2 Q. Was it a regular occurrence for floor managers to work more
3 than 39 hours a week?
4 A. Not regular, no, in terms of we would schedule them
5 every week, week in, week out, absolutely not. They would
6 be scheduled for their hours. As I mentioned on Friday, it
7 may well be, especially on the night shifts, with their
8 administration responsibilities when the restaurant had
9 closed, that could take an hour or so, perhaps longer, than
10 it did to tidy up, depending on the ability, obviously, of
11 the floor manager in question.

13 Q. Again, they were not scheduled to work more than 39 hours a
14 week, but were they regularly working more than 39 hours a
15 week?
16 A. Not regularly, no.

18 Q. What about other levels, below floor managers but above
19 crew; were they scheduled to work more than 39 hours a
20 week?
21 A. No. To my recollection, we had training squad, and
22 that was all, in the two restaurants.

24 Q. Would they be treated basically the same as crew?
25 A. In terms of the schedule, absolutely, yes.

27 Q. You would not expect them to work more than 39 hours a
28 week?
29 A. No.

31 Q. Whether or not they were scheduled 39 hours a week, you
32 would not expect them to work more than 39 hours a week?
33 A. Certainly.

35 Q. If crew or training squad were regularly working more than
36 39 hours a week, would that concern you?
37 A. They were not working more than 39 hours a week.

39 Q. If crew were working more than 39 hours a week, would you
40 say that indicated the store was understaffed, if they were
41 working more than 39 hours a week on a regular basis?
42 A. It would lead me to talk to the manager about why.
43 I do not think it would necessarily mean understaffed;
44 there may have been a whole series of holidays taken in one
45 go. So my advice to the manager would be, perhaps, better
46 holiday planning; rather than let ten people go all at
47 once, try and see whether or not he could balance it out,
48 in terms of spreading across the year; or maybe two or
49 three people were ill. But it would not necessarily lead
50 to me to one conclusion. Part of my job was to try and
51 advise the manager to ensure they did the troubleshooting,
52 so to speak, about the reasons; and, if it was holidays,
53 then obviously we could make improvements upon that.

55 Q. If it was something that went on for a few months, would
56 you say that it indicated there was understaffing?
57 A. I would hope that, as a good supervisor, I would be
58 able to advise the manager and we could sort it out within
59 a matter of a week or two weeks, depending on what the
60 particular difficulty was.
