     4   Q.   Because it is one of the most important things that happens
     5        in the store?
     6        A.  Well, the health and safety of employees and customers
     7        is most important.

     9   Q.   Trash walk gets four, we see, whereas, for example, many
    10        other things get three or two.  We notice that smiling gets
    11        five at No. 4, yes?
    12        A.  Yes.

    14   Q.   And No. 3, active communication gets four, yes?
    15        A.  Yes.

    17   Q.   And so on.  It is not for you to say whether the company is
    18        right or wrong about the way it weights the different
    19        importances of these various activities that have to be
    20        carried out but, in your own opinion and experience as a
    21        store manager, does it seem to you that this is a fair way
    22        of assessing the importance of the activities carried out
    23        by your employees?
    24        A.  Yes, I believe so.

    26   Q.   So do you agree that after matters such as fire exits,
    27        trash walks deserve the next highest mark?
    28        A.  Yes.

    30   Q.   No. 7 is:  "Information board is well stocked with McFact
    31        Cards, diabetic cards and nutrition booklets".  Does it
    32        happen ever that you run out of McFact Cards and nutrition
    33        booklets, diabetics cards, things of that kind?
    34        A.  Yes, we have run out in the past.

    36   Q.   So what happens when you run out?  First, I should ask you,
    37        for what period of time might you be absolutely without any
    38        of one or other of these categories of information?
    39        A.  To my knowledge, it has never been more than one or two
    40        days.

    42   Q.   What do you do when you notice that you have run out?
    43        A.  Well, one manager is responsible for the ordering of
    44        the promotional stock which includes these Fact Cards.  So,
    45        he is responsible for checking the stocks and for ordering
    46        the stocks.  Now, mistakes can happen.  Sometimes customers
    47        take handfuls and throw them in the bin.  I have seen that
    48        before.  We can accurately assess how much food and paper
    49        we need but we cannot assess this so we do run out.  If
    50        possible, we will try to get stocks from another 
    51        restaurant.

    53   Q.   If you run out there could be two reasons, I suppose.  One
    54        is that there is a run of them, as you have just said,
    55        somebody takes a handful and throws them in a bin,
    56        presumably from malice; another is that somebody simply has
    57        not noticed that you are running low?
    58        A.  Yes.
