3 Q. With a hangover?
4 A. Well, yes; some of them with a slight hangover, yes, in
5 which case they would not be performing their duties and
6 their responsibilities and their attitude may not be the
7 desired attitude for the rest of the crew to work with let
8 alone the management, and that may have been one of the
9 reasons why a crew member would have been sent home without
10 pay.

12 MS. STEEL: But this was specifically about answering back;
13 they would not necessarily have to be hung over or drunk or
14 whatever, would they?
15 A. No, not necessarily, but it depends on what the
16 incident of answering back was in relation to.

18 Q. You said that during the period that you were responsible
19 for West Ealing you do not recall any incidents of
20 employees failing to return to work after suspension apart
21 from those who had been dismissed. What you are referring
22 to there, if the crew had basically either been sent home
23 for answering back without any kind of formal disciplinary
24 procedure or had got fed up with repeated toilet duty, or
25 something like that, then you would not actually get to
26 hear about it anyway, would you, because there would not be
27 any kind of formal disciplinary procedure?
28 A. In relation to -- no, I probably would not if it was
29 just where they did not return to work, it would not
30 necessarily be something that would be brought to my
31 attention.

33 Q. Have you ever been told by a crew member that they have
34 joined a union?
35 A. No.

37 Q. Or that they were a member of a union?
38 A. I have known of crew members being members of unions,
39 but it was not a relevant issue really.

41 Q. It was not something they told you themselves?
42 A. Well, it was something that if you are having a
43 conversation with somebody, because McDonald's is quite a
44 social or we have social events where you meet people
45 outside the work environment and you have one on one
46 conversations with them and it is something that could have
47 just been mentioned in passing, but it was not an issue or
48 anything that I remember distinctly, anybody making a
49 specific point about.

51 Q. There were not active members?
52 A. I have no idea.

54 Q. You do not remember them organising other crew members in
55 the store?
56 A. Absolutely not.
