     1        we look at all the performance reviews that are due for the
     2        following week.  We allocate them to different managers,
     3        again get a consensus of opinion as to who is doing
     4        excellent, who is doing good, who is not doing very good,
     5        etc.

     7   Q.   If somebody behaved like that continually, what would
     8        happen?  Would he ever get a pay rise?
     9        A.  No, more than likely, longer term, if he carried on
    10        like that and he was put on till and then he served a
    11        customer in that sort of manner that would cause the
    12        customer maybe to complain, then basically he would either
    13        be not put on the till or eventually he would not have a
    14        job there.

    16   Q.   He would be sacked?
    17        A.  Not sacked, but longer term he would have to go through
    18        a longer process of about 9 to 12 months of him doing that
    19        continuously.

    21   MR. JUSTICE BELL:   Before what?
    22        A.  Well, you would have like a retraining slip, you would
    23        have -----

    25   Q.   Yes, but what would happen after 12 months?
    26        A.  Well, he would not be suitable to work there.

    28   Q.   Yes, but that, presumably, would mean that he would lose
    29        his employment?
    30        A.  That is correct.

    32   Q.   I have to say I am surprised that it would take anything
    33        like 12 months; I thought most employers would get shot of
    34        them within a few days, but supposing it takes 12 months,
    35        what happens at the end of it?
    36        A.  You would have all your facts over that 12 month
    37        period, i.e. when he has been retrained, his verbal, maybe
    38        final written warning, etc. etc, so once you have all the
    39        documentation and you have given this person 12 months ----

    41   Q.   And then he would be told "no more"?
    42        A.  Yes.

    44   MR. RAMPTON:  Then Mr. Magee goes on -- I would also like you to
    45        comment on this, Mr. Giardina -- "I did these things just
    46        to spite all the Managers and the five star yellow badge
    47        people.  These were the people that I resented the most
    48        even more so than management.  The five star yellow badges
    49        had an awful lot of power.  I disliked them for their own
    50        stupidity.  They were treated like dirt by management and 
    51        for lousey wages as well."   Leaving out the lurid language 
    52        about the wages for the moment, Mr. Giardina, does that 
    53        ring any bells with you?
    54        A.  No.

    56   Q.   Did the yellow badged people get treated like dirt by you?
    57        A.  On the contrary, because these were the same people
    58        that I mentioned earlier on that went on to become Floor
    59        Managers.
