Day 034 - 11 Oct 94 - Page 48

what the document was is so that the witness could do it
with an open mind. I have not had days and days of
discussion with each of our witnesses to prepare them for
material we want to put to them.

MR. JUSTICE BELL: It is entirely up to you whether you put it
or not. Quite frankly, I do not think there is a
significant risk that any of the witnesses who come here
as experts are going to be unduly affected by where a
statement comes from. If they are particularly going to
be, it is because they come here already committed to one
view or another, whichever side they are giving the
       evidence on.

MR. MORRIS: OK. If this can be handed up?

MR. JUSTICE BELL: If they are sceptical because they are
committed scepticists or they are enthusiasts because they
are committed enthusiasts, otherwise (and it seems likely
to me) the witness is just going to give an honest
response of what their view is. So, do not be deterred.
You are not going to be worse off if you put it, are you?

MR. MORRIS: If we can just hand it to the witness? It has
marks on it but it does not really matter.

MR. JUSTICE BELL: Do I have a copy of it?

MR. RAMPTON: My Lord, I am sure it would do if Mr. Morris just
       read it out.

MR. MORRIS: I was going to. (To the witness): This is a
document produced by McDonald's. Can you just read it,
the left-hand side of the page?

MR. JUSTICE BELL: Do I have a copy of it?

MS. STEEL: Volume VI, Nutrition, pink volume VI, No. 3, 4 and
5 -- it does not matter which version -- and internal
       page 12.

MR. MORRIS: It is the page, the section with: "What else is
needed for a healthy diet?". If you can just read from
"In recent years" at the top?
       A. OK.

  Q. Just under the top?
       A. Down to the headline, "What else?"

  Q. Down to the bottom of the page. If you want to make any
       comments?
       A. Yes, well, the page simply states what has been known
for quite a period of time (and is commonly accepted) that
there is, as they say, a considerable amount of evidence
linking dietary factors which they describe, a lack of
fibre and an over abundance of fat, salt and sugar in the
diet of western countries, linking those factors with the
diseases that they have mentioned, and I certainly believe
       that those are reasonable conclusions.
