     2        followed.  If it is your case that it is not followed then
     3        it is essential that you put it.

     7   MR. JUSTICE BELL:  What it does not advance is asking what the
     8        grievance procedure is when he has already told us, do you
     9        understand?

    11   MR. MORRIS:  So, Mr. Nicholson, that grievance procedure, is
    12        that followed in all cases?  That is the procedure that
    13        would be used for all cases, is it?
    14        A.  I think it is followed.  I think it works.  I cannot
    15        say it is followed in all cases because I do not know all
    16        cases and I can only talk on what I know about in so far as
    17        I am concerned that the grievance procedure is used, is
    18        followed and is successful.

    20   Q.   What I am saying is, I thought that only applied to
    21        individual grievances, but does that apply also to if, say,
    22        five members of staff are concerned about the safety of a
    23        particular machine, the manager has not dealt with it
    24        properly ----
    25        A.  Absolutely.

    27   Q.   --- they would then go to the next person up?
    28        A.  Yes.

    30   Q.   If they were not satisfied to that, they would go to the
    31        next?
    32        A.  Yes.  In that particular case there would be a sideways
    33        move.  They could go to the health and safety officer.  It
    34        is open to them all the way through.  If it was something
    35        as serious as a piece of electrical equipment which was not
    36        working and they had brought it to the attention of the
    37        manager and the manager did nothing about it, I would be
    38        most surprised if someone was not on the phone to Jill
    39        Barnes or indeed any senior member of the company.

    41   MR. JUSTICE BELL:  While I am looking at page 151, when you
    42        talked about the supervisor who has responsibility for
    43        three restaurants ----
    44        A.  Three restaurants.

    46   Q.   What is his or her full title because 151 refers to
    47        Operations Supervisor and Senior Supervisor?
    48        A.  Right, my Lord.  The Operations Supervisor is the
    49        supervisor that is the person who will have the
    50        responsibility for three or four restaurants.  The Senior 
    51        Supervisor has now ceased to exist.

    53   MR. JUSTICE BELL:  Very well, just so I know.

    56        whose -- some staff, presumably, may be generally
    57        discontented with the company, yes?
    58        A.  I am sure that is right.
