       A. No, we do not. Our -----

  Q. Sorry, how then is the basic starting rate determined in
       the United States?
       A. Individual marketplaces will set their own wages. We
do what we call internally employment quests, where we
compare ourselves to others who are seeking the same labour
       force, if you will.

  Q. When you say "we", do you mean Oak Brook?
       A. No, I am sorry, and you will have to forgive me -- in
McDonald's it is rare that I would use the word "I" or "the
Company" or whatever, we use the word "we" often. No, this
is not an Oak Brook responsibility. That responsibility is
delegated down to our 40 regions within the US, and each of
our 40 regions has Human Resource people within the
regional office, and they would be the folks responsible
for doing wage surveys and data gathering to determine what
       their wage rate should be.

  Q. In this country a similar exercise is done, we have heard,
from Lyn Mead. Do you know her?
       A. Yes, I do.

  Q. That is done nationally in this country and we have seen
       some documents?
       A. OK.

  Q. Is that an exercise which is not done nationally, as
I understand it, in the United States?
       A. No, it is not. What we do is -- I think I have already
mentioned -- we delegate that down.

  Q. I am sorry about this, could you change over those two
       files, please -----

MR. JUSTICE BELL: Before we leave those then, Mr. Rampton, if
I could just turn back to D2 ----
       A. My Lord, what page is that?

MR. RAMPTON: That is the one behind your statement.

MR. JUSTICE BELL: Two sheets from the back.

MR. RAMPTON: It is the government form.

MR. JUSTICE BELL: I think I can tell you the columns there,
both male and female, have a column which is "White" and
then in parenthesis "not of Hispanic origin" and "Black"
and then in parenthesis "not Hispanic origin". I assume
that you are Hispanic origin if your first tongue is
Spanish, probably that is the definition, is it?
       A. It is usually the surname. It is -- you identify it by
surname but also verify it with the employee.

  Q. Right. Why should it be that there is a risk of
discrimination or prejudice there? Is it because they are
mostly of Mexican origins or from Puerto Rico or what?
       A. The rules in this area, my Lord, are very specific.
When you are going through the interviewing and hiring
