     1        which is inconsistent with that.  But, if that is so,
     2        I think the sooner it is found the better, because I can
     3        see a potential significance in, for instance, 10 per cent
     4        on a payroll not working at all in a three month period
     5        which might not be there if it was just a one week period,
     6        which was the snapshot concern.  I will not say any more
     7        about it, but I merely say that to illustrate that it may
     8        be of some importance to get it right.

    10   MR. MORRIS:  If it is any help, I cannot see how it can possibly
    11        be weekly.  It would have to be at least fortnightly
    12        because on that basis they work the 96 hours chart.

    14   MR. JUSTICE BELL:  It may be, but when we have categoric answers
    15        like that one has to look and see if there is any other
    16        evidence which contradicts it.  It does not have to be done
    17        within the next couple of days, but it has to be done so
    18        that if either side wants a witness recalled or a new
    19        witness called to elicit further evidence about it, there
    20        is time to do it.  That is my only point.

    24   MS. STEEL:   I wanted to ask some questions about the schedule
    25        that you drew up on the train yesterday?
    26        A.  Yes.

    28   Q.   This would be a typical -- I mean, I realise you have only
    29        filled out one name, so it is not exactly typical -- but it
    30        would be a typical schedule that would be put up on the, is
    31        it put up on the notice board for crew to see so they know
    32        what hours they have been scheduled for?
    33        A.  That is right, yes.

    35   Q.   And would you fill out the breaks so they knew how long a
    36        break they were entitled to?
    37        A.  Yes, we would.

    45   Q.   Did you ever write "close" in the schedule rather than a
    46        specific time?

    53        store shut, or would that be close when the cleaning up had
    54        finished?
    55        A.  No, that would indicate when the clearing up had

    60        A.  I think, on some occasions, we did actually write a.m.
