Day 252 - 20 May 96 - Page 05

do with a description of a typical McDonald's meal so I
assumed that that paragraph was out.

  MR. JUSTICE BELL: Which paragraph?

MS. STEEL: The one in the middle.

MR. JUSTICE BELL: Yes, it is, it is just the last paragraph.

MS. STEEL: Just the last paragraph is in?

  MR. JUSTICE BELL: Yes.

  MS. STEEL: OK.

MR. JUSTICE BELL: Let me just say, I think Mr. Rampton has
accurately summarised it to Professor Naismith, but let me
say again lest there be any doubt, it starts with the bold
heading, "Diet and Cardiovascular Disease" on page 6 and
continues to the foot of page 8. On page 11 it is the 3
paragraphs under the heading "Fibre and Cardiovascular
Disease", and then it is the very last paragraph of the
report on page 12, insofar as it relates to diet and
       cardiovascular disease.

MR. MORRIS: I do not mind him reading the words out "and some
forms of cancer" if he wants to.

MR. RAMPTON: I am not going to do a Morris, my Lord, I am not
going to read anything out - I am simply going to ask
Professor Naismith whether those parts of his report he is
content to have stand as his in evidence-in-chief in this
case subject to a couple of questions which I will ask.

  Q. Did you hear what I was proposing to ask you, Professor
       Naismith?
       A. Yes, I did.

MR. JUSTICE BELL: I am sorry to interrupt yet again. I had to
decide to what extent I was prepared to hear further
evidence on certain topics and, for better or worse, I gave
leave in respect of your evidence so far as diet and
       cardiovascular disease is concerned only?
       A. Yes.

MR. RAMPTON: The only thing, before I ask, a couple of matters
of detail Professor Naismith, the last paragraph on page 12
which I will read out, subject to the new edited
version: "The relationships between fat ingestion and the
development of coronary heart disease are far from clear
largely because of many confounding variables, dietary
behaviour, behavioural and environmental. The claim that
McDonald's food promotes these conditions is not supported
by any scientific evidence." From the work that you have
done, upon the basis of which you have prepare in this
report, are you content to stand by that conclusion?
       A. Yes, I am indeed, yes.

  Q. Just one question on page 6. You make reference in the
third paragraph under the heading "Diet and Cardiovascular
