Day 158 - 19 Jul 95 - Page 61
things to Mrs. Antenni on the basis of those transcripts
without notice to me, then I shall certainly want to see
it.

MR. JUSTICE BELL: How long is it thought Mrs. Farrer will take,
how long in-chief?

MR. RAMPTON: About half an hour, 40 minutes.

MR. JUSTICE BELL: How long do you think you will be
cross-examining Mrs. Farrer? I am thinking about the time
table for the rest of the week. May I say what I have in
mind at the moment is that we continue with the remainder
of the argument on amendment numbers 1 and 2, that we deal
with timings and any other matters left over from my
ruling, that we will not hear Mrs. Farrer before 2 o'clock
tomorrow afternoon. If that means there is some gap
between the argument and 1.00 p.m. that will not concern me
because it will give me time perhaps to finish my ruling on
the matters we argued about yesterday and the first thing
this morning, so I can deliver that maybe. But suppose you
call Mrs. Farrer at about 2 o'clock tomorrow afternoon, how
long would she take to finish? You would finish her
in-chief halfway through the afternoon.

MR. RAMPTON: My Lord, I would be finished before 3.00.

MR. JUSTICE BELL: We would have our five-night break. How long
do you think you would be with Mrs. Farrer?

MR. MORRIS: I think she will go over to Friday.

MR. JUSTICE BELL: Just do your best and tell me how long you
think she will go into Friday. Do you think she will take
the whole of Friday morning?

MR. MORRIS: I think it depends on what she says. We really
cannot give any kind of estimate on how long she will
take. It depends what she says.

MR. RAMPTON: What she will say, my Lord, is in her statement.

MR. JUSTICE BELL: Who was the other witness you had there? Was
it Mrs. Hall?

MR. RAMPTON: I have dropped her, because I do not think we can
fit her in. It depends how long the Defendants are with,
first, Mrs. Farrer, although I find it totally
inconceivable that they could not finish her on Thursday.
There it is. I suppose I have to get used to that. Then
how long on Friday they need, because every time a witness
goes longer than I would expect, the rest get shunted. If
Mrs. Antenni starts on Friday -- which I am certain she
ought to; she is a franchisee, and she has put it aside, as
well as Monday -- she certainly ought to finish on Monday.
If she does not, then I would not call any more evidence
this term. But I would like, if it were up to me, to use
all or some of Tuesday for the Defendants' outstanding
interlocutory applications, in particular, the application
which they say they want to make in relation to nutrition.
