Day 159 - 20 Jul 95 - Page 43

Q. No Manager has ever told you but that?
A. No. Nothing has ever been discussed about unions at
all by anybody.

Q. But it has happened, has it not?
A. No, not as far as I know.

Q. Well, Mr. Giardina says he found some union leaflets ----

MR. RAMPTON: My Lord, now we are getting into idiotic
territory.

MR. MORRIS: No, we are not all. We are getting to very
interesting territory.

MR. RAMPTON: My Lord, I am making an objection. If Mr. Morris
might have the courtesy to sit down.

MR. MORRIS: I think the witness should be asked to leave the
room because otherwise Mr. Rampton is doing as he always
does ----

MR. JUSTICE BELL: No, because I have something to say about it
as well. What I wish to say is that this may be a
completely unnecessary challenge. The mere fact that
Mrs. Farrer who went into the crew room from time to time,
even near enough every day as she now recalls it when
Mr. Giardina was Manager, does not mean to say she would
necessarily have seen leaflets if they were on the table.

MR. MORRIS: That is not the point I was making.

MR. JUSTICE BELL: Or a union poster if it was on the notice
board.

MR. MORRIS: No, I am not saying she should have done.

MR. JUSTICE BELL: But you are putting it to her.

MR. MORRIS: I was going to put something else to her but
Mr. Rampton interrupted me.

MR. RAMPTON: I wish to repeat what I said.

MR. JUSTICE BELL: Let us go back, first of all. But it has
happened, has it not?

MR. RAMPTON: Exactly.

MR. JUSTICE BELL: The witness says, "No, not as far as I know",
and then you start telling her what Mr. Giardina has said
which is totally irrelevant.

MR. MORRIS: It is already accepted in this case by Tony
Giardina that there were union leaflets left in the union
room and the poster put up some days later, and he
remembers it to this day, when he was Manager recruiting
for a union. (To the witness): He had never told you that?
A. No. No, nothing has ever been mentioned of unions at
