Day 179 - 30 Oct 95 - Page 33

MR. RAMPTON: So this particular practice, as you allege it to
be, went on only for a short time then while you were at
       Colchester?
       A. Yes.

  Q. How long do you say, roughly speaking -- I am not expecting
precise figures, Mr. Gibney -- that it went on for?
       A. Two months, I should say.

  Q. Two months?
       A. Yes.

  Q. This also applied to the reduction in the amount of lettuce
that you were putting into the hamburgers, does it?
       A. That was quite regularly done.

  Q. Yes?
       A. The correct amount would not ......

  Q. Also squeezing fry cartons so as to make sure the customer
       got less; is that right?
       A. That was a fairly regular practice, yes.

  Q. Yet you only got occasional complaints about watery milk
shake or coke not tasting right, something like that; is
       that right?
       A. Yes, that is right.

  Q. Have you ever tried drinking watered down Coca Cola?
       A. Yes, I have, yes.

  Q. It is absolutely disgusting, is it not?
       A. If you put too much water in, yes.

  Q. It is unrecognisable as what it is supposed to be, is it
       not?
       A. It depends how much water you put in.

  Q. Tell us then how much water you put may be up seven times a
week on a regular basis for two months into the Coca Cola?
       A. I said the milk shake was regular, the Coca Cola maybe
on a Saturday lunch time, pour a couple of litres in the
tank which would hold about maybe 25, 30 litres.

MR. JUSTICE BELL: Just pause. That is 25 or 30 litres of
       syrup, is it?
       A. Yes, roughly.

  Q. Yes.

MR. RAMPTON: Mr. Gibney, where were you living when you were
       transferred to Milton Keynes?
       A. Where was I living in Milton Keynes?

  Q. No, at the time when you were transferred to Milton Keynes?
       A. I was living in Colchester.

  Q. Did you go on living in Colchester?
       A. No, I did not.
