Day 167 - 02 Oct 95 - Page 28

       A. But, you know -----

  Q. If it is the case (and we have heard evidence) that five
per cent of all staff approximately every week are working
over 39 hours, at least five per cent, and that would
translate as something like 25 per cent of all full-timers
are working over 39 hours, something like that, i.e. 25 per
cent of full-timers are every week breaking the policy of
the Company, is that not something that would have got back
       to you?
       A. Well, I am not sure that the fact -- those figures are
accurate. I have not heard those figures. I am sure that
there are people who do work more than 39 hours in the
       Company -- I certain do.

  Q. I am talking about crew.
       A. Well, also some crew, I am sure, do -- willingly as
well. What we would have recommended in that situation is
that there comes a time when people do not become effective
because they get tired, and so they should not work, but
that, you know, 39, it may be 35 for some, it may be 45 for
others, but 39 was a figure that the Company had given as a
       guideline.

  Q. So it does not matter to you if the policies of the Company
       are broken?

MR. JUSTICE BELL: Look, try to stick to what Mr. Tindale can
       help us about.

MR. MORRIS: He is in charge of training and -----

MR. JUSTICE BELL: Yes, I know. Do not ask whether it matters
to him; it is whether it matters to me at the end of the
       day which counts.

MR. MORRIS (To the witness): But that is something that did not
get fed back in your meetings with Operations; that was not
       an issue that came up?
       A. No, not to my specific knowledge.

MR. JUSTICE BELL: It is five to one. Let us think about what
our timetable is from now on.

MR. MORRIS: We are close to finish.

MR. JUSTICE BELL (To the witness): Sit down for a moment,
       Mr. Tindale.

MR. MORRIS: We are close to finish but I do not think we will
finish by 1.00, so if we could have the break that would be
       appreciated.

MR. JUSTICE BELL: Yes, what I think we should do is come back
at 2 o'clock, finish Mr. Tindale, then, unless anyone has a
contrary suggestion, we will have your discussion with
Mr. Atkinson. I would like you to spend a bit of the
mid-day break thinking just what you want to put to
Mr. Atkinson so you have yourself organised on that.
