     1   MR. MORRIS:  I have made a couple of calls, but mostly the
     2        problem is that I have not put enough energy into it
     3        because, to be honest, we have about four subjects going on
     4        concurrently at the moment in this case, and I find it
     5        really hard just to cope with the amount of paper work.

     7   MR. JUSTICE BELL:  I think you should make a good effort to get
     8        in touch with him and say:  "Look, we are all waiting for
     9        what you are going to produce".  The first thing you need
    10        is something from him in writing, is it not?

    12   MR. MORRIS:  Yes.  He is sometimes quite difficult to get hold
    13        of.

    15   MR. JUSTICE BELL:  Right.  Do your best.

    17   MR. MORRIS:  There is also the question of discovery from the
    18        Plaintiffs.  I do not know when that is happening.  Do you
    19        remember, there were documents that we went through that
    20        you said they should provide?

    22   MR. JUSTICE BELL:  Yes.

    24   MR. MORRIS:  I think Helen spoke to Barlow Lyde & Gilbert and
    25        they said there was a file being prepared.  I would like to
    26        know when.

    28   MR. RAMPTON:  What happened was that Mrs. Brinley-Codd told
    29        Ms. Steel on Friday that Mrs. Brinley-Codd would do it this
    30        week and so she will; it is Monday today.

    32   MR. JUSTICE BELL:  Put that on your list of procedural things to
    33        be dealt with which must I think -- I do not want to deal
    34        with them on the Wednesday, the last day of term.  I would
    35        prefer to deal with the remaining procedural matters -- may
    36        be we would start the day by me giving judgment on the
    37        matters we heard quite recently; go on with the other
    38        procedural matters; make sure that is on a day which is few
    39        days before the end of term so that if it throws up some
    40        other loose end, we have done our best to tie that up
    41        before we break up for Christmas.

    43        But let us get on with Mr. Van Erp in the morning.  Find
    44        out about Ms. Dibb.  Apart from anything else what occurs
    45        to me is that if, for instance, we were able to start
    46        Mr. Oakley on Thursday, hopefully, he would finish that
    47        date; if he did not and he was just rolling into Friday
    48        morning, it would obviously be much better that we carry on
    49        with him, finish him and then start Ms. Dibb.  So one wants
    50        to know, if we did not finish her by Friday evening, could 
    51        she roll into Monday.  But try to get a cluster of days 
    52        from her, apart from Friday, when she would be good enough 
    53        to come to court to complete her evidence.  10.30
