Day 088 - 13 Feb 95 - Page 84

MR. RAMPTON: My Lord, I really do not want him to come on
Monday for his own sake. If, in fact, the Defendants are
not going to be finished with Dr. Pattison, I mean, that
would be the worst of all possible worlds.

MR. JUSTICE BELL: No, I quite agree. Then there is a problem
the following week because that is the week when Dr. Gomez
       Gonzalez is coming back.

MR. JUSTICE BELL: What had occurred to me is that it seems to
be sensible to start Dr. Gomez Gonzalez, come what may, on
       the Monday morning.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: But if it appeared that there was time at or
towards the end of that week then Mr. Bowes might come back
       in then.

MR. RAMPTON: My Lord, there is another possibility which is the
second thing I was going to say to your Lordship.
Mr. Bowes does not think he will be free next week, but in
view of what your Lordship said, I am going to suggest to
him that he does not keep next Monday free but leave that
       as a spare day.

MR. JUSTICE BELL: We will leave that as a possible run over day
for Dr. Pattison then Monday. We will not sit if
       Dr. Pattison finishes this week.

MR. RAMPTON: My Lord, there is or there has unexpectedly opened
up in any event another gap after Dr. Gomez Gonzalez for
this reason, that we have spoken to Jarrets. They have
scratched their heads and they have looked at the statement
of the woman, Marie Hovey, and they have taken the decision
(and it has to be their decision; it is not one which it is
within our power to influence or alter in any way) that
they want to answer her with an independent person from
outside Jarret with somebody who knows Jarret extremely
well. When I say an "independent person", I mean an expert
in the matters about which Ms. Hovey purports to speak.

The trouble is that that person cannot prepare a report
until 27th March, not before 27th March. We will do
everything we can to persuade them to do it by then. If
that is right, that means he will be a good deal later in
producing his report than when your Lordship had indicated
it was desirable. But your Lordship's date was dependent
on putting Jarret in after Mr. Chambers on 8th and 9th,
       possibly 10th March.

If that space is made available, Mr. Chambers may go on
anyway until Wednesday. 9th and 10th, if he is available,
Mr. Bowes could be asked to come back. Since Ms. Hovey and
the Jarret person are, really, in a sense a discrete
section of the case in that she makes a specific
allegations with which he will deal, it perhaps does not
matter very much if they go together. All I would say is
that I accept your Lordship's previous indication that the
Jarret person, the expert, should precede Ms. Hovey.
