Day 084 - 07 Feb 95 - Page 09

MR. JUSTICE BELL: No, they are the 1.6 ounce ones.

MR. MORRIS: "... and the quarter pound patties was increased by
two and six seconds respectively. Following the Preston
incident the cooking times were lengthened still further".
So, these were increased twice in a period of 18 months,
the cooking times. We want the documents related to the
increase of the cooking time, as for the reason, documents
that McDonald's have in their possession, power or control
related to the reason for increase in the cooking times.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Obviously, any particular reference to health
       concerns.

The next one is McKey's documents seen by Professor Jackson
and referred to, preferably from the day that he visited.

MR. JUSTICE BELL: When you say "from the day", you mean the
ones he saw on that day, do you?

MR. MORRIS: Yes, if possible, or nearest available day if they
have been destroyed. I would expect they would not have
been destroyed as they are relevant to litigation.
I cannot remember specifically -- if I am asked to, I can
identify any statement -- which particular documents but
I am sure the Plaintiffs will be aware of which documents
he saw. Professor Jackson himself had notes which he read
out in court. This is particularly at McKey's. I think he
specifically referred to summaries of documents showing
which experiments had been carried out that day in the
       laboratory.

MR. JUSTICE BELL: Which microbiological tests, you mean?

MR. MORRIS: Yes. The testing, microbiological and E.coli
testing, which he said he had seen documents showing the
complete day's tests. Secondly, records from the testing
of finished products. That is partly covered by the first
one, but also Mr. Walker said that something like 13,000 --
he gave a specific figure -- burgers were rejected or
thrown away, or whatever. We would like the documentary
records which led to that figure in terms of in what
circumstances they were thrown away and why, and especially
relating to the testing of finished products. I presume
that would be the same thing.

MR. JUSTICE BELL: That was all the 13,000 referred to. It was
13,000 burgers destroyed because samples of them had been
taken for microbiological testing. That is what Mr. Walker
       said.

MR. MORRIS: Yes. I was not sure how he specified -- he
actually said what that figure, whether they were ones that
solely had been tested on or whether they meant other ones
that may have been damaged, I do not know.

MR. RAMPTON: My Lord, he said -- I have almost the words in
front of my mental screen -- chemical and microbiological
