Day 142 - 26 Jun 95 - Page 42

  Q. -- for the region of northern Germany. In 1985 she was
moved to headquarters, the national headquarters, in
Munich. She took over responsibility for personnel in
Germany on a nationwide basis in 1986.
       A. That would be correct, my Lord.

MR. MORRIS: If we go to the letter from the NGG Union?
       A. OK. Can you tell me where that is?

  Q. It is at the back of her statement. I cannot read the name
very well, Burchard Bosche, I think, Dr. Burchard Bosche?
       A. We are talking about something in German right now?

  Q. Yes, behind it, though, it has a translation. Do you have
the translation which is McDonald's translation?
       A. Yes, it appears to be the same thing only in English.

  Q. Yes, sorry, Dr. Burchard Bosche?
       A. OK.

  Q. From NGG Headquarters. Do you know what his position is?
       A. No, I do not. I do not know this man.

  Q. He says in that first sentence: "We hereby confirm that,
since the end of 1986, the relation between McDonald's and
the union NGG have changed fundamentally"?
       A. Help me a second; where are you reading from?

  Q. That is the first paragraph in that translated letter.
       A. What I have here is, "Upon Mr. Heyll's"?

  Q. Yes, sorry, I just missed that out.

MR. JUSTICE BELL: Yes, the end of that line.
       A. OK.

MR. MORRIS: "We hereby confirm that", etc.
       A. OK.

MR. JUSTICE BELL: We can read the letter. What is it that you
want to put to Mr. Stein?

MR. MORRIS: He says in that paragraph: "The question of the
correct standard pay was, for the first time, clarified
together in an agreement concluded for the Frankfurt France
stores in 1987. Since then, works councils have been
elected in some McDonald's stores". So, is it the case
that before 1987 works councils were not elected in
       McDonald's stores?
       A. That is not correct at all, sir. There were works
councils in McDonald's stores prior to 1987.

  Q. What, in all McDonald's stores?
       A. This says: "Since then works councils have been
elected in some McDonald's stores", and I know that prior
to 87 there were works councils in some McDonald's stores
       as well.

  Q. When did works councils start to be elected in McDonald's
       stores in Germany?
