Day 312 - 11 Dec 96 - Page 46

can I just say there are a couple of things I wanted to
raise about what Mr. Rampton had said in his closing
submissions which I consider to be incorrect.

  MR. JUSTICE BELL: Yes.

MS. STEEL: I do not know whether you have it in front of you
or not, this is on the publication bit.

MR. JUSTICE BELL: You want me to look at the -----

MS. STEEL: Yes, it may be easier.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Actually, while I have it on my mind before
I forget, in the animal section Mr. Rampton said something
about that Clare Druce and Alan Lomb said that they would
defer, or something, to Dr. Gregory. Now, I have not had
time to look it up, but that is not my recollection. As
far as I recall, they said that they would respect his
experience but that they disagreed with his
interpretation. So, just that if you were thinking about
attaching any significance to that part of Mr. Rampton's
submission, I would urge you to check what they actually
said on the subject of their view of Dr. Gregory.

MR. JUSTICE BELL: Yes. I bear that in mind. I have a
recollection of Mrs. Druce being asked by Mr. Rampton
whether she respected Mr. Gregory and she said, yes, she
did and then adds something, although she was a little
disappointed with some of the things he had said.

  MS. STEEL: Right.

MR. JUSTICE BELL: Or words to that effect. I have not looked
it up. That is just my recollection of the evidence as she
       gave it.

  MS. STEEL: OK.

MR. JUSTICE BELL: Anyway, I have to say, I formed a very
favourable impression of Dr. Gregory myself, but at the end
of the day I have to look at individual issues in relation
to that and see what I make of it all. But I have made a
       note of that comment, anyway.

MS. STEEL: Right. We are not trying to suggest that you
should not have a good opinion of him, whether -----

MR. JUSTICE BELL: I know, but that is not the end of the day.

MS. STEEL: But people do have different opinions on what is
       acceptable.

MR. JUSTICE BELL: Both you and Mr. Rampton have made points
about what you say the relevance or irrelevance of industry
       standards are.

MS. STEEL: Yes, right. OK. Moving back to publication. This
