Day 173 - 16 Oct 95 - Page 46
A. I recollect it when I reread it, yes.

Q. He was not just complaining about the rates of pay that he
was getting; he was complaining about the rates of pay in
general that he was getting in common with the other crew
members?
A. Well, I think, reading from this, he complained about
the rate of pay pertaining to himself, because he compared
it to his previous wage in a previous employment.

Q. He was not suggesting, though, that he should get more than
the other crew members?
A. I do not recall that.

Q. It then goes on further down there to say: "A crew rap
session was called for 22nd February and was held in the
Royal Dublin Hotel, O'Connell Street."

That was held by you; that is correct, is it not?
A. Yes, it would have been, and the manager as well of the
restaurant.

Q. That was standard practice, was it, that you attended all
rap sessions and the manager did as well?
A. At that stage, with only two restaurants, I was able to
attend probably the majority of the meetings and rap
sessions.

Q. The rap session, this was called following the crew
meeting; it was a follow-up to that?
A. Yes. It was held shortly after the crew meeting.

Q. 11 crew members attended; and you go on to say: "The
following pertinent comments came out of the crew rap:
1. Pay rate was too low." Sean Mosrek put this one
forward. "2. Part-time people had no chance of doing
overtime" -- again put forward by Sean Mosrek. He was a
full-time worker, was he not?

MR. JUSTICE BELL: Well, he was -----
A. Yes, from memory.

MR. JUSTICE BELL: He seems to have been saying that he was
getting £58 per week as a laboratory assistant, and if one
looks at what he was getting paid, he was now getting
something between £35 and £45 a week, i.e., double those
amounts per fortnight; and he was not too chuffed about
that.

MS. STEEL: But he appears to be putting complaints forward on
behalf of other crew members, because it would not affect
him if part-time people had no chance of doing overtime.
Would you accept that, that the complaints he is making
appear to be complaints on behalf of other crew members?
A. Sorry, would I accept that the part-time people did not
have a chance to do overtime?

Q. No. Would you accept that he appears to be making
complaints not just for himself, but on behalf of other
crew members?
