     1        is another matter, but they were discussed, were they not?
     2        A.  They were along with just like every employee that was
     3        in the restaurant, we discussed people whose performance we
     4        thought was good and poor, just like we would discussing
     5        all aspects of the business.

     7   Q.   But you would discuss people who were not coming up to
     8        scratch?
     9        A.  We would, just as we would discuss people that were
    10        coming up to scratch.

    12   Q.   I am asking you about the people who did not come up to
    13        scratch.
    14        A.  Oh, we would discuss them, yes.

    16   MR. JUSTICE BELL:  You would not be doing your job if you did
    17        not discuss it?
    18        A.  No, absolutely.  We would discuss it as part of the
    19        normal meeting structure.

    21   MR. MORRIS:  People that were -- a neutral term -- not coming up
    22        to scratch, that was an item on the agenda for the
    23        management meeting about what to do about that?
    24        A.  There was not a specific items on the agenda, no.  We
    25        generally talk about -- we start the meeting by talking
    26        about sales for the week, results for the week, what we
    27        were going to do about those results and then we would talk
    28        about performance reviews, for instance, whose performance
    29        reviews were due in the next week or two weeks, and what
    30        comments we were going to make on their performance;
    31        whether they deserved an extra merit, for instance, whether
    32        they were available for courses or promotion and if someone
    33        required extra tuition, as it were, then we would organise
    34        that for them.

    36   Q.   So, in your point (7) in your statement you say:  "If an
    37        individual crew member's performance is not satisfactory, a
    38        manager will concentrate on improving that individual's
    39        performance".  Then you go on to talk about the "buddy"
    40        system.  So, that would be something that would crop up at
    41        a managers' meeting?
    42        A.  Yes, it would.  If, for instance, you said that Joe
    43        Bloggs was not coming up to scratch, we would, perhaps,
    44        discuss the reasons why they were not coming up to
    45        scratch.  If necessary, the Store Manager would interview
    46        that person and speak to them on their own and see if they
    47        had any kind of problem.  Then you would organise some
    48        extra training for them or whatever was appropriate.

    50   Q.   Did that really happen, that you wanted to improve 
    51        individuals' performance? 
    52        A.  Yes.

    54   Q.   What, just every so often one person or was it that 10 or
    55        15 of the staff would -----
    56        A.  Not 10 or 15.  It might be occasionally you would get a
    57        problem with someone where they would be need to be
    58        rerolled.  For instance, someone who was unhappy at working
    59        till regularly might request that they spend a little more
    60        time in the kitchen.  You might be able to accommodate that
