Day 195 - 04 Dec 95 - Page 34

period, about three months. I do not know whether the
diary contains any other entries which may be relevant.
I assume it is the diary for the whole year.

THE WITNESS: No, it is not a diary -- I mean, I am not very
good at keeping a diary, so for some reason I recorded only
those days and a few more days, but there is a gap between
those days and the rest of them.

MR. JUSTICE BELL: Wait and see if Mr. Rampton asks you more
about that but, in principle, the whole diary is
disclosable, if you still have it. If there are any
personal details in it which you do not want to disclose,
tell me about them and we will think of some way of
       covering them up.

  THE WITNESS: OK.

MR. MORRIS: Your evidence is that these were the only weeks
       which were complete?
       A. These were -- which were continuous, yes.

  Q. There are a few odds days?
       A. There were a few odd days after that.

  Q. Can you just explain starting on March 20th, just for
example, give us an idea of what you mean? The first one
we have is Thursday, March 20th.
       A. OK. "4.00 to close" means that I was scheduled from
4 o'clock and finishing at close, and 4 o'clock, when you
are scheduled for 4 o'clock, it means that you arrive at
the store at 3.45 and are ready -- you are ready to clock
       in at 4 o'clock.

  Q. It says "off sick" so that would be the day -----
       A. So that particular day I did not go to work. I was off
       sick.

  Q. Then we have "10.15 to 5.00"?
       A. That is 10.15 in the morning to 5 o'clock in the
       afternoon.

  Q. I think it is pretty clear. I will just go through
Saturday 22nd, 8.30 to 5.00, 2.45 to close. When you say
"close" in these entries, was that a specific time or what
       was the general -----
       A. I think the general picture is what I have given in my
statement, that close was meant -- I was certainly under
the impression that close meant 12 o'clock, 12 midnight,
but we regularly went over that. So, these closes that
I have put down are actually when I was scheduled to work,
and then for some reason sometimes I have crossed it out
and put another shift in there and that is when I actually
       did work.

  Q. Right, so these would be scheduled times unless they are
       crossed out and amended?
       A. Yes, sometimes I have made a mistake with the day and
removed it to another one as well, but it is not a general
       rule but ......
