Day 147 - 04 Jul 95 - Page 25
for the time being. So if you look from page 21, line 56
onwards, and see if I have it right.

I will add a fourth one, that, in addition to no one should
have a transcript if you do not, even if I hold that
McDonald's are entitled to have one by the rules of the
Supreme Court which are made pursuant to statutory powers,
then I should not have one.

MR. MORRIS: We are not arguing that one no one should have
one. We are arguing that if someone does have one, that we
should have one.

MR. JUSTICE BELL: That is the third. You are not saying
McDonald's should not be able to buy their own?

MR. MORRIS: But if they do -----

MR. JUSTICE BELL: Then I should not have it?

MR. MORRIS: Effectively; or everyone should have one.

MR. JUSTICE BELL: That is all part of ordering the first two
applications.

MR. MORRIS: The last point I would like to make, that the
whole -----

MR. JUSTICE BELL: Do you say the same with regard to CaseView?
Is there any extra application you have in relation to
CaseView? You have an additional one in relation to
CaseView, in that you say McDonald's should not be able to
use CaseView.

MS. STEEL: Yes.

MR. JUSTICE BELL: No one should be able to use CaseView?

MS. STEEL: Yes; because that was the agreement on CaseView
being used in court, that everyone would be able to make
use of it. I think that is on Friday, 27th May, page 62.
Mr. Rampton said that, of course, if they had this, they
would be providing the same facilities for us; and that was
the basis on which we agreed.

MR. MORRIS: My last point is that McDonald's seem to be --
Mr. Rampton recognised earlier on today that a public trial
is "unavoidable" -- his word -- and his clients would have
preferred to avoid a public trial. They would prefer to
hear legal matters heard in chambers -----

MR. RAMPTON: My Lord, Mr. Morris is doing exactly what I object
to, and that I knew he would do and was the reason I wanted
to sit in chambers. He is abusing this courtroom to make
tendentious and unfounded statements ---

MR. MORRIS: Not at all.

MR. RAMPTON: -- as I knew he would.
