Day 188 - 15 Nov 95 - Page 63

concerned over working conditions anyway, but that he is
also concerned to seek the views of other staff, presumably
with a view to improving their conditions as well as his
own, and I think that is, therefore, relevant to the frame
of mind of people that are trying to organise trade union
activity at McDonald's, that they gather information from
       other people.

So, really, that one is a matter of principle rather than
the -- I do not think not having it in there would make our
case weaker, but it seems to be a principle there that it
is reasonable to understand the motivation of why people
want trade unions, which has been accepted in this case as
being an important aspect of the trade union issue; for
example, if they -- well, that is all really. I think that
       is everything.

MR. JUSTICE BELL: Yes, thank you.

(Please see separate transcript for ruling)

MR. JUSTICE BELL: Let us turn back to the beginning then.
What I suggest you do, if you have had time to cross out
the bits which I have ruled inadmissible, is for you to
read what is left in the statement which is, indeed, the
vast bulk of the statement and the continuation statement.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Do you want to read it out or take it as
       read?

MR. MORRIS: We would like to read it out. Helen is going to
do it today. Everyone is sick of my voice!

MS. STEEL: "Proof of evidence of David McGee". I do not need
to read out the address, do I, because I do not think he
lives there anyway, or should I read out the address?

  MR. JUSTICE BELL: The?

MS. STEEL: The address; it does not matter, does it?

MR. JUSTICE BELL: I think you excluded it.

MS. STEEL: He has moved from that address.

MR. JUSTICE BELL: Start, "I, David McGee, will say", and then
carry on from, "My date of birth".

  MS. STEEL: Right.

"My date of birth is 1st September 1967.
I worked at Seven Sisters Road, McDonald's, from
November 1986 to July 1987. When I started work
there I started as a 'green badge'. The order
of rank from bottom upwards was green badge,
yellow badge, white badge and then management.
There were very few white badges in my store. A
white badge was verging on management.
