Day 079 - 27 Jan 95 - Page 70

basically, we did not feel that that part about the number
of tests that were carried out, I do not know, the fact
that it suddenly came up and what-have-you sounded very
truthful, the way it was put.

  MR. JUSTICE BELL: Yes.

MS. STEEL: I do not know whether it might be better to -----

MR. JUSTICE BELL: Is there anything else you can conveniently
       deal with now?

MR. RAMPTON: My Lord, there is something I want to deal with,
yes, but only when the Defendants are finished.

MR. JUSTICE BELL: What topics have you to deal with on Monday
morning? Thank you very much, Mr. Walker. Will you leave
       the witness box?

MS. STEEL: It is mainly about animals really.

MR. RAMPTON: I hope the Defendants do not forget -- I realise
that they must cross-examine on animals; I am, as usual,
not overwhelmed at the speed with which we have proceeded
in the last two days -- I just ask them to remember that
I have two people coming down from Scotland on Sunday to
give evidence in this case. The more time spent in court
the less time they have to prepare for Mr. Atherton, I
think it is, the following day. My Lord, there is another
       matter which makes it -----

MR. JUSTICE BELL: Are you asking for a marking so far as the
next witness is concerned, or is he coming down first thing
       or on Sunday night?

MR. RAMPTON: They are coming but they are only at the end of a
telephone in Glasgow. I have no doubt that if we are told
that there is no sensible prospect of their beginning their
evidence on Monday, I will put them back, if I can. There
is no point their coming down just to sit in court.

MR. JUSTICE BELL: I was thinking more about mid-day. I
mean, they may choose to come down on Sunday night anyway
       but -----

MR. RAMPTON: They will probably come down Monday anyway so as
to be ready for Tuesday morning.

MR. JUSTICE BELL: But if they might well start on Monday but
not before 2 o'clock, for all I know they might choose to
       fly down.

MR. RAMPTON: That is what they are going to do anyway, they are
       going to fly down.

MR. JUSTICE BELL: They might choose to fly down on Monday
morning rather than on Sunday night if they have a choice.

MR. RAMPTON: Yes, that is what I would like to know so that
       I can arrange it.
