     1        A.  Not necessarily.  Under labour laws in Ireland, a
     2        person has a right to make an appeal to a Rights
     3        Commissioner, I think it is up to six months or maybe even
     4        12 months after the date that their employment is
     5        terminated.  It could be six months, but I am not sure.

     7   Q.   You received notice from the Irish Transport and General
     8        Workers Union on 22nd August that they were referring the
     9        issue to the Rights Commissioner's office, did you?
    10        A.  If that is what it says in the correspondence.  I do
    11        not have it in front of me.

    17        A.  I have 1164.  It is obviously beyond that, is it?

    23        Commissioner's office.  Do you remember whether or not
    24        Mr. Trimble had either left or told you that he was leaving

    26        A.  No, I am sorry.  As I have indicated, I cannot recall
    27        the date on which he left our employment.

    29   Q.   Did you ask Mr. Trimble, when he said he was leaving, for a
    30        contact number or address for the purposes of this -- well,
    31        for the purposes of this dispute or anything else?
    32        A.  No, I did not.  Like I say, I do not know what date he
    33        left the Company, so I cannot give you an answer as to
    34        whether I did or I did not.

    36   Q.   Did you get an affidavit off Mr. Trimble concerning his
    37        version of events?
    38        A.  No, I do not recall getting an affidavit from
    39        Mr. Trimble.

    41   Q.   You spoke to Mr. Trimble, though, about these dismissals?
    42        A.  Yes.  He referred them to me through the supervisor
    43        after they were terminated.

    45   Q.   Did you ask him why he had not followed the dismissal
    46        procedure with verbal, followed by written, warnings?
    47        A.  No.  I was not aware that he had not followed them.  He
    48        gave me the reasons for the dismissals.

    51        the correct procedure? 
    52        A.  I cannot recall at this stage whether I did or I did 
    53        not.
