Day 084 - 07 Feb 95 - Page 37

MR. MORRIS: Has his statement been taken as read?

MR. JUSTICE BELL: Yes, Mr. Wignall's -- he has averred the
accuracy of Mr. Wignall's statement with those limited
number of alterations.

MR. MORRIS: We would like a break.

MR. JUSTICE BELL: Shall I break off until 3 o'clock?

MR. MORRIS: Yes, please.

(Short Adjournment)

MS. STEEL: Before start the cross-examination I just wanted to
bring something up. I thought yesterday the Plaintiffs
said they would be serving the observation check lists
today, and as they are something that is relevant to this
issue I wondered what had happened to that. (Handed).

MR. JUSTICE BELL: Where should they go? Let us leave that.
I will put them down again and if I am told in due course
I will put them in the right place.

It is sensible to put them with the ones we looked at
before, is it not?

MR. RAMPTON: What Mrs. Brinley-Codd is suggesting if the
British accident statistics are 57-M, the American ones
would become 57-N and the observation check lists,
appropriately enough, 57-O in pink file 13.

MR. JUSTICE BELL: Where are the ones we looked at before?

MR. RAMPTON: There was one.

MR. JUSTICE BELL: Yes. Where was that, do you know?

MR. RAMPTON: No, I am afraid I do not.

MS. STEEL: There are the older versions which are in the
Defendants' documents in the employment bundle.

MR. RAMPTON: The old one, my Lord, the one we had before, went
behind Mr. Stumps' statement. Perhaps it should come out
of there and go to a new section of the pink employment
file.

MR. JUSTICE BELL: It is just if and when we are ever looking at
them it is obvious, it seems to me, they should be in the
same place.

MR. RAMPTON: My Lord, apparently that one that is behind
Mr. Stumps' statement is included in that new bundle
anyway, so it is a duplication.

MR. JUSTICE BELL: Is it sensible for me to write on the bottom
of the index on the front of this "40" and then I will put
"from behind Mr. Stump"?
