Day 154 - 13 Jul 95 - Page 50

  Q. Even when he had done a long stint at the end of his five
       days?
       A. Yes, he was a good worker.

  Q. Finally, and it is also, you will be glad to hear, in this
tab , three pages from the end of the tab before 18,
please, you will find, I hope, a table showing the current
yields as at February 1986. Do you have that?
       A. I have that, yes.

  Q. I want to ask you about shake which is supposed to be
something between 18.6 and 19 servings per imperial gallon,
not just because it is gallons and pints that it is
concerned with, that I want to ask you about it. When it
       says "shake yield" ---
       A. Yes.

  Q. -- "19", let us take 19, "servings per imperial gallon",
somebody has written in, do you see, "of syrup". Do you
see that in handing write underneath?
       A. Yes, I think the "of syrup" refers to the beverage
yield. It should not refer to the shake yield.

  Q. No, beverage has got also "of syrup" -----
       A. It does -- yes, it should read not "of syrup" but "of
       raw mix".

  Q. This, I think, requires you to give us a little bit of
education. One of the few things we have not learned about
McDonald's in the course of this case is how the milk shake
is actually made. You gave a bit of an explanation
earlier, but I think I would like you, if you will, to go
through it in a bit more detail. Where does one start?
       A. It is manufactured, or I am not sure of the exact
ingredients, but I believe it is butter, fat and milk.

  Q. No, I am not interested in the ingredients because only to
a limited extent, because I do not want you to give away
any commercial information if it is not necessary.

MR. MORRIS: We do know what the ingredients are for the shake
       mix.

MR. RAMPTON: I dare say you do, but here we are, we do not need
that unless we have to have it.

MS. STEEL: They are in the statement.

MR. RAMPTON: I am sorry, I do not know what all that is about,
but can you start again at the beginning?
       A. Right. You get a four gallon container in a polythene
bag stored in the refrigerator inside a -----

  Q. What does the four gallon container contain?
       A. The liquid shake mix, as we call it.

  Q. The shake mix is a liquid, is it?
       A. It is liquid, yes.

  Q. It has various constituents in it, does it, ingredients?
