"The survey results which were presented to McDonald's in
early October indicate", etcetera. In other words, this
must have been written after the survey was presented to
you; it cannot be extracted directly from the survey?
A. The second paragraph refers to the PUP survey.

MR. JUSTICE BELL: Just think about it.
A. My Lord, these are their words. I am trying to
interpret their words.

Q. I think the first thing to find out is were the survey
results -- can you remember whether the survey results were
presented to McDonald's in early October?
A. The PUP survey results?

Q. No, because it cannot -- the survey results cannot refer to
the PUP survey results because they are the survey results
which indicate that the PUP claim was inaccurate.
A. I see what you are saying.

Q. What I am asking you is whether you can remember if survey
results were presented to McDonald's in early October.
Just answer that question, first of all.
A. I am trying to go back over the timetable. They sent
out the materials, I think, in July or so, and then it
would have -- it is possible they came back in October.

Q. The other thing is this: Can you remember receiving any
survey results from TPF&C before you actually got their
written report?
A. That part I do recall.

Q. What happened then?
A. They just sent us preliminary data and said, "Here is
what we have and we are proceeding with the final report".
The problem that I am having, my Lord, is remembering the
timing.

Q. What I suggest you do, Mr. Morris and Ms. Steel, is if you
have any further questions which you had in mind to ask
those. If you wish to overnight you can check the
transcript or Caseview, and you can read through again,
although you clearly have read it already, tab 94 and you
can ask tomorrow if there is anything you want to challenge
Mr. Stein on.

MS. STEEL: I have actually found the relevant part of the
transcript on the screen.

MR. JUSTICE BELL: Is it today or an earlier one?

MS. STEEL: It is today, yes. We were talking about number --
this tab and you -- in fact, it was you who asked
Mr. Stein, "Who actually prepared the summary?" and you
said, "We, McDonald's, prepared the summary from extracts
from their documents".

MR. JUSTICE BELL: That is a quibble for you, or could be. What
I suggest you do is not only look at that but look at the
