Day 006 - 05 Jul 94 - Page 80

1 MR. JUSTICE BELL: I think the reason it has arisen is when we
were talking about this yesterday afternoon, my
2 recollection is you said that Professor Duxbury had to be
              done on Wednesday morning.
     3
MR. RAMPTON: I have better intelligence than that now. We
4 will have to speak to him, but our understanding was, as
I said to your Lordship yesterday -----
     5
MR. JUSTICE BELL: I think someone is coming round.
     6
MR. RAMPTON: Perhaps this is the man himself. I do not know
7 if your Lordship heard that, but he is available all day
tomorrow. So, for the sake of Mr. Kouchoukos, I would
8 like to start with Mr. Kouchoukos tomorrow morning and
then bring in Professor Duxbury late tomorrow afternoon or
     9 tomorrow afternoon.

10 MR. JUSTICE BELL: Speaking for myself and not yet having asked
Miss Steel and Mr. Morris, I would prefer to have
11 Mr. Kouchoukos and then Mr. Duxbury, rather than starting
Mr. Langert and then breaking off.
    12
MR. RAMPTON: I am sorry, that was my fault. That was a late
    13 muddle by me.

14 MR. JUSTICE BELL: When would you be thinking of Mr. Langert?

15 MR. RAMPTON: I would like to do Mr. Langert after
Mr. Kouchoukos and Professor Duxbury, so as to ensure that
16 he gets back to the United States by the weekend if I
can. I have already moved Mr. Mallinson from Thursday to
17 Monday to make that possible.

18 MR. JUSTICE BELL: What you would be considering is you would
have to be ready to cross-examine Mr. Kouchoukos tomorrow
19 and Professor Duxbury. Mr. Langert you would have to
cross-examine maybe on Thursday, and then we would come
    20 back to Mr. Preston.

21 MR. MORRIS: The problem for us is dealing with the whole
swathe of the packaging issue suddenly which, obviously we
22 have been concentrating on Mr. Preston. We would have to
prepare considerably to cross-examine those three.
    23
MR. JUSTICE BELL: You have known that they were going to be
    24 this week.

    25 MR. MORRIS: Yes.

26 MR. JUSTICE BELL: I am not unsympathetic to the trial -----

    27
MR. MORRIS: It is clearing away one set of papers and getting
    28 a whole lot more.

29 MR. JUSTICE BELL: I appreciate. But it seems to me there is
no reason why you should not be ready for Mr. Kouchoukos
    30 tomorrow for cross-examination.
