Day 184 - 06 Nov 95 - Page 33

  Q. He was trying to -----
       A. That is what I understood it as.

  Q. But, as a general matter of job security, what the union
wanted, did that refer to, say, a union representing people
against dismissals or anything like that in general?
       A. Not from what I understood. It was just, if we signed
a card and we got fired, then the union would be able to
protect us, but if we did not sign the card -----

  Q. Right. If you have a dispute -- say an individual has a
dispute with a Manager which results in them being
disciplined or dismissed, for whatever reason, can they
call a union representative to represent them, have a
       meeting with management?
       A. I do not understand, I am sorry. Like, what are
       you -----

  Q. Well, if someone is dismissed or threatened with dismissal
at McDonald's, your store, do they go up to the Manager and
have a talk about it sometimes?
       A. Right now?

  Q. Yes.
       A. We never -- like, we do not threaten to dismiss people,
like, for nothing. I mean, the only way they can get
dismissed is if they have the three lates, if they have,
you know, the no-shows or whatnot. I mean, if there is a
dispute, then we do not fire them; we just try and sort out
       the problem.

  Q. But if someone is disciplined or dismissed for what you
said, say, three lates or no-shows, and they feel badly
treated, or they might not even agree they should be
dismissed for being late three times or something, how do
they resolve that; do they just have to accept it?
       A. No. They can go and talk to Cam. There is a lot of
people at McDonald's who have had more than three lates and
still work there. They can just go and talk to Cam and
explain how they feel; and, I mean, so long as -- I mean,
so long as they can talk, tell Cam that, you know, it will
not happen again, or so long as they can promise to improve
their dependability or their attitude or whatnot, Cam will
keep them. Cam does not -- he is not that type of person.

  Q. When they go and see the Manager, can they take the union
rep along with them if they want to?
       A. I guess so. I do not know. I have never heard of
       anything like that.

MR. JUSTICE BELL: She does not know.

MR. MORRIS: No, OK. Basically, if there is a dispute, it is
between the individual crew member and the Store Manager,
Cam Ballantyne; they sort it out in some kind of meeting
       together, yes?
       A. Cam tries to sort out all the problems. He does not
like any problems to get any bigger or anything like that,
and he always deals with us fairly.
