     1        unhappy with the end of October because I would have to
     2        find somebody to answer Mr. North if what he said had any
     3        substance.  Then your Lordship said:  "When it comes, if
     4        Mr. Rampton says it is too late, I will consider his
     5        argument and I will consider your answer to it".  Then your
     6        Lordship said:  "I am not going to say now that if it comes
     7        at the end of October that will be all right".  We are now
     8        some way into December.

    10        I am not saying it is too late but, of course, the longer
    11        one goes on, if it is evidence which one has to answer, the
    12        more difficult it becomes.  I am reminded that Mr. Morris
    13         -- the Defendants met Mr. North after court on 17th
    14        October 1995.  Your Lordship said to them:  "You get off
    15        now and meet Mr. North now, hopefully, and pick a time when
    16        we finish a bit early to raise those matters" -- what those
    17        matters were, I do not know.  Anyhow, your Lordship was
    18        obviously encouraging them in the middle of October to get
    19        something done.  I refer to that, not to make any point,
    20        but just because your Lordship asked.

    22   MR. JUSTICE BELL:  Thank you.

    24   MR. RAMPTON:  The only other thing is this, your Lordship did
    25        say to the Defendants yesterday that they should try to
    26        produce a list of interlocutory matters of their own if
    27        there were any that they wanted to raise.

    29   MR. JUSTICE BELL:  Are there any further matters you want to
    30        raise on Friday?

    32   MR. MORRIS:  There is nothing substantial; just may be some
    33        discovery matters, but if there is anything specific we
    34        will put it in writing for the Plaintiffs.

    36   MR. JUSTICE BELL:  Yes.  Fax it across to Mrs. Brinley-Codd so
    37        that Mrs. Brinley-Codd has it on Thursday morning anyway.
    38        I think Mr. Glen said I would be grateful if a bit of
    39        clearing up could be done because another case will be
    40        tried in here tomorrow and the day after.  10.30 on Friday.
