Day 092 - 27 Feb 95 - Page 73

       A. OK.

  Q. If you cannot work it out now but can do some sums
       overnight ---
       A. Yes, I can do that.

  Q. -- do that and tell us in the morning. That is all.

MR. MORRIS: Shall we leave it there for today?

MR. RAMPTON: Yes, My Lord, there is something I wanted to raise
in any event, if I may?

MR. JUSTICE BELL: Do you want to ask anything more now?

  MR. MORRIS: Not today.

MR. JUSTICE BELL: We can break off now. (To the witness): If
you cannot do it, say you cannot?
       A. No, I can do it.

MR. JUSTICE BELL: If you can help by doing it, then Mr. Morris
will go on to something else.

THE WITNESS: I can do it. It is just a matter of getting a
       calculator and a pen.

MR. JUSTICE BELL: Would you like to go and sit down then,
       Dr. Gonzalez?

                      (The witness withdrew)

MR. RAMPTON: My Lord, it is only this, that your Lordship will
remember that the Defendants put a Civil Evidence Act
notice on the PHLS report in relation to Preston.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: Our time for service of the counter notice
expires today. One had hoped that one would have in one's
hand by this time the Defendants' proposed amendment in
relation to Preston. I wonder if your Lordship would
simply say that our time for service of the counter notice
should not start running until your Lordship has seen and
ruled on the proposed amendment? It may never be
       necessary.

MS. STEEL: Can I just say, I did mean to bring that today and
       I forgot to bring it.

MR. JUSTICE BELL: Do not worry. All Mr. Rampton is saying is
it would be sensible to have so many days from ------

MR. RAMPTON: It is 21 days under the rules.

MR. JUSTICE BELL: Yes, it is but whether you would need 21 from
       the moment -----

MR. RAMPTON: No, I am just reminding your Lordship that is what
it is. No, no, I do not need that at all. It is just that
