Day 182 - 02 Nov 95 - Page 20

not object to that, although it is -----

MR. JUSTICE BELL: I am going to have to allow some in and ---

MR. RAMPTON: Yes, I agree, but what we -----

MR. JUSTICE BELL: -- sift some out at the end of the day, if,
as I keep saying, the detail of things like this is going
to make one jot of difference.

MR. RAMPTON: I agree but I know what is coming. Mr. Morris is
now going to ask Mr. Jenssen on the basis of that piece of
hearsay evidence to speculate why it is he did not know
       before.

MR. MORRIS: Can you give a reason why you yourself did not tell
McDonald's or other workers at the store that you were a
       union member?
       A. That was at a time I believed that it was a sackable
offence or that McDonald's would take action against me if
they knew I was a union member.

MR. JUSTICE BELL: Pause there. Yes?

MR. MORRIS: We have heard that there are certain provisions in
the UK and US Crew Handbook. Do you have a Crew Handbook
       in Norway?
       A. Yes.

  Q. We have heard there are certain provisions in the Crew
Handbook in the UK against holding any unauthorised
meetings with crew members or putting up posters or
distributing any literature in store or collecting
subscriptions. Are any of those points familiar to you as
       regards Norway?
       A. Yes, well, the Crew Handbook states that you should not
use the working area for your own interests, something like
       that.

  Q. There is no specific thing -----
       A. There is no specific thing about unions or about
meetings. It does say McDonald's does not disagree with
crew members meeting on the outside, a social meeting on
the outside of the restaurant after work, but they -- but
while at work you should have a professional attitude.

  Q. OK. What happened then? You contacted the union; what
happened following that? How did the agreements come
about? You have already said something in your statement,
but have you anything further to add from what you have
already said in your statement? There was a strike threat,
       you said, yes?
       A. Yes. Well, there is negotiations between -- if
McDonald's would not agree to a collective agreement right
away, there has to be mediation by an official mediator and
the HRAF and McDonald's were in that process at this time,
were quite -- they have come quite far in that process, and
I believe this was two weeks or so before the agreement was
       actually reached and -----
