Day 199 - 11 Dec 95 - Page 26

MR. JUSTICE BELL: If you could give a copy to Mr. Glenn because
I read it in The Times but I did not keep a copy.

MR. RAMPTON: For that reason we put No. 3 on this possible
agenda, having regard to the terms of the leaflet.

MR. JUSTICE BELL: That is the wood processing and pulp
       processing.

MR. RAMPTON: Yes, possible detrimental effects. One is really
asking in the light of that judgment from the Court of
Appeal, is it a proper and sensible use of the court's time
to investigate that issue at all, given that it is never
likely to be decisive of anything in the case. That is,
put shortly, the question I raise.

MR. JUSTICE BELL: I think we should deal with that on Friday,
if we have time. So I will put Friday against that. What
you are being asked to do simply at this stage -- do I have
       a statement from Miss Link?

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: Can you give me the references?

MR. RAMPTON: Bateman, my Lord, is yellow IV tab 11, Anne Link
is Defendants 1B section C tab 5. Your Lordship will
remember that Miss Link was a replacement.

MR. JUSTICE BELL: Yes, I remember. What you should be prepared
to do on Friday is argue what you say the relevance of any
evidence which Miss Link can give to this leaflet, what is
said in the leaflet, and whether it is defamatory of
McDonald's and whether, if it is, you can justify it. The
first step is really to look and see what you say is in the
leaflet which brings Miss Link's evidence in, but in very
       generally and completely unlegal terminology.

MR. RAMPTON: My Lord, the only other thing which is not on this
list which Mrs. Brinley-Codd has reminded me, I do not know
whether it is a question of discussion or just the
Defendants to give your Lordship a date, it is the question
of Mr. Richard North's further statement about hormone
pesticides and residues. There is some reference to that
in the leaflet and it is only a question ----

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: I have put it as 6.

MR. JUSTICE BELL: I have put it as 7. 6 is Mr. Fairgrieve's
document, 7 is Dr. North's further report -- or is it
       Mr. North?

MR. RAMPTON: I think it is Mr. North.

MR. MORRIS: I believe he has become a doctor; I am not sure.

MR. JUSTICE BELL: What other matters -- have you got any more?
