Day 060 - 02 Dec 94 - Page 32

       A. Public concern, yes.

MR. JUSTICE BELL: What is being put to you is, by the same
token as it was wrong to put September 1988 in the
penultimate line on page 6 because you, in fact, took the
       decision in the previous year?
       A. Right.

  Q. And sometime in the summer of the previous year?
       A. It was before Montreal, yes, OK.

  Q. By the same token, it was before rather than after the
       Montreal Protocol?
       A. That is correct, yes, that is correct.

MS. STEEL: The decision to change was made after publicly
expressed concerns about the use of CFCs in packaging
causing damage to the ozone layer.
       A. Where is this?

  Q. I am putting that to you.
       A. Oh, sorry, say it again.

  Q. The decision made by McDonald's to change and stop using
CFCs was made after publicly expressed concerns about the
use of CFCs in packaging causing damage to the ozone layer?
       A. Absolutely wrong.

  Q. That is wrong?
       A. Yes.

MR. RAMPTON: It depends whether Ms. Steel means "after" or
       "because of".

MS. STEEL: The witness has said it is wrong, full stop.

MR. RAMPTON: Yes, I know, but maybe he did not understand the
       question.

MR. JUSTICE BELL: It must have been after the expression of
some public expressed concerns, because the concerns of the
Antarctic expedition were publicly expressed, very publicly
expressed. It was as a result of that public expression
that you took the attitude you did, you told us?
       A. I agree with "some", but that is not what was said.
You did not say "some", you said "public concern".

  MS. STEEL: "Publicly expressed concern".

MR. JUSTICE BELL: No, that was the difference. It was "public
expressed concern" rather than "public concern". It may
have been, I cannot say what was in Ms. Steel's mind when
she asked the question, but those were the words she used.
Put it another way. We have got slightly at cross
purposes. It may amount to the same thing. Shall I try
and then you take it on?

  MS. STEEL: Yes.

MR. JUSTICE BELL: There have obviously been publicly expressed
