Day 060 - 02 Dec 94 - Page 71
products. Just pause there for a moment.
A. Yes.

Q. But what you were saying yesterday is that the polystyrene
product has a number of practical advantages so far as the
customer is concerned -- that is a part two. Therefore,
the suggestion is that you are putting those factors
attracting your customer ahead of environmental
considerations?
A. Right.

Q. Part three. That is the thrust of what you are putting,
Mr. Morris, is it?

MR. MORRIS: Yes.

MR. JUSTICE BELL: What would you like to say about that?
A. Well, I honestly do not think McDonald's in the USA
would have made this change had they not had a landfill
problem in the United States. This is their preferred
package. We do not have a landfill problem here. It is
our preferred package and that is why we have stayed with
it until the next generation comes along which, as
I indicated, is well on the way to coming along.

MR. MORRIS: Apart from the landfill consideration, if you look
at, say, the implications for energy and resources that
were put into the production of polystyrene as opposed to
paper in that report, the EDF McDonald's report, the energy
and resource implications were that it had worse
environmental implications. Is that correct?
A. That is a fact if you compare apples with oranges which
is what you are doing here.

Q. I am just asking about that report, the EDF report?
A. Yes, but that was not -----

Q. They are saying that the energy and resource environmental
consequences are greater with polystyrene than with paper,
never mind the landfill, is that correct?
A. They are saying that, but McDonald's would never have
made that change unless -----

Q. But they are saying energy and resource. So, in fact, in
your UK sheet you know now, do you not, that when you say
foam packaging is more energy and resource efficient to
produce than paper or cardboard, but your company now knows
that that is now incorrect?

MR. RAMPTON: I think it is fair to read the next sentence, if
I may say so.

MR. MORRIS: Sorry, I am asking you, you now know that is
correct, yes?
A. Let me read on.

Q. It is not true, is it, now?
A. In reading this, it is very clear and it is six of one
and half a dozen of the other. You can make good points
and bad points for either package.
