       1 Q.   Were they the practices that you have been taught by him
       2      originally?
       3      A.  Yes.  I mean, basically it would be the case that the
       4      things I had learnt I carried on doing and people I taught
       5      were taught the same practices right the way through.

       7 Q.   If we go to Steve Harney, I do not know, is he just
       8      behind?
       9      A.  Yes.

      11 Q.   In paragraph 3 he talks about watering down of products
      12      and docking crew hours, etc. etc. which are listed there.
      13      He says that none of the following malpractices which were
      14      alleged by you and Simon Gibney ever happened or were ever
      15      mentioned while Mark Davis was Store Manager.  Do you have
      16      any comment to make on that?
      17      A.  I find this actual statement very hard to accept as
      18      true as during my time at the store, both as a Trainee
      19      Manager and the Store Manager, Steve Harney was working
      20      very closely with me or just underneath me.  He would have
      21      been aware of all the things that he said did not go on
      22      taking place.  As a crew member, a training squad member,
      23      he worked on a lot of my shifts to actually assist me when
      24      I was training, and certainly worked excess hours, being
      25      clocked off, paid a bonus.  He would be a party to all the
      26      things that had gone on here.  I find it very hard to
      27      believe that he can actually write down and say they have
      28      not happened.

      30 Q.   The last point you mentioned that was in relation to
      31      paragraph G, was it?
      32      A.  Certainly that would have happened to him during his
      33      early stages with the Company.

      35 Q.   That he would have worked beyond the legal hours?
      36      A.  He actually worked shifts with me as a training squad
      37      or it would be a training squad at the time on the close
      38      where he would have actually, should have clocked off and
      39      he clocked off and stayed on and he would have been paid a
      40      bonus.

      42 Q.   He was under 18 at that time, was he?
      43      A.  At that time.  Because of the age when he joined the
      44      Company, he got to a stage where we needed to promote him
      45      but he was not of the age to be promoted at one stage.
      46      So, he was actually far in advance of what we could
      47      actually do for him at that time.

      49 Q.   This was while Mark Davis was Manager?
      50      A.  Yes, I was Assistant Manager.
