Day 164 - 26 Sep 95 - Page 53
and your Lordship can look at them tomorrow.

MR. JUSTICE BELL: Yes.

MR. RAMPTON: Your Lordship should also know this -- I
had forgotten to say this and meant to -- which, looked at
superficially, is a point against me but perhaps on further
consideration is not, it is that when the original batches
of notes were disclosed, I think it was Mr. Clare's notes
originally, I think it is right we did not do any blanking
out. It was only with the experience of the way in which
this case has been conducted, I am afraid I decided that a
strict view should be taken and that the blanking out
should occur.

MR. JUSTICE BELL: So the Defendants should have a copy of
Mr. Clare's notes?

MR. RAMPTON: The first set of Mr. Clare's notes which they
originally had with Mr. Clare's first statement which were
for a particular set of occasions have not been blanked
out.

MR. JUSTICE BELL: In your own interests, I think you should
look at those and see whether any of the blanked out parts
-- have blanked out copies of the meetings referred to in
Mr. Clare's first statement now been done?

MR. RAMPTON: No.

MR. JUSTICE BELL: So they are complete?

MR. RAMPTON: They have just been left as served.

MR. JUSTICE BELL: I see. Very well.

MR. RAMPTON: One can see, if it be necessary, but in due course
one can see quite how much material is in those original
notes which really are not of any interest at all in this
case. Anyhow, my Lord, I do not desire to say anything
more about that for the moment.

MR. JUSTICE BELL: Yes. Do you want to say anything in reply?

MS. STEEL: If it is being left open until the morning to look
at these cases, then I think that I would prefer to do it
then.

MR. RAMPTON: My Lord, I really do not want to run into time
trouble with my Thursday witness.

MR. JUSTICE BELL: Could you remind me who the Thursday witness
is?

MR. RAMPTON: It is Mr. James Atkinson who was, I think, the
Manager at Marble Arch.

MR. JUSTICE BELL: Where do I find him? Is he in yellow X?

MR. RAMPTON: He is in yellow X.
