Day 034 - 11 Oct 94 - Page 72

THE WITNESS: I understand.

MR. JUSTICE BELL: Quite apart from Mr. Rampton's
cross-examination, there may be re-examination, I do not
know. What sort of notice do you have to give to change
your flight?

THE WITNESS: I have not checked on that, but I came here to
provide evidence to the court and I am glad to do that for
as long as necessary. I will take whatever steps are
needed. If it is possible for me to return back to
America on Thursday I would like to do that, but if not
----

MR. JUSTICE BELL: It is always difficult to estimate the
length of cross-examination. Is it thought that there
will be any risk that cross-examination and re-examination
will extend beyond the close of play on Thursday?

MR. RAMPTON: No. I would hope your Lordship now appreciates
that I am of the general, at least, if I can be, of the
short rather than the long route cross-examiner, but there
is a lot of reading that Dr. Barnard and I shall have to
do together which has not been done yet. That is bound to
take all of tomorrow. I would expect I might trickle into
Thursday, but I would hope and am almost certain that
Dr. Barnard would be free to leave on Friday.

MR. JUSTICE BELL: What I would advise you to do, Dr. Barnard,
is see if you can change your flight to Friday and leave
yourself available to be in court the whole of tomorrow
and the whole of Thursday.

THE WITNESS: Very good.

MR. JUSTICE BELL: What it looks like is that you will be in
the witness box all of tomorrow. That being so, if at any
stage during the day you would like a break say so. The
cross-examination may go into Thursday. We will probably
then have a bit of a break so that Ms. Steel and
Mr. Morris can think about any re-examination and then we
will complete the re-examination on Thursday.

THE WITNESS: Very good.

MR. MORRIS: There is just one point about the Food for Life
book. Mr. Rampton, I am not making a cheap point, always
complains that we do not have a full document. I do not
mind that he has only given us parts of the document, but
as it seems to be used for credit. If Mr. Rampton is
using it for more than that, I do not know whether the
rest of it should be copied or whatever, but if it is for
that purpose only then it does not matter to us to have
the whole document.

MR. JUSTICE BELL: It is a book which is actually written by
Dr. Barnard himself. So, I would expect that if
Mr. Rampton takes a point on one page and Dr. Barnard
thinks that that is a partial view of the matter, he will
