Day 128 - 24 May 95 - Page 50
though it were a fact to Mrs. Barnes that Sarah Stibbards
sued the Company.

MS. STEEL: I believe that to be the case.

MR. RAMPTON: Then it should have been asked as a question.

MR. JUSTICE BELL: I do not think we need get too uptight about
it because it is all coming out in the wash. It may be
thought that there are two distinctions between what the
documentation may reveal and what was put to Mrs. Barnes.
First of all, whether there was any question of suing and,
secondly, that it was put that it was in the first half of
1990 but one, which would be when Mrs. Barnes was already
Health and Safety Manager, when the documentation appears
to relate to the middle of 1988. What were you then,
I have forgotten?
A. I was Quality Assurance Supervisor.

MR. JUSTICE BELL: But there we are.

MS. STEEL: I mean, I accept that the date I had was wrong.

MR. JUSTICE BELL: Just leave it there.

MS. STEEL: It was the fact I was accused of making up
employees.

MR. JUSTICE BELL: Whatever happened, if it was the middle of
1988, it does not look as if Mrs. Barnes could be
expected to know about it.

MS. STEEL: When you make presentations to various
courses -- which courses do you lecture on?
A. I do not lecture on any at the moment. I lectured on
the Advanced Operations course until about 18 months ago.

Q. When you lectured on that course, did you give advice or
give instructions on how long accident books were to be
kept for?
A. No. The content of the course was (because it was to
Restaurant Managers) more about health and safety
management and systems and procedures they should have in
place in their restaurant.

Q. So if Mr. Nicholson thought that you did that, then he
would be wrong?
A. It is one of the things that was not included. He was
correct that I teach on courses, but on the accident book
it very clearly states it should be kept three years
anyway.

Q. There is no separate instruction that comes from the
Company, though?
A. If it is anywhere, it would be in the Health and Safety
manual. If it is in there, it is something that has only
quite recently been introduced.

Q. Have you ever been asked by Mr. Nicholson, or by anybody
else, for the purposes of this case, about how long you
