Day 095 - 02 Mar 95 - Page 18
restaurant?
A. No, I am not aware.

MR. RAMPTON: My Lord, I do not know that it would matter very
much even if he were aware of it.

THE WITNESS: Excuse me?

MR. RAMPTON: I am sorry, my Lord. I do not know that it would
matter even if he were aware of it.

MR. JUSTICE BELL: It may be but I was letting it pass because
it allowed of an easy answer, "yes" or "no".

MR. MORRIS: The Plaintiffs have mentioned that incident in
their counterclaim. It is in Paul Preston's statement.

MS. STEEL: Were you aware that in 1987 the Humane Society of
the US began a boycott of bacon and egg breakfasts?
A. No, I am not.

Q. You are not aware of that?
A. No.

MR. JUSTICE BELL: I think the point is I am not helped by
whether there was a picket or a boycott. If you say the
Humane Society disapproves of this or that, and then you
want to argue that they are an organisation whose views
ought to be given weight, then fair enough. So, put what
they particularly object to.

MS. STEEL: Actually, the point I was asking those questions
about was that the Plaintiffs have talked about having an
animal welfare policy. I was going to bring up again about
the fact that they implement policies only when they have
been put under pressure.

MR. JUSTICE BELL: By all means -- I understand, yes.
(To the witness): Were you aware of public demonstration
of one kind or another by this Society?
A. Yes. There have been numerous public demonstrations of
all, that is, everybody that is in the business, including
ourselves.

MS. STEEL (To the witness): Since then you have been developing
new policies and practices?
A. Not necessarily. We have been always -- we have always
been working with or without their involvement.

Q. The American Society for the Prevention of Cruelty to
Animals, would you accept that is a respected organisation?
A. Again, I really support and respect their intent.
There are some things that they do right. There are a
number of things that they do not. Those things that they
do right, I have a high respect for those. Some things
that they do wrong, I have no respect for them whatsoever.

Q. Were you aware that they had placed factory farming on
their 10 most unwanted list of cruel practices?
A. No.
