3 Q. Were what happened and what people said at the rap sessions
4 recorded in any way?
5 A. It was recorded almost as verbatim as you could make
6 it. You either took someone along who would take notes for
7 you or you took them yourself, took the notes as you went
8 along.

10 Q. Then what would you do with your notes?
11 A. Get them typed up. One copy would go up on the crew
12 room notice board, one copy would go to the management
13 team, one copy would go to the store file, and I think a
14 further one went to the Supervisor. From those notes for
15 the rap session the store management team would compile an
16 action plan. The action plan should go on the crew room
17 wall, and the action plan consisted of problem,
18 responsibility of a particular Manager and then the
19 resolution to that problem. That was an action plan that
20 was posted on the crew room wall alongside the rap session.

22 Q. Was the action plan acted upon?
23 A. Yes.

25 Q. What about individual grievances, Mr. Davis? Suppose I am
26 a crew member and I am a bit fed up with the First
27 Assistant because I think he has put a down on me and he is
28 giving me the wrong kind of hours, or something like that,
29 or he is being unfair to me in the performance reviews.
30 What should I do with that individual grievance?
31 A. In a rap session?

33 Q. No, outside of a rap session?
34 A. Sorry, can you repeat the question? I am still
35 thinking of the rap session.

37 Q. Suppose that I do not want to say -- I have left the rap
38 sessions now, sorry about that -- I do not want to say it
39 at a rap session, but I do want to make an individual
40 complaint.

42 MR. JUSTICE BELL: Or the next rap session is some way ahead and
43 you may not be able to attend it anyway?
44 A. Yes. If they had a complaint about a specific
45 Assistant Manager, then I would hope, as a Manager, they
46 come and speak to me about it and I would do my best to
47 resolve the situation as amicably as possible between the
48 two parties. If they felt they could not come to me for
49 whatever reason, then there was always the Area Supervisor
50 they could go to. I suppose, taken to its ultimate, they
51 could always write off to Head Office if they felt that
52 neither of those situations worked, although I cannot
53 recall any instances of that happening.

55 MR. RAMPTON: That is what I was going to ask you, whether, in
56 your experience, that actually ever happened. You have
57 dealt with that. Just a couple more things, Mr. Davis,
58 then I will sit down. How good do you think, looking back
59 on it, the standard of hygiene and food handling was in the
60 Colchester restaurant in your time?
