Day 046 - 04 Nov 94 - Page 85

MR. JUSTICE BELL: In the light of this Mr. Rampton may be able
to avoid evidence which does in fact rely on research done
by others. The proposed programme is Mr. Miles on Monday.
You must be prepared to cross-examine him starting during
the morning. You may not have to start until 2 o'clock,
but you must be prepared to start cross-examining him
during the morning. If he is not finished on Monday, we
will go to Mr. Hawkes on Tuesday.

MR. MORRIS: I do not understand if Mr. Miles is starting on
       Monday morning ----

MR. JUSTICE BELL: He cannot come on Tuesday, so if you finish
cross-examining Mr. Miles on Monday well and good. If you
have not, we will go to Mr. Hawkes on Tuesday. We will
finish Mr. Hawkes. If we finish him on Tuesday or early on
Wednesday I will not ask you to call either Miss Dibb or
Miss Gallately. We will go over until Thursday when we
will finish Mr. Miles. If we finish Mr. Miles on Monday
and we finish Mr. Hawkes on Tuesday or Wednesday, we will
go straight on to Miss Dibb or Miss Gallatley, whichever
       you choose to call first.

MR. RAMPTON: My Lord, may I know which it is?

MR. MORRIS: The present, as we said, Miss Gallatley is prepared
to come on Wednesday and Sue Dibb was prepared to come on
       Thursday and Friday, but -----

MR. JUSTICE BELL: What we will hope to do is that we will be
ready to go on with Miss Gallatley on Wednesday. Then take
       Miss Dibb after that.

MR. MORRIS: That depends on whether Mr. Miles and Mr. Hawkes
can be finished on Monday and Tuesday.

MR. JUSTICE BELL: Yes, but I will not, unless the programme has
to be very dramatically altered, call upon you to call Miss
Dibb or Mr. Gallately until we have completed Mr. Hawkes
       and Mr. Miles.

MS. STEEL: Miss Dibb has problems, on the 15th onwards she may
be away. Hopefully it will be sorted out by then. Looking
at other paragraphs of Mr. Miles' statement, there are so
many things in there where he is referring to research and
we have not seen the papers. If he says anything along
those lines, then I do not see we should have to
cross-examine him until we have seen the papers.

MR. JUSTICE BELL: Maybe not. Let us wait to see if he does
rely upon any research or rather his own experience.

We will resume on Monday at 10.30.

(The court adjourned until the following day)
