     1   MS. STEEL:  I just think that Mr. Rampton implied that the
     2        reason Mr. Magee was not getting any pay rises or whatever
     3        was because he was behaving like this, but if you actually
     4        read it in context, it reads that he started behaving like
     5        that because he got fed up with the way he was being
     6        treated.

     8   MR. JUSTICE BELL:  You may be right about that, but I wonder to
     9        what extent Mr. Giardina can help you?

    11   MR. MORRIS:  I would think probably nothing, but Mr. Rampton
    12        seemed to think he could help with their case on that
    13        subject.

    15   MR. RAMPTON:  He can help about the attitude of the management
    16        to a staff member that behaves in the way that Mr. Magee
    17        accepts that he behaved, of course he can deal with that.

    19   MR. JUSTICE BELL:  There we are.

    21   MR. MORRIS:  I am quite happy not to continue this line of
    22        questioning as long as all the conclusions that Mr. Rampton
    23        was aiming for when he brought it up, because it was him
    24        that brought this up, are also disregarded.  For example,
    25        Mr. Rampton was encouraging the conclusion that that kind
    26        of person should be got rid of because, you know, they are
    27        obviously a liability.  I could ask you to conclude, could
    28        I not, Mr. Giardina, that disciplinary action should have
    29        been taken against the management for creating such
    30        disgruntled employees?
    31        A.  If I was aware of the situation and that was the case,
    32        that is what I would have dealt with.  I would have dealt
    33        with the managers as well.

    35   Q.   You said in answer to Mr. Rampton's question about
    36        Mr. Magee's comment about the five star people having lousy
    37        wages, "Well, they are some of the highest paid".  But even
    38        for some of the highest paid in McDonald's, it is still
    39        lousy wages, is it not?
    40        A.  Not as far as I am aware.

    42   MR. JUSTICE BELL:   See if you can help me a bit on that because
    43        Mr. Magee said he started as a green badge in November 1986
    44        at œ2.19 an hour.  If you got your five stars, would you
    45        automatically be on the training squad?
    46        A.  No, because some people did not really want to go into
    47        that field.

    50        A.  Yes.

    52   Q.   But suppose you had worked well and been there for about 18 
    53        months and got your five stars, could you get five stars in
    54        18 months?
    55        A.  Yes.

    58        someone might then be earning, been there about 18 months,
    59        got their five stars, a time when the basic rate is about
