Day 130 - 26 May 95 - Page 06
Q. Just while we are on that last subject about fire, can we
go to the Glasgow incident report forms; I do not know
where they have been put. I do not know if they are in the
witness bundle. It is 57P. Do you have them there? It is
the Lingwood section, page 2 of the Lingwood section. Have
you got it? It is the last section No. 2 of that tab.

MR. JUSTICE BELL: I am not with you, Mr. Morris. In 57P?

MR. MORRIS: I was told it was 57P.

MS. STEEL: It is No. 443.

MR. MORRIS: It is store 443.

MR. JUSTICE BELL: It is the second sheet, is it?

MS. STEEL: No.

MR. MORRIS: It has a "2" on it. It is the second to last sheet
in that section. It is No. 2 at the bottom of the page.
(To the witness): Mrs. Barnes, have you got that?
A. I have got it, yes.

Q. This is an incident report form from Lingwood McDonald's
store; "Yasminder Ragger whilst filtering on the close
noticed the reflection of a flame and then saw some fumes
from the underside of the filtering machine. Somebody, a
Floor Manager, extinguished the fire with an extinguisher".
Do you accept that fires have occurred at McDonald's from
the filtering machine?
A. OK. It would appear so in that case, but there is
nothing to say it was an electrical fire. One of the
design faults that was identified at the time of Manchester
Arndale was that the machines could get very, very hot
underneath. So, as part of the retrofit programme, when we
put in the switches, we put in a heat shields on the bottom
to address that.

Q. This was June 1993?
A. Yes, it was a little while after.

Q. I am going to come on to your report but, before I do that,
could you get out the Defendants' witness statements which
are the light blue at the front? There should be a list, I
do not know which one Robert Chapman is.
A. 15.

MR. JUSTICE BELL: It is volume 2?
A. Yes, it is No. 15.

MR. MORRIS: Can you just read that to yourself, please? (Pause
to read.) Have you have you seen it before?
A. I think I have, yes. OK.

Q. You were in charge of the investigation, yes?
A. I pulled together all the detail, although the was a
unusual investigation, in that I did not carry out any
interviews with the people involved in the accident, and
the reason we did that was twofold. First of all, the
