     3        offer a take-away service only, then obviously the rubbish
     4        would be created, the problem would be created outside
     5        instead of being able to be contained inside the
     6        restaurant.

     8   Q.   So you are recognising there is a environment/index.html">litter problem but you
     9        are saying it is the residents' own fault for objecting to
    10        an eat-in?
    11        A.  No, I said that this, because we did not have a late
    12        night cafe licence, this obviously caused a problem because
    13        inconsiderate customers late at night threw their rubbish
    14        away on to the adjoining areas.

    16   Q.   This environment/index.html">litter patrol, this is the one that lasted for two
    17        weeks or something like that; is that right?
    18        A.  That is correct, yes.

    20   Q.   How many people were sent out on this environment/index.html">litter patrol?  How
    21        many employees?
    22        A.  We, as usual, we sent one out.

    25        A.  That is correct, yes.

    27   Q.   Why not send them out in twos and threes?
    28        A.  Well, after they voiced their opinion that they were
    29        worried about going out late at night by themselves or
    30        going out late at night while it was dark completing a
    31        environment/index.html">litter patrol, I asked them if it would be better to go out
    32        in pairs, but they still felt worried because the pubs came
    33        out at approximately just after 11 o'clock and they were
    34        worried that there may be problems caused by -----

    36   MR. JUSTICE BELL:  But this would be after midnight, would it
    37        not?
    38        A.  Yes, that is correct, but they still felt there would
    39        be people out there.

    41   Q.   I have to say it sounds to me as if they were much more
    42        anxious to be off home.  I would not have thought two
    43        perhaps young men of reasonable fortitude had anything very
    44        much to worry about walking down Smith Street at 10 past 12
    45        at night.  I mean, anything can happen in this large
    46        metropolis and unfortunate things do but I would not have
    47        thought they had much cause for worry.
    48        A.  Yes, but we decided just to eliminate that risk.

    50   MS. STEEL:  Would you be afraid to go out there and do the 
    51        environment/index.html">litter patrol at that time of night? 
    52        A.  I would be wary as I am wary if I go out at night and 
    53        I come home late at night, I am wary of what I do when
    54        I walk by myself late at night.

    56   MR. JUSTICE BELL:  What is closing time in the area?  Is it
    57        11 o'clock still and ten minutes drinking up?
    58        A.  I believe so, sir, yes.
