black marks across the top which would indicate that -----

MR. JUSTICE BELL: Yes, all right.

MR. MORRIS: That is the enclosed brochure, as far as we can
       see?
       A. Yes.

  Q. The next paragraph says: "You will notice", presumably
from the enclosed document -- it is all quote -- "that a
relatively high percentage of the energy in our food comes
from fat." It goes on: "Nevertheless, there is no
reason why these foods cannot be included as part of a
varied, and therefore healthy diet". Was that quote you
       were putting in your statement?
       A. Could you refer me to the precise position in my
       statement?

  Q. This is page 5 in your statement, first paragraph.
       A. You will see a reference there. "A relatively high
percentage of the energy in our food comes from fat". It
is identical to that quote anyway.

MS. STEEL: The reference given at the back is the letter of
       McDonald's public relations.
       A. Yes, it is that same letter.

MR. MORRIS: That is from Annette Allen, Public Relations
Manager. If I just point the court to the paragraphs
following: "You may be interested to know that our other
two publications are intended for consumers"; the first
one of those "The Facts about'" -----

MR. JUSTICE BELL: Let me read the whole letter. Yes.

MR. MORRIS: There are two paragraphs in that quote which
I wanted to read out: "You may be interested to know that
       our other two publications are intended for consumers;
'The Facts about Eating at McDonald's'" which we have
referred to before and you heavily criticised it ---
       A. Yes.

  Q. -- Mr. Cox -- "is available free in all 165 of our
restaurants, and apart from giving energy, fat, protein,
carbohydrate and sodium content, it also offers some
general nutrition advice." Then it says the second of
the two documents intended for consumers is "Good food,
Nutrition & McDonald's" is available on request from this
office. It not only explains the role of the macro and
some of the micronutrients in the diet but also compares
the major nutritional content of the menu items with the
UK Recommended Daily Amounts (as published by DHSS). The
booklet also looks at typical meal combinations available
in our restaurants and shows how they compare with other
       typical British meals.

Should you have any patients interested in following a
healthy, well balanced diet, we would be pleased to send
them a copy of our literature". That, presumably, was a
reference to the Bexley Community Health Council.
