Day 189 - 20 Nov 95 - Page 40

MS. STEEL: In the Crew Handbook the rules and discipline thing
just says, which is on page 1044, that "drunkenness" -- it
says "of" but it should be "or" -- "or use of or possession
of intoxicating liquors or narcotics on Company property is
a basic rule". It does not actually say that you are not
allowed to drink before coming on duty.

MR. JUSTICE BELL: Yes, thank you. Do you want to read
       Mr. McCann now?

MR. MORRIS: Yes, that might be a good idea. I cannot remember
       where it is.

MR. JUSTICE BELL: He is No. 6 in volume 3.

  MR. MORRIS: Right.

MR. JUSTICE BELL: I have got -- no.

MR. MORRIS: It is one typewritten page with handwritten
       additions at the bottom.

MR. JUSTICE BELL: I have not checked them word for word, but
I assume that that was the original draft statement, but
I can ignore it because the one which is signed by
Mr. McCann is the same and he has added certain things to
       it.

MS. STEEL: What that was was we could not get a signed copy in
time for the deadline so we handed over an unsigned copy.
       It is exactly the same.

MR. JUSTICE BELL: But I can forget the unsigned one?

  MS. STEEL: Yes.

MR. JUSTICE BELL: Right. I suggest that either you, Mr. Morris
or Ms. Steel reads the signed one and goes slowly through
the notes at the bottom, please.

MR. MORRIS: Right. This is the statement of Connor McCann of
Meadow Mount, Church Town, Dublin 14, and signed on
       July 9th 1993:

"I was employed by McDonald's from 7th January 1985 until
29th June 1985. I worked at the store in the Nutgrove
Shopping Centre, Dublin 14. After I started the job,
I joined a trade union because I felt there was a need to
improve conditions for workers in the store. The
management's attitude to me, until then very positive,
completely changed, and I was discriminated against and
harassed with the intention of forcing me to leave the job.

I had been a member of the crew training squad. This squad
were granted certain unwritten privileges, i.e. they were
exempt from 'menial duties'. These were based on custom
rather than 'policy'. Management were within their right
to ask training squad to provide the same functions and
duties as any other staff member. However, customarily,
