Day 245 - 07 May 96 - Page 25

Q. Some stores actually handed them out to people?
A. They handed them out when they were asked, if they were
asked, and some put it in the "Did You Know Board" an
people would take them if they were interested.

Q. Some were handed out to some customers?
A. I presume some must have been.

Q. In total, I think we have heard that there were 300,000 of
these printed?
A. I think so.

Q. You accept that. I think it is actually in your pleading
somewhere. It is in the Further and Better Particulars of
the Defence to Counterclaim dated 15th July 1994. It says
that 600 boxes of 500 leaflets were produced?
A. Sure.

Q. Right. If you look at the fourth paragraph?
A. Yes?

Q. This is the leaflet entitled: "To our customers: Why
McDonald's is going to court". I will read the first part:

"From 18th April 1994, McDonald's will go to court to stop
publication of the leaflet, 'What's wrong with
McDonald's'."

Then in the fourth paragraph, it says:

"This leaflet has been distributed worldwide since 1984.
Its content have been repeated in the media stores and even
in church magazines."

You do not have any evidence that it was actually
distributed in 1984, do you?
A. I know that it or something very similar to it with all
the same contents was, yes. We looked at it a few moments
ago.

Q. Yes, but it was quite different.
A. I would dispute that.

Q. It certainly was not the same leaflet, was it?
A. It was not identical.

Q. To say that, "The leaflet has been distributed worldwide
since 1984" is incorrect; is it not?
A. No.

Q. The next paragraph is:

"During that period" -- i.e. since 1984 -- "the group has
ignored several requests from McDonald's to stop publishing
the leaflet." That is not true, is it?
A. I believe it is true.

Q. Why do you believe it is true?
A. Between then and the court dates, requests were made to
