     2        misrepresents both the nature of the argument about
     3        nutrition and disease and, more particularly, does it
     4        misrepresent what I said in the Court of Appeal; does it
     5        not?
     6        A.  I don't think so.  I mean, it is referring to the
     7        passage in the fact sheet and that is the passage in the
     8        fact sheet which -- that section of the fact sheet is a
     9        passage which you referred to as being the kiss of death
    10        for, you know, if it was proved.

    12   Q.   Can I ask you to look again at those short paragraphs in
    13        The Guardian article, which were certainly accepted on our
    14        side and, I think, by his Lordship some time ago but that
    15        does not matter for this purpose, as being an accurate?

    19        A.  With all respect to Mr. Justice Bell, he was not
    20        actually at the hearing.

    23        say about what I have accepted yet because he had not got
    24        to the end of his question.

    30        here, accurately reported by Mr. James Erlichman, was that
    31        the allegation which would be the kiss of death if it were
    32        thought to be true, so far as McDonald's is concerned, is
    33        that their food was apt to cause cancer?
    34        A.  I do not, I mean, I do not say there is anything
    35        incorrect in what is in there.  But it is quite obvious
    36        that Mr. Erlichman has condensed what you said that
    37        morning.  And you said a great deal more than that.  You
    38        were talking about that section of the leaflet and you said
    39        it would be the kiss of death for a fast food company if
    40        that section of the leaflet was proved.
