Day 006 - 05 Jul 94 - Page 69

1 A. Yes, it is dealt with.

2 Q. It is dealt on a local level?
              A. Some of it. Some of it may not be. Some may of it
3 have be to referred up; it depends on the parameters the
              manager operates between.
     4
         Q. What kind of thing would be referred up?
5 A. It depends what it is. I do not know. I cannot give
you categoric, this manager is going to refer this, this
6 manager is not going to refer that. I do not put them all
in that kind of tight pressure cooker or chamber. They
7 have some latitude; some refer everything, some refer
              nothing.
     8
MR. JUSTICE BELL: Some are fussers and some are not?
9 A. It is simple as that.

10 MR. JUSTICE BELL: If you have a specific topic you want to
concentrate on, put it to Mr. Preston.
    11
MR. MORRIS: When, for example, Mark Hopkins died in the
    12 Arndale Centre at Manchester?
              A. Yes.
    13
         Q. Did the head person from the Health & Safety go to that
    14 store?
              A. I think so, yes. I do not understand the relationship
15 between what we are at and where we were, Sir.

16 MR. JUSTICE BELL: Do not worry. Just answer the question.

17 MR. MORRIS: What about the Newcastle bomb scare when Fatima
Heron was jailed, did the head person or head person from
18 the company relevant to that issue go to the store?
              A. Whom might that be, "head person in the company
19 relevant to the issue"? The local market manager, the OPs
manager, market manager were all involved, yes.
    20
         Q. But it was not sort of something that head office is
    21 really interested in?
              A. Well, head office knew about it. Did Andrew Taylor or
22 Sid Nicholson get personally involved every step of the
way? I do not remember. I do not know. I would doubt
    23 it.

24 Q. What about a not very serious accident -- well, all
accidents are serious, but I think a couple of accidents
25 have been admitted by McDonald's. I cannot immediately
pick them out, but if there was an accident, someone had
26 an injury or maybe they were fined, McDonald's fined by
the courts after the injury -- just say if someone broke
27 their arm, slipped and fell and broke their arm, that
would not be something that would be referred up to the
    28 top of the tree?
              A. Probably not.
    29
         Q. It would be instore or maybe the next level?
30 A. By "the top of the tree", you mean me? The chances
              are no.
