5 MR. JUSTICE BELL: That was the first, I thought. In fact,
6 I put a "1" on that, a "2" on the one we have just looked
7 at, and a "3" on "What is a union contract?"

9 MR. MORRIS: OK. Sorry. At the bottom of that first document
10 that we have looked at, document number 2 in fact, it has
11 got at the bottom: "Just the facts. Candid Cam", and a
12 signature. Was there a signature on that?
13 A. Yes.

15 Q. This is document number 1, "Who needs a union?" Can you
16 explain what this document is? I have the original here,
17 but I think it is the same. Can you what explain what this
18 document is and what was done with it?
19 A. This was put in the crew room during the campaign for
20 the vote, apparently, by the intervening employers against
21 the union; and along with it there was an invitation for
22 staff that wanted to go to Sabina Iurillo's house for a
23 pizza party. What happened, I attended that with
24 Courtney Gill; and what they did, they ordered pizzas, you
25 had pop -- it was all paid for, I do not know by who -- and
26 they went through the list on each side, disadvantages with
27 the union and your advantages with -- disadvantages with
28 the union and your advantages without a union -- saying
29 that McDonald's does not need a union. Each point that
30 they brought up, Courtney and I sort of gave them our
31 opinion, sort of refuted what they were saying almost on
32 every point.

34 Q. I have not got my notes. I probably gave them to someone
35 by mistake. Can you just have a look down both columns and
36 pick out any things which you feel are particularly
37 significant in this leaflet -- significant because they are
38 not true, or for some other reason?
39 A. The first one on "disadvantages with a union", "you
40 could end up making less than the minimum wage", that was
41 told to us by Cam on the October 5th meeting in the
42 (inaudible). "Promotions" -- on the same list
43 -- "promotions may not be based on seniority -- may be
44 based on seniority and not ability"; that is not true in
45 union contracts.

48 A. Ability is generally number 1 in union contracts.

50 Q. But seniority would be part of it?
51 A. Seniority would be part of it, but it would not be the
52 first reason.

54 Q. Any other comment, as you go down the list?
55 A. The second last one: Shop stewards are usually the
56 loudest union supporters and often get better treatment";
57 in fact, they actually get -- from what I have heard, they
58 can get worse treatment as well, because they are the most
59 pro-union people that fill out these forms, right.
