     2        to find it to cross-reference.  I am not sure whether we
     3        are actually going to use it.

     5   MR. JUSTICE BELL:  Think about how much of this you need to put
     6        to Mr. Beavers, because we went into it in some detail with
     7        an English witness.  I can see where the lines are drawn.
     8        Parts of the Health & Safety Executive Report were put to
     9        that witness.

    11   MR. RAMPTON:  My Lord, if anybody wants the reference, it is
    12        volume XIII, tab 55.  I would also mention, of course, that
    13        Mrs. Barnes is going to be a witness in the near future.

    15   MR. JUSTICE BELL:  Yes.  Obviously, it is quite apparent in this
    16        case that I am hearing a lot of evidence about UK
    17        practices, some about US practices, and perhaps not very
    18        much about the rest of the world.  But, save in so far you
    19        think there may be a real difference between the UK and the
    20        US, once you have raised the topic with the witness, that
    21        is really all you need to do.  (To the witness):
    22        Mr. Beavers, do not bother until it is put to you; if it is
    23        put to you, look at it.

    25   MR. MORRIS:  Just to save time, hustle is something that has
    26        emanated from the United States, McDonald's in the United
    27        States, the hustle policy, yes?
    28        A.  Yes, it has its roots in our early days.

    30   Q.   Obviously, it has been taken up in the UK.  Was the hustle
    31        policy that was taken up in the UK, effectively, what was
    32        happening in the United States, as far as you know?
    33        A.  My understanding of hustle that I articulated earlier
    34        is pretty much my understanding of how we try to translate
    35        that in all the countries we operate.

    37   Q.   So the hustle policy that would have been effective in the
    38        UK over the last, whatever it is, 20 years ---
    39        A.  I would think so.

    41   Q.   -- would be roughly the same throughout the world?
    42        A.  I would think so.

    45        A.  I would think so.

    47   Q.   Are you aware that the hustle policy or the working of the
    48        hustle policy has been condemned by the Health & Safety
    49        Executive in the UK which is, as far as I am aware, a
    50        statutory body which is concerned about employees' safety, 
    51        amongst other things?  Are you aware of that? 
    52        A.  I am not aware of that.  No.

    55        flipping through it.  It was tab 55 in volume XIII.
