Day 188 - 15 Nov 95 - Page 60

MR. RAMPTON: Then the next two -----

MR. JUSTICE BELL: Do you want to deal with them one by one or
       altogether?

MR. MORRIS: It might be better if we do it at the end. We will
just identify them and talk about it ourselves.

MR. RAMPTON: My Lord, the next two, I think, are on page ten,
the two middle paragraphs. I am saying this without
       looking back at the transcript.

MR. MORRIS: There is nothing identified on page ten.

MR. JUSTICE BELL: No, I do not have anything on page ten.

MR. RAMPTON: Perhaps I did not raise it then. The next one
then is 11, and that is because of what appears partly --
it is partly because of what is actually written there; the
words from "this girl" down to "sick pay". The principal
reason for it, apart from the words that actually appear
there, was because of what appears on page 3 of the
       supplementary statement.

MR. JUSTICE BELL: You have got the foot of page 2 ----

MR. RAMPTON: Is it the foot of page 2? Yes, that is right,
sorry -- from the foot of page 2 beginning, "I think", and
then the first paragraph on page 3, which again is the
plainest possible hearsay. Apart from that, as I have said
before, there is an awful lot that looks as if it is
probably hearsay. I do not think I had anything else,
except the first paragraph on page 1 of the continuation
statement, the last three sentences: "One person told
       me".

MR. MORRIS: Sorry, where are we up to? Page 1 of the
       continuation -----

MR. RAMPTON: Yes, the last three sentences of the first
       paragraph.

MR. MORRIS: That is a new one.

MR. JUSTICE BELL: Yes, I have not got that.

MR. RAMPTON: Perhaps I did not get to it or I forgot it, but
anyhow I notice it now because it is quite obviously
hearsay. I do not know if it helps for the future, but can
I give your Lordship a reference in the case which has just
been published -- I am not going to read it now; it is not
fair; anyway the Defendants have not got it -- in the
latest part of the Weeklys for the 10th November 1995, to a
       case called -----

MS. STEEL: What is the Weekly?

MR. JUSTICE BELL: Weekly Law Reports.
