Day 245 - 07 May 96 - Page 73
that he was not telling the truth and that we believed the
evidence was pointing in the opposite direction?
A. I think it was purely vindictive because you did not
get your way. The facts he had put forward had gone so far
opposite of the points you were trying to get him to make
that you could not handle it.

MR. MORRIS: That is a matter of argument. We believe we proved
our case the following week when you -----

MR. JUSTICE BELL: Yes, but ---

MR. MORRIS: But that is another matter.

MR. JUSTICE BELL: -- you are asking the witness what he
observed.

MR. MORRIS: I understand that.

MR. JUSTICE BELL: Try to resist the temptation to let the
argument develop.

MR. MORRIS: Can we summarise this whole issue as being fairly
simple? Everything your critic says is lies, but
everything that McDonald's says must be true. That is
basically what you believe, is it not?
A. No. I admit I make mistakes occasionally and I have
said so from this box. I have the sensibility to do that.
I am not perfect. The Company is not perfect. But I know
what I read in that leaflet is not true. I have been
around McDonald's for too many years, touched too many
departments, too many people to accept it as -- because you
say it, it is right. I am sorry, it is not right. Blatant
falsehoods.

Q. Can I just refer to the leaflet that was being circulated
before the trial started? It has a number of references,
but a number 177 in the publication bundles, I have got it
down as. I am not sure what volume that is. I have it
dated 25th June, 1994. It is 1B. It should be 177. It
might just say 77.
A. I am looking for 1B?

MR. JUSTICE BELL: It is a pink volume 1B.

THE WITNESS: The tab, please?

MR. MORRIS: 177.

MR. JUSTICE BELL: It is quite near the back.
A. I have a 77. I do not have any 177.

MR. MORRIS: Try 77; it is probably 77.
A. 77 -- the first page is numbered 455 at the bottom?

MR. JUSTICE BELL: No, it is -----

MR. MORRIS: Yes, it is, yes.

MR. JUSTICE BELL: Mine it is 396 A1.
