1 that we have discussed this morning.

2 Q. Right. I think it was a year before that?
              A. That is correct.
     3
         Q. I think you said that you had been having discussions with
4 New York for sometime and the final format of the book
              came out of those discussions?
5 A. Yes, we had had some discussions with the New York
Attorney General, Mr. Mandell, and his staff.
     6
         Q. Do you know the booklet Nutrition and Ingredients Issues:
7 A Reference Guide for McDonald's Owner Operators? Do you
              know that booklet?
8 A. Could you give me something to look at?

9 Q. Yes, it is tab 4D. It should be in that volume.
              A. Volume 6, tab 4D.
    10
         Q. Page 59I. You have that, the right page?
    11 A. Is that it?

12 Q. That is the one, yes. Do you know when that document was
              produced?
13 A. I must say that this document, which looks like it is
a number of pages long, does not look familiar to me.
14 I am not even sure I have seen this one before.

15 Q. You do not remember ever having seen it before?
              A. Could you tell me how long this brochure is, it is
16 from page 001 through page?

    17 Q. 37?
              A. I do not recall having seen this before.
    18
MR. JUSTICE BELL: I am assuming the adjective "healthful"
19 means just the same as "healthy" as we use it. It does
not have any special connotations? For instance, on page
20 59K we have had it once or twice today.

21 MS. STEEL: Right. I do not think we have a date for this
document. I do not know whether -- perhaps we could look
    22 at page 59AE.

    23 MR. JUSTICE BELL: 59?

    24 MS. STEEL: AE.
              A. I am there.
    25
         Q. At the top of the page it says: "Why don't you label your
26 products?" The answer is: "Quite simply it is not
practical or economical to do so". So, at the stage when
27 this booklet was published -- if you read lower down as
well: "If you don't label your products how can I find
28 out what ingredients are in them? You can call or write
              to McDonald's nutritional information centre".
    29
So, would you agree that it is apparent from this at the
30 stage this document was produced McDonald's was not
providing nutrition information in its stores on a
