     1        the Defendants to make an amendment.  I have not, of
     2        course, had anything from Mr. North.

     4   MS. STEEL:  I do not know that is the correct recollection of
     5        what has happened.

     7   MR. JUSTICE BELL:  Check it, but my recollection is,
     8        effectively, the same as Mr. Rampton's, that the way it was
     9        left was that Mr. North might make an additional statement
    10        in relation to that.  Query whether you produce such a
    11        statement you should be put to seeking leave to amend, or
    12        the statement should be deemed to be an additional
    13        allegation and, depending upon that, Mr. Rampton might make
    14        an application for leave if, indeed, he requires it, to
    15        call a witness to answer what Mr. North has to say.

    17   MS. STEEL:  Yes.  To be honest, Mr. North has to come back for
    18        re-examination on food poisoning anyway.  I do remember
    19        that we have not re-examined.  That is for certain.  I was
    20        just trying to be helpful actually.

    22   MR. JUSTICE BELL:  What I am going to write on the list of
    23        outstanding witnesses on past topics is, "query, North".

    25   MS. STEEL:  There is also Jane Brophey to be heard under
    26        Defendants; there may be others as well which I will check.

    28   MR. JUSTICE BELL:  Yes.  Let us call it a day will and resume at
    29        10.30 in the morning.
