Day 266 - 20 Jun 96 - Page 58

MS. STEEL: Excuse me!

MR. RAMPTON: Yes, the application comes first. If leave is
granted, then the Appeal subsequently.

MR. MORRIS: Well, I never knew that Mr. Rampton. Thank you
very much.

MS. STEEL: If I might add we got the hearing brought on
speedily, despite Mr. Rampton writing a letter asking for
it to be put back until after our witnesses.

MR. JUSTICE BELL: So it is for that one day, is it?

MS. STEEL: Yes it is, but that does mean -- I do not know how
long Professor Crawford is going to take but bearing in
mind the Appeal, if it is going to take place, it will be
on Thursday. We would obviously prefer not to call any of
our publication witnesses before that time. I have mean,
it may well be an academic question anyway.

MR. JUSTICE BELL: I think it probably is, is it not? Yes. Do
you have anything to say as far as scheduling?

MR. RAMPTON: Yes, I do. Rather a lot, I am afraid. I will say
it now if your Lordship wants me to?

MR. MORRIS: Shall I?

MR. RAMPTON: Was your Lordship addressing the defendants?

MR. JUSTICE BELL: Did you have anything more to say or should
I hear what Mr. Rampton has to say about it?

MS. STEEL: You could hear what Mr. Rampton has to say about it.

MR. RAMPTON: Very gracious. The problem is I foresee and I do
not say necessarily; there may be several problems. The
first is that I have not yet seen Professor Crawford's
report. It is no good giving to it me now. I am not going
to look at it now.

MR. MORRIS: OK.

MR. RAMPTON: If it is detailed and imaginative in the way that
his last report was and if I should require help with it, I
do not know that I will be able to get that help before
next Tuesday. I hope I will be. I am going to be in Court
all tomorrow as we all are because we have got Mr. Olive
and Mr. Clare coming back. I see a distinct possibility
that Mr. Clare will not finish tomorrow given the pace of
things, which means we will be in Court again on Monday.
If I do not have time to prepare for Professor Crawford and
I will not know that until I have read for his report, it
may be I should have to ask your Lordship not to hear him
on Tuesday.

The second thing I would like to say is this. The
defendants have got Lord Vesty subpoenaed for Thursday.
