Day 079 - 27 Jan 95 - Page 64

asking question after question on that. There has to be
some control on it. What other aspects do you want to ask
       about?

MS. STEEL: I do not think we are going on indefinitely. We had
virtually finished this and then Mr. Walker suddenly raised
a new test, and we had to ask him about that.

MR. JUSTICE BELL: I am just asking you to tell me what other
aspects you want to ask about in the processing there.

MR. MORRIS: There is paragraph 30 I want to ask about as well.

MS. STEEL: I am still not clear what he is saying about these
tests as well. Initially he said one per pallet, then it
was one per box and then it was one per box on top of the
       pallet.

MR. JUSTICE BELL: What is the answer to that? Is it one from a
box on top of each pallet?
       A. It is one from each box on the top of the pallet, my
       Lord.

  Q. So you just take the top storey, as it were?
       A. You cannot destroy the whole pallet.

  Q. No. You take the top storey of boxes?
       A. You open the boxes and take a burger out.

  Q. You take a burger out of each of the boxes on the top
       storey?
       A. Yes, sir.

MR. MORRIS: You do that for every pallet, do you?
       A. Yes, we do.

  Q. How many pallets again go through at the end of the line,
approximately, sorry at the end of all the lines?
       A. I am sorry, I am getting tired, I cannot work that out
without a calculator. If you give me a calculator I will
       tell you in two seconds.

MR. RAMPTON: My Lord, does it matter? Every box of every
       pallet is checked.

MR. MORRIS: Well, I am going to say that I think the witness is
lying. I do not believe that McKey's take thousands of
       samples.

MR. JUSTICE BELL: You are cross-examining. You are not
       addressing me.

MR. MORRIS: I am trying to justify why I am asking these
       questions.

THE WITNESS: My Lord, I object to that statement being called a
liar. We throw away hundreds of burgers a day on testing,
hundreds and hundreds, and no-one in my profession has ever
called me a liar. I am sorry, sir.
