Day 152 - 11 Jul 95 - Page 72

       A. That would be ----

  Q. That is the sort of thing which would happen from time to
       time.
       A. That could happen, yes. So, for instance, if they
phoned up at the beginning of the week, said they had been
to the doctor and are going to be off sick for the week,
then you would cross off their hours on the schedule and
then try and replace them with somebody else.

MS. STEEL: At the end of the four there is a column, there are
columns for the total hours scheduled in -- total hours
scheduled this week, total hours worked in excess of
scheduled, total hours in excess of previously worked
       during the year?
       A. Yes.

  Q. Number of Sundays worked in excess of four hours this
month. Are they all -- they are all standard columns that
ought to be filled in, are they?
       A. That is right, yes.

MR. MORRIS: Just while we are on this particular form, we have
had evidence in the case already that this form shows that
three of the people on that sheet out of about, whatever it
is, 20, were working illegal hours as under 18s. I think
there has been an admission by McDonald's on that. Do you
recall memos or a new set of instructions about the illegal
hours, about the Company being fined for working under 18s
       illegal hours?
       A. No, I do not.

  Q. Would you remember, if you did see anything written down
about that, was sent to you? You started up as a, you
started up in a management position, did you not?
       A. I certainly did, yes.

  Q. That was in, just to refresh my memory, 82?
       A. If I received a memo such as that at the time I would
have remembered it at the time. What I am saying is that
now, ten to 12 years later, I do not remember such a memo.
What I do know is that the Company paid a lot of attention
to ensure that crew members did not work over and above
what the regulations and the law stipulated. So there was
a lot of attention to making sure that under 18s did not
work past 10 o'clock if they were female and past
12 o'clock if they were male.

  Q. Are you aware that, now, are you aware that the Company was
fined for a number of infringements of those laws in 1982
and 1984 just before the period that we are talking about
       in Colchester 86/87?
       A. I was not aware then. The first time I became aware of
it was when you cross-examined Frank Stanton yesterday.
That is the first time I have heard such an example.
However, I was aware the Company took its responsibilities
       in this area very seriously.

  Q. Simon Gidney you said was a very good worker?
       A. Yes.
