5 A. Yes, I do.

10, we see a document dated July 3rd 1986. It looks like
7 a McDonald's press release -- no, it is not. It is to the
people within the organisation?
8 A. This is an internal publication.
9 Q. Internal memorandum: "Subject: National Distributions.
Dated July 3, 1986. National Distribution of McDonald's
10 Ingredient Brochures.
11 "This is to advise you that on Monday, July 7, we will
announce to the media that ingredient information
12 brochures will be available at all U.S. McDonald's
restaurants, effective August 15, 1986.

"By way of background ... As you know, the enclosed
14 brochure (McDonald's Food the Facts ....)" ---- Is that
the one we have been looking at?
15 A. Yes, it is.
16 Q. " --- was developed for use in our New York state
restaurants. 'Pre- market' copy testing and initial in-
17 store customer reaction has been positive- customers feel
good about our making this information available." So far
18 as you were aware, Mr. Horwitz, was that a true statement?
A. Yes, Sir.

Q. "As a result of this customer response, and because of the
20 increasing attention being given to the area of ingredient
disclosure by state and federal legislators, and the
21 media, we feel this national announcement is both timely
and appropriate". Mr. Horwitz, was there at this time in
22 1986 increasing attention being given to the question of
ingredient disclosure?
23 A. Yes, there was.
24 Q. Was that a national thing or was it focused in one or two
states, or how did it work, so far as you were aware?
25 A. Well, in terms of governmental action, the three
most interested governmental entities were the Attorneys
26 General of New York California and Texas. Certainly
nutrition generally was, in my opinion, of greater
27 interest throughout the United States increasing interest
throughout the United States at this point in time.
