Day 209 - 25 Jan 96 - Page 64

  MR. MORRIS: Right.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: (To the witness) Mr. Logan, do you know if that
kind of audit would be done in the audits done by
Head Office as well as those that are supplied to Head
       Office from the store?
       A. What do you mean, the breaks checklist?

  Q. That kind of thing, yes.
       A. I do not know about the out of store audits, whether
they would be done. They do not ever seem to show up, so
       I assume -----

  Q. If you look at page 179 -- I think we looked at this
before, so I will not labour the point -- the score for
schedules on page 179, under "hours of work regulations"
was nought out of 30; and I believe we looked at it
before. It was nought out of 40 on a different audit. But
you do not know how they would have scored that, or what
kind of checks they would have done?
       A. No, I cannot say exactly. So it is best not to say at
       all.

  Q. Do you know anyone that was ever disciplined for any
scheduling infringements of policy or -----
       A. They may have been, but I never saw anybody
disciplined. They were disciplined if labour was not to
the matrix, if the schedule -- you had a matrix, a Matrix 1
which somebody wrote out potential volumes, predicted
volumes, and then you would have a Matrix 2, where you
would work out the crew you needed; and if that did not add
to the schedule and somebody checked that then, yes, they
would be disciplined, I think, because they would be doing
the schedule inaccurately. But I have never known them to
be disciplined for this thing to include Sunday works
       breaks due, total hours.

  Q. It is not strictly the schedule, is it, but it is the
       actual reality of what happened?
       A. I assume when it says "total hours for all hourly paid
employees", you would have to write that on the schedules.
But that was never written on the schedule. I do not think
I ever saw it written on the schedule. It may not have to
be written on the schedule, but if it says it there
I assume it would have to be on there.

  Q. Under the schedule, it says "breaks taken, 25 out of 30",
but you do not know how that was audited or whether it was
       audited?
       A. No.

  Q. I do not think I want to deal with any more from the
       audits.
       A. There is a comment here about -- I am not sure I can
say that now -- the adjustment audit reports.

  Q. We have dealt with that, it was raised before unless you
