Day 012 - 18 Jul 94 - Page 56

1 A. I think the intention was to set up a schedule of
runs, and the campaign continues scheduling.
     2
         Q. Yes. I know nothing of this, I do not know if his
3 Lordship does, does one when one is running a campaign
like this take a view for a certain period about how long
4 you think it might last, and then if it is a success or
whatever you adjust it or you continue it? Is that what
     5 happens?
              A. That certainly is one thing that is examined, but also
6 campaigns are run and notwithstanding how successful they
              are concluded at their termination.
     7
         Q. Because you booked the space?
8 A. That is correct. You have moved on to something else
and you do not want to submerse the public in too much of
     9 one thing.

10 Q. Where is the new material?

11 MR. JUSTICE BELL: All the dates on page 183 are 1987, are
              they?
    12 A. Yes, Sir.

13 MR. RAMPTON: My Lord, one can see that from page 181.

    14 MR. JUSTICE BELL: Yes.

15 MR. RAMPTON: Which is dated January 13th 1987: "Please find
attached our recommended quotation schedule for the second
    16 quarter".

17 MR. JUSTICE BELL: Is there any more documentation which helps
              on this issue?
    18
MR. RAMPTON: Yes, my Lord. There are two new sets of
19 documents which were inserted this morning at yellow
Volume V, tab 2. In your yellow one, V, you will find tab
20 2 your own statement which you made for these
proceedings. At the back of that tab 2 you should find
21 some documents, the first of which, I hope, is a letter
from you to Mr. Stephen Mandell?
    22 A. That is correct.

    23 Q. Dated 20th November 1987?
              A. I see it.
    24
         Q. Right?
    25 A. Yes, Sir.

26 Q. He is an assistant Attorney General apparently in the New
              York department of law?
27 A. He was the assistant Attorney General in charge of the
              consumer division.
    28
         Q. He calls himself an Assistant Attorney General, Department
29 of Law, Consumer Fraud in New York. Is that your
              signature at the bottom?
    30 A. Yes, it is.
