Day 298 - 11 Nov 96 - Page 18
consumption of McDonald's food, that that is more than we
would have to prove by any standard, because we don't
believe we have to show that anyway, but even if you think
that we have to, it is the link between consumption of
McDonald's food itself and people's diet, that we only have
to show that some people consume such a substantial amount
of McDonald's food, like three times a week or six times a
week, that it may make their diet high in fat, sugar,
animal products and salt.

MR. JUSTICE BELL: Why do you say that?

MR. MORRIS: It is what you have said ----

MR. JUSTICE BELL: The meaning I have taken is because eating
it may well make your diet high in fat, and that is the
best I could say, because the leaflet does not say that if
you eat a lot of it, it may. It is completely silent about
whether you have to eat a lot of it or not.

MR. MORRIS: Yes. So what I am saying is that in your meaning,
which I am working from now, you say because eating it may
well make your diet high in fat, sugar, and animal
products, all I am saying is that if you think we have to
show that some people have eaten a substantial amount of
McDonald's food to influence their diet, that we only have
to show, if we do, that some people eat a substantial
amount of McDonald's food so that it may affect their
overall diet in -----

MR. JUSTICE BELL: That is what you say is actually happening.
The meaning does not -----

MR. MORRIS: We are saying it does ----

MR. JUSTICE BELL: What the leaflet does not say and what the
meaning does not say is that a certain proportion of people
eat an awful lot of McDonald's food, and because they do
so, they may well make their diets high in fat with the
undesired result. It does not spell that out, does it, by
my interpretation? It just says eating it may well make
your diet high in fat.

MR. MORRIS: Yes. We are saying the leaflet does not say that
at all. Obviously it just talks about diet.

MR. JUSTICE BELL: Well, you are stuck with my meaning.

MR. MORRIS: I know. All I am saying is on your meaning you
use the word "may", not because eating it will make your
diet ----

MR. JUSTICE BELL: May well make your diet high in fat.

MR. MORRIS: Yes. What I am saying is we have to show that
some people eat -- McDonald's food plays a contribution to
an extent where it may, for those people, affect their diet
in a negative way. So we do not have to haul somebody into
the witness box to say "I have been eating McDonald's food
seven days a week". We have to show that some of these
