Day 103 - 14 Mar 95 - Page 70

If you approach tomorrow from the point of view that
between you you have an hour and three quarters, having
already had four days, to complete your cross-examination,
first of all, I do not think that is unfair and, secondly,
I think you might actually find it helpful.

So go away confident you are not going to have to ask
Mr. Bennett anything tomorrow, and concentrate on getting
yourself in order so you do not have to do any recapping
and you can use that time for constructive
cross-examination aimed at the targets you have got your
       eye on.

MR. MORRIS: As we go over the schedule in general, we asked the
Plaintiffs yesterday or the Plaintiffs's solicitors
yesterday that any draft schedule being thought about
should be submitted to us before they are put to yourself
so that we can try to work out some schedule that is
realistic by agreement. I can see that the Plaintiffs have
got some draft schedule they are going to produce in a
       minute.

MR. RAMPTON: Would you like to look at what is in my hand?

MR. JUSTICE BELL: Leave it for now. What we have until Easter
or just before your witnesses on these two topics, if we do
not finish Mr. Bennett by the close of play on Friday the
question of recalling him at some stage if Mr. Bennett
cannot come on Monday or you tell me you would like Monday
for preparation anyway before you call the first of your
witnesses, you must concentrate on asking Mr. Bennett on
Thursday and Friday the matters you want to raise with him
before you embark on your own witnesses, do you
       understand?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: So if need be he can be called back at any
stage in the future. What I would like with regard to
general scheduling is for Mr. Rampton or Mr. Atkinson or
Mrs. Brinley-Codd to give you a copy of any schedule and
then allow something like two or three days anyway for you
to give them your observations before and do pay due heed
to your observations before I am asked to try to help sort
out any differences which may have arisen between you.

You have plenty of time at the moment because the next
topic starts after Easter. To some extent I anticipate, it
depends upon any response you have got to the forms which
       have been sent out.

MR. MORRIS: They have not been send out yet. I am drafting up
a cover note to go with them. That is under way.

MR. JUSTICE BELL: Get them off just as soon as you can.

MR. MORRIS: I think part of what I wanted to say was, there is
a certain amount of pressure we feel under. I know that
everybody feels under pressure to keep things going as
quickly as possible, but, for example, Easter I think you
