     1         "Schedule, to include Sunday work breaks due and total
     2        hours for all hourly paid employees including Floor
     3        Managers, nought out of 40."

     5        Was any disciplinary action taken at that time?  It seems
     6        to be a continuing problem; or did the Manager give you a
     7        good talking to, or what?
     8        A.  No, I do not recall.

    10   Q.   You do not recall that?
    11        A.  No.

    13   Q.   You would remember, though, if you had been given a good
    14        talking to, would you?
    15        A.  I would remember if I was given a warning, an official
    16        warning.

    18   Q.   It says there: "18 out of 40 for early/late.......(read to
    19        the words)....... under-18s."  So, does that indicate that
    20        is a continuing problem, from what we saw before; or do you
    21        remember the problem you had at the time between scheduling
    22        under-18s and their correct hours?  This is 18 months ago,
    23        15 months ago.
    24        A.  Well, as I say, I did not complete the audit.  It is
    25        under half, just under half McDonald's marks.

    27   Q.   When an audit is done, do you not get, you know, called in
    28        to the Store Manager and say: "This is what we achieved and
    29        this is what let the side down, and this is outrageous,
    30        something should be done", or -----
    31        A.  As I say, it would be individual Managers who are in
    32        charge of this area of personnel, or Human Resources, their
    33        area.

    35   Q.   So, it is just a question that the Store Manager chats with
    36        someone from the Human Resources Department about
    37        the -----
    38        A.  No, an individual Assistant Manager within the store
    39        who would be responsible for the personnel administration.

    41   Q.   Personnel administration.  Who is in charge of personnel
    42        administration?
    43        A.  I cannot answer that, because I cannot remember who was
    44        in charge of it at the time.

    46   MR. JUSTICE BELL: To go round in a circle, what you are really
    47        suggesting is that Mr. Henden was responsible for doing the
    48        schedules?

    50   MR. MORRIS:  And shift running, as well.

    52   MR. JUSTICE BELL:  Let us concentrate on the schedules.  He ran 
    53        the shifts from time to time; he was the person who was
    54        doing the schedules; and he got nought out of 40 on two of
    55        these audits.

    57        (To the witness)  Did you know that you got nought out of
    58        40 on two of them?  I say you; I mean it was the store, but
    59        you were the person who did the schedules, as I understand
    60        it?
