Day 255 - 23 May 96 - Page 28

What I would invite you to do is spend a few minutes of the
hour you are now going to have just seeing whether you need
to go through absolutely every one of them. So far as the
point whether it came from Greenpeace or not, I would
suggest you have put enough of that to Mr. Nicholson
because he has, in effect, said he does not know. He has
no evidence to add as to whether there was a network of
communication under these manifestation of these
allegations and, so far as the question of whether it was
lifted from London Greenpeace, I can judge that for myself
       if I look at them.

MS. STEEL: I am trying to go faster and speed up.

MR. JUSTICE BELL: That may be but see in what way you can edit
it because you have made it clear what your points are and
one does not have to inspect every hole in the ground to
see whether it is any different from the last one.

  MS. STEEL: OK.
                       (Luncheon adjournment)

MS. STEEL: Thank you for the time to serve the appeal.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Mr. Nicholson, to try and save a bit of time, do you
still have the "words complained of" bundle?
       A. Yes.

  Q. From tab 25, The Morning Star, 16th October 1989?
       A. Yes.

  Q. Tab 26, BBC Sheffield, 16th October 1989; tab 27, News
Shopper Bromley and Hayes, 18th October 1989; tab 28,
Sunderland and Washington Times, 19th October 1989; tab 29,
Somerset County Gazette, 20th October 1989; and tab 30,
Richmond and Twickenham Times, 20th October 1989, and the
date of action for those ones was between November 1989 and
       February 1990.

Can you just flick through those and see whether you
       remember any of those?
       A. Not The Morning Star, not BBC Sheffield, well The News
       Shopper is obviously just a letter from -- no, nothing;
Sunderland and Washington Times no, sorry. Did you say 29,
       as well?

MR. JUSTICE BELL: Up to and including 30?
       A. Up to and including 30. No. I mean, some of these are
so short, no. 30, no. I would not be able to help you with
       that after all this time.

MS. STEEL: Right. Tabs 31 to 35, Sheffield Journal, 10th
       October 1989; The Lowestoft Journal, 20th October 1989;
Time Out, 25th October 1989; Best Magazine from November
1989; and One Little Indian, November 1989. Date of action
between November 1989 and February 1990.
