Day 252 - 20 May 96 - Page 63

because entitlement is not necessarily followed by actually
doing because then I will hear what the defendants have to
say because if I agree with you rather than wait for you to
re-examination, I want to give them the opportunity to
canvas it in cross-examination before they complete their
cross-examination. Otherwise, I will be asked by Ms. Steel
and Mr. Morris whether in the light of that
cross-examination we would like to ask this and with a new
witness coming in at this stage, I am not inclined to stop
them. So I would like to know just what it is which you
consider the cross-examination has entitled you to ask.

MR. RAMPTON: I have given your Lordship one example.

MR. JUSTICE BELL: I would like you to give me the rest in the
       morning.

MR. RAMPTON: There will be others I am sure.

MR. JUSTICE BELL: Then I will decide it and Ms. Steel and
Mr. Morris can decide what further they want to ask about
before they complete their cross-examination. What I want
to avoid, if possible, is you asking matters in
re-examination Ms. Steel and Mr. Morris saying: "We do not
think that is raised." I ruling, "Perhaps, yes well I think
you have let it in. So you come back to cross-examination
after your re-examination, and in you re-examine again. I
would like the cross-examination to be completed before you
re-examine and then you re-examine your own witness. There
we are. It is a question of first of all, entitlement and
secondly, what you wish to do.
