Day 196 - 06 Dec 95 - Page 31

MR. JUSTICE BELL: I think you can make the time. Whether it
means talking to Mr. Coton for some time this evening or
getting here, say, at half past 9 tomorrow and making some
arrangement for your boy, if that has to be made, for a
fellow parent to take him to school or not. In so far as
there is any need to take instructions, I think you ought
to be able to do it by 10.30 one way or the other, if you
make your own arrangements. So we will carry on at 10.30
if, indeed, there is any further you want to ask Mr. Coton
       then.

MR. MORRIS: There is quite a lot in the documents.

MR. RAMPTON: My Lord, can I ask that the communication between
defendant and Mr. Coton, your Lordship's leave for that, is
confined to what arises out of those documents and does not
hack back over what he has said today.

MS. STEEL: We have no reason why we would want to hack back
       over them.

MR. JUSTICE BELL: No. All that is being said, which is clearly
not only right but sensible, is do not be tempted with
Mr. Coton to say: "You said this in your evidence" and
then ask him about that, with a view to seeing if there is
anything more you can usefully ask him about it tomorrow.
Restrict yourself to any further matters on the
documentation. I mean, quite frankly, the issues in the
area Mr. Coton has given evidence about are really quite
stark and clear and how much additional detail helps, I do
not know. Someone is not telling the truth and I have to
       decide who.

MS. STEEL: I just want to bring something else up. You asked
about whether we could find a witness for Friday. The only
witness that we are able to get to come to court on Friday
is Vicky Watkins. As yet there has not been a discussion
about whether she was going to be able to come, but I do
not know what you want to do about that. She is able to
come on Friday, if you want to hear her evidence on Friday.

MR. JUSTICE BELL: Can you remind me what her evidence covers?

MS. STEEL: She took a video of chickens at Sun Valley Poultry.
It is fairly short, but the Plaintiffs insisted on her
coming to court for some reason -- I do not know why. So
she can come on Friday, if you want to hear her evidence
       then.

MR. JUSTICE BELL: Do you have anything to say about that,
       Mr. Rampton?

MR. RAMPTON: I am not anxious to waste the court's time.
I would be willing for her to come on Friday, subject only
to this, that I have not yet been able to lay hands on a
veterinary inspector who Vicky Watkins activated as a
       consequence of her raid.

  MS. STEEL: Her what?
