Day 187 - 13 Nov 95 - Page 21
MR. JUSTICE BELL: Yes.

MR. MORRIS: That is an improvement. Can I just say, it does
not matter, but I just say that this original translation
was not done for the court; it was done for us to explain
what Mr. Lamti was -----

MR. JUSTICE BELL: It does not concern me. What concerns me is
that there is not a difference which might be of some
significance.

MR. MORRIS: I understand. So, "The election for staff
representatives personnel delegates in 1993 and work
council...."

MR. JUSTICE BELL: "....in 1994."

MR. MORRIS: "....In 1994 was held in a climate of discrimination
against the CFDT on whose list I was heading. In effect,
there were numerous pressures and threats to not stand on
the list and not to vote for the list."

MR. JUSTICE BELL: It means he was at the head of it. So I am
going to put "against the CFDT whose list I headed".

MR. MORRIS: Yes.

MR. JUSTICE BELL: Yes.

MR. MORRIS: "Following evidence to the police by fifty employees
and numerous work inspections, a criminal proceeding was
undertaken to investigate 12 managers of the Lyon region of
McDonald's."

Can I ask him, was Mr. Antolinos investigated also in these
-- regarding these elections?
A. He said, in fact, 18 people were investigated at this
time, the 12 managers of the 12 McDonald's shops, and six
other people of them, Michel Antolinos and Gerard Touloux,
and the Supervisors -- of which 12 managers were held in
custody.

Q. Right. When he says "work inspections", do you mean from
the Department of Employment?
A. Works inspections -- the works inspectors come from the
Department of Employment. They are there to supervise the
various companies and to make sure that they are applying
the law.

Q. What was their -- did they make findings and demands?
A. The works inspectorate started six formal hearings for
anti-union discrimination, and they visited the workplace
and noted many irregularities in working conditions.

Q. Did they make any demands?
A. The works inspectorate, yes. These changes have since
been applied.

Q. We do have the documents disclosed, but if I can just
ask -----
