Day 138 - 20 Jun 95 - Page 42

  Q. Was that permitted?
       A. Absolutely, yes, it was.

  Q. What did the representative -- do you speak Spanish?
       A. No, I do not.

  Q. Then I will not ask you what they said.
       A. I was told what they said.

  Q. Did you understand that they invited the crew to join the
       union or strike rather?
       A. Yes, they extolled, if you will, the virtues of the
union, told the employees that they wanted to represent
them, and that they should cease working.

  Q. What, even though you do not speak Spanish, was the
response of the crew present in the restaurant at that
       invitation?
       A. All the employees shouted "No". They began to chant
that they did not want this union, that the union should
       leave, and leave them alone.

  Q. Did the union leave?
       A. No, they did not.

  Q. For how long did this state of siege go on for?
       A. It went on for three hours. We attempted to get the
       police.

  Q. I was going to ask you that. Did the police arrive or not?
       A. The police did not arrive. We finally were able to get
       the malitia to come out.

  Q. Is that like the National Guard?
       A. Yes.

  Q. Was there any actual violence?
       A. There were scuffles in the store.

  Q. Between whom?
       A. Between employees and the union people who had tried to
force their way in. What we were trying to do was there
were some customers who obviously had been trapped in this
thing and they wanted to get out and we tried to get them
out. That would happen from time to time. Some of these
people who had ringed the restaurant would try to force
their way in and there were fisticuffs.

  Q. You probably heard me tell his Lordship yesterday, but I
thought there was some film taken of this event?
       A. Yes, there was.

  Q. Were you present when it was taken?
       A. Yes, I was.

  Q. Have you looked at the film?
       A. Yes, I have.

  Q. So far as it goes, is it faithful record of what you
       observed?
