rubbish and the Environmental Protection Act 1990. On
4 page 2 of that -- I do not know what it is numbered, yes,
there is a number of cut out sections from the 1990 Act,
5 I presume, we will assume that the Tidy Britain Group is
accurate in its selection from the Act, is that as you
6 understand it? You have the same document as I have?

8 page, the bottom tear out, it says section 47(2)?
A. 47(2), yes.

Q. If I may read that and let me ask what you think: "If it
10 appears to a waste collection authority there is likely to
be a situation of any premises in its area ... (reading to
11 the words) ... Of such waste of the kind and number
specified", is that correct?

13 Q. The next box, it says: "Section 93(1)", presumably of the
Act, "A principal environment/index.html">litter authority may ... With a view to
14 the prevention or accumulation of environment/index.html">litter or refuse
... (reading to the words) ... to such environment/index.html">litter or
15 refuse". That is also correct, what it says?
A. That is what it says.

Q. Then underneath that, not from the Act but as a comment,
17 it says: "If in certain areas there is a environment/index.html">litter problem
caused by occupiers of premises then the local authority
18 may designate it as a street environment/index.html">litter control area"; is that
correct?
19 A. Those are the words, yes.
20 Q. Finally, in section 94(4) underneath that: "The
requirements which may be imposed by a 'street environment/index.html">litter
21 control' notice shall relate to the cleaning of environment/index.html">litter or
refuse from specified area may particularly require (a)
22 the provision or emptying of receptacles for little or
refuse; (b) the doing within a specified period of any
23 such thing as may be so specified; or (c) the doing at
such times or intervals or within such periods of any such
24 thing as may be so specified". Then it goes on to say
there are sanctions for those that do not.

Bearing in mind all that, do you believe that the Tidy
26 Britain Group clearly is concerned about the
responsibilities of businesses that produce items which
27 could later become environment/index.html">litter on the street?
A. But I think the Tidy Britain Group are concerned about
28 every aspect of environment/index.html">litter on Britain's streets, whether it be
business or individuals or whomever.
