Day 105 - 16 Mar 95 - Page 17

young children and very old people, the symptoms,
I understand from the doctors, can be much more serious.

MR. JUSTICE BELL: Let us have our five-minute break there.

I would like you to consider, Mr. Morris, the extent to
which very broad questions are really going to help with
Mr. Bennett. The reason I say that is that this is not one
of those areas where you do not particularly have a witness
of your own, so you are searching with a McDonald's witness
for information which you think might be there.

You are going to call Ms. Hovi and you have material which
you are expecting to come out there, hard material, you
anticipate, which she could deal with.

MR. MORRIS: If it is any help we certainly -----

MR. JUSTICE BELL: Whatever conclusion I draw on the evidence as
to what happens at Jarretts, having heard both Mr. Bennett
and Ms. Hovi, at the end of the day, it is only common
sense is going to likely affect me more than
generalisations which might or might not apply to Jarretts
or McDonald's generally. Anyway, think about that and we
will have our five-minute break now and you can find the
       document you want.

MR. MORRIS: We are not expecting this questioning to continue
beyond Friday. Certainly we will finish this week.

MR. JUSTICE BELL: I was not particularly turning my mind to
that, just what at the end of the day is likely to be more
       or less productive.

                      (Short Adjournment)

MR. MORRIS: You said you held a basic hygiene course for the
       management that they asked for?
       A. That is true.

  Q. I cannot remember exactly when that was. When was that
       exactly, during the HACCP introduction?
       A. No, that followed that. The HACCP came first and, if
memory serves, it was October 1994.

  Q. How long was the course?
       A. Six hours.

  Q. Six hours?
       A. Well, the total introduction, lecture, exam, then the
marking up, that totals six hours.

  Q. They passed the exam and they got some kind of -----
       A. Yes, they were rewarded with a Basic Food Hygiene
Certificate of the Environmental Health Officers'
       Association.

  Q. I am trying to go through what you said in-chief and your
statement. It is in a different order and the documents
are in a different order still, so it is a bit difficult to
