Day 134 - 13 Jun 95 - Page 60
over-ruled on appeal in the Crown Court.

Mr. Nicholson has dealt with it. It is in one of his
affidavits. I think it is in his second supplementary
statement as well. My Lord, it is in paragraph 13 of his
second statement. I know that.

MR. MORRIS: Maybe if I ask about that then? Mr. Nicholson has
said that the Company was prosecuted at Gravesham
Magistrates Court and fined -- I have the original court
documents here fined -- £500.

MR. JUSTICE BELL: Why do you not ask anything about a Bolton
Magistrates Court conviction or a Gravesham Crown Court
appeal?

MR. MORRIS: Yes. (To the witness): I am particularly
concerned about the Gravesham one, Gravesend one. Do you
know the circumstances of that case? This was in November
1991 -- October 1991 was the conviction at Gravesend in
Kent. Do you know the circumstances of that?
A. No, I do not believe so. I mean, it may be if you tell
me I might, but I certainly did not deal with it directly.

Q. The court documents do not give the details. It just
says: "Contrary to section 33/1/A of the Health and Safety
at Work Act" etc. -- no, Health and Safety at Work Act
1974, failing to maintain the said place of work in a
condition that was safe and without risk to health of
employees". That was appealed. Does that recall -----
A. No, I would not have dealt with something like that.

Q. Do you know anything about the Bolton case? I cannot
remember myself.
A. No, it would not be. It is outside my area.

Q. OK. Mr. Rampton says "acquittal" -----

MR. JUSTICE BELL: It does not matter. I am not interested in
the argument if the witness does not know about anything
about it at this stage.

MS. STEEL: The records about why people leave the Company,
document C in the latest -----

MR. JUSTICE BELL: The codes and then the tabulation of
percentages and numbers ---
A. Oh, yes.

Q. -- leaving for various reasons.
A. Yes.

Q. Leavers by termination code.

MS. STEEL: These are for 1994, is that right -- 1993, sorry?
A. The table?

Q. The table, yes.
A. No, it is the April to December 1992 period.
