2 Evidence Notices on them but they are abroad, so far as we
3 know.

5 MR. RAMPTON: So, my Lord, that leaves in effect, and there are
6 two journalists, Mr. Pattinson and Harriette Lamb.

8 MR. JUSTICE BELL: Pattinson, is it not?

10 MR. RAMPTON: Pattinson, yes, he is the Daily Mirror person, and
11 Harriette Lamb who was working at one time for somebody
12 called Transcontinentals or something.

14 MS. STEEL: She also worked for McDonald's.

16 MR. RAMPTON: So if you take little bit out Harriette Lamb for
17 McDonald's that is five people that I have to deal with
18 specifically. As I say, I can do that quite economically,
19 particularly since I think two of them, Alimi and Harrison,
20 were from the same restaurant, Colchester, at the same
21 time. That can be dealt with by one lot of evidence.

23 My Lord, as time passes it is going to become more and more
24 difficult for me to respond to last minute indications from
25 the Defendants that so and so is after all coming to
26 court. I do not know what has been happening these last
27 however many weeks -----

29 MR. JUSTICE BELL: No, in a moment I am going to ask Mr. Morris
30 about telephone communication. I also want to talk to him
31 or Ms. Steel about any further Civil Evidence Act notices
32 if, as he indicated yesterday, some of the potential
33 witnesses may be abroad.

35 MR. RAMPTON: My Lord, whether I should sit down now; there is
36 one other matter which is again -----

38 MR. JUSTICE BELL: I am not going to make a decision on the
39 argument today. I would like to hear from Mr. Morris about
40 telephone communication he has had. Then I am going to go
41 away and remind myself of the evidence of all the witnesses
42 he has named, the ones he named yesterday and the ones he
43 may name in a moment or two.

45 MR. RAMPTON: My Lord, I am not really asking for a ruling today
46 but I may be driven to it in due course. What I am really
47 asking your Lordship to allow me to do is to say that I am
48 not obliged to schedule any other witnesses than those who
49 will deal with the people who have been named at the
50 present time.

52 My Lord, the other thing which I might usefully mention now
53 before I sit down is that it is becoming, if I may say so,
54 a matter of some importance, the Defendants' estimate of
55 cross-examination.

58 if Mr. Morris and Ms. Steel can help me in relation to
