Day 189 - 20 Nov 95 - Page 39
witnesses were fabricated, he would not have granted the
order.

MR. JUSTICE BELL: If he had thought, "I really cannot tell on
affidavit evidence; no one wants oral evidence or
cross-examination, and a peace keeping order is sensible in
all the circumstances", that would probably be enough,
would it not?

MR. RAMPTON: It probably would. I do not know enough about
Irish law to be certain of that, but it is likely, if one
applies English standards, that that is right.

(To the witness): Finally, can you go to past the end of
the dispute in your mind, please, Mr. Mrozek? I would like
a bit more of the chronology, if you could help us? You
went back to work, I think, about 17th September?
A. Round that time, yes.

Q. How long after you went back before the incident which you
call the false accusation of -----
A. I would say it may be about two or three weeks.

Q. Two or three weeks?
A. Two weeks, yes.

Q. Then how long after that was the lager incident?
A. Maybe a couple of weeks after that.

Q. But you did not finally leave until you think some time in
November; is that right?
A. I think I gave up round that time. The dates I -- and
the time span, I am not ......

Q. Do you think you left before the end of the year?
A. As far as I know, I left before the end of the year.

Q. Yes. You know, do you not, that it is (and always has
been) McDonald's Company policy that you are not allowed to
drink before you go, I mean, drink alcohol before you go to
work?
A. Well, I saw people many times who had been drinking and
nothing was said to them. In fact, some of them were
management so .....

MR. RAMPTON: Thank you.

MR. MORRIS: No further questions. Thank you.

MR. JUSTICE BELL: Yes. Thank you, Mr. Mrozek.
A. Thank you, your Lordship.

MS. STEEL: I do not know whether it is worth bringing it up,
but I notice that in the Crew Handbook -----

MR. JUSTICE BELL: Leave that, Mr. Mrozek. Please go and sit
down?
A. Thank you.
