document which had already been produced before he came
    54        into the witness box.  Mr. Rampton should have an
    55        opportunity to read it as well.

    59   MR. RAMPTON:  And, with your Lordship's leave, to speak to the
    60        witness about it.
