and date at a later point in time and they decided not to
turn up for that one either.

  Q. So?
       A. So, in total, I only had actually one appeal, although
there were three that may have been.

  Q. That would be in six years as a senior Supervisor, would
       it?
       A. Yes.

  Q. For covering between eight and 14 stores?
       A. Yes.

  Q. This has come up before -- I will ask it again. You said:
"If anybody had been sacked other than in accordance with
the correct procedures the employee concerned would
       undoubtedly" ----

MR. JUSTICE BELL: Do not bother to pursue that. I have the
       greatest difficulty with that.

MR. MORRIS: OK. We think we might have a quarter of an hour's
questioning left. If we could have a break it might be
       helpful.

MR. JUSTICE BELL: How long do you want?

MR. MORRIS: A five minute break.

MR. JUSTICE BELL: I will come back at 20 past three.

                        (Short adjournment)

MS. STEEL: You said in paragraph 17 of your statement that
"Cranna's claim that an employee would be sent home
immediately if he or she answered back should be put into
context. It is true that a Manager might consider this
approach to be appropriate in certain circumstances; for
example, it might be an appropriate way of reprimanding an
employee if he was particularly out of line, but without
resorting to formal disciplinary procedures which would
remain on the record. If the employee was sent home as
part of the formal disciplinary process, then he or she
would be entitled to receive normal pay." If they are just
sent home without recourse to formal disciplinary
procedures they would not be entitled to pay, would they?
       A. No, they would not because it is a reprimand.

  Q. Right.

MR. JUSTICE BELL: Can you give me an example of the
circumstances in which you think it appropriate to send
someone home so that they lose what would otherwise be paid
hours of work but not invoking the disciplinary
       proceedings?
       A. Well, it may well be that it is just a crew member that
has been socialising the night before, has come into work
feeling rather tired, possibly suffering from the after
effects of alcohol, not in the best of moods and not
