Day 005 - 04 Jul 94 - Page 84

     1
MR. JUSTICE BELL: What I suggest you do is if and when you
2 ever serve any documents on Barlows, you make a list of
them. You say you would like these included in the trial
3 bundles and then, if there is any objection to that,
              Mr. Rampton can tell me.
     4
         MR. MORRIS: Yes.
     5
MR. JUSTICE BELL: The policy which should be adopted is they
6 should go in unless there is any very, very good reason
for it, even if they turn out not to be admissible, then
7 I can just cut them out of my consideration.

8 MISS STEEL: I do not know whether this is something for the
court or maybe we should just sort it out separately, but
9 there was a mention about an index to the pleadings
bundle. I do not know whether that has been finished or
    10 sorted out or anything?

11 MR. JUSTICE BELL: Is that so, Mr. Rampton?

12 MR. RAMPTON: I do not know, my Lord. It is not done yet.

13 MR. JUSTICE BELL: It is being done, is it?

14 MR. RAMPTON: It will be done.

15 MR. JUSTICE BELL: Yes. The other thing was I was going to get
the allegations in the amended defence in a form which
16 I could put in my extract bundle.

17 MR. RAMPTON: Yes, that has been done. What we have done is
actually a reworking of the whole thing, but I do not know
    18 where it is.

19 MR. JUSTICE BELL: I have mentioned it. It need not be found
now. What would help me is if I can slide into the back
20 of each tab such allegations in the reamended defence as
              relate to that topic.
    21
MR. RAMPTON: Would your Lordship prefer that, or would you
22 prefer the complete re-working which has now all the
              allegations in it?
    23
MR. JUSTICE BELL: Of the reamended defence?
    24
         MR. RAMPTON: Yes.
    25
MR. JUSTICE BELL: I would like that, but if someone would be
26 kind you have enough to divide it up so I can then put
each separate sheet in the back of each tab in the
    27 extracts bundle.

28 MR. RAMPTON: That is impossible because what has happened is
it has been re-word processed from start to finish.
    29
MR. JUSTICE BELL: Can I see that first sometime then? Let me
    30 have it tomorrow.
