Day 085 - 08 Feb 95 - Page 55

MR. JUSTICE BELL: He can ask him to look at it, surely?

MR. RAMPTON: My Lord, on what basis?

MR. MORRIS: On the basis you are going to listen to the
       question I will put.

MR. JUSTICE BELL: On the basis we have followed so far.

MR. RAMPTON: No, my Lord, I am sorry. I do not want to keep
coming back to this. Mr. Morris is not entitled to read
       out in court ----

MR. JUSTICE BELL: He has not read out yet.

MR. RAMPTON: He is asking him to look at it.

MR. JUSTICE BELL: He has been asked to look at all the
       documents. You have objected ----

MR. RAMPTON: He should ask his question first, he has asked to
look at a document which is not identified, and ask him if
       adheres to his answer.

MR. JUSTICE BELL: I cannot see any harm in just mentioning that
it is Mr. Clark's statement because he has it there with
him. The real vice comes, if it comes at all, if he is
asked to read it out and Mr. Morris has not got to that
       yet.

MR. RAMPTON: Mr. Morris is just about to do it.

MR. JUSTICE BELL: We do not know that, do we?

  MR. RAMPTON: He always does.

MR. MORRIS: You have his statement?
       A. I have three books open here.

  Q. It is the thin yellow 8.
       A. I have it.

  Q. Had you seen this statement before from Mr. Clark, the
Plaintiffs' expert witness? It is No. 10.
       A. Yes, I have.

  Q. You have seen that?
       A. Yes.

MR. JUSTICE BELL: Be punctilious in following the procedure.

MR. MORRIS: Of course. Were you involved in helping with the
preparation of the statement, with the interview or
       anything like that?
       A. No.

  Q. So you have seen it for the purposes of this case since it
       got done?
       A. I saw it in the reading for this case, yes.
