5 incident the cooking times were lengthened still further".
6 So, these were increased twice in a period of 18 months,
7 the cooking times. We want the documents related to the
8 increase of the cooking time, as for the reason, documents
9 that McDonald's have in their possession, power or control
10 related to the reason for increase in the cooking times.

14 MR. MORRIS: Obviously, any particular reference to health
15 concerns.

17 The next one is McKey's documents seen by Professor Jackson
18 and referred to, preferably from the day that he visited.

20 MR. JUSTICE BELL: When you say "from the day", you mean the
21 ones he saw on that day, do you?

23 MR. MORRIS: Yes, if possible, or nearest available day if they
24 have been destroyed. I would expect they would not have
25 been destroyed as they are relevant to litigation.
26 I cannot remember specifically -- if I am asked to, I can
27 identify any statement -- which particular documents but
28 I am sure the Plaintiffs will be aware of which documents
29 he saw. Professor Jackson himself had notes which he read
30 out in court. This is particularly at McKey's. I think he
31 specifically referred to summaries of documents showing
32 which experiments had been carried out that day in the
33 laboratory.

35 MR. JUSTICE BELL: Which microbiological tests, you mean?

37 MR. MORRIS: Yes. The testing, microbiological and E.coli
38 testing, which he said he had seen documents showing the
39 complete day's tests. Secondly, records from the testing
40 of finished products. That is partly covered by the first
41 one, but also Mr. Walker said that something like 13,000 --
42 he gave a specific figure -- burgers were rejected or
43 thrown away, or whatever. We would like the documentary
44 records which led to that figure in terms of in what
45 circumstances they were thrown away and why, and especially
46 relating to the testing of finished products. I presume
47 that would be the same thing.

49 MR. JUSTICE BELL: That was all the 13,000 referred to. It was
50 13,000 burgers destroyed because samples of them had been
51 taken for microbiological testing. That is what Mr. Walker
52 said.

55 actually said what that figure, whether they were ones that
56 solely had been tested on or whether they meant other ones
57 that may have been damaged, I do not know.
