Day 117 - 27 Apr 95 - Page 34

MR. MORRIS: No, I just could not remember whether we put Civil
Evidence Notices on them but they are abroad, so far as we
       know.

MR. RAMPTON: So, my Lord, that leaves in effect, and there are
two journalists, Mr. Pattinson and Harriette Lamb.

MR. JUSTICE BELL: Pattinson, is it not?

MR. RAMPTON: Pattinson, yes, he is the Daily Mirror person, and
Harriette Lamb who was working at one time for somebody
       called Transcontinentals or something.

MS. STEEL: She also worked for McDonald's.

MR. RAMPTON: So if you take little bit out Harriette Lamb for
McDonald's that is five people that I have to deal with
specifically. As I say, I can do that quite economically,
particularly since I think two of them, Alimi and Harrison,
were from the same restaurant, Colchester, at the same
time. That can be dealt with by one lot of evidence.

My Lord, as time passes it is going to become more and more
difficult for me to respond to last minute indications from
the Defendants that so and so is after all coming to
court. I do not know what has been happening these last
       however many weeks -----

MR. JUSTICE BELL: No, in a moment I am going to ask Mr. Morris
about telephone communication. I also want to talk to him
or Ms. Steel about any further Civil Evidence Act notices
if, as he indicated yesterday, some of the potential
       witnesses may be abroad.

MR. RAMPTON: My Lord, whether I should sit down now; there is
one other matter which is again -----

MR. JUSTICE BELL: I am not going to make a decision on the
argument today. I would like to hear from Mr. Morris about
telephone communication he has had. Then I am going to go
away and remind myself of the evidence of all the witnesses
he has named, the ones he named yesterday and the ones he
may name in a moment or two.

MR. RAMPTON: My Lord, I am not really asking for a ruling today
but I may be driven to it in due course. What I am really
asking your Lordship to allow me to do is to say that I am
not obliged to schedule any other witnesses than those who
will deal with the people who have been named at the
       present time.

My Lord, the other thing which I might usefully mention now
before I sit down is that it is becoming, if I may say so,
a matter of some importance, the Defendants' estimate of
       cross-examination.

MR. JUSTICE BELL: Yes. I was going to ask about that as well
if Mr. Morris and Ms. Steel can help me in relation to
that. Mr. Morris, have you any others you have spoken to,
so even though they have not filled in a form, you are
