24 MR. JUSTICE BELL: The only reason I ask is that in tab 7 of
25 divider 94 at page 1593 there is a bit of detail about
26 McDonald's Restaurants of Canada Limited.

30 MR. JUSTICE BELL: That is not in evidence, but I wonder whether
31 there is any dispute about it. In fact, it says that
32 McDonald's Restaurants of Canada Limited is a wholly owned
33 subsidiary of a wholly owned subsidiary of the First
34 Plaintiff.

36 MR. RAMPTON: Your Lordship is right. It is not in evidence as
37 such. It was offered by McDonald's of Canada. Therefore,
38 strictly speaking, it is not a statement by either of the
39 Plaintiffs in this case. I cannot tell your Lordship, as a
40 matter of fact, whether it is right or wrong. I assume it
41 is right. But if your Lordship thought it important, we
42 will get it verified, which is not a difficult thing to
43 do. These are statements of fact rather than argument.

45 MR. MORRIS: The union did count McDonald's statements about
46 their relationship.

48 MR. JUSTICE BELL: I know that, and I am not going to enter into
49 the argument which has evolved in the pleadings, but it
50 might be material for me to know simply whether -- it need
51 not be more than this, that McDonald's Restaurants of
52 Canada Limited is a wholly owned subsidiary of either the
53 First Plaintiff or, in turn, a wholly owned subsidiary of
54 the First Plaintiff, which probably amounts to the same
55 thing at the end of the day.

60 times in this trial, may be another matter.
