Day 168 - 03 Oct 95 - Page 22
is another matter, but they were discussed, were they not?
A. They were along with just like every employee that was
in the restaurant, we discussed people whose performance we
thought was good and poor, just like we would discussing
all aspects of the business.

Q. But you would discuss people who were not coming up to
scratch?
A. We would, just as we would discuss people that were
coming up to scratch.

Q. I am asking you about the people who did not come up to
scratch.
A. Oh, we would discuss them, yes.

MR. JUSTICE BELL: You would not be doing your job if you did
not discuss it?
A. No, absolutely. We would discuss it as part of the
normal meeting structure.

MR. MORRIS: People that were -- a neutral term -- not coming up
to scratch, that was an item on the agenda for the
management meeting about what to do about that?
A. There was not a specific items on the agenda, no. We
generally talk about -- we start the meeting by talking
about sales for the week, results for the week, what we
were going to do about those results and then we would talk
about performance reviews, for instance, whose performance
reviews were due in the next week or two weeks, and what
comments we were going to make on their performance;
whether they deserved an extra merit, for instance, whether
they were available for courses or promotion and if someone
required extra tuition, as it were, then we would organise
that for them.

Q. So, in your point (7) in your statement you say: "If an
individual crew member's performance is not satisfactory, a
manager will concentrate on improving that individual's
performance". Then you go on to talk about the "buddy"
system. So, that would be something that would crop up at
a managers' meeting?
A. Yes, it would. If, for instance, you said that Joe
Bloggs was not coming up to scratch, we would, perhaps,
discuss the reasons why they were not coming up to
scratch. If necessary, the Store Manager would interview
that person and speak to them on their own and see if they
had any kind of problem. Then you would organise some
extra training for them or whatever was appropriate.

Q. Did that really happen, that you wanted to improve
individuals' performance?
A. Yes.

Q. What, just every so often one person or was it that 10 or
15 of the staff would -----
A. Not 10 or 15. It might be occasionally you would get a
problem with someone where they would be need to be
rerolled. For instance, someone who was unhappy at working
till regularly might request that they spend a little more
time in the kitchen. You might be able to accommodate that
