Day 206 - 22 Jan 96 - Page 46

her hours have been unfairly docked?
       A. No.

  Q. Did Mr. Logan ever mention this alleged incident with
       Mr. Richards to you?
       A. No, he did not.

  Q. Then the next, if you go back to the piece of green paper,
it is number 3, Mr. Henden: "For three years Michael Logan
was a shift running Manager two or three times a week, but
still hourly paid. No salaried Manager was on for most of
those shifts and he (that is Mr. Logan) very rarely was
able to take a break on such shifts, except for maybe 10 to
       15 minutes."

Do you have any comment on that?
       A. Without personally looking back at any of the clock
card reports at the present, I cannot actually say the
exact shifts he worked each day. But, invariably, there
would be an opening Manager in the morning and there would
be a swing shift Manager who would cover, say, a 12/8
       period or 11/7 period.

  Q. 11 at night to 7 in the morning?
       A. 11 in the morning to about 7 in the evening.

  Q. I see. What about the later shift?
       A. As I say, without actual reference to the schedules --
I mean, he may be shift running by himself on occasions.

  Q. When you say "on occasions", how frequently do you think
that that is likely to have been so?
       A. Maybe -- I would say perhaps one or maybe twice a week.

  Q. Then he says in number 4: "Freezer stickers were on
occasion put on out-of-date buns to be able to use them and
avoid the 'use by' deadline, especially in 1991, 1992."

What comment, if any, do you have on that allegation?
       A. That did not occur. If freezers stickers would be put
on buns when they were withdrawn from the freezer, then
they would be dated with a 48 hour shelf life from there.

  Q. What is a freezer sticker?
       A. Basically, you can actually put either pre-printed
computer stickers on to them or, if you have not got those
available, you have a date gun which you can dial in the
date and the time, with the "use by" date, and then put
those on to the individual trays of buns. So, basically,
it is like, maybe, as they use a price gun in a
       supermarket.

  Q. Have you ever -- and I think this is what the allegation
means; perhaps you will be able to correct me if I am wrong
-- the allegation appears to be that a bun which had gone
past its useful shelf life had a freezer sticker put on it
to make it appear as though it had just come out of the
freezer. Is that how you understand the allegation?
       A. That is correct.
