Day 310 - 04 Dec 96 - Page 19

the rationale was of having a basic minimum wage applicable
to workers of 21 or over only and not to the sort of ---

MR. RAMPTON: I do not know.

  MR. JUSTICE BELL: -- 16, 17, 18, 19 and 20 year-olds.

MR. RAMPTON: The government it was that disapplied it for
       people under 21.

MR. JUSTICE BELL: Yes. One can dream up all sorts of
rationales that it was to persuade employers to take on
school leavers and people like that. But I never did
actually have any evidence about it, did I?

MR. RAMPTON: The concession I make in relation to overtime is,
I hope, only a minor one. I make it in relation to the
system which operated until the Wages Act 1986 came into
force. But I do rely heavily on what McDonald's actually
did, if fairness be the approach -- actually did -- as
opposed to what they had to do, following the passage of
that Act. In other words, from June 1987 onwards.

MR. JUSTICE BELL: Yes. I remember you dealt with that.

MR. RAMPTON: It is all in here, yes.

MR. JUSTICE BELL: It may be in Mr. Atkinson's other bundle.
But you remember I did an exercise on Siamak Alimi's pay?

  MR. RAMPTON: Yes, I do.

MR. JUSTICE BELL: Is the antidote to that in your bundle?

MR. RAMPTON: Yes, it is. It is in the Colchester section of
       Volume 5.

MR. JUSTICE BELL: Could someone give me the reference, so that
I make sure I do not miss it in due course?

MR. RAMPTON: They have all been done and they have all been
done on what I conceive to be the correct basis. My Lord,
it is in the Colchester section, which is section 1 of
       Volume 5 at (c).

MR. MORRIS: I have numbered the pages -- I have probably
missed one or two out -- but I have got it as page 50 in
       that bundle.

  MR. JUSTICE BELL: Thank you.

MR. RAMPTON: It is behind tab C.

MR. MORRIS: In that tab, I mean.

MR. RAMPTON: At the front of the Alimi calculations is a
summary of the results and then each one of the
calculations for all the available fortnights is set out on
       a separate sheet.
