Day 166 - 28 Sep 95 - Page 41

That restaurant itself is on, like, a block.

MR. JUSTICE BELL: Is it in the same block as the underground
entrance on the north side of Oxford Street?
       A. No, it is over the road.

  Q. On the other side of the Edgware Road?
       A. No, no, it is on the same side as the Odeon Cinema,
       next to it but one.

  Q. Where is that? Down towards Oxford Circus or further west
       from the underground station entrance?
       A. I am forgetting my geography here.

  Q. If you stood on what I am calling the north side of Oxford
street or the square which is Marble Arch, as if you were
about to go down into the underground, would McDonald's be
to your left or right or somewhere completely different?
       A. To the left over the road. I think you have the
Cumberland Hotel on the corner there.

  Q. Yes, and then you cross over a side street, do you?
       A. Yes, you would cross over the road. Thomas Cook,
I think, is still, perhaps still there, I do not know, and
       then McDonald's is No. 1.

  Q. I see, yes. So it looks right out on to Marble Arch
       itself?
       A. Yes.

MS. STEEL: How often on average would people be sent out then
       on environment/index.html">litter patrols?
       A. As often as needed.

  Q. You do not know how often that was then?
       A. I cannot say, no.

MR. MORRIS: Just roughly, would that be once a day, once every
two hours? Just some rough figure?
       A. Probably many times during a day.

MR. JUSTICE BELL: You have to wonder whether you really need to
ask more questions. You know, you have been challenging
the case of McDonald's in other witnesses that they went
out every so often. You have a witness from McDonald's
saying they did not do that in his experience, they went
out when he thought it was required. If you ask more
questions, you will end up confirming McDonald's earlier
       evidence.

  MR. MORRIS: We will see.

MR. JUSTICE BELL (To the witness): What was the system in Hemel
Hempstead with regard to environment/index.html">litter patrols?
       A. Pretty similar. There, it was not like a complete
square like Marble Arch was on. It is more of a high
street location, so you have more shop, shop frontages and
before you get to another corner, shall we say.

  Q. But you went out there when it was thought to be necessary,
