Day 157 - 18 Jul 95 - Page 60

"The work which is within the ordinary scope of a
barrister's practice consists of advocacy, drafting
pleadings and other legal documents and advising on
questions of law. A barrister acts only on the
instructions of the professional client and does not carry
out any work by way of the management, administration or
general conduct of the lay client's affairs."

MR. JUSTICE BELL: I do not think Mr. Rampton is going to go out
here and get a bit of his notepaper and write to the Lord
Chancellor himself. I assume what he meant was that he
would advise his clients to instruct their solicitors to
write on their behalf to the ----

MS. STEEL: If I could finish the point.

MR. JUSTICE BELL: --- Lord Chancellor enclosing a copy of the
letter of 17th July.

MS. STEEL: If I could just finish the point. It does say: "...
nor the management administration or general conduct of
litigation." So it is not really any of his business. If
the Plaintiffs are going to write to the Lord Chancellor,
then obviously we regard their letter as highly deceptive
and one-sided and they should ----

MR. JUSTICE BELL: You can write to the Lord Chancellor again.
All Mr. Rampton is doing is advising his client.

MS. STEEL: I am just going to say, so it is in open court so
that they know they should give us a copy of any letter
which they send to the Lord Chancellor along with any
copies of any letters they are sending ----

MR. JUSTICE BELL: That is entirely a matter for them.

MS. STEEL: --- at the time they are written to enable us to
respond to them. We will leave everything else until the
morning.

MR. JUSTICE BELL: Concentrate on what is actual reply rather
than going over the same points again. When the argument
is finished on the question of transcripts we will progress
straightaway to the other interlocutory points which you
want to raise and I will hear the argument in relation to
those.

We will resume at 10.30 in the morning.
