whole of article 1 and then all the other articles to see
just what the extent of the alleged advice is.

MR. MORRIS: I think my recollection is that (and it may be
biased, of course) Professor Walker accepted there was a
body of evidence for allergies from a number of these
       compounds.

MR. RAMPTON: My Lord, it may be helpful, if Mr. Morris is going
to do things from recollection, if we try to avoid that
trap by turning to page 24 and following of the transcript
of Day 26 which is Monday, 19th September 1994.

MR. JUSTICE BELL: Yes. I have left my transcripts in my room.

MR. RAMPTON: I am sorry about that, because one can see what
Professor Walker says about every single one of these
substances seriatim, and that was at your Lordship's
urging. In this case, for example, he says that there is
an allergic reaction known so far as Sunset Yellow is
concerned. I asked (and perhaps it was a
leading question) -- no, he said "It is rare" and I said:
"It is rare?" He said: "It is relatively rare; it is not
serious and it is reversible." "Is it a bit like having a
stomach upset?" "Only in extreme cases. I mean, most
people would not have the gastric upset and vomiting,
although they may have hives." "Hives"" say I; "Yes", he
says, "nettle rash type", and so on.

One can find his account for each of these allergic
reactions in his evidence on those pages. So it is best
that Mr. Morris does not, as it were, try to do it from
       memory.

MR. JUSTICE BELL: Can I just use that as an example?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: That is evidence which gives some picture, in
general terms, as to the prevalence or otherwise of a
reaction which the witness is accepting. What I need to
know is whether you are meeting that with some contrary
view expressed by, in this case, Dr. Millstone and, if so,
the extent of the difference and how particular
       Dr. Millstone can be.

What I was trying to point out by referring to that
paragraph on page 9 of Dr. Millstone's statement, which
ends up with the one referring it to the footnote, is how
often and to what extent it has been shown. Then I can
match it with Professor Walker's evidence. This is not
meant as a criticism of Dr. Walker. I do not know yet of
course what I will say about his evidence. But "certain
azo-dyes, including Sunset Yellow and SCF, have been shown
to be associated with hypersensitive reactions in man" does
not tell me at all whether that is something someone of
ordinary sense and fortitude ought to be concerned about or
not. Do you understand? Sit down a moment and think about
       it.
