Day 155 - 14 Jul 95 - Page 53

  Q. How many more crew would you need on shift as compared to
       the rest of the year?
       A. It depends purely on volume.

MR. JUSTICE BELL: We appreciate that but you are being asked to
assist if you can. Let us suppose by November 86 you were
getting up towards your 100. First of all, can you
remember what you were aiming for to have year round?
       A. The 100 was the benchmark.

  Q. How many more would you contemplate taking on to cope with
       anticipated extra trade at Christmas?
       A. Maybe another 10, 15 maximum, but then if I lost 10,
       15, that 100 was a benchmark plus a buffer.

MS. STEEL: The people who went back to Spain and Italy, I mean
were they coming back after the Christmas break?
       A. Some did, some did not.

  Q. So were they all terminated?
       A. No, it was purely dependent on the individual
themselves. If they said to me they are definitely going
back to Spain or Italy, then obviously they would be
terminated. If they approached me and said, "Tony, I am
going to Italy for X amount of weeks, months, or whatever.
I am definitely coming back on this day", then they were
       not terminated.

MR. MORRIS: Just going back to before your time, the previous
Manager was dismissed. McDonald's do not dismiss Managers
       lightly, do they?
       A. I am not aware of that.

  Q. In your general experience throughout your 14 years,
Managers are not dismissed night and day, are they?
       A. Not night and day, no.

  Q. How many about a year might be dismissed?
       A. I could not give you a figure.

MR. RAMPTON: How can the witness answer that sort of question?

MR. MORRIS: He can probably answer it very simply but there you
       go.

MR. RAMPTON: How can he? He cannot be expected to have the
statistics of Managers dismissed throughout the Company
during the course of the year in his head.

MR. JUSTICE BELL: He said that he cannot answer.

MR. MORRIS: So the conditions that you inherited must have been
going on for some time anyway?
       A. I do not know because I had a different Supervisor
under Enfield so I had no contact whatsoever with the
Supervisor and previous Restaurant Manager of Seven
       Sisters.

  Q. But you would have been briefed when you arrived. They did
