Day 207 - 23 Jan 96 - Page 50
because there are certain legalities where you cannot
actually schedule people?

MR. JUSTICE BELL: No, you say "presumably" -----

MR. MORRIS: I do not know.

MR. JUSTICE BELL: No, I think we should ------

MR. MORRIS (To the witness): Why would the computer set a limit
on David Watts?
A. I presume so you can monitor the hours that staff --
that staff are working.

MR. JUSTICE BELL: But excess over what? I mean, do -----
A. I do not personally know the limits, what the computer
uses.

Q. What sort of limits might a person have? I mean, is it
always something like 35 or 39 hours or ----
A. It appears, I thought it was -----

Q. -- do some people have a limit of 20 hours in a week?
A. It appears that it runs on a daily basis, so it must be
some sort of rolling or moving rolling figure.

MR. MORRIS: Yes, but, with respect, you are in charge of the
scheduling. Presumably, you to have know if there are
limits to what people can be scheduled and work. You have
to know what the system is. Are you saying you do not know
what this system is set up for then?
A. Well, this is in a Husky ---

Q. Yes.
A. -- which records the hours.

Q. Yes, so this information is really for your benefit, is it
not, so that you can see if the system is working or not?
Mr. Watts has had 18 hours 51 minutes over or excess hours
on what, we do not know, so what does that mean?
A. I do not know -- it means that 18.51 hours have been
recorded on the excess hours.

Q. Yes, actually it is 18.51 and not 18.51, you are right,
minutes. But can you help us? I mean, excess hours on
what?
A. I do not know how the computer works it out, it
is -----

Q. You are in charge of scheduling. Can you help us in any
way, shape or form or this is just a completely meaningless
document ------

MR. JUSTICE BELL: He said he cannot. Whether you have made a
significant point or not really depends upon what the
excess hours are. I mean, if you want someone to find out,
if you want him to find out, then ask him to do so and he
can do so overnight, or some instructions can be taken.

MR. MORRIS: It might be helpful if the Plaintiffs ------
