Day 169 - 04 Oct 95 - Page 23
restaurant, somebody who has been in the restaurant almost
eight years and who attends Managers' meetings regularly, I
would expect to be told of such instances at Managers'
meetings. And as someone who fills in the incident report
forms myself, I would expect to notice such incidents in
the report forms book and I am unaware of these incidents.

Q. So are you saying that ------

MR. JUSTICE BELL: Quite frankly, I cannot tell you just how to
do your case ---

MR. MORRIS: I was going to call the man a liar but I ------

MR. JUSTICE BELL: -- I will be quite candid with you. You have
to cross-examine, but I think there is a public
misconception about the value of cross-examination.
Sometimes it is very valuable, sometimes you can go on and
on cross-examining and it just makes one wonder why they
are not getting on and calling their own witnesses. What
I want you to do is challenge what you have to challenge,
test with some economy the witnesses called by McDonald's
and then get into your own witnesses side and hear what
they have to say.

MR. MORRIS: As I was saying, I was going to challenge the

trying to make absolutely clear what he is saying.

MR. JUSTICE BELL: If you can score big points in
cross-examination, well and good; if you cannot, let us
hear what your witnesses have to say.

MR. MORRIS: OK. We are nearly finished -- just checking.

MR. JUSTICE BELL: Shall we break until 12 o'clock and then see
what is left?

MR. MORRIS: Yes, please.

(Short adjournment)

MR. JUSTICE BELL: I just want to make a note of something
before we go on, Mr. Morris. Yes?

MR. MORRIS: I have to ask you this, Mr. Richards: Regarding
your evidence about removing the trip switch and the
rigmarole you went through every time the RCD system failed
and the extensive checks you made each time, you are lying
about that, are you not?
A. No.

Q. Regarding the extensive procedures you implemented every
time to check on the internal temperatures of food
products, you are lying about that, are you not,
Mr. Richards?
A. No.

Q. Regarding the lack of complaints about uncooked meat
products being made by customers to the store, you are
