5 where -- is she in this country?

9 MR. JUSTICE BELL: The normal practice if someone is being
10 called within an area of one of your particular witnesses
11 is if at all possible to have that person in court during
12 the evidence so they can listen and give you instructions
13 on the spot or at least over a midday or overnight
14 adjournment.

16 MR. RAMPTON: My Lord, I doubt very much there is anything in
17 this statement to which Ms. Hovey could possibly make any
18 contribution at all.

20 MR. JUSTICE BELL: One just does not know. If you can possibly
21 get Ms. Hovey here if not on Wednesday say on Thursday so
22 that you can tell her what has passed on Wednesday and she
23 can listen to what happens on Thursday, so much the better.

25 MR. RAMPTON: I wonder whether your Lordship would consider one
26 other thing? I am very anxious not to bring Dr. Pattison
27 back if possible. I wonder if your Lordship would consider
28 sitting at 10 o'clock tomorrow morning?

30 MR. JUSTICE BELL: Can you get here by 10.15, Mr. Morris?

32 MR. MORRIS: I can try. It is a bit of a rush. I can try
33 tomorrow. Again tonight I should have left at half past
34 four but luckily my baby sitter has agreed to sit on for an
35 extra half hour.

37 MR. JUSTICE BELL: Trials cannot be run to everyone's
38 convenience. One has to try to take a line which is not
39 too inconvenient to absolutely everyone. We will start at
40 10.15 or as soon thereafter as you get here in the
41 morning. Your very best to get here by 10.15 if you can.

44 MS. STEEL: I want to say something else. Mr. Rampton was
45 making disparaging remarks about when I had arranged this
46 appointment for. I was actually given an appointment in
47 December which was whilst Dr. Gomez Gonzalez was giving
48 evidence, and because he was from the States I cancelled
49 that appointment and this was the next one I got after
50 that.

52 MR. JUSTICE BELL: I purposely said before we rose that I was
53 making no criticism of you in respect of the time of the
54 appointment. If you have any difficulties in the future,
55 particularly with any medical appointment, I would be
56 grateful if you would let me know. It is not the question
57 of the court waving a big stick. I have no authority to do
58 that and I would not want to do it. It is just experience
59 teaches one that often things sort themselves out if a
60 doctor or hospital concerned are aware of what is at stake,
