Day 285 - 23 Oct 96 - Page 36

MR. JUSTICE BELL: Is it sworn?

MR. RAMPTON: No, it is merely Civil Evidence Act.

MR. MORRIS: Sorry, a signed statement for the purposes of
this case, brought by McDonald's. Then obviously we have
to assume that he has been told to deny what happened, and
basically he has failed to do so and the only conclusion
must be that it is because he was telling the truth and
that it was fortunately recorded on camera and that he
signed a statement at the time verifying that it was his
       opinion that he gave.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: If I just mention about -- just to go back to
Mr. Zamora, that the transcript of his interview is also
in a Civil Evidence Act notice statement and he identifies
also Burger King, McDonald's and Wendy's in North America
using Costa Rican beef, exactly the same chains as
       Mr. Quintana identified.

I use the transcripts of the interviews, not the
transcripts from the film. He was not shown on the film.
Mr. Wolf did testify. I have not got the reference but I
have seen a note made about that. He said that he had
been told by Mr. Zamora that Mr. Zamora had refused to
even talk to the film director, Peter Heller. We have
heard we have got a signed statement from Mr. Zamora about
       his interview.

The last point on Mr. Wolf is that he was asked about
whether Peter Heller had a grudge against McDonald's. In
fact, I think you asked him. It was day 227, page 20,
line 28. Because he was having a meal with Peter Heller
in McDonald's. They were eating a Big Mac each or
something or a cheeseburger or something. He was asked:
"You cannot really say Peter Heller had a grudge against
McDonald's or something, he was eating their food". And
       he said "correct".

We would say that one word nullified the whole point of
the plaintiffs bringing Mr. Wolf over from Costa Rica.
Yes, if it is helpful, Mr. Wolf did not claim any
expertise regarding vegetation or forests or even on
       statistics.

I seem to have got bogged down in Costa Rica here. If we
go back to the US labelling, all our witnesses on this
subject, Douglas Shane, Jim Nations, Charles Secrett, and
also Howard Lyman, a very experienced ex cattle rancher
from the USA, also said that the US labelling system is
completely inadequate and that once imported beef is
checked on arrival it goes into the domestic supply and is
       indistinguishable.

Dr. Gonzalez said on day 69, page 44, line 3, that it is
possible that Costa Rica could supply beef to McDonald's
US suppliers. Douglas Shane in his statement refers to
