     2        of something like five per cent each week of McDonald's
     3        employees working over 39 hours or, in fact, it was over 78
     4        hours in a fortnight, so we are assuming it is something
     5        like five per cent or more, in a week.  Would that be
     6        roughly the same for Marble Arch or was the Marble Arch
     7        store different from other stores?
     8        A.  I could not really recall that.

    11        A.  I could not give you a definite answer from this length
    12        of time away on that.

    14   MR. JUSTICE BELL:  Can you put it another way then?  Would it
    15        surprise you if one in 20 of the Marble Arch payroll was
    16        working more than 78 hours in a fortnight?
    17        A.  Perhaps not at certain times.

    19   MR. MORRIS:  If one out of 20 of the payroll working over 39
    20        hours then, and if -- I know you were not clear about that
    21         -- the typical average of 20 full-timers for 80
    22        part-timers was the situation, then something like a
    23        quarter of all the full-timers would be working over 39
    24        hours each week?
    25        A.  Or a part-time person that is full-time when the summer
    26        season is there or Christmas is there.

    28   Q.   Right.  But, in general, people that worked over 39 hours
    29        would be full-timers?
    30        A.  Quite possibly.

    33        A.  Yes.

    35   Q.   Right.  You have got experience of quite a lot of stores,

    37        A.  Yes.

    39   Q.   So quite a lot of people that work over 35 hours --
    40        full-timers -- in your experience, work something like 37,
    41        38, 39 hours, would that be the bulk of what the
    42        full-timers would work?
    43        A.  Very possibly.

    45   Q.   You schedule your full-timers for how many hours?
    46        A.  Five shifts a week.

    49        A.  Seven or eight hour shifts.

    54   MR. RAMPTON:  My Lord, I am a bit puzzled by this.  I know my
    55        interventions do not often save time -- maybe this one will
    56        not either.  I would really like to know; we have had this
    57        range of questions of practically every McDonald's witness
    58        that has appeared in the witness box.  I really would like
    59        to know whether the Defendants say that there is something
    60        adverse to McDonald's in the fact that somebody might work
