Day 166 - 28 Sep 95 - Page 24

if they pass their probation, yes, they will get a yellow
       badge.

  Q. If they fail, presumably, you ask them to leave?
       A. That is right.

  Q. Is that recorded in the ----
       A. Employee history?

  Q. Yes, in the records that you keep of who you have employed
and how long they have stayed and -----
       A. Yes.

  Q. It is. When they get a yellow badge, that is, if they do
not get the push, do they automatically get a pay rise?
       A. No.

  Q. No, right. Do any of them get a pay rise?
       A. Possibly.

  Q. If they were particularly good?
       A. Yes.

  Q. Like a star performer or something like that?
       A. Yes.

  Q. Right. Do you remember there being a shortage of yellow
badges at any stage while you were Manager of the -----

MR. JUSTICE BELL: You mean the actual badges rather than the
       people who wear them?

MS. STEEL: Yes, sorry, that might account for why Mr. ---
       A. I just think he -----

  Q. -- Magill did not get a yellow badge until three or so
       month after he joined?
       A. I just think he is a little mistaken. I mean, he goes
on to say that he had them every -- sorry, PRs, performance
reviews -- every two weeks. With a staff between 100 or so
and 200, if I was having problems doing them on time,
I certainly would not manage to do them every two weeks.

  Q. So there were problems getting them done on time?
       A. No, I did not say that. I would hold my hand up and
say, unfortunately, there is going to be occasions when
somebody would have a review late for whatever reason, be
it my fault, be it an illness, be it bad luck that they are
not on a shift when, say, a Manager was assigned to do
their own review. But if he goes on to say that he had
them every two weeks, I find that highly surprising.
I think he is getting very confused between that and the
       training system.

  Q. You think he may be referring to the OCLs?
       A. That is right.

  Q. Which, of course, are part of the performance review system
but they are also carried out just as a general check as
       well?
