Day 174 - 17 Oct 95 - Page 38
A. Not necessarily. Under labour laws in Ireland, a
person has a right to make an appeal to a Rights
Commissioner, I think it is up to six months or maybe even
12 months after the date that their employment is
terminated. It could be six months, but I am not sure.

Q. You received notice from the Irish Transport and General
Workers Union on 22nd August that they were referring the
issue to the Rights Commissioner's office, did you?
A. If that is what it says in the correspondence. I do
not have it in front of me.

Q. If you have pink XIII B ---
A. Yes.

Q. -- it is tab 62, page 1158.
A. I have 1164. It is obviously beyond that, is it?

Q. 1158.
A. Sorry. Excuse me. Yes, I have it.

Q. Which says they are referring the issue to the Rights
Commissioner's office. Do you remember whether or not
Mr. Trimble had either left or told you that he was leaving
by that date?
A. No, I am sorry. As I have indicated, I cannot recall
the date on which he left our employment.

Q. Did you ask Mr. Trimble, when he said he was leaving, for a
contact number or address for the purposes of this -- well,
for the purposes of this dispute or anything else?
A. No, I did not. Like I say, I do not know what date he
left the Company, so I cannot give you an answer as to
whether I did or I did not.

Q. Did you get an affidavit off Mr. Trimble concerning his
version of events?
A. No, I do not recall getting an affidavit from
Mr. Trimble.

Q. You spoke to Mr. Trimble, though, about these dismissals?
A. Yes. He referred them to me through the supervisor
after they were terminated.

Q. Did you ask him why he had not followed the dismissal
procedure with verbal, followed by written, warnings?
A. No. I was not aware that he had not followed them. He
gave me the reasons for the dismissals.

Q. Did you enquire of him as to whether or not he had followed
the correct procedure?
A. I cannot recall at this stage whether I did or I did
not.

Q. This is the same Mr. Trimble that made an affidavit for the
1979 dispute; is that correct?
A. Yes.

Q. The same one who signed the petition against the union?
A. Yes, that is correct. Sorry -- signed the petition in
