Day 153 - 12 Jul 95 - Page 45

       heard about it?
       A. I would have thought even as Area Manager.

  Q. I am going to come to that, but certainly as Store
       Manager ---
       A. Certainly, yes.

  Q. -- you should have got to know about it and even as Area
Supervisor you should have got to know about it?
       A. Yes, sir.

MR. RAMPTON: My Lord, the date from the Accident Book appears
to have been Thursday, 28th August 1986.

  MR. JUSTICE BELL: Thank you.

MR. RAMPTON: That is from tab 57L, volume XII.

MR. MORRIS: In the Accident Book, it says: "Crew member
slipped on floor and burnt both forearms badly on the grill
surface", which seems to tally with what Mr. Gibney put in
       his ---
       A. Yes.

  Q. -- evidence without the benefit of having seen this book.
She was 17 years old at the time, according to the book?
       A. Yes.

  Q. "Place where accident or date of occurrence took place,
grill area"; does it worry you that a serious accident like
that to all intents and purposes took place which you, as
Manager, do not know anything about?
       A. Well, the point is I could not remember it.

MR. JUSTICE BELL: We do not know if he was Manager, because can
you remember which date in August of 1986 you stopped as
Manager because that was the very month when, according to
your evidence yesterday, if my note is correct, you were
there as Manager for about two years until August 1986. It
may have been Mr. Rampton -----

MR. RAMPTON: 87, I think, my Lord. I can ----

MR. JUSTICE BELL: I think you actually led him to this.

MR. RAMPTON: I did. I am not blaming your Lordship.

MR. JUSTICE BELL (To the witness): You became First Assistant
about one year later, June 84. I made a note of it because
-- let us get it straight now. You were then one year at
Colchester before you were Manager; you were there as
Manager for about two years which would, in fact, take you
to August 87 rather than 86?
       A. That would sound better, especially as we were Store of
the Year for 1987, and I had received that, so I would have
been there for the majority of 87, so that would indicate
that 1987 was the year I was promoted.

  Q. Yes, thank you.
