MS. STEEL: I think we have finished on CFCs. I do not know
       whether ----

MR. JUSTICE BELL: We will break then until 2.00.

                        (Luncheon adjournment)

                                                    2.00 p.m.

MR. MORRIS: I just want to deal with three brief outstanding
matters from the morning's evidence. There was the New
Zealand document which you have now read, yes?
       A. Yes, I did.

  Q. Apparently, in New Zealand the recycling scheme was quite
       extensive, was it not?
       A. I have to say, prior to reading these two newspaper
cuttings, I had no knowledge of what was happening in New
       Zealand.

  Q. Right.

MR. RAMPTON: My Lord, in that case it means, does it not, if
I may submit it, that this witness has no relevant evidence
       to give on this matter?

MR. JUSTICE BELL: I do not know. It may very well mean that.
It means it is pointless asking him anything about ---

  MR. MORRIS: In detail.

MR. JUSTICE BELL: -- whether he knows anything or it probably
means it is pointless asking him anything about New
Zealand. If you think that may be wrong, then tell me what
       you have in mind.

MR. MORRIS: If it was true or if it was established to be true
that a recycling scheme, if we can call it a scheme, a bin
separation scheme which might be a more appropriate way of
describing it, was virtually national throughout the
country -- I will ask you a general question rather than on
New Zealand. Do you not think it is conning customers that
they should believe that McDonald's is playing its part in
a recycling system when they are playing their part as
       customers?
       A. I do not -----

MR. JUSTICE BELL: No, do not answer that question. There might
be legitimate ways you could put it. But you are assuming
a state of facts which is not established, and since you
clearly are beginning to base it on what happened in New
Zealand and he said he did not know -----

MR. MORRIS: It also applied to Nottingham.

MR. JUSTICE BELL: Yes, we have been through Nottingham, have we
not? You may or may not have a good point on Nottingham.
I have read what is there and I understand your point that,
for instance, however that paragraph started off, it
