     2        will be disclosed in due course, certainly during the
     3        course of this week.

     5        The Costa Rica documents I have dealt with and also the
     6        early United States beef specifications.  By chance
     7        Mr. Walker came up with two and we have already disclosed
     8        one from what we think might be 1967.  Germany and Gunther
     9        Walraff which is one of the outstanding things.  What
    10        Brinley-Codd has done is to go through the transcript of
    11        the hearing on day 70, as Mr. Morris was demanding that she
    12        should and she has done it.  This is the fruit of her
    13        search.  The Gunther Walraff papers, your Lordship will
    14        remember that he was the subject of court proceedings by
    15        McDonald's on the grounds of something similar to
    16        defamation.  I believe the other place Mr. Hill has been to
    17        as well as Costa Rica is Germany.  What he has discovered
    18        is that we have disclosed the court order, the formal
    19        judgment, but that there had been appended to it the actual
    20        written judgment, in other words, what the judge says as
    21        opposed to the order, which when Mr. Nicholson had made
    22        enquiry previously the Germans had not understood was
    23        required, partly I think because the lawyer who was
    24        handling the case was an outside lawyer who died some time
    25        ago.  Anyhow, that is now in our possession in England and
    26        will be disclosed in due course.

    28        Then, my Lord, on recycling and waste there were, and
    29        I think it is page 725 of pink volume V, some documents
    30        referred to as being in a McDonald's library.  I do not
    31        know whether in your Lordship remembers?

    33   MR. JUSTICE BELL:  I do.  Mr. Morris raised them.  One included
    34        the Swiss survey.

    38   MR. JUSTICE BELL:  One was the Swiss survey, but the others
    39        might have been relevant as well, although Mr. Morris was
    40        only interested in about four of them.

    42   MR. RAMPTON:  Yes.  I think it was documents 1, 2, 5 and 11.  In
    43        fact, all those documents are not as we had originally
    44        believed with McDonald's in this country.  They are with
    45        McDonald's in Europe.  It is thought that the probable site
    46        for them is Germany.  So we are asking the Germans to
    47        secure copies of those documents, if they still have them.

    49        Your Lordship will also remember that I think it was on
    50        pages 22 to 23 of the transcript for that day, Mr. Van Erp 
    51        mentioned a UK report and review of packaging for 1990.  We 
    52        have now been sent that.  We were sent that I think last 
    53        week or maybe the week before.  Its contents were reviewed
    54        by Mrs. Brinley-Codd and Mr. Atkinson.  Their joint view is
    55        that it contains no relevant material whatsoever and,
    56        therefore, it will not be disclosed.  It may be helpful if
    57        I do this because then the Defendants can come back to
    58        anything they do not like.
