Day 270 - 28 Jun 96 - Page 47
whenever there has been a legal argument -- unless it has
been something completely trivial -- we have sent them a
transcript, and your Lordship.

MR. JUSTICE BELL: What I suggest you do is you will be given a
copy of the transcript of this afternoon from when I first
came back until now where a line can be drawn. So you will
be able to read what I said about your possible application
for leave to issue a third party notice and what Mr.
Rampton has said about this.

MS. STEEL: Right.

MR. JUSTICE BELL: There is no harm in having it anyway, because
it may or may not crop up in the future when I am asked to
consider the status of documents and to what extent I can
take them into account at all, regardless of the question
of what weight I would attach to them, if I could take them
into account.

MS. STEEL: Yes.

MR. JUSTICE BELL: We will draw the line across the transcript
there.

MR. RAMPTON: Would your Lordship excuse me because I have got a
lot to do. But before I go can I say this? There was a
question, I understand, whether Mr. Bishop or
Mr. Pocklington or both of them should come back. I
understand that Mr. Pocklington is not required, but that
unless we are disposed to accept that the note he made
referred to IMF leaflets rather than London Greenpeace
leaflets, if my memory serves me correctly, the Defendants
would want him back, we are not disposed to make that
concession. Therefore, he must come back, as I have
understood your Lordship's view of the matter. He would be
very short because it is only one short point.

MR. JUSTICE BELL: Could he come on Monday?

MR. RAMPTON: I would like him to come on Monday after
Mr. Brett. He is abroad at the moment, but there will be
lots of gaps next week and I will try and get him for, I
hope, Monday, but certainly Wednesday or Thursday.

MR. JUSTICE BELL: I think the answer is this: It seems to me
you can be confident in making a school appointment on
Monday afternoon?

MR. MORRIS: Yes.

MR. JUSTICE BELL: Do not make it on Monday morning and do not
make it early on Monday afternoon. But you must be
prepared to ask your further questions of Mr. Bishop at
very short notice indeed.

MS. STEEL: I would just like to say, actually, I would prefer
it if he does not come on Monday because we have not got
any of the publication documents in court. Obviously, we
are going to have to be bringing them for Tuesday,
