2 MR. MORRIS: I understand that. I said only those agree. 18
3 per cent positively disagree with that and 12 per cent were
4 not sure. So, 18 per cent is a pretty substantial
5 percentage of McDonald's employees nationally not getting a
6 performance review in the last four months, indeed, it
7 might have been five months, six months, seven months or
8 eight month for all we know, but at least four months they
9 did not get a performance review, so would that concern
10 you?
11 A. Yes, because the performance review system is
12 important. Before I go on to answer properly, can I
13 just clarify that four months is the frequency now, that is
14 the recommended frequency, so that is the period of time in
15 which it is due so it is only beyond that time that it is
16 over-due.

18 Q. Exactly. It may have been over-due for months for all we
19 know, but we only know that it was at least over-due ---

22 Q. -- at least had not happened in the last four months?
23 A. Right, but four months is the period of time during
24 which it should take place, so it is only beyond that.

26 Q. We can argue about that, but it is obvious to me that it is
27 at least four months that it had not happened, they had not
28 received a performance review in the last four months. So,
29 it was a basically, if we can rely on this, which you have
30 claimed you can ---
31 A. Yes.

33 Q. -- then that would indicate that at least 18 per cent were
34 not getting the possibility of a pay rise which is a
35 Company policy, that they should get that
36 performance -----
37 A. Yes, I understand that point. I was merely trying to
38 clear up what I thought was a technical sort of difference
39 that we have. Perhaps you have understood.

41 MR. JUSTICE BELL: Is your point that it might be not very much
42 over four months or this gives us no ---

45 Q. -- it does not say how much over or is there another point
46 you have in mind?
47 A. No, that was the point. It was only because in the
48 documents we looked at earlier, the frequency then was
49 every two months of the performance review. This is four
50 months. I thought there had been a misunderstanding in
51 that area, but perhaps not.

53 So, to answer the point then about the four months: In the
54 same way, the reason why we conduct this survey is in order
55 to find out whether the policies that we have are operating
56 and then where they are not. That is where we find that
57 they are not happening, in those restaurants which got a
58 lower response which would be the representation of what we
59 see here in summary. That is where those Area Operations
60 people would then go and look at the details of that and
