3 Q. Will you turn to tab 7 in your file at page 122? Here we
see a letter addressed to you from the State of New York's
4 Department of Law dated 13th April 1987. It comes from a
lady called Sara Nathan, who describes herself as an
5 assistant Attorney General in the state of New York. The
attorney general is a gentleman called Robert Abrams, is
6 that correct?
A. Yes, that is correct.

Q. Or was at that time. It reads: "Dear Mr. Horwitz,

We are extremely disturbed by the current advertising
9 campaign being conducted by McDonald's. We believe that
the public may be seriously mislead by statements and
10 representations in the advertisements.
11 We would appreciate the opportunity to discuss this matter
with you at our offices on April 27th, 1987 at 11.00
12 a.m.. Prior to that time, please arrange for a full set
of all advertisements ... to be delivered to me. (Please
13 note that television advertisement should be in VHS
format)". Were any of these advertisements put on
14 television, do you know?
A. I am trying to recall -- just bear with me for a
15 moment -- I just do not recall. I believe they were but
I am not positive.

Q. Two questions, Mr. Horwitz. Did you go to a meeting at the
17 offices in Albany -- this is in ----?
A. This would have been in the City of New York.

Q. This is 120 Broadway, New York City?
19 A. Yes.
20 Q. Did you go to a meeting there on 27th April?
A. I did attend a meeting there. I do not recall the
21 exact date I attended.
22 Q. Second, at this date, April 13th 1987, had you had any
indication from the Attorney General of New York that he
23 was concerned by the advertising campaign?
A. Up to this point in time, no.

Q. No indication at this date?
25 A. No, this was a surprise.
26 Q. It came as a surprise?
A. Yes.

Q. Please turn over the page. This is a McDonald's document;
28 it says: "This is the letter from Jim Mattox, Attorney
General for the State of Texas and it was released today,
29 April 24th, 1987." I do not want to read it out. Can
you run your eye through it and tell me when you have
30 finished?
A. Yes.
