3 Q. What I am saying is that you would know if someone was off
4 because, even if it happened on a Friday, they would be
5 back on the Monday, but, with McDonald's, if someone is
6 only doing 20 hours, they may not have been scheduled for
7 another week, so ---
8 A. I agree to the extent -----

10 Q. -- you do not know?
11 A. It is down to the Restaurant Manager to contact them.
12 Part of what we teach is the accident reporting as well,
13 and what we used to call the intermediate Operations
14 course. I believe the name has changed these days, but we
15 go through that accident reporting procedure with them, so
16 they know it is their responsibility to follow up.

18 Q. But in reality?
19 A. It happens.

21 Q. In reality, the Manager would have to be pretty dedicated
22 to phone up someone who has had an accident three days
23 later who was not scheduled or not scheduled for more than
24 another week, and say: "Are you still off work?" When
25 obviously they would still be off work because they were
26 not scheduled anyway. How do they decide whether they are
27 off work because they not scheduled, or -----
28 A. They asked them could they come into work today. That
29 is really the criteria. As I said to you, our stores are a
30 very close community. Certainly, as a Restaurant Manager,
31 if one of my crew were hurt, I would want to know how they
32 are getting on. I would ring them up and find out almost
33 every day how they were getting on.

35 Q. The reality is that, compared to a job that is based around
36 a guaranteed working week, a structured working week, the
37 same week every week, and one that is McDonald's system,
38 chosen system, it requires extra -- what is the word?

40 MR. JUSTICE BELL: You have to make a positive effort rather
41 than finding out willy-nilly?
42 A. Yes.

44 MR. MORRIS: I could not think of the word. So, it is quite
45 possible there that might be one of the areas of
46 non-reported RIDDOR accidents, which you calculated at 20
47 per cent of reported, maybe going up near 90, nearer 90
48 than 80 per cent in more recent years, so that would be one
49 of the areas that would be more difficult for managers to
50 ensure they reported?
51 A. As we just agreed if somebody only is working, say, one
52 shift a week, yes, it will require their effort to follow
53 it up, and I suppose there is a possibility they might not
54 do it. AsI said, we might not be perfect for accident
55 reporting, but we have an extremely good record. We
56 recognise the legal obligation to do that.
