Q. I want to continue with the footnote which qualifies what
5 is said there about Federal law. The footnote reads:
"McDonald's has, in fact, made saturated fat information
6 readily available to its customers. In the particular
advertisement to which you refer, McDonald's sought to
7 address the public's concern about cholesterol content.
For those consumers who have special concern about
8 saturated fat levels, McDonald's has provided complete
information on this subject against ingredient and
9 nutrition disclosure booklet. The booklet to which the
advertisement calls attention breaks out the fat content
10 of all of McDonald's products, including the regular
hamburger into three separate categories: monounsaturated
11 fatty acids polyunsaturated fatty acids and saturated
fatty acids"?
12 A. Yes.
13 Q. If one goes through the version which we have at tab 5,
McDonald's Food - the Facts which is 1986, one can find
14 reference to saturated fat appearing there and other kinds
of fat, but there is not for every item a complete break
15 out that I can find at any rate. Look, for example, at
page 64. Do you have that?

Q. Which describes beef pattie, the meat inside the hamburger
18 sandwich?
A. Yes.

Q. In the second paragraph in that box it says: "One regular
20 McDonald's hamburger pattie supplies 15 per cent of the US
regulated daily allowance of protein, with only 93
21 calories. Hamburger meat from the supermarket may have up
to 30 per cent fat, but the hamburger meat at McDonald's
22 never has more man 22.5 per cent fat".
23 There is nothing there I can see about saturated fat. May
we deduce from that that this leaflet, McDonald's Food -
24 the Facts, or similar material was developed from its
version in 1986, so that by the time we are in May 1987 a
25 new version was on offer?
A. That is correct. In addition, there should have been
26 in every store at the beginning of this campaign a large
chart, approximately two and a half feet, two feet across
27 the top and three feet going down which has a full
nutritional break out of every single product.
