7 MR. RAMPTON: My Lord, if Ms. Dibb could be moved, Mr. Oakley
8 could be finished on Friday. That would be very
9 convenient. The following week at the moment Mr. Gonzales
10 is booked. He is coming over from America. As I have
11 understood what your Lordship has been saying to the
12 Defendants, he would not start until the 14th which is the
13 Wednesday because your Lordship has promised them two clear
14 days, so that would have to be the Monday and the Tuesday
15 of that week. What I could then do is to postpone the two
16 Scottish academics who are down for -- yes, sorry, I see
17 crossed fingers.

19 MR. JUSTICE BELL: We can see the dates there; the last day of
20 term is Wednesday 21st.

22 MR. RAMPTON: Yes. What I am suggesting is that if we were able
23 to postpone Professor Jackson and Dr. Clark, we would have
24 three days, 19th, 20th and 21st, for Ms. Dibb to choose
25 from.

27 MR. JUSTICE BELL: I am going to break off now with this
28 suggestion: We will in any event start Mr. Van Erp
29 tomorrow morning. We will hope to finish Mr. Van Erp
30 before we come to Friday. If we finish comfortably before
31 then, well and good, but we will do our best to complete
32 his evidence within the bounds of Tuesday, Wednesday and
33 Thursday.

35 If Mr. Oakley would be kind enough (and I see he is doing
36 it now anyway) to let Mrs. Brinley-Codd know on which dates
37 between now and Wednesday, 21st December he could come back
38 for a whole day, I would be grateful. If you would get in
39 touch with Ms. Dibb and find out if, in fact, she were not
40 to be called on Friday, which days -- again a full day
41 ought to be allowed for -- between now and Wednesday,
42 21st December she would be available. Then we can renew
43 this discussion either tomorrow afternoon or on Wednesday.

45 MR. MORRIS: Can I make a practical suggestion, that we have at
46 the moment about three issues on the boil.

48 MR. JUSTICE BELL: Yes, I have that in mind. I have, when I am
49 ready to do so, to give judgment on the matters we heard
50 the other day, and you have got other procedural matters
51 which it seems to me ought to be decided before the end of
52 this term.

54 MR. MORRIS: Yes. All I am saying is also in terms of the
55 evidence, we also still have outstanding packaging,
56 nutrition and advertising. It may be more efficient for
57 everybody if we put back the whole subject of food
58 poisoning and make sure we finish off the subjects of
59 packaging, advertising, nutrition such as it is at the
60 moment with Mr. Oakley.
