Day 193 - 28 Nov 95 - Page 16

statement, please, and the last paragraph: "As soon as Cam
found out about the union, he invited day staff into his
office one by one to 'chat'." Why do you put the word
       "chat" in inverted commas?
       A. Because during these meetings -- like, we had never
really had anything of the sort before. He usually does
not interview people one on one, but Cam cannot talk -- he
cannot ask people about the union. What I believe he was
trying to do was figure out exactly what was going on,
trying to figure out where he stands, you know, like,
       management and crew relations.

  Q. Again, that is just a suspicion on your part, is it not?
       A. Well, people that had been interviewed told me about
       it.

  Q. Did they? I want to ask you about the Labour Board
hearings. How many days did you actually go to the
       hearings?
       A. I am not sure exactly. I think it was maybe between
one and three, because the hearing was closed, so it meant
that I could not hear any of the testimony.

  Q. You were there on the first day, were you not?
       A. Yes.

  Q. Do you know that on that first day Cam's side suggested
that the way out of the difficulty would be to have a
       secret ballot?
       A. Yes.

  Q. Do you know also that the union rejected that ---
       A. Yes, I do.

  Q. -- approach?
       A. Because Cam had asked, you know, put forward maybe we
should have a secret ballot. But under Bill 40, because of
the number of cards we had signed, that had been signed, it
should have been an automatic certification. Like, I do
not know what the labour laws were exactly before Bill 40,
but I know tht they involved signing cards and a couple of
       votes here and there.

  Q. If a sufficient number of the signed cards were invalidated
by the Board after a hearing, the certification application
would have been dismissed, would it not?
       A. I believe so.

  Q. Yes -- because you would have come down below 55 per cent?
       A. That is true.

  Q. The union did finally agree to a secret ballot, did it not?
       A. Yes.

  Q. On 3rd February?
       A. I guess that was the date. I cannot remember.

  Q. After hearing more than 20 of the intervenors being
examined and cross-examined before the Board?
       A. Yes. They were subpoenaed by Cam's lawyer to come down
