1 cost of rodent control problems resulting in the storage
of foam packaging contaminated with food waste". Were you
     2 conscious of that event?
              A. I was not conscious of that particular event, no.
     3
         Q. As the person in charge of Perseco, would you expect to
4 have been aware of that if it had happened?
              A. Not necessarily so, because that is only -- no,
5 I would not necessarily be aware of that.

6 Q. Dropping down four paragraphs from there to the paragraph
starting "in stage one", this is McDonald's supposed
7 response to the McToxics Campaign?
              A. Yes.
     8
         Q. "McDonald's hired public relations ... (reading to the
9 words) ... such as foam packaging is good for landfill, it
aerates the soil". Were you conscious of any such claim
10 ever having been made on behalf of McDonald's?
              A. Which part of that sentence are you referring to, the
    11 quote?

12 Q. No, the claim "foam packaging aerates the soil"?
              A. Yes, I am aware of that.
    13
         Q. Then it goes on: "McDonald's uses recycled paper in its
14 packaging ... (reading to the words) ... uses to ship its
products". At that time which, I think, was 1989 was that
    15 a true statement?
              A. Absolutely not.
    16
         Q. No. What other recycled paper was -- sorry, in what other
17 items was recycled paper being used at that time?
              A. In 1989 we used it in the drink pulp tray carriers; we
18 used it in some napkins; we used it in half milk cartons
and in some tissue products, along with the corrugated
    19 that he mentions.

20 Q. Drop down two paragraphs below that, stage two: "During a
meeting with representatives ... (reading to the
21 words) ... he later reneged on that promise"; leave all
that. I am not going to ask you about Mr. Yastro. "As to
22 the recycling of foam the company's actions proved this
promise to be false as well; foam packages collected from
23 recycling and shipped to McDonald's headquarters or
delivered to local McDonald's restaurants for recycling
24 were promptly trashed". Were they?
              A. No, it is absolutely untrue.
    25
         Q. Was a serious attempt made to make the McRecycle programme
26 in relation to polystyrene foam successful?
              A. Yes, No.1 it was practically my full time job to make
27 it happen; No. 2 I travelled the country to make it
happen; No. 3 we reached a level of thousand restaurants
28 recycling it; No. 4 I saw it being recycled physically
              myself.
    29
MR. RAMPTON: My Lord, I have no further questions of Mr.
    30 Langert.
