     2   MR. JUSTICE BELL:  I do not know what the position is with
     3        Mr. Fernando Gomez Gonzales.

     5   MR. RAMPTON:  He is arriving this coming Sunday, 11th, on the
     6        shores.

     8   MR. JUSTICE BELL:  It is not convenient to witnesses living in
     9        the United Kingdom to have them shuffled around, but I can
    10        see it causes much less disruption that someone who is
    11        coming across the Atlantic expecting to give his evidence
    12        and go back again.

    14   MR. MORRIS:  But he is a McDonald's person.

    16   MR. JUSTICE BELL:  It does not matter, he is also a person; that
    17        is what matters.

    19   MR. MORRIS:  Yes, I know but he does not have to come that
    20        week.  He could come whenever it is suitable for both him
    21        and -----

    23   MR. JUSTICE BELL:  I am going to leave it there.  We will come
    24        back to that.  Mr. Rampton will tell me in due course
    25        whether, in fact, Mr. Fernando Gomez Gonzales must for
    26        reasons of practical convenience, apart from what has
    27        actually been arranged, be called that week.  Mr. Oakley is
    28        looking through his diary.  I would be grateful if you
    29        would approach Ms. Dibb as well.  If she must come on
    30        Friday, she must come on Friday.  But, for all I know, when
    31        you ring her up it really will not matter too much to her
    32        whether it is Friday or one of a selection of four or five
    33        other days before the end of term, so I would like you to
    34        find that out.

    36   MR. RAMPTON:  My Lord, while Mr. Oakley is here, he tells me he
    37        could clear Thursday, if that would help?

    39   MR. JUSTICE BELL:  If he would be kind enough to keep it clear
    40        and we will see how we go on with Mr. Van Erp.

    42   MR. RAMPTON:  One other thing, while the Scottish academics are
    43        still where they are in the trial, can I mention this to
    44        your Lordship:  Yet again, they are getting quite close
    45        and, quite evidently, I need to show what Mr. North may
    46        have to say to them before we call their evidence.

    48   MR. MORRIS:  There is a matter of the Plaintiffs were preparing
    49        discovery as well of documents.  I do not know when that is
    50        likely to happen.

    52   MR. JUSTICE BELL:  What is the position with Mr. North?

    54   MR. MORRIS:  Yes.  The position is we have not managed to speak
    55        to him in the last few weeks, in fact, since he made his
    56        visit.  I know he did make his visit.

    58   MR. JUSTICE BELL:  What is the difficulty?  Is that just time on
    59        your part or some difficulty getting in touch with him?
