Day 202 - 11 Jan 96 - Page 45

talked about, was the 369 and the 399 restaurants, the two
Colchester restaurants opened, I guess we could find the
dates out, but that would be probably a year or so -----

  Q. You need not be particular about it. What I am really
asking is whether there was a need within the McDonald's
system in this country to produce management material all
the time, particular people who would grow into store
       managers?
       A. Yes, there was a need to do that, both within the
region but we also exported -----

  Q. Just generally?
       A. Yes, generally.

  Q. There was generally a need to find more store managers?
       A. Yes, yes.

  Q. Yes, thank you. Thank you, Mr. Atherton.
       A. Thank you.

                       (The witness withdrew)

MR. JUSTICE BELL: Unless there is anything we must deal with
-- for instance, I notice on your list you have scheduling
-- I do not want to sit beyond about 20 past or 25 past,
is there anything which must be mentioned this afternoon?

MR. RAMPTON: My Lord, I mention it now not so as it is
necessary to have an answer today, but certainly in the
hope of having an answer before the end of tomorrow, and
that is to know in relation to scheduling whether we are
writing in people we have put down, not the dates but the
dates are important as well, the people we have put down as
being the remaining Defendants' employment witnesses. The
reason I say that is, of course, one needs notice but, much
more importantly, we have to schedule our own people.
Until we know which Defendants' witnesses are coming and
what dates they have been given by the Defendants, it is
difficult for us to do that.

That only becomes crucial when one gets to Heathrow, I
think, which is a few weeks away, but there are potentially
five witnesses on Heathrow and we have to start trying to
organise them. My Lord, also, we have assumed, in the
light of what your Lordship said last term, that the
remaining Colchester witnesses for the Defendants are going
to come next week. Obviously, one needs to have that
confirmed because if those days are for any reason not
going to be used we need to use them for something else.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: The Harrisons are unable to come next week. They
are investigating being able to come on 5th and 6th
February, which has been put down as Lamb only.

MR. JUSTICE BELL: They both come one day.

MR. MORRIS: They cannot come on the same day because they have
