Day 252 - 20 May 96 - Page 48

certainly served; I just do not know where it was put.

MR. JUSTICE BELL: Yes. Just pause a minute. Have you got a
copy there so I can see what it looks like?

MR. MORRIS: Well, that is what the front page looks like.

MR. JUSTICE BELL: I have found something which is labelled
"Defendants Fourth Supplementary List" but that is in a
bright blue bundle 4 and it does not have the World Health
       Organisation paper on it.

MR. MORRIS: I think the best course is to read out the sections
       and if the witness ----

MR. JUSTICE BELL: He must have a copy. Whether anyone else
       does or not ----

MS. STEEL: I will hand up my copy to the witness (Handed).

MR. JUSTICE BELL: If you are going to attach weight to parts of
this, you must track it down, because when we come to
speeches, unless I know where things are and have them at
       my fingertips ----

MR. MORRIS: It has been put to witnesses before, so it will be
       on the transcript.

MR. JUSTICE BELL: I appreciate that. I recognise what you are
talking about and it is probably there somewhere, but I
need to know where it is.

MR. MORRIS: To be honest, probably asking me would be the last
person to ask as our documents are often in a mess.

MR. JUSTICE BELL: I know, but, essentially, it is your
responsibility to keep track of where documents are. I
know in a case of this length you can lose track of them
easily, but when something like this crops up you have to
make a note to find out where it is.

MR. MORRIS: Maybe because it was thick, it has 52 sides of
papers, you may have kept in your room.

MR. JUSTICE BELL: It may well be that you gave me an original
and that I have it in my room but I do not recognise it
from the pale blue cover. I recognise, for instance, the
green one there. I have that in my room, I think, and I
have some of the various grey books in my room. Anyway,
carry on with Professor Naismith now, but give me the
references clearly so I can make a note of them.

MR. MORRIS: (To the witness): The initial question is: The
World Health Organisation would be substantial
       authoritative body, would it?
       A. I would agree with that, yes.

  Q. And this report, are you familiar with its contents if you
       do not remember the details?
       A. Yes.
