Day 081 - 31 Jan 95 - Page 46

MS. STEEL: In fact, I did hand a copy to the Judge.

MR. JUSTICE BELL: Is that the ones produced in court?

  MS. STEEL: Yes.

MR. RAMPTON: Yes. Your Lordship should have the documents but
probably has not the proper file because I have one which
is called bundle V and it is headed "Judge" so perhaps if I
       pass that up?

MR. JUSTICE BELL: That is the one starting off: "List of
       Documents served 18th January 1995"?

MR. RAMPTON: My Lord, that is right.

MR. JUSTICE BELL: I will undo all Mr. Stiles' good work and put
       it in the .....

MR. RAMPTON: I would only say this: I know enough about this
file of documents to know that the vast majority of them
are inadmissible -- not all but most. I do, therefore,
utter a word of caution at this stage before Mr. Morris
starts reading them out, according to the principle
enunciated by your Lordship the other day.

MR. MORRIS (To the witness): When you did your expert visits to
Sun Valley or, indeed, any other place but specifically Sun
Valley, did you ask about incidents of food poisoning which
McDonald's customers had suffered? Did you ask them if
       they kept records?
       A. No.

  Q. If they took the decisions of local authorities or
Magistrates Courts seriously or anything like that?
       A. No.

  Q. You did not ask to get access to any documents with those
       kinds of records?
       A. No.

  Q. If you go to the fourth document, the fourth sheet, it is
actually the fourth sheet in document 1, can you just read
       that?

MR. JUSTICE BELL: We had better make sure we just identify it
in some way by a number or a date or something.

MR. MORRIS: It is 6th August 1990 Magistrates ruling on
salmonella food poisoning incident at McDonald's.

MR. RAMPTON: No, my Lord. It is not that at all, with the
       greatest possible respect.

MR. JUSTICE BELL: Anyway, it is a return of legal
       proceedings -----

MR. MORRIS: He said it is nothing to do with that; it is the
one I am looking at anyway.
