Day 203 - 12 Jan 96 - Page 73

you made a long reply but -----

MR. RAMPTON: He gave a general reply.

MR. MORRIS: Yes. Regarding the store, 194, in Clacton referred
to by John Atherton, your superior, just concentrating on
that store, he said: "There does not seem to be a will to
serve top quality product. The basics, such as time cards,
holding time usage, care of raw products, and enough
lettuce on Macs or not in place. Both stores have been
caught abusing shelf life." What action did you take
against Clacton store to bring back the recognition of the
importance of time cards, holding time usage and care of
       raw products?
       A. Well, I mean, this was not a call to take a specific
one-off piece of action. Mike Buckley had his goals and
objectives and we would have conducted full fields, our own
internal full fields, not -- just to sort of for us to
evaluate the restaurant and to get the standards in place
pretty much as we would have in Colchester. It is not
saying, you know, I need to take specific action against an
individual. You need to build a culture in the restaurants
where they understand and appreciate what is required and
why it is required, so I was taking the same action there
as I was in Colchester in relation to quality and .....

MS. STEEL: Just to move on, the summary of Steve Harney's
performance review on 1st June 1990. Is this something
that you found in your -- it is about five pages on,
       I think?
       A. Sorry, can you show me that?

MR. JUSTICE BELL: Where are you now? What is it, Ms. Steel?

MS. STEEL: I thought it was something that had been prepared
-- I have put them altogether for some reason behind
Mr. Skehel's statement. I thought it was something that
had been prepared by him but if it has not, then I will
leave it. I do not know whether it has been actually.

MR. RAMPTON: The summary of Mr. Harney's performance reviews
which were lost at the time is in 1990, July 1990.

MR. JUSTICE BELL: Yes, 1st June 1990.

MR. RAMPTON: It cannot possibly be anything this witness can
       answer a question on.

MS. STEEL: I do not know why all mine were together ------

MR. RAMPTON: I am not really answerable for that.

MS. STEEL: I presume because they were all is served together.

MR. JUSTICE BELL: It maybe, but it has a date 1st June 90, so
the short answer is that he cannot help.

  MS. STEEL: Yes.

MR. MORRIS: We have nearly finished.
