2 MR. RAMPTON: Yes. There is no doubt a case which could be
3 made, if the evidence were there to make it, that there was
4 a sufficient number of people in this country and elsewhere
5 in the world eating so much McDonald's food that McDonald's
6 could be held responsible for a diet which was likely to be
7 adverse to the health of the people that consumed it; no
8 doubt at all, which is why the frequency figures are
9 relevant, as your Lordship rightly says. That is
10 undoubtedly right.

12 My Lord, I remind your Lordship -- thanks to
13 Mrs. Brinley-Codd -- of this: Professor Crawford was
14 giving evidence, page 16 line 34 -- I do not know quite how
15 this bears on what I was just saying to your Lordship but
16 never mind -- this is while Professor Crawford was giving
17 evidence my Lord, page 16 line 34: Ms. Steel said this,
18 whether it is was question or statement, I am not at all
19 clear: "Going on to page 4, this is really dealing with
20 some of the evidence given by other witnesses, where those
21 witnesses have claimed there is no proof that diet is
22 linked to cancer". I intervened: "No, my Lord. They have
23 not said that. The witnesses have not said there is no
24 proof that diet is linked with cancer. The word 'link'
25 should be abandoned, perhaps, for the purpose of these
26 proceedings." Your Lordship: "Yes. Use the word
27 'cause'. There are all sorts of words we have
28 used,'association','link' and'cause'. One of the things,
29 if I may say so which-- I know the word'link' is in the
30 text;'medical fact' is in the text. It may be that Mr.
31 Rampton will argue that if you use the phrase 'medical
32 fact' that hardens up 'link' in some way. You also have
33 or, rather, we have on the leaflet one of the arches with
34 'McCancer' in. So he is going to argue", and your
35 Lordship is absolutely right, of course, "that, look as one
36 might at each specific word, sentence and phrase in the
37 text, 'McCancer' itself means that McDonald's food causes
38 cancer." That is on 5th October while Professor Crawford
39 is still giving evidence before Dr. Barnard gives evidence.
40 My Lord, there is quite a lot following that, but I need
41 not read it out. It goes on, certainly, through to page 18
42 and beyond, I am told.
