     1        We would hope that we could lay hands on them while
     2        Mr. Richards is still in the witness box.  But, obviously,
     3        these new allegations, specific allegations, raised for the
     4        first time mean that we have to do some urgent work to find
     5        if the documents do still exist and where they might be.

     7   MR. JUSTICE BELL:  What about the document which I
     8        have suggested Mr. Morris might talk to Mr. Atkinson
     9        about?  When do you do that?

    11   MR. RAMPTON:  That is a different matter.  That can either
    12        happen, and I would suggest now it is better that it should
    13        happen after court today, rather than keep a witness
    14        waiting again.  It is only a question of whether there are
    15        any bits of that scheduling document that are missing -- we
    16        do not believe there are -- but if Mr. Morris knows what he
    17        thinks is missing, then he could tell Mr. Atkinson after
    18        court today.  There is no reason why the witness should be
    19        delayed while that happens this afternoon.

    21   MR. JUSTICE BELL:  What I suggest is that Mr. Richards goes into
    22        the witness box now, that when whatever step is going to be
    23        taken with his evidence-in-chief has been taken, he be
    24        asked any questions which either you or Mr. Atkinson wish
    25        to ask him about possible documentation.  Then I would
    26        suggest that Ms. Steel and Mr. Morris, supposing we have
    27        got time, ask in a shorter form as possible any questions
    28        they want to ask which are directed at possible discovery.

    30   MR. RAMPTON:  Yes.

    32   MR. JUSTICE BELL:  That we break off at 4 o'clock anyway which
    33        will allow what would have been quarter hour or 20 minutes
    34        of court time for Mr. Morris to talk to Mr. Atkinson about
    35        the document.

    37   MR. RAMPTON:  Mrs. Brinley-Codd has passed me a note which says
    38        that she has already spoken to Mr. Morris and has informed
    39        him that there is nothing further we are able to do to help
    40        him.

    42   MR. MORRIS:  That is a slightly debateable point, but she did
    43        contact me, yes.

    45   MR. JUSTICE BELL:  You may ask a witness a question about that,
    46        I do not know, but that appears to be your answer at the
    47        moment.  Let us see where we got to on that basis.  We may
    48        rise about 4 o'clock anyway if there are all sorts of
    49        queries about discovery.
