Day 118 - 01 May 95 - Page 81

  Q. "Workers in catering do badly in terms of pay and
       conditions"?
       A. I do not believe they do.

  Q. You do not believe they do?
       A. No.

MR. JUSTICE BELL: What you are being asked is whether you made
any enquiry about any other other industry before you felt
able to reach that point of view?
       A. No I did not my Lord.

MS. STEEL: We will leave it it there.

MR. RAMPTON: There are some things I would wish to raise at
       your Lordship's bidding.

Your Lordship asked me to give as accurate a prediction as
we could for the Jarret evidence. We very much hope that
we will be able to serve it not later than 2nd June.
I hope it will not be later than that.

MR. JUSTICE BELL: That is far too long. It is far too long.
I say that because last November, or whenever it was, we
had or was it just before Christmas, beginning December we
had Ms. Hovi, although you said that some of papers in her
statement were matter of expert (and so they were) there
were a lot of allegations of fact there.

MR. RAMPTON: My Lord, this new Jarrett statement is not to deal
with what is in her statement, it is to deal with what she
said in the box which was not in the statement.

MR. JUSTICE BELL: I appreciate that, but I have to say I am
surprised that someone was not proved about just what the
general situation was at Jarrett. When we were arguing
about it before you said that the witness they want called
was, and it turned out to be a gentleman who was called,
whereas I would have thought it is wrong to say none of
Jarrett's business they want called, it is who your clients
can best call. I appreciate if you can please them as well
       it may be, but -----

MR. RAMPTON: I cannot tell Jarretts who to provide as a
       witness.

MR. JUSTICE BELL: Well you can -----

MR. RAMPTON: I am afraid, but anyhow I am not really on that
question, because as I say -----

MR. MORRIS: They can subpoena someone if they want to.

MR. JUSTICE BELL: Do not bother about that because it is quite
apparent that someone could have gone into Jarretts on
McDonald's behalf and really sorted out what the situation
was, and if Jarretts had said: "Well we are not too keen on
any of us giving evidence on that", the wisdom of calling
anyone at all from Jarretts could have been assessed, and
if you thought it was a good idea to call someone from
