Day 172 - 12 Oct 95 - Page 58

  MR. MORRIS: Right.

MR. JUSTICE BELL: You can skim through it. I think it is
probably not a bad idea you have it between you, in case
you need to refer to it later on in the case. But when we
come back to your Civil Evidence Act witnesses, I will hear
what you want to say about the argument on Mr. Magill.

  MR. MORRIS: Mr. McGee.

MR. JUSTICE BELL: McGee, sorry. If Mr. Riley would be kind
enough to make one copy of Chapter 21 of Phipson and then
       give it to you.

Subject to my ruling on the discovery of the Bath
documents, is there anything more we can do this
afternoon? Are we going to go on Mr. Megan on Monday
       morning?

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: I propose to hand down my ruling on
Mr. Megan. There is only one matter where I varied from an
indication, the indication which I gave yesterday
afternoon, and that is in respect of copies of weekly time
sheets; and for reasons which I hope will be apparent from
my ruling, I have said that Mr. Morris should have the
option, when he has seen the weekly schedules, of asking
for weekly time sheets for one week only of his own choice
from August 1993 and August 1994; and I hope the reasons
for that will be apparent when the ruling is read. It will
mean an extra 14 to 16 pages of documentation on the basis
that Mr. Richards said that they were seven to eight pages
       each.

MR. RAMPTON: Did he say they were seven to eight for a week?

MR. JUSTICE BELL: Yes, he did -- one line per crew member.

MR. RAMPTON: I think the thing I have seen is probably
different. I do not know. Anyway, i will leave that.

MR. JUSTICE BELL: By all means, come back to me if there is
anything which anyone wants to say about that. But you
will gather my reasons from the ruling which has been
       wordprocessed.

MR. MORRIS: When you said 14 to 16 pages, presumably, you mean
       for a fortnight?

MR. JUSTICE BELL: For a fortnight -- because my note of
Mr. Richards' evidence was that the weekly time sheets
covered seven to eight pages, one line per member of crew.

  MR. RAMPTON: For a week.

MR. JUSTICE BELL: For that week, the weekly time sheets?

  MR. MORRIS: For a fortnight.
