1 this statement on Friday. I think some of the ones he has
2 mentioned, he is not really placing any importance on it;
3 he is just mentioning them in passing. I know that the
4 ones he thought were particularly important he tried to
5 give us copies of and those ones we have served on the
6 Plaintiffs. The ones we have got we served on the
7 Plaintiffs. If it is possible to come back on Wednesday
8 rather than tomorrow then I will sort it out tomorrow.

10 MR. JUSTICE BELL: Certainly we should come back on Wednesday
11 rather than tomorrow.

13 MR. RAMPTON: May I leave it like this, that we will look at
14 Professor Crawford's statement in more detail than I
15 certainly certainly have had the opportunity of doing so
16 far. We will then communicate with the defendants telling
17 them which papers we think we should have before Professor
18 Crawford gives evidence, and leave it to them to do what
19 they can to lay hands on them. I observe in passing that
20 one of them looks to be illegible, but that may be one we
21 have already got. I believe that may be one we have got
22 somewhere else.

24 MR. JUSTICE BELL: You have got to provide a copy of any of the
25 references which the Plaintiffs wish to see. It does not
26 matter that it is written in whole or in part by the
27 witness. Indeed, it may be particularly important that
28 the plaintiffs have copies of that because it is the
29 witness's own work. So the Plaintiffs must have an
30 opportunity to look at this. Maybe it will appear to them
31 to be sensible work; maybe they will want to challenge it
32 in some way. So they must have copies of those if they
33 wish.

35 MS. STEEL: The point I was making in relation to the ones he
36 has written himself, if you look at page 6, the very last
37 paragraph, the first and second line, he has written five
38 papers that he has referred to on the same subject,
39 whether it was really necessary to have all five.

41 MR. JUSTICE BELL: I cannot second guess Mr. Rampton's judgment
42 on that. He says he will look at it overnight. Someone
43 will communicate with you in the morning. Make sure that
44 Mrs. Brinley-Codd and Mr. Hill know where you will be
45 available on the telephone tomorrow morning very early on
46 in the day. We must have copies of the references which
47 the Plaintiffs want when we come back to court which will
48 be on Wednesday. We will resume at 10.30 on Wednesday
