Day 086 - 09 Feb 95 - Page 45
Q. And hand washing?
A. And hand washing, indeed.

Q. If you go to page 15, if you can read -- is that OK?

MR. JUSTICE BELL: I am going to let you do it this way for the
moment if it is on the same basis as what we have just
done.

MR. MORRIS: Yes, I understand that.

MR. RAMPTON: My Lord, no, I am sorry. I know it does not
create a great deal of good atmosphere in court but, with
respect, it is not right for Mr. Morris to say to the
witness: "Go to page 15 of this inadmissible document
which I would like to read out but I cannot", and then
say: "Look at the document" and then ask questions on a
hypothetical basis. That amounts to exactly the same thing
as reading out the document.

MR. JUSTICE BELL: I appreciate that, but in relation to the
last page it probably saved about five minutes because we
did about twenty situations with one question.

MR. RAMPTON: Your Lordship knows well that I am not concerned
about any impact that this document is likely to have on
your Lordship's mind. I am quite satisfied that it is
not. That is not my concern, as your Lordship knows. The
Defendants, having been told that there would be an
audience afternoon, appear intent upon doing what they know
by now they are not allowed to do, which is, in effect,
read out the contents of inadmissible documents.

MR. JUSTICE BELL: We will see. Direct me to the part of it,
Mr. Morris.

MR. MORRIS: Yes, it is page 15, the last paragraph.

MR. JUSTICE BELL (To the witness): Do not look for the moment,
just sit down.

MR. MORRIS: And the next two paragraphs on the other side.

MR. JUSTICE BELL: I think you should ask your question without
the witness looking at the document for the time being.
Then follow the procedure which we have outlined previously
if you are not satisfied with the answer.

MR. MORRIS: Can I just ask a legal question?

MR. JUSTICE BELL: Yes.

MR. MORRIS: We have put a Civil Evidence Act Notice on this
document. It is not because I am looking at this because
I want to read it out, I want the witness to look at the
document as I am asking questions, but I cannot see now
what the problem is. If it has a Civil Evidence Act
Notice, then why cannot -----

MR. JUSTICE BELL: It does not make it admissible if a counter
