     1        A.  Yes.

     3   Q.   So if someone visits a hospital and is not off work for
     4        more than three days, then it is not a notifiable accident?
     5        A.  Correct.

     7   Q.   Notifiable accidents are the RIDDOR -----

     9   MR. JUSTICE BELL:  It must go in the Accident Book, but so far
    10        as the instructions on that sheet are concerned, it does
    11        not have to go on an Incident Report Form?
    12        A.  I would -- I am not sure if this is written down
    13        anywhere, but it is my experience that if anyone does go to
    14        hospital with an accident from the store, an Incident
    15        Report Form would certainly be filled out.  That is
    16        somewhere when I talked about the difference between the
    17        cut finger and something being notifiable by law, the
    18        Incident Report Form would get filled in.

    20   MR. MORRIS:  Just to clarify, those notifiable accidents are the
    21        RIDDOR accidents, the statistics?  That is one and the same
    22        thing?
    23        A.  Yes.

    25   Q.   I will just go back over some other matters that were
    26        raised in the examination by Mr. Rampton.  Why do you make
    27        unannounced visits rather than announced visits sometimes?
    28        A.  Out of a matter of interest in the job that I do.  A
    29        new restaurant may open and it just happens that I have an
    30        interest to go to that particular restaurant, and I do not
    31        ring or tell anyone that I am going there.  I maybe
    32        accompanied by someone who works for me.  We go to the
    33        restaurant, maybe with some items on agenda, maybe some new
    34        way of running the trifle operation, may it is just a new
    35        style of restaurant, maybe it is just because it is on the
    36        way to somewhere else, that we would go along and visit the
    37        restaurant.

    39        Sometimes, as regards announced, it is not a proclamation
    40        that goes out.  It is just that I will arrange to meet
    41        someone who is associated with the restaurant, maybe the
    42        Area Manager or the Operations Manager, or meet him at the
    43        restaurant, or there maybe a specific issue I wish to
    44        discuss with the restaurant manager who may have had a new
    45        piece of equipment that he has been looking at over a
    46        couple of months and I just want to go and solicit his
    47        opinion about how it is going.  Occasionally it is
    48        announced and occasionally is not announced.

    50   Q.   But when you want to see people working in as natural a way 
    51        as possible without knowing that the boss is coming down, 
    52        do you make unannounced visits in those circumstances? 
    53        A.  I visit restaurants with my family and see the normal
    54        operation and I can make observations there.  I am still
    55        the same person going in.  I am not quite sure what it is
    56        you are driving at.

    58   MR. JUSTICE BELL:  I would assume, without the question being
    59        asked, if you want to get a true view of how the restaurant
    60        is run on any normal working day you go announced so ---
