Day 285 - 23 Oct 96 - Page 29

MR JUSTICE BELL: He did not say that-----

MR. MORRIS: McDonald's had a separate supply -- sorry, what
       did he not say?

MR. JUSTICE BELL: You had better give me chapter and verse
for that. You may be right, I may be wrong. I do not
think he said it came to Alajuela for processing by Co-op
Montecillos for McDonald's from all over the country.

  MR. MORRIS: No, no, no

MR JUSTICE BELL: Which is the bottom line as far as I am
       concerned?

MR. MORRIS: No, I did not say he said that. I said that that
plant at Alajuela received supplies -- this the local
market -- so they get the general beef supplies. But
I was going to say, but he did not accept that McDonald's
would get that beef because they would have separate
supplies from Baranca division. But the point is it does
open the question to anybody that, really, is that always
       the case?

  MR. JUSTICE BELL:   What evidence is there to the contrary;
       that is the point?

  MR. MORRIS: I am making ----- (pm2)

MR. JUSTICE BELL: When I said what I did to you a few moments
ago, I was not getting on at you. I am genuinely
interested in what the evidence is, what the reliable
evidence is, if any, that beef for McDonald's actually
comes from land which was rainforest at this time or that
       time.

  MR. MORRIS: Right.

MR. JUSTICE BELL: Then when I have got that straight in my
mind, I can go on and ask myself what the evidence was
that it was rainforest at some time and, if so, which, and
what the ramifications are of that, if it is so. All that
is quite apart from the hamburger connection argument.

  MR. MORRIS: Right.

MR. JUSTICE BELL: But I must be right about it.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: I cannot just say because Co-op Montecillos
gets some meat from a local market which may come from
some other part of the country, even though the evidence
is that they got their McDonald's meat from Baranca and it
came from this specified part of the country, that I
cannot say from that "oh, well, on balance of
probabilities meat from McDonald's came from a market
which grew from rainforest areas". That would be pure
speculation. That is why I am asking you, you know, where
       it takes you.
