MR. JUSTICE BELL: Yes. Do not speak to anyone else from
wherever about anything to do with your evidence in this
case which is specifically with regard to environment/index.html">litter and, more
generally, the good administration of the Kings Road
       restaurant.

  THE WITNESS: Yes, sir.

                      (Luncheon Adjournment)

MS. STEEL: Mr. Stump, you said you had read the statement of
       Mr. McIntyre?
       A. I have, yes.

  Q. He says that the manager of McDonald's had assured the
Council, when they were considering a late night extension,
that environment/index.html">litter patrols existed -- I think that was
       Mr. Siddique's ---
       A. Yes, that is correct.

  Q. -- rather than you. If Mr. Smith says that the environment/index.html">litter
patrols are not taking place and he has not seen them, how
       do you explain that?
       A. I believe that.

  Q. Sorry, Mr. McIntyre.
       A. As I said before with other residents, it is their
opinion. I maintain that we do complete regular trash
       walks.

  Q. What has the situation been? Have you been round to Smith
Street and had a look at the environment/index.html">litter situation there?
       A. I have, yes, on a number of occasions.

  Q. Has there been environment/index.html">litter in the street?
       A. Yes, there has been environment/index.html">litter in the street, yes.

  Q. Including McDonald's environment/index.html">litter?
       A. On some occasions I have seen a small amount of environment/index.html">litter,
       yes.

  Q. McDonald's environment/index.html">litter?
       A. Yes, underneath parked cars.

  Q. Underneath parked cars?
       A. Yes.

  Q. So when you went round the streets you actually bent over
       and looked underneath parked cars?
       A. No, I could see underneath the wheel, the wheels I seem
to remember. It was only, I think, on one occasion or two
       occasions.

  Q. How many times have you been to Smith Street?
       A. I could not give you an exact number. Approximately,
I would walk down that direction in Kings Road possibly two
times a week, three times a week, I pass by Smith Street.

  Q. Pass by?
       A. Yes.
