Day 181 - 01 Nov 95 - Page 26
A. I must say, I do not know which documents ....

Q. I am sorry.

MR. JUSTICE BELL: Which ones are you looking at?

MR. RAMPTON: The second page of E, my Lord.

MR. JUSTICE BELL: I seem to have got an EE stuck between the
first and the second page.

MR. RAMPTON: I am sorry, your Lordship has a document that I do
not have. (To the witness): It is the third page.
A. Is it a table or text?

Q. It is a table.

MS. STEEL: It is like a computer print out.

MR. JUSTICE BELL: I think if Mr. Rampton reads across the top
to you, we will see what -----

MR. RAMPTON: It should have a subheading: "Current employees
by average weekly hours for the Company".
A. Yes, I do have that one.

Q. Good, I am glad. You will see that the figures that were
given here are for three-quarters, that the current
quarter, that is, the one ended 31st March 1995, the
previous quarter, that is, the end of 1994, and the first
quarter of 1994 as well in the last column, do you see
that?
A. Yes, I do.

Q. Right. I would like you to look at the percentages which
appear below the figure 11 to 20 hours which is in the
left-hand column.
A. I do have that.

Q. What?
A. I have that.

Q. You have that. Then you will see that 21 to 30 hours is
just over 15 per cent, that 31 to 35 hours is roughly seven
and a half per cent, that 36 to 39 hours is four and
three-quarters per cent and the 40 to 50 hours is just over
five per cent, do you see that?
A. Yes, I do.

Q. The people doing overtime are the 40 to 50 hour people, are
they not, and the ones beyond, of course?
A. Well, I would agree on the face of it, but the problem
is for a part-time employee, of course, overtime is working
beyond the hours which they were expecting to work, though
they still may attract a flat rate. That is why I was
generally, kind of, slightly hesitant in agreeing with you
about the point about it is only full-timers that do
overtime.

If I may just finish? There is a characteristic in the
