Day 139 - 21 Jun 95 - Page 32

aware of were not being watched by the owner/operator; and
that everyone should go back to their systems and processes
that they have, to ensure that all of these laws and
requirements were adhered to, and do a check, and make sure
that they are properly in order; and that they should make
sure that, unlike McCale, that they continued to do it as
they should do it, on a continuing basis.

  Q. What did you say that you had done, as a corporation, as a
       result of this?
       A. That we had sent in some of our people to work with
McCale, to provide additional education, to look over his
systems, ensure that they were in proper order, and that
everybody understood what needed to be done in order to
make sure this would not happen again.

  Q. And that no disciplinary action was taken against the
       management?
       A. Are you saying whether or not we said that to him?

  Q. No. But the effect is, there was not any disciplinary
       action?
       A. There were some serious discussions that took place.
You categorise it whichever way you want to, sir.

  Q. Do you take the violation of child labour laws seriously?
       A. Enormously seriously.

  Q. Do you take it as seriously as -- how long did you spend
there, directly looking through, I mean, involved in that
       situation?
       A. I sent my people there. I did not personally go --
because it was a matter of examining records, examining
systems, letting me know what they had found and then
receiving direction from me. I did speak with the
owner/operator by telephone, but I did not physically go
       there.

  Q. It was not as important as an union dispute, then?
       A. It was every bit as important; frankly, more
important. But there are certain things you can do through
records and data, and there are certain things you need to
do when you are there. I was not handling -- we were not
handling the matter before the agency, the local agency, so
there was no reason to go. Everything that I needed to
know came from records, my people, or the owner/operator.
The owner/operator was not contesting anything; he was
asking for help: "Tell me what I need to do and I will do
       it."

MR. MORRIS: I am going to sit down for a moment.

MR. JUSTICE BELL: Yes. Are you going to move on to another
topic, or are you just checking?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: We will break off now and resume at five to
       two.
                       (Luncheon Adjournment)
