Day 170 - 05 Oct 95 - Page 23
what it is.

MR. MORRIS: That is what it is.

MR. JUSTICE BELL: In fact, I will not shut my mind to anything
you have to say but, at the moment, I do not anticipate
being the least bit interested in whether McDonald's could
have brought the action in the United States or not. The
fact is there is a valid action in this country which
I have been called upon to adjudicate upon, and that I will
do.

So, on the one hand, do not be concerned that Mr. Beavers
may have said they could have brought it in the United
States. What I will do, as a matter of interest (if no
more), I will read that letter but, at the moment, among
all the real issues in this case, that was not one which it
seemed to me was relevant to decide at all.

MR. MORRIS: OK.

MS. STEEL: I went to the Plaintiffs' solicitors' offices
yesterday to look at the Operations and Trainings Manual,
and I marked up the pages which I felt were relevant and
that we wanted copies of, and actually I did not have time
to go through the whole of it. I might have to go back
again. But there were some which I thought were possibly
relevant to Mr. Fairgrieve and I asked that they be
provided. I actually asked if they could provide them
yesterday, and I spoke to Mr. Hill and he said they could
not do them yesterday but they were trying to sort them out
for today to bring them to court, before court ended
today. I did say I thought that would probably be before
lunch.

Now, I have just asked Mrs. Brinley-Codd and she did not
know anything about it, but ....

MR. JUSTICE BELL: How many pages were there altogether, can you
remember?

MS. STEEL: The ones that I actually asked for today were, there
were 50 in total.

MR. RAMPTON: May Mrs. Brinley-Codd just find out? If they are,
I was going to suggest that Ms. Steel goes home via Barlows
and picks them up.

MR. JUSTICE BELL: She is going to see counsel this afternoon.
I would have thought something could be fixed up.

MR. MORRIS: Especially as the Plaintiffs are under orders to
disclose relevant material----

MR. RAMPTON: No, Mr. Morris must not keep saying that,
my Lord. It really is terribly annoying. Our obligation
is to make discovery and to give inspection and to make,
talking about strict obligations which Mr. Morris appears
to think that he is, and to make such copies of such parts
of a relevant document that has been inspected that the
