10 Q. Do you know for a fact whether she kept a separate record
11 or is that just an inference that you have made?
12 A. I have just been told that she -- no, I do not know for
13 a fact, no. She never actually told me she kept it
14 separate.

16 Q. Do you know for a fact whether or not you went two years
17 without a performance review?
18 A. Yes, I know that for a fact, I did not.

23 Q. If you had gone even for a reasonable period without a
24 performance review, what would you have done about it?
25 A. I would have just kept on Manager until I had one.

27 Q. I am sorry, you can put that away now, so far as I am
28 concerned. Just look back at your statement and please
29 turn to paragraph 5 on the second page. It is under the
30 heading "Performance reviews". "When I joined McDonald's,
31 performance reviews were given every two months, which
32 later changed to every four months. Prior to the time when
33 I became a Breakfast Manager, I received plenty of
34 performance reviews which were held on a regular basis.

36 From the time when I first became a Breakfast Manager in
37 July 1990 until the end of 1992, I received handwritten
38 performance reviews from both Jane Jarvis and Alan
39 Charlesworth, who were the Store Managers during this
40 period. There were some occasions during that time when my
41 performance reviews were late". Do you remember now how
42 late they might have been, those performance reviews?
43 A. Well, as I say in my statement, I can remember one time
44 when Jane did two together because I think it was not long
45 after she became Store Manager, so there was like a bit of
46 period when she was, sort of, trying to settle in that
47 I had two done together, and usually they are either on
48 time or, perhaps, two, three, it might even be a month
49 later, but I do not ------

51 Q. That is what you tell us at the end of that paragraph: "It
52 has been my experience" -- I expect you can see it there --
53 "that if any of my performance reviews have been late,
54 some may have been two to three weeks late", and now you
55 say it might have been a month?
56 A. Yes, I mean, yes .....

58 Q. "They have always been backdated". When you say
59 "backdated", does that mean that you were paid from the
60 date at which they were backdated?
