Day 142 - 26 Jun 95 - Page 55

with legislative matters where Congress is considering
something or McDonald's wants to be involved with it, that
would be handled by the Government Affairs Department.
I was not someone who engaged in, if you will, the
       political arena.

  Q. That was not your area?
       A. No, it was not.

  Q. But were you aware of those kinds of submissions and what
have you being made to the Congress?
       A. McDonald's was not, to my knowledge, making any
submissions with regard to the Fair Labour Standards Act at
       that time.

  Q. I just want to clarify something because you said that ----

MR. JUSTICE BELL: Can I just check I understand that? Was the
Fair Labour Standards Act legislation which was going
       through Congress?
       A. No, my Lord. The Fair Labour Standards Act, as I am
going to call it, is the umbrella act that has existed for
many, many years and there would be periodically amendments
to that law being passed on a regular basis.

  Q. The amendment which related to what has been called a
"subminimum wage", was one such amendment, was it?
       A. That was an amendment, yes, my Lord. I do not know
when that was though, my Lord.

  Q. What you are saying is that you had nothing to do with any
submissions or anything to do with any amendment to the
Fair Labour Standards Act; is that what you are saying?
       A. That is correct, my Lord. That is absolutely correct.

MR. MORRIS: That would have been Cliff Raber, the Manager of
Government Relations, up to 1979, yes?
       A. I believe that Cliff was a Vice President and that
would have been Cliff's area, yes. My Lord, can I clarify
       something?

  MR. JUSTICE BELL: Yes.
       A. If there was a submission that would be his area. I am
not saying that he did submit anything. I am not aware of
       it.

  Q. You are saying it would have been his patch rather than
       yours?
       A. That is correct, my Lord.

MR. MORRIS: How many times have you visited Australia,
       approximately?
       A. The last time I was in Australia was the mid-70s.

  Q. The mid-70s?
       A. Yes. You are asking me how many times I was there?
I would say on two or three occasions.

  Q. Do you know about a recent, well, let us say sometime
around 1993, case in the State of Victoria where ----
