     1        A.  I would not assume, I would think it likely though.

     3   Q.   Do you remember Mr. Alimi and several other crew members
     4        tried to organise a staff walk out because it was so
     5        unpleasant to work in these conditions and this was not
     6        successful?  Do you remember something like that?
     7        A.  Do not remember that at all.

     9   Q.   Do you remember the ring leaders of any revolt about these
    10        conditions being penalised for their activity or being
    11        given warnings?
    12        A.  Certainly do not.

    14   Q.   You do not remember a great deal about this incident
    15        really?
    16        A.  I can remember it reasonably well, actually.

    18   MR. MORRIS:  I hope that has satisfied Mr. Rampton.

    20   MR. JUSTICE BELL:  Yes.  Put the penalties.

    22   MR. MORRIS:  He said there were not any penalties given out.

    24   MR. JUSTICE BELL:  I know, but on the "might jog your memory"
    25        basis I think you had better put it.

    27   MR. MORRIS (To the witness):  Does it jog your memory if I was
    28        to say that the people that had complained about this cold
    29        temperature were shouted at, or may have been shouted at,
    30        and given bad jobs, i.e. cleaning the toilets, or life was
    31        made unpleasant for them?  Does that refresh your memory at
    32        all?
    33        A.  That is -- that does not concur with my memory of it in
    34        any way, shape or form.

    36   Q.   Right.  You talked about not having concerns about slipping
    37        accidents in the grill area -----

    39   MR. JUSTICE BELL:  Let me just put the rest very quickly for
    40        you.  (To the witness):  What may be suggested is that
    41        Mr. Alimi was just there for one day while the problem
    42        existed; in fact, it lasted for several days and he was on
    43        holiday the other days.
    44        A.  As I remember it, on this occasion it lasted one,
    45        possibly two days.  We actually had an arrangement with the
    46        service Company who were first in service and part of their
    47        contract was that they would get to the restaurant within
    48        four hours if there was a problem.  The only reason that I
    49        remember it stretching on for longer than one day on this
    50        particular occasion was because they needed to have a part 
    51        couriered from the manufacturers in order to fix the air 
    52        conditioning unit.

    54   Q.   It may be suggested that management at the store refused to
    55        repair the fault.
    56        A.  I cannot see any benefit at all to anybody, including
    57        the store management, in not fixing the air conditioning.
    58        (1) The management team had to work in the restaurant as
    59        well, and I am sure they, you know, we would not have been
    60        particularly happy about working in cold temperatures, that
