2 Q. When I first asked you how long the notes of rap sessions
3 were kept, you said you understand that they were kept
4 until the subsequent rap session. Why do you say that you
5 understand?
6 A. Because I asked Human Resources in Birmingham if they
7 would have any record of any rap sessions in relation to
8 the particular one conducted, which I remember conducting
9 in Colchester; and, basically, they said they would not
10 have it.

12 Q. So it was Human Resources in Birmingham that said to you
13 they have only got them from previous rap sessions?
14 A. Yes, yes.

16 Q. Sorry -----
17 A. Something along those lines, Ms. Steel.

19 Q. When you were Supervisor, you did not tell the Managers how
20 long to keep their rap session notes for?
21 A. I think on the Human Resources audit, which is I think
22 conducted annually, there needs to have been a rap session
23 conducted in the last six months -- I think that is the
24 right sort of period -- in which case I think at least the
25 last one which is within the last six months should be
26 within in the restaurant, complete with an action plan.

28 Q. What about the one that you took; what happened to the
29 notes that you made?
30 A. I would have kept a copy and given a copy to Ray and
31 discussed them with him. But as to what happened with the
32 notes, normally, when things like this take place, you copy
33 the notes to the Regional Office, and I would have also
34 kept a record of them for my own purposes on my files at
35 home. So, store, me, office, and then the office
36 disseminate that information to, I think, possibly to the
37 senior Supervisor. I am not sure.

39 Q. Did you check your records at home for the records of this
40 rap session?
41 A. I have discarded (and deliberately discarded) all my
42 information relating to the period when I was a
43 Supervisor. When I moved, several years ago in Suffolk,
44 I had extensive notes regarding all the restaurants and all
45 the Managers and all dimensions of their operation.

47 Q. Why did you discard them all?
48 A. Because they were cluttering up my filing cabinet;
49 I did not wish to pay a removal company to transport them,
50 when I could put them in the bin.

52 Q. So, were these all documents which there were other copies
53 of elsewhere?
54 A. There may have been for some of them, and for others
55 there would not have been. A lot of it would have just
56 been daily communication with the restaurant management and
57 notes that I left when I was in the store. I mean, for
58 instance, when I was in the store I was -- I mean, you have
59 to realise at this time I was actually a new Supervisor, so
60 I was very keen on establishing the right system, but
