              food".  Mr. Horwitz, can I ask you this, since you are an
     2        American lawyer and American law is a question of fact in
              these courts?  For the purposes of construction,
     3        interpretation of a document, is it a rule of American law
              one must read things in their proper context?
     4        A.  That is correct.
 
     5   Q.   "More about your balanced diet and McDonald's good food.
              Before we talk about our good food let us see what the
     6        U.S.  Government has to say about balancing your diet.
 
     7        Seven keys to building a good diet.  The U.S. Department
              of Agriculture and Health and Human Services have issued
     8        dietary guidelines for Americans".  That has an asterisk
              on it; is there an asterisk at the bottom of that column -
     9         "For reprints of complete dietary guidelines for
              Americans" ---?
    10        A.  That is correct.
 
    11   Q.   "Contact the US Consumer Information Centre, Pueblo,
              Colorado"?
    12        A.  Yes.
 
    13   Q.   "These guidelines recommend:  Eat a variety of foods,
              maintain a desirable weight, avoid too much fat, saturated
    14        fat and cholesterol, eat foods with adequate starch and
              fibre; avoid too much sugar; avoid too much sodium; if you
    15        drink alcoholic beverages do so in moderation.
 
    16        Nutrition experts agree these seven steps are the most
              important things you can do for your diet to stay
    17        healthy.  Whether you eat at McDonald's or not, please
              observe them".

              Then there is a passage about variety.  Then in the middle
    19        column under the heading:  "How to get the most out of
              McDonald's: Now ... about our good food.  Let's say you
    20        order a Big Mac, regular french fries, and a medium diet
              Coke for lunch today. In order to balance your diet, here
    21        are the minimum additional servings recommended for the
              rest of your day:  Low fat dairy products two servings;
    22        fruits and vegetables four servings; protein one serving.
 
    23        This example will give you a good start.  But don't stop
              with today. You should think about your diet everyday in
    24        order to truly eat healthfully."  Then some more about
              balance, "Balance is best"; then this:  "How to find out
    25        even more about McDonald's nutrition.  Ask your McDonald's
              Restaurant Manager for this booklet, 'McDonald's Food, the 
    26        Facts'".  Is that the one we looked at earlier? 
              A.  Yes, it would be, that would be a later updated 
    27        version.
 
    28   Q.   Then there is a telephone number given, it says:  "We want
              you to know everything about our food.  And about good
    29        nutrition.  Because the smarter you are about food, the
              smarter you can eat.  It is as simple as that".
