Day 124 - 10 May 95 - Page 39

on the back of specific topics, if you do not consider
yourself an expert on that specific topic.

MR. MORRIS: If I can refer you to a document which I gave to
Mr. Rampton this morning before we started regarding Hong
Kong. (Handed). Do you recognise this as Hong Kong? It
says on the right-hand side "Hong Kong 1995" -- that is
this year -- "McDonald's News" do you recognise that? At
the bottom it has: "Copyright 1995 McDonald's
       Corporation". That is your -----
       A. It is the first time I have seen this. I have been to
Hong Kong before, but it is the first time I have seen this
       publication.

  Q. It has " Copyright McDonald's Corporation" which is your
organisation, is it not, you represent? If we look at the
section: "We care about the ozone layer". If you read the
fourth paragraph it seems that HCFC-22s are still being
used in Hong Kong as blowing agents in foam packaging of
       some kind?
       A. It indicates that it has reduced the harmful effect to
the ozone layer by 95 per cent.

  Q. So that is recognising it still has a 5 per cent harmful
effect, compared to CFC. So if it has a harmful effect on
the ozone layer, how can you have a heading that says: "We
care about the ozone layer"? That is deceiving the public,
       is it not?
       A. I think that is quite a stretch, Mr. Morris. I would
draw your attention to the third paragraph where it says:

"In 1987 McDonald's became the first company in the
restaurant industry to require in its packaging suppliers
to stop using foam packaging -- the use of CFCs in the
       manufacture of its packaging".

  Q. Yes, but the reality is if something is still damaging the
ozone layer, you should not have a heading say "We care
       about ozone layer"?
       A. Well, we do.

MR. JUSTICE BELL: That really is a matter of comment.

MR. MORRIS: It is because it is a new document.

MR. JUSTICE BELL: That is fair enough.

MR. MORRIS: We only got it in the last few days.

MR. RAMPTON: Last few days, then I respectfully enquire why it
was only given to us this morning. I might have been able
to made some enquiries about it if I had been given it when
Mr. Morris got it. Your Lordship has told them several
times as soon as they get a disclosable document they must
       disclose it.

MR. MORRIS: We reserve the right to get legal advice on whether
something is relevant or admissible before we disclose a
       document.
