MR. JUSTICE BELL: Work on the basis that ----

MR. RAMPTON: I cannot possibly say ----

MR. JUSTICE BELL: -- that may be it.

MR. RAMPTON: That is what we were told.

MR. MORRIS: I think that is what we were told by the
Plaintiffs.

MR. JUSTICE BELL: Work on the basis for the moment that it may
be it.

MS. STEEL: Working on the basis that this is the magazine that
is referred to, if you turn to the last page of that tab
you see the leaflet there?
A. Yes.

Q. And it is a leaflet produced by Veggies; do you see that?
A. Well, I am not sure it is produced by ----

MR. JUSTICE BELL: I think the point is this, if you look at
what is wrong with McDonald's the easiest way to
demonstrate one of the differences is it has 'Why is it
wrong for the beef industry to destroy rainforest?'

MS. STEEL: Can you not read the box in the bottom left corner;
is that illegible?

MR. JUSTICE BELL: Yes, but I want to point out a difference
which may or may not at the end of the day be of some
significance in some ways, it may not be, whereas the
equivalent headline in the leaflet which is complained of
in this litigation is, 'Why is it wrong for McDonald's to
destroy rainforests?' Do you see? The text underneath is
different. I might summarise it in this way: whereas this
leaflet makes certain specific allegations with regard to
McDonald's, let us say it is argued, and the rainforest,
that is pointing at the beef industry. But whatever the
rights and wrongs are there is a difference in the text?
A. I can just about half read the headline in mine, and
the first and second paragraphs on that right-hand side
I cannot read from this anything.

Q. You do not have to. The headline in relation to the
rainforests is different, and parts of the text which might
be thought to be significant.

MS. STEEL: If you want ----

MR. JUSTICE BELL: For instance, "McDonald's and Burger King are
two of the many US corporations using lethal poisons to
destroy vast areas of central American rainforest" does not
appear there.

MS. STEEL: Mr. Preston, if you want a better copy if you get
publication volume A then it is in there in tab No 53.
