Day 152 - 11 Jul 95 - Page 73

Q. He was in charge of scheduling for some of the period which
you were Manager at the store in Colchester?
A. I do not believe I said that.

Q. OK. In his statement he said: "For a period of about
three months I was responsible for the staff schedule".
Then he gives a chart in his statement. Have you read his
statement? You must have read his statement because you
have commented upon it?
A. Yes, I do not remember the chart being in there, to be
quite frank, anyway, yes, I will take your word that it is
there.

Q. You did comment on the various sections of his statement?
A. Yes.

Q. He says in his statement which you have read and commented
on: "When I was under 18 I regularly worked past midnight
which would be illegal. You were told to clock out at
midnight and written by the side of that day on your clock
card would be something like, 'Plus X hours bonus' or just
'Plus X hours", and various bits and pieces. Then he
says: "Under 18 year-old males working past midnight was
the norm. In my entire three years at McDonald's, in all
the stores I worked, I doubt whether there was an under 18
year old male full-timer who never worked past midnight",
i.e. he is saying that illegalities were occurring on a
grand scale at McDonald's. You have said it did not
happen. Are you saying categorically it did not happen or
it did not happen to your knowledge?
A. I am saying as far as I can be certain, of which I am
fairly certain, it did not happen during my time at
Colchester. I certainly was never made aware of Simon
Gidney specifically being asked to work past 12 o'clock
when he was under 18, and I would be extremely surprised if
he did.

Q. Can you think of any reason why Mr. Gidney should want to
say all that if it was not true?
A. No.

MS. STEEL: Just before we leave the scheduling, perhaps you
could get Mr. Gidney's statement out? It is in the bundle
with the pale blue label on it; I think directly in front
of you it should be.

MR. JUSTICE BELL: II.

MS. STEEL: Is it bundle II?

MR. JUSTICE BELL: Volume pale blue II.

MS. STEEL: Then I think it is tab 7; it should be.
A. Yes.

Q. If you turn to the fourth page of his statement there
should be the schedule there. Do you have that?
A. Yes.
