Day 074 - 16 Jan 95 - Page 45
aware, but what they wanted was, they wanted after
10 o'clock the environment/index.html">litter patrol to be done; they were not
worried about before 10 o'clock.

Q. She says that you called the Secretary of the Smith Street
Residents Association and said that "McDonald's would
increase the frequency of the environment/index.html">litter patrol which makes
rounds from 10 a.m. to closing"?
A. Right, that might have been misunderstanding on her
part about the way she has stated, but I understand what
she meant, that what they wanted was to make sure that
after 10 o'clock, because they did not think there was any
environment/index.html">litter before 10 o'clock.

Q. In the morning?
A. And in the openings times perhaps they were not even
aware that we open at 7 o'clock for the breakfast. They
must have thought that we opened at 10 o'clock maybe for
the menu or something.

Q. Do you still have your statement there?

MR. JUSTICE BELL: Tab 6.

MS. STEEL: In paragraph (7) -- do you just want to read that
to yourself for a moment?
A. "Mr. McIntyre is correct in saying that the Council
refused our application" -----

MR. JUSTICE BELL: Just read it to yourself so you remind
yourself of what it says.

THE WITNESS: I have read it.

MS. STEEL: What are the environment/index.html">litter problems that you are referring
to in that paragraph?
A. It is just a normal percentage, as I suggested, could
have been around 45 per cent of take-away, depending on the
weather and the conditions. Now, what happened was because
it was all take-away, 100 per cent of it was take-away
only, because we did not have a licence, so it was amount
of environment/index.html">litter -----

MR. JUSTICE BELL: We understand that. The question is you
refer to "such environment/index.html">litter problems as we had" and you are
asked: What environment/index.html">litter problems did you have.
A. This I am referring to, basically, is it the same
between 11.00 and 12 o'clock, because what I am suggesting
here is because as the volume increased after the opening,
so basically our problem got worse and worse because more
of the people were aware -----

Q. You are being asked what the problem was before it got
worse, do you understand? Were you conscious of there
being a environment/index.html">litter problem before you were refused your late
night cafe licence?
A. Yes, we were aware.

Q. What did it amount to?
A. Basically, for myself it was that between 11.00 and
