Day 205 - 17 Jan 96 - Page 33

MR. MORRIS: I want to do a bit of preparation before the
Brazilian one. Probably that one, probably the Brazilian
one next. There are some statements I wanted to serve, and
that is very important to do before the end of the day.

MR. RAMPTON: We have been served with some additional
statements: Alimi, North, Millstone and Mainprice. I say
no more than we have them at the moment. They ought to be
deferred, because they require thought. It is very likely
I shall take objection to all or some of them. So, perhaps
that is better left until we have had a chance to digest
       them; not today.

I can tell your Lordship about Ryan and Lynval as well, but
I will wait until after the adjournment.

MR. JUSTICE BELL: We will resume at five past two.

                       (Luncheon Adjournment)

  MR. JUSTICE BELL: Yes.

MR. MORRIS: I would like to sort of carry on as we are going,
really. I have got the Brazil ones that I have not got in
my documents. I checked at lunchtime. I am aware they are
       obviously pretty urgent.

MR. JUSTICE BELL: Well, there is no point in dealing with it
unless you are absolutely in a position to deal with it.
I will need some help with that, because although I have
read Mr. Morganty's statement and I have tried to relate it
to the map, you will have to take me through in some
logical form to explain what your argument is.

  MR. MORRIS: Right.

MR. JUSTICE BELL: The longer you let it go, the nearer you get
       to Mr. Cesca's evidence.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Can I fill in? Next week we have got the
Plaintiffs' Bath witnesses. Have days been allocated to
       particular witnesses?

MR. RAMPTON: I am not sure. Mrs. Brinley-Codd will tell me,
I hope, that I can tell your Lordship what the order is.
It will be Mr. Hendon on Monday, and Mr. Cox and
Mr. Perrett after that. We are going to have them all
       here.

MR. JUSTICE BELL: Mr. Cox and?

MR. RAMPTON: Mr. Perrett. Just so there are no gaps, I am
going to have them, I think, all hear from the beginning of
the week. As best I can, I am going to try and ensure that
there are no gaps, so that we can maybe finish them in two
and a half to three days.

MR. MORRIS: Mr. Logan has confirmed that he is able to come on
