Day 119 - 02 May 95 - Page 30

Officers. On their visits to the store they would examine
the clock cards of the store to ensure correct compliance
       with the regulations.

  Q. In this case they failed to ---
       A. Well, I do not know about this case.

  Q. -- (indecipherable) them. So who examines the time sheets,
       who would examine those?
       A. The Manager, the Supervisor, the Senior Supervisor --
he existed in those days -- the Office Manager and the
       Field Personnel Manager.

  Q. Just say, for example, because obviously a manager is not
going to put themselves in trouble by admitting that they
are scheduling people for illegal hours, how would the
Supervisor check or people above the level of Manager check
to see that everything was being done properly?
       A. He would read the clock cards.

  Q. So, is that part of the supervisor's ---
       A. Oh, yes.

  Q. -- regular, systematic job description, is it? Sorry, part
       of their ------
       A. It is part of his regular responsibilities.

  Q. What, the Supervisor would come into every store under
their responsibility and check every single under 18
year-old's time schedule to check there were no breaches,
       would they?
       A. His responsibility is to ensure they are not; how he
does that, how he meets that responsibility is a matter for
himself, but it is his responsibility to do it. Similarly,
       we would expect the Senior Supervisor to carry out checks;
similarly, we would expect the Office Manager to carry out
checks and, certainly, it would be on the list, on the
Field Service Personnel Officer's audit. Let me explain.
       I used to have -----

MR. JUSTICE BELL: Can I interrupt you there because I wonder if
we are not making rather heavy weather of this. If a young
woman who was known to the manager to be under 18 worked
after midnight on three successive days, he should realise
       that?
       A. Absolutely.

  Q. He should realise she should not be doing it?
       A. That is right.

  Q. He should not be allowing her to do it?
       A. That is right.

  Q. If two other young employees at the same branch over the
same period of about a week or just under were not allowed
an 11 hour break between shifts in a 24-hour period, the
       manager should realise that?
       A. Absolutely.

  Q. And not allow it to happen?
