Day 258 - 07 Jun 96 - Page 38
seeing us attending certain demonstrations?
A. That is right.

Q. Right. When you gave evidence previously, you said you did
not have any evidence that we were organisers of the 1989
demonstration?
A. There was nothing I saw there which indicated you were
organisers. You were involved. That is as far I could
take it.

Q. Nothing you had before that time by way of evidence?
A. Not as it related to you or Mr. Morris, no.

Q. Right. You said that by October 1990 you considered that
we were organisers, presumably, of the October 1990 picket
-- hold on, I will find the reference of where it was
said. Yes, you said that I asked you a question, you
considered that myself and Mr. Gravett were the organisers,
or at least some of them, did you not, and you said
eventually, and that was after you got the reports from the
agencies. Then the question: so by October 1990 you
considered that myself and Mr. Gravett were organisers and
then you said, 'and others'.
A. Yes.

Q. Which others were you referring to?
A. Mr. Morris and the other two names that were on the
writs.

Q. Right.
A. That was Farrell and -- now the name escapes me but,
yes, the five names that were on the writ.

Q. And the basis of that was?
A. The strength of the agency's report.

Q. The notes that have been disclosed, the evidence that is in
front of us from the inquiry agents from their statements
and their notes?
A. Yes.

Q. That is what you are referring to?
A. Yes.

Q. You are not referring to any other notes or evidence that
we have not seen?
A. No. (Pause).

MR. JUSTICE BELL: What is the problem?

MS. STEEL: The problem is that my papers are not sorted out
and I am completely disorganised.

MR. JUSTICE BELL: What is your estimate for finishing
cross-examination Mr. Nicholson, because we cannot have
people just coming back into the witness box and standing
there waiting for questions. Quite regardless of any
antagonism there may be in the case Mr. Nicholson, as far
as I am concerned, is just another witness in the case.
