Day 186 - 10 Nov 95 - Page 57
was unhealthy.

MR. JUSTICE BELL: I remember that. Do not go back over the
argument again.

MS. STEEL: Yes. Just the bit about McDeadly. I did not say
anything about this during the argument, but I would say
that that is exactly the same as the others; it could be
referring to animals; Mr. Rampton said it could be
referring to diet; it could be referring to starvation in
the Third World, and really that just backs up my point
that they could, in theory, mean anything and therefore the
meaning must be from what is said in the text.

That was all I wanted to say.

MR. JUSTICE BELL: Yes, thank you. I will deliver my ruling in
due course.

MR. RAMPTON: Yes.

MR. JUSTICE BELL: I think it has got a bit too late to embark
on a great discussion about scheduling, unless there is
something which I must deal with.

MR. MORRIS: We have some documents as well that we wanted to
hand up.

MR. RAMPTON: Can Mr. Morris please restrain his natural
enthusiasm for the moment. Your Lordship raised the
question of scheduling. I do not invite your Lordship to
enter into a great discussion at this time on a Friday in
regard to scheduling. Your Lordship, I hope, will have
seen the uncontroversial and, I hope, accurate letter which
we wrote to the Defendants.

MS. STEEL: It is controversial actually.

MR. RAMPTON: That is as may be -- the letter which we wrote to
the Defendants, I think, on the 8th November. We have got
a lot of gaps to fill. It is not, at the moment, our
obligation or burden to fill them. We would appreciate
knowing, for the reasons we have given, what proposals the
Defendants have to make for those missing days, most
particularly for the greater part of next week, because at
the moment it looks as if we have got maybe a half morning
or a morning of Mr. Lamti, and that is it.

MS. STEEL: Can I just say in relation to that, firstly that is
why I said it is controversial for one thing, is that
I thought I recollected that it had been agreed the end of
next week was going to be time off after the Plaintiffs
asked for us to shift our witnesses from those dates
because they did not want our witnesses to give evidence on
those dates.

MR. JUSTICE BELL: I think that may be a different point though
because, you see, it may be one thing to contemplate having
Thursday and Friday as extra preparation days; but, at the
moment, we may be looking at Tuesday, Wednesday, Thursday
