Day 042 - 31 Oct 94 - Page 36

MS. STEEL: When I looked at it closer up last night, I did not
think there were any adults in there, apart from the
characters that are from McDonald's Land. I cannot see
       from here, to be honest.

THE WITNESS: If it helps, there are a number of Ronald
commercials that we have with children in that do not have
adults in. That is not a problem.

MS. STEEL: That is mixing fantasy with reality again, though,
       is it not?
       A. What, in this instance?

  Q. Because it is directly outside a normal McDonald's store?
       A. How they got there was not exactly normal, but it is a
replication of the store in a ghost train scenario, yes.

MR. MORRIS: But it is not a fantasy like on the moon with
       puppets, is it?
       A. It is a different kind of fantasy.

  Q. It is a mixture of fact and fantasy, is it not?
       A. Yes, in terms of the restaurant itself looks realistic.

MR. JUSTICE BELL: What is the criticism of mixing fact and
fantasy -- so that can I follow? Is it a criticism made by
       one of your witnesses?

MS. STEEL: It is the effect of it, really. There is a mention
in the ITC guidelines about children's ability to
distinguish between fact and fantasy varying, according to
age. Really, it is kind of on those lines.

MR. JUSTICE BELL: Take it up later. It was just that, if there
was an obvious point and I was missing it, I would like to
       be told.

MS. STEEL: There is something else, but I think we might leave
       it until-----

MR. JUSTICE BELL: What are you looking for now?

MS. STEEL: If we just carry on for now, and we will come back
       to it, if necessary.

MR. JUSTICE BELL: We are not very far away from the midday
adjournment, so if you want to identify something you can
do it during the break and come back to it at two o'clock.
       Yes.

                 (The next advertisement was shown)

MS. STEEL: The box that was shown there in Ronald's hands, is
that a box in which McDonald's products are commonly sold,
       in polystyrene?
       A. Yes.

MR. JUSTICE BELL: That was a Big Mac spinning around in the
       middle, was it?
