Day 242 - 29 Apr 96 - Page 26

  Q. -- a treeless desert?
       A. This is correct, and this is very likely to be --
problems of definition are very likely to explain the two
-- the apparent differences between the two maps, so what
is the definition of a forest?

  Q. You have told us that the white parts of the 1961 or the
1950 or the 1977 or the 1940 maps show areas that do not
contain stands of trees sufficiently large to qualify as
       forest?
       A. According to most definitions, yes.

MR. JUSTICE BELL: There must be something in the article which
explains what the map is meant to show. It refers to life
zones. It has a table number. Rather than asking a
witness what it means, why can we not just look at the
article and find what Mr. Tosi says it means?

MR. MORRIS: I am trying to find .....

MR. JUSTICE BELL: I mean, it may be an unrewarding search, but
it may give us the answer in one sentence.

MR. RAMPTON: It may do, my Lord. I am sure that can be found
       in due course.

MR. MORRIS: If I can just read out what it says on page 25?

MR. JUSTICE BELL: I had better have a photocopy in due course
and I will put it in.

MR. MORRIS: It says, this section -- sorry, it is not
absolutely clear. I will have a look see if I can find a
       suitable explanation.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: Finally this, you remember the diagrams, again
historical deforestation diagrams, in the form of maps
which you attached to your last statement?
       A. Yes, I do.

  Q. There are only three of those. They are much less like
maps and more like diagrams but they, broadly speaking,
also correspond with this Tosi map, do they not ---
       A. Yes.

  Q. -- and with the other five maps taken from Sader and Joyce?
       A. Well, if you -- I am trying to manipulate three maps
       here.

  Q. I know it is difficult, is it not?
       A. If you compare the map headed page 167 ---

  Q. Yes.
       A. -- and we were looking at the southern end of
Guanacaste -- I am sorry, I am afraid I am lost. Could you
       repeat your question?

MR. JUSTICE BELL: Can I make a suggestion? On this one I have
