can distribute outside the store, I cannot stop you
distributing outside the store as long as you do not
obstruct the entrance to the store, but I am not going to
give you permission to go into the store to distribute the
literature." He did ask could he address the crew during
their breaks and I said, no, the breaks are given to them
to rest and to have refreshment. He accepted the
situation. As I understand it he was there for about an
       hour.

  Q. About an hour?
       A. About an hour I believe.

  Q. Outside?
       A. Yes, outside.

  Q. Did you have any objection to his standing in street giving
out leaflets or talking to people as they come away from
       the store?
       A. No, we are quite used to people standing outside our
       store giving out leaflets.

  Q. But you would not have then, as I understand it what you
are telling us, any objection to a union recruiting or
trying to recruit your crew members outside their working
       area?
       A. No.

  Q. Have you still got, I hope you have, volume XI open in
front of you? You should be at page 151 at the moment?
       A. Yes.

  Q. Look at the bottom of the page, "Notice Board"?
       A. Yes.

  Q. It says: "Notice boards are located in your restaurant.
These boards are used to post announcements on matters
regarding safety, working conditions and other matters
relating to your employment. Please do not put up notices
or remove information without your manager's permission.
You should refer to your notice board frequently as it is a
very important means communication." Mr. Nicholson, why
does a crew member need the manager's permission to put up
       something on the notice board?
       A. One, there is extremely limited space on the notice
boards. We have a legal requirement to display notices and
that almost fills the board. The remainder of the board is
needed for communicating what we want to communicate to the
       crew.

  Q. Can you turn back in this tab to page 130, please?
       A. Yes.

  Q. It is headed: "Some Basic Guidelines and Responsibility".
Please look at the number numbered (e): "You should make
it a practice to look at the notice board regularly. Do not
post or alter any notice on the company's section of the
       notice board"?
       A. Yes.
