Day 265 - 19 Jun 96 - Page 53

MR. JUSTICE BELL: Well, yes, but if you are putting it to him
positively that was wrong, then do that. It sounds as if
you are repeating his evidence when it is not, in fact,
what he said, the way you put the matter. Someone
listening to what you have just said might think he had
said in evidence in-chief that he made the notes in his car
or went back to the office. That is the way it came out to
       me.

  Q. Well, I was asking a question. Did you make your notes in
the car or did you make your notes in the office after
       driving back to the office?
       A. The notes were made in my car either where it had been
parked, or I would drive away from the venue so as not to
be seen in my car by anybody in the group. So I would
drive a couple of miles away.

  Q. Did you ever go back to the office after meetings or was it
you were always making the notes in the car?
       A. No, I did not. I made them in the car.

  Q. Be it where the car was parked or ten minutes later?
       A. That is right.

  Q. And you never waited until you had got home? I asked you
       about the office?
       A. No.

  Q. But you did not go anywhere else to make them?
       A. Not that I recall.

  Q. They was always in your car?
       A. That is correct.

  Q. So it would always be within ten minutes of leaving the
       meeting?
       A. Thereabouts, sir.

  Q. Were you basically really only bothering to write down that
       was said about McDonald's?
       A. No. It was what happened. Who was there. Primarily
obviously with McDonald's; they were the clients as such.
But, yes, whatever really took place.

  Q. What, you would try and recall the whole meeting?
       A. Well, not the whole meeting but pertinent parts of the
       meeting.

  Q. Right. Which was generally the antiMcDonald's stuff?
       A. And if that was not discussed, what else?

  Q. If that was not discussed what else? Sorry?
       A. Whatever else was.

  Q. But you were making a particular effort to get everything
       down whenever McDonald's was mentioned?
       A. An effort to recall whatever was discussed,
       McDonald's.

  Q. And you would make a particular effort to recall what was
