Day 187 - 13 Nov 95 - Page 23
MR. JUSTICE BELL: Well -----

MR. MORRIS: Can I just ask a question to clarify the last
point?

MR. JUSTICE BELL: It must have been -- was it about a year
ago? It was not with the original batches of statements,
then?

MR. MORRIS: No, it was not. It was after. For example, it
mentions August 1994.

MR. JUSTICE BELL: Yes.

MR. MORRIS: (To the witness): Have there been any changes
since August 1994 in conditions, working conditions?
A. Yes.

Q. How has that come about?
A. Due to the hearings and the rulings that were made,
because the works inspectorate forced them to change the
working conditions.

Q. What role has he played and has the union played?
A. At each hearing of the works inspectorate, myself and
the union, each time there was a hearing, we went to the
hearing. We financed the actions, so that they could be
ruled upon and completed.

Q. "Advocates" -- is that lawyers?
A. Lawyers.

Q. Has there been any publicity in the newspapers about these
demands for changes?

MR. JUSTICE BELL: I cannot take any note of that unless it is
directed at a particular point.

MR. MORRIS: The point is that is, obviously, the union pressed
the legal actions but, also, the publicity putting pressure
on McDonald's to improve the conditions, which is part of
our case, that the only time -----

MR. JUSTICE BELL: But is it part of your case here? I thought
it was that they were dragged kicking and screaming through
all these hearings and had to change because of that.

MR. MORRIS: Yes. That is fine.

If I can go to the notes from 8th November 1995, it is A8.
It may help actually if the translator can translate
these. The first one we have already dealt with.

MR. JUSTICE BELL: Let me just look again. A, you have dealt
with; C, you have dealt with; and D, you have effectively
dealt with just a moment ago. So that leaves B and E, does
it not?

MR. RAMPTON: I think E has been dealt with, too. It is the
penultimate paragraph of the statement.
