Day 209 - 25 Jan 96 - Page 59

MR. JUSTICE BELL: We will have a five-minute break, unless
Mr. Logan wants longer. During the break, I would like you
to think, bearing in mind, as I understand it, you have
       your dental appointment tomorrow ---

  MR. MORRIS: I know, yes.

MR. JUSTICE BELL: -- what we are going to do, how far we are
going to get tomorrow morning and what we are going to do
about scheduling if we have not finished Mr. Logan.

MR. MORRIS: Can I say, if Mr. Rampton feels that it is going to
       go beyond tomorrow lunchtime -----

MR. RAMPTON: Yes, it is. It may well go on until tomorrow
       evening.

MR. MORRIS: Then maybe it is better that we make the Brazilian
interrogatories application tomorrow and Mr. Logan comes
back for a full day on ------

MR. JUSTICE BELL: What I need to know from you, really, is how
long you are expecting Mr. Logan to be giving evidence in
answer to your questions, because I can be persuaded, but
I am not too happy to get, say, three-quarters way through
his evidence and then break off. Breaking off at the end
of his evidence-in-chief may or may not be satisfactory.
I will hear what you, Ms. Steel and Mr. Rampton want to say
about that. Instinctively, I am not very happy about
       breaking off in chief.

One of the reasons -- it is no imputation on anyone's good
faith -- one tends to come back and start going over things
again, which is avoided if you complete evidence-in-chief
       and then wait for cross-examination.

  MR. RAMPTON: Yes.

  MR. JUSTICE BELL: Five minutes.

                         (Short Adjournment)

MR. MORRIS: I did check out pages 319 to 327, at your
suggestion, Mr. Logan, in volume 2. I do not know if
       people have it?
       A. I have 319, yes.

  Q. Tab A2, pages 319 onwards -- because I was not quite sure
which day 12.8.93 would be, was it the date at the top, was
it the date -- but, also, the implication is that around
that time, it is a random check, everything seems to be
fine. Yes, I am sorry, I am just saying -----

MR. JUSTICE BELL: As I understand it, when you say you checked
three days, you would have checked the 11th, the 12th and
       13th August?
       A. That is right. We checked all the three days, because
it could have been any of those. We were not sure which,
because there is a problem with, if it is done after
