Day 134 - 13 Jun 95 - Page 77

  Q. Would that be about right?
       A. That would be about right, yes.

  Q. Would that remain so even if it is a much bigger
       restaurant?
       A. If it is a much bigger restaurant there might be four
people perhaps and again they do not always do that.

  Q. Slightly more people to do the bits and pieces?
       A. Yes.

  Q. My question is really this, and again if you do not know
please say so because it is important you do not
speculate. If it is roughly 5 per cent that ever worked
the premium rate, from your knowledge of company's wage
policy, do you think that the removal of that additional
payment for the night shift made any significant
contribution to saving of payroll costs by the Company?
       A. As you will have observed here arithmetic is not my
strongest point, but it would seem to me that it be
statistically invisible, or whatever the term should be,
again at this late point in the day, so, no, I think it
       would be highly insignificant.

  Q. We can perhaps all do the arithmetic in due course. Thank
you very much, Ms. Mead. May Ms. Mead be released now, my
       Lord.

MR. JUSTICE BELL: Yes certainly. Thank you.

                      (The witness withdrew).

MR. JUSTICE BELL: We will adjourn now and resume at 10.30 on
       Thursday.

MR. RAMPTON: Your Lordship does not wish us to do any
       interlocutory work tomorrow?

MR. JUSTICE BELL: No, because as I understand it, Mr. Morris
and Ms. Steel, you do not want to do interlocutory matters
       tomorrow?

  MR. MORRIS: No.

MR. JUSTICE BELL: It would seem to me sensible, and we should
talk about this perhaps on Thursday or Friday if we have
time, if we can deal with interlocutory matters after
       Mr. Sexton.

MR. RAMPTON: Would it help your Lordship if I now handed in a
list which we have made of the things which we believe we
need attention to on our behalf?

MR. JUSTICE BELL: Yes, that would be very helpful and you have
       a copy for the Defendants?

MR. RAMPTON: I have copies for the Defendants.
Mrs. Brinley-Codd has also written out her list of those.
She believes that the Defendant's employment witnesses have
