Day 248 - 13 May 96 - Page 40

MR. JUSTICE BELL: I will not look at that now. Carry on with
       Mr. Preston.

MR. MORRIS: I wanted to give it in as soon as possible.
       (Handed).

MS. STEEL: Have you still got your statement there?
       A. I do.

  Q. If we look at your first statement -- I do not know whether
the witness averred his statement or not, actually.
I cannot remember. Does anyone know?

MR. RAMPTON: No, almost certainly he did not, my Lord, at that
       stage of the case.

MR. JUSTICE BELL: No. In the early days -- indeed, for several
months -- the witnesses on both sides were taken solemnly
in chief without reference to their statements, save in
respect of an occasional specific part of them. So, if you
want to bring in something, you had better do it.

  MS. STEEL: Right. OK.

MR. JUSTICE BELL: I do not think you would run into a technical
problem because the statements are signed by Mr. Preston
and dated, but if you want to underline something do so.

MS. STEEL: Right. OK. (To the witness): If you read
       paragraph 24 of your statement?
       A. Yes.

  Q. Is that true what is written there?
       A. Yes.

  Q. It is true. You stand by it?
       A. Yes.

  Q. OK. That is part of the reason that you rely on for your
justification for bringing this case. That is what it
says. That is an example of why you decided to bring this
       case?
       A. What I say there is true in 24, yes.

  Q. Can we show the video? I will not show the whole of it.

MR. JUSTICE BELL: Yes. Can you operate it?

  MS. STEEL: I will try.

MR. JUSTICE BELL: Do you mind coming and standing in the well
of the court, Mr. Preston, please, so you can get a good
view of it and if you are asked a question while you are
there, speak up so it is caught on the microphones,
       please.
       A. OK, sir.

                         (Video film shown)

MS. STEEL: I think it needs to be fast forwarded a bit,
