Day 124 - 10 May 95 - Page 57

have it in front of me. I have it. It is in tab 4, it is
at the bottom of page 4. Let me just read it.

MR. RAMPTON: That is as it stands at the moment.

MR. JUSTICE BELL: Just leave it for the moment, please,
       Mr. Rampton.

  MR. RAMPTON: Yes, my Lord.

MR. JUSTICE BELL: Yes. When you ask your question do not
assume any factual situation; just ask what Mr. Beavers
       knows.

MR. MORRIS (To the witness): Are you aware of publicity or
controversy appearing in the press, or in discussions that
you have had with other people from McDonald's, about a
ronald mcdonald person basically criticising the role he
had been put in and apologising for brainwashing children?
       I could read out -----

MR. JUSTICE BELL: The first part of your question is a good
       start.

MR. MORRIS: Are you aware of that?

MR. JUSTICE BELL: Are you aware of a ronald mcdonald being
publicly critical of McDonald's and the role he played in
       promoting McDonald's?
       A. I am not aware of any press nor any controversy
surrounding ronald mcdonald in Canada. I am not aware of
       any of this.

MR. MORRIS: Do you remember that at all, anything that jogs
your memory about that, any discussions with anyone?
       A. Nothing at all. There is nothing in my memory that
I can, you know, reflect on that comes remotely close to
       what you have described.

MR. RAMPTON: My Lord, I would like the opportunity to come back
to that at some stage because what, in fact, has happened
is that the pleading has not been altered in accordance
       with your Lordship's ruling.

MR. JUSTICE BELL: That may be. There may be other witnesses
who can help you, but it seems to me you have run it out so
far as Mr. Beavers is concerned on that specific
       allegation.

MR. MORRIS: Yes, I understand that.

MR. JUSTICE BELL: Because I have to confess I have forgotten
what I ruled in relation to that ---

MR. RAMPTON: I can remind your Lordship.

MR. JUSTICE BELL: -- but if at some time when the witness is
not in the witness box I can be told, I will just write it
       in on my page.
