Day 067 - 15 Dec 94 - Page 63

letter was 10 years ago. If you want to spend some
sometime reading transcript, maybe we can talk -----

MR. JUSTICE BELL: Stop a moment. Stop, both of you. What
would help me most is if you could say what dates or
       approximate dates the letters were?
       A. I have seen letters from recent letters, the year 1994,
1993, and then it goes back, I think, periodic letters
going back to 10 years, throughout those times, but
I remember, the last one I remember is about 10 years old.

MR. MORRIS: You have seen no evidence before that time ---
       A. No, sir.

  Q. -- that Coope Montecillos was not exporting?
       A. That is correct. I have said no evidence, and
I suggest that we bring Ray Cesca who is responsible for
that particular area regarding the rainforests which we
discussed in Costa Rica's part, Coope Montecillos' part of
that issue, that he will provide the information that you
       are looking for.

  Q. Before, say, 1983/84 then, you cannot recall any evidence
that you have seen -- evidence from before that time --
that would convince you that they were not exporting to
       other countries?
       A. That is incorrect, sir. I have stated that I have
communicated with people who were involved in this
particular issue that have been in the company up to 20
years. They have told me, and it is people that I have
worked with them and I have a high level of respect and
trust, they have told me that they have never seen
evidence. They have told me that no evidence has ever been
brought up to them or to anybody. The film contains
unsubstantiated accusations. There is not a single fact or
proof of evidence that we have exported product from Costa
Rica to the United States ---

  Q. But you have not seen -----
       A. -- if you let me finish.

MR. RAMPTON: My Lord, I really must object to Mr. Morris'
intimidatory form of cross-examination. Your Lordship will
remember that I was extremely patient with Ms. Dibb who
most of the time was not answering the questions I asked.
I do ask that Mr. Morris be quiet while the witness answers
       the questions.

MR. JUSTICE BELL: Whatever happened or did not happen -- no,
please sit down for a moment -- with regard to Ms. Dibb,
you must let him finish. We can then judge to what extent
the answers help, but when you interrupt, no doubt out of
enthusiasm for the cause, we end up having this kind of
       discussion.

MR. MORRIS: I understand Mr. Gonzalez wants to -----

MR. JUSTICE BELL: The next point is this: You have, in fact,
asked that question on a number of occasions. If you are
not satisfied with the answer, instead of asking the
