Day 311 - 06 Dec 96 - Page 50

MR. RAMPTON: They are also in the pink publication bundles.

MS. STEEL: Did you say it was in the pink publication
       bundles?

MR. RAMPTON: Yes -- pink publication numbers are pink 1A, 68,
65 and 86. I give them in that order, because that is
       their chronological orders.

MR. JUSTICE BELL: I think it is appendix 2, is it not?

MR. RAMPTON: Yes, my Lord, it is.

MS. STEEL: I cannot find the solicitors letter up there.

MR. JUSTICE BELL: Yes. I keep saying you can apply to reply on
the counterclaim, and I will say "yea" or "nay", but I am
obviously going to let you respond on questions relating to
the counterclaim. So if you want to say anything about
       this, you can do then.

  MS. STEEL: OK. Thank you.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: My Lord, the first document, though is not dated
in this document, is in fact October 1990. That we get
from pink 1A. Mrs. Brinley-Codd's has the date on the
top: 16.10.90. I think it was part of the 1990 demo
       outside the Headquarters.

MR. JUSTICE BELL: Is this 68 now? You said 68, 65 and 66.

MR. RAMPTON: If your Lordship is in pink 1A -----

MR. JUSTICE BELL: It is 16.10.90.

MR. RAMPTON: Yes, 16.10.90. This is the least important of
these documents, for two reasons: first, because at that
time there were five defendants, including of course these
two; but, also, it is not anything like as venomous in its
tone as the others. It does, however, in its first
paragraph, repeat -- at any rate in summary -- some of the
allegations in the leaflet complained of. But
your Lordship will notice the substance of the response, in
bold capitals with exclamation marks, at the bottom of the
       page.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: So, that is Defendants' response number 1. The
next document, my Lord, is the same month, and of 1990, and
that is pink 1A, 65. Mine also has at the top, 10.90, and
its heading is "McDonald's gets McNasty".

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: The important paragraph is, well, the first
important paragraph is the third paragraph: "So worried are
the McGarbage food producers that they have infiltrated the
