1 MR. MORRIS: Yes. Advertising. The US Santa Claus survey was
2 brought up on day 45. It was page 22, lines 24 and 42.
3 Mr. Green on line 24. Line 24 refers to the original
4 survey which Mr. Green says McDonald's has referred to. He
5 was not sure who had done the survey but McDonald's
6 referred to it.

8 MR. JUSTICE BELL: He did not think McDonald's had done it.

10 MR. MORRIS: Yes, and later on I think, if you remember, Helen
11 was quoting from an Annual Report which purported to
12 interview ronald mcdonald. He quoted the conclusion of
13 that survey about Santa Claus. On line 42 he says there
14 was a second survey which, I believe, is an annual survey
15 called the Que survey -- I do not know why it is called
16 that -- which also talks about the popularity and awareness
17 of characters, including ronald mcdonald. So, we would ask
18 the Plaintiffs or request the Plaintiffs to disclose both
19 those surveys if they are in their possession or power.

21 MR. JUSTICE BELL: What do you say is the relevance of that?
22 You have the figure which, apparently, it contained about
23 percentages; it was 96 knew of Ronald. I am assuming
24 everyone knew about Father Christmas -- Santa Claus,
25 I should call him, I suppose.

27 MR. MORRIS: What is the relevance of that or in the light of
28 them admitting-----

30 MR. JUSTICE BELL: No, you hoping to get out of the survey apart
31 from it is said that 96 per cent of children knew Ronald?

33 MR. MORRIS: Well the first survey is the most significant in
34 terms of evidence because doubt has been thrown on, in
35 fact, whether such a survey or conclusion was actually
36 done, and whether it was, in fact, a piece of hype by
37 McDonald's publicity agents on behalf of McDonald's. So,
38 it will be important.

40 MR. JUSTICE BELL: Is there any objection to an enquiry being
41 made as to whether these surveys are available and
42 Mr. Beavers, if they can be found, can bring them across
43 with him?

45 MR. MORRIS: The Germany Kindergartens dispute, which is day
46 44. That is the one before the one we were just looking
47 at. The one after is also day 44. It is pages 57 and 58.
48 The witness did not recall such a dispute but we referred
49 to our understanding, or our belief. If we look at line 50
50 on page 57 -- sorry, regarding a particular kindergarten on
51 line 40 in Frankfurt; then the German Children's Protection
52 Association recommended ronald mcdonald education
53 programmes for kindergartens should be rejected.

58 Plaintiffs have in their possession regarding that dispute
