Day 187 - 13 Nov 95 - Page 14

MR. JUSTICE BELL: Is there any objection to that, Mr. Rampton,
       if it helps?

MR. MORRIS: This is an official McDonald's document.

MR. RAMPTON: I do not care what it is. I am saying that to
Mr. Morris, through your Lordship. I have not had a chance
to look at it. It may be, it may not be. I do not know
what language it is in. It really is intolerable, the way
Mr. Morris carries on as though your Lordship had never
made any kind of ruling at all.

MR. MORRIS: Of course, the fact that it has happened for at
least 30 or 40 other witnesses called by the
       Plaintiffs -----

MR. JUSTICE BELL: If you do not like my ruling, go to the Court
of Appeal on it. But you must observe the ruling.

  MR. MORRIS: All right.

MS. STEEL: Why does it only ever apply to us, though -- because
they brought documents last week that, you know, we had no
       chance to see?

MR. JUSTICE BELL: The reason is this, because when we have had
documents in the past -- I am not suggesting it is done on
purpose -- but the effect is that I let a document be put,
and then there are questions in relation to that which
bring in a whole lot of consequential evidence which rides
a coach and horses through the ruling I made about three
weeks ago. That is why. It is ---

MR. MORRIS: There has to be some flexibility.

MR. JUSTICE BELL: -- done on the basis that here is a document
which might be helpful, but that is just a key to the door
to adduce further evidence in breach of my ruling; and that
is what I am anxious about.

MR. MORRIS: Yes. I understand -----

MR. JUSTICE BELL: If you have a point in mind -- forget the
hierarchy document for the moment -- if you have a point in
mind, just go straight to it, and I can see whether you are
going way beyond anything in any written evidence you have
disclosed or whether it is what I would call a legitimate
       explanation.

MR. MORRIS: If Mr. Rampton is happy to look at this document,
it is actually McDonald's own -----

MR. JUSTICE BELL: Forget McDonald's. He may well, during the
course of the day, have a glance at these documents, but
forget the document for the moment. I do not know what
I will make of the evidence at the end of the day, but you
have three and a bit pages of statement left, with quite a
lot of material in, and I think you would be best served
just by getting the statement out. By all means, ask for a
