3 main concern is to know where we have, effectively, closed
4 the evidence in relation to certain of the stores I am
5 familiar with and where we have got more to come, so that
6 I can get a measure of how much more is to come. So I will
7 not put you on the spot about that.

16 about Joanne Bishop, who is number 1, and I have not heard
17 anything about Dan Gallin, who is number 9 of the Civil
18 Evidence Act statements.

28 to her?

30 MR. MORRIS: We have not actually spoken to her for an enormous
31 length of time.

33 MR. JUSTICE BELL: You are still hoping to call her, are you?

35 MR. MORRIS: We are going to have a discussion with her and then
36 we will let the court know.

38 MR. RAMPTON: My Lord, all I would say about all of this really
39 is, at this stage of the case, we have been hearing
40 employment evidence since, I think, April.

42 MR. JUSTICE BELL: Yes.

44 MR. RAMPTON: If Mr. Morris and Ms. Steel think that it is open
45 to them at any time before judgment, as it were, to keep
46 feeding employment witnesses into the picture, whatever
47 other matters we may be dealing with by then -- in
48 particular, rainforest and publication -- I would certainly
49 have something very strong to say about it.

51 MR. JUSTICE BELL: I think we should just leave that because the
52 two potential witnesses may come to nothing. If they do
53 appear, I will really have to look and see whether what
54 they have to say is going to advance the matter or not and
55 give leave or not accordingly.

57 MR. RAMPTON: That I understand, my Lord, but we have question
58 marks against Mr. Patel, Mr. Townsend, who we have earlier
59 been told is not being called.
