Day 165 - 27 Sep 95 - Page 31

from looking at it. Certainly, it all appears to be in
translation. I am not at all sure that Mr. Contana speaks
       English.

MR. JUSTICE BELL: We will see.

MS. STEEL: There was just one thing that I was going to ask
before lunch which is whether there is a place for this to
go that has been set aside in the bundle?

MR. JUSTICE BELL: What I suggest you do, I am going to wait and
see if you come back on that. If you do not, in the
       meantime perhaps -----

MR. RAMPTON: Your Lordship has a sticky with a ------

MR. JUSTICE BELL: I have pink volume XI, section A, new
tab 10B. Are there any loose ends before we go on to
       scheduling?

MR. MORRIS: There were a couple of brief matters, but I would
like to do that after lunch.

MR. JUSTICE BELL: We will deal with those matters at 2 o'clock
and then go on to scheduling.

                      (Luncheon Adjournment)

MR. MORRIS: There is only actually one personal matter ---

  MR. JUSTICE BELL: Yes.

MR. MORRIS: -- which is, believe it or not, I have some kind of
condition in my arm, this right arm, and I am receiving
medical treatment for it -- I have details of that, if you
want to see it -- so that may affect my ability to write.
I have been ordered to have total rest in my arm but I will
write -- obviously I will keep writing -- but I will not be
       able to write extensive notes.

MR. JUSTICE BELL: I think the answer is if we reach a stage
where you feel at a significant disadvantage, tell me about
it and we will see what we can do.

MR. RAMPTON: My Lord, that leaves, I hope, a fairly short
discussion about scheduling. There is -- I hope your
Lordship has it; at any rate, it is contained in the
correspondence which took place during the vacation -- a
part schedule proposed by us which was attached to our
letter to the Defendants of I think it is sometime in
September. Yes, my Lord, it was attached to a letter of
ours of 13th September to deal with the witnesses for the
start of this term after the interlocutories. I do not
know whether if your Lordship has it?

MR. JUSTICE BELL: No, I remember the letter but I did not
actually have a copy of the schedule because I remember
noting that at the time. I did not send a message for it
because I thought the letter was really kicking off some
       discussion about it.
