1 fries or whatever. In other words, they do not become
2 competent -- again I am trying to help about it -- they do
3 not become competent in everything all at once; they
4 acquire the knowledge and skills over time.

6 Q. But in order to get a pay rise what areas of competence
7 would you need to have achieved? I am sure we could go to
8 a document, if you could just summarise? You would have to
9 be able to not just do the fries, you would have to know
10 about lots of different things to do with the Company?
11 A. Right. It would depend on how long they had been there
12 because, broadly speaking, down the left side of the
13 document there are, if you like, the functional tasks, the
14 areas, which is where if they do not get the OCL, for
15 example, as we have talked about before, they will be
16 automatically graded at a high grade, and that is where
17 they will not be expected to have covered all the areas.
18 On the right-hand side are the other things, like turning
19 up for work, appearance and so on, which do not relate to a
20 specific area of competence and performance. Do you see
21 what I mean? They are general about being at work.

23 Q. I am sorry, I am trying to see -- I do not know where they
24 are but there are some standard forms.

26 MR. JUSTICE BELL: If you have a particular point you want to
27 make, why not put it anyway? Then, if you are unhappy with
28 the answer, we can look at the document if you think it
29 will help you in your cross-examination. But quite often,
30 as you have learned by now, you approach something
31 indirectly because you are suspicious about what the
32 witness may or may not answer if you put it directly. When
33 you have put it directly, the witness has actually agreed
34 with your suggestion.

36 MR. MORRIS: Would you agree that somebody that is working 40
37 hours a week at McDonald's is going to get a pay rise in a
38 shorter space of time because of their experience in
39 McDonald's than someone who is working 20 hours a week at
40 McDonald's, in general, not obviously in every particular
41 case?
42 A. No, I would not because -- I understand the point that
43 you are making, but again because the functional areas will
44 be marked differently for full-timers and part-timers, the
45 other areas would be marked based on, you know, the amount
46 of time the person was there in that frequency. So, if
47 they were good at it, even if they were not working as many
48 hours, if they were punctual when they were punctual, if
49 you see what I mean?

51 Q. Yes, but you have to pass the job ability areas to get a
52 pay rise?
53 A. Not in all of the areas and not at the same rate for
54 full-time versus part-time. For the precise detail of
55 that, you would have had to enquire about that of a
56 training person because I could not be sure I would be 100
57 per cent accurate that I am right in those distinctions
58 that I am making.
