Day 070 - 20 Dec 94 - Page 56

related matters, I do not know if the Plaintiffs are
proposing a redrafting of the timetable or whether we are
still working from the existing one?

MR. RAMPTON: My Lord, perhaps Mr. Morris could sit down and
I might be able to give some information, unless he has
       something to offer.

MR. JUSTICE BELL: Yes, allow Mr. Rampton to.....

MR. MORRIS: I certainly have some points to make but if he
       specifically wants to ------

MR. RAMPTON: It sounds as though he has nothing constructive to
offer so perhaps I can offer something. My Lord, in
principle, the schedule stays as it is. What we would like
to do, so far as we can, is finish up the witnesses on
recycling and waste, which includes (but is necessarily
confined to) the environment/index.html">litter witnesses. I am talking about the
Plaintiffs' witnesses, Siddique, Ashworth, Stump and then
the Defendants' witness, McIntyre. Then we would like to
finish up, if it possible, the nutrition issue which is an
important issue in the case before we continue with rearing
and slaughter and food safety. That would mean that we had
in this order Mr. Siddique on 11th -----

MR. JUSTICE BELL: That is a half day, remember.

MR. RAMPTON: I see. This is a pencilled chart only because the
availability of the witnesses has not been confirmed. It
is a proposal. There is still Mr. Theo Hopkins to come
back at some stage, I do not know when. But, as a
proposal, it might go Siddique on 11th, Ashworth -- I
had stood up in the hope I was going to be helpful but
I see that is absolutely not so.

MR. JUSTICE BELL: Can we just pause a moment? What matters
apart from the schedule do you have to raise?

MR. MORRIS: There are some matters to do with the schedule in
       general and then -----

MR. JUSTICE BELL: Apart from the schedule?

MR. MORRIS: Apart from that we were going to bring up some
corrections to the judgment we noticed, but may be that
could be left to some -----

MR. JUSTICE BELL: The judgment I gave the other day?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: That has been approved and is fixed. If you
want to raise anything on it with me at any appropriate
time, then clearly you must do. But, for better or worse,
that is the judgment which has been given.

MS. STEEL: I do not think we are trying to say we are going to
get the judgment changed, just that there were some things
we wanted to bring up in relation to that and in relation
