Day 193 - 28 Nov 95 - Page 40

MR. RAMPTON: My Lord, does it matter what opinion she has about
this?

MR. MORRIS: -- have a right to be represented by a union?

MR. JUSTICE BELL: It does not matter, quite frankly, what Miss
Inglis thinks because she is not an expert witness. She is
called as a factual witness, and there is no way she can
qualify under our laws as an expert witness.

MR. MORRIS: No further questions. Thank you very much.

MR. JUSTICE BELL: (To the witness): You may not be able to
help me, but I am not asking you to say any of the names of
the 67 people who signed cards or who were said to have
signed cards, but do you, in fact, know the names of all or
nearly all of them?
A. Yes.

Q. What sort of proportion of them, and take a bit of time to
think if you wish, would be your age or 16 or younger?
A. My age or 16 or younger, or are you talking about the
under 18s?

Q. 16 years of age. If you had asked them, "How old are you?"
would have said 16, 15 or 14? That is at the beginning of
October, by the beginning of October 1993.
A. I cannot be sure, but I would imagine that would be the
majority of workers there.

Q. Can you keep your voice up.
A. I cannot say for sure, but I believe that would be the
majority of workers there were in the ages of 14 to 16ish.

MR. MORRIS: Can I say -----

MR. JUSTICE BELL: No, just pause a moment. I will allow you to
ask any questions you want to ask after I have asked my
questions.

MR. MORRIS: There is a document on that.

MR. JUSTICE BELL: Yes, maybe, but just leave it for a moment.
(To the witness): Can you help as to what proportion of
those signed were 14ish to 16ish, 14 to 16ish?
A. Proportion, like you want numbers?

Q. Of the 67 - a majority of those or less than half of those
or about half?
A. A majority.

Q. The other matter is this. Although I have just said that
I cannot treat you as an expert, you may be able to help on
this -- if you cannot, just say so -- do you know whether
there is any provision in any of the labour legislation for
people being able to call for their union cards back within
a certain period of time, or at all?
A. No, I do not know of one.
