     1        A.  I did make a comment to Mr. Rampton.

     4        A.  I told him that I considered this a colossal stall by
     5        you and I was getting very impatient.

     7   Q.   What did Mr. Rampton reply?
     8        A.  He felt that you were just stumbling and had been ----

    10   MR. RAMPTON:  My Lord, I do not know that I am willing to have
    11        this investigated.  I do not want to contradict my own
    12        witness, but that is not actually what I said.  I used an
    13        English word which the witness ----

    15   MR. MORRIS:  I would like Mr. Rampton to be reminded that he
    16        should be telling witnesses not to talk to him and he
    17        should not be commenting himself.

    19   MR. RAMPTON:  I am allowed to talk to the witnesses as freely as
    20        I like, whether it is about the length of time in the
    21        witness box or the weather.  What I am not allowed to do is
    22        to discuss their evidence which I have not done.

    24   MR. JUSTICE BELL:  That is perfectly accurate in fact.  Counsel
    25        normally try to avoid talking to a witness lest there be a
    26        misunderstanding, but it can be very difficult if someone
    27        speaks to you, it can appear rude not to make some kind of
    28        a reply.

    30   MS. STEEL:   I just wanted to ask you something about something
    31        in your statement.  I do not know whether you want to get
    32        your statement.

    34   MR. JUSTICE BELL:  It is in yellow X, Mr. Stein.
    35        A.  I have it.

    37   MS. STEEL:  If you turn over to tab 4, page 54 in the bundle?

    40   Q.   In paragraph 11 it says: "Each franchisee throughout the
    41        world has a field consultant who is McDonald's employee."
    42        That presumably is McDonald's Corporation employee?
    43        A.  It would not necessarily be an employee of the
    44        Corporation.  It could very well be an employee of that
    45        business in the country.

    47   MR. JUSTICE BELL:  The Company in that country -- McDonald's
    48        Corporation is the Iowa holding corporation?
    49        A.  Is the US Corporation, my Lord.

    51   Q.   For instance, it might in the UK be McDonald's Restaurants 
    52        Limited? 
    53        A.  That is correct.

    55   Q.   The employee, that is, might be the employee of McDonald's
    56        Restaurants Limited?
