Day 130 - 26 May 95 - Page 41

MR. MORRIS: She does not appear at all for three and a half
years, and when she appears again, that is between 1.8.87
and 26th January 1991, when she came back she came back as
a Floor Manager. We do not know, maybe she went and got
training in other stores, other whatever, or maybe she went
to college. We do not know if she left at all no -----

MR. JUSTICE BELL: It does not matter. She appeared six times
I think in 1992. Where are you going from this?

MR. MORRIS: We are just trying to get a bit of a picture really
of if she is someone who is maybe fairly diligent.

MR. JUSTICE BELL: Do ask Mrs. Barnes if it is vital you ask
her, otherwise you can put the picture to me. You can give
me a thumbnail sketch of what you, statistically, as it
       were, gain from this.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Have you finished the Colchester accident.

MR. MORRIS: I have finished those specific documents yes.

MR. JUSTICE BELL: How are you doing?

MR. MORRIS: I think we should finish today.

MR. JUSTICE BELL: It is not a question of "should", you must
finish today. You must complete your cross-examination
today and so must Ms. Steel, though I think she has done
that. With this rider only, that if there is any document
which you have not had an opportunity to read, which has
yet to be discovered and where in the future you can tell
me: "I want to ask about this. I need to ask about this".
Then I will consider that and decide whether Mrs. Barnes
must be recalled. You have ample opportunity today to put
anything you wish to put to Mrs. Barnes. Ms. Steel had a
day, and then the second, if she wished to do so. I am
going to restrict your cross-examination to the remainder
of this afternoon. It is not being unfair on you. You
will have had, between you, over two days to cross-examine
her. I invite you to think between now and 2 o'clock how
best you can get what you need to ask into the afternoon,
so that at 4 o'clock, or shortly, thereafter I can give
Mr. Rampton the opportunity to re-examine.

If you just spend a little bit of the midday adjournment
thinking about that, and concentrating on which is
important, what can be left for comment and how best you
can take the matter, I am confident you will be able to ask
anything you need to ask. I am saying that now, so that
there is no surprise about the course I am going to take.
We will break now and come back at 2 o'clock.

                      (Luncheon Adjournment).

MS. STEEL: I just wanted to ask something briefly about the
statistics at tab 57M, the first page, you have got total
       numbers for -----
