Day 086 - 09 Feb 95 - Page 22

       A. I think that is what he -- he thinks he should be
involved in that but there may well have been another
system of investigating that. There are other people
involved in equipment in the region and there are
Operations people, and there may well have been a regional
health and safety officer who was doing that. To me, he
obviously wants to do something about it and get involved.

  Q. Immediately?
       A. Yes, he thought it was very important that this note,
the underlining and the exclamation marks within there.

MR. MORRIS: Manchester is in the northern region, is it not?
       A. That is correct, yes.

  Q. Whatever it was, eight months later Mark Hopkins died of
electrocution. If we look at page 794J in that tab you see
a Deferred Prohibition Notice from Manchester City
Council. What is the purpose of a Deferred Prohibition
Notice? Is it a statutory sanction?

MR. JUSTICE BELL: What reference did you say?

MR. MORRIS: Sorry, 794J. (To the witness): You know about
       Prohibition Notices, though, do you?
       A. I have heard about Prohibition Notices.

  Q. How many Prohibition Notices do you get in a year?
I suppose you have only been in the position for six
months. Would you hear about a Prohibition Notice being
       served on a store?
       A. When I was in Operations, as an Operations Manager, we
probably had two or three Prohibition Notices served on an
       aspect of the restaurant.

  Q. That you were involved with?
       A. Yes.

  Q. You said you covered 20 restaurants?
       A. About 20 or so restaurants.

  Q. That is for a period of how long?
       A. About four years.

  Q. You had about three in four years -- less than one a year?
       A. I think so.

  Q. In 20 stores?
       A. I am not sure about a Deferred Prohibition Notice.
I cannot recollect having a deferred one. They all seemed
       to be Prohibition Notices.

  Q. Yes. So what are the usual reasons for -- I mean,
Prohibition Notices are to be taken extremely seriously,
       are they?
       A. If a prohibition Notice comes in, yes, we would take
it, take it seriously and act upon it.

  Q. If you did not you would be prosecuted or something like?
       A. I am not too sure about that, but I would say logically
