1 from here as my responsibility to oversee it.
2 Q. So which body in the States?
A. Well, there just as here.
3
Q. Which corporation made the decision to sue?
4 A. I am not sure it was a body so much as it was a
person; ultimately there, just like here, the-----
5
Q. Which person does that mean?
6 A. The decision authority to go forward on a matter like
this will rest with the Chief Executive, Michael Quinlan.
7
Q. He was responsible for bringing this action?
8 A. He is responsible for the activities of the entire
corporation.
9
Q. Yes. We are talking about who decided for the corporation
10 to bring this case? Who made that decision? Which
individual or which body made that decision?
11 A. I do not know. Ultimately Mike Quinlan will be the
one who does as the chief executive of the company;
12 whether he discussed it with the parent corporations
board, whether he took outside counsel, whether other
13 people were involved I have no way of knowing. I know
what took place regarding the British company, the members
14 of its board who are also in four persons -- excuse me,
now three persons -- Mr. Newman is deceased -- three
15 persons related to their position as it related to the
subject document, and I took my instructions from my
16 board. That is to whom I am ultimately responsible; the
board of directors of the British company.
17
Q. But the decision to bring the case against the defendants
18 was your personal decision?
A. Yes.
19
Q. You said before, did you not, that for all the court cases
20 it has to go through you?
A. I said that any time we go to court I would be the
21 person who finally says: "Yes, we do" or "No, we do not".
22 Q. You have to be satisfied, do you not, that you should go
to court?
23 A. Let me assure you, I do no not take these matters
lightly.
24
Q. When a case is progressing, do you oversee the case?
25 Obviously, you may not have attended yourself but do you
get reports back and oversee how the case is progressing?
26 A. It depends what it is; sometimes I do, sometimes I do
not.
27
Q. If it is an important case?
28 A. I get regular reports of what is happening to us on
most fronts within the United Kingdom.
29
Q. Have you ever stopped a case while it was happening?
30 A. I do not think so. I think that is probably due to
taking great pains to be sure that before we take the
