Day 032 - 06 Oct 94 - Page 54

enough is served on a tray with a piece of paper on it
that could also contain a lot of information about the
nutrients and food value of what you are eating,
       ingredients.

MR. JUSTICE BELL: Is that a convenient moment?

MR. MORRIS: I was hoping to keep going to make sure --
Mr. Rampton indicated we might finish tonight.

MR. RAMPTON: My Lord, yes, if Mr. Morris and Ms. Steel are
going to finish within the next 10 minutes or so, I will
guarantee I will finish with Dr. Lobstein by twenty past
       four.

MR. MORRIS: I am just trying to get through it as quick as I
can. While we are getting our thoughts together, there
was a disclosure you asked us to put in your references.
I did not understand where it came from. If I pass it up
to you, maybe -- I think it was No. 7, undated, an extract
-- if you could just explain? It may not be relevant at
all. I do not know. (Handed)
       A. Yes. I do not know how admissible these things are,
but I can tell you the source of it is an unpublished
internal report for the Consumers Association.

MR. JUSTICE BELL: Do you want to say something about it,
       Mr. Rampton?

MR. RAMPTON: I have not seen it.

MR. MORRIS: It is No. 7 on the list.

MR. RAMPTON: The difficulty with this is, unless this witness
has had some input into this, it is a little difficult to
see what evidence he can give about it. He can obviously
say: Do you agree or disagree with this statement?

MR. JUSTICE BELL: Tell me what its province is again?
       A. Its origin?

  Q. Can you tell me how this came into being? You started to
       give an explanation.
       A. It is an internal report compiled by the staff of the
Consumers Association on or around 1990 which is mostly
quoting other sources, so did not seem to me particularly
       relevant.

  Q. Mostly quoting?
       A. Other sources than itself, but it did have its own
survey of which this is the relevant -- this is the only
bit I think that they did for themselves, which was to
phone around 10 major fast food outlets in the London
area, seeing what healthier menu options were available.

MR. RAMPTON: My Lord, I do not think it proves anything.

MR. JUSTICE BELL: No, it is a very small sample in any event.

  THE WITNESS: Yes, it is.
