Day 059 - 01 Dec 94 - Page 56
departments, presumably, have to work pretty closely
together; if you are going to get a certain amount of
packaging, the machines have to be the right size for it to
fit into or whatever, yes?
A. Yes.

Q. So is it a part of your department or is it -----
A. No, it is not a part of my department, no. I have no
involvement other than the occasional negotiation on price
or quantity.

Q. But you would be aware of all the equipment issues to do
with the type of equipment?
A. Not necessarily, no. The equipment is specified by the
headquarters in Chicago, as are the packaging items, as are
the food items. They make sure that the cups would fit the
tubes that go alongside the shake machines or the drink
machines. It would not be the UK company's responsibility
to do that and certainly not mine.

Q. So when you say the equipment specifications are specified
by Chicago, would that apply also to the European
countries, say, for example, the European countries that
you have responsibility for?
A. By and large, unless they are using a different size
cup to the UK company or a different type of packaging for
some reason or another. But, by and large, the equipment
would be specified by Chicago for all markets other than
where there is an exception for some reason or other.

Q. Does that apply to both the machinery that, you know, the
consumers can see in the store, customers can see, that is
being used for the preparation of food and also to the
storage equipment as well, such as refrigeration or the
storage areas?
A. I do not handle equipment, so it is difficult for me to
answer you exactly, but it would certainly apply to the
restaurant kitchen equipment that the customer can see; it
may not apply to the backup storage equipment which I think
might be different, based on different shapes and types of
buildings. But I cannot be specific in that area because
it is not my area.

Q. But the overall policy guidelines on equipment would be
there would be specifications emanating from Chicago about
that?
A. Certainly, as far as I am aware, for the restaurant
kitchen equipment. I am not sure that there is for the
backup storage equipment.

MR. JUSTICE BELL: If you have particular items of equipment
which you are interested in for some reason, if it is
important where the specification comes from, why not raise
those?

MR. MORRIS: Yes. I might come on to it, I am not sure in what
order we are doing things.

MS. STEEL: Is everything that you have put in all three of
your statements true?
