Day 080 - 30 Jan 95 - Page 52

Q. What in a port somewhere?
A. Yes, in a bonded warehouse. For us to have 83 tonnes
over the period we did, they bring it in in ship loads and
they would serve it us from bond; not from Brazil.

MS. STEEL: To be honest, I find these forms quite hard to
understand, but basically the 30 tonnes and the date does
not tally with any of the other consignments as they were
broken up, as Mr. Rampton broke them into five
consignments. So, I am having difficulty understanding.

MR. JUSTICE BELL: Let us have a look for a moment. If you look
in tab 3 in the bundle which you have there, Mr. Walker,
11 -- have you got volume 11?
A. Yes.

Q. If you look at tab 3?
A. That appears to be in German in this one, sir.

Q. The 3 after tab 5?
A. Yes, sir.

Q. Page 1 seems to relate to the first consignment. It is
July 1983?
A. Yes, sir. It is very hard to see.

Q. Turn on to page 10. That was the second consignment on
around 14th -- around September 1983.
A. Yes.

Q. Page 12, the 3rd, around January 1984.

MS. STEEL: Well, the thing with the third consignment ----

MR. JUSTICE BELL: I am not going to ask any question. I just
want him to see how the documentation was arranged
according to Mr. Rampton.

MS. STEEL: The thing with the third consignment is that the
invoice date is December 1983, beginning of December 1983.

MR. JUSTICE BELL: If we just go through the others and then by
all means take your point. Page 17, it was suggested, was
the fourth consignment and that is around April 1984. E,
it was suggested, was the fifth consignment and that is
around July or so 1984. Ask your question again. You were
suggesting you could not tally page 6 with the
documentation we had earlier.

MS. STEEL: Could you explain what page 6 represents and how it
fits in?
A. That is an order going out from the buying office. It
is quite straightforward: "For 30 tonnes in three 10 tonne
lots of Brazilian 95 AL forequarter on pallets from bond.
Under the A scheme health certificates are required." It
is a straightforward purchase order. It is dated 4th
January 1984. So the invoice for it would be about 28 days
later.
