MR. MORRIS: Is it possible to ask a couple of questions

7 MR. JUSTICE BELL: Yes.
8 MR. MORRIS: Just something I would like to point out, because
there was confusion about that 181,000, it does not relate
9 to corrugated, but I believe the calculations on the tree
area were based upon that figure, so they would have to
10 add the third of the -- corrugated packaging was a third
of your total paper packaging used, is that correct,
11 approximately?
A. It is not -- well, you are talking apples, oranges
12 here to a degree because you have been asking us for the
consumer packaging so that is what I presented.

Q. Yes, it is, I know.
14 A. The corrugated, number one, is recycled by a majority
of McDonald's Restaurants; it contains recycled content,
15 but your point that it was not included in the calculation
of trees is correct.

Q. The final question I would like to ask is do you recall
17 that there was an anti-polystyrene or styrofoam, I do not
know exactly the difference myself between that, but
18 assuming it is polystyrene there was a statute enacted in
Portland, Oregon in 1989/1990, are you aware of that?
19 A. Yes, possibly, depending on what are you talking
about.

Q. Could you educate the court what that statute was, very
21 briefly, from your memory?
A. No, I am not sure what statute you might be referring
22 to; help me a little more, then maybe I can.
23 Q. I do not know a great deal amount about it except that
there was a statute brought in, which, presumably, limited
24 or banned the use of polystyrene packaging.
25 MR. RAMPTON: My Lord, I think this is a subject of an
admission, I really do think that Mr. Morris had no need
26 to ask any questions about this at all. It is an
allegation in the reamended defence and it is the subject
27 of a specific admission of fact.
28 MR. JUSTICE BELL: Is that not so?
29 MR. MORRIS: I will not press on it.
