Day 199 - 11 Dec 95 - Page 17
MR. RAMPTON: No. I have only the statement.

MR. MORRIS: It should be in the Plaintiffs' supplementary
statements. It is the document we would like to rely on as
part of his evidence that he wrote. I believe it is in the
Employment supplementary list of documents by the
Defendants served during the trial; otherwise, we will just
have to leave that one until another time.

MR. JUSTICE BELL: You have several bundles, have you? These
are the most recent ones?

MR. MORRIS: Yes, there was one that was a specific bundle just
of employment documents that had about 20 odd documents in
it. I seem to remember that the New Zealand document was
in there.

MR. JUSTICE BELL: Section 6 -----

MR. MORRIS: I do not think it was in that one. I think it is
in a separate bundle, purely of Employment documents.

MR. RAMPTON: I wonder if it matters whether it is found now
because the statement can be read. The document is
mentioned in the statement. If the document is somewhere
else, then it can be incorporated by reference. There is
no need for it to be found now.

MR. JUSTICE BELL: You are not going to read the document
anyway; what I suggest you do is read Mr. Duncan's
statement and then in due course tell me what the reference
is so that I can enter it in my note.

MR. MORRIS: We would like to read the document as well, because
he wrote the document and he did not include the matters
-----

MR. JUSTICE BELL: In that case, I will rise for five minutes.
Do your best to find it because I would like to do it now
and get the matter out of the way.

(Short adjournment)

MR. MORRIS: The document is No. 9 in the Defendants' additional
documents, Employment, which is a separate bundle of
documents. Bundle 6, in fact, of the documents.

MR. JUSTICE BELL: What do you want to do? Are you going to
read the whole of that or are there just parts of it which
are particularly important?

MR. MORRIS: I am going to read most of it. There were a couple
of paragraphs -----

MR. JUSTICE BELL: I suggest you read the statement first and
then come back to that. Yes?

MR. MORRIS: Yes. The statement of Alistair Duncan, Industrial
Organiser with the New Zealand Service Workers' union,
Dated 26th June 1995 for the purposes of this case.
