Day 099 - 08 Mar 95 - Page 31
are passable, 500 are not; is that right?
A. That is correct yes.

Q. Or not satisfactory.
A. Yes.

Q. Mr. David Walker told us that if any of his samples showed
a presence, despite this guideline, of E.coli the batch
would be rejected?
A. Specifically 0157, yes.

Q. I mean 0157.
A. Yes.

Q. Do you know, roughly speaking, how many coli forms there
are?
A. Strains of E.coli, I would say, in excess of 2,000.

Q. Is the test which is nowadays done, is it specific for
0157?
A. Yes, it is at McKey's.

Q. If it be right that Mr. Walker rejects anything or refuses
to allow out anything with 0157 in it, is that his own idea
or has McDonald's had an input into that?
A. There would have been a discussion between the two
parties.

Q. Not one in which you were concerned personally?
A. Not one that I was involved with, no.

Q. He also told us (and this has not been dispute, perhaps
because it could not be) that in the last four or five
years when he has been testing for E.coli 0157, McKey's
have found it once and one of their suppliers found it once
in all that time. Do those figures surprise you?
A. No, not at all.

Q. Dr. Gomez Gonzalez told us that over about the same period
they had found it 10 times in America where, of course, the
volume is much greater?
A. Sure.

Q. Before we leave McKey, I am taking this slightly out of
order because I want to go to chicken -----

MR. JUSTICE BELL: Mr. Rampton, I would like to ask one thing.
The Minced Beef Directive, have you actually read that
yourself?
A. I have read sections of it, yes.

Q. Is it very long?
A. Yes, it is reasonably long, yes.

Q. Do you recall the section which ----
A. I do not specifically recall this section. This is a
McKey document quoting the guidelines.

MR. RAMPTON: Would you think you would have once somewhere in
the office?
