2 Q. So things like performance reviews, they would be discarded
3 immediately?
4 A. I cannot say every case they would be discarded
5 immediately because it may well be that they would not
6 dispose of files straightaway. They would not deal with
7 it, but they would not be retained necessarily for very
8 long.

10 Q. There is not like a set period you keep them in case they
11 come back in four months time and you want to know whether
12 they were a good worker?
13 A. No, there is not a set period like that.

15 Q. What about the other documents then, generally, how long
16 are they kept for?
17 A. Those would generally be kept for really anything from
18 five to seven years.

20 Q. At either the store or at some regional office or
21 something?
22 A. No, it would be perhaps in another restaurant or
23 somewhere like that that we would try to retain them,
24 although there are times when space is a problem and so
25 that is why they have to find different places.

27 Q. The crew training programme says that clock cards should be
28 kept for five years. Do you keep the individual clock
29 cards with the person's file or are they all stored
30 separately?
31 A. Obviously, this is something that used to happen. It
32 has not happened for some years now, but they were kept in
33 a batch, not with the person's file, but they would be kept
34 in a batch of whatever week they related to.

36 Q. In the store?
37 A. Again it would vary, it depends on the storage space.

39 Q. Or at another store if there was a bigger store nearby or
40 something?
41 A. Something like that, yes. That is the sort of thing
42 that happens.

44 Q. The records that you keep for the crew, are they all also
45 kept for people you decide not to take on after the three
46 week probationary period?
47 A. If they had been employed, yes. If they were an
48 employee they would be kept because they would have been an
49 employee so they would be retained. It would be a
50 different system for people who were never hired at all.

52 MR. JUSTICE BELL: If you did get even your probationary job,
53 they would not keep any records.

56 A. Yes.

58 Q. OK. The clock cards were replaced with a computerised
59 system, yes?
