Day 012 - 18 Jul 94 - Page 09
1 A. Yes.
2 Q. Do you see that?
A. Yes, I do.
3
Q. This gentleman who is the writer, Mr. Shelden, writes
4 this: "On behalf of the Texas Attorney General's office
and the California Attorney General's office, we want to
5 thank you for your courtesy and co- operation in meeting
with us to address the issue of nutrition labelling by
6 quick service restaurants". Had there been a meeting
between Dewey Ballantine and those Attorney Generals'
7 officers at about this time?
A. Yes, there had been a meeting at which I attended.
8
Q. I was going to ask you whether you were there?
9 A. Yes, I was.
10 Q. Can you tell us what the meeting was about, what was
concluded?
11 A. Yes, I can.
12 Q. Would you like to read the letter to yourself first?
A. Yes, may I take a moment to read it first?
13
Q. Yes. I do not want to read it out. Tell me when you have
14 finished. Does that help to remind you what the purpose
and result of the meeting was?
15 A. That is correct, it does.
16 Q. Tell us just in broad terms?
A. The meeting was an exploratory by the Attorneys
17 General mentioned in order to gather more information
about how nutritional information was being dispersed or
18 not being dispersed by quick service restaurants, and the
question as to ---- They addressed questions as to whether
19 they had the authority under local law to request that
certain information be dispersed.
20
As a result of this meeting, they requested that these
21 quick service restaurants that had met with them disperse
information in certain forms, by a certain time and, in
22 fact, McDonald's did make a dispersal of information at a
later date since it had already been in the process of
23 making such information available in New York, New Jersey,
Connecticut and Washington.
24
Q. Are McDonald's concerned to conform with state and federal
25 law so far as matters of this kind are concerned?
A. We were concerned at that time, at all times, to be
26 in conformity with all laws, both state and federal. We
did not believe that the state laws did apply, nor do we
27 today. We did believe that the consumer had the right to
have this information available to them. That is what we
28 had been looking at for the prior year.
29 Q. Can you look at the second page of this letter from Mr.
Van Kemp to Mr. Sheldon, 186D, and there are som
30 subheadings towards the end of the page 1A and B?
A. Yes.
