Day 093 - 28 Feb 95 - Page 38

Q. Asked him when?
A. I asked him the specific numbers.

Q. When did you ask that?
A. During part of when I was here and I was asked that
question, I wanted to verify the question.

Q. So that was when you were giving evidence before you asked
him?
A. That was probably the first or the second day.

Q. Prior to getting in the witness box you had never asked him
about the number of birds that were dead on arrival?
A. I had an idea. I have not asked specifically, yes.

Q. That was not something that either you or McDonald's felt
you needed to know about?
A. No, that is wrong. We have discussions very often. It
is part of the formula costing. If an animal dies on
arrival, we have an open book policy, we look at everything
in the cost, so we know how much.

Q. So, previously, it was one to two per cent from your own
knowledge of those discussions?
A. From that was what I remember as an estimate, yes.

MR. JUSTICE BELL: Shall we pause there?

MS. STEEL: Yes. Can the witness be reminded not to speak to
anybody during lunch-time or during the rest of his
evidence, for that matter?

THE WITNESS: I was reminded before that and ever since I have
not spoken to anybody. I sit at a different table when we
go for lunch.

MR. JUSTICE BELL: Yes. The difficulty is you have been asked a
lot of questions and about things which, it is quite clear
to me, are not within your direct knowledge. You have been
pressed about them, although you have said they are not of
your direct knowledge and, therefore, you have gone to try
to find information about them. Since a point has been
taken on it, do not do that any further.

THE WITNESS: Yes, my Lord.

MR. JUSTICE BELL: We will resume at 2 o'clock.

(Luncheon Adjournment)

MS. STEEL: You said that for the chickens at the
slaughterhouses there is no breast comforters in other
parts of the world apart from the UK. Why is that?
A. I do not know. I cannot speak for everybody else in
the world. I have seen variations of that, yes.

Q. Variations?
A. Yes.
