Day 104 - 15 Mar 95 - Page 53

they have not done this or that previously and he says, in
effect -- and there is no need to pursue it further in
cross-examination, you can address me on it later -- "Well,
I think that criticism is a bit unfair because the whole
point of calling Dr. Gregory in was to see what, if
anything, he ought to improve from an animal welfare point
of view among other points of view".

MS. STEEL: It was the answer about "Yes, that is right" about
       what he saw was exceptional.

MR. JUSTICE BELL: No. I think Dr. Pattison was merely agreeing
that there might be things which Dr. Gregory saw which
might be unusual, because a spot check does not necessarily
give you what happens all the time. But Dr. Pattison is
not making that point with regard to any particular
       experience of Dr. Gregory.

MS. STEEL: So it might also be the case that actually there
were more birds that were not getting stunned properly,
       yes?
       A. As I say, I cannot really say any more than I have
said. You have seen his report, I have described what has
happened, the rest is just conjecture.

MR. JUSTICE BELL: Or argument in due course.

MS. STEEL: Can you explain when you said in chief that the
current recommended by MAFF was based on an AC current and
was a different electrical characteristic. Can you just
explain why Sun Valley feels that should make any
       difference?
       A. Well, it is not Sun Valley that feels it should make
any difference. There are quite clearly differences in the
electrical characteristics between AC and DC.

  Q. Have you actually published anything about your experiments
on whether the stunning is effective or not?
       A. I have not published anything, no.

  Q. No, has Sun Valley published anything?
       A. No.

  Q. So it is all internal information that the company is
storing and it is not been verified by anybody outside?
       A. Well, I have said that it has been verified by several
MAFF officials at the time it was installed.

  Q. They did not actually do any tests themselves I think you
       said?
       A. They came and observed it in practice, which is the
normal way of testing whether something is working
       efficiently.

  Q. It has not been subjected to the kind of indepth tests that
AC current has been subjected to?
       A. There is a wealth of information on DC current because
that is the standard method used in the United States.

MR. MORRIS: I will try to get through this as quickly as
