Day 118 - 01 May 95 - Page 34

       A. Yes, that one.

  Q. How do the Head Office staff know about who is working over
39 hours in any individual week?

MR. JUSTICE BELL: Do they, first of all?
       A. Well, I am sure the supervisors on their visits -- you
       see, supervisors -----

  Q. It is Head Office, you see?
       A. Not Head Office, no. The Field Personnel officers
might because they visit the stores regularly and that is
one of the things they look at. The supervisors will
because they visit the stores regularly. Head Office will
not know until that return comes out.

MS. STEEL: Right. They still will not know when that return
comes in because it is only fortnightly?
       A. Fortnightly, yes.

  Q. So they cannot actually tell, unless people have worked
over 39 hours for two weeks running -----
       A. Head office staff, no. Head Office staff have those
figures in front of them once a fortnight, those people at
Head Office who are concerned with wages.

  Q. Nobody is in a position at Head Office to check on who is
working over 39 hours each week as opposed to ---
       A. Each fortnight.

  Q. -- fortnight?
       A. No, that is right.

  Q. Nobody in the Head Office would know which under 18
year-olds were working more than 48 hours in a week, would
they if it was more than one week running because they only
       get fortnightly figures again?
       A. Yes. It is very difficult when you say "nobody at Head
Office" because all of the operations and supervisory staff
are at Head Office and they will know. When you talk about
        -----

  Q. What figures do they get?
       A. Those figures.

  Q. They are fortnightly figures?
       A. But they also visit the stores and they will get
reports from the supervisors who visit the stores.

  Q. So what figures do they see when they visit the stores?
       A. They will see the schedules.

  Q. So they would have to check through all the schedules by
       hand ---
       A. Oh -----

  Q. -- and compare them with the actual hours that were worked,
in fact, as opposed to just what the schedule -----
       A. They probably do.
