     1        arisen generally so far as that is concerned, because you
     2        called your witnesses after the McDonald's witnesses have
     3        been called.  Do not try and persuade me that that which
     4        I have clearly heard with my own ears is not so.  There has
     5        been a lot of new material.

     7        It may mean that Mr. Rampton will wish to call evidence in
     8        rebuttal.  If he does, at the moment, I am minded to let
     9        him do so because of the new stuff.  In a thoroughly well
    10        ordered household, all the additional matters which Ms.
    11        Hovi has mentioned would have been put in a supplemental
    12        statement and served some weeks ago.

    14        No-one is stopping you going on with adducing the
    15        evidence-in-chief, but it may be that Ms. Hovi will have to
    16        come back and it may be that Mr. Rampton will want to call
    17        evidence in rebuttal.  We will just have to wait and see.

    19   MR. MORRIS:  If I may just make a general observation, that it
    20        seems to me that every witness in this case, without
    21        exception, has made a statement upon which they have
    22        expanded and expounded.  Ms. Hovi is no different; she has
    23        made quite a substantial statement.  I do not believe any
    24        matter that she has brought up, apart from the earlier
    25        material about general bacterial contamination which is
    26        under her expertise, but that has all been dealt with any
    27        way by other witnesses.

    29   MR. JUSTICE BELL:  I have listened to Ms. Hovi's evidence.  I am
    30        making no comment on it.  I have heard with my own ears
    31        what she has said.  I totally disagree with what you have
    32        just said.  We will just have to wait and see whether
    33        Mr. Rampton needs more time to take instructions before
    34        cross-examination and wishes to call evidence in rebuttal.

    36   MS. STEEL:  There was one thing.  I think you gave as an example
    37        something about the cleaning facilities, the sterilising
    38        facilities.  That is actually under paragraph 7 of the
    39        statement.  It was mentioned in the statement.

    41   MR. JUSTICE BELL:  Do not argue about it any further.  I have
    42        ears; I have CaseView; I have the statement in front of me
    43        and I have my own view about it.  You carry on with your
    44        evidence-in-chief and then we will see what, if anything,
    45        further Mr. Rampton has to say then.

    47   MR. MORRIS (To the witness):  Just to finish off the actual
    48        floor plan and the line, your concerns about the boning
    49        hall?
    50        A.  Yes.

    52   Q.   What are your concerns about the minced beef production 
    53        which I do consider is a new point?
    54        A.  That had only to do with the fact that the cleaning was
    55        not going to be efficient under those circumstances.  That
    56        was why I felt it important to establish a system of
    57        monitoring the cleaning with the TVC counts but, that aside
    58        -- we can discuss the TVC counts, if you want to, later --
    59        an additional concern that I had in the boning hall was
