     1        document number 4 -- it said, if you remember in point 2 on
     2        that document 4, it said there would be a 40 per cent extra
     3        for night closers on the basic rate of 66.90 kroner.  Was
     4        that a general basic rate around that time, which would be
     5        the end of 1993?
     6        A.  That was the crew basic rate.

     8   Q.   66.90 kroner?
     9        A.  Yes.

    11   Q.   You remember that from your own experience; is that
    12        correct?
    13        A.  Yes.  I was a Floor Manager, so I had two kroner extra
    14        on top of that.

    16   Q.   Right.  So you had 68.90 kroner?
    17        A.  Yes.

    19   Q.   Now, the last document, which was document E in your
    20        appendices today, is a tariff regulations chart.  Do you
    21        have a copy of that?
    22        A.  No.

    24   Q.   Maybe it could be handed to the witness? (Handed)  Would
    25        that tariff be a tariff that applied at the time that the
    26        crew people at McDonald's were earning 66.90?
    27        A.  Yes.  That was the tariff that was put into effect when
    28        the collective agreement was reached.

    30   Q.   Right.  Where does it say on that particular tariff what
    31        would apply to McDonald's?
    32        A.  It says under "hotel and restaurant work".

    34   Q.   The bottom section of the first page?
    35        A.  Yes, that is the bottom section here.

    37   Q.   Whereabouts on that section is the relevant tariff?
    38        A.  It says beginner pay is 10,932.74 kroner a month, which
    39        translates to 70.99 an hour, while you would be working
    40        35.5 hour weeks; or 67.49 if you were working 37.5 hour
    41        weeks.  The problem here is that McDonald's has never
    42        recognised that McDonald's is a shift work environment, and

    46        A.  Yes, so -----

    48   Q.   So this applied to shift workers?
    49        A.  Yes, this 70.99.  So, consequently, they will not pay
    50        anyone, except those who work on Saturday night or Sunday 
    51        (which they have to), they will not pay anyone else by 
    52        these higher standards.

    54   Q.   Right.  So they are paying under the official tariff for
    55        shift workers?
    56        A.  Well, they believe McDonald's is not a shift work
    57        environment.
