Day 200 - 12 Dec 95 - Page 28
unhappy with the end of October because I would have to
find somebody to answer Mr. North if what he said had any
substance. Then your Lordship said: "When it comes, if
Mr. Rampton says it is too late, I will consider his
argument and I will consider your answer to it". Then your
Lordship said: "I am not going to say now that if it comes
at the end of October that will be all right". We are now
some way into December.

I am not saying it is too late but, of course, the longer
one goes on, if it is evidence which one has to answer, the
more difficult it becomes. I am reminded that Mr. Morris
-- the Defendants met Mr. North after court on 17th
October 1995. Your Lordship said to them: "You get off
now and meet Mr. North now, hopefully, and pick a time when
we finish a bit early to raise those matters" -- what those
matters were, I do not know. Anyhow, your Lordship was
obviously encouraging them in the middle of October to get
something done. I refer to that, not to make any point,
but just because your Lordship asked.

MR. JUSTICE BELL: Thank you.

MR. RAMPTON: The only other thing is this, your Lordship did
say to the Defendants yesterday that they should try to
produce a list of interlocutory matters of their own if
there were any that they wanted to raise.

MR. JUSTICE BELL: Are there any further matters you want to
raise on Friday?

MR. MORRIS: There is nothing substantial; just may be some
discovery matters, but if there is anything specific we
will put it in writing for the Plaintiffs.

MR. JUSTICE BELL: Yes. Fax it across to Mrs. Brinley-Codd so
that Mrs. Brinley-Codd has it on Thursday morning anyway.
I think Mr. Glen said I would be grateful if a bit of
clearing up could be done because another case will be
tried in here tomorrow and the day after. 10.30 on Friday.
