Day 121 - 04 May 95 - Page 47

least bit interested in any other person's view of it.

MR. MORRIS: In your investigations, were you satisfied that the
Manager had pressurised the lobby hostess to make that
       call?
       A. I was satisfied that a proper investigation was
undertaken by a combination team of the personnel, regional
personnel, and regional security department, and that they
came to the right conclusion, that the three persons
involved should be summarily dismissed. What happened to
them after that, was a matter for the Newcastle City
       Police.

  Q. But are you satisfied in your investigations which were
       very detailed, were they not?
       A. Not mine -- the regional.

  Q. Your Company's investigations were very detailed?
       A. Yes.

  Q. You took statements from over a dozen witnesses?
       A. Yes.

  Q. I do not want to get them all out now. We have the papers,
as far as I know, all the papers, to do with that. Are you
satisfied that the Manager, Pati Maheron, had pressurised
Helen Caulderwood to make that hoax phone call?
       A. I do not know that "pressurised" is the right word. As
I understand it, there was a discussion between three
members of the staff and it was agreed that Helen
Caulderwood would make the telephone call.

  Q. Why would she do that? What did you find from the
       investigation?
       A. I have no idea why she would do it.

MR. RAMPTON: My Lord, there really is not any point in Mr.
Morris asking Mr. Nicholson about this. The whole of the
progress and the evidence taken during the course of
McDonald's internal enquiry is recorded in the documents,
all of which have been disclosed. What is the point of Mr.
Morris asking Mr. Nicholson to recall from memory what the
investigation found? It is an idiotic waste of time, in my
       respectful submission.

MR. JUSTICE BELL: Whether it is idiotic or not, what is the
point of asking Mr. Nicholson? What do you gain which is
       there not already?

MR. RAMPTON: Yes, my Lord. The reference is volume XV, tab 104
       to 106.

MR. MORRIS: I was just trying to avoid going into the
paperwork; maybe we will leave that ---

MR. JUSTICE BELL: I think so, yes.

MR. MORRIS: -- to one side. Can I ask just for a bit of advice
on that? Is all the paperwork in that tab admissible
evidence, if they are signed statements?
