1 MR. JUSTICE BELL: Yes.

3 MR. MORRIS: Is that Mr. Kier Starmer is the person who is
4 prepared to do that application. We talked to him last
5 night, I went to see him last night. He is in another case
6 on Monday and Tuesday, which may go over to Wednesday. He
7 is prepared to seek an adjournment of the Wednesday morning
8 if he had to. He feels that he wants to help us with the
9 application, and if you were to say it has to be on
10 Wednesday, he would not know until the Tuesday whether his
11 case would go over until the Wednesday. But he is prepared
12 to come here, or to tell the trial there that he --

14 MR. JUSTICE BELL: No, I am not prepared to do that. I do not
15 think the difference between Wednesday and Thursday -- I do
16 not know that I have the power to do it anyway, but it does
17 not even justify me giving some indication that I would
18 like to get on with it on Wednesday. So I think he should
19 finish his case, whatever it is, and I do not want you to
20 tell me about that. All I am saying is that if it becomes
21 clear by, say, lunchtime on Tuesday that he is not go to be
22 in court on Wednesday, then there will be still time to
23 arrange that we come into court on Wednesday. That is all.

25 MR. MORRIS: Well, what we are saying is that we would prefer it
26 to be done on Wednesday, as long as he feels he has the
27 time to come and attend and, if he cannot, he should
28 indicate.

30 MR. JUSTICE BELL: Well, he should do. I am sure he appreciates
31 that the main concern in relation to the third party
32 application is the stage we have reached in the trial.

34 MR. MORRIS: Okay. So, what with are saying to him is we would
35 like it done on Wednesday, unless he cannot attend. He
36 should give an indication.

38 MR. JUSTICE BELL: I think he should make some arrangement to
39 communicate with Mrs Brinley-Codd at the latest during the
40 afternoon of Tuesday. Then either you or she can ring
41 Mr. Glen. If Mr. Starmer is available on Wednesday, I will
42 come into court at 10.30 on Wednesday morning and if he is
43 not I will come into court at 10.30 on Thursday morning.

45 MS. STEEL: Can I just raise something briefly? This is not
46 meant to detract from the great job that the stenographers
47 do, but when I was reading through the transcripts, in
48 particular of my evidence, but also some quite a while ago
49 with other witnesses, for example I think Mr. Nicholson,
50 there are some errors in there. And I have just spoken to
51 Mrs Brinley-Codd about it and what I am going to do is I am
52 going to do a list of the various matters which I think are
53 wrong, and then they will see if they agree them. But do
54 you want me to send the list to you as well?

56 MR. JUSTICE BELL: I would try and agree it first. I have
57 noticed some, you are quite right, it is a difficult job to
58 get everything done down and the person who is checking
59 cannot always get the checks right. I have to say the ones
