Day 169 - 04 Oct 95 - Page 51

MR. JUSTICE BELL: Just pause a moment.

MR. RAMPTON: My Lord, what I had in mind was -----

MR. MORRIS: Can I ask a question as well?

MR. RAMPTON: What I had mind was the second paragraph on page 4
       of Mr. Cranna's statement.

  MR. MORRIS: Mrs. French.

MR. JUSTICE BELL: Yes it is, on my copy of the fax it has
"page 02" in the bottom left-hand corner.

MR. RAMPTON: Yes, my Lord, that is right.

MR. JUSTICE BELL: I do think you should put the substance of
the second paragraph on that page because, granted, that
Mr. Cranna appears to have got his management the wrong way
round, it does appear to me that one of the two posts held
there was held by Mrs. French in the year in question. The
Area Supervisor is next above the Store Manager. What
Mr. Cranna refers to as Area Manager, I think he probably
means Senior Supervisor, which is higher above still. But
assuming that he has the titles of the post confused, that
is what it appears to me to cover on my reading of the
statement. If that is so, Mrs. French held one of those
posts at the relevant time. So it is only right to put
that to her. What I will do is I will take the five minute
break now and you can collect your thoughts about it.

MR. MORRIS: I would prefer to carry on actually.

MR. JUSTICE BELL: Would you? Fair enough.

MR. MORRIS: As long as the stenographer does not mind.

MR. JUSTICE BELL: No. We have had one or two pauses anyway.
If you want a break, say so. On the basis of that, I am
not going to force the pace. If we finish Mrs. French this
afternoon you can have tomorrow as a preparation day and we
should have no trouble dealing with Friday's witness. Do
you have anything to say about that, Mr. Rampton?

MR. RAMPTON: No, my Lord. Friday's witness, hypothetically at
       least, will be extremely short.

MR. JUSTICE BELL: It will give you more time to get ready for
       next week.

MR. MORRIS: (To the witness) You said in your statement that
sales and labour targets are projected by the Store Manager
on a weekly and monthly basis and not imposed from above as
Cranna suggests. When they are projected by the Store
Manager, that is done in consultation with people higher
up, whether it was yourself or whether it was a Supervisor?
       A. What, on a weekly basis?

  Q. You tell us; would it be on a weekly basis or a monthly
       basis?
