Now of the two witnesses, Mr. Langert and Mr. Kouchoukos,
2 he is much the shorter, since he is not a McDonald's
person at all. He is a Pacico witness. If I say he is
3 just a facts and figures man, that would not do him
justice, but that is essence of his evidence. He gives
4 figures for the consumption of HCFCs and timber, which are
important matters for your Lordship's to know, both in the
5 United States and elsewhere.
6 What I am proposing at the moment with your Lordship's
approval is this, that if it should appear
7 that Mr. Preston's cross-examination is going to go on,
let us say, till lunch time or beyond tomorrow, then what
8 I would like to be able to do is to call Mr. Kouchoukos
first thing tomorrow morning, interpose him in other
9 words, so he can complete his evidence and then continue
with Mr. Preston. Professor Duxbury is not movable, but
10 he is short. Then one can continue with Mr. Preston and
then interpose Professor Duxbury who has come down from
11 Scotland to give evidence, and then do Mr. Langert on
Thursday and Friday, so that he too can return to the
12 United States before the weekend. They both arrived this
last weekend. They have been sitting in court. I am very
13 anxious, particularly in Mr. Kouchoukos' case, that
I should be able to finish him tomorrow. I am not by
14 saying any of that intending or attempting to suggest that
the cross-examination of Mr. Preston should in any way be
15 abbreviated or curtailed, merely interrupted.
16 MISS STEEL: Could you just explain exactly when you are
proposing to call -----

MR. JUSTICE BELL: The suggestion is that, we can come back to
18 Mr. Preston and I do not think since his cross-examination
has been broken once already and has to be broken again, I
19 do not think it will harm your cause if we break it for
Mr. Kouchoukos or other witnesses. It seems to me if we
20 are going to do that in the light of what happened with
Mr. Beavers when we waited until 12 noon, at my
21 suggestion, and we did not finish, it would be better to
get on with Mr. Kouchoukos in the morning. It means you
22 can remind yourself overnight of what you want to ask
him. When you do that, if I might suggest, remember he is
23 not the only witness on recycling and waste. So what you
really want to concentrate on in your cross-examination
24 are those matters which he alone really speaks on behalf
of McDonald's.

MR. RAMPTON: The witnesses, my Lord, who represent McDonald's
26 on recycling and waste are principally Mr. Langert and
Mr. Oakley.

MR. JUSTICE BELL: Mr. Langert is the first plaintiffs'
28 director of environmental affairs.
