Day 057 - 29 Nov 94 - Page 36

MR. MORRIS: Yes. Advertising. The US Santa Claus survey was
brought up on day 45. It was page 22, lines 24 and 42.
Mr. Green on line 24. Line 24 refers to the original
survey which Mr. Green says McDonald's has referred to. He
was not sure who had done the survey but McDonald's
       referred to it.

MR. JUSTICE BELL: He did not think McDonald's had done it.

MR. MORRIS: Yes, and later on I think, if you remember, Helen
was quoting from an Annual Report which purported to
interview ronald mcdonald. He quoted the conclusion of
that survey about Santa Claus. On line 42 he says there
was a second survey which, I believe, is an annual survey
called the Que survey -- I do not know why it is called
that -- which also talks about the popularity and awareness
of characters, including ronald mcdonald. So, we would ask
the Plaintiffs or request the Plaintiffs to disclose both
those surveys if they are in their possession or power.

MR. JUSTICE BELL: What do you say is the relevance of that?
You have the figure which, apparently, it contained about
percentages; it was 96 knew of Ronald. I am assuming
everyone knew about Father Christmas -- Santa Claus,
I should call him, I suppose.

MR. MORRIS: What is the relevance of that or in the light of
       them admitting-----

MR. JUSTICE BELL: No, you hoping to get out of the survey apart
from it is said that 96 per cent of children knew Ronald?

MR. MORRIS: Well the first survey is the most significant in
terms of evidence because doubt has been thrown on, in
fact, whether such a survey or conclusion was actually
done, and whether it was, in fact, a piece of hype by
McDonald's publicity agents on behalf of McDonald's. So,
       it will be important.

MR. JUSTICE BELL: Is there any objection to an enquiry being
made as to whether these surveys are available and
Mr. Beavers, if they can be found, can bring them across
       with him?

MR. MORRIS: The Germany Kindergartens dispute, which is day
       44. That is the one before the one we were just looking
at. The one after is also day 44. It is pages 57 and 58.
The witness did not recall such a dispute but we referred
to our understanding, or our belief. If we look at line 50
on page 57 -- sorry, regarding a particular kindergarten on
line 40 in Frankfurt; then the German Children's Protection
       Association recommended ronald mcdonald education
programmes for kindergartens should be rejected.

MR. JUSTICE BELL: What are you asking for here?

MR. MORRIS: We are asking for any documents which the
Plaintiffs have in their possession regarding that dispute
or that matter. It was 21st March 1989, at the bottom of
page 57. There is quite a lot of details there for the
