2 MR. MORRIS: But if they were taken from inside they would
3 concern you?
4 A. If it was the actual temperature in there, but the
5 thing with the, what is it, the counter refrigerator, which
6 is where the salads have been kept before they are served,
7 that product is going to be served within a couple of
8 hours, so that is not of a great concern. It would be
9 great if we could maintain the temperature down at four,
10 but it would fluctuate as the door opens and closes. It is
11 the Main Chiller and Freezer which are the priorities for
12 us.

14 Q. That depends on whether the temperature has been taken
15 inside or on the dial outside?
16 A. The thing is the dial outside is not -- is very
17 sensitive to opening and closing of the door. It is the
18 product temperature rather than the air temperature, and
19 that measures the air temperature. It is one of the
20 reasons why we take the temperatures of the product is that
21 we get a better indication. So, to answer your question,
22 these figures do not cause me undue concern because they
23 are very close and they are in -- I believe they are from
24 the outside of the door.

26 Q. But if you have standards, recommended temperature,
27 presumably, that applies to what it reads on the dial, does
28 it not?
29 A. No. Temperature of the product. They are guides for
30 it. It will -----

32 Q. Are you telling me that you measure the temperature of
33 frozen products?
34 A. I am.

36 Q. That is what the average staff will be doing to ensure that
37 the freezers and chillers are working every day? They will
38 be testing the products?
39 A. Put it between two, between two bags of Nuggets to
40 check the temperature -- to a box of Chicken McNuggets, you
41 put a temperature probe between two bags of Nuggets will
42 give you a temperature of the product. You do the same
43 between two bags of lettuce on chilled product, and when
44 the product arrives in the restaurant that is our check on
45 the product that comes off the back of the truck. The
46 guide to the chillers and freezers are useful so you have a
47 catastrophic break-down, you see it ------

49 MR. JUSTICE BELL: Where you might see troubles coming?
50 A. You will see trouble that it is way up, but throughout
51 the day it will fluctuate up and down as the door opens and
52 closes, similar to your fridge at home. If you keep it
53 closed, it will maintain its temperature, but if you open
54 and close it, then it will be fighting to get back down
55 again. So, the temperature between two bags of Nuggets
56 will not change with opening and closing the main freezer
57 door, but the dial will change. So, to answer the question
58 again, these would not particularly concern me.
