Day 181 - 01 Nov 95 - Page 67
but he is happy to come on December 4th, which I was going
to indicate. I had him before as 16th and 29th. I vacated
29th, as far as he is concerned, and moved him to December
4th which is a Monday which he is happy with. He may -- it
is possible -- take only one day.

MR. JUSTICE BELL: I think that is very much up to you. I have
obviously looked at quite a bit of documentation in
relation to him on a number of occasions. You could take
him fairly shortly in chief. If you got through him in
chief by noon on Thursday, 16th, I can see it might very
well be that he would be finished that day, important
witness though he is and detailed though he is, if you get
through him by 11 o'clock, it makes the prospect that much
better.

MR. MORRIS: Yes. I just thought it prudent to act.

MR. JUSTICE BELL: What at the moment I am not terribly
attracted by is a witness of fact such as Mr. Alimi -- and
some detailed fact -- who, at best, is not going to take
more than, say, a day and a half, giving a day of evidence
and then coming back some considerable time later for
another half a day. Can you find out what his problem is?

MR. MORRIS: Maybe I can schedule him for the 4th or 5th, or
something, and put him back. I will contact him, yes.

The other thing is that I am a bit mindful of the fact that
we have got a very packed programme as from last Thursday.
There is not actually a day off, so to speak, a proper
preparation day, until the end of Miss Ingliss on 30th
November. It is over five weeks all together. So, I just
think that should be borne in mind, that we are feeling
greatly under stress at the moment, and we would like some
days to be built in for preparation times.

MR. JUSTICE BELL: What I suggest is that I do not give any
indication about that at the moment, because it may well
be, either because we go more quickly than anticipated or
because of some misadventure, you find that you are getting
the odd preparation day. If we go on for a couple of weeks
and you are not getting one, then raise it with me again
and we will talk about allocating some preparation time.

MR. MORRIS: OK.

MR. JUSTICE BELL: You see, if, for instance, we did get through
Mr. Jenssen in good time tomorrow, you will get an early
day tomorrow and you will be back at two o'clock on
Friday.

MR. MORRIS: Yes. Now, what is the situation with Mr. Coton?
I do not see why there is any obligation on us to call him
after our other witnesses. I mean, it may be that is
better, but -----

MR. JUSTICE BELL: I am not saying there is an obligation. I am
just saying that if you had the choice it might be a
sensible way of doing it.
