Day 187 - 13 Nov 95 - Page 33

"...took place in June 1994. Faced with manoeuvering by
the management to dissuade the workers from voting for the
CFDT list of which I was a candidate, the state prosecutor
ordered a letters rogatory (sic) so that an enquiry would
be set up to investigate anti-union practices. During an
interview with the new Manager Mr....."

MR. JUSTICE BELL: Do not bother with the name -- Chikh.

MR. MORRIS: "....Chikh, I fully realised to what extent
McDonald's management did not want CFDT unionists elected
to the works council. I informed 'inspectors' of this by
       letter (see copy enclosed)."

This letter is B54 to 55. Actually, I put the legal
judgments at the end; so it would be before the legal
judgments, in fact. It is actually in the middle of the
bundle, B54 and 55. I will not read it out.

MR. JUSTICE BELL: "I have been systematically..."

MR. MORRIS: "I have been systematically discouraged, isolated
from other workers and prevented from taking any
       responsibilities.

"This clearly shows that it is inadvisable to be unionised
       at McDonald's.

"All these discriminatory practices aim to discourage
workers witnessing these events from joining a union.
I hope that my statement will draw the attention of those
reading it to the fact that some employers practise some
anti-union policies and that in these conditions it is very
difficult for someone to assert their rights."

That was received from Chantal Villeneuve-Gallez, and that
is a translation by Suna Scutcher, who is the translator
       today.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Her second letter was received yesterday, but is
dated 6th November 1995; and the translation of that -----

MR. JUSTICE BELL: It is behind your new bundle,

MR. MORRIS: It is her identity file.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: This is the official supplementary statement of
       Chantal Villeneuve-Gallez, 6th November 1995, translation
       by Suna Scutcher.

"Since the arrival of the CFDT union in the Social and
Economic Unit legally recognised, important changes
occurred in the different restaurants in Lyon part of the
SEU." Sorry, that says Social and Economic Unit.

"1. A/the works council was created and elections for
