     3   MR. JUSTICE BELL:  Provided it is not an insubstantial amount,

     6   MR. RAMPTON:  All I will say is that it is well into the
     7        hundreds per day.

     9   MS. STEEL:   That is not the information that we were seeking.
    10        We were seeking the cost of a copy, as in how much
    11        journalists would be charged if they asked to purchase a
    12        copy.

    14   MR. RAMPTON:  That is information which the Defendants may seek
    15        quite separately from Barnett Lenton or anybody else.

    17   MS. STEEL:  Which is what we were seeking.  I do not understand
    18        why -- if the Plaintiffs know how much it is, perhaps they
    19        can tell us in private.

    21   MR. JUSTICE BELL:  Tell me what difference it makes in
    22        principle, because I am not going to rule on or advise
    23        McDonald's about what they should or should not do in this
    24        case.  If I have a power to order them to do something,
    25        then I will consider whether I should.  If I reach the
    26        conclusion that I do not have any power, then I do not have
    27        to look.  It obviously follows as to whether I would
    28        exercise it if I did have the power.

    30   MS. STEEL:   It has a bearing on whether we are able to afford
    31        to pay for copies of transcripts.

    33   MR. JUSTICE BELL:  Whether you would?

    35   MS. STEEL:  Yes.

    37   MR. JUSTICE BELL:  You could have asked about that yesterday
    38        evening or this morning.

    40   MS. STEEL:  We were told a specific figure which, obviously,
    41        I will not say, but it was a lot more than we could
    42        afford.  However, that was, I think, for provision --
    43        I think that is different to what journalists are charged
    44        when they just want to buy a copy of it; and that was what
    45        we were specifically trying to find out today.

    47   MR. JUSTICE BELL:  I will hear what Mr. Rampton says, and then
    48        I will give you an opportunity to make a telephone call to
    49        Barnett Lenton, and see if you can find information before
    50        I make a decision.

    52   MR. RAMPTON:  My Lord, I no longer have very much to say.  I do 
    53        not really feel involved in the question of whether
    54        Order 68 provides your Lordship with any power or
    55        discretion to provide the funds for the Defendants to have
    56        the transcripts.

    58        If your Lordship wanted help from me, I would merely say
    59        that it is quite apparent from the construction of the rule
    60        that rule 5 applies to appeals, rule 1 applies to trials at
