Q. So again the cooking is very important?
A. Yes.

Q. Can we also look at the McKey's thing, their guidelines,
say for E.coli, if we look at the second column, of the
tests, of the five, the N equals is the number that is
tested -----

MR. RAMPTON: I believe that Mr. Morris has confused the witness
by asking him to look at yellow volume VII, tab 1F. In
fact, Mr. Morris is referring to pink VIII, tab 3.

MR. JUSTICE BELL: I think actually he has got open the pink
one.

MR. RAMPTON: Has he? That is my fault then.

MR. JUSTICE BELL: I did wonder which one you were on.

MR. MORRIS: I thought it was the same one.

MR. JUSTICE BELL: No, you had open the Sun Valley one as well
which was also a McDonald's specification.

MR. MORRIS: Yes. No, I have moved on from that.

MR. JUSTICE BELL: You have moved back to the pink one.

MR. MORRIS: Yes.

MR. JUSTICE BELL (To the witness): You have the microbiological
guidelines more for McKey?
A. Yes.

Q. Not the Sun Valley one?
A. No.

MR. MORRIS (To the witness): So if we look at those guidelines
there, we notice that over the page it has what the "n",
"c", "m" and "M" mean. "n = number of samples to be taken"
and "c = number of samples permitted to fail". What does
that mean "permitted to fail"?
A. It means that it does not pass.

Q. So, in other words, E.coli, of five tested, five patties or
whatever that are tested, two might fail of that batch but
the batch would still be satisfactory as long as it
averaged out that those five samples averaged out as
"fairly satisfactory" or whatever?
A. That is what I understand to be the meaning.

MR. JUSTICE BELL: Was that actually put to Mr. Walker?

MR. MORRIS: No, because I did not notice this. It is on the
form.

MR. JUSTICE BELL: That is fair enough, but you are asking
someone who had nothing to do with the making of the
document to read it as you could ask me to read it.
