Day 061 - 05 Dec 94 - Page 76

from forests which is Mr. Hopkins' area, and we are on
supplies mostly but not entirely related to packaging at
the moment. That is what we are all focused in on. Would
you like just to sit down behind Mr. Atkinson or next to
       Mrs. Brinley-Codd, Mr. Oakley?

MR. RAMPTON: My Lord, if Ms. Dibb could be moved, Mr. Oakley
could be finished on Friday. That would be very
convenient. The following week at the moment Mr. Gonzales
is booked. He is coming over from America. As I have
understood what your Lordship has been saying to the
Defendants, he would not start until the 14th which is the
Wednesday because your Lordship has promised them two clear
days, so that would have to be the Monday and the Tuesday
of that week. What I could then do is to postpone the two
Scottish academics who are down for -- yes, sorry, I see
       crossed fingers.

MR. JUSTICE BELL: We can see the dates there; the last day of
       term is Wednesday 21st.

MR. RAMPTON: Yes. What I am suggesting is that if we were able
to postpone Professor Jackson and Dr. Clark, we would have
three days, 19th, 20th and 21st, for Ms. Dibb to choose
       from.

MR. JUSTICE BELL: I am going to break off now with this
suggestion: We will in any event start Mr. Van Erp
tomorrow morning. We will hope to finish Mr. Van Erp
before we come to Friday. If we finish comfortably before
then, well and good, but we will do our best to complete
his evidence within the bounds of Tuesday, Wednesday and
       Thursday.

If Mr. Oakley would be kind enough (and I see he is doing
it now anyway) to let Mrs. Brinley-Codd know on which dates
between now and Wednesday, 21st December he could come back
for a whole day, I would be grateful. If you would get in
touch with Ms. Dibb and find out if, in fact, she were not
to be called on Friday, which days -- again a full day
ought to be allowed for -- between now and Wednesday,
21st December she would be available. Then we can renew
this discussion either tomorrow afternoon or on Wednesday.

MR. MORRIS: Can I make a practical suggestion, that we have at
the moment about three issues on the boil.

MR. JUSTICE BELL: Yes, I have that in mind. I have, when I am
ready to do so, to give judgment on the matters we heard
the other day, and you have got other procedural matters
which it seems to me ought to be decided before the end of
       this term.

MR. MORRIS: Yes. All I am saying is also in terms of the
evidence, we also still have outstanding packaging,
nutrition and advertising. It may be more efficient for
everybody if we put back the whole subject of food
poisoning and make sure we finish off the subjects of
packaging, advertising, nutrition such as it is at the
       moment with Mr. Oakley.
