Day 119 - 02 May 95 - Page 51
MR. JUSTICE BELL: 1989 is obviously ------

MR. RAMPTON: 1989 is an additional one, O, sexual harassment.

MR. JUSTICE BELL: Yes, which page is that?

MR. RAMPTON: 147, my Lord.

MR. JUSTICE BELL: In tab 3. There is a bit of social history
for us. Sexual harassment comes in by 1989?
A. Yes. I think it probably was a topic of conversation
at that time. We review this document every year.

MR. MORRIS: Just going to point F ----
A. In section 1?

Q. Yes, in section 1 because it is the same. I will check
that 1989 is exactly the same?
A. Yes.

Q. You said this did not only apply to someone contacting a
trade union, it applied also to any political or ---
A. Or anything.

Q. -- religious ----
A. I do not think you should read trade unions necessarily
into that. I think the main thing to read from that is
competition. "Any of our trade secrets at any time during
the continuation of your employment".

Q. Yes, but when you were asked in evidence-in-chief -----

MR. JUSTICE BELL: Is it not the first part, if you wish to make
a point on this, that you may want? I would have thought
trade secrets is pretty universal ---
A. Yes.

Q. -- and implicit, if not express, in a contract of
employment, but is it the other matters you want to -----

MR. MORRIS: Yes, information related to the Company's business
or affairs. (To the witness): That particular section, is
it your case it does not only apply to trade unions; it
applies to any outside body?
A. Yes, I would say so. I mean, it would depend upon what
the making of the statement was and how damaging it was.
But it is to anybody; it does not relate to trade unions,
not at all.

Q. It does not relate only to trade unions?
A. It does not relate to anybody in particular.

MR. RAMPTON: No, my Lord ------

MR. MORRIS: I am trying to listen to the witness. The witness
is giving his answer to the question. Can I hear the
answer?

MR. RAMPTON: My Lord, I am making an objection -----
