Day 052 - 21 Nov 94 - Page 44

MR. RAMPTON: Yes. There is no doubt a case which could be
made, if the evidence were there to make it, that there was
a sufficient number of people in this country and elsewhere
in the world eating so much McDonald's food that McDonald's
could be held responsible for a diet which was likely to be
adverse to the health of the people that consumed it; no
doubt at all, which is why the frequency figures are
relevant, as your Lordship rightly says. That is
       undoubtedly right.

My Lord, I remind your Lordship -- thanks to
Mrs. Brinley-Codd -- of this: Professor Crawford was
giving evidence, page 16 line 34 -- I do not know quite how
this bears on what I was just saying to your Lordship but
never mind -- this is while Professor Crawford was giving
evidence my Lord, page 16 line 34: Ms. Steel said this,
whether it is was question or statement, I am not at all
clear: "Going on to page 4, this is really dealing with
some of the evidence given by other witnesses, where those
witnesses have claimed there is no proof that diet is
linked to cancer". I intervened: "No, my Lord. They have
not said that. The witnesses have not said there is no
proof that diet is linked with cancer. The word 'link'
should be abandoned, perhaps, for the purpose of these
proceedings." Your Lordship: "Yes. Use the word
'cause'. There are all sorts of words we have
used,'association','link' and'cause'. One of the things,
if I may say so which-- I know the word'link' is in the
text;'medical fact' is in the text. It may be that Mr.
Rampton will argue that if you use the phrase 'medical
fact' that hardens up 'link' in some way. You also have
or, rather, we have on the leaflet one of the arches with
'McCancer' in. So he is going to argue", and your
Lordship is absolutely right, of course, "that, look as one
might at each specific word, sentence and phrase in the
text, 'McCancer' itself means that McDonald's food causes
cancer." That is on 5th October while Professor Crawford
is still giving evidence before Dr. Barnard gives evidence.
My Lord, there is quite a lot following that, but I need
not read it out. It goes on, certainly, through to page 18
       and beyond, I am told.

I have forgotten what it was your Lordship was asking me
       about. My Lord, yes.

MR. JUSTICE BELL: Then there is more on the following page.
I merely refer to that so that Ms. Steel and Mr. Morris can
look at page 17 as well. And the top of 18 because on
       page -----

MR. RAMPTON: Page 18 is an important passage from your Lordship
       at line 22.

MR. JUSTICE BELL: I know it is tiresome, but I think it might
help if you read pages 17 and 18 so that the Defendants can
       hear them now.

MR. RAMPTON: May I start at line 34 -- I will start
       from the -----
