Day 167 - 02 Oct 95 - Page 29

At some stage -- it may be before Mr. Richards is called --
you will want some discussion on the ramifications of the
extra details you have given; it is largely up to
Mr. Rampton. Also, whether you do it or Mr. Atkinson does
it or not, I would like to go back yet again to the
question of what the McDonald's Operations and Training
manual consists of. One way to do it is to look at volume
X and ask Mr. Tindale what he recognises there. I do not
even know if you are talking about the same book.

MR. RAMPTON: Your Lordship may find it more profitable actually
to ask Mr. Richards about it. I will tell your Lordship
what I believe the position to be. What your Lordship has
there, you will see it from the front cover, is 1990/1991,
it should say on the front, I think.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: In those days it was a -----

MR. JUSTICE BELL: Just pause there for a moment, Mr. Rampton,
as Mr. Tindale is here. I was hoping to hand down my
ruling on the variety of topics which was argued tomorrow,
but I do not want to do it all in bits and pieces. I would
like some further resolution about the form which this
takes because I remember perfectly well what you told me,
Mr. Rampton, and also any further argument with regard to
discovery in relation to Bath, if there is to be any, and
then I will have it all in the one ruling. But I do not
see why Mr. Tindale should hang around while we do bits and
       pieces.

MR. RAMPTON: I respectfully agree with your Lordship and
I apologise for launching out on to that now. I am not
sure that I know what the factual position is -- I think
I do -- but it does not matter; it can be dealt with by
       Mr. Richards anyway.

My Lord, I would say in relation to these names which you
have now been given, we have given a copy to Mr. Richards
but, plainly, we need to know in advance what, if anything,
he says about any of these people or the somewhat general
allegations which are made in relation to their names
before he gives evidence. It may be your Lordship would
think it appropriate when Mr. Tindale has finished to have
something of a break so that we can -----

MR. JUSTICE BELL: We will come back at 2.00. We will complete
Mr. Tindale's evidence. He can then be released and we
will go on to talk about what we do next then. 2 o'clock
       then.

                       (Luncheon Adjournment)

MR. MORRIS: You know the Management and Crew Scheduling
       programme?
       A. Well, I know of it yes.

  Q. You know of it. There are various guides to help Managers
be able to schedule; is that correct?
