Day 140 - 22 Jun 95 - Page 46
MR. JUSTICE BELL: If you go two more sheets, you will have it,
I think.
A. Yes, I have it.

MR. MORRIS: Sorry about that. If we note, in his article in
the third column, the middle column under the picture, he
says:

"In Philadelphia, for example, a sampling of 20 restaurants
showed an average starting wage of $4 per hour. A study of
20 suburbs and locations reveal an average of $5.10 an hour
to start according to the store managers."

Then he goes on about some other areas. That is the survey
by Glen Berkin which you referred to before?
A. Yes, exactly.

Q. You say that someone told you that he said he may withdraw
what he said?
A. The information that I had was that he was not as
certain about the information and indicated it was a random
survey. In fact, I notice a column here talking about
"random calls". The point was, I believe, that it was not
very valid methodology.

Q. But if he actually did speak to 20 restaurants in inner
city Philadelphia and 20 restaurants in suburban
locations -----
A. If I recall correctly what I was told, I was told
that -----

Q. Hang on, I am asking you a question.
A. I am sorry.

Q. If he did speak to 20 restaurants in inner city and he
spoke to 20 suburban locations and they did reveal an
average of a $1.10 different, would that worry you?
A. It would be of concern to me.

MR. JUSTICE BELL: There is something else you ought to put in
that article? Maybe you are going to do it.

MR. MORRIS: No.

MR. JUSTICE BELL: Do you see the bottom of the first column?

MR. MORRIS: "McDonald's officials conceded that there was a wage
disparity, but said it was more like 22 cents, not 87 cents
an hour."

MR. JUSTICE BELL: Then, in fact: "Company officials said the
gap had shrunk to about 11 cents per hour since the federal
minimum was raised earlier this year"; and the federal
minimum was in fact raised -----
A. In April.

Q. 1st April, 1990?
A. That is correct.

MR. MORRIS: So the -----
