2 Q. Is there anything incorrect in what Mr. Gidney has written
3 there, in your opinion?
4 A. Yes. He is inferring in his statement that the
5 percentage, labour per cent, was the be all and end all
6 and, in fact, the more important facets of the scheduling
7 was to ensure that we had enough people on at any given
8 time. The labour per cent could vary within a given range
9 according to the need of the customer flow coming into the
10 restaurant.

12 Q. If the labour per cent was not the be all and end all but
13 it was the key?
14 A. It was not the key.

16 Q. You would not accept that?
17 A. Not at all, no. It was a by-product. It was something
18 we looked at but it was a by-product of the actual
19 scheduling process.

21 Q. Did you train Mr. Gidney in how to schedule the -----
22 A. I may have done. I cannot specifically remember doing
23 it.

25 Q. You do not know?
26 A. It may have been something I would have delegated to a
27 First Assistant Manager who may have trained him to do it.
28 As I said, I do not actually remember him doing the
29 schedule.

31 MR. MORRIS: What was the labour percentage at Colchester
32 generally while you were Manager?
33 A. As I remember, it varied between 14 and 17 per cent,
34 something like that.

36 Q. You said that under 18s were something between 30 and 50
37 per cent of the staff in Colchester in your evidence
38 in-chief when you were asked by Mr. Rampton?
39 A. Yes.

41 Q. If you have that kind of level of under 18 year olds
42 working for you, there is going to be a great deal of
43 temptation, is there not, Mr. Davis, that when you need
44 people to work past 10 o'clock or past 12 o'clock, if they
45 are male or female that are available, to have under 18
46 year olds who are a large bulk of your available staff to
47 work past that time, is there not?
48 A. Well, for one, 30 to 50 per cent is not the largest
49 bulk. So the largest bulk is the people who are over 18
50 and, therefore, we had enough people who were able to work
51 past 10 o'clock and past 12 o'clock. So, no, there was not
52 a temptation.
