Day 193 - 28 Nov 95 - Page 28

       did not hear, I think.

MR. JUSTICE BELL: Yes. I understand what the witness is
       saying.

MR. RAMPTON: That is not right, is it, Miss Inglis? The fact
is that if the Labour Board had been satisfied that Cam had
been guilty of election malpractices, two things could have
happened: either it could have ordered another election to
be held, or else it could have awarded the union automatic
certification there and then, could it not?
       A. It could have. But I, like, I was not in the caboose
to see what was going on. From my understanding, the
union, from what the union had told me, that the union had
to bring these up at the Labour Board. I do not know
       everything about labour law.

  Q. The union is not short of resources, is it? It is an
enormous union; it has millions of members in Canada and
       the United States?
       A. I do not know its membership. The last I saw, it was
       -- I just read it -- 1989, I think they had 75,000, and
then the union was saying during my organising campaign
that they were one million strong, so -----

  Q. The fact is that the union realised that it had been
defeated fair and square and that the workers in
Cam Ballantyne's restaurant did not want to be part of a
union; that is the fact, is it not?
       A. No.

  Q. They recognised -----
       A. The union recognised that McDonald's is an absolutely
huge corporation, and it, you know, may take a couple of
times to get a union in a McDonald's.

  Q. Were you, apart from this shift which you say was taken
       away -----
       A. I did not hear that, sorry.

  Q. After the election, apart from the shift which you say was
taken away, were you victimised in any other way?
       A. I was not, no.

  Q. You were not?
       A. I was ignored. Like, I mean, management was not here
there to management (sic). But management -- I mean, they
were kind of put in that position, because had they fired
me or whatever, it would have been brought up at the Labour
Board and it would have been obvious that I was fired for
       union activity.

  Q. One point I have forgotten: in the lead up to the
election, did you and your union people hold meetings at
       McDonald's?
       A. There was one meeting that was held in the caboose, but
that was negotiated in the vote between the parties at the
Labour Board, that the union was to hold, I believe it was,
three paid meetings by McDonald's with the Labour Board
official there; and it was held in the caboose, which is
