Day 267 - 21 Jun 96 - Page 54

MS. STEEL: We would not really be able to call evidence about
it. The thing is that if there were bugs planted and tapes
made then, obviously, the conversation would be relevant
and disclosable if it was of meetings of London Greenpeace.

MR. JUSTICE BELL: The point is, I have no evidence at the
moment that bugs were put in. I have got no potential
evidence in statements from you. Insofar as you want to
argue that I should draw an inference that bugs were put in
because there are photographs of matters which do not refer
to McDonald's, you can do that on the evidence you have put
       so far.

MS. STEEL: Right. I am just -----

MR. JUSTICE BELL: Asking further questions does not improve
the point, if you have got one.

MS. STEEL: It is just we do not know what the Plaintiffs have
got hidden at their offices and whether they have, in fact,
got tapes of these meetings that they are calling evidence
       about.

MR. JUSTICE BELL: I have no evidence that they have
whatsoever. The most I could have is an inference from the
matters you have brought out and going on and asking
questions about that is not going to improve the point.
So, all I am suggesting is leave it unless you have some
       specific information to put.

MS. STEEL: (To the witness): Did you ever discuss planting
bugs with your superiors or anybody?
       A. I do not recall.

  Q. You do not recall. So you might have done?
       A. I really do not recall.

  Q. Photograph number 9 ----

MR. MORRIS: Sorry, before we ask about that, when you say you
do not recall it was not something that was ruled out then,
       bugging?
       A. I do not recall it ever being discussed.

  Q. Yes. You do not recall it being discussed. So, you do not
recall it being specifically ruled out?
       A. If it was not discussed, it could not have been ruled
       out.

  Q. Are you saying it was not discussed?
       A. I am saying I do not recall it being discussed.

  Q. So, you do not think it was discussed?
       A. No, I do not recall it being discussed.

  Q. You do not recall whether it was discussed or not?
       A. That is correct.

MS. STEEL: The boxes that are numbered 6 in that of answered
       letters?
