Day 107 - 24 Mar 95 - Page 29
MR. JUSTICE BELL: Right. Do you want to ask Mr. North any more
questions?

MR. MORRIS: I am completely all over the place now in where we
are in the examination.

MR. JUSTICE BELL: Just sit down -- I will not leave court --
and collect yourself. Where you actually were was in a
restaurant in Leeds. If I can just remind you, you had
asked about the ramifications for food safety if one worked
quickly. You had an answer that the critical control was
cooking of the product and pushing time on that had
implications for the food safety.

You had then asked what, if any, conclusion Mr. North drew
from the Shrewsbury and Kingston incidents. He said he
could not express surprise about that and gave some more
answers. You then got to Preston and we put that on one
side to the extent which has been explained, and the
question is what you were going to go on to after
Shrewsbury, Kingston and Preston.

MR. MORRIS: The problem is, of course, that a lot of the thing
in the actual store relates to matters that might come out
of Preston and Mr. North's further report. So, I do not
know if it is a good idea to embark upon -----

MR. JUSTICE BELL: You can embark upon it, if you want. What
I suggest is that you can perfectly well do that if you
have aspects about procedure in the store that you want to
ask Mr. North about. You need not illustrate it with
Preston; we will see what comes of that. But if you have
reason to believe that he would be critical of this
procedure or that procedure, or if you want to ask him
about it anyway, do so.

MR. MORRIS: I think it might be better to leave it until
Mr. North's supplementary report.

MR. JUSTICE BELL: Do not forget, Preston is not the be and end
all of food poisoning, so you could ask him about that if
you wished. Then I noticed the very last paragraph of his
13th January visit report is a general comment on
McDonald's. There is a question, whether you want to
elicit something like that or not from him.

MR. MORRIS (To the witness): Mr. North, the tests that you saw
conducted at the store for the efficient cooking of the
products, how reassuring are those tests that you saw, and
the tests which I do not think you saw but the Plaintiffs
have said that they do, which is internal thermometer
testing?

MR. JUSTICE BELL: What test did you see being done? You saw
the calibration of temperature of the grill, did you?
A. That is right, and the product temperature testing.

Q. And the?
A. The product temperature testing. I can answer the
question.
