1 reason that I have mentioned before, is that on our part it
2 involves a considerable body of rebuttal evidence. I am
3 not willing to call rebuttal in this particular field from
4 all over the country unless I am confident that the
5 Defendants' witnesses are actually going to come and give
6 evidence in court. My Lord, I will not develop that now.

8 MS. STEEL: If Mr. Rampton has some reason for supposing that
9 our witnesses are not going to be turning up in court, then
10 I think that he should give what that reason is.

12 MR. JUSTICE BELL: What I will do is I will wait and hear what
13 Mr. Rampton says on Monday and make any ruling I am asked
14 to make or rule on any question I am asked to deal with.

16 Unless there is any further we can usefully discuss,
17 I think it is better you go away and get on particularly
18 with deciding what your position is in relation to the BSE
19 matter and getting your list in relation to discovery
20 done. We will resume at 10.30 on Monday morning. If there
21 are any other authorities, I would like them to be got to
22 me on Friday sometime.
