Day 173 - 16 Oct 95 - Page 60

wages; they may be people who are living with someone else
and, therefore, quite content that their part-time wages
are a contribution to the family budget.

The fact is, I can see that they are no doubt concerned to
be as well paid as they possibly can be, but it is not
quite the burning issue that it is if it is their sole
source of income. That is just obvious, is it not?

So I have got your point. What I am saying is, I do not
think I can, because someone is handing out that page on
the street, accept that it is right.

  MR. MORRIS: Right. OK.

MR. JUSTICE BELL: As I have said several times today already,
the Labour Court said it did not matter anyway because, as
far as it was concerned, whatever the minority was, a
member of the union was entitled to have its interests
       represented with its employer.

MR. MORRIS: OK. I think we will move on from that.

MS. STEEL: Can I just ask something? Assistant manager, there
would be a floor manager below them, would there?
       A. Yes.

  Q. People would not go directly from being crew members to
being assistant manager without becoming a floor manager in
       the meantime?
       A. Generally speaking, no.

  Q. This petition that you put behind your statement, did you
have any involvement with the petition?
       A. Sorry, may I -- you are referring to this?

  MR. JUSTICE BELL: Yes.
       A. "To whom it may concern"?

  MS. STEEL: Yes.
       A. No.

  Q. You did not have any involvement whatsoever?
       A. No.

MS. STEEL: In that case, can it actually be appendixed to
       Mr. Mehigan's statement?

MR. JUSTICE BELL: It is there, so it is difficult to -- it is
hardly worth taking it out of the bundle. I am not going
to attach any evidential weight to it.

MS. STEEL: That is the main point.

MR. RAMPTON: It is no more than nor no less evidence of the
truth of what is stated than anything that the union said
either. It is in precisely the same condition.

MS. STEEL: When the dispute started, did you take on extra crew
to cover the ones that were on strike?
