Day 306 - 26 Nov 96 - Page 15

so far as publication is concerned. It is quite right,
when I originally said -- not on the Monday before last, or
rather the Monday before that, I think it may even have
been the Monday before that -- how many days you had for
each, I may well have said something about if you took less
on one topic that would give you time to take more on
another. Certainly, I said something to that effect at
some stage. But that only makes sense if you have some
idea yourself how you were going to go about things.

So, what I am going to do is rise for five minutes. If you
ask me in a moment not to come back until quarter past
twelve, I will readily do that, but when I do come back I
want you to tell me how you propose to set about the rest
of what you have to say on publication, and all that you
have to say in relation to counterclaim, subject to
anything which you anticipate you may put in written form
to be delivered by midday on Wednesday 18th. But I want
you to tell me how you would propose to set about saying
the rest of what you have to say about publication, and
anything which you wish to say on the counterclaim so as to
finish by the midday adjournment on Thursday, so I can do
what I firmly intend to do, which is hear what Mr. Rampton
wants to say by way of introduction to his written
       submissions on Thursday afternoon.

Now, how long do you want to talk that over between you?

MS. STEEL: If we had a couple of extra minutes, or something.

MR. JUSTICE BELL: Yes, I will come back just after quarter
       past.

                        (Short Adjournment)

MS. STEEL: Mr. Morris is going to carry on for now, then I am
going to move on to 16th October. Some other bits and
pieces that I have got to finish off after that, and we do
expect to be finished on publication this afternoon and
then to move on to the counterclaim. I mean, if there is
time this afternoon; if not, first thing tomorrow morning.

MR. JUSTICE BELL: I will allow you to go on with publication
now. You anticipate finishing this afternoon, but you must
       finish this afternoon.

  MS. STEEL: Right.

MR. JUSTICE BELL: And that will leave you one and a half days,
which should be enough, after all, it is between six and
seven hours in actual fact, to deal with counterclaim, but
you must finish what you have to say on counterclaim by one
       o'clock on Thursday.

MR. MORRIS: Just a couple of points. I think Brian Bishop did
not leave me out of his notes of 20th September, but I have
got a note saying that... I think I did refer to it, that
he originally was saying that he could only remember me at
one meeting. So any impressions that he was giving were
based upon his recollection based upon one meeting, but in
