Day 062 - 06 Dec 94 - Page 69

MR. JUSTICE BELL: What then did you want to do about
Mr. Mallinson? Have your two days preparation, if we run
to schedule, on Monday and Tuesday of next week; hear the
evidence of Mr. Gonzales and then, if need be, come back to
Mr. Mallinson who is on a discrete part of the packaging
       case.

MR. RAMPTON: We do not mean Mallinson, do we, my Lord, perhaps,
       we mean Mr. Hopkins?

MR. JUSTICE BELL: No, I mean Mr. Hopkins, thank you.

MR. MORRIS: I am not sure if Mr. Hopkins could make it. From
my recollection, he said that he might have been able to
       make the 19th and 20th.

MR. JUSTICE BELL: I am not so much concerned about that. What
I am concerned about is since Mr. Hopkins is in a discrete
area of the case, he could come back at some stage in the
future rather than immediately. For all I know, he cannot
come back immediately anyway. So, what I am asking is
whether we could finish Mr. Van Erp, hopefully, tomorrow,
finish Mr. Oakley, hopefully, on Thursday, finish Ms. Dibb,
hopefully, on Friday, have Monday and Tuesday as your
preparation days for food poisoning and go to Mr. Fernando
Gomez Gonzales for Wednesday, Thursday and Friday, or
       starting on Wednesday morning.

MR. RAMPTON: At the moment, my Lord, I have not dislodged my
Scottish academics on 19th and 20th either. If we managed
to finish Van Erp, Oakley and Dibb this week, then I see no
reason to defer Professor Jackson and Dr. Clark.

MR. JUSTICE BELL: We might take stock of that at the end of
       this week.

MR. RAMPTON: They have to come down from Glasgow and they will
       have to stay overnight.

MR. MORRIS: Can I make a point, that I am getting a little bit
disturbed at the way things are developing because of the
tight schedule. We are having three or four or may be more
subjects sandwiched together. It is making it very, very
difficult to prepare. I would prefer if there are days
spare, Monday and Tuesday, 19th and 20th, to try to finish
someone off that is outstanding. Obviously, there is the
matter of outstanding legal matters as well which were
intended to be finished before the end, presumably, to
allow some time to see what happens in the following days.
But Mr. Gonzales, I was quite worried about Mr. Gonzales
because it is a new issue, about being prepared for him.
As far as I could see, I think the Scottish academics, as
       they have been described ---

MR. RAMPTON: Which is exactly what they are.

MR. MORRIS: -- go into a great deal more detail on food
poisoning and hygiene documentation, I would think. I am a
little bit worried about the additional burden that would
be on top of Mr. Gonzales.
