Day 118 - 01 May 95 - Page 67

is the reason. In fact, I feel certain that is not the
       reason why they discourage overtime.

  MR. JUSTICE BELL: Yes.

MS. STEEL: When you ran into this increasing amount of overtime
that was occurring, and you wanted to deal with this
problem as you saw it and you did that by setting up this
computer report, it did not cross your mind to call a
meeting and discuss with other people in the Personnel
Department, "Why not let us get rid of this rule about not
       wanting employees to work overtime"?
       A. No. I sat down with the department actually. When
I say "I put that in", I was the head of department and it
was in a meeting of my department that we came up with this
       idea.

  Q. Who else was at that meeting?
       A. I cannot remember now. It would be a personnel
meeting, so I take it that everyone who was in the
Personnel Department at that time would be there.

  Q. Nobody there mentioned the reason why you had this rule?
       A. No. Everyone has accepted that McDonald's policy is
       they do not work overtime.

  Q. Well, whether or not you accept it, you might be interested
to find out why the company has that policy?
       A. No.

  Q. You are not?
       A. No.

MR. JUSTICE BELL: He said he did not. If you are interested in
the point I suggest you ask Mr. Preston when he comes back.

MS. STEEL: I just wanted to ask a couple of things. When you
were giving evidence on Thursday you were asked about the
       Mac Books Educational Programme?
       A. Yes.

  Q. Mr. Rampton asked you: "What does the company provide for
those people?" You answered: "For anyone taking a
recognised business course they are awarded £50 towards the
costs of their books. Then there is an award of £250 given
to each restaurant." It is not available to anyone, is
it? The staff crew members have to stay on the crew for
six months before they become eligible for that scheme?
       A. I cannot remember now what the qualification time was.

  Q. But there is definitely -----
       A. There is a policy on it.

  Q. There is definitely a length of time they have to be on the
       crew ----
       A. I cannot remember now.

  Q. Well, according to the Crew Handbook it does not specify a
length of time, but it is on page 143 tab 3 pink 11.
       A. What page number?
