Day 095 - 02 Mar 95 - Page 31

part. I have to look at the entire process. We do not
make assumptions like that. We do not draw conclusions
like that on just one little thing.

  Q. So it is possible for your suppliers to have chickens five
to a cage like that and, as long as everything else is OK
such as the feed or whatever, you would be quite happy in
       terms of animal welfare?
       A. I told you our suppliers do not have that. I am not
       going to speculate.

MR. JUSTICE BELL: I am going to stop you there because it is
       far too hypothetical a question.

MS. STEEL: Except that Dr. Gomez Gonzalez does not know how
       they are organised.

MR. RAMPTON: I have to say (I do not want to waste time) that
Dr. Gomez Gonzalez has made a number of positive assertions
about the conditions in which the animals supplied for
McDonald's use are kept, the conditions in which they are
slaughtered. I have not heard a single direct challenge to
any of his evidence on these matters. All I have heard is
       theoretical hypothesis.

MS. STEEL: We know in this country they are kept five to a
       cage.

MR. JUSTICE BELL: But you have Dr. Gomez Gonzalez in the
witness box now, figuratively speaking. It is to him you
are directing your questions. You say it is a hypothetical
question. You said that except Dr. Gomez Gonzalez does not
know how they are organised, which underlines it. It is
hypothesis upon hypothesis so far as that question is
       concerned.

MR. MORRIS: He is the international meat quality purchasing
director in this country. They have admitted using five a
       cage.

MR. JUSTICE BELL: You must move on with your cross-examination.

MS. STEEL: If you could fast forward reviewing, please, and
stop as soon as you get sight of a pig. Yes. Play from
       there.

                  (The video recording continued).

MS. STEEL: Pause there. The crate that is shown there, that
would be fairly typical, would it not?
       A. No, I have only a little piece of the picture.
I cannot make an assumption what is behind that. You can
move forward and it shows that I can tell you.

MR. JUSTICE BELL: We could in fact see part of the crate.

                  (The video recording continued).

MS. STEEL: If you just pause there. The crate that you saw
       there ----
