     1        higher than normal in temperature throughout the store?
     2        The grill area is a hotter area than other areas in the
     3        store?
     4        A.  Slightly hotter, although the air conditioning unit,
     5        which is called a HVAC (heating ventilation air
     6        conditioning).  So if the temperature inside the building
     7        is hot, it will cool it down; if the temperature inside the
     8        building is cold, it will heat it up to a standard
     9        temperature.

    11   Q.   But if people are standing around grills that are
    12        370 degrees, then that environment is going to be fairly
    13        above the ambient temperature, but it is going to be fairly
    14        substantially above it, normally?
    15        A.  I would not say fairly substantially, because you have
    16        got two vents immediately above the grill area which would
    17        cool it down, although it would be warmer than elsewhere in
    18        the restaurant.

    20   Q.   This may be an obvious question to you, but if you have a
    21        grill at 370 degrees, if that is the grill there and my
    22        hands are there, can you feel the temperature coming off
    23        the grill?
    24        A.  Yes, I would say.

    26   Q.   You said, I believe -- I think it was you -- the grill area
    27        is part of the kitchen area, is it?
    28        A.  That is right.

    30   Q.   Yes -- you said there is not much room for running and
    31        sliding in there, in the kitchen area; is that correct?
    32        A.  Not when it is in operation, no.

    34   Q.   Is that because there is just not the space to do it?
    35        A.  And also there are people around.  The actual walkways
    36        are not that wide; and, generally, also, if you are working
    37        in a kitchen, you are stationary.  Also in the kitchen we
    38        have got -- we had at that time -- non-slip tiling
    39        throughout the kitchen.

    41   Q.   There is no such thing as non-slip tiling, is there?
    42        A.  Well, there is tiling that prevents or helps to prevent
    43        slippage; and I have always referred to it as non-slip
    44        tiling.  So, yes, I suppose you could say there is such a
    45        thing as non-slip tiling.

    47   Q.   But you did have slippage accidents, did you not, including
    48        the grill area -- or did you?
    49        A.  We occasionally had slipping accidents, yes.

    51   Q.   In the grill area? 
    52        A.  I cannot recall one specifically in the grill area, 
    53        although it may be the case, yes.

    55   Q.   When you say cannot recall one specifically, you cannot
    56        recall that there were any slippage accidents in the grill
    57        area?  It may have occurred, but you just cannot recall
    58        that?
    59        A.  I cannot recall a specific incident.  All I am saying
    60        is, yes, it could, in theory, occur.
