Day 017 - 25 Jul 94 - Page 66

     1 both of them.

2 MR. JUSTICE BELL: It is your present intention, unless
something gets in your way, to call both Mr. Barnard and
3 Mr. Gardner? I have to say, on what I know of the case at
the moment -- I am not in any way belittling what maybe be
4 the significance of Mr. Gardner's evidence -- it seems to
me Dr. Barnard is particularly important to you, but you
5 are probably aware of that anyway.

6 While we are talking of your witnesses, my copy of
Mr. Cummins' statement which is No. 3 in section L is a
7 very poor one. I can read it but only with difficulty, so
if it is possible to provide me with a better copy of that
8 I would appreciate it. He is in your Civil Evidence Act
list at the movement. And Pater (?) says on one sheet
9 that he has proof, records, statements and comprehensive
investigations to support what he says. If you are
10 thinking of actually calling him, I merely repeat what I
said in relation to other witnesses, that if he is going
11 produce anything extra, the sooner it is disclosed the
better, but you have that point in mind no doubt. Yes?
    12
MS. STEEL: The couple of things I wanted to bring up was you
13 were handed a bundle of correspondence last week to go in
the correspondence bundles. There was an attendance note
14 with it. I was not sure if this was supposed to be of
              particular significance.
    15
MR. JUSTICE BELL: I have not actually read them. Do you want
16 me to look at it now or not?

17 MS. STEEL: It is the one of 27th June. I am not sure whether
this has been put in because it is of some significance,
18 because I did ask about other attendance notes or
telephone calls, and I was told that no other ones had
19 been handed in to you, so I assumed from that there was
              some significance to this.
    20
MR. JUSTICE BELL: Let me just have a look at it. Can you
    21 remember the attendance note?

    22 MR. RAMPTON: No.

23 MR. JUSTICE BELL: There is no point in me reading it out, so
just have a look at it. I assume the re. Gravett is just
24 because at some stage or other that has been the file
              name.
    25
MR. RAMPTON: That is the name. I cannot not see any
26 significance in that, not immediate significance, in it
              anyway.
    27
MS. STEEL: My Lord, the only thing I was concerned about is
28 in case it does come up as a matter of some significance
for some reason later and I may have forgotten by then
29 what this was about, the package I was asking about them
collecting was the video that Mr. Rampton was asking for
    30 ---
