Day 015 - 21 Jul 94 - Page 64

     1 in this country.

2 Q. So that was why it was brought up then as relevant to the
              UK?
     3
MR. JUSTICE BELL: Well, was it or was it because ----?
4 A. No, I think the important point is that, as
I understand it, this case is about the situation in the
5 US as well as about the situation in the UK.

6 MR. JUSTICE BELL: So I understand.

7 MR. MORRIS: Let us just go through it.
              A. Just a minute, please. We have to understand that
8 there are major differences between the UK and the USA,
not only in the customer profile in terms of the number of
9 times that people go to McDonald's restaurants -- again we
have accepted that people go to McDonald's, that a
10 proportion of the customers go to McDonald's three or four
times a week in the States, whereas that does not happen
11 to anything like the same extent in this country.

12 Q. We do not know?
              A. All right, that will be dealt with later, but on the
13 other hand the range of products in McDonald's is more
extensive in the States than it is in this country.
    14
         Q. Right, OK. If we just look at this chart as briefly as
15 possible because we have five minutes left maximum. If
someone corrects me if I am wrong, they can correct me
16 later to save time. On the top left: "Apple juice is not
available in the UK; one per cent low fat milk is not
    17 available in the UK"?
              A. Well, in this country there is semiskimmed milk.
    18
         Q. Is that exactly the equivalent?
19 A. Well, the fat content is about 1.6 to about 1.8 per
              cent.
    20
         Q. So it is a higher fat content?
21 A. It is a bit higher, yes.

22 Q. The next point: Orange juice. We think it is about 89ish
in the UK. Egg McMuffin, okay. Orange juice again. I am
23 just going through the breakfast menu. Low fat milk
again. Bran muffin -- is that in the UK, bran muffin?
24 I recall there is a muffin, but I do not know whether it
is made of bran. A fat free muffin was introduced in 1990
25 in the States from your figures that were given?
              A. That is right.
    26
         Q. As part of your statement. Grapefruit juice is not in the
27 UK; then the next column: "Thursday, one per cent low fat
milk". Again it is higher fat here. Friday, grapefruit
    28 juice.

29 MR. JUSTICE BELL: Pause a moment. When you say entire milk,
are you suggesting that you can only get entire milk in
    30 McDonald's?
