Day 208 - 24 Jan 96 - Page 48

       ought to do it?
       A. Never.

  Q. Yes, Mr. Perret. Thank you very much. Can you remain
there, please, to answer the Defendants' questions? No,
I did say I wanted to ask you -- I am sorry -- something
about your personnel file. There should be behind you or
near you, perhaps, by your right-hand a couple of files
called "Bath documents". I would like you to get file
       No. 1, please.

MR. JUSTICE BELL: It is on the side table next to you. No. 1,
       please, Mr. Perret.
       A. Yes.

MR. RAMPTON: Mr. Perret, one of the reasons that you are here,
as I expect you appreciate -- there may be others; the
Defendants can ask you about that if they are interested --
as I expect you know, that it is asserted by Mr. Michael
Logan that you had late performance reviews. Are you
       conscious of that?
       A. Yes.

  Q. In tab 6 of this file, you will find your employee record.
I think it is the first page.
       A. Yes, I have got it, yes

  Q. It is that. I am not going to ask you to look at
particular performance reviews. What I would ask you to
look at is right down towards the bottom of the table or
chart, call it what you like, under "Disciplinary record,
       promotions, merit increases" -----

MR. MORRIS: Sorry, is this page 96?

MR. RAMPTON: This is page 96. Yes, I am sorry, page 96. You
see there is a performance review on 12th April. I think
it is probably 1990, is it? I think it must be -----
       A. Yes, it is, yes.

  Q. The previous one is 12th or 11th 1989?
       A. Yes.

  Q. Then there is a gap until 16th June 1992 when it says
"Company rise". Then on 13th January 1993, a 15 pence
rise after a performance review, do you see those ---
       A. Yes, I do.

  Q. -- which suggests there was a fair gap between your
performance reviews. Can you tell me, please, whether that
is an accurate record, so far as your recollection of your
       performance reviews is concerned?
       A. I definitely did not go two years without a pay rise.
I think the reason being is because when I became Breakfast
Manager, Jane did them separately because I was not really
a Floor Manager or a salaried or anything, so she did it
separately and she used to write the copies by hand and not
       print them.

  Q. Jane?
