Day 132 - 07 Jun 95 - Page 33
shocks. I do not believe that a defect of this type would
be ignored, running contrary to all the laid down training
and management systems". Apart from the fact that you are,
effectively, implying the person is lying or making it up?
A. No, I am not.

Q. That if a toaster was giving people shocks you would be
concerned, would you not?
A. Of course. What this implies is that there was a
toaster that was live and giving people shocks for six
weeks. It would not just work on Saturdays, presumably.
I do not believe that a toaster would be left for six weeks
giving people shocks. I do not think for a second -- if
I may finish -- that people are lying. What I will say is
that you have to be absolutely sure when you are making
allegations of shocks that it is not, in actual fact,
static electricity, or something like that.

I do not know the instance and why she said so. If we are
talking about people getting a belt off a toaster, I do not
believe it would be left for six weeks, and that is my
considered opinion.

Q. But these, of course, are from people that have worked at
McDonald's in reality.

MR. RAMPTON: My Lord, we cannot have that. We have not seen
them yet.

MR. MORRIS: No, but I am saying these are statements -----

MR. JUSTICE BELL: I do not think you need go any further
because Mr. Purslow has given his view, for whatever it is
worth. We will see what the evidence is in due course.

MR. MORRIS: You then say: "Why the 'Mac toaster bun sheet'
should fall on staff, I cannot conceive." If a Mac toaster
bun sheet was in danger of falling on staff, would that
concern you?
A. Yes, of course, and I am sure. All I am saying is
I cannot usefully comment on why that should have
happened. That is all the point I am saying. It is not as
if Mac toaster bun sheets were falling on people every five
minutes.

Q. You are not saying that you cannot comment, are you? You
are trying to deny -- you are trying to counter what these
witnesses are stating as -----
A. I am commenting on what the witness said and, as I say,
I have no -- I cannot conceive why that would happen.

MR. JUSTICE BELL: Can you tell me what the Mac toaster bun
sheet is?

MR. MORRIS: I cannot actually at the moment.

MR. JUSTICE BELL: What is it?
A. I think it is a tray, basically, that buns go on to,
but in this particular instance I could not see the
relevance of the comment. It might well have happened.
