Day 184 - 06 Nov 95 - Page 04

MS. STEEL: Yes, OK. In particular, in Sabina Iurilla's
statement on page 9, paragraph 25. I do not really know
how important the next one is, but on page 11, the last
       part of the -----

MR. JUSTICE BELL: Hold on. In paragraph 25, it is what he is
alleged to have said, is it?

MS. STEEL: Yes. He said that nobody had mentioned anything to
him. I mean, I do not really know what the position is
with a peering shot (sic), but it is also possible to axe
       that as well.

MR. JUSTICE BELL: I know. That is a question of what
       interpretation one draws from it.

MS. STEEL: The main point is that it is not evidence that he
did not know anything about it previously.

MR. JUSTICE BELL: What else then?

MS. STEEL: On page 11, the very last couple of lines of
paragraph 31 -- although I suspect it may well have been
some of the parents who were so concerned about the turn of
       events.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Then on page 15, the last sentence of paragraph 45
is really a repetition of what was said in paragraph 25.

  MR. JUSTICE BELL: Yes.

MS. STEEL: There are other points where it says he did not
intimidate anybody, but I think, you know, perhaps we can
just deal with that during cross-examination.

MR. RAMPTON: My Lord, the only one I agree about is the one on
page 11, which is not hearsay, but speculation.

MR. JUSTICE BELL: What about the others?

MR. RAMPTON: The witness is entitled to say that it was her
impression that a person has heard news for the first
time. In my submission, in any case, the function of those
parts is only to meet the suggestion by Sarah Ingliss --
which may also well be hearsay, for all I know -- that it
was somebody else who had earlier told Mr. Ballantyne about
Sarah Ingliss's union activity. I think it was a girl
       called Michelle Owen.

MR. JUSTICE BELL: I think that the line in page 9 paragraph 25
should come out, because it seems to me that is more
directed at suggesting that that was true than the fact it
       was said.

MR. RAMPTON: I am quite happy with that, my Lord.

MR. JUSTICE BELL: Let me just look. I do not see any objection
to 15, paragraph 45, because that clearly relates back to
