Day 246 - 09 May 96 - Page 39

Q. You do not know what it is. Of course we do not because it
has been blanked out. I think it is ridiculous blanking it
out. We have got 2 pages and all we have got is one line.

MR. JUSTICE BELL: You ----

MS. STEEL: We do not know what the heck it is about.

MR. JUSTICE BELL: I have ruled on the previous matter. I have
urged Mr. Rampton in relation to the second point you
raise, namely it not being easy to understand what the
bottom part of page 14 meant if we cannot have the title,
and he is going to go away and think about that, and I am
not prepared to make a formal ruling on whether those
present should be disclosed until Mr. Rampton has had an
opportunity to consider whether, whatever the legal
niceties of the matter, he is prepared to disclose it
voluntarily.

MS. STEEL: In terms of this particular document, which might
appear to be notes of a meeting but we absolutely cannot
tell at all, I think that the same thing applies to that
one where A was missing and the subheading is that at least
some of it should be disclosed to enable us to make sense
of what it is, because right now it is absolutely
meaningless.

MR. JUSTICE BELL: It appears to have part of it on page 17.

MS. STEEL: I do not know.

MR. JUSTICE BELL: You must let me give my ruling.

(FOR RULING - SEE SEPARATE TRANSCRIPT)

MS. STEEL: If I could just say that it appears to me that it
may actually be something separate to document number, the
documents starting on page, I think it is 18 actually,
because again it is in handwriting.

MR. JUSTICE BELL: I am not going to change my ruling. You must
abide by it. If, at the end of the day, you think it was
wrong, and it has adversely affected the result of the
action, then you must take that up with a Higher Court.

Do you want to ask any more questions before 1 o'clock or
do you want to break off now?.

MS. STEEL: Break off now.

MR. JUSTICE BELL: We will return at 2 o'clock.

(Luncheon adjournment)

MR. JUSTICE BELL: Yes.

MR. MORRIS: I would like to come on to some nutrition matters.
I am not sure whether this is in the bundle. I am not sure
it was originally served. It was the 1994 Annual Review.
