Day 187 - 13 Nov 95 - Page 50

day, or the best part of a day, you really ought to be able
to put it to some very real use.

MS. STEEL: I do put it to use, but the fact remains that
I still have not even read all of the employment documents
that are relevant in the case. So when we get time off, I
am still in the process of reading those. We have just
been given a whole load more. There is plenty to do, and I
am just being totally honest in saying that I have not had
the opportunity yet to start any kind of preparation for
       the closing speech.

MR. JUSTICE BELL: The other thing I would say is, remember what
I have said more than once before, and I have said it to
you in your own interests - there has to be a real division
of labour between you and Mr. Morris when it comes to final
submissions and in preparing for them. It is not to say
that you do not put your heads together; either one of you
has made a list of points you want to make, or even before
that is done. You approach it in your own way. But when
it comes to preparing your final speeches, there is no need
for both of you to do exactly the same work. I am not
saying this because I am making any ruling. I am just
trying to encourage you to think about it.

Let us leave that there for the moment. You shall have
your four days at the end of term ---

  MS. STEEL: Thank you.

MR. JUSTICE BELL: -- for your own personal reasons and just
       generally as extra time anyway.

  MS. STEEL: Thank you.

MR. JUSTICE BELL: So, we will not sit for four days of that
       last week.

MR. MORRIS: Can I say, Mr. Sutcliffe is confirmed for the 1st
December, if you have the schedule. He has been put by the
       Plaintiffs on their schedule -----

MR. JUSTICE BELL: Yes, I got your letter; thank you

MR. MORRIS: I have not scheduled him for Friday the 8th. Well,
I certainly have not scheduled him for Wednesday, 22nd, as
the Plaintiffs have done, because we have two witnesses
from Ireland; I do not really know -- I originally thought
they might take three days. I have not scheduled him for
       Friday, 8th.

MR. RAMPTON: My Lord, it would be unwise to do so.

MR. MORRIS: I thought it might be.

MR. RAMPTON: I fully expect that Mr. Coton may go on into that
       day.

MR. MORRIS: I do not know when we are going to know about when
you are going to be scheduled elsewhere.
