3 Q. Take the Floor Managers first, if we may: Why is it or was
4 it that the Floor Managers tended to work 39 or more than
5 39 hours in a week?
6 A. Generally, with the Floor Managers -- on any given
7 shift you would like to have a salaried Manager and a Floor
8 Manager on together -- so generally the Floor Managers were
9 scheduled a five-day week. If two of those shifts, for
10 instance, were night shifts, then that would mean two x
11 nine hour shifts plus three x eight hours shift, so that
12 would mean they would work more than 39 hours. The idea of
13 them working with the salaried Manager was that (a) they
14 were aiding the salaried Manager and (b) it was a sort of
15 shadowing effect, if you like, so that they were learning
16 the job of Assistant Manager.

18 Q. Were they sometimes then or perhaps often, I do not know,
19 people who wanted to go on and be salaried Managers?
20 A. Most of them wanted to be salaried managers at some
21 point.

23 Q. I think you said one or two ordinary crew members also on
24 average during a week would work more than 39 hours, yes?
25 A. Sometimes, yes.

30 English colloquialism. One to three. Mr. Davis, to what
31 extent, if any, were those people who worked more than 39
32 hours -- I am talking now about the crew members ---

35 Q. -- required by you to do so and to what extent did they do
36 it because they wanted to?
37 A. None of them were forced to work more than 39 hours.

41 Most -- it would be more of the case that people would
42 request to do it or people who particularly wanted to work
43 night shifts. So, for instance, if they did three night
44 shifts a work, started at 4.00 and finished at 1.00, for
45 instance, on average ------

47 Q. Started at 4.00 in the afternoon and finished at 1.00 in
48 the morning; is that right?
49 A. Yes, that would be three x nine hour shifts and then
50 maybe they did two x eight hour shifts on top of that. So,
51 that is the mechanism whereby they might work over 39. The
52 idea was not to have people working over 39 hours.
53 However, if it meant that they went 40 on occasions, then
54 I did not see that as a problem.

56 Q. I understand you were in court -- I was not, Mr. Davis but
57 I have read the transcript -- when Mr. Alemi's time sheets
58 or some of them were gone through?
