Day 118 - 01 May 95 - Page 62

  Q. Is your position, as a company, that if you find
illegalities being committed, they should be reported to
       the appropriate authorities?
       A. Absolutely, yes.

MR. JUSTICE BELL: What do you mean by that, because it
surprises me; it is contrary to just about every principle
of the English common law I have ever been aware of.
       A. I am sorry.

  Q. You certainly do not report to the authorities that you
       have done something illegal?
       A. Oh, I see -- no.

  Q. You may report to ---
       A. To us.

  Q. -- higher up the chain ---
       A. That is right.

  Q. -- to try to make sure it does not happen again.
       A. Yes, that is what I meant.

MR. JUSTICE BELL: Is that what you meant, Mr. Morris?

MR. MORRIS: I actually meant the first thing.

MR. JUSTICE BELL: I am surprised.

MR. MORRIS: But Mr. Nicholson seems to think that was something
       they would do ----
       A. No, I would expect that any illegality is brought to
our attention and if it was it would be put right, but I do
not know what the author of this means by "any
       illegalities".

MR. MORRIS: If we turn to page 1806 -----

MR. JUSTICE BELL: I know you are still on the same subject, but
let us have the five-minute break now.

                      (Short Adjournment)

MR. MORRIS: 1806, the third item down, is Mr. Williams got a
verbal warning, 7th November 1988, for infringement of
illegalities. Can I ask you, do you know what percentage
of managers, or approximately what percentage of managers,
or how many managers, a year would go through disciplinary
       hearings?
       A. No, I do not.

  Q. Is that monitored?
       A. It may well be monitored within the Operational region.

  Q. What about the existence of illegalities ---
       A. I do not know what that means.

  Q. -- in stores, are they monitored? Do you compile
       statistics on that?
