Day 059 - 01 Dec 94 - Page 65

       A. "or duvets".

  Q. So one might have thought the inference is that it is
actually being recycled into such things.
       A. That is what it says, yes.

MR. RAMPTON: My Lord, I hesitate to interrupt, but one ought
perhaps to look at the previous sentence in fairness to the
witness: "To assess the potential of recycling foam
containers" which it calls a pilot scheme.

MR. JUSTICE BELL: I see that. I think it would be helpful if we
could find out just what is there.

MS. STEEL: I have a better copy here actually.

MR. JUSTICE BELL: Can you read it out slowly?

MS. STEEL: "We are currently running a pilot scheme at four
restaurants in the Nottingham area to assess the potential
of recycling foam containers. Customers are asked to
divide their waste, putting food remains and paper into one
bin and recyclable foam cartons into another - the aim
being that the foam is then collected for recycling into
such things as plant pots, coat hangers and insulation
material for use in homes, even fillings for duvets". Is
there any part of that that you want me to read?

  MR. JUSTICE BELL: No.

MS. STEEL: A customer reading that would think, would they
not, that McDonald's was taking this seriously and was not
actually engaged in some kind of recycling, be it a pilot
       scheme?
       A. It does say "the aim being" very clearly. It does not
say it is actually being done.

  Q. No, but it does not say it is actually not being done
       though, does it?
       A. It says "the aim being".

MR. JUSTICE BELL: That "The foam is then collected for
recycling into such things as" and they are listed. There
we are. I will draw my own conclusion about it. Do you
actually know what happened to the waste from these bins
which it looks, broadly speaking, was half polystyrene and
       half something else altogether?
       A. I do not actually know. I would imagine the exercise
took place as a customer exercise and whatever was
collected in whatever form was then disposed of, because
there was no infrastructure to deal with any separated
       materials.

  Q. There is no suggestion then that the polystyrene was
separated out and put in some store against the day when
       there would be an infrastructure?
       A. No.

  Q. It was dumped somewhere?
       A. That is right. As far as I am aware, that is correct
