     4   MR. MORRIS:  Our position is that all our witnesses abroad we
     5        would like to attend court.  They have said they are
     6        willing to attend court.  It depends upon whether we can
     7        raise the money and obviously -----

     9   MR. JUSTICE BELL:  Have you actually served Civil Evidence Act
    10        Notices in respect of them?

    12   MR. MORRIS:  Not the French ones.

    14   MR. JUSTICE BELL:  Is it not sensible to do that anyway?

    16   MR. MORRIS:  Yes.

    18   MR. JUSTICE BELL:  Because if it all falls to pieces and for
    19        whatever reason at all they do not come, if you have served
    20        a valid Notice which qualifies, and it does not matter
    21        whether it is abroad or because someone, unhappily, has
    22        died or is too ill to come, if you have one of the reasons
    23        which means that you can serve a copper bottom Civil
    24        Evidence Act Notice, by which I mean one to which
    25        McDonald's cannot respond with a counter notice because you
    26        have got the "they are abroad" ground for doing it, you had
    27        better do that anyway, had you not?

    29   MR. MORRIS:  Yes.  I am sorry we have not formally done that but

    34   MR. MORRIS:  I have not got my own list here, but basically the
    35        two French witnesses, we would like a Civil Evidence Notice
    36        put on their evidence.

    40   MR. MORRIS:  Yes, Lamti, I think his name is, Hassen Lamti.

    47        say yesterday there were some whose last address you had
    48        was abroad?

    53        unmarked, a girl called Sarah English who is No. 30 who
    54        lives in Orangeville, Ontario.
