     1
         Q. Not you, no. I mean of the Health and Safety Department.
2 Mr. Turner would not be rushing around every time there
              was -----
     3 A. Mr.?

     4 Q. Sorry, Andrew Taylor.
              A. Andrew probably would not be involved in it, no.
     5
         Q. So if we go to the statement of Mr. Nicholson, it is the
     6 blue file.

7 MR. RAMPTON: I think it is volume 10 of the first section.

8 MR. MORRIS: It is 10A, XA, yellow XA?
              A. I have nothing yellow here. (Handed) OK.
     9
         Q. I believe he has made two statements; the first statement
    10 I can find at page 13, point 33. Mr. Nicholson's
              statement, yes?
    11 A. 13? Page 13, article 33? Yes.

12 Q. Yes. To save the court time do you want to have a quick
              read of that?
13 A. Sure. Yes, OK, I have read it.

14 Q. That has given you Mr. Nicholson's opinion about the whole
situation. There is a situation in East Ham where some
15 staff were considering joining a union, the Transport &
General Workers union, and Mr. Nicholson at that time -- I
16 do not know what year that was, is it 1985?
              A. It does not say here.
    17
         Q. Sorry.
    18
MR. JUSTICE BELL: If you look at 28 on page 11, it seems to
19 says in or about 1986 in East Ham.

20 MR. MORRIS: In or about 1986, yes. It says that Mr. Nicholson
was the head of personnel, was he? He was, as he stated.
21 So he was a top person in the company. Why was the head
of personnel going down to a store to tell people, purely
22 it says here, that of course they had a right to join a
              trade union?
23 A. Why would he do it?

24 Q. Why would the head person from the whole company?
              A. It is probably a question best addressed to him. I do
25 not know why he did it.

26 Q. Would you not think this was a gross waste of your
management personnel's time, to deal with such a trivial
    27 issue as that?
              A. That is a matter for Mr. Nicholson to administer his
28 department, his use of time resources as he sees fit.
I have no idea -- ask him.
    29
         Q. I am going to be asking him, but are you responsible for
30 your subordinate? He is one of your subordinates?
              A. Yes.
