Day 173 - 16 Oct 95 - Page 58

Trimble was a Manager, was he not?
       A. No, no, David Trimble was a crew person.

  Q. In his affidavit of 3rd April 1979 at the front of his
affidavit, which is page 986, he says, "I, David Trimble,
Assistant Shop Manager aged 20 years hereby make oath and
say as follows:" So would you agree that he was assistant
       shop Manager at that time?
       A. Well, if that is what he is putting in his affidavit he
must have been, but he started as crew.

  Q. OK. But you would accept that by the time of 3rd April he
was assistant shop Manager? That is what he says?
       A. That is what he says.

  Q. Yes. Thomas Cullen was a Manager, yes?
       A. Yes, yes.

  Q. What was his position at that time, do you remember?
       A. I think he was an Assistant Manager.

  Q. Right.
       A. Possibly a Floor Manager.

  Q. What about Mark Daley, do you remember what position he
       was?
       A. He started as crew.

  Q. Did he become management?
       A. He did later on, yes.

  Q. Later on. OK. If we look at the petition we can see that
Thomas Cullen and David Trimble, just in the middle,
       slightly below the middle to the right, Thomas M. Cullen;
that would be him, would it?
       A. Yes, it is.

  Q. If we look at the bottom right we see David Trimble has
       signed it, yes?
       A. Yes, it looks like Trimble, yes.

  Q. I do not know how many others are management, but you would
accept that members of management have participated in this
       petition and signed it?
       A. Yes.

  Q. If it is 45 signers it cannot possibly be the majority of
       McDonald's employees, can it?
       A. It may have been at the time.

  Q. It cannot have been, can it, unless there were less than 90
employees ten days after the strike started?

MR. JUSTICE BELL: One of the problems I have is that mine is
clearly cut off at the bottom. I take your point about
someone swearing that 45 or about 45 people signed it.
       A. I do not know how many employees we had at that
       particular time.

MR. MORRIS: If it is something like 150, or maybe a bit more,
