Day 152 - 11 Jul 95 - Page 62

scared to say what they think and generally they do.

  Q. Were what happened and what people said at the rap sessions
       recorded in any way?
       A. It was recorded almost as verbatim as you could make
it. You either took someone along who would take notes for
you or you took them yourself, took the notes as you went
       along.

  Q. Then what would you do with your notes?
       A. Get them typed up. One copy would go up on the crew
room notice board, one copy would go to the management
team, one copy would go to the store file, and I think a
further one went to the Supervisor. From those notes for
the rap session the store management team would compile an
action plan. The action plan should go on the crew room
wall, and the action plan consisted of problem,
responsibility of a particular Manager and then the
resolution to that problem. That was an action plan that
was posted on the crew room wall alongside the rap session.

  Q. Was the action plan acted upon?
       A. Yes.

  Q. What about individual grievances, Mr. Davis? Suppose I am
a crew member and I am a bit fed up with the First
Assistant because I think he has put a down on me and he is
giving me the wrong kind of hours, or something like that,
or he is being unfair to me in the performance reviews.
What should I do with that individual grievance?
       A. In a rap session?

  Q. No, outside of a rap session?
       A. Sorry, can you repeat the question? I am still
       thinking of the rap session.

  Q. Suppose that I do not want to say -- I have left the rap
sessions now, sorry about that -- I do not want to say it
at a rap session, but I do want to make an individual
       complaint.

MR. JUSTICE BELL: Or the next rap session is some way ahead and
you may not be able to attend it anyway?
       A. Yes. If they had a complaint about a specific
Assistant Manager, then I would hope, as a Manager, they
come and speak to me about it and I would do my best to
resolve the situation as amicably as possible between the
two parties. If they felt they could not come to me for
whatever reason, then there was always the Area Supervisor
they could go to. I suppose, taken to its ultimate, they
could always write off to Head Office if they felt that
neither of those situations worked, although I cannot
recall any instances of that happening.

MR. RAMPTON: That is what I was going to ask you, whether, in
your experience, that actually ever happened. You have
dealt with that. Just a couple more things, Mr. Davis,
then I will sit down. How good do you think, looking back
on it, the standard of hygiene and food handling was in the
       Colchester restaurant in your time?
