Day 195 - 04 Dec 95 - Page 67

  Q. Do you remember was he both? Did he transfer from one to
the other while you were at the store?
       A. As far as I know he was a Floor Manager, but now
looking back I considered he was actually carrying out the
duties of Manager, proper Manager, because he was in charge
of shifts, he was running shifts. So he was actually --
what I am saying is that his job title was Floor Manager,
but, as far as we were concerned, he was the Manager on the
shift when he was running it.

  Q. He had authority of the shift?
       A. The authority, yes.

  Q. The Manager you referred to, I cannot remember his name
now, the one with the Italian sounding name?
       A. Daniel Rizzardini.

  Q. His position was what?
       A. He was a trainee Manager and then he became Second
       Assistant Manager.

  Q. How often did you speak to him about things?
       A. Quite frequently because he was the only Manager
I actually socialised with outside the work time.

  Q. What you say in your statement about the Manager, was there
anything contradicted by him when you would talk to him?
       A. No. I mean, if anything, I think he would tell you, he
would give you the picture I have depicted there. He would
give you a lot more than what is in my statement. I mean,
his whole attitude, I believe it took him a long time to
move from trainee management into a proper management
position because he was not, he was reluctant to comply
with certain aspects of his work which he regarded as
unfair, like sending people home because of their
appearance, sending people home because, you know, the
store does not seem to be as busy as they expected.

  Q. So when you give an impression of management, you say, for
example, on page 7, "Management would also cut the number
of scheduled works hours of anyone who refused to do the
extra hours on late shift," etc.
       A. Yes.

  Q. That collective impression, would that include
       conversations with Daniel Rizzardini?
       A. Yes.

  Q. That applies to any time you use the word "management",
       does it?
       A. Yes, it is collective authority I am referring to.
That is right. When I am generally talking about
management, as another aspect to it, I did want to say a
specifically this and that and that and that Manager did
it, because generally any Manager who was in charge would
       have done it.

  Q. The same thing?
       A. The same thing, so I refer to it as management.
