Day 293 - 04 Nov 96 - Page 23

MR. JUSTICE BELL: Mr. Van Erp, Mr. Langert and -----

MR. MORRIS: -- and Mr. Kouchoucos all said that. I have not
got the references for those. I think the Casper Von Erp
reference was probably in my list, but I did not bother to
       read it out.

Mr. Kouchoucos also stated -- but I have not got the
reference -- that McDonald's generated 6 percent of all US
food service packaging. There are bits and pieces -- in
fact, yes, Mr. Langert said the bit about not having a
policy on 8th July 1994, day 9. He also said -- this is
another issue -- that he had received 7,000 to 10,000
letters of concern over the use of foam packaging in the
       USA.

MR. JUSTICE BELL: This is Mr. Kouchoucos, is it?

MR. MORRIS: This is Mr. Langert -- in 1989; this is before
they withdrew their foam packaging. So, that is another
       point. It was during cross-examination.

I have got the references for Mr. Beavers that I have
referred to before, when he said that he recognised the
benefits of in-store customer recycling packaging -- and
that was day 124, pages 52 and 53 -- and that the working
of it "does not cause difficulty". Robert Langert had said
that less than 10 stores out of 10,000 were actually doing
this. That was day 9, page 18, line 30.

If you wanted to see where the challenge was made about the
Hong Kong "We Care About The Ozone Layer" Corporation
leaflet, that was to Mr. Beavers; I think it was on
day 124, either page 36 or page 39, during that time about
       questioning about CFCs.

Mr. Langert said something that was interesting as well, on
day 8, 7th July. I have not got the exact reference. He
basically recognised the strength of the environmental
movement in the '80s in forcing these kind of recycling and
waste issues on to McDonald's agenda or on to their
suppliers' agenda -- particularly toxic waste groups and
       public demand for recycled paper.

I have nearly finished this subject now. I think that is
       basically it.

What I would like is maybe if we could finish earlier and
I can look at the documents. I could not find them last
night. It is a very complex subject.

MR. JUSTICE BELL: How long do you want, then, for the midday
       adjournment?

MR. MORRIS: As we are not going to take, I should not think,
more than an hour, hour and a quarter, it would be good if
we could just start at 2, as normal.

MR. JUSTICE BELL: Will you want to add anything, Ms. Steel?
