Day 060 - 02 Dec 94 - Page 55

  Q. Do you know the date of this document?
       A. No, I do not. What is it?

  Q. It has not actually got a date in it, I do not think, but
there are hints to indicate when roughly it was created.
There is something in here about CFCs.

MR. MORRIS: Yes, on page 3 just before it is signed off as
       "Mike".

MS. STEEL: In the third paragraph of page 3, it says, the
second sentence: "For example, we ceased using CFCs in our
foam cartons well over a year ago". So, that indicates it
is likely to be very late 1989/early 1990; would that be
       about right?
       A. Well, we ceased using CFCs in July 1988, so it is
       probable.

  Q. I thought it was September 1988 you finally finished?
       A. No, July. So it is likely to be the summer of 1989.

  Q. Well over a year.

MR. JUSTICE BELL: Well, if ---
       A. Well, over a year.

  Q. -- that is right, it could not be earlier than summer 1989,
       could it?
       A. No, it may have been earlier in the year, 1989.

MS. STEEL: Right. So it is likely to be around the end of
1989, possibly the beginning of 1990?
       A. Well, beyond the summer of 1989, I do not know. I do
not know what he means by "well over a year". He may mean
a couple of months over, he may mean six months over.

  Q. If it was couple months over, that would take us to take
       September 1989?
       A. Right.

  Q. Which is, more or less, after that is the end of the year.

MR. JUSTICE BELL: I can work out the timing as well as anyone
else. I know it is a draft. A remarkable large number of
documents in this case do not have a date on them.
I suppose one is used to putting dates on all one's own
documents and so it seems strange, but it may be more
sensible if one missed the dates off sometimes.

MS. STEEL: Anyway, if you turn to page 676, this is Corinne
Reed and she says in the third paragraph that "all UK
carry-out bags are made from 30 per cent recycled paper".
       A. No, that would be wrong.

  Q. That would be wrong, would it?
       A. At that time, yes. And this, as the Judge said, is a
       draft. That is not correct.

  Q. Why do you say it is wrong?
