Day 001 - 28 Jun 94 - Page 65

1 as the documents are concerned, if you cannot get them all
organised, at least get yourself organised so far as the
2 documents which are required for cross-examining
Mr. Preston in so far as you can do at this stage, when we
3 have not had all the pleadings completed in relation to
the counterclaim, because you want to reserve any
4 cross-examination in relation to that until later.

5 You will have your documents ready in so far as you need
them for cross-examining Mr. Beavers. For reasons which
6 are quite beyond my control, I cannot sit late on Friday.
I cannot sit on indefinitely, much as I would like to help
7 Mr. Beavers if he wants to get back to the States on
Friday evening. So he is being placed at the end of the
8 first week which is always a perilous time in long trial.
              We will have to see.
     9
MR. RAMPTON: That is because I anticipate that he might end.
10 I do not believe his evidence-in-chief will be more than
about three-quarters of an hour. If your Lordship reads
11 his statement, it is very short.

12 MR. JUSTICE BELL: I am just pointing out that you are at risk
in so far as finishing Mr. Beavers.
    13
MISS STEEL: Thank you. That was very helpful. Can I
14 just object to some of the comments that Mr. Rampton
made. We are actually lucky if we get four or five hours
    15 sleep at night.

16 MR. JUSTICE BELL: I do not think you should because I have put
them on one side and they have not affected my decision at
    17 all..

18 MISS STEEL: It is just it is somewhat offensive to be accused
of not getting on with work.
    19
MR. JUSTICE BELL: I have not taken it into account in any
20 way. If you concentrate on getting ready for your
openings first of all. Then you will have any time which
21 is left tomorrow and Thursday morning to get your
documents ready for Mr. Preston and Mr. Beavers.
    22
         MISS STEEL: Thank you.
