Day 046 - 04 Nov 94 - Page 79

is talking about the actual qualities in his opinion as an
expert of McDonald's children's advertising in the context
       of the regulatory framework.

MS. STEEL: I am sorry, I do not agree with "advertisements
performing a valuable role". I do not agree with paragraph
6 which says that advertising is most valued by consumers.
There are a lots of things in his statement that are just
controversial statements which we do not just accept.

MR. JUSTICE BELL: What I propose to do, will you be able to see
Miss Dibb in order to go through and find out just what
parts of the booklet she is, in effect, or you are hoping
she will incorporate into her statement? Put another way,
is there any prospect of you getting from her an expanded
statement which sets out any further propositions which she
would put forward in evidence and listing the particular
references among the 170 which she would rely on?

MS. STEEL: We can ask her.

MR. JUSTICE BELL: Are you going to have the opportunity to do
       that?

MS. STEEL: We will not get the opportunity to see her, but we
could ask her to do it over the telephone.

MR. RAMPTON: I thought she was in court this morning.

MS. STEEL: She was in court this morning but we are not going
to see her within the next few days. In fact, I do not
know when we are going to see her again. It is all very
well Mr. Rampton saying, "I thought she was in court this
morning", but obviously we only have half an hour to chat
at lunch-time and you cannot get masses sorted out in half
an hour. Mr. Rampton did not raise this this morning, so
we could not talk about at lunch time.

MR. MORRIS: If Mr. Rampton can indicate which particular -----

  MR. RAMPTON: No.

MR. JUSTICE BELL: No, he does not know. He does not even know
yet which parts of the booklet. If he knew it was
paragraph this of the booklet, he could probably then look
at the numbers, presumably for references, although I have
not seen it, and say "it is these". I tell you what
I think is the only practicable solution, it is not the way
it would normally be done, but it seems to me it is the
only practicable solution because I am not going to stop
you calling Sue Dibb until everything is apple pie order,
it is not satisfactory in many ways but it is the only
solution I see at the moment, subject to hearing from any
of you as to a better solution, is that you call Sue Dibb.
You put this problem to her. You at least telephone her
and say that this has arisen. I do not know when you get a
transcript of this afternoon. Will you get it tomorrow
       morning?

  MS. STEEL: Not usually.
