Day 120 - 03 May 95 - Page 55

had and against our projected top line sales left us with a
crew payroll of 14.8 per cent or 81,162,000. That was what
       they budgeted.

  Q. That was the plan?
       A. Mmm.

  Q. Right. It is a funny thing, is it not, if we look at the
management labour No. 24, we can see that the actual spend
as a percentage of sales for management for 1991 was 4.91
per cent, but the plan was to increase the management
percentage of labour costs as to sales to 5.07 per cent; so
how do you account for the intention of the Company to
reduce the crew labour percentage remuneration but to
       increase the management percentage?
       A. Well, without the figures in front of me, I cannot tell
you, but I imagine that when they have budgeted, they have
calculated the number of stores they have had, they have
calculated how many management they need and that has
       brought those variations about.

  Q. Do you know what the average hours worked are by McDonald's
       part-time staff, approximately?
       A. I have not seen the figures for some years. I think
the average was running at about 22 -- it is a figure I
       remember.

  Q. 22 hours?
       A. I mean, that figure was available to me but I have not
seen those figures for four years.

  Q. If you remember, was that for all staff, included all
staff, or was that just for the part-time staff?
       A. No, I think part-time workers were averaging somewhere
round about 20. I remember seeing that somewhere.

  Q. To be honest, I think I have seen something like that but
       I cannot remember where.
       A. No, I do remember reading somewhere that it was round
about -- but it is four years ago, and that figure will
move a little year by year.

  Q. Did you enquire or look into what the category "occasional
       workers" meant?
       A. No, I have not had the opportunity. I am not allowed
to discuss my evidence with anyone until I have finished
       giving it.

MS. STEEL: Do you remember the Guardian article that you took
legal action over about workers' employment conditions ---
       A. Yes.

  Q. -- and pay and things like that? Do you remember the
       article?
       A. Yes.

  Q. After that article appeared, did your Department send out a
memo saying that under no circumstances could the branches
make employees work on their day off or for longer hours
       than they were supposed to?
