Day 060 - 02 Dec 94 - Page 63
be made from virgin paper pulp, would she?
A. A fry bag?

Q. Yes, that is what it says here.
A. As I say, that is a draft and I do not know where she
got that information from or what got corrected in that
draft subsequently or where that document went even.

MR. MORRIS: I want to ask one question about paper in contact
with food. In your paragraph about napkins on page 9 --
well, at the bottom of page 8, you said: "There was a
doubt as to whether the legislation enabled us to use 100
per cent recycled paper. Legislation requires that no
recycled paper can be in contact with food because its use
has not been known." What was the doubt? Was the doubt
whether any recycled paper or whether a 100 per cent
recycled paper?
A. I think any paper that had a recycled content on its
surface.

Q. You said, "When that doubt was clarified we were able to
switch to 100 per cent recycled paper"?
A. Yes.

Q. Well, 100 per cent recycled would be recycled on its
surface, would it not?
A. Yes.

Q. So what was the doubt that was clarified and who clarified
it?
A. I think the doubt that was clarified is that napkin is
not regarded to be primary packaging for food.

Q. I might be wrong, but in this paragraph you seem to be
talking about the general issue of what this legislation is
with regard to recycled content in touch with food, is that
correct, or is it only relevant ----

MR. JUSTICE BELL: The way I read it: Legislation requires that
no recycled paper can be in contact with food.
A. Right.

Q. That obviously deals with bags and cartons which carry the
food?
A. Right.

Q. So any recycled part has to be the core, or certainly not
the surface which comes into contact with the food?
A. Correct.

Q. It was not quite as clear as that with napkins because the
food was not carried in napkins or not primarily so, but
before it was eaten it might come into contact with the
napkin?
A. Yes.

Q. So if the napkins were not made of 100 recycled content,
while that enquiry was in mind. A time came when it was
clear that the contact with food provision, whatever it
was, did not apply to napkins, so the green light could
