Day 159 - 20 Jul 95 - Page 44
all.

Q. But in the light of that, are you willing to do withdraw
your comment regarding the union matter at least that
Mr. Magee was lying?

MR. JUSTICE BELL: No.

MR. RAMPTON: My Lord, that is wholly unfair.

MR. JUSTICE BELL: It just is not the way I took it down at
all. Mrs. Farrer was asked if she had read the statement
and what she did. She made her comment about lies or a
liar. She was then asked, which I did not necessarily
relate to those questions and answers at all, whether she
remembered anything of Mr. Magee running a campaign to join
a union and she said she did not. You have asked that she
was a five-star person. She will excuse me saying so, she
was already by that time rather older than Mr. Magee. I do
not find it at all difficult to believe that whoever he
canvassed he did not get round to Mrs. Farrer. I do not
necessarily see any conflict there. I said you should ask
about it; perhaps I should modify that. You can ask about
it if you want.

MR. RAMPTON: My Lord, it is also right to say that Mr. Magee's
allegation is quite different. His allegation is that
Mr. Giardina or somebody else broke into his locker and
took the leaflets out.

MR. JUSTICE BELL: Yes. Mrs. Farrer can be specifically asked
about that, but I have absolutely no reason to suppose that
Mrs. Farrer will know anything about that either.

MS. STEEL: I think the point is that Mrs. Farrer should not
have said that Mr. Magee was a liar. She should have said
"I did not recognise any of those things happening while
I was there.

MR. JUSTICE BELL: You can challenge her on that if you
liability or you can just let it pass and there we are.

MS. STEEL: You are not in a position ----

MR. JUSTICE BELL: Just listen for a moment. If you want to
challenge her on that it is entirely up to you, you do not
have to do it at all, the first thing you have to ask her
is in what respects she says Mr. Magee was lying and take
it from there. But you do not have to ask that.

MS. STEEL: As far as the union matter goes, you are not in a
position to say whether Mr. Magee was lying; you can just
say you are not aware of anything he said?
A. I was not calling him a liar on that. I was calling
him a liar on other matter of his statement.

MR. MORRIS: Well, the union allegation was the only one that
was put, so that is the only one we are concerned with.

MR. JUSTICE BELL: See if you can carry on for about another 10
