     1        are particularly pertinent:  "'The percentage by weight of
              fat and of saturated, polyunsaturated and trans fatty
     2        acids in butter, margarine, cooking fats and edible oils
              should be printed on the container or wrapping in which
     3        they are sold. Consideration should be given to providing
              in addition (i.e. not in place of) uniform and more simple
     4        labelling codes to enable the general public to
              distinguish easily between fats and oils with low or high
     5        contents of saturated fatty acids.'
 
     6        'Information comparable to that specified above should be
              provided, wherever practicable, for all other foods with a
     7        fat content of more than 10 per cent by weight", which
              would, presumably, apply in the case of McDonald's, "or
     8        which are major contributors to fat intake'."
 
     9   MR. RAMPTON:  Can read on, please?
 
    10   MS. STEEL:   I am going to, do not worry.  "'If the foods are
              sold in pre-packed form, the information should be printed
    11        on the package wherever possible.  If the foods are not
              sold pre-packed the information should be displayed
    12        prominently at retail outlets".
 
    13        So, is that something you have changed your mind on as
              well?
    14        A.  Again, if you will finish the quotation.
 
    15   MR. JUSTICE BELL:  Do you want to read on?  "'The foods in this
              category are mainly meats and meat products'".

         MS. STEEL:   Right. "'... milk and cream, cheese, and cakes and
    17        biscuits.  Equally, caterers should provide similar
              information in appropriate ways'."

              Meat products, milk, cream, cheese and biscuits are all
    19        things that are sold at McDonald's, are they not, and
              cakes, are they not, so that fits the bill really?
    20        A.  Yes, well, it does because McDonald's are caterers,
              and if you go on and read, it says:  "'... caterers should
    21        provide similar information in appropriate ways'."
              McDonald's does provide the information in the form of
    22        leaflets which, in my view, fully meets this rubric.
 
    23   MR. JUSTICE BELL:  Where is the caterers' -- I see you have
              caterers up before the quote but where is the reference to
    24        caterers?
              A.  Sorry, last sentence, still at the quote.

         Q.   I see, thank you.

         MS. STEEL:   McDonald's are a retail outlet, are they not?  I 
    27        mean, they are retailing fast foods to the public?
              A.  I think, you know, in this sense McDonald's are
    28        caterers.
 
    29   Q.   "In this sense"?
              A.  Yes.  They are selling food for consumption on the
    30        premises.
