Day 241 - 26 Apr 96 - Page 18
but not the truth of what the Wages Inspector said to her.
How much, if any weight, I attach to her evidence is
another matter.

Mr. Howes has not been mentioned, but it seems to me only
right I should hear his evidence, for whatever I make of
it, with regard to alleged publication of the leaflet to
visitors to court on 13th June 1994.

MS. STEEL: I just realised I have not got his statement in
front of me and I had forgotten about him.

MR. JUSTICE BELL: That is what he dealt with. Did you want to
say something about that?

MS. STEEL: Because I remember the Plaintiffs bringing it up at
the time and seeing as it is a solicitor from their own
offices, I do not see why they could not have got a
statement at the time which we then could have got advice
about and maybe got statements if necessary. Now
basically, I cannot even remember who was sitting anywhere
in the court two years ago. Well just the point, you know
he was from their offices and they could have served this
statement two-and-a-half years ago.

MR. JUSTICE BELL: I think it is a matter I should hear if the
Plaintiffs want to put it before me. Better, it seems to
me, that the evidence be heard before anything is put in
cross-examination to either Ms. Steel or Mr. Morris along
those lines if, in fact, they give evidence.

Either now or fairly shortly I would like you to take stock
of who you need leave for. No objection has been actually
made so far with regard to the witnesses who have been
served, so it is highly likely I will grant you leave but
for the avoidance of doubt it is better they should be
listed.

MR. RAMPTON: Your Lordship spotted one of my rare descents into
the playground whenever we last discussed this and called
it tit for tat and, indeed it was. I have no objection to
any of this.

MR. JUSTICE BELL: What I think though so there is no
misunderstanding, in the light of that you need not
actually make the application today, if you have not got
your list, but I think some time pretty quickly you had
better. Just in case there is any misunderstanding.

MR. MORRIS: Yes. Can we just -- it is just that all our
witness statements -----

MR. JUSTICE BELL: If you like what I will do, I will give you
leave for you to call any of the additional witnesses whose
statements you have handed to me in open court.

MR. MORRIS: I think you should everything basically, so
I assume -----

MR. JUSTICE BELL: It is merely my suggestion if you make a list
