Day 166 - 28 Sep 95 - Page 42

       did you?
       A. Yes. On a regular basis Managers will check out the
front of the store and as, indeed, dining area people will.

MS. STEEL: You said that you cannot recall whether gloves were
       provided for the environment/index.html">litter patrol?
       A. No, for the freezer.

MR. MORRIS: We have just discovered, amazingly enough, that me
and Helen have different statements from the witness. I do
       not ------

MR. JUSTICE BELL: Which of them accorded with what Mr. Atkinson
       read this morning?

MS. STEEL: I was not scanning down as he was reading it so I do
       not know.

MR. RAMPTON: I do not know whether this helps or not, but it
may help to reconcile the problem. Unfortunately,
Mrs. Brinley-Codd is not in court. I have got a 10 page
statement, it ends at paragraph 26, three-quarters of the
way down the page, the signing and dating spaces are left
blank, but at the bottom the typist has typed "4th July
1995" with a reference underneath it.

MR. MORRIS: Both of ours are both dated 4th July 1995.

MS. STEEL: And end on the same page, page 10.

MR. JUSTICE BELL: Tell me where the difference between them is.

MR. MORRIS: It is just an example .....

MR. JUSTICE BELL: Tell me the one you have found.

MR. MORRIS: In this one, in Helen's one it says: "I cannot
       recall" -----

MR. JUSTICE BELL: Give me the page and paragraph.

MR. MORRIS: The one we are on, page 8, paragraph (17), the
first thing I can see -----

MR. JUSTICE BELL: Read what is in your statement

MR. MORRIS: In my statement it says: "I cannot recall at this
distance of time whether gloves were specifically provided
for use in the walk-in freezer". On Helen's it says:
"I cannot recall at this distance of time whether gloves
were specifically provided". Then lower down it
       says -----

MR. JUSTICE BELL: What goes on in Miss Steel's -----

MR. MORRIS: "However, had any requested gloves" ---

MS. STEEL: -- "I would have provided them and I cannot recall
receiving any such request. Similarly, gloves were also
available for use in the walk in freezer".
