Day 152 - 11 Jul 95 - Page 71

in. So, for instance, if it was 7 till 2 we might write 7
a.m. just as an indicator. I never remember it really
being a problem. Basically, the people would know what
their hours of availability were usually.

  Q. But in terms of if, say, it was 11 till 7, as in the first
column, it would be assumed that was the day-time one
unless somebody wrote 11 p.m., would it, and it was an all
       night shift?
       A. Yes.

  Q. I do not know if you could get the Defendants' documents.
It is in one of the blue bundles. It is bundle IV and then
turn to tab 17, please. The pages are not numbered,
unfortunately. It is actually closer to the back of that
particular tab. There is a time record ----
       A. The first of the 11th 87 written on it?

  MR. JUSTICE BELL: Yes.

MS. STEEL: That is the one, yes. Is that the, is that an
example of a schedule that you would use or is that a
different kind of form to the one that you are ----
       A. It is the same format, although I would have to say
that the schedule that we would use would be more fully
filled out that the one, the example given, in that the
       columns would be filled in.

  Q. Which, oh, the ones on the end in the right-hand column?
       A. Well, if column 2 and 3, for instance, that is the
columns I referred to when you are talking about male or
female and under or over 18.

  Q. Yes, I think they are filled out, are they not?
       A. Not on the copy I have.

MR. JUSTICE BELL: No, there is not ----

THE WITNESS: Sorry, second page is; the first page is not.

MR. JUSTICE BELL: It is on the second page but not on the
first, because although -- they would not expect to see a
cross on the first page because it has over 18 on all of
them at the top of the column; but you might expect they
are either male or female and there is not a mark for
that. So all that has happened on the first page it has it
written in over 18, but it does not say whether they are
male or female, although, presumably, the Manager would
       always know.
       A. OK, thank you.

MS. STEEL: Is this a, obviously without the bits that are
filled in, is this exactly the same format that you used to
       use in Colchester?
       A. Exactly the same format, yes; obviously the detail on
       it is different.

MR. JUSTICE BELL: I see Kay Thorely there was scheduled for
five days but appears to have worked no hours at all
because he or she was sick.
