Day 182 - 02 Nov 95 - Page 34

employers are in the 37.5 column?
       A. Yes.

  Q. What I do not understand at the moment is what that has to
do with shift work. Is there anything about shift work on
the tariff, on the schedule there?
       A. Yes. If you work shift work, then you are supposed to,
because that is not good for you, then you are supposed to
work less hours for the same pay, which means that,
consequently, you have to earn more per hour.

  Q. Is that in some other document, or can I see that on here?
       A. I could show you, but it does not say here. That is
       just -----

  Q. Very well. I have been trying to get it off that sheet.
       Just pause a moment.
       A. Sorry.

MR. MORRIS: If I can ask a question? These are minimum rates,
       are they?
       A. Yes, those are the minimum rates; and the point is that
both of these rates, anyway, are above what McDonald's were
paying at the time when the agreement was reached; so
everyone was going up, were given extra pay.

  Q. After the agreement was signed?
       A. Yes.

  Q. So it is a bit of an academic exercise, really?
       A. Yes. I am sorry about that.

  Q. No, that is OK. It is my fault.

MR. JUSTICE BELL: Hold on a moment. It is not academic in
that, rightly or wrongly, you are making the point that
after the collective agreement, you say, McDonald's workers
should come in the right-hand column rather than the
       left-hand one?
       A. Well, that matter -----

  Q. They should come in the left-hand column rather than the
       right hand one?
       A. That is my personal opinion, but it has not been
       decided yet.

MR. JUSTICE BELL: We will see where we go from there, if
       anywhere.

MR. MORRIS: When you say it has not been decided, is it still
       the subject of dispute?
       A. That is the dispute, that is right.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: So, following the signing of the agreement, all the
crew members at McDonald's got a wage increase, did they,
as from that day or from that week?
       A. Yes. I believe 90 per cent. Me, myself, I had two
kroner extra, but I was given four years of -- sine
