Day 305 - 25 Nov 96 - Page 35

comment, and it is not permissible as evidence. Also, the
same applies to his "impressions", as he calls it, of why
people were reluctant to take decisions at that meeting.
It is speculation. But, even if it was true, where does it
take anybody in relation to any evidence about myself and
Mr. Morris encouraging distribution of the fact sheet?

Just a final point in relation to Mr. Bishop's statement --
this is the third one -- where he asserts in paragraph 10
that he had never encouraged anyone to pick up a leaflet or
distribute, and he had never distributed any himself; that
that is untrue, because, as we heard from Mr. Bishop, he
"manned" his stall at the George Roby where he believed
that the London Greenpeace fact sheet McDonald's was
available. So, he should not have been put in his
statement that he never encouraged anyone to pick up a
       leaflet or distributed any.

MR. MORRIS: He did say that some of the time he was running
that stall on his own, single-handed.

MS. STEEL: Just really to sum up the effect of Mr. Bishop's
evidence, or what came out of Mr. Bishop's evidence:
despite being asked to focus on myself and Mr. Morris,
there is no mention anywhere in his evidence of me agreeing
to any use of the fact sheet or to me stating that
I distributed the fact sheet or that I was going to
distribute the fact sheet, or to encouraging anybody to use
the fact sheet; nor is there any even any evidence of any
comment or role in the anti-McDonald's campaign in general
on my part. Mr. Bishop attended, I think it was, at least
12 meetings of London Greenpeace, where he was trying to
keep an eye out for things that would connect me to the
anti-McDonald's campaign, and yet he did not come up with
       anything.

I was going to move on to Alan Clare, but I do not know
whether it would be appropriate to take the break now?

MR. JUSTICE BELL: Would you prefer to do that?

  MS. STEEL: Might as well.

MR. JUSTICE BELL: Yes. Five minutes, then.

                         (Short Adjournment)

MS. STEEL: Moving on to Mr. Clare, his first statement,
paragraph 3 -- and this related to the meeting on
18th January 1990 -- stated that I took control of the
meeting and organised the agenda. I mean, you could say,
for starters, that even if I had taken control, so what?
Where is there any evidence of any decision relating to
distribution of the fact sheet? But, in any event, when we
actually cross-examined Mr. Clare about this on day 265,
page 67, line 60, he actually said that what he meant by
somebody taking control was simply that they announced the
next item to be discussed or that they said something like,
"Let's move on." So, that part of his statement was a
       complete red herring.
