Day 132 - 07 Jun 95 - Page 42

  Q. That does not give any guarantee, though, that the people
are given the training, does it?
       A. No, indeed not, but it is, as I understand, part of the
system and it is certainly the norm that it is given.
Obviously, I cannot comment about the individual.

  Q. When you say "norm that it is given", it may be the norm
that it is specified that it should be given?
       A. No, I believe -----

  Q. You do not know what the norm it?
       A. I believe that it is the norm that it is given. I know
the systems, I have talked to the managers, I have talked
to people in restaurants. I believe it is the norm that it
       is given.

  Q. On page 24, your summary of general points on looking at
all the Defence witness statements you conclude in point 4
at the top: "Much play is made of the pressure of work and
       the need to run".
       A. Yes.

  Q. Then you say something about: "It is specifically stated
that hustle should preclude the need to run". The pressure
of work, when you say "much play", should it not concern
you if a body of McDonald's ex workers make signed
statements where a common theme is of the pressure of work
which could lead to safety implications?
       A. Not -----

  Q. Should that not concern you?
       A. Not specifically. If we had taken 20 workers at random
and asked for a statement on hustle and they had all come
out with it, yes, it would concern me, but these are
statements from people who clearly feel that they have been
aggrieved in some way, shape or form and, as such, it is
       not a representative base.

  Q. How do you know that?
       A. Because, by definition, you have asked them to make a
claim because they feel that something is wrong. That is
entirely their right to say so.

  Q. So you would think the same if you spoke then to management
that, obviously as management are loyal to the Company,
their word should not be taken as evidence of what
       conditions are really happening ---
       A. I did not say that at all.

  Q. -- in the stores?
       A. I did not say that at all.

  Q. That would follow, though, would it not?
       A. No, not at all. What I am saying is that the people
who have made these statements are necessarily
representative basis -- representative of the whole of
       McDonald's crew members.

  Q. So you could safely ignore them then?
       A. I did not say that at all. That is your words -- not
