     3   MR. RAMPTON:  My Lord, if I may so, that is a wholly irrelevant
     4        observation because whether or not we call the Jarret
     5        witnesses, the fact is we will not finish Mr. Kenny until
     6        17th.

     8   MS. STEEL:  If Jarrets and Chambers are not called that week,
     9        presumably, they will have to be after Kenny, in which case
    10        we would not be starting our witnesses the following week.

    12   MR. JUSTICE BELL:  The way it is laid out at the moment,
    13        Mr. Kenny was originally put in for three days at the
    14        beginning of next week.  So I have assumed that three days
    15        are provisionally now allowed from Monday 13th.  My
    16        understanding is that as from Thursday 16th the proposal
    17        was that we would be on to your witnesses.

    19   MS. STEEL:  Kenny was originally down for four days because he
    20        was on the Friday before.  I think he is quite a
    21        substantial witness.

    23   MR. RAMPTON:  Mr. Kenny is down for a whole week now.

    25   MR. JUSTICE BELL:  He is down for a whole week.  That takes us
    26        to Monday 20th.

    28   MR. RAMPTON:  I am not trying to harass the Defendants, but
    29        unless we know who they are going to be, when they are
    30        going to be called, we cannot make arrangements for the
    31        witnesses of ours who have to come after.  That is all.  I
    32        do not know why Ms. Steel is so resistant to co-operation.

    34   MR. JUSTICE BELL:  She may not be; it may be just a
    35        misunderstanding.  What I am suggesting is that starting on
    36        Monday 20th in those blank squares you have there, you
    37        start writing in your witnesses.  Do you understand?

    39   MS. STEEL:  I understand that, but the problem is that I am not
    40        clear what Mr. Rampton is saying about Jarrets.  They are
    41        either going to come on 8th or not at all, or whether they
    42        may be coming at a later date if they cannot make it on the
    43        8th.

    45   MR. RAMPTON:  It does not affect anything, my Lord.  My
    46        intention is to call somebody from Jarret possibly;
    47        possibly not.

    49   MR. JUSTICE BELL:  If they are called it will be in that time
    50        slot?

    52   MR. RAMPTON:  It will be then.  If it is not, then we will 
    53        notify your Lordship and the Defendants and alternative
    54        arrangements can be made.  In any case, Jarrets are only
    55        in, largely speaking, because of Ms. Hovey and I do not
    56        expect the Defendants to call Ms. Hovey until they have
    57        heard from the Jarrets witnesses.  So, that is, in a sense,
    58        largely a discrete issue.  It does not affect the question
    59        of when the Defendants are going to call and who they are
    60        going to be, their experts and other witnesses on food
