Day 278 - 11 Jul 96 - Page 32
one, Miss Steel. The passage in Trial News wholly
misrepresents both the nature of the argument about
nutrition and disease and, more particularly, does it
misrepresent what I said in the Court of Appeal; does it
not?
A. I don't think so. I mean, it is referring to the
passage in the fact sheet and that is the passage in the
fact sheet which -- that section of the fact sheet is a
passage which you referred to as being the kiss of death
for, you know, if it was proved.

Q. Can I ask you to look again at those short paragraphs in
The Guardian article, which were certainly accepted on our
side and, I think, by his Lordship some time ago but that
does not matter for this purpose, as being an accurate?
A. With all respect to --

Q. Just let me finish my question?
A. With all respect to Mr. Justice Bell, he was not
actually at the hearing.

MR. JUSTICE BELL: I do not know what Mr. Rampton is going to
say about what I have accepted yet because he had not got
to the end of his question.
A. He just said that you accepted it.

MR. JUSTICE BELL: Start again Mr. Rampton, please?

MR. RAMPTON: What I said at the Court of Appeal, as is reported
here, accurately reported by Mr. James Erlichman, was that
the allegation which would be the kiss of death if it were
thought to be true, so far as McDonald's is concerned, is
that their food was apt to cause cancer?
A. I do not, I mean, I do not say there is anything
incorrect in what is in there. But it is quite obvious
that Mr. Erlichman has condensed what you said that
morning. And you said a great deal more than that. You
were talking about that section of the leaflet and you said
it would be the kiss of death for a fast food company if
that section of the leaflet was proved.

Q. Then I would like to move on to the third page in this
little bundle, which is September 1995, page 3 is there
just to give the date of the document?
A. In this bundle, sorry?

Q. In this bundle, Trial News 2 September 1995 emanating from
the Mclibel support campaign, care of 5, Caledonian Road.
Please turn over to the page which I have numbered 4 in the
bottom right-hand corner, and look in the box just below
the middle of the page with the word "rainforest" written
in it. I would like you to read that. Once again, I am
not going to dignify it by reading it out. I would like
you to read it to yourself, please?
A. Just the box?

Q. Just the box?
A. Looks true to me.

Q. Did you write it?
