Day 179 - 30 Oct 95 - Page 16
not sought leave and he needs it.

MR. MORRIS: I am going to ask him to explain what he means in
the statement.

MR. JUSTICE BELL: There is nothing in his statement which I do
not understand at the moment, so tell me what it is you
have in mind. Perhaps a lot of people in your position
would, having got this far, leave it well alone.

MR. MORRIS: What the shift running floor Manager, what he was
doing, his responsibilities were, what times of shifts he
was aware of, or was on, the paperwork.

MR. JUSTICE BELL: Just take it steadily because you are asking
me to say: "Yes, you can ask about these things", so just
go through them.

MR. MORRIS: All right. The paperwork that he had to do, what
he was trained to do -- I think we have dealt with Milton
Keynes -- how these targets were set that he refers to in
his section 1, and ask him to explain about the watering
down of food, what he means for the specific items that
Mark Davis went into at great length, what does he mean by
squeezing the fry cartons.

MR. JUSTICE BELL: That does not need explanation.

MR. MORRIS: No, Mark Davis dealt with that.

MR. JUSTICE BELL: What I am anxious that you should not do is,
having elicited the evidence in a written statement, just
go all over it again.

MR. MORRIS: No, I understand that.

MR. JUSTICE BELL: Subject to anything Mr. Rampton says, what I
have certainly got no objection to is you putting what you
have heard Mark Davis say about these matters. For
instance, reasons why it would not be sensible for this
practice to occur with regard to watering down, and matters
of that kind.

MR. MORRIS: Yes. I cannot remember the individual quotes of
Mark Davis, but I remember that it was dealt with in great
detail.

MR. JUSTICE BELL: Yes, but what I do not want you to do is just
say: "Would you like to expand on that?" because
I understand what is happening, the evidence which has been
given. What I am saying is if you do remember something
Mark Davis said about it and want to put that, then I have
no objection. But what I do not want you to do, because
I do not think it serves any useful purpose, is just go
through the statement saying: "Would you like to say more
about that?"

MR. MORRIS: I asked him to explain what he means on specific
things I do not think there is any harm in that.
