Day 038 - 19 Oct 94 - Page 39
mentioned but nothing significant.

MR. JUSTICE BELL: So be it. All I want you to remember is that
an attack on the validity of the body's judgment maybe a
means towards an end, but that is what it is. The end is
actually showing, if you can, that additives used by
McDonald's have or have been known to have adverse effects.

MR. MORRIS: I am going to be moving on very soon; I am
conscious of the need to move on.

MR. RAMPTON: My Lord, I will intervene at this stage, if
I may? I say it with some heartfelt emphasis. I am
frankly sick and tired of sitting here listening to people
at my client's expense using this court as a political
platform. If the Defendants have a case to make that the
additives that McDonald's use in their food are hazardous
to human health, let them make it.

MR. MORRIS: I am sick and tired of Mr. Rampton making
completely irrelevant and unhelpful comments. We are going
through the evidence in order to establish our view.
I have not made a single political statement since the
opening speeches certainly in this trial, and I do not
intend to do so either.

MR. JUSTICE BELL: Yes. Just think of what you said because
that may illustrate the point. "We are going through the
evidence in order to establish our view".

MR. MORRIS: Yes.

MR. JUSTICE BELL: You have to distinguish that from what you
strictly are doing, or should be doing, which is
establishing your case against McDonald's as pleaded with
some room for extension according to the statements.

MR. MORRIS: That is exactly what I have said.

MR. JUSTICE BELL: Carry on now try. Try and distinguish
between the witness just expressing what may be his lack of
satisfaction with the way things are and what you are
trying to establish in the case. I, obviously, have
understood the purpose of this line, but be aware that time
comes when you have reached the extent of its value and you
have to get down to the hard and fast allegations.

MR. MORRIS: Yes, I am very close to doing that.

MR. JUSTICE BELL: Yes. On you go then.

MR. MORRIS: Right. When I said "our view" before, I did not
mean our personal view; I meant of relevance to the case.

MR. JUSTICE BELL: Very well.

MR. MORRIS (To the witness): One question we could get out the
way is the Delaney cause in America which the Plaintiffs
have kindly served a document on. I will read it out. It
was just served, I think it was, yesterday by the
