     2   MS. STEEL:  Can I just ask, does that mean that the Plaintiffs
     3        are not going to be calling a witness in relation to
     4        Heathrow?

     6   MR. RAMPTON:  Ms. Steel is quite right.  I had completely
     7        forgotten about Heathrow.  That will have to be fitted in
     8        somewhere too.  I am sorry about that.  I have Mr. Beach on
     9        my list and I forgot that he probably would be called..

    11   MR. JUSTICE BELL:  Is there any objection to Mr. Beach being
    12        called because I have not dealt with leave for him at the
    13        moment?

    15   MR. RAMPTON:  I am sorry, I should have said that.  I am a bit
    16        at sixes and sevens this morning.  I am sorry about that.
    17        I should have said that.  No, I would not reasonably object
    18        to Mr. Beach.  I can deal him and will do so.  Of course,
    19        I shall need leave for my witnesses just the same, but if
    20        your Lordship is going to give leave for Mr. Beech, then I
    21        would respectively submit it would only be on the
    22        basis -----

    24   MR. JUSTICE BELL:  I give leave to call Mr. Beach which I had
    25        already indicated I wished to give leave anyway.  I will
    26        merely indicate (and I would be surprised if the Defendants
    27        objected) that it would only seem right that you should
    28        call a witness, perhaps more, in response to Mr. Beach, but
    29        it is important that a statement of any such witness or
    30        witnesses be served fairly soon.  Should I give a direction
    31        that it be served by Friday, 8th January?

    33   MR. RAMPTON:  My Lord, that is a Monday.  That is my birthday so
    34        I know!

    36   MR. JUSTICE BELL:  Yes, the schools go back or most of them do
    37        on that date.

    39   MR. RAMPTON:  It is Friday, 5th, my Lord.  Besides Mr. Beach and
    40        the four Colchester witnesses from the Defendants and
    41        Mr. Logan for Bath, the only one I know to be outstanding
    42        is Miss Lamb.  As to the rest, if there are any of the
    43        rest, I am not knowing.

    45   MR. JUSTICE BELL:  There is Mr. Soriano?

    47   MR. RAMPTON:  Yes, there is Mr. Soriano, that is right.  He is
    48        down for the 29th, I think -- that week anyway.

    50   MR. JUSTICE BELL:  I do think it is important that we try to 
    51        pack the Colchester witnesses in at the beginning of next 
    52        term.  We have had a number of days in the last two or 
    53        three weeks when we have had early days because witnesses
    54        have only taken an hour or so.  I have been prepared to
    55        suffer that because I know there are problems, but with a
    56        break now of something like four weeks before we come back,
    57        even allowing for a proper break, it should be possible to
    58        organise witnesses so that they are packed in.
