Day 253 - 21 May 96 - Page 54
there is anything we can do to avoid that.

We will have cross-examination of Dr. Arnott tomorrow. We
will hope to finish cross-examination of him tomorrow.
I do not know if anyone has made any inquiries of him about
Thursday, because Thursday did not appear to be a
possibility.

MR. RAMPTON: It was not originally, but we will speak to him.
We are going to see him tomorrow at 9 o'clock. I am not
going to ask him any questions in chief unless you tell me
tomorrow that I have to.

MR. JUSTICE BELL: I hope we can finish Dr. Arnott's
cross-examination tomorrow. If we cannot, and he can
possibly stay on Thursday, I would like him to do so, so it
can be completed then. When we have finished Dr. Arnott's
evidence, or if he cannot attend on Thursday morning in any
event we will go on with Mr. Nicholson, but not beyond
about 3 o'clock so that you can attend your meeting.

MR. MORRIS: Are we going to deal with the Brazil matter?

MR. JUSTICE BELL: No. We will deal with the Brazil matter when
Mr. Rampton is ready. I would like, if possible, to deal
with it on Thursday if we can.

MR. RAMPTON: I will read Miss Branford's transcript before
then.

MR. JUSTICE BELL: It does not seem to me that, whatever my
answer to it, whether it allows a very great argument.

MR. RAMPTON: I agree. As I said to your Lordship, my
inclination at the moment is that it does not matter very
much one way or the other.

MR. JUSTICE BELL: I would be happier if everyone went away for
the vacation with an answer, leave or no.

MR. MORRIS: If I can say, if Mr. Rampton is going to challenge
the interrogatory on the basis of the transcript if a
transcript can be provided to us -- sorry, the amendment,
yes. If the transcript can be provided to us, because
obviously we do not have the transcript.

MR. JUSTICE BELL: Wait and see, let us hope we can deal with it
on Thursday. I do not know yet, you see, that Mr. Rampton
is actually going to object to it either in substance or in
form.
