Day 025 - 16 Sep 94 - Page 24

regular hamburger is relatively high, is it not?

MS. STEEL: I do not think Mr. Rampton read out the whole of
the sentence in the letter; I might be wrong.

MR. RAMPTON: I am going on to say -----

MS. STEEL: It does have to be put into context.

MR. RAMPTON: I am going on to saturated fat. Please be
       patient.

THE WITNESS: That was relative to other sandwiches served by
McDonald's, such as the McDLT, which has 101 milligrams of
cholesterol; the quarter pounder with cheese, which,
according to another advertisement of this packet, has 107
milligrams of cholesterol, and the Big Mac with 83
milligrams of cholesterol, not with respect to another
       food product.

  Q. One can see that from the table in the "Leaner"
       advertisement, can one not?
       A. I believe that is what I was looking at.

  Q. It gives the regular hamburger 29, the McDLT 101, quarter
pounder with cheese 107, and a Big Mac 83; it also gives
the sodium contents and the fat contents for each of those
       items.

One of your allegations was (and I understand still is)
that these advertisements were not simply misleading but
intended to deceive the consumer; is that right?
       A. Yes, sir.

  Q. Do you know actually what the saturated fat content of a
regular hamburger was at this time?
       A. At this point, no, sir.

  Q. Would you like to take the big pink bundle?
       A. Is that volume VI again?

  Q. Volume VI, yes, please. This is "McDonald's Food: The
Facts", which is the United States publication by
McDonald's in April 1987, so at about the same time as
these advertisements were appearing. It is the document
that was available in the restaurants at that time. I am
coming back to that in a minute. Can you turn to tab 19
       of this volume VI, please?
       A. Yes sir.

  Q. I am afraid I do not have anything but the internal
numberings. If you turn the volume sideways there are
some tables towards the back. Can you find page 40?
       A. Yes, sir.

MR. JUSTICE BELL: Which tab is this?

MR. RAMPTON: Tab 19 of volume VI. Do you have a table headed
       "Nutrition Information per serving, sandwiches"?
       A. Yes, sir.
