3 Q. When illegalities are being discovered to be happening
4 within stores, as they are, as they are discovered --
5 obviously this is a case where one example -----
6 A. But I do not know what he means by "illegalities".

8 Q. Let us just assume that something illegal has happened,
9 yes, infringement of legalities, OK; is there some kind of
10 system for monitoring and co-ordinating that information
11 from around the country to try to identify if there are
12 illegalities happening on a wide scale or if there are
13 specific illegalities that are cropping up fairly
14 regularly?
15 A. If illegalities are occurring and coming to attention,
16 that would require an incident report form to be filled
17 out. That would then go to each regional office where it
18 would be recorded on computer. Then the department
19 responsible for whatever this illegality is would be asked
20 to enquire into the circumstances. In that sense, they are
21 recorded.

23 Whether or not anyone is looking at them to see whether a
24 pattern develops, I would say that depends upon what the
25 illegality is. If it is employment law, it would be the
26 Personnel Department or the Human Resource Department. If
27 it was incidence of crime, it would be the Security
28 Department. It depends upon what it is -- and I do not
29 know what that is.

31 Q. The only thing I can immediately think of is that in the
32 two pages previous upon 1804, that came up under the
33 heading of Personnel regarding no-shows and lateness?
34 A. Well, I cannot think of anything that could be illegal
35 about -----

42 MR. JUSTICE BELL: Let us just suppose it was someone
43 contravening some rule or regulation with regard to
44 employment, a young person working too late or too many
45 hours. You are being asked whether there is any Head
46 Office monitoring.
47 A. No. I would say -- there is recording but monitoring,
48 it is left to the department responsible for whatever the
49 alleged illegality is to monitor it. It is recorded.

51 MR. MORRIS: What I mean by "monitoring" is not the individual
52 case being monitored, but the Company as a responsible
53 company ---
54 A. Yes, that is often done.

57 A. It would be left to the department who is responsible
58 for that aspect.
