Day 007 - 06 Jul 94 - Page 60

     1 not certain whether -----

2 Q. But you would have to check that because, as it appears at
the moment, it is just HCFC, is it not?
3 A. Yes, that is how it is written here.

4 MR. RAMPTON: My Lord, I am not sure this is quite fair. If
one looks at the front page of the document, one sees what
5 is subject matter of the whole document. One sees the
document is not about McDonald's consumption of CFCs; it
6 is about their consumption of HCFC 22.

7 MR. JUSTICE BELL: It may be but then one gets to page 36 -----

8 MR. RAMPTON: One starts at the top of 36, the second black
blob as reference to Formacel-S which is the HCFC 22 in
9 question. That is the question asked by the document:
"What is the McDonald's use of HCFC 22 in the form of
    10 Formacel-S?".

11 MR. JUSTICE BELL: Which page are you looking at now?

12 MR. RAMPTON: If one looks at 36, one sees an answer to the
question posed at the start of the document in the second
13 blob, remembering always that Formacel-S is the HCFC 22
about which the question is asked.
    14
MR. JUSTICE BELL: I appreciate that, but then why at the
15 bottom of page 37, having dealt with Formacel-S, does it
go on to make comparisons with CFCs and refrigerators in
    16 homes?

17 MR. RAMPTON: That I accept is a different question.

18 MR. JUSTICE BELL: I have referred to the wrong page; it may be
that it makes a minute difference; it may make a
19 significant one but unless we have the figure we do not
              know.
    20
MR. RAMPTON: That is a different question.
    21
MISS STEEL: I think earlier when Mr. Rampton was asking you
22 about the chart concerning which countries used HCFCs and
CFCs in 1989, he said did it concern you that 22 countries
23 were using HCFCs. Your answer was it did not concern you
because another year earlier these would all have been in
24 the CFC column so it was an improvement?
              A. It was an improvement, yes.
    25
         Q. So in 1988 there were 22 countries using CFC?
26 A. I do not know that. That was not something we
              tracked.
    27
         Q. On top of the other five that were still using them?
28 A. I do not know that. I do not have that information
              available.
    29
         Q. That is what you told the court this morning.
30 A. I said some of those 22 that you were talking about
              could have been.
