Day 057 - 29 Nov 94 - Page 48

operations manual clearly states that they compile accident
statistics, and that is the operation manual that is
produced in the US and distributed, as far as we can see,
       worldwide.

MR. JUSTICE BELL: Where does your understanding come from?

MR. MORRIS: You may remember it was brought up earlier on when
we questioned Mr. Preston I think. It was referred to in
the operations manual on a chart showing the most
       common ----

MR. JUSTICE BELL: Why do you not wait and see what is in this
letter and then, if you are saying, that is all very well
but it is inconsistent with this document or that document,
you can tell me about it. Apart from anything else, if you
get the British statistics you may be able to see to what
extent they advance the matter one way or another. All the
most reputable companies unhappily suffer the misfortune of
accidents to their employees. What you want to know is
whether out of a workforce of 31,000 there are hundreds or
thousands of people having accidents every year, or whether
there are just a few hundred each year, as there must be in
almost any large corporation in the country.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: What I suggest is wait until you get the
English ones and wait until you get this letter, and you
can come back in relation to that. What I am anxious not
to do, and I think I have been pretty candid about this, is
set McDonald's an enormous literally paper-chase across,
what is it now, 51 States for a purpose which may not help
much one way or the other. So rather than jump into doing
that or, conversely, jump into saying, no, I do not think
it is worth it, I would like to see what the information
       is.

MS. STEEL: Moving back on to slaughter of animals, Keith
Kenny's appendix is down by mistake. It was something
I wanted to check with Dave. He misunderstood what I had
said and put it down on the list. So we can forget that.

MR. JUSTICE BELL: So I can cross that out.

  MS. STEEL: Neville Gregory.

MR. JUSTICE BELL: Remind me about that.

MS. STEEL: Well, there were a few points. I cannot remember
what they were. I am sure there is more than one. I have
found one example anyway of where I asked him about whether
he made notes about something. He said he would go back
and look and that he would send the information on. There
is one example which is on Day 20 which is 28th July. On
page 31 right at the bottom it says:

"You cannot remember the length of time between stunning
and neck cutting? No. This is information which I will
send back to the court when I return to Bristol tomorrow.
