Day 150 - 07 Jul 95 - Page 82

       easily be identified.

On that sort of basis, because you will have a bit of time
over the weekend where you can reflect on Mr. Stanton's
evidence having heard all his evidence-in-chief, how long
do you think you are going to need to complete your
       cross-examination?

MR. MORRIS: I think it will certainly take more than Monday.
He was originally scheduled for three days, so we lost that
yesterday because of the interlocutories. I cannot see it
going beyond Tuesday, but certainly I do not expect we will
be completed before -- I mean Mr. Davies could wait in the
wings, so to speak, on Tuesday but I think ----

MR. JUSTICE BELL: Where does he have to come from?

MR. ATKINSON: It is not a problem, apparently, I have been
told. He is in the wings ready to come.

MR. JUSTICE BELL: What I will say is there is no need, unless
you require it or he would like to be here in any event,
for Mr. Davies to be here on Monday, and sometime around
the break time on Monday afternoon if you have not finished
by then I will ask you the same sort of question.

  MR. MORRIS: This is Tuesday?

MR. JUSTICE BELL: Mr. Davies need not be here before Tuesday.
He need not come on Monday if you tell me you are going to
fill Monday with cross-examination of Mr. Stanton.

MR. MORRIS: Yes, that is we are saying.

MR. JUSTICE BELL: I am saying therefore Mr. Davies need not
attend at all on Monday. Around the time of our usual
mid-afternoon break on Monday I will ask you how much
longer you think you going to be in cross-examination and
then we will try to help as to when Mr. Davies should
       attend.

The final matter is I have to deal with an election
petition in another court at 9.30 on Monday, but I do not
suppose that it will take anywhere near like until like
10.30, so everyone should be ready to resume at 10.30.
I hope I will not be late.

(The court adjourned until Monday, 10th July 1995).
