Day 053 - 22 Nov 94 - Page 52

MR. JUSTICE BELL: Yes. It seems to me it is important that we
have Ms. Dibb, Mr. Mallinson, Mr. Stump, Professor Ashworth
       and Mr. Oakley.

MR. RAMPTON: My Lord, the only thing I would say about that is,
I think Mr. Stump has been moved, so Tuesday morning is now
free. I do not know how much longer the Defendants are
going to be. My fear is that if we break off now, as it
were, we will get much of the same as we have had today
       again on Tuesday.

MR. JUSTICE BELL: Are you suggesting we have can finish by half
       past four?

MR. RAMPTON: My Lord, I have only about two things to say. I
do not know how much longer the Defendants are going to
be. What I will do so as to abbreviate my reply (which
will be about five minutes) is to give your Lordship some
references from the evidence of Dr. Barnard.

MR. JUSTICE BELL: What I would like to you to do, because you
should be able to do that, is there any reason why you
cannot finish your submissions in relation to F within the
       next few minutes?

MS. STEEL: The problem is, I mean, basically I am more or less
finished, but it is just that -- I am sure this is a common
problem -- because I know what my state of mind was at the
time, it feels frustrating that I cannot convey that.
Really, I am wondering about further examples.

MR. JUSTICE BELL: I am going to break off this application
now. I know Mr. Rampton will be ready to go at very short
notice back to it; I want you to be ready to start again
whenever we find we have an interlude in the evidence
within the next few days. I would like you to give a bit
of thought to how much more you have to say in relation to
F and also how long it will take you to deal with L,
because it is not -- Mr. Rampton has indicated -- going to
take him very long to reply, then you have made your
submissions and I will go away and think about the matter.

MR. RAMPTON: My Lord, could I ask that if there is to be an
interruption in this application which there now is, and
Ms. Steel is intending to search through the transcripts
for further references which may, she may feel, support her
argument, that as I have done with them, the Defendants
manage to persuade themselves to let me have, or us have, a
list of those references in advance because that always
saves time, as well as being a question of equality and
       fair play.

MR. JUSTICE BELL: If you do want to refer to particular parts
of the transcript, put them on a list, it can be in long
hand, it does not have to be typed up. All it need have is
the name of the witness, the date and the page, preferably
the lines, just like McDonald's list had. Apart from
anything else, that can be handed to me at any time, it
does not have to wait until we come back to it, I can look
