Day 008 - 07 Jul 94 - Page 67

1 Mr. Mallinson and Mr. Hopkins.

2 MR. RAMPTON: Your Lordship will be conscious, as in the case
of Mr. Lipsett, I shall be asking Mr. Mallinson questions
3 about what Mr. Hopkins has said.

4 MR. JUSTICE BELL: What I think we should do is go on on Monday
to Mr. Stump and Mr. Siddiq. Mr. Van Erp has to be read.
     5
MR. RAMPTON: Yes. Then I have Mr. Oakley. I can do him from
6 Tuesday -- Monday is a very bad day for him, but he is
very much part of the case. He is in a sense the British
     7 equivalent of Mr. Langert.

8 MR. JUSTICE BELL: Have you any other ---

9 MR. MORRIS: When is Mr. Oakley due to be coming?

    10 MR. JUSTICE BELL: Tuesday.

11 MR. RAMPTON: With Professor Duxbury, he can come back on
Tuesday so you can do Professor Duxbury and then
12 Mr. Oakley on Tuesday and Wednesday.

13 MR. MORRIS: Is Mr. Oakley on Wednesday?

14 MR. RAMPTON: Professor Duxbury ought not to be all day. I am
proposing we start Mr. Oakley as soon as Professor Duxbury
15 is finished. We continue with Mr. Oakley, if we have to,
              on Wednesday as well.
    16
MISS STEEL: Could we go over again who is coming on what days?
    17
MR. JUSTICE BELL: Yes. Day by day, tomorrow Friday, Mr.
18 Langert. Do you expect to be able to, on your present
              estimate, finish Mr. Langert tomorrow?
    19
MR. MORRIS: I would think so. It was a very long
    20 evidence-in-chief.

21 MR. JUSTICE BELL: You have to pick the points you really want
to fight with on him. On Monday we go on to Mr. Stump,
22 who is the Chelsea manager; Mr. Siddiq, who is the
licensee at Barnet but was at Chelsea; then Tuesday
23 Professor Duxbury, followed, supposing he is completed, by
Mr. Oakley who may, if he starts on Tuesday, drift into
    24 Wednesday.

25 MR. RAMPTON: Yes, he will; because he has to do not only
packaging, he has to do policies and nutrition.
    26
MR. JUSTICE BELL: I had forgotten the extent of that. Does
27 that mean that we may have a rather short day on Monday?

28 MR. RAMPTON: Yes, it might do; it depends on the
              cross-examination.
    29
MR. JUSTICE BELL: Because there is a difficulty with Mr.
    30 Preston on Monday?
