Day 067 - 15 Dec 94 - Page 71
MR. JUSTICE BELL: What it is preferred that you should not do
(which you would not have done without leave anyway) is
say: "Now, I want you to have a good hard think about
whether there is any anything else in any other category"
because that we will just wait and see.

MR. RAMPTON: No, your Lordship has just told him that anyway.

MR. JUSTICE BELL: No, but I do not expect him to speak to you
about it. I know if he started to do, you would tell him
not to go any further.

MR. RAMPTON: Absolutely not, and it is a difficult thing for
American witnesses because, of course, the same rule does
not apply there. So they have all been very firmly told
that we cannot speak about the case or about their evidence
while they are giving evidence.

My Lord, there are some other administrative matters. I
would like Dr. Gomez Gonzalez to be able to see a copy
of "Jungle Burger" over the weekend before I re-examine
him. I will not say anything to him about except
Mrs. Brinley-Codd will give him a copy. Would that be all
right? It will save time.

MR. MORRIS: There is no problem with us.

MR. JUSTICE BELL: No. It may enable you to ask more usefully
the questions I was asking a few minutes ago.

MR. RAMPTON: In relation to this lady, Anne Link, it is not,
with the greatest possible respect to Mr. Morris, good
enough to say she is going to come and give evidence about
packaging, paper and forest cover. I would invite your
Lordship to set a deadline for the service of a statement,
a full statement, by her including a detailed account of
her qualifications to speak on these matters so that I know
whether I have to bother recalling any of my witnesses or
calling Mr. Bateman.

MR. JUSTICE BELL: What I said last night is that Mr. Morris or
Ms. Steel should state by Friday whether they are calling a
witness, who he or she was and the topics, but not at this
stage what they will say. Mr. Morris has done that.
I then went on to say: "Then if you are calling someone,
we can talk about when the statement should be served".

What I would like you to do is, having made contact with
Miss Link, to find out as soon as you can so that we can
deal with it not later than next week when she would be
able to provide a statement, and then you can tell me about
that and we will fix a date. It is often better for the
witness if a date is fixed because they are then working to
a deadline.

MR. RAMPTON: In that connection, I remind your Lordship that
Mr. North visited the various sites in August of this year.

MR. JUSTICE BELL: Leave it there. Can you do the same with
him? It was only yesterday evening I made the point about
