Day 138 - 20 Jun 95 - Page 40

Q. In the restaurant?
A. I was in the restaurant and about the restaurant.

Q. All the employees turned up, so far as you know,
voluntarily?
A. There is no question that it was voluntary.

Q. So roughly how many employees would have been present in
the restaurant on that day?
A. Again, I cannot recall exactly how many we had, but
I would say over 100, 150, 200. I cannot really recall.
I remember there was -- we had hired and we were employing
a large number of employees.

Q. Was there a similar split in the ages of employees as one
might expect to find in a restaurant in the United States?
A. Very similar; more college students, if you will, than
high school students. So, a tad older by one or two years
in general.

Q. Were there women as well as men?
A. Yes.

Q. In what sorts of proportions?
A. 50-50.

Q. Was Mr. Kahan present as well?
A. Yes, he was.

Q. At the appointed hour, which I think you said was about
6 o'clock in the evening, were there any members of the
public in the restaurant?
A. Yes, in the restaurant at that time were customers. We
wanted to continue business as usual. So there were
customers there. There were also -- Saul's lawyer was
there and a photographer was there as well.

Q. Why was the photographer there and why was the lawyer
there?
A. We did not really know fully what to expect, except we
knew that 6 o'clock was a significant moment in time, and
we wanted to make sure that whatever occurred there
occurred correctly from the Company's point of view.

Q. At 6 o'clock the union is supposed to turn up and make its
strike call; is that correct?
A. That is correct.

Q. Is there any legal requirement or limit in Mexico on
Mexican law as to the number of union people that may come
along at such a time and make the strike call?
A. It should be the top union officials who come, maybe
two or three, and are to be given the opportunity to speak
to the crew.

Q. Did such people turn up on this occasion?
A. 200 to 300 people showed up.

Q. Did the union officials turn up?
