Day 179 - 30 Oct 95 - Page 15
there were three different rates.

Q. We are going to go back to your original statement in a
minute. I am working through my notes. What was the
Company's attitude to trade unions, or what did you hear
about trade unions while you were at the store? I am not
talking about the specific McDonald's Freedom Fighters and
that incident, but -----
A. Just a basic rumour around the store that I had heard
from various managers, saying that McDonald's does not like
unions; when a store tried to start a union -- no specific
store mentioned -- the store was closed and staff were
brought in from another store.

MR. JUSTICE BELL: Pause there.

MR. MORRIS: You say the store was closed and staff brought
in -----

MR. RAMPTON: My Lord, I do not know that we can get much
further down this road. Mr. Morris is now trying to
establish a fact which is plainly -----

MR. JUSTICE BELL: Yes. I have understood perfectly well what
he said the rumour was.

MS. STEEL: I just thought, in terms of clarification, the staff
coming in to re-open the store, I do not know whether it is
worth clarifying.

MR. JUSTICE BELL: That is what I had understood it meant, yes.

MR. MORRIS: One final question on the additional notes: Litter
patrols: Have you anything to say about the Company's
attitude or use of environment/index.html">litter patrols?
A. I would say that they were very rarely done. Usually
as a punishment, a Manager would punish a member of staff
by sending them on a environment/index.html">litter patrol. The immediate area
outside the front of the store would be kept free of environment/index.html">litter
by the lobby hostess.

Q. Going back to your statement -----

MR. RAMPTON: My Lord, again I am not trying to be difficult,
but I wonder how much we are going to get which is not in
the statement of which we have had no notice. I hate to be
a bore about it, but your Lordship did say that any
substantial extension of what is in the witness statement,
though your Lordship might give leave for it, had to be the
subject of an application.

MR. JUSTICE BELL: Yes, just tell me what sort of things you
want to ask about.

MR. MORRIS: Basically, to explain what it says in the
statement, and if Mr. Rampton wants to object to any
particular question, he should do it at the time
because -----

MR. RAMPTON: No, my Lord my objection is that Mr. Morris has
