     1   MS. STEEL:   That is the first one?
 
     2   MR. RAMPTON:  The first one.
 
     3   MR. MORRIS:  There are two others, are there not?
 
     4   MR. RAMPTON:  Yes, there are.
 
     5   MR. MORRIS:  So are we including them all?
 
     6   MR. RAMPTON:  No, I think for the moment just include the
              first.  How far we need to take the second as read, you
     7        will see in a minute when I have asked about McDonald's
              food.

         MS. STEEL:  If we want to take the first one as read, please
     9        can we have copies of all the studies that are referred to
              in it?

         MR. RAMPTON:  My Lord, the reference to the Finnish study is a
    11        study referred to -- I will give the reference,
              Dr. Arnott's references No. 21, which is a paper
    12        entitled:  "Environmental Dietary Factors in Colorectal
              Cancer" by a team who have done a lot of work in this
    13        field, Ernst Wynder, Bandaru Reddy and others.  Its date
              is 1991.  It makes reference to the Finnish study
    14        I mentioned which is Reddy, Hedges, Laakso and Wynder
              1978.  It is reference 6 in that paper by Wynder, Reddy
    15        and others.  Page 496 is where they report what the
              Finnish study finds.

         MS. STEEL:  I am not clear.  Does that mean that the Finnish
    17        study is in that file?
 
    18   MR. RAMPTON:  No, it means that the Finnish study is not in the
              file; no doubt it might be found but not by us.  Thank you
    19        very much.
 
    20   MR. JUSTICE BELL:  What is the position with regard to the
              Finnish study because this witness has referred to it?

         MR. RAMPTON:  He has read it.  It was my fault; I referred it
    22        to him because I had a memory of it from Professor
              Walker's reference.

         MR. JUSTICE BELL:  Yes, but are the defendants not entitled to
    24        have the reference and, if at all possible, a copy so that
              they can check?

         MR. RAMPTON:  The trouble is, your Lordship knows how the 
    26        system works, experts in these fields do not have the time 
               -- it would not be humanly possible; they would have to 
    27        look at thousands of years -- to do the research
              themselves.  What they do then is review existing
    28        authority on the subject and then come to a conclusion.
              Each of those papers builds on the existing body of
    29        authority, so that when at the top of the pyramid the
              latest report is produced, there is underlying it
    30        literally hundreds of thousands or, at any rate, thousands
              of pre-existing studies.
