Day 117 - 27 Apr 95 - Page 36
MR. JUSTICE BELL: Do you know about that? I put them right at
the back, I think.

MR. MORRIS: Our position is that all our witnesses abroad we
would like to attend court. They have said they are
willing to attend court. It depends upon whether we can
raise the money and obviously -----

MR. JUSTICE BELL: Have you actually served Civil Evidence Act
Notices in respect of them?

MR. MORRIS: Not the French ones.

MR. JUSTICE BELL: Is it not sensible to do that anyway?

MR. MORRIS: Yes.

MR. JUSTICE BELL: Because if it all falls to pieces and for
whatever reason at all they do not come, if you have served
a valid Notice which qualifies, and it does not matter
whether it is abroad or because someone, unhappily, has
died or is too ill to come, if you have one of the reasons
which means that you can serve a copper bottom Civil
Evidence Act Notice, by which I mean one to which
McDonald's cannot respond with a counter notice because you
have got the "they are abroad" ground for doing it, you had
better do that anyway, had you not?

MR. MORRIS: Yes. I am sorry we have not formally done that but
if we can just say -----

MR. JUSTICE BELL: Let me -----

MR. MORRIS: I have not got my own list here, but basically the
two French witnesses, we would like a Civil Evidence Notice
put on their evidence.

MR. JUSTICE BELL: That is Le Meil and Gallez, is it?

MR. MORRIS: Yes, Lamti, I think his name is, Hassen Lamti.

MR. JUSTICE BELL: Lamti, is it?

MR. MORRIS: I think so, yes.

MR. JUSTICE BELL: But apart from those I thought I heard you
say yesterday there were some whose last address you had
was abroad?

MR. MORRIS: Yes.

MR. RAMPTON: My Lord, there is also, I do not want it to pass
unmarked, a girl called Sarah English who is No. 30 who
lives in Orangeville, Ontario.

MR. JUSTICE BELL: Yes. Is she in the same category as Magee
and McGill?

MR. MORRIS: No, she is someone who worked in McDonald's in
Canada. If we can put a formal request for a Civil
