Day 024 - 15 Sep 94 - Page 26

MR. JUSTICE BELL: What is it you have in mind?

MS. STEEL: It was about whether the booklets in New York came
out of the action over the Chicken McNuggetts adverts,
whether like how -----

MR. JUSTICE BELL: Can you recall what Mr. Horwitz said about
that?

MS. STEEL: I cannot actually.

MR. JUSTICE BELL: I cannot at the moment.

MR. MORRIS: I did read it this morning, but I have forgotten;
something along the lines that it may have been -----

MR. RAMPTON: My Lord, I think it very likely that Mr. Gardner
can say anything about the Chicken McNuggetts issue.

MR. JUSTICE BELL: Do you know anything about any Chicken
McNuggetts furore?
A. Yes, your Lordship.

Q. Of your own knowledge, or from what you were told by
someone else?
A. A little bit of both, your Lordship. I believe that
the information regarding Chicken McNuggetts had been made
available to me through the same consumer group that
brought it to the attention of the New York Attorney
General.

Q. But did you have any contact with McDonald's about Chicken
McNuggetts?
A. No, my Lord, I did not.

MS. STEEL: OK. I presume that means we cannot go into it?

MR. JUSTICE BELL: Just tell me what it is you want to put.
What is the evidence you would like to get Mr. Gardner to
give, if it is legitimate to do so?

MS. STEEL: Whether the agreement to produce brochures in
New York came out of the threatened action by the New York
Attorney General when they threatened to sue them over the
Chicken McNuggetts adverts for them being deceptive, and
whether the booklets came out of discussions arising from
that.

MR. JUSTICE BELL: Do you have any information about that
topic? Just answer "yes" or "no".
A. Yes.

Q. Where did the information come from? Was it something you
were told by someone else?
A. Yes, your Lordship. It was in conversations with
members of the New York Attorney General's office.

MR. JUSTICE BELL: That, I am afraid, is beyond the pail.
