Day 121 - 04 May 95 - Page 37

MR. JUSTICE BELL: OK. Ask a question about something else and
address me on that basis in due course.

MS. STEEL: The statement of Karen Anstee who worked at -----

MR. JUSTICE BELL: Give me the page number.

MS. STEEL: It is the Defendants' statements and it is actually
in the Civil Evidence Act section, statement No. 1.

THE WITNESS: Do I have them here?

MR. JUSTICE BELL: Yes. It is not necessary always for you to
look at a statement, but it is a pale blue volume No. II,
Defendants' witness statements, and it is in section B, No.
       1.

  THE WITNESS: Tab number, please?

MS. STEEL: It is in the Civil Evidence Act statements at the
back. Section B, statement No. 1. If you turn to page 3
       of that statement?
       A. Yes.

  Q. It is the second paragraph: "The occasion that brought all
the above crashing together for me during my employment at
McDonald's was the day that a burst water pipe caused a
flood in the work area of our branch. The water came
rushing through the ceiling above the work area and there
was soon at least a quarter of an inch of water over the
entire area. I was working on the till that day, but
covered the making of fries whilst the employee normally
responsible tried to mop up the water. The Manager did not
stop us from working, despite the treacherous conditions
and the employees did not stop working. I myself continued
to work around boiling vats regardless of the situation.
It was only after about 20 minutes that I suddenly woke up
and realised the danger in which I was putting myself by
continuing to try to keep up with the normal output. I was
horrified that I and my companions had become so much a
part of the machine that we thought nothing of our safety".

Would that concern you, does that concern you?
       A. I have no knowledge of this incident at all.

MR. JUSTICE BELL: No, just pause. If what happened was what is
narrated in the second -- that is this large paragraph --
       line ---
       A. Yes. That would concern me.

  Q. -- down to about line 11 which tells us that Miss Anstee's
account is that it went on for 20 minutes at least ---
       A. Yes. That would concern me.

  Q. -- if that happened, would that concern you?
       A. Oh, certainly, yes.

MR. JUSTICE BELL: So ask another question, if you want, about
       that.
