Day 088 - 13 Feb 95 - Page 83

might finish Dr. Pattison by Friday evening.

MR. JUSTICE BELL: How long do you think you will be in-chief?

MR. RAMPTON: About the same as I was today, I should think,
perhaps a little less, perhaps a little longer, I do not
know, but certainly not the whole day by any means.

MR. JUSTICE BELL: So if I put half a day or so?

MR. RAMPTON: Half a day, my Lord, to be fair. If I go over a
little bit over as I did today or a little bit -----

MR. JUSTICE BELL: I have said half day or so.

MR. RAMPTON: That leaves two-and-a-half days in the hands of
Dr. Pattison. Really, the question is what happens next
because I have asked Mr. Bowes to find out on a provisional
basis whether he is available, or would be available, the
following week, 20th, because with any luck he could be
finished in a day or less, perhaps -- one is always
       optimistic.

MR. JUSTICE BELL: Let me just make some enquiry. Doing the
best you can at this stage, how much longer do you think
you will need cross-examining Mr. Bowes?

MS. STEEL: I think probably a day but I am not really sure.

MR. JUSTICE BELL: What about Dr. Pattison -- I say Dr. -- he is
       Mr. Mark Pattison.

MR. RAMPTON: No, my Lord, he has a doctorate, yes, not in
       medicine but in veterinary science.

MS. STEEL: I am not really sure, to be honest.

MR. JUSTICE BELL: Of course you are not sure, you cannot be
sure. You have not even started to cross-examine him but
just give me some kind of picture, if you can.

MS. STEEL: I do not know. It is possible he might go over but
       I do not know.

MR. JUSTICE BELL: Mr. Morris, have you made some enquiry as to
whether you could get cover at home on the Monday? On
Tuesday, as I have said, I have to go to a conference and I
am not contemplating coming back into court on this case on
the Wednesday, Thursday or Friday. The question is whether
we really should use the Monday either to finish
Mr. Pattison, if he is not finished by the Friday, and to
go back to Mr. Bowes if Mr. Bowes was available so that
       those witnesses are dealt with.

MR. MORRIS: Yes, Monday would be OK.

MR. JUSTICE BELL: I will not ask you to give up more than that,
but I think it would be sensible if we can sit on Monday.
Do we know Mr. Bowes' position on Monday?
