Day 246 - 09 May 96 - Page 59

  Q. Do you know if the imposition of that tax, as it affects
McDonald's, has resulted in less disposable packaging being
used by McDonald's in those stores that are affected?
       A. I think in certain stores in Germany they have a
reusable cup programme being trialed. Whether at the end
of the day it has effected the totality of environment,
I do not know. I am not sure the test has been concluded
yet, but I do believe there is a couple of restaurants --
and by a couple I do not know whether I mean 2 or whether I
mean 20, I just do not know -- doing some kind of reusable
       cup test, yes.

  Q. Right.

MR. JUSTICE BELL: I think part of the question is, that being so
do you know whether that is a response to relevant
       taxation?
       A. I would be surprised, sir, if it was not.

MR. MORRIS: Right. I think that is all we need to deal with on
that particular matter. If I can just collect my thoughts.

MR. JUSTICE BELL: Sit down for a minute, and if you want to sit
       down, Mr. Preston, do so.

MR. MORRIS: We are moving much faster than I thought we would
       on this.

MR. JUSTICE BELL: If you can give a time indication when we rise
about how much longer you expect to cross-examine Mr.
       Preston it might be helpful.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: But concentrate on what you are going to do
       next first of all.

MR. MORRIS: Right. (Pause). Just one thing to emphasise, in
the Clive Harris Financial Times article, which you
verified as being based on an interview with you, there was
a reference to the UK phasing out foam packaging following
what happened in the States. I know that never happened,
and there is in the Defendants' second supplementary list
of documents, number 10, I do not know exactly where it is,
if I can just read it, maybe we ought to get it just to
emphasise that particular point. It is the Defendants'
       second supplementary list No 10.

MR. JUSTICE BELL: Do you know which bundle that is?

  MR. MORRIS: Sorry.

MR. JUSTICE BELL: If it is the second supplementary list I am
not sure we can just work on the bundles, because I think
some of the documents in the second supplementary list are
       in Defendants' supplementary list bundles.

MR. MORRIS: Yes, I do not know if...

MS. STEEL: I think for some reason they got called
