Day 205 - 17 Jan 96 - Page 47

MR. MORRIS: It might be less, OK.

MR. JUSTICE BELL: It might be less.

MR. MORRIS: I will try and do that.

MS. STEEL: I am not 100 per cent sure. I was not clear
whether you were saying that you had got updated pleadings
that had had the amendments added.

MR. JUSTICE BELL: I have got the amendment with regard to
       Brazil.

MS. STEEL: Incorporated into the pleadings?

MR. JUSTICE BELL: Yes, as particular C.

MR. MORRIS: Is this the one that we successfully pursued, that
in the early 1990s Brazilian beef was exported for
McDonald's use from Braslo Limited to Argentina and
Switzerland? That was allowed; that should be in.

  MS. STEEL: On which page?

MR. JUSTICE BELL: On page 3 of divider 1.

MS. STEEL: Which part? About Brazil?

MR. JUSTICE BELL: In paragraph C.

MS. STEEL: We have not actually got a copy of the changed
abstract. I do not remember ever getting a copy, but -----

MR. JUSTICE BELL: On 3rd October 1995, I gave a ruling on
various interlocutory matters, and on the first page at B
I said this: "One amendment relating to exports of
Brazilian beef was agreed between the parties. The result
is that the first sentence of the first amendment for which
I gave leave on 25th July 1995 should read: 'Brazilian beef
raised in regions causing the displacement of farmers into
Amazon forest areas has been supplied to McDonald's in
Brazil and to McDonald's UK and to McDonald's or their
       suppliers in Argentina and Switzerland.'"

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Now, the abstract which I have has a
paragraph C which has words to that effect, but does not
have the words at the end of the first sentence "and to
McDonald's or their suppliers in Argentina and
       Switzerland".

MS. STEEL: I think that that was added at a later date.

MR. RAMPTON: It was based on what Dr. Gomez Gonzales had said
in the witness box -- it is coming back to me now -- that
he saw no reason why Brazilians should not export to
Argentina or Switzerland or anywhere else, except the
       United States of course.
