Day 197 - 07 Dec 95 - Page 32
Q. Were they the practices that you have been taught by him
originally?
A. Yes. I mean, basically it would be the case that the
things I had learnt I carried on doing and people I taught
were taught the same practices right the way through.

Q. If we go to Steve Harney, I do not know, is he just
behind?
A. Yes.

Q. In paragraph 3 he talks about watering down of products
and docking crew hours, etc. etc. which are listed there.
He says that none of the following malpractices which were
alleged by you and Simon Gibney ever happened or were ever
mentioned while Mark Davis was Store Manager. Do you have
any comment to make on that?
A. I find this actual statement very hard to accept as
true as during my time at the store, both as a Trainee
Manager and the Store Manager, Steve Harney was working
very closely with me or just underneath me. He would have
been aware of all the things that he said did not go on
taking place. As a crew member, a training squad member,
he worked on a lot of my shifts to actually assist me when
I was training, and certainly worked excess hours, being
clocked off, paid a bonus. He would be a party to all the
things that had gone on here. I find it very hard to
believe that he can actually write down and say they have
not happened.

Q. The last point you mentioned that was in relation to
paragraph G, was it?
A. Certainly that would have happened to him during his
early stages with the Company.

Q. That he would have worked beyond the legal hours?
A. He actually worked shifts with me as a training squad
or it would be a training squad at the time on the close
where he would have actually, should have clocked off and
he clocked off and stayed on and he would have been paid a
bonus.

Q. He was under 18 at that time, was he?
A. At that time. Because of the age when he joined the
Company, he got to a stage where we needed to promote him
but he was not of the age to be promoted at one stage.
So, he was actually far in advance of what we could
actually do for him at that time.

Q. This was while Mark Davis was Manager?
A. Yes, I was Assistant Manager.

Q. If you could go to the statement of Timothy Taylor? It is
possible that is the one before.

MR. JUSTICE BELL: Was that the Civil Evidence Act one?

MR. RAMPTON: Yes, my Lord, it is on a piece of paper which
Mrs. Brinley-Codd has given to the Defendants.

MR. JUSTICE BELL: Yes. It went into yellow XIII, I think.
