Day 171 - 11 Oct 95 - Page 34

MR. RAMPTON: The only issue there is how many people there were
available in the restaurant at the point when Mr. Logan
says he resigned. He says three; he said three some many
years some -- sorry, some year ago, one year ago -- to the
Department of Employment. If the clock card showed that in
fact there were whatever it was Mr. Richards said -- seven,
eight, 10 -- then, plainly, Mr. Logan is in some
       difficulty.

So any and all material which is available to establish the
truth of that particular issue is likely to prove of very
great importance in relation to Mr. Logan's credibility
       generally, amongst other things.

My Lord, yes, we will look also for the schedule for that
week. I do not know what day of the week 9th November was.

MR. JUSTICE BELL: We will adjourn in a minute or two, anyway.

MR. MORRIS: It will not take me long to come back.

MR. RAMPTON: My Lord, Mr. Morris does not have a right of
reply. Oh, yes he does. I am sorry.

MR. JUSTICE BELL: He does. He only came in to help out in the
       first place.

MR. RAMPTON: Yes, he does. Can I just deal quickly with the
other things. Maybe I cannot do them in five minutes.

MR. JUSTICE BELL: I think it is unrealistic, and I think we
will go on too long if we do not adjourn now.

The only matter I wanted to mention is to say that what
I have in mind at the moment is the various documents which
you have listed, in addition to May 1994, for either
August 1993 or August 1994; and it would be helpful before
I go away at the end of the argument if it were possible to
know -- I do not see why you should have both -- whether
there is difficulty in obtaining the one or the other and
to hear any argument as to whether one is preferable to the
       other for any reason.

MR. RAMPTON: Mrs. Brinley-Codd has telephoned the Bath
restaurant and is waiting for a response.

MR. JUSTICE BELL: There we are. We will resume at two o'clock.

                        (Luncheon adjournment)

MR. RAMPTON: My Lord, I bring news from Bath to London.
Your Lordship can have, if he should think it appropriate,
the three categories of documents, clock cards, adjustment
sheets -- four it is -- excessive hours reports, etcetera,
and weekly schedules either for August 1993 or for
August 1994, assuming your Lordship does not want both.
Both still exist. I do not know in how complete a form or
in what shape, I do not know, but both sets of documents do
still exist. If your Lordship was minded to have one or
