Day 149 - 06 Jul 95 - Page 47

conditions of the workers, to the policy on hustle, and
they are relevant to safety and food safety. There was
great play made of the supposed benefits of working at
McDonald's, being the training and the conditions that
employees work under. I think it is relevant to all of
       that area.

MR. MORRIS: On the subject of the Costa Rica map, because of
the confusion over the Guatemala/Costa Rica thing, which
I introduced and Mr. Rampton took up, it may be helpful if
the Plaintiffs were asked just to clarify what the position
is on that, because they did not say incontrovertibly that
       there was no map.

MR. RAMPTON: Yes. There is no map, my Lord. I will say it
       now.

MR. JUSTICE BELL: What you were told was there was no
Costa Rica map. There was a map which ---

  MR. RAMPTON: A Guatemala map.

MR. JUSTICE BELL: -- Mr. Rampton first had in mind was
Costa Rica but was, in fact, Guatemala. That was the only
one McDonald's had. What he did not know was whether that
was what Dr. Gomez Gonzales had in mind. It is in the
       bundles somewhere.

MR. MORRIS: It cannot have been the one Dr. Gomez Gonzales had
in mind, because the one that was disclosed to us was not
an actual map or a copy of a map; it was something
obviously done in order to -- tab 72, yellow XIV is
something that was clearly prepared for a letter that was
written. It was part of a letter. It was not something
which was obviously: "This is a map on our wall that we
based our operations on", because it is clear from looking
at it, it is not that kind of -----

MR. JUSTICE BELL: The position seems to me at the moment that
McDonald's are saying they do not have any other map with
regard to Guatemala or Costa Rica. You heard me say this
morning that I was anxious to avoid, for instance,
Mr. Cesca coming and having that map put to him and being
asked: "Have you ever seen another", and saying: "Yes,
I think we have one somewhere or another."

That is the state of play at the moment. If McDonald's are
saying that the only Costa Rica and/or Guatemala map they
have is the Guatemala map which you have in mind, they are
conscious of the inconvenience which would be called if
Mr. Cesca turned up in a few months' time and said: "Yes,
there was another one after all."

MR. MORRIS: Just one point on that subject which is I think the
Plaintiffs said Mr. Monroe is coming. I do not believe we
have a statement from him and it would be helpful to have
       one.

MR. RAMPTON: I think you should already have one.
