Day 174 - 17 Oct 95 - Page 59
well. What alarms me at the moment is that I have so much
empty space on the schedule.

MR. MORRIS: It will not be like that when ----

MR. JUSTICE BELL: I would very much appreciate you filling in
some of these gaps in the schedule and I can then at least
offer a view of my own as to whether you are putting enough
in or not. If you think I have misjudged that matter you
can come back to me. But, at the moment, we have a lot of
empty gaps. What I do not want to do is resort to saying,
"This has got hopeless and McDonald's must just get on
with calling all their witnesses and then you call all
yours at the end"; or, say, for instance, we have still got
an empty week, say in the week ahead of the 20th November,
we have still got a week empty or nearly two weeks empty
and I would very much appreciate Mr. Rampton starting to
call some of his publication witnesses so we can get them
out of the way.

MR. MORRIS: If it is any help, depending on the transport
arrangements, we are expecting Sean Mrozek and Anne Casey,
Anne Holmes and Anne Casey, to come at the beginning of
that week, the 20th November, and at the end of that week
on the 24th Mel O'Riordon in the morning and Keith Baker in
the afternoon. We have asked Sarah Inglis to attend on the
9th and 10th November. I did not want to say the specifics
too early in advance because I wanted to juggle people
around a little bit.

MR. JUSTICE BELL: I have put those names in but I have put a
question mark against each one of them. What I would very
much like you to do is start filling in like that and then
you can tell me if you run into problems, but at least it
would encourage me to think that we are making some
progress.

MR. MORRIS: Can I just say, probably the best time is not to do
it now because everyone is getting ready to go, but on the
rulings there were a couple of things we wanted to bring up
before they were finally -- there were two rulings, if you
remember, on the 12th October and the 3rd October. There
were two or three points we wanted to bring up before they
became final judgments or to point out.

MR. JUSTICE BELL: Those are my rulings. If you have some
further argument to put to me, then I will reconsider it,
but you must treat those as actually being the rulings at
the moment.

MR. MORRIS: I am not saying that we are questioning the -- that
is another matter, questioning the actual judgment. What I
am saying is that in case there is something like --
I cannot remember now exactly -- there are a couple of
things where there is a word in that is, like "Defendants"
instead of "Plaintiffs" and things like that.

MR. JUSTICE BELL: Do not worry about obvious slips.

MR. MORRIS: There are couple of things where we feel we were
