Day 080 - 30 Jan 95 - Page 60
MR. RAMPTON: With your Lordship's leave, I would not call
Professor Jackson tonight.

MR. JUSTICE BELL: No, I had not appreciated he had come.

MR. RAMPTON: No, they both came today. I will call him
tomorrow. I anticipate that my examination in-chief will
be very short tomorrow; whether that means a short day is
another matter.

MR. JUSTICE BELL: We will see. So, the Defendants can really
count on it that -- by that you mean really asking him to
affirm -----

MR. RAMPTON: No, because there are some scientific questions
raised by your Lordship today which I think he may be able
to answer.

MR. JUSTICE BELL: Yes, but basically you expect him to verify
his report and then you have some additional questions.

MR. RAMPTON: Maybe I will ask twenty minutes or quarter of an
hour of supplementary questions. The Defendants should be
aware that there is a strong possibility that I shall not
trouble to call Mr. Clark at all, given what is in
Mr. Mills' statement. He is concerned only with conditions
in the restaurant.

My Lord, the last thing is that your Lordship might like to
insert Mr. Atherton's statement into yellow -- it has got a
Mrs. Brinley-Codd sticker on it which tells your Lordship
what it is -- VII, tab 3.

MR. JUSTICE BELL: Yes, thank you. We will resume -----

MR. MORRIS: Can we just hold on one second?

MR. JUSTICE BELL: Yes. Do sit down, Mr. Walker. It does not
concern you, Mr. Walker, thank you.

MR. MORRIS: Regarding Mr. Clark.

MR. JUSTICE BELL: Yes?

MS. STEEL: When Mr. Rampton said about not calling Mr. Clark,
did that mean that his statement would be taken as read or
what?

MR. JUSTICE BELL: No, there would be no evidence from Mr. Clark
unless Mr. Rampton calls him.

MR. RAMPTON: My Lord, that is, of course, subject to Mr. North
not departing from what he says in his statement. But
since he gives 100 per cent clean bill of health to
McDonald's restaurant, I do not feel we need to call
Mr. Clark.

MS. STEEL: That is not quite true but .....

MR. JUSTICE BELL: You have to call him, if you are going to
