1 MR. MORRIS: Let us assume there are breaches on that
documents. If there are breaches of regulations that have
2 been pointed out, you have already said that breaches are
not monitored on a national scale, but if it is found
3 there is a breach, would there be some action taken
              against a manager?
4 A. In the full field process, the auditing process, the
work practices of every store are examined. If they are
5 found to be wrong, they will be fixed. It may involve
counselling the manager. It may involve dismissing a
6 manager. It may involve total re-adjustment of their
systems and procedures. But we are not going to tolerate,
7 nor have ever demonstrated toleration passively of
management in restaurants improperly treating their people
     8 or breaking the law.

9 Q. So let us say, for example, there was a breach that took
place then and it has only luckily come to light because
10 we have a witness on this, but what would be the response
to a manager that had clearly broken the law there?
11 A. Are you saying the guy did once in three years, 12
              months? What is the circumstance?
    12
         Q. That is the only store where we have the info. That was
13 just an example and it was by coincidence there happened
to be three breaches of law, as we are alleging, on one
    14 sheet of paper?
              A. If someone did it, I am sure we would counsel him or
    15 her.

16 Q. What happened if they done it again?
              A. We would probably council them again.
    17
         Q. What happens if they done it again?
18 A. They would probably lose their job.

19 Q. So you do take it seriously?
              A. I have said that now three or four times, yes.
    20
         Q. Look at document 12, it is 46?
    21 A. 46, yes.

    22 Q. No. 710?
              A. Yes.
    23
         Q. This is a report which you receive every fortnight about
24 people that have worked over 96 hours?
              A. Yes.
    25
         Q. The company policy was identified, was it not, as 39 hours
    26 a week maximum?
              A. Yes.
    27
         Q. So if someone worked 96 hours they have averaged 48 hours
    28 per week?
              A. That is correct.
    29
         Q. Over the policy.
    30
MR. JUSTICE BELL: Can we just see?
