Day 008 - 07 Jul 94 - Page 41
1 statement made by three bodies such as this?
A. This is extremely unusual.
2
Q. Were you involved in any way in the preparation of this
3 document?
A. No.
4
Q. Were you consulted about it?
5 A. No.
6 Q. Were you told about it in advance?
A. No.
7
Q. It is dated April 12th 1988. When do you think you first
8 saw it?
A. Well, I just wanted to clarify something -- I started
9 working at Perseco in the summer of 1988.
10 Q. Right.
A. So that is an important distinction, so that is
11 obviously one reason I was not involved in that.
12 Q. My mistake.
A. But I also know that we had nothing to do with this.
13
Q. No. "Statement of Support for The Foodservice Packaging
14 Institute's Fully Halogenated Chloroflurocarbon" -- that
I call CFC, am I right about that?
15 A. Yes.
16 Q. -- "Voluntary Phaseout Programme". I read quite a lot of
it yesterday and I need not read it again today. I would
17 like you to look, if you will, at the second paragraph of
text: "The ozone depletion potential of HCFC-22 is far
18 smaller than that of CFC-11 and CFC-12." Was the CFC at
that time -- I think Mr. Kouchoukos told us this -- that
19 was used for McDonald's packaging No. 12?
A. Yes.
20
Q. "In view of the urgent need to achieve drastic reductions
21 in ozone depleting chemicals as soon as possible, the
near-term complete replacement on an accelerated timetable
22 of CFC-11 and CFC-12 with HCFC-22 in the manufacture of
disposable foodservice packaging represents significance
23 progress."
24 So far as you are concerned, Mr. Langert, at that time
(and please disallow the aid of hindsight) that
25 represented what you knew about HCFC-22?
A. Yes.
26
Q. Then if you turn over the page, you see that the three
27 environmental bodies "recognise the environmental benefits
of implementing the Food Packaging Industry programme in
28 the effort to protect the stratospheric ozone layer. We
support the actions to be taken by the individual
29 companies and their customers to eliminate use of the CFCs
in their products by substituting non-fully halogenated
30 blends, including HCFC-22, and to seek and adopt improved
blowing agents under this program."
