Day 032 - 06 Oct 94 - Page 78
keep sight of your daily intake?
A. Yes.

Q. It would be sensible?
A. I mean, normally, one gives advice on slightly
different terms, not to look at these figures and ask: Am
I meeting this or that criteria? But to encourage a
healthier diet, which means encouraging the consumption of
certain types of foods indicated in that plate diagram we
saw a little earlier.

Normally, my encouragement is to simply follow government
guidelines and say more fruits and vegetables, more
complex carbohydrates and so forth. If, however, one
wants to work on the basis of meeting dietary reference
values for all the different nutrients, and so on, then
I am very sympathetic to the goal to keep sight of your
daily intake. That is a wonderful idea.

MR. MORRIS: No further questions.

MR. JUSTICE BELL: Thank you, Dr. Lobstein. Have we got anyone
to give evidence tomorrow?

MR. RAMPTON: We have not and did not expect to have.

MR. JUSTICE BELL: Have you anyone?

MR. MORRIS: No. We were expecting Dr. Lobstein to continue
tomorrow. That is a bonus for us. Richard Brown cannot
come tomorrow.

MR. JUSTICE BELL: We will resume on Monday then with
Dr. Barnard. When is Dr. Barnard coming, do you know?

MS. STEEL: He is arriving on Saturday.

MR. JUSTICE BELL: There is something I want to say in relation
to that then. Do you have your copy of the draft amended
statement of claim, the one you were going to take advice
before we heard argument as to whether McDonald's should
have leave to amend their statement of claim in relation
to meanings? If you look at page 13, it really relates in
part to something of what I said when Professor Crawford
was giving his evidence. We have not argued this yet
because you wanted to take advice about it. That means we
will not be arguing it before you call Dr. Barnard because
we want to get on with him straightaway on Monday
morning.

I am not prejudging in any way what my decision will be,
but that means the only safe basis to work on, when you
are calling Dr. Barnard, is that you work on the basis
that the statement of claim has in it everything which has
red on it at the top of page 13, do you understand? Both
the bit which is crossed out in red and the proposed
substitution which is underlined in red? In other words,
work on the basis that McDonald's are saying the leaflet
means that they sell meals which cause cancer of the
breast and bowel and heart disease in their customers. Do
