Day 153 - 12 Jul 95 - Page 43

  Q. Or did it happen?
       A. I cannot remember a specific incident, mainly because
if you are working in the grill area you are standing
       stationary.

  Q. Yes, I understand that. But when you say, for example, you
do not recall anybody being forced to work all night or
something against their will, you were not asked: "Do you
remember any specific person working all night against
their will?" You were asked the question: "Did it ever
happen?" So I am asking you the question now: did it ever
happen that there were slipping accidents in the grill
       area?
       A. It may have happened. I cannot recall any specific
       incident.

MR. JUSTICE BELL: You cannot do better than that, Mr. Morris.
Whether he is right or not is another matter, but it is a
       perfectly sensible answer.

MR. MORRIS: Did you have concerns at that time about the
potential for slippage accidents in the grill area?
       A. Well, in so far as we would be continually looking
around the restaurant for potential hazard areas. I did
not have any -- that would be as far as I would go. As for
people slipping up in the grill area, I cannot remember any
occurrences of it happening. Therefore -----

  Q. It was not an area of great concern?
       A. It was not an area of great concern, no.

  Q. Have you seen the accident book for Colchester?
       A. I have seen a page from the accident book in
       Colchester, yes.

  Q. What was that page?
       A. What was the page?

  Q. Yes. You said you have seen a page. Which page were you
       shown?
       A. Just a page with -----

  Q. What was the reason you were shown a page -- sorry?
       A. I was asked to comment on an entry for Vicky Golding.

  Q. And that was an accident you could not remember?
       A. I could not remember it, no, although it obviously
       occurred.

  Q. Do you remember Mr. Alimi being splashed with hot oil in
       the face?
       A. I certainly do not, no.

MR. MORRIS: I cannot find whether Vicky Golding's accident was
dealt with -- it was dealt with in the statement, was it
       not?

MR. JUSTICE BELL: It is in divider 7 of your blue II bundle,
towards the end of Simon Gibney's statement, paragraph 7.
