Day 195 - 04 Dec 95 - Page 36

was on that day, but whatever I say will be really a
deduction from other days, that, you know, it could
have -- it may have been at that time that we generally
finished at 2 o'clock in the morning.

  Q. So we are relying on your statement to give a general
       indication?
       A. That is correct, yes.

  Q. So why did on some days when you got home you wrote, say,
the exact time you finished, say on 28th March?

MR. JUSTICE BELL: Has he not given the answer to that in answer
to Ms. Steel's intervention a moment ago? If he has
written it in beforehand, for instance, realises he is not
going to work 12.00 to close but 3.45 to close, that is
what he writes in; if he writes it in afterwards, he puts
the time when he actually finished. I am not suggesting
this happened 100 per cent of the time, but that is what
you are saying your system was by and large with your
       diary?
       A. Yes.

  MR. MORRIS:  OK.  I obviously will not go through them all;
Mr. Rampton can if he wants.

MR. JUSTICE BELL: If you are aware of a particular point and
want to make it, do now rather than just leaving us to look
       later.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: I see the accident is 3rd May 1986.

MR. MORRIS (To the witness): Is that correct? 3rd May 1986, is
that the one you talked about in your statement?
       A. Yes, that is correct.

  Q. On that day you finished at 2 a.m. in the morning?
       A. Well, I finished -- I was sent to the hospital then at
that time but the close had not finished yet.

  Q. So that was a day when the close was going on beyond
       2 o'clock in the morning?
       A. Yes, I believe, I mean, I can -- I do remember that
when I came back after the check up, I do not know how long
that took, but when I came back the close was still going
on. So, I went with Steve Harney to the hospital and came
back after maybe an hour, an hour and a half, and the close
       was still going on.

  Q. If we go back to April 7th, Monday -----

MR. JUSTICE BELL: Just pause a moment. Are you saying that
2.00 is when the accident happened or when the close
finished, you having already come back?
       A. No, at 2.00 or approximately, I was sent to the
       hospital.

  Q. Did you work after you came back from the hospital?
