Day 161 - 24 Jul 95 - Page 21

MS. STEEL: I do not accept any of what Mr. Rampton said, but
I actually presumed that the purpose of writing it on a
piece of paper was not to broadcast it.

MR. JUSTICE BELL: I am not minded to make great matter of
principle out of it. Do not write on the paper. What
I wrote on is the title of the action, so that it can go
into the file. Can I have it back, please? (Handed)

MISS STEEL: I am not sure what the position is. I believe it
has been mentioned already on a number of occasions.

MR. JUSTICE BELL: All you need to do is, you need not mention
the name of the store, you need not mention the evidence of
any other witness. In fact, I have told you in the past
that, really, the question should not mention the evidence
of any other witness. What you can do is put a suggestion
to Miss Anteneh about the store in question, if you want.
Do not mention the name. Then, when you come to
submissions to me, you can refer me to the other evidence
in the case which you say relates to it.

MISS STEEL: (To the witness) Do you know why the store became
a franchise store? Were there problems with the store
prior to it becoming a franchise store?
A. I do not know.

Q. You do not know? So you were not given any kind of
briefing when you took it over?
A. I was given the financial papers, but nothing else.

MR. JUSTICE BELL: You had a look round it, presumably?
A. Yes, sir.

MS. STEEL: When you took over, did the crew remain the same ---
A. Yes.

Q. -- or did you get rid of the old crew and get a whole load
of new ones?
A. No. They remained with me.

Q. They remained the same. Did you -----

MR. JUSTICE BELL: I would like all members of the public to
leave the court for a moment. It will only be a matter of
a couple of minutes. If you have an assistant in court
whom you know personally, then there is no objection to him
remaining.

(The following remarks were made in chambers)

MR. JUSTICE BELL: It is just that Miss Anteneh has drawn my
attention to the fact that on the witness slip -- which
I think is available to anyone who enquires, to see who has
been called -- the same address is given as the address you
have been given. I merely mention that; and I have
mentioned it in chambers, so that if there is anything to
be concerned about at all, that does not make an obvious
public route to the same address. That is all. You need
