Day 057 - 29 Nov 94 - Page 31

MS. STEEL: No, it was not 1993.

MR. JUSTICE BELL: Just what was the information which it
       contained?

MR. RAMPTON: My Lord, it is tab 2.

MS. STEEL: There was a whole chart of -----

MR. JUSTICE BELL: Do you have a page, Mr. Rampton?

MR. RAMPTON: Page 65, my Lord. They are terribly difficult to
read. My recollection is that we looked at an original.
Mrs. Brinley-Codd has it now. It looked like that. It is
page 65 of that file. It is the Annual Report for 1990.
I seem to recall I had a better copy at one stage.

MS. STEEL: Whoever drafted this chart must have had the figures
that they worked upon because, I mean, at the time this was
referred to by Mr. Wheelock we had not had any nutritional,
recent nutritional, information for the United States after
they changed their menu to include things like grapefruit
juice, and things like that, and all the other new things,
apple bran muffins. I am not sure whether we have anything
recent, in fact, even now, but in any event we do not know
what figures these are based upon. If reliance is being
placed on them, we ought to have the figures.

MR. JUSTICE BELL: The position is this, that you are saying:
"I cannot just accept off the face of that that those
daily diets do come within 3,000 calories or 1500 calories
because one has nothing to check the arithmetic against"?

  MS. STEEL: Yes.

MR. JUSTICE BELL: That sheet is only evidence (if it is
evidence of anything at all) Mr. Rampton, is it not, that
that is what McDonald's were saying, it is not evidence
       that it is true?

MR. RAMPTON: I quite agree. If we think this is a valuable
document to which your Lordship should pay attention, then
we will enquire whether there are any underlying documents
in existence which are relevant and, if there are, then we
       will disclose them.

MR. JUSTICE BELL: Should you not do that even if, whatever your
stand maybe -- is it not right that one way or another
I should, having had the document put in front of me, know
what the actual quantities are, provided that can be
       discovered?

MR. RAMPTON: It may be, but your Lordship, I do not know, 1990,
there is a good deal of information -- says he without as
much confidence as he should feel -- on that topic already
in the nutrition file, the pink one, VI.

MR. JUSTICE BELL: It seems to me -- it need not be done at this
moment -- some effort must be made to see if we do have
material from which anyone who wants to spend the time on
