Day 285 - 23 Oct 96 - Page 23
cross-examined, to say that the beef was not from
rainforest land.

MR. JUSTICE BELL: All I am saying is they did not use it to
try and persuade Prince Phillip. We can forget Prince
Phillip, can we not? No disrespect to him. He is only
of historic significance in the case because what he was
alleged to have said led to a great fuss.

MR. MORRIS: All right. I think the Vestey reference, and I
am sure that you made a note at the time, in terms of the
evidence that he gave, was pages 45 to 47, which --

MR. JUSTICE BELL: Which day?

MR. MORRIS: I am not sure what day he gave evidence.

MR. JUSTICE BELL: Of whichever day it was.

MR. MORRIS: Yes, that he gave evidence.

MR. JUSTICE BELL: I will be able to find that easily.

MS. STEEL: Day 276.

MR. JUSTICE BELL: Thank you.

MR. MORRIS: We have got a list of who appeared on what days,
if you need it.

MR. JUSTICE BELL: I have my own in my room. I made one the
days when they gave evidence and what their topics were.
So there is no problem with Lord Vestey, because he gave
evidence for about an hour on one morning only. It is
where you have got people like Mr. Cesca or Dr. Gonzalez,
who gave evidence for several days, that I need help.

MR. MORRIS: Right. I did sort of lose the point I was
originally making, which was there was an example of a
supplier giving McDonald's the reassurance that they had
sought to smooth over any public, you know, embarrassment
and basically it just not being true. I mean, even if it
was not used in the end, McDonald's was seeking a
guarantee and they got the guarantee but it turns out the
reality was different.

Might that be a convenient time to break?

MR. JUSTICE BELL: Yes, we will come back at two o'clock.

(Luncheon Adjournment)

MR. MORRIS: We are still in the area of policy.

MR. JUSTICE BELL: You had been making some points on Lord
Vestey's letter and his evidence.

MR. MORRIS: Right. Yes, I mean, that was a sort of a bit of
a digression, but it related to the unreliability of
information from suppliers and we branched out into, of
