If your Lordship remembers, that is in a sense one of the
reasons, or perhaps the reason, why I am, in these
submissions, somewhat reluctant to descend into the arena
in relation to environment/index.html">litter.

MR. JUSTICE BELL: Yes.

MR. RAMPTON: Because it really has not got anything to do with
the conduct alleged in this part of the leaflet.

MR. JUSTICE BELL: I may come to that when I come back to --

MR. MORRIS: Can I just ask a legal question?

MR. JUSTICE BELL: Yes.

MR. MORRIS: If McDonald's, if Mr. Rampton says you would have
to show someone has a poor reputation on the subject by
real evidence, then obviously we would submit, as we have
done, that McDonald's have to show real evidence that their
reputation has suffered from the distribution by me and
Helen of this fact sheet as well. It would surely be the
two parts of the same coin?

MR. RAMPTON: Well, it is not, but there it is. Perhaps
your Lordship does not wish me to deal with that
intervention?

MR. JUSTICE BELL: No, I do not think so.

MR. RAMPTON: No. The only thing I should add, when I said
real, gritty evidence about bad reputation, the relevant
authority, if your Lordship should want it, is Plato v
Speidil 1960 Appeal Cases. I am afraid I cannot remember
the page number, but it is in the House of Lords. Their
Lordships gave an example, I think it was Lord Denning when
he was in the House of Lords before he came back down
again, the sort of evidence that you need if the allegation
is that, for example, a woman Plaintiff is a prostitute,
you have to call somebody like a police officer to say,
well, she lives in my patch and she certainly has that
reputation within this district.

MR. JUSTICE BELL: Yes.

MR. RAMPTON: 1961 Appeal Cases.

MS. STEEL: What is the name of the case again?

MR. RAMPTON: P-L-A-T-O v Speidil -- General Speidil who was one
of the Germans during the war who was accused of war
crimes. Something like the Plaintiff.

MR. JUSTICE BELL: Yes. The other matter is page 40 where you
are dealing with what the evidence is as to when land was
deforested. This is in relation to Costa Rica. So, in so
far as Civil Evidence Act witnesses -- leaving
