Day 209 - 25 Jan 96 - Page 55

MR. JUSTICE BELL: To whom does one 147 apply?

MR. MORRIS: It is Mike ---
       A. Mike Stokes.

  Q. -- Stokes. To be honest, he had a pay -- I do not know.
I think we can just move on from that, just maybe if I can
come on to stores and store audits?
       A. Could I just point out something on the PRs, that in
McDonald's it was always very important for OCLs to be done
and they were supposed to be an indicator of your
performance and, you know, on a great deal of them there
are no OCLs done. It is only a couple done, you know, or
none, or it just says no OCLs or they are just blank, and
       that is for ------

  Q. Where does it record OCLs?
       A. On the PR you have one section "Observation check list
scores" and one section "Personal attributes", and
observation checklist scores, I think, makes up half the
mark. So your PR can be decided on one OCL done on
       you ---

  Q. Right.
       A. -- or no OCLs done on you, as is the case in some of
them, there is actually none at all or just, you know, or
one OCL which is not -- an OCL can take, a good OCL can
take 15 minutes, I suppose, 15, 20 minutes, after, like,
half an hour's observation or whatever, but should that
really determine your PR mark, if that is what they are
       used for?

They just were not -- things just were not taken
seriously. The crew members were very -- a lot of them,
I know it is only my personal opinion, but they were very
apathetic about PRs because they were always late. You
would look at the crew comments section which is supposed
to be filled in by the crew because it is part of an audit,
you know, that crew fill in the comments section, and very
few of them are ever filled in. I think, to me, it was
because, you know, they would have their PRs, they would
get two in a row and they think: "What is the point? They
are not taken seriously. I am not even going to reply to
it" and most of them were not replied to.

  Q. Some of them have things like "no comment" or "agree"?
       A. Yes, but you found one that said "good goals" and
I have not found another one yet.

MR. JUSTICE BELL: What might help me, Mr. Morris, is because,
you know, it is part of McDonald's case about when you are
looking at low pay that it can be misleading to look at
what the basic rate is at any given time because of the pay
increases in accordance with performance reviews. We have
had all sorts of to-ing and fro-ing about that and how long
people stayed so how many they have and what chance they
have to increase. What I suggest you do, if you have not
done it already by the time you come to make some comment
-- I am not going to make a note of this so it is up to
you to bear it in mind -- if you do a bit of an analysis of
