Day 156 - 17 Jul 95 - Page 22
I have to rely on the evidence because any kind of view --
I mean, I may be able to see something of what is going on,
but I really have to rely on the evidence there because any
kind of arranged inspection may or may not give a typical
view. Do you have any reservation about me going in at
all, if I choose to?

MS. STEEL: We do not mind.

MR. MORRIS: Whatever you want to is fine by us.

MR. JUSTICE BELL: The other view was the question of the environment/index.html">litter
patrol at the Kings Road. It is extremely easy for me just
to walk round, of course I will not be picking up stuff,
but what I would like both sides to do, and there is a long
time in which it can be done, is each side put down a route
or for that matter as many routes as they wish, i.e. start
at front door, turn right and then all my right and left
turns and the roads I am in, and I will saunter around and
see how long it takes me, unless there is any objection.

MR. RAMPTON: No, I am very happy with that too. I think we had
a map once while Mr. Stein was giving evidence.

MR. JUSTICE BELL: Yes. If it can be just written down where
I am to go. What I propose to do is just stroll round, by
which I mean walking but walking at a casual pace rather
than a brisk pace, each of the routes. I will time myself
and I will come back into court and say, "This is what it
took me", and then the parties can argue to me whether if
you had been picking up something it would probably have
taken you such and such a time and where we go from there.

MR. RAMPTON: It rather looks as if I am going to have to do the
same thing.

MR. JUSTICE BELL: That is as may be. Again, I would much
rather do that on my own. I can do it without any
significant personal inconvenience.

MS. STEEL: You want that before the end of the term, yes?

MR. JUSTICE BELL: No. It can come at any time. If it came
before the end of term I could do it on a day during the
vacation, but I can equally stop off on one of my cycling
days and do it then, so it is no inconvenience.

We will resume with the interlocutory applications at 10.30
tomorrow morning.
