suggestion that the temperature should be higher than they
are, perhaps we can move on to something else.

MR. MORRIS: I do not see it makes a lot of difference whether
it is gas or electric. The important thing is the
temperature and the cooking of the patty. Just to refer to
yellow volume VII, page 193, which is I think Mr. Wignall's
tab D, it has the temperatures recommended for the snap
action and the electric. The electric temperature
recommended is 340 degrees Fahrenheit and the snap action
       is 350.

MR. RAMPTON: My Lord, if one looks at Mr. Clark's statement and
his report of his visits to the restaurants, we find that
every single one of the grills which he had inspected had a
temperature at or above the recommended temperature limit.
So what is the basis for this cross-examination, I ask?

MR. MORRIS: Thanks for Mr. Rampton to raise it. If you look at
page 14 of Mr. Clark's statement, the Glasgow Fries Fryer
is under the recommended temperature, and the East Kilbride
McNuggets and Filet Fryer are both under the recommended
       temperatures.

MR. JUSTICE BELL: We cannot go off at too many tangents. What
I am concentrating on at the moment is appendix 2.

  MR. MORRIS: I understand.

MR. JUSTICE BELL: Quite frankly, 14 does not help us about
appendix 2 because it is completely different equipment.
If the suggestion is that they may have had gas fired
plates at Friargate, Preston, I understand that. If the
suggestion is then that Preston might not have happened if
the minimum, the front of the plate had been 345 rather
than 325, I understand that. But I would like it put, so
I can understand what it is about.

MS. STEEL: All my questions were directed at was trying to
understand what this represents. It has been put in
evidence and I feel that we have a right to understand what
is the evidence being put in front of court because
otherwise how can we test it?

MR. JUSTICE BELL: I understand that but I feel you have got to
that stage so far as the grill area plates were concerned
       some time ago.

MS. STEEL: I am still not clear when it is expected that the
grill area will be at these temperatures.

  MR. JUSTICE BELL: Ask that.

MS. STEEL: That is what I asked.

MR. JUSTICE BELL (To the witness): What is the answer to that?

THE WITNESS: Sorry, can you just rephrase that question?

MR. JUSTICE BELL: When is it expected that the relevant part of
