Day 259 - 10 Jun 96 - Page 65
say, "Are you sure that is what happened?" On the other
hand, if you have any reason to suppose that there was not
a pile of sheets of paper with that image on the front
behind you, then you should put it to Mr. Howes.

MS. STEEL: (To the witness) You did not see those where the
elderly couple got their copy of the leaflet from; they
were just sitting with it when you first saw them?
A. That is right.

MS. STEEL: OK. I think we have dealt with it, because the
witness has said what he has seen and what he has not seen.

MR. JUSTICE BELL: Let me put it this way: if you challenge
that there was a pile of documents with that appearance
behind you in court on the third day of the trial, then you
should put it to Mr. Howes.

MS. STEEL: There were all sorts of documents behind us. Our
legal advisers were sitting behind us, and they may have
had a copy of the fact sheet on the top of their papers.

MR. JUSTICE BELL: I am merely suggesting that if you have
reason to believe that it was not there, you should put it.

MS. STEEL: (To the witness) You do not have any evidence, do
you, that the pile of papers which you saw, with a copy of
what you say was the fact sheet on top, was actually a pile
of fact sheets as opposed to a pile of paper with the
fact sheet on the top?
A. No, I have no concrete evidence, but I assumed, because
it was a very neat little pile, they were all the same
thickness of documents going down; it was not a random
selection of papers with one different document on the top.

Q. You are telling me that you could identify how many pages
were stapled together from right back there, about a pile
of papers on there?
A. I could tell that it was a pile of identical documents,
yes.

Q. I mean, I put it to you that is complete and utter rubbish?
A. No, it is not.

Q. You could not tell from that distance?
A. My impression was that they were the same documents.

Q. You assumed they were the same documents is basically what
it comes down to?
A. I assumed from what I saw that they were the same
documents, yes.

MR. JUSTICE BELL: Thank you. Any re-examination?

MR. RAMPTON: No, my Lord.

MR. JUSTICE BELL: Thank you, Mr. Howes.
