Day 025 - 16 Sep 94 - Page 73

April, which would certainly be beyond February or March,
       and into the second quarter.

  Q. Right. Does it also appear that many of the ones that are
not underlined do not appear to be -- if you look, for
       example at -----

MR. JUSTICE BELL: Look at calcium in April. It is the first
time it has arrived in that, in Better Homes & Gardens,
but it is not underlined. In TV Guide balance appears for
the first time in March. That is not underlined. It
seems to me, at the moment, I cannot draw any conclusion
       about what the underlining means.

MR. MORRIS: I do not know whether it is something I ought to
ask the witness or just draw to the court's attention. It
also strikes me that some of the magazines in one list are
different from magazines in other lists. We do not know
if they are a comprehensive list anyway.

MR. JUSTICE BELL: Make that comment later. That is something
which you can say just as well as Mr. Gardner.

MS. STEEL: The other point is, looking at page 183, do you
notice that June, apart from one, the adverts scheduled to
       be run are salad advertisements?
       A. That is what is reflected on 183, yes.

  Q. It does not appear, does it, as though salad appears
anywhere before June on that schedule?
       A. I sure do not see it.

  Q. Looking through the Time Magazine, or perhaps you can
remember anyway, is there a salad advertisement in that
       series?
       A. No.

  Q. So it would appear, would it not, that the salad
advertisement was not part of the original series; it was
       a new advert?
       A. A new advertisement that, at least, from 183 would be
part of the nutrition series. I do not recall exactly
what was in the salad advertisement. I recall having seen
       it.

MR. MORRIS: If we stay on that page, in May there was a wide
range of the adverts from that campaign; is that correct?
       A. Yes.

  Q. Then by June the only advert that remained was the "Pinch"
       one?
       A. As scheduled in this memo, yes.

  Q. As scheduled in the memorandum, yes. If we now just have
a look at the adverts that were shown after May, as we
       have the details here.

MS. STEEL: They are behind Mr. Horwitz' statement in the
       yellow volume.
