1 Q. Do you remember that you were represented at that hearing
2 in the High Court? Were you there?
3 A. I was not there, no.

5 Q. Do you remember that you were represented by solicitors and
6 counsel?
7 A. Through the union, yes, but I was not there.

10 A. Yes. Well, I was not there, so yes.

12 Q. Would you like to turn over to 1024 or 32?

15 Q. You made an affidavit for those proceedings, I think?
16 A. I did, yes.

18 Q. You, Mr. Macken, Mr. Dowling and somebody called
19 Thomas White; yes?
20 A. Yes. There was a union official, Thomas White.

22 Q. What was before the court were allegations of intimidation
23 and violence of pickets, was it not?
24 A. Yes, so I believe, yes.

26 Q. I expect in your affidavit you denied those allegations,
27 did you?
28 A. I never saw any of them; and, what is more, I was not
29 there when any of the alleged ones occurred.

31 Q. Would you just look over the page at the order that the
32 court made? This is second time round.
33 A. Which page?

36 A. Yes.

38 Q. "It is ordered that the defendants and each of them and all
39 persons associated with them be restrained until after
40 trial of this action and until further order from
41 trespassing on the plaintiff's premises at Upper O'Connell
42 Street and Grafton Street and from obstructing the
43 premises, from using abusive and threatening language
44 against employees or customers, or otherwise intimidating
45 the plaintiff's employees, calling at the houses of the
46 plaintiff's employees, picketing the premises otherwise
47 than in reasonable numbers, and the court does declare the
48 same in the circumstances of this case to be not more than
49 three persons at any one time, picketing the premises
50 otherwise than for the purpose of communication
51 communicating information, picketing the said premises
52 after the hour of 10 o'clock in the evening."

54 Do you still say, Mr. Mrozek, that the picket was peaceful,
55 non-violent and unintimidating?
56 A. When I was on it, it was never, it was never
57 obstructive or violent. There may have been shouting by
58 some individuals, like, but there was never any violence at
59 any stage when I was there, never; and I have never been
60 abusive to anyone.
