Day 072 - 12 Jan 95 - Page 53

lived in Smith Street complaining to you about environment/index.html">litter?
       A. No, sir.

  Q. Anyone who in conversation might have been a journalist?
       A. No, sir, only in the letters.

MR. RAMPTON: My Lord, there is one other possibility. It would
appeared from his name that he might be a Scot.

THE WITNESS: I think I would have recognised the name as "old
       McIntyre".

MR. JUSTICE BELL: If he gave his name of course?
       A. Yes.

  Q. I think that is sufficient to put to the witness.

MR. MORRIS: These residents associations, the representatives
you have met or spoken to, yes, did they come across as
people that were genuinely concerned about the area as
       responsible people?
       A. Just the people on the residents committee or other
       residents as well?

  Q. People from the residents committees you have spoken to.

MR. JUSTICE BELL: Officers of the residents association?
       A. The only gentleman I have really spoken to, who is the
       Chairman of the Royal ----

  MR. MORRIS: Hospital Ward?
       A. --- is Dr. Taylor.

  Q. How did he strike you -- a responsible person?
       A. Yes, I would say so.

  Q. Genuinely concerned about the community?
       A. Yes, as anyone would be.

  Q. So why would somebody who was genuinely concerned about the
       community ----

MR. JUSTICE BELL: That question was been asked already.

MR. MORRIS: Mr. Stump said that he felt people had a grudge
against McDonald's. Are you saying that the -----

MR. JUSTICE BELL: That is comment to me, if you want, in due
course. For better or worse this witness has given his
evidence to the extent to which there is environment/index.html">litter. I really
do not think you can validly ask him why should Dr. Taylor,
who you think is a responsible person, have said this
       unless it is true.

MR. MORRIS: Just a few final points. The staff who do the
environment/index.html">litter patrols in the winter, indeed they do, like to put
on coats when they do those if it is in the winter. Is
that because it is cold and windy?
       A. Yes.
