Day 130 - 26 May 95 - Page 39

or not, so if there is -----

  Q. What I am saying is that you would know if someone was off
because, even if it happened on a Friday, they would be
back on the Monday, but, with McDonald's, if someone is
only doing 20 hours, they may not have been scheduled for
       another week, so ---
       A. I agree to the extent -----

  Q. -- you do not know?
       A. It is down to the Restaurant Manager to contact them.
Part of what we teach is the accident reporting as well,
and what we used to call the intermediate Operations
course. I believe the name has changed these days, but we
go through that accident reporting procedure with them, so
they know it is their responsibility to follow up.

  Q. But in reality?
       A. It happens.

  Q. In reality, the Manager would have to be pretty dedicated
to phone up someone who has had an accident three days
later who was not scheduled or not scheduled for more than
another week, and say: "Are you still off work?" When
obviously they would still be off work because they were
not scheduled anyway. How do they decide whether they are
off work because they not scheduled, or -----
       A. They asked them could they come into work today. That
is really the criteria. As I said to you, our stores are a
very close community. Certainly, as a Restaurant Manager,
if one of my crew were hurt, I would want to know how they
are getting on. I would ring them up and find out almost
every day how they were getting on.

  Q. The reality is that, compared to a job that is based around
a guaranteed working week, a structured working week, the
same week every week, and one that is McDonald's system,
chosen system, it requires extra -- what is the word?

MR. JUSTICE BELL: You have to make a positive effort rather
       than finding out willy-nilly?
       A. Yes.

MR. MORRIS: I could not think of the word. So, it is quite
possible there that might be one of the areas of
non-reported RIDDOR accidents, which you calculated at 20
per cent of reported, maybe going up near 90, nearer 90
than 80 per cent in more recent years, so that would be one
of the areas that would be more difficult for managers to
       ensure they reported?
       A. As we just agreed if somebody only is working, say, one
shift a week, yes, it will require their effort to follow
it up, and I suppose there is a possibility they might not
do it. AsI said, we might not be perfect for accident
reporting, but we have an extremely good record. We
recognise the legal obligation to do that.

  Q. On AAA, Gloria Saul in the second one. Actually in the
first one we note that she got some kind of chemical
splashed in her eye, but the second one, "put foot down
