Day 153 - 12 Jul 95 - Page 62

everybody else, rather than sit in an office and govern it
from upstairs. That, as I remember, is the type of sort of
       dissatisfaction that he expressed.

  Q. So all the points in his statement that he made that you
are looking at, you did not hear about any of those kinds
of dissatisfactions from Kevin at the time regarding -----
       A. Such as what?

  Q. Labour costs being of paramount importance?
       A. I do not remember him expressing any opinion at all on
       labour costs -----

  Q. Managers encouraged to keep employees ignorant of their
entitlement to various payments, overtime payments?
       A. He never brought any of those allegations you have just
        -----

  Q. Discretionary bonuses?
       A. No.

  Q. Crew members working on an entire shift without a break,
health and safety, no shoes with non-slip soles provided?
       A. I mean, Kevin was a salaried Manager, so the specific
instance of the -- it would have been his job to make sure
that crew got a break on a particular shift because he
would have been the shift runner.

  Q. In general a "them and us" attitude was fostered between
       crew and Managers?
       A. I think that in Kevin's case it was the fact that he
felt we should have been more aloof and less working
shoulder to shoulder with the crew rather than a "them and
       us" type situation.

  Q. So when he complains about a "them and us" attitude, what
he really means is it should have been more "them and us",
should it, is that what you are saying?
       A. I am saying at the time that he perceived we should not
have been working shoulder to shoulder with the crew in the
restaurant. He felt we should have been more aloof and
       away from the operation.

  Q. If he says: "I believe there was very much a hidden agenda
of exploitation of crew members wherever possible by all
levels of management", that was not something that he had
brought up at the time, as far as you remember?
       A. I cannot remember him ---

  Q. You cannot remember, no?
       A. -- saying anything as general as that.

  Q. Because at McDonald's everybody is happy all the time, is
       it not, Mr. Davis?
       A. They are not happy all the time.

  Q. It is happyland, is it not, at McDonald's?
       A. Is that a question?

  Q. Yes.
