Day 053 - 22 Nov 94 - Page 39

MR. JUSTICE BELL: Yes. That is why I think it must have either
been a slip of the tongue of mine or a mis-transcription
that I would ever have actually said "unsaturated fat" in
       that context.

MR. MORRIS: But it is quoting from Mr. Rampton.

MR. RAMPTON: It is supposed to be.

MS. STEEL: I am quite happy to show where Mr. Rampton talked
about unsaturated fat. If you look at 16th December,
page 27, opposite B, Mr. Rampton said: "The relationship
between a diet high in unsaturated or total fat" -- this
relates to what subject Mr. Rampton wants to adduce
       additional expert evidence on.

MR. RAMPTON: My Lord, I believe, and I am going to check it,
that that, too, is a misprint or a slip of a tongue by me.
No, it is not a matter for hilarity. This is a serious
       case.

MR. JUSTICE BELL: It is a serious case. Quite frankly, I will
have removed from court anyone on either side who laughs
out loud, either in relation to a point which Ms. Steel
makes, Mr. Morris makes or Mr. Rampton makes, and they will
       not come back.

This case has been conducted with a great deal of dignity
by Ms. Steel and Mr. Morris, and it does not help if those
behind them do that sort of thing.

MR. RAMPTON: While I am on my feet, I might urge the fan club
to restrain themselves from reporting this case in a way
       that is a travesty -----

MR. JUSTICE BELL: That is an antagonistic remark, as well,
       Mr. Rampton.

What I am trying to say -- and of course I cannot
categorically say one way or another now -- is that I am
surprised if I just took the quote on 21st December --
which is, in my judgment, is it not -- from a transcript on
16th December, thinking that "high in unsaturated fat" was
       important.

MR. RAMPTON: All I was going to say is that I would be
       surprised if I had, too.

MR. JUSTICE BELL: You have never thought that "high in
unsaturated fat" was significant in this case, and I never
       have -- not unsaturated fat.

MS. STEEL: If it is any help, I think I just referred to
       page 27B on 16th December.

  MR. JUSTICE BELL: Yes.

MS. STEEL: There is also another quote by Mr. Rampton, in fact
       two quotes, on page 23E:
