Day 070 - 20 Dec 94 - Page 42
investigate what goes on there, you can do that. If it is
essential for you to state the name in court in order to
put it to a witness, you can do that.

It is not, in fact, a great sacrifice, or any sacrifice, so
far as the conduct of this issue is concerned.

MR. MORRIS: We are not averse to that, you know, to get things
moving, but I am not very keen on the principle that is
being raised here. Can we do it without prejudice to any
future applications of this kind?

MR. JUSTICE BELL: Yes. Do you want to say anything?

MS. STEEL: No.

MR. JUSTICE BELL: I am not going to ask you for a formal
undertaking. As far as I am concerned, for the fair
disposable of this action, you are entitled to that
information. I am not going to impose any conditions on
you or ask for any undertaking. Rightly or wrongly, I am
going to rely upon you just to use it for the purposes of
this action, and leave it at that.

MR. RAMPTON: My Lord, I should only add this -- although of
course, I accept that, and I am not going to argue that --
if it should continue to turn out that the information
supplied by us to the Defendants, for example, under a
ruling of your Lordship, is misused in the way that the
transcripts have been misused, then I am afraid to say that
the Defendants will have to find their own resources to buy
copies of the transcripts themselves, because we have been
extremely patient. I have mentioned it before. The supply
of what I might call distorted or misleading reports to the
media -- specialist media, not the mainstream media -- has
not stopped. One of its principal arenas is a thing called
"Internet".

MR. JUSTICE BELL: Mr. Rampton, I am going stop you there,
because you will take such course in the future as appeals
to you.

MR. RAMPTON: I would not do it without telling your Lordship.

MR. JUSTICE BELL: There are quite enough hurdles in this case
without jumping ones which may or may not appear in the
future. I am going to leave it there.

MR. MORRIS: The next item is the blanked out nutrition document
that we have now a new document -- well, the alleged full
document is now disclosed. Do you have a copy of the ones
that were disclosed today?

MR. JUSTICE BELL: Yes.

MR. MORRIS: The first one. You may wish to compare it to the
previous disclosed document.

MR. JUSTICE BELL: Can you give me the reference to that?
