Day 084 - 07 Feb 95 - Page 08

read of what I have said and if you want to look again at
the Lonrho case which is concerned with subsidiaries.

MR. RAMPTON: My Lord, I can say this, if it would help -- I was
going to say it anyway; I think I have already indicated it
last week -- so as far as McKey's are concerned, whatever
the strict legal position might be, I do not suppose that
Mr. Walker will be unco-operative, not for a moment. It
will, of course, depend upon the nature and the number --
I stress both those words -- of the documents which the
Defendants should wish to see. If they are sensible and
conservative in their requests -- again I use those words
advisedly -- then it may very well be that there is not any
problem about McKey's documents. That is as far as I can
go at the moment because I have not asked Mr. Walker
specifically in relation to whatever documents may be asked
for, but they might like to bear that in mind. The same
does not, of course, apply to Jarret for whom I cannot
       possibly speak.

MR. JUSTICE BELL: Focus on what you think you really need and
what you really need first, what are the most important
matters. I will come back in 10 minutes time from now.
Mr. Stiles will come up and if you need any longer let him
       know.

                      (Short Adjournment)

MS. STEEL: We want to move on to the documents relating to food
poisoning. We left off with the salmonella incident which
we will now have to plead. The Oregon 1982 outbreak of
food poisoning: It is actually referred to in the
statement of McDonald's witness, George Rummel, who is a
Civil Evidence Act Notice statement. We would like any
documents relating to that outbreak of food poisoning in
McDonald's, any investigations undertaken and, basically,
any documents related to that outbreak of food poisoning.
Also, which is pleaded which we missed off putting on the
list for documents for discovery, the outbreak in 1987 of
typhoid as a result of eating shrimp salad at a McDonald's
restaurant in Maryland; documents relating to that.

MR. RAMPTON: My Lord, volume XII, tab 14, is Mr. Rummel.

MR. JUSTICE BELL: They are at the foot of page 3 and at the top
of page 4 of tab 5 of the Abstract.

  MS. STEEL: Right.

MR. MORRIS: The next thing is the cooking times of burgers. In
David Wignall's statement on page 5 -- he is tab 3 in
volume VII; I do not think it is necessary to go to it --
he basically says that the cooking times of burgers were
increased from 1990 to 1991 -- I will just read out the
sentence: "It can be seen on page 3 of each of the
booklets", that is disclosed with his statement, "that from
1990 to 1991 the recommended cooking time for 10:1
patties", that is the large ones -- no, the small ones
