Day 207 - 23 Jan 96 - Page 23

MR. JUSTICE BELL: It says 41 minutes after midnight on the 8th,
so it presumably relates to the 7th?
       A. You cannot actually shut the system until the rollover
has occurred, which is 12 midnight.

  Q. But can you say which day of the week it is?
       A. The indication where it says "Sa", which indicates the
fact that it is a Saturday.

  Q. I see.
       A. So that indicates the day.

  Q. Thank you.

MS. STEEL: Then if you go three names down -- actually, I have
not done teatime breaks to check for illegalities, but
another lunchtime with no break: Conrad Davis started at
three minutes to six, went on a break at 14 minutes past
10, came back on at four minutes past 11 and then worked
until one minute past three; so no break between the 11.30
       to 2.30 period?
       A. No, there is no break.

  Q. Then Colin Phillips, two down from that, started work at
four minutes past nine, went on a break at 10.51, came back
from the break at 11.32 and finished at three o'clock. So,
again, no break of three-quarters of an hour between 11.30
and 2.30; and, also, he did not get the full 45 minutes.

MR. MORRIS: The lack of 45 minutes also applies to the one
above; only got 43 minutes, that is Rianid Easton; and it
also applies to three above that, to Adiolotikan?
       A. Adiolotikan.

  Q. Yes. So he only got 44 minutes.

MS. STEEL: It also applies to Stephen Clarkson, who only got 30
minutes. Again, underneath Colin Phillips, there is Lee
Richards, who had a break between 26 minutes past nine and
three minutes past 10, which is not a full break, and he
then worked until 2.30. So he should have had his break
between 11.30 and 2.30; is that right?
       A. He should have a break, yes.

MR. MORRIS: I think, under Roland Hill, he only got a break
between 14.03 and 14.14, if that is accurate -- you can
clearly read it -- implying that he only got an 11 minute
       break.

MS. STEEL: The one under Matthew Newman is not illegal, but he
started at two minutes to 11 and then went on his break at
half past 11, and then worked until almost four o'clock.
So that was a break that was taken very early on in his
       shift.

MR. MORRIS: And he only got, I think, 41 minutes break. It is
hard to tell from my copy.

MS. STEEL: Then, if you turn to the next page,
