     5        store and what was McDonald's doing?

     7   MR. RAMPTON:  This witness is a witness of the fact in some
     8        respects and an expert witness in others.  For Mr. Morris
     9        to put to this witness (and I have got my eye very firmly
    10        on the clock) a whole lot of hypothetical questions about
    11        evidence which may or may not have been given in this case
    12        and expect him to answer, really, to my way of thinking, is
    13        absurd.

    15   MR. JUSTICE BELL:  The point is, Mr. Morris, I think you have
    16        lost your route a bit and I am going to have much more
    17        information about this than ----

    19   MR. MORRIS:  I will get straight to the point.

    23   MR. MORRIS:  Straight to the point.  What did the McDonald's
    24        tell you they were doing with the recycled material?
    25        A.  I know no more than that which is contained in the fact
    26        sheet that you have alluded to and which we have looked at
    27        just now.

    29   MR. JUSTICE BELL:  Was your source of information the fact
    30        sheet?
    31        A.  No.  I discussed the matter with Mr. Preston.

    33   Q.   You do not know any more than appears there?
    34        A.  No.

    36   MR. MORRIS:  Evidence has been given in this court that in fact
    37        McDonald's did not do any recycling whatsoever with that
    38        material.

    40   MR. JUSTICE BELL:  This is where you go off the path again
    41        because you are not here to educate the witness about what
    42        the facts may or may not be.  I am not stopping you ----

    44   MR. MORRIS:  If it is true that they did not in fact recycle
    45        that material, do you not think that would be evidence that
    46        they are getting publicity when, in fact, they are not
    47        really committed to concerns over environment/index.html">litter and waste?
    48        A.  I do not think I can answer that question.

    50   MR. JUSTICE BELL:  I was going to say, I am not stopping you 
    51        making a point of fact with the witness or something within 
    52        his particular expertise, but ----

    57        to be asking me in a few months time.
