Day 207 - 23 Jan 96 - Page 48

  Q. Then they complain when pay day comes around because they
have not got as much money as they would have got if they
had worked all their scheduled hours?
       A. No.

MR. MORRIS: I am just going to move on to another scheduling
matter. If you open volume 2, file 2 -- I will try to do
this as efficiently as possible -- between pages 582 and
       604?

MR. JUSTICE BELL: Which divider is that?

MR. MORRIS: It is divider 13.

  MR. JUSTICE BELL: Yes.

MR. MORRIS (To the witness): Sam Mason worked, amongst other
complaints there might be about the times he clocked in and
out and had breaks and everything, eight days in a row.
Have you any comment to make about that?
       A. I do not -- I have not actually totalled up the days.
I do not know the reason why she worked eight days in a
       row.

  Q. Yes, it is Samantha, is it not?
       A. Samantha Mason.

  Q. Samantha Mason, yes. In fact, on page 588 she did not have
any break. I will not go through all the days for Samantha
Mason. I think one of them we have already looked at.
6.8.94 -- is that one we looked at? On 6.8.94 -- sorry,
that was 594, page 594, Samantha Mason, she started at 7.26
in the morning on a Friday and worked until 4.26 in the
afternoon, and only got a 20 minute break in the middle.
       Do you see that?
       A. I can see that.

  Q. Does that give you some concern? You said that 7.00 was
like the absolute maximum; in exceptional cases someone
might be scheduled seven days in a row. Does that worry
       you?
       A. It does give me concern. I do not know the reason why
       she worked eight days.

  Q. You do not know. Do you know the reason why it was
       allowed?
       A. No.

  Q. Did you say that nobody actually monitors the clock cards
to see if there is any -- you said that it was for the
Store Manager, was it not, to check that everything is OK?
The Store Manager does the monitoring, yes?
       A. Yes, he is responsible for it.

  Q. Fair enough. If we look at a different person -- I will
not take you through those days, people will have to take
my word for it; no doubt Mr. Rampton will point out if
I make a mistake -- David Watts on page 593: David Watts
comes into the picture here between pages 593 and 616, from
the days 6th August 94 to 13th August 94, he worked eight
