Day 073 - 13 Jan 95 - Page 52

MR. JUSTICE BELL: You have Friday 27th then as well for him.
We ought to stick to the academics on Monday 30th, Tuesday
       31st, Wednesday 1st and Thursday 2nd.

MR. RAMPTON: Maybe I can help a bit? I think we only allowed
two days each for Professor Jackson and Dr. Clarke.
I think it is likely they will not take two days each.

MR. JUSTICE BELL: I was pausing while Mr. Morris spoke to
Ms. Steel. What are the prospects of getting through,
I think it is, Dr. Jackson and Mr. Clarke over those four
       days?

MR. RAMPTON: I would have said they were pretty good this
time. I am trying to be as realistic as I can, given
everything I have experienced during the course of this
case. I should have thought between them there is a very
good prospect they will not take more than three days.
They are coming down from Scotland together. I would have
thought they would not be more than a day and a half each.
There is really no ground on which their evidence can be
seriously contested anyway because, subject to anything
that Mr. North may come up with, whose report is due today
according to your Lordship's order made at the end of last
term, they have made inspections and there it is, which
       might leave Thursday 2nd.

MR. JUSTICE BELL: What do you say about that?

MR. MORRIS: We have had some paperwork from Mr. North today
which we have not had time to read. I do not know if it is
complete or whatever. We did ask them to send something
       down as soon as possible.

MS. STEEL: They actually handed it to us this afternoon while
       Mr. Hopkins was giving evidence.

MR. JUSTICE BELL: Doing the best you can at the moment, do you
think it is likely that we will complete Dr. Jackson and
Mr. Clarke over the four days at the beginning of that
       week?

MR. MORRIS: We think that is likely.

MR. JUSTICE BELL: What I suggest is that we hope for that and,
unless Mr. Rampton tells me there is a major difficulty, we
then begin Mr. Kenny unless, for instance, Mr. Rampton
wanted to substitute someone else on some respectable
notice, for instance, Mr. Chambers because he has been at
the moment provisionally taken out, on Monday 6th which
gives you a bit of slack for Dr. Jackson and Mr. Clarke
that week which, hopefully, will not be needed and,
therefore, will give you an extra day's preparation.

MR. MORRIS: That is appreciated, thank you.

MR. RAMPTON: Yes, but I must fit in Mr. Chambers somewhere.
I can tell your Lordship that Mr. Bowes is able to come on
13th and 14th, but it is unlikely if Mr. Kenny starts not
