Day 086 - 09 Feb 95 - Page 70

any other health and safety hazard.

  Q. But in terms of day-to-day accidents, things like people
burning themselves on the hot plate are going to be far
more frequently than people catching fire or the restaurant
       going up in smoke?
       A. They are, but the consequences of the latter happening
are much more severe than a small burn.

  Q. But people can get very severe burns, can they not, from
slipping and falling and putting their hands on the grill
       or something like that?
       A. Yes, they can by doing that.

  Q. Is there anything in these about not running?
       A. I do not think you will see anything that specifically
       says "do not run".

  Q. You said yesterday that by the definition people do not run
in the stores, but they do move very quickly, do not they?
       A. I was given assistance yesterday on the definition of
"running" and by that definition -----

MR. JUSTICE BELL: It was really what I saw as running so that I
could I understand just what you were talking about.
       A. That is right. So, I accept that people move quickly
       in McDonald's.

  MS. STEEL: Very quickly, though?
       A. No. On occasions they may do, but the majority of our
business is in quiet restaurants in the suburbs with few
customers coming through them. There is no need to move
particularly quickly to serve customers effectively.

  Q. There is nothing in these observation check lists about
doing things at a steady speed and carefully making sure
that you are not going to ----
       A. To answer effectively, I think I would probably have to
       look through them all.

  Q. You do not know then? I mean, this is part of your area of
responsibility, is it not, this is part of what is used for
       training purposes?
       A. We use this for training purposes, yes.

  Q. But you do not recall anything like that being in the -----
       A. It gives advice on how quickly people should move.

  Q. Yes.
       A. Other than our hustle.

  Q. Other than the hustle. The hustle, of course, is to move
       at speed?
       A. No. We went through that yesterday and that was not
       the definition of hustle.

  Q. As it happens, perhaps would you like to turn to page 306
of the yellow VII? It is in tab F. It is behind
       Mr. Wignall's statements.
       A. This is page 245?
