Day 093 - 28 Feb 95 - Page 69

       A. Yes.

MR. RAMPTON: Can you let him have mine? I have got a good
       copy.

THE WITNESS: I have it, sorry. I went to page 54.

  MR. MORRIS: 53.

MR. JUSTICE BELL: He seems to be doing all right, Mr. Rampton.

MR. MORRIS: Out of 64 tests there was a 95 per cent
       non-conformity of which 45 was major non-conformity and 15
was critical non-conformity, that is in numbers?
       A. Can you -- no, I do not think you have it right. Can
you walk through your numbers again one at a time?

MR. JUSTICE BELL: I am sorry I said that he did not need help
because, clearly -- can you not read the line?
       A. I can read but you are moving from one number to the
       other.

MR. MORRIS: I am sorry. If we look at the second row, it says
"equipment disassembly" on the left-hand side?
       A. Yes, I see the 64.

  Q. Then it says 64 tests performed?
       A. That is correct.

  Q. Then on the next columns it has minor non-conformity, one
out of 64, major 45, critical 15, and then it says that
percentage at the very end, 95 per cent non-conformity.
       A. No, that is what is -- that is where you are wrong. It
is not 95 per cent. It is not a percentage number.

  Q. It must be, it is 95.31; it has to be a percentage, has it
       not?
       A. No, it is not. It is the sum of the numbers from 45
       plus 15 plus 61 -- I am sorry, no, 45, plus 15 plus 1.

MR. JUSTICE BELL: They did 64 tests, 61 of them attracted some
kind of attention and 61 is 95.31 per cent of 64. That
must be right, must it not?
       A. I am sorry. This, what it is, it is the sum of the
points that they give, they assign a minor but it is one
       point.

  Q. The 61 is but 61 is 95.31 per cent of 64. 64 tests, 61 --
I will use the neutral phrase -- attracted some attention
and 95.31 per cent -- let me just look at your
figures -- it is three short of 64 which is about
two-thirds of 100, so it is about five short of the 100 per
cent, if one wants to do a little mental arithmetic.

MR. MORRIS: Equipment disassembly: That is something that is
quite important, is it not, in terms of sanitation?
       A. That is correct. What it also means is that they will
not allow -- once they have this number, they will not
allow it to be assembled until it meets all of the specs.
