Day 258 - 07 Jun 96 - Page 56

That was it, "We want to stop this". So you, personally,
       instructed private investigators?
       A. Yes.

  Q. He told you to stop it when, this fact sheet?
       A. Round about June.

  Q. Round about June?
       A. Yes.

  Q. You were the person who was going to take responsibility
       for stopping this fact sheet?
       A. I was the person -----

  Q. Was there any way you were going to stop it apart from
       litigation?
       A. Certainly. I would have thought that when this was
finished if -- one of the ways we could have done it was to
write to you and say, "Look, we now know who was
distributing; you are the people responsible; will you stop
distributing?" As it was, that was not the advice I was
       given by our solicitors.

  Q. The first thing that was written to London Greenpeace was
-- well, nothing was written to London Greenpeace. The
first thing that was written ---
       A. No, no, it was -----

  Q. -- were letters to five people saying, "You have a writ for
       defamation"?
       A. Quite right. As the observation went along, and the
evidence got stronger and stronger, it was decided that we
       would go for writ.

  Q. Right. As the evidence that London Greenpeace were
       involved in distribution?
       A. Yes, and the people -----

  Q. Which you knew, of course, was 100 per cent -----

MR. JUSTICE BELL: You must let him finish the answer and then
       ask your next question.

THE WITNESS: And we had identified the individuals responsible.

MR. MORRIS: Yes, but you knew London Greenpeace were producing
a fact sheet that you wanted stopped; it would not matter
if it was two individuals or seven individuals or 77
       individuals, but it -----

MR. JUSTICE BELL: We have had lots of evidence on this already.

MR. MORRIS: The point is that you took no action whatsoever of
any kind to stop the distribution of this fact sheet,
except for to prepare a legal case against named
       individuals?

MR. JUSTICE BELL: Now, put what conclusion I am to draw from
       that.
