     1 different question -- "Since the early 1970's, McDonald's
has made complete nutritional information available".
2 Mr. Horwitz will tell you whether it is true or not; that
              is what it says.
     3
MS. STEEL: I do not think any of these documents have been
4 disclosed with the exception of the Hazleton laboratories
one after we made an application. So, without seeing what
     5 they contain .....

6 MR. RAMPTON: Again one has an example of Good Food, Nutrition
and McDonald's dating from 1984/5 at tab 4, just in front
7 of this document. This is the British version which
contains charts and everything else besides.
     8
MR. MORRIS: That is dated March 1985.
     9
MR. RAMPTON: Yes, first published 1984.
    10
MS. STEEL: Whether or not that is the same as the American
11 document, of course, we will not know, unless the document
is disclosed. I do not believe that that document
12 actually has ingredient listings in it either.

13 MR. JUSTICE BELL: Anyway, you have made your point on what is
              in the letter.
    14
MS. STEEL: I just wanted to ask you some questions about --
15 well, actually, the first paragraph 2 of this letter of
              July 21st you say -----
    16
MR. JUSTICE BELL: Do you mean No. 2 on page 189?
    17
MS. STEEL: On page 2, sorry. The announcement that is
18 referred to in that paragraph, how was that announcement
              made?
19 A. I just want to take a second to read this, please?

    20 MR. JUSTICE BELL: Yes.
              A. I do not know. I do not recall.
    21
MS. STEEL: To go on to paragraph No. 3, where Dewey Ballantine
22 on McDonald's behalf are telling the Attorney General of
Texas that this past April McDonald's announced a
23 voluntary agreement with the New York Attorney General to
launch an unprecedented programme to put nutrition
24 information every store in New York State. Can you tell
us, if this was an entirely voluntary programme, why was
25 the New York Attorney General involved at all?
              A. Well, the contact, original contact, came from Sandy
26 Mandell who, I believe, has signed some of these. I have
worked off and on with Sandy for over 20 years, both at
27 McDonald's and prior to McDonald's, and my recollection is
in this particular case that it was nothing more than a
28 phone call from him, just asking what's doing, what we are
doing in certain areas, how things are going.
    29
         Q. That was all he said?
30 A. We talked, yes. He asked what are we doing. I cannot
remember the exact conversation. It was years ago. But
