Day 242 - 29 Apr 96 - Page 55

MR. ATKINSON: -- the more recent one -----

MR. JUSTICE BELL: You changed and you just put further
voluntary particulars of the Plaintiff's' case. Is there
anything else to deal with this afternoon because otherwise
we will go on to Miss Link on Thursday.

MR. RAMPTON: Only this, and I know it is tiresome for
everybody, but we have to have an eye on trying as best we
can to meet your Lordship's provisional, I do not know if
it is a deadline but wish to end the evidence around the
end of June. I notice, looking at my calendar sheet, that
we have a series of what look like maximum three day weeks
between now and the end of June.

I am wondering if your Lordship is going to prompt me to
try to fill some of those gaps. I am now running out of
witnesses, of course. After the possibility of Naismith
and the certainty of Fairgrieve, a possibility of Arnott,
the certainty of Pearce, I am left only with five
publication witnesses. Obviously, I will try to put in
people other than publication witnesses before the break at
the end of May, or whenever it is, but, if driven to it and
held by your Lordship, I will find publication witnesses,
if I can, before then.

MS. STEEL: I am a bit confused by what Mr. Rampton has just
said. He said something about a three day week to the end
of June.

MR. JUSTICE BELL: What we have got ------

MS. STEEL: As far as I am aware, the only witness scheduled in
June is Colin Campbell at the moment.

MR. JUSTICE BELL: No, what I think Mr. Rampton means is that
this week is a three day week, next week only ever could
have been a four day week because of the Public Holiday on
the Monday, but it is a three day week because we have not
got anyone on the Wednesday. I do not see any need, nor do
I think it is a good idea, to insert someone on Wednesday,
8th ---

MR. RAMPTON: No, I agree with that; I accept that.

MR. JUSTICE BELL: -- with Mr. Preston being recalled; that
would just be a distraction to everyone. If Mr. Preston
can come on the Monday, if he is required, we still only
have Wednesday and Thursday of that week, so that is a
three day week. We have got no-one on Tuesday, 14th, and
no-one on Friday, 17th. Then we have got no-one for
Monday, Tuesday and Wednesday, 20th, 21st and 22nd before
Mr. Morris's other trial on the 23rd and 24th. So even on
the basis that those days are filled, it is only three days
from our -----

MR. RAMPTON: That is what I meant.

MR. MORRIS: Mr. Olive is hoping to come on the 14th or the
