5 that he was talking of percentage, Mr. Stein was talking of

15 those who had been investigated.

19 MR. JUSTICE BELL: So they were completely at odds as to the
20 approach to take.

22 MR. MORRIS: Yes. I think it is equivalent to saying you do not
23 have any records when you know that you can get the
24 information through other means by making all due diligent
25 inquiries of all the relevant official, in Mr. Stein's
26 recent statement.

28 But if you look at the middle of that page, Mr. Lantos
29 said: "Therefore, only those 200 and 300 potentially could
30 be cited are we in agreement?" "That is correct,
31 sir." "Accepting your figure of 200 to 300, the violation
32 therefore is not one per cent, but it is from 7 to 10 per
33 cent. Do you agree with that?" Mr. Stein: "That is
34 correct, sir."

36 So, we are talking about something from between 7 to 10 per
37 cent, as accepted by Mr. Stein, of all franchisees
38 investigated have been cited for child labour violations.
39 That is, we are not talking about other violations, just
40 child labour violations, child labour law violations.

42 MR. JUSTICE BELL: What at the moment I do not understand --
43 I mean, that might be like saying that of every 100 people
44 against whom allegations of crime are made, 10 per cent are
45 charged or whatever. You see, what I do not know, and you
46 may be able to tell me, is whether before there is an
47 investigation there is some reason to believe that there
48 have been transgressions. But, anyway, that is another
49 point; that is not on interrogatories.

51 MR. MORRIS: I believe it is dealt with in that testimony, that
52 it is mostly random.

57 sweep that was done.
