as we had hoped they would.

  Q. So what?

  MR. JUSTICE BELL: Well -----

MR. MORRIS: Are you saying that customers,, it is their fault
that this scheme is not working? Is that what are saying?

MR. JUSTICE BELL: No. He is saying they were not very good
       at ----
       A. At separating.

  Q. --- reading what was on the bin or paying any attention to
it I suppose. They threw other stuff in as well.

MR. MORRIS: What implication are you trying to make from that?
       A. I am not trying to make any implication. I am saying
       that half the waste ----

  Q. Are you saying it is the customers' fault?

MR. RAMPTON: I wish occasionally Mr. Morris would restrain his
natural enthusiasm and allow the witness to finish the
answer. He might not have to ask another question.

MR. JUSTICE BELL: Listen to the answer before you ask another
       question.

THE WITNESS: What is the question?

MR. JUSTICE BELL: He has already answered your question twice.

MR. MORRIS: There is no difficulty, is there, as far as
customers taking part in the recycling scheme? If
McDonald's introduce a national recycling scheme in its
stores tomorrow and explain to the customers what was going
on, that would be quite feasible, assuming you were
carrying out your responsibilities at the other end? Is
that correct? People are capable of recycling, are they
       not?
       A. Apparently not in this case.

  Q. So that is the implication then?
       A. That they did not recycle?

  Q. Apparently they are not capable, is that what you are
       saying.

MR. JUSTICE BELL: No, they were not capable -- it is clear to
me the customers in the four Nottingham stores were not
capable if Mr. Oakley's evidence is accurate. If they
could not distinguish polystyrene from paper or carton to
the extent that it was about half and half in the bin, they
clearly were not capable or were not minded to co-operate.
       That must follow.

MR. MORRIS: Or were not encouraged or were not positively
feeling that something was going to be done with it. In
fact, the company was completely incapable of doing any
