1 Q. I noticed from reading the transcript something to this
2 effect -- I think his Lordship did most of the arithmetic
3 -- it meant that over a period of just over a year
4 February 1986, I think it was, to March 1987 there will
5 have been at least six weeks, and maybe more, when he did
6 more than 39 hours, did you notice that?
7 A. I think that is what the pay slips indicated, yes.

9 Q. Did you ever tell Mr. Alemi: "You have got to work these
10 additional hours"?
11 A. No. He used to request to work those sorts of hours.
12 He used to request to work closes specifically. He liked
13 to have as many hours as he possibly could.

15 Q. Did he ever do any all night shifts?
16 A. I believe he may have done. I cannot specifically
17 remember Siamak doing an all night shift, but he may well
18 have done at some point.

20 Q. How frequent were all night shifts?
21 A. Probably once a quarter, something like that.

23 Q. What was reason why they were done?
24 A. If we wanted to do a spring clean on the restaurant or
25 if somebody very senior in the Company was coming.

27 Q. So if you were threatened with Mr. Preston or somebody like
28 that, then you would make sure that you had -----
29 A. If it was needed, yes.

31 Q. If it was needed. Did Mr. Alemi ever give you a reason why
32 he wanted to work all these additional hours?
33 A. I believe it is because he wanted the money.

35 Q. Did he give you a reason why he wanted to do that
36 particular -- you said his favourite shift was the
37 one ----
38 A. Obviously on a night shift you got evening and premium
39 rates, so therefore you earned more money for the hours
40 that you worked.

42 Q. In those days, as you know (as we all know), there were
43 three rates - day, evening and close, were there not?
44 A. That is right. Premium rather than closing, it is
45 called.

47 Q. What would happen, Mr. Davis, if, for example, you had
48 scheduled a certain number of people to come in on an
49 evening and you found, for some reason, one or two people
50 did not turn up, maybe because of some accident or
51 something of that kind; what would you do to make up your
52 compliment?
53 A. We used to operate a substitute list for people who
54 were really willing to come in.

56 Q. At short notice?
57 A. At short notice, and we would ring them specific people
58 up, and if they were willing to come in, which nine times
59 out of ten they were, then we would call them in to cover
60 for the missing shifts.
