Day 167 - 02 Oct 95 - Page 52
in a store level and on a regional personnel investigation
level. An investigation was undertaken by Operations
Personnel in the area, the Area Supervisor and the
Operations Manager, and they replied through Jane Jarvis,
who was the Personnel Manager at the time.

MR. MORRIS: Sorry, if we can get that down, please.

MR. ATKINSON: My Lord, I have no further questions on that
particular document.

MR. JUSTICE BELL: The only question which occurs to me is in
respect of any of those what, if any, documentation there
might be and how easy or difficult it might be to get.

MR. ATKINSON: Do you want me to ask?

MR. JUSTICE BELL: I am sure it is going to crop up.

MR. ATKINSON: (To the witness) You heard what his Lordship has
said on that.

MR. JUSTICE BELL: Just look down the list.
A. If there was a problem where they complained to the
Area Personnel Department or Human Resources Department, as
it is now, they would have a record of that on file.

MR. ATKINSON: So the Human Resources Department would be ----

MR. JUSTICE BELL: I do not know whether that is going to be
realistic because people can have, if they do have
something they are concerned about, it is one thing to --
it may be one thing to have a bit of a beef in store; it
may be another entirely to go to the area of personnel or
human resources. I was less interested whether they
complained, but what sort of documents there might be which
might show -- you got John Gore mistreated by scheduling --
to what extent they might show it at all.

MR. ATKINSON: Are there likely to be any documents in the
store, for example?
A. There would be very few from that. The only document
that would really relate to that would, perhaps, be the
clock card reports. We do keep them.

MR. JUSTICE BELL: What do they consist of?
A. They consist of a sheet which tells you when you clock
in -- when each employee clocks in and out each day and it
will say how much they have been paid for that day, whether
they have had a break.

Q. How far back would they go?
A. Five, six, seven years.

MR. ATKINSON: My Lord, is it going to help you if I go through
the list of these people and just ask Mr. Richards what
sort of documents might be available on the particular
allegations?

MR. JUSTICE BELL: I think it might, but I cannot anticipate
