Day 095 - 02 Mar 95 - Page 41
MR. JUSTICE BELL: You say there is a similar directive but
related to performance-based inspection systems?
A. Yes.

Q. That is the one we should be looking at to relate to the
Tysons' printout we saw.

MR. RAMPTON: It might save time in re-examination if your
Lordship could ask him what this does relate to.

MR. JUSTICE BELL: Yes. Can you explain that because at the
moment I am unclear?
A. This one? This is the corrective process to -- when
something goes wrong, when an inspector is inspecting the
plant there is a process if he finds some deficiencies,
this is the process that will guide him through. So when
he tags, let us say, a major deficiency, he tags the
product and informs management of it. The next day the
management is responsible to provide the inspector with a
plan of corrective action as to how they are going to solve
the problems. Not all the problems can be solved
immediately, such as, let us say, it is a light bulb that
goes out in the middle of production, it does not affect
the product, the wholesomeness of the product, then there
is corrective action. They say: "OK, by tomorrow morning
during sanitation we will replace that light bulb." That
is the process that this corrective action and directive
guide us to.

MR. JUSTICE BELL: Who did this come from, Mr. Morris? Who is
Mr. Jollio?

MR. MORRIS: Well, I was told he was the director. I told him
it was for a court case.

MR. JUSTICE BELL: I suggest we leave it there. What I suggest
you might do is find whether there is a directive which
would fit the description which Dr. Gomez Gonzalez has just
given and, if you do have ready contact with someone from
the FIS you might be able to get them in a letter in
relation to which you could give a Civil Evidence Act
notice some explanation of the Tysons' printouts we were
looking at the other day. . You do not have to do it
straightaway. I will put this at the moment at the back of
tab 6 of supplementary Volume V.

MR. MORRIS: Yes. I feel that the thing is self-explanatory,
but I will go through page 8 and ask if there is anything
further.

MR. RAMPTON: I know your Lordship is perhaps as a little
troubled by the same that I am because I do not understand
it fully. I am not willing for it to be left in the air,
though Mr. Morris may fear the result. I will ask
Dr. Gomez Gonzalez when he has finished his evidence if he
will produce whatever is needed to produce an explanation
in documentary form. It might be in the form of a
statement.

MR. JUSTICE BELL: That may be, but the reason I addressed
