4 MR. RAMPTON: My Lord, I can say this, if it would help -- I was
5 going to say it anyway; I think I have already indicated it
6 last week -- so as far as McKey's are concerned, whatever
7 the strict legal position might be, I do not suppose that
8 Mr. Walker will be unco-operative, not for a moment. It
9 will, of course, depend upon the nature and the number --
10 I stress both those words -- of the documents which the
11 Defendants should wish to see. If they are sensible and
12 conservative in their requests -- again I use those words
13 advisedly -- then it may very well be that there is not any
14 problem about McKey's documents. That is as far as I can
15 go at the moment because I have not asked Mr. Walker
16 specifically in relation to whatever documents may be asked
17 for, but they might like to bear that in mind. The same
18 does not, of course, apply to Jarret for whom I cannot
19 possibly speak.

21 MR. JUSTICE BELL: Focus on what you think you really need and
22 what you really need first, what are the most important
23 matters. I will come back in 10 minutes time from now.

29 MS. STEEL: We want to move on to the documents relating to food
30 poisoning. We left off with the salmonella incident which
31 we will now have to plead. The Oregon 1982 outbreak of
32 food poisoning: It is actually referred to in the
33 statement of McDonald's witness, George Rummel, who is a
34 Civil Evidence Act Notice statement. We would like any
35 documents relating to that outbreak of food poisoning in
36 McDonald's, any investigations undertaken and, basically,
37 any documents related to that outbreak of food poisoning.
38 Also, which is pleaded which we missed off putting on the
39 list for documents for discovery, the outbreak in 1987 of
40 typhoid as a result of eating shrimp salad at a McDonald's
41 restaurant in Maryland; documents relating to that.

51 David Wignall's statement on page 5 -- he is tab 3 in
52 volume VII; I do not think it is necessary to go to it --
53 he basically says that the cooking times of burgers were
54 increased from 1990 to 1991 -- I will just read out the
55 sentence: "It can be seen on page 3 of each of the
56 booklets", that is disclosed with his statement, "that from
57 1990 to 1991 the recommended cooking time for 10:1
58 patties", that is the large ones -- no, the small ones
