2 MR. RAMPTON: My Lord, the only thing that is not, in my belief,
3 entirely in the Defendants' hands is the question of their
4 employment witnesses, because our scheduling for July,
5 which is holiday time for some, depends to a large extent
6 on that. I would say that I would invite your Lordship to
7 get an update from the Defendants before we all go away for
8 Easter so that we can get on with it.

10 MR. JUSTICE BELL: At the moment, on what I have been told by
11 you, what I would like to do is, supposing we finish
12 Dr. Long tomorrow, if you can call Mr. Bruton on Wednesday
13 morning, well and good. If you can give me some
14 information about the response to the questionnaire on
15 Wednesday, I would like you to do so. Otherwise, I would
16 like you to give me the information when we resume right at
17 the beginning of next term.

19 The first witnesses anyway next term are going to be
20 called, whatever the position is with your own employment
21 witnesses. There is no question of them not being called,
22 as I understand it, dependent on the response, or lack of
23 it, to the questionnaires -- not questionnaires, the form
24 of enquiry which was sent out.

26 I would like some information on Wednesday if Mr. Bruton is
27 called then, and a pretty comprehensive assessment of the
28 situation in any event at the beginning of next term. If
29 you cannot get hold of Mr. Bruton in order to get him here
30 on Wednesday, then it looks at the moment as if we will
31 have Wednesday as a preparation day and deal with
32 Mr. Bruton on Thursday, and also anything you can help on
33 with regard to employment witnesses.

35 Is there anything else which must be dealt with?

37 MR. RAMPTON: No, my Lord, there is nothing that needs to be
38 dealt with urgently, as far as we can see.

40 MR. JUSTICE BELL: It is just that it is tidier and probably
41 helps you better if we can be done by Wednesday afternoon
42 and you have an extra two days added to the break in any
43 event rather than having a preparation day on Wednesday,
44 coming back on Thursday.

46 MR. RAMPTON: I would like to be told if Mr. Bruton is coming on
47 Wednesday and not to arrive here to find that he has turned
48 up unexpectedly.

50 MR. JUSTICE BELL: What it seems to me is if you have not
51 managed to get hold of him by, say, 2 o'clock tomorrow
52 afternoon and ascertained that he can come on Wednesday,
53 then we will leave him to Thursday rather than have a late
54 change of plan tomorrow evening.
