     4   Q.   The McDonald's Corporation has used the words "healthy" and
     5        "nutritious" to describe its food; is that correct?
     6        A.  Yes, in terms of, I believe, that the food we provide
     7        provides nutrients and that it can be part of a healthy
     8        diet.

    10   Q.   Yes.  We do not need to go through all the documents, but
    11        if court has been shown a document which says:  "Every time
    12        you go to McDonald's, you are eating good, nutritious
    13        food", if you use the word "nutritious" in your advertising
    14        or promotions to describe McDonald's food, what would you
    15        mean?
    16        A.  From my perspective, that it could fit into a well
    17        balanced, nutritious diet.

    19   MR. MORRIS:   Yes.  But anything can fit into a well balanced,
    20        nutritious diet, can it not?

    22   MR. JUSTICE BELL:  He gave quite a clear definition which,
    23        I have to say, I thought was rather more realistic than
    24        Professor Wheelock's earlier on in his evidence.  But I do
    25        not think I actually put that into my notebook, as opposed
    26        to highlighting it.  It was something related to containing
    27        food that was good for you, something along those lines.
    28        I think that, probably as a result of having Case View,
    29        none of us have actually got it in a notebook.

    31   MR. RAMPTON:  I have hardly got a notebook, for that reason.  If
    32        your Lordship can tell me which day it was?  My Lord, on
    33        day 43----

    35   MR. JUSTICE BELL:  Could you give me the date?

    37   MR. RAMPTON:  1st November, page 64, line 53 -- this may be what
    38        your Lordship is referring to -- your Lordship said:

    40        "I think we should know what Mr. Green means by
    41        'nutritious' in the light of previous evidence we have
    42        had" -- which might have been a reference to Professor
    43        Wheelock, amongst others -- "Mr. Green, from my
    44        perspective, from a layman's perspective, it provides
    45        nourishment, it provides nutrients and can be part of a
    46        healthy balanced diet."

    48        I do not know whether that is what your Lordship was
    49        thinking of?

    51   MR. JUSTICE BELL:  It is.

    53   MR. MORRIS:  (To the witness)  So, for example, a Coke could not
    54        be described as nutritious, could it?
    55        A.  Well, providing water, and I think that is part of a
    56        balanced diet; but if it has no nutrients, or if it has no
    57        vitamins and so forth, then it probably is irrelevant.

    59   Q.   It has sugar.  That is a nutrient, is it not?
    60        A.  Yes.
