Day 074 - 16 Jan 95 - Page 64

       A. No, sir, I do not. The one gentleman I remember, he
must be around 6 foot or something. He is a very tall
       gentleman.

  Q. The next step is this. If you have some specific incident,
conversation like that which you know that Mr. McIntyre is
going to speak to relating to Mr. Siddique, if you have,
you should put that to Mr. Siddique so he has got an
opportunity to give evidence about it. You may know of
some such particular incident; you may not.

MR. MORRIS: I have no idea if Mr. McIntyre has actually spoken
to Mr. Siddique. I only know what it says in the
       statement.

MR. JUSTICE BELL: Yes. You only know what is in the statement,
       do you?

MR. MORRIS: Yes, at this stage. I hope to speak to
       Mr. McIntyre on Wednesday morning.

MR. JUSTICE BELL: What are you doing at the moment on
       Wednesday, Mr. Siddique?

THE WITNESS: On Wednesday I can be available.

MR. JUSTICE BELL: Are we going to finish Mr. Siddique this
       afternoon?

MS. STEEL: We might overrun by half an hour or something like
       that.

MR. JUSTICE BELL: When you eventually leave the witness box,
having completed your evidence which may be tomorrow
morning, if not too late tomorrow morning, then it is
entirely a matter for Mr. Rampton or Mrs. Brinley-Codd but
you may be asked if you can come back and listen to
Mr. McIntyre's evidence or part of it on Wednesday. Do you
       understand?
       A. OK, my Lord, yes, I do.

MR. MORRIS: Maybe it is an idea if Mr. Siddique is going to
overrun for him to be recalled on Wednesday.

MR. JUSTICE BELL: No. Let us finish Mr. Siddique's evidence
because whatever Mr. McIntyre says Mr. Rampton may not want
to recall him. So, I do not want to put ourselves into a
position where he has to come back. You complete your
cross-examination of Mr. Siddique. If I can just make this
comment for the future. If you foresee the possibility
after a particular clash between two particular witnesses,
it may arise for all I know when we get to employment
witnesses, in so far as they have made general statements,
as Mr. McIntyre has, you have got to do your best to try to
find out before you cross-examine the relevant McDonald's
witness whether they have got specific incidents which they
are going to give evidence about.

MR. MORRIS: Most of our employment witnesses we have not even
spoken to them; five minutes on the phone or something.
