Day 060 - 02 Dec 94 - Page 56
A. Because I have known it to be greater than that at that
time.

Q. How do you know that?
A. I think at that time we were looking at pretty close to
50 per cent.

Q. Where do you know that from, though?
A. Well, it would be on the supplier file and it could be
checked.

Q. OK. I have finished with that for the moment.

MR. JUSTICE BELL: I see at the bottom -- you need not dig it
out again -- it says at the bottom of 676: "The foam
packaging can be recycled into items such as plastic trays,
or filling for duvets and coat hangers"?
A. It can be, yes.

MS. STEEL: Do you know who that presentation was to?
A. No, I have never seen that before.

MR. MORRIS: What is a "Panel Presentation" -- is that an
internal -----
A. I have no idea what they are referring to. The only
panel presentations we have in McDonald's are when we are
interviewing franchisees. This certainly would not have
been put in front of a prospective franchisee.

MS. STEEL: You are asserting, you are continuing to assert,
that since 1991 the carry-out bags have been made from 100
per cent recycled paper?
A. Yes.

Q. Right?
A. Yes.

Q. I have not got a copy of this document. It is a McDonald's
own document. It is a new Fact Book. If I could just hand
it to the witness and ask him to confirm something that is
written there? I am quite happy for Mr. Rampton to see it.

MR. JUSTICE BELL: No. What do you want to ask about it? Can
you date what date the Fact Book is?

MS. STEEL: I think this is the second Fact Book he was
referring to yesterday that comes after the one we were
looking at a minute ago.

MR. JUSTICE BELL: What is the bit you want from it?

MS. STEEL: It says: "Recycled material usage in 1993,
carry-out bags, the recycled content was 80 per cent".

MR. JUSTICE BELL: Why not hand that up to Mr. Oakley?
(Handed). What is the date again?

THE WITNESS: I do not actually see a date.

MS. STEEL: I do not know whether it is dated. I think it was
