Day 136 - 16 Jun 95 - Page 30

October to compensate for some days off at the end of July,
it would not trouble me at all. Mrs. Brinley-Codd is all
       right too.

MR. JUSTICE BELL: What I think we should direct our minds at --
I have not actually a diary with me -- I think we should be
considering whether it would not be a good idea to start in
September, sit for the last complete week in September.
Does anyone actually have a diary here?

MR. RAMPTON: I am afraid not. I understood Mr. Morris to say
that he wants not to be here on Wednesday -----

MR. JUSTICE BELL: He would like us not to sit Wednesday,
Thursday, Friday and Monday of the last day of term. What
I have in mind is that we -----

MR. RAMPTON: One could sit from 25th.

MR. JUSTICE BELL: Yes, from Monday 25th September as if that
was the beginning of our term, as it were, instead of ---

  MR. RAMPTON: 3rd October.

MR. JUSTICE BELL: -- it is probably something like 3rd or
4th October that the legal term begins.

MR. RAMPTON: It is probably 3rd because it is normally the
       Tuesday and not the Monday.

MR. JUSTICE BELL: Yes, very well. Especially if there is good
reason for missing the last four days of this term, can
everyone think about starting again on 23rd September?

  MR. RAMPTON: Certainly, my Lord.

MR. JUSTICE BELL: Monday, 25th September. Is there anything
else which we must decide now which cannot be picked up
       next week?

MR. MORRIS: Just as regards the scheduling for the rest of this
term, we asked that no draft schedule beyond the
Plaintiffs' employment witnesses be done until after our
interlocutory hearing, bearing in mind that draft schedules
become virtually established, because some of the
interlocutory matters that we may be bringing up may affect
whether witnesses and when witnesses should be called or
       recalled.

MR. JUSTICE BELL: That might be so. Mr. Rampton, quite apart
from what Mr. Morris has said, now we are on employment,
all other things being equal, I would like to get through
your employment witnesses if we can.

MR. RAMPTON: That is my plan, but I do not want to waste time
at the end of the term if I should run out of employment
       witnesses.

MR. JUSTICE BELL: I think it is not productive to talk any more
       about it ---
