Day 241 - 26 Apr 96 - Page 31
McDonald's is relevant or necessary or desirable, or
whatever, whether we want to ------

MR. JUSTICE BELL: He is at L6.

MR. MORRIS: I am just checking. Obviously, the letter from
McDonald's is evidence anyway in itself, the translation of
it has been verified by the translator and I think has been
referred to previously in this case. So, I do not think we
actually need the verification by Francis Wirtz, do we,
effectively? If we wish to rely on any part of the letter,
we can just do so from McDonald's.

MR. JUSTICE BELL: I suggest, you need not read the letter, but
in case there is any doubt or argument about it, why do you
not read the Francis Wirtz letter which starts: "Dear
David".

MR. MORRIS: OK then.

MR. JUSTICE BELL: Because he produces that letter from
McDonald's of Germany.

MR. MORRIS: Yes. It is Francis Wirtz, of Osnabruck in
Germany. I have not got a date.

MR. JUSTICE BELL: You need not worry about that because there
is a date on the letter.

MR. MORRIS: Yes. He says: "Dear David, here is the original
letter from Fumik(?) GmbH, McDonald's in Osnabruck, I send
you with fax. As well I enclosed my answers from June 1989
to McDonald's. I hope I can help you with this. If you
need other things and more, please call with me. Best
wishes, Frank Wirtz, and he has signed it.

There then follows a letter with the translation of
McDonald's ---

MR. JUSTICE BELL: Yes.

MR. MORRIS: -- and a further letter that he wrote to them which
is not relevant in the case really. If I can just say, the
letter from McDonald's is about soya feed for cows destined
for McDonald's in Germany.

MR. JUSTICE BELL: Yes.

MR. MORRIS: OK. Looking through my particular bundle here, the
next one is Ronald Cummins.

MR. JUSTICE BELL: He is L3?

MR. MORRIS: Yes. "Fast-food Chains Beef Overconsumption and
Deforestation: The case of Guatemala and Costa Rica".
