Day 043 - 01 Nov 94 - Page 72

MR. JUSTICE BELL: The "received" stamp in the top right-hand
corner is a date early in December; it is "DEC 0",
something which I cannot read, legal department?
       A. No.

  Q. Is that right or is the legal department stamp something
       different?
       A. To the best of my recollection, this is just a stamp
that when something is received at any office at Leo
Burnett they stamp when it comes in.

MR. RAMPTON: What his Lordship is, I think, looking at which
       I completely missed -----

MR. JUSTICE BELL: I have only just noticed it which is why I
       have raised it.

MR. RAMPTON: I can hardly read it but over the words "Leo
Burnett USA", which are the last words on that line, are
stamped the words "Legal department" and beneath that a
       number. Do you see that?
       A. Yes, I think it is separate from the initial stamp. It
looks like it is different. I do not have any idea whether
that is Leo Burnett or McDonald's.

  Q. Can you tell us (because if you cannot, I can) who Kevin
       McAnaney is?
       A. It seems to me that those are lawyers in the McDonald's
       legal department.

  Q. In fact, I think at that time Kevin McAnaney was an
attorney at Dewey Ballantyne, your outside lawyers. Do you
       remember that?
       A. I do not remember the name but Dave W, I do remember.

  Q. Who is that?
       A. That might be Dave Weidenfeld.

  Q. He was at the time an internal lawyer at McDonald's?
       A. Yes.

MR. RAMPTON: My Lord, those are all the questions I have to ask
       Mr. Green in-chief.

MR. JUSTICE BELL: Yes, thank you. Do you know why it should go
or a copy should go to the legal department?
       A. Of McDonald's or any other legal department?

  Q. Yes.
       A. Again, I believe that because this was an issue that
had significant governmental interest from the point of
view of how you advertise ingredients of food and food
advertising, that they would want to take a look at it and
that we would want to make sure that it complied with any
regulations that were in force at that time.

It is my specific remembrance that charts themselves had to
follow a particular format, and that if you used certain
words, then that would trigger that you would have to have
some other things that would be in the ad. So, we wanted
