Day 245 - 07 May 96 - Page 20

leaflet. That is correct; is it not?
       A. I do not believe that is true.

  Q. You do not believe that is true. What is that is in your
       statement there?
       A. When you say "entirely differently leaflet", I do not
believe that is true; I think it is almost identical.

  Q. It is almost identical?
       A. Possibly more serious.

  Q. Have you actually looked at that?
       A. I have.

  Q. Perhaps you would like to look at it again. I think it is
in Publication Bundle 2, pink 2.

MR. JUSTICE BELL: Pink 2, Mr. Riley by your head. Thank you.
       A. Where am I looking?

MS. STEEL: In tab 12A. You just have a look at that (Pause)
do they look anything like each other, Mr. Preston?
       A. There is a cartoon in there which is similar to
something inside talking about the slaughterhouse and junk
food. There are references in here to rainforest. There
are references in here to food being a 4 letter word,
       prefixed by the word "dog".

  Q. There may be similar criticisms, Mr. Preston, some of them
may be similar, but it is an entirely different leaflet, is
       it not, clearly?
       A. No. I dispute the "entirely" part. There are some
       differences but hardly "entirely".

  Q. I do not have an original copy of the fact sheet but this
is normally half the size, this is enlarged. That one is
two sides of A4. This one is 6 sides of A5. Only one
cartoon is the same. Criticism of while they might cover
the same issues, they are expressed totally differently and
they are far more expensive in the one that you are
actually suing over currently, are they not?
       A. Exactly my point, is it not? They are not entirely
different. In fact, I think in some regards as or more
       serious.

  Q. Apart from some of the issues being the same, the leaflet
is entirely different, is it not?
       A. No.

  Q. You can confirm that the letter written by McDonald's, or
on McDonald's behalf, to London Greenpeace was about this
leaflet which is not the subject of the current libel
       action?
       A. I wish my memory was that good, but I think you are
       probably right.

  Q. That is what your statement says and you have confirmed
that and you say that you talked to people before you wrote
       your statement?
       A. I did.
