Day 244 - 03 May 96 - Page 28

MR. JUSTICE BELL: For all you have said, I noticed, when
I raised the question of Mr. Hill ringing, he nodded his
head. So, clearly, there is no objection from his point of
view, nor would I expect there to be.

MR. RAMPTON: No, there is not. There is nothing sinister about
it at all. I believe that Mr. Hill was speaking to the
American lawyers only yesterday about this very question,
and if they cannot get any joy out of Mr. Morganti Mr. Hill
will try. That is all I can do.

MR. JUSTICE BELL: I would be grateful if Mr. Hill tries
direct. What success he has, of course, I do not know. If
he can try directly, and if the statement is not
forthcoming but he can speak to Senor Morganti and identify
       where the places are, then the statement can come later;
but at least we can work on that basis so far as Miss
       Bramford is concerned.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: The sooner we have the statement the better,
obviously, because it is evidence one has put in under the
       Civil Evidence Act.

  MR. RAMPTON: I agree.

MR. JUSTICE BELL: What were the other matters?

MS. STEEL: The other matter is that behind Mr. Preston's
statement is a list of UK stores, and I did notice that the
Plaintiffs have said that they want to rely on that as one
of their documents, or something. I did notice that was in
their list. Anyway, it is just to say that the copy I have
got is illegible in quite a few places and it would be
helpful if the Plaintiffs could provide a legible copy of
       that.

MR. JUSTICE BELL: Mine is up in my room, so I cannot check
       that.

MR. RAMPTON: Mine is in chambers, so I cannot either. If I am
told the appendix number, I will -----

MR. JUSTICE BELL: I am not sure it does not appear in two
       places, in fact.

MR. RAMPTON: I do not know which one Ms. Steel is referring
       to.

MR. JUSTICE BELL: Which of Mr. Preston's statements is it, the
       one in which yellow bundle?

MS. STEEL: I do not know because I have it on my one at home.

MR. RAMPTON: My Lord, it is yellow 1.

MS. STEEL: For example, the very last page of tab 1 has got
illegible parts, but I think my copy at home is even worse
       than this one.
