Day 112 - 31 Mar 95 - Page 36

  Q. They may might have been in over the weekend?
       A. The carcasses would have been there over the weekend,
so I would assume that you could safely say they were well
       below 7 at that stage.

  Q. Then as the week builds up?
       A. The carcass temperatures tend to go up.

  Q. In theory anyway, whatever I decide about what is happening
here in so far as it may be relevant at all to an issue
I have to decide at the end of the day, it would be
possible for things to build up and for carcasses to be
moved out of the chiller earlier rather than later?
       A. Yes.

  Q. If that did happen, then the temperature might not have got
down to 7 degrees centigrade. All that is, in theory at
       least, possible?
       A. Yes. We in particular recognised the problem at
Jarretts and we discussed at a meeting, like I said
earlier, with Stewart and Bob Jarrett where we tried to
find solutions to the problem of having to move the
carcasses out of the chillers early since there were new
carcasses coming in and we had to empty them.

MR. MORRIS: May I have a minute to check something?

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Just to clarify 29.4.94, that was your last day?
       A. Yes, as far as I can remember.

MR. RAMPTON: It was a Friday.

MR. MORRIS: That would have been after some considerable
complaints on the subject were made?
       A. Yes, by that time we had discussed it in several
       meetings.

  Q. Well, the first two days that we looked at Mr. Rampton
focused on was the 28th February and 28th March; they were
       both Mondays.

MR. RAMPTON: With respect, if Mr. Morris is going to give
evidence about dates he will find it is a futile exercise
because, for example, when one goes through the whole year
one finds a whole variety of days of the week.

MR. MORRIS: As far as the first ones before your complaints are
concerned, it is only Mondays. So can we draw any
       conclusions from -----

MR. JUSTICE BELL: Just tell me what the dates are, Mr. Morris?
The 28th March was a Monday, was it?

MR. MORRIS: Yes, and 28th February is a Monday.

MR. RAMPTON: My Lord, the 7th and 14th April which are two
other relevant dates were both Thursdays.
