Day 260 - 11 Jun 96 - Page 58

because there is a hierarchy and we are going to be
overruled if we do make a decision"?
       A. No. That was the impression I received, because no
decisions were made and there was no real discussion.

  Q. So, it could be that, in actual fact, people just felt that
there were not enough of the kind of regular attenders
       there to make a decision?
       A. You could be correct, yes.

MR. MORRIS: Presumably, the group had been carrying on fine
without me. I only attended on 2nd August, according to
       you?
       A. Yes.

  Q. The group had been carrying on fine without me, all the
       other meetings you attended?
       A. Yes.

MS. STEEL: OK. If we move on to 16th August.
       A. Yes.

MR. MORRIS: I am not sure if 16th August comes up in the
       statement or not.

MS. STEEL: Can I just say that in respect of what is here, we
totally disagree with the account of what is said in
paragraph 4; but as it is not in evidence I do not need to
       challenge it, I presume.

MR. RAMPTON: No, of course not. I would not dream of advancing
that as evidence in this case.

MR. JUSTICE BELL: I would not concern yourself with that.

MS. STEEL: It is completely inaccurate.

MR. JUSTICE BELL: It has not come to public attention; and
I have already said that unless some admissible evidence is
brought and the relevance is explained to me, I do not see
it as an issue in this case anyway, and I am not making any
assumption adverse to you because that sort of thing has
crept into the documents, or something Mr. Preston said,
       I think.

MS. STEEL: I mean, I could quite easy cross-examine -----

MR. JUSTICE BELL: Quite frankly, I would not bring it out.
I am not holding it against you and it is not in the public
       arena.

MS. STEEL: It is based on the fact that it is actually
something that he was trying to listen to, as opposed to --
he has quite clearly got it completely wrong. But, anyway,
       I will leave it.

MR. JUSTICE BELL: You have to decide whether you challenge that
just as a challenge to Mr. Bishop's credit or you think it
is better just to leave it alone. You may think the second
       course is the more advisable.
