Day 292 - 01 Nov 96 - Page 42

got a suggestion to make to you. If I may say so, when you
gave the overview you went through making your main points
in relation to the areas which you say are irrelevant in
this part of the case. From my point of view, all you need
to do now is just point me in the direction of any
particular facts which you think are particularly
important, and what the nature of the evidence was in
relation to it. That is what will help me. Quite frankly,
I think you can probably do it fairly quickly, and you
shall not be anxious, as I know you were in
cross-examination, about having absolutely every imaginable
point. What I want you to do is -----

MR. MORRIS: If I could get something photocopied. I have some
       notes here.

MR. JUSTICE BELL: I will break off until a quarter past three,
I want you to get focused on-----

MR. MORRIS: I don't mind giving you a copy of my note.
Although you probably cannot read my handwriting, you will
be able to read the actual references in numbers, which
would save time, because as long as people do not mind
       having my handwritten notes.

MR. JUSTICE BELL: How many sheets are there?

  MR. MORRIS: It is four.

MR JUSTICE BELL: I will break off for 10 minutes. We will
arrange some copies. What I will also hand down, so I do
not forget later, is the photocopy of that part of Polly
Peck which I photographed for my own interest, which
happens to be pages 1032 to 1034. It is the last two pages
       of Lord Justice O'Connor's judgment.

                        (Short Adjournment)

MR. MORRIS: I have just got the material back. I am just
checking that it is done right. It seems that some of it
might not have been done properly. I am not criticising,
but the back pages are done where I have got different
       notes.

MS. STEEL: Which is not what was supposed to be handed up.

MR. JUSTICE BELL: Is there anything here you do not want me to
have? The first page starts "packing" and has 59 and 60.
Then packaging notes Oakley, 60. Then a note of your own,
       check notebooks of Mallinson. (Pause)

MR. MORRIS: Yes, it does not matter. I mean, people should
bear if mind that, you know, they are personal notes and
       stuff.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: And, you know, the main thing is the references.

  MR. JUSTICE BELL: Thank you.
