     2   MS. STEEL:  That would be all right if Mr. Hawkes was not
     3        called then, so we would have some reading time to prepare
     4        on advertising.

     6   MR. JUSTICE BELL:  If it was essential to do that; as you know,
     7        I have been anxious to finish the nutrition witnesses.
     8        I do not mind one witness such as Mrs. Brophey being held
     9        over with a view to giving you as much as possible of the
    10        week beginning Monday 24th to prepare for advertising to
    11        start on Friday 28th.  It is rather happy that we should
    12        not put Mrs. Brophey in during that week if she was
    13        available.  We can come back to her as a special case
    14        later.  I am in another court on Monday 24th in any event.

    16   MR. MORRIS:  If she could make that Friday ----

    18   MR. RAMPTON:  No, I would rather not inconvenience my witnesses
    19        yet again.

    21   MR. JUSTICE BELL:  Let us stick to the plan as much as we can.

    23   MR. RAMPTON:  I accept your Lordship's suggestion, with respect
    24        I endorse it, that she should be left hanging over to
    25        another time.

    27   MR. JUSTICE BELL:  Can you remind me just what the area of
    28        Mr. Hawkes is?

    30   MR. RAMPTON:  He is the UK equivalent of Mr. Green.  He is the
    31        head of McDonald's advertising in this country.

    33   MR. JUSTICE BELL:  How long do you think he will be in-chief?

    35   MR. RAMPTON:  I think it advisable to start him on Friday, if
    36        we can, because he will be cross-examined, I suspect, at
    37        some length.  He has got to show your Lordship an amount,
    38        not a huge amount, but an amount of UK television
    39        advertising.  That is why he comes with a video.
    40        Obviously, depending largely on the significance of the
    41        nutrition issue, advertising is an important issue in the
    42        case.  Therefore, it needs to be treated with care.
    43        Therefore, if the Defendants have four days to prepare,
    44        actually six days because there is a weekend as well, six
    45        days to prepare for advertising, so much the better.

    47   MR. JUSTICE BELL:  Is your concern about Mr. Hawkes lack of
    48        time for preparation?

    50   MR. MORRIS:  He is a McDonald's person and from this country, 
    51        so it would be helpful to us if that day could be used up 
    52        for the nutrition witnesses.
