Day 151 - 10 Jul 95 - Page 20

trying to find what those areas are.

MR. JUSTICE BELL: He can give evidence about them, even though
he is not responsible for them, if he actually knows the
answers. But if he does not know the answer and he says
so, the mere fact that he goes on to say why, because that
is someone else's responsibility, really ought not to lead
us into inquiring why that is so and whether it should be
so, because we have really moved well away from the issue
       then.

I am prepared to accept, unless it is shown to be wrong,
that someone who has an Operations managerial function over
a large area will get to know something about marketing and
the way it works and Human Resources and the way it works,
and so on, but on any particular topic he is asked about
may say: "I am sorry, I do not know what the position is
       there."

MR. MORRIS: Right. It is not an academic enquiry, because
Mr. Stanton has made a lot of very sweeping and generalised
statements about what happens at McDonald's.

MR. JUSTICE BELL: I would like you to -----

MR. MORRIS: It is hard to -----

MR. JUSTICE BELL: But then I would like you to concentrate on
those, rather than find one is steered off down a line of
questions about who did what. You did something similar,
if I can remind you, earlier in your cross-examination,
when you asked him about how he knew whether there were
lots of jobs available in Leicester. You have the answer
you wanted there; and I suggest you follow that course with
regard to something which you want to say to me in due
course was a sweeping statement which was not justified.
If there are a number you are unhappy about, then challenge
him and say: "How do you know that", and we will find out
if there is any basis for Mr. Stanton's assertions. But
take each of them head on, I suggest.

  MR. MORRIS: Right.

MR. JUSTICE BELL: Do you want the five-minute break now, so
that you can get that in order?

MR. MORRIS: We can carry on for a while.

  MR. JUSTICE BELL: Right.

MISS STEEL: (To the witness) I just want to ask you, in your
second statement -- perhaps you will want to get it?

MR. JUSTICE BELL: It is yellow X, Mr. Stanton.

  MISS STEEL: Tab 34.
       A. Thank you.

  Q. It is the second statement. You have given some
percentages of how much pay reviews were, performance
