Day 192 - 27 Nov 95 - Page 19
A. First week, anyway.

Q. One question: you said about this meeting you had with Pete
Mortson -----
A. It was not a meeting; it was just a get-together. It
was just Christmas time; we were sitting round the
Christmas tree.

Q. Did he work at the store?
A. Yes. He was a Swing Manager there.

Q. Right. I think in your second statement you mentioned
something about an incident when you were taken off
drive-thru. Can you just explain when that was and what
happened?
A. I believe that was late July of 1993, when
Patty Galbraith -- I do not know what her married name is
now, but she was the Store Manager -- took me into her
office and told me that I would be suspended for drive-thru
for a while -- it was an indefinite amount of time; she did
not give me until when -- because she felt that I did not
smile enough. But I was placed on counter, where I was
still dealing with people.

Q. How did you feel about that incident?
A. I did not understand why she had done this. She did
not give me any reasons, other than not smiling. She did
not give me any situations which I should be disciplined
for. Of course, I was upset, because if you are taken off
a station or whatever, it is shows up on your performance
review which is done biannually, I think, twice a year. It
shows that you are not on the station any more. So,
therefore, it is a decrease in your pay increase that you
are supposed to get.

Q. Can I just ask a question, as you have brought that up,
about pay increases? You worked there for three years, and
you say that you ended up something like five cents over
the minimum wage?
A. Yes. I do not know exactly. It could have been like
10 cents. It was not much.

MR. JUSTICE BELL: I had completely missed that, which shows the
difficulty. I have made a note that you finished at
$6.30.
A. Yes. It was around there. I cannot say -----

Q. How much was that above the minimum wage?
A. I believe it was about five cents above it. But I do
not know exactly how much the minimum wage was then.
I cannot remember.

MR. MORRIS: So, how was it that, after a number of performance
reviews, that for three years you were still only something
like five or 10 cents above the minimum wage?
A. What happened was, because the left wing party was in
provincial power, they increased the minimum wage a couple
of times at least; and when they increased the minimum
wage, I would lose my pay increase, so I would just be
making the same wage as, like, new employees, like, the
