Day 207 - 23 Jan 96 - Page 39

thought to be some sense in giving your
break/refreshment/rest period nearer the middle of the
       shift than one end.

MS. STEEL: I am happy to take that course.

MR. JUSTICE BELL: Why not take it up on that premise?

MS. STEEL: If I ask the question again then. If people were
having to take their breaks early or very late in their
shift, rather than having it around about the middle of
their shift, would you accept that that is an indication
that there is understaffing there, insufficient number of
staff to be able to cover for them to have their breaks?
       A. On the day in question that we went through earlier,
I counted 44 members of staff on the day shift, and
I considered that adequate staffing to run that shift. So,
       no, but -----

  Q. If that day is representative of other days, it is not
unusual, then; you are perfectly happy that the staffing
levels are what they need to be?
       A. I would say 44 crew was enough to run the store
       properly, yes.

  Q. The day that we looked at in question, would you say that
that would be a fairly normal day?
       A. From -- what, without the number of staff in the
       restaurant?

  Q. Yes.
       A. For a Saturday.

  Q. Yes. That would be fairly normal? If you nod, it does not
       come out on the transcript?
       A. Yes. Sorry.

MR. JUSTICE BELL: Is that page 407 that you are looking at?

MS. STEEL: I was not actually looking at any page. I was
referring to the pages that we were talking about this
       morning, on the Saturday.

  MR. JUSTICE BELL: I see.

MS. STEEL: I think that was what the witness was referring to,
       too.

MR. JUSTICE BELL: It was, except that I think he opened -- and
I thought I could see that you had got open there as well,
because Mr. Henden referred to tab 5 -- a day which has
numbers in store. It is a complete misapprehension.

(To the witness) Are you clear that Ms. Steel was
       referring to the payroll?
       A. The one we looked at earlier?

  Q. This morning; not at the document you have open in front of
       you there.
       A. Yes.
