     5        out of the action over the Chicken McNuggetts adverts,

     9        that?

    15   MR. MORRIS:  I did read it this morning, but I have forgotten;
    16        something along the lines that it may have been -----

    18   MR. RAMPTON:  My Lord, I think it very likely that Mr. Gardner
    19        can say anything about the Chicken McNuggetts issue.

    21   MR. JUSTICE BELL:  Do you know anything about any Chicken
    22        McNuggetts furore?
    23        A.  Yes, your Lordship.

    25   Q.   Of your own knowledge, or from what you were told by
    26        someone else?
    27        A.  A little bit of both, your Lordship.  I believe that
    28        the information regarding Chicken McNuggetts had been made
    29        available to me through the same consumer group that
    30        brought it to the attention of the New York Attorney
    31        General.

    33   Q.   But did you have any contact with McDonald's about Chicken
    34        McNuggetts?
    35        A.  No, my Lord, I did not.

    37   MS. STEEL:   OK.  I presume that means we cannot go into it?

    39   MR. JUSTICE BELL:  Just tell me what it is you want to put.
    40        What is the evidence you would like to get Mr. Gardner to
    41        give, if it is legitimate to do so?

    43   MS. STEEL:   Whether the agreement to produce brochures in
    44        New York came out of the threatened action by the New York
    45        Attorney General when they threatened to sue them over the
    46        Chicken McNuggetts adverts for them being deceptive, and
    47        whether the booklets came out of discussions arising from
    48        that.

    50   MR. JUSTICE BELL:  Do you have any information about that 
    51        topic?  Just answer "yes" or "no". 
    52        A.  Yes.

    54   Q.   Where did the information come from?  Was it something you
    55        were told by someone else?
    56        A.  Yes, your Lordship.  It was in conversations with
    57        members of the New York Attorney General's office.
