Day 181 - 01 Nov 95 - Page 39

       A. I did not actually write down what I saw. I tape
recorded what I saw, using a hand dictaphone, when I went
       to the stores.

  Q. I mean, Caseview has got: "I wrote this at the time of the
visit, so this is what I saw." You tape recorded it and
       made your statement?
       A. Yes, absolutely.

MR. RAMPTON: Now, I would like you just to look at this,
Mr. Pearson. My Lord, this was the Health and Safety
Commissioner's annual report which, as your Lordship will
remember, Mr. Purslow referred to. I gave my copy to
Mr. Morris, because he asked to borrow it in order to copy
it. I am not saying he has swallowed; I am just saying
I have not seen hide nor hair of it since. So what I have
done -- that was the last copy at that time. We have some
more. I am going to give one to the witness and one to
your Lordship, because that is all I have, and I am going
       to keep one for myself.

MR. MORRIS: I cannot remember if we actually -----

MR. RAMPTON: It is all recorded in the transcript. I looked it
up last night. We would have brought more if -----

MR. JUSTICE BELL: Let us see where we get to.

MS. STEEL: I think Mr. Rampton could have mentioned yesterday
if he was intending to bring it up, so that we could have
       brought it.

MR. RAMPTON: I did not know.

MR. JUSTICE BELL: Let us see where we get to.

MR. MORRIS: Well, we have not got copies of it in front of us.

MR. JUSTICE BELL: Let us see where we get to. If there is a
problem, you can borrow the one Mr. Rampton has given me.

MR. RAMPTON: What I will do, actually -- because I hope it is
not marked in any sense that would matter -- is give the
Defendants -- no, I will keep mine. I have some copied
pages. That surprises me. I will give the Defendants this
coloured one. But this time I want it back.

(To the witness): Could you turn to page 90 of this
document, please, Mr. Pearson? This is all about what are
       called RIDDOR accidents, this section?
       A. Yes.

  Q. That is to say, broadly speaking, is it not, fatal and
       serious?
       A. Notifiable.

  Q. Notifiable -- or reportables, as we have been calling them
in this court. There are some words in italics under the
heading: "Reporting levels of non-fatal injuries". Do you
       see that?
