Day 181 - 01 Nov 95 - Page 40
A. Yes, I can see that.

Q. The third sentence says: "Preliminary results from the 1994
LFS" -- that is the Labour Force Survey -- "indicate that
there has been a small but discernible improvement in
levels of reporting by employers with the percentage of
injuries recorded having risen from 34 to 38 per cent."

Do you know, Mr. Pearson, what is the current rate of
reporting in the fast food industry?
A. In the fast food industry, I am not aware that there
are any separate fast food statistics.

Q. You would not be familiar with a figure of 16.5 per cent,
one in 6?
A. No, I do not -- I am not aware of the 16.5 per cent
reporting figure for the fast food industry, but it looks
to me to be somewhat below the figure that you have
referred to for the average.

Q. Do you know what McDonald's reporting rate is and was back
in 1990 or 1992?
A. No, because I have not seen any evidence on that.

Q. Very well. Will you please turn to page 93, where you have
some graphs? Doing the best I can without a coloured copy,
am I right that for fatal injuries the lowest score, the
last line on the graph, is the service industry?
A. Yes, yes.

Q. Am I also right that tht is true also of the non-fatal
injuries in the second figure?
A. Yes, that is right.

Q. Can you turn over the page?

MR. MORRIS: Sorry, which graph are we looking at here?

THE WITNESS: Figure 2.

MR. RAMPTON: I think it was a sort of mode colouring.

THE WITNESS: It is figures 1 and 2, and the lower line is
purple, and it shows the service industry scoring the
lowest of all the six sectors.

MR. MORRIS: Services, is that -- maybe the witness can be asked
what that means.

MR. JUSTICE BELL: Well, your own witness, I think, referred to
them. Mr. Pearson referred to what they were.

MR. RAMPTON: The hotel and catering industry, Mr. Pearson, are
part of services, are they not?
A. You would have to accept that is where they would be if
they were anywhere.

Q. We will see some actual figures in a minute, although these
are reported figures so one must treat them with every
piece of due caution, I quite agree.
