Day 025 - 16 Sep 94 - Page 65

  Q. Forget the mailgram. Go back to page 122.
       A. Yes, sir.

  Q. The first letter to McDonald's to Mr. Horwitz is
April 13th 1987. I hope I have not got that wrong; is
       that right?
       A. Yes, on the face of it, this is a letter from
Sara Nathan, a former colleague of mine, in the New York
       Attorney General's office.

  Q. Did you know about that letter?
       A. I must have done. I saw it when, I think, my
attention was first directed to Exhibit 34. I had not
seen it in what would be now seven years.

  Q. I do not want to make a mistake, but was your letter of
24th April your first communication with McDonald's on
       this topic?
       A. I believe that was the April 10th mailgram.

  Q. That is what I thought. That is why I am puzzled that
I cannot find it in this section.

MS. STEEL: It is page 165.

MR. RAMPTON: Thank you. That is why it is out of order, yes.
4th April -- no, you put your dates the other way around
from us, it is 10th April 1987?
       A. Yes.

  Q. That requests a meeting, does it not?
       A. Yes, sir.

  Q. You cannot remember whether or not there was a meeting?
       A. That is correct.

  Q. Then the first official notification McDonald's gets, a
further notification, is on 24th April, page 131?
       A. The next written letter, not the first official but
the next communication, from us of which I am aware is
       April 24 letter.

  Q. That comes in two forms. It comes in the form of a
letter, what we ordinarily call a letter, which is page
       131; is that right?
       A. Page 131 and following are the letter ---

  Q. Then we see -----
       A. May I finish? -- are the letter and the enclosures
that Attorney General Mattox sent to Mr. Rensi on April
       24th 1987.

  Q. Then if you turn back to page 129 you, apparently, read
over the terms of the letter to somebody at McDonald's,
       would you agree with that?
       A. Without knowing that, I would agree with it. It
certainly is what it appears to be. It is certainly
possible that either I contacted them to say: "We want
you to know there is a letter coming, let me read it to
