Day 067 - 15 Dec 94 - Page 42

MR. RAMPTON: I would add only this, my Lord, the amendment of
1978 does provide a sanction in this form, that it provides
for inspection by government inspection, and for the
withdrawal or refusal of the inspection facility if the
slaughtering and handling facilities are not deemed to be
humane.

MR. JUSTICE BELL: It may be. It may well be that there is
legislation, as one might well expect, in a country like
the United States with a very large agricultural industry
for inspection of livestock conditions on farms, but I just
do not have ---

MR. RAMPTON: We do not have that particular amendment.

MR. JUSTICE BELL: -- that in front of me. Anyway, I suggest
you carry on, Mr. Morris. If anything is produced in the
future, you can cross-examine someone about it.

MS. STEEL (To the witness): You said you do not know whether
your department has a copy of this Act in it?
A. That is correct.

Q. If you do not know whether you have a copy, how do you
ensure that your suppliers are complying with what the Act
is?
A. How do we ensure? We have, well, first of all, when
I going through school, we went through the whole book, if
I can call it that. I understand the intent, and I am well
aware of some of the very important details that are
included in the Act, our suppliers too. I cannot read you
the whole book now, but I can tell you the intent of the
law. Based on that, based on my experience and based on
what I see on the field with our suppliers and the work
that I have done with them, that is how I ensure and by
looking at the product, that is how I know.

Q. You are relying on your memory?
A. I rely -- I am relying on my understanding of the
intent as well as my memory, that is correct.

MR. MORRIS: You have never sent copies of these documents out
to suppliers or anything like that?
A. No, no.

Q. Saying: "This is our policy, adhere to it"?
A. Which is what?

Q. Saying: "This is our policy, adhere to it"?
A. It is your policy, I am sorry?

Q. Sorry, you are saying this is your policy, effectively.

MR. JUSTICE BELL: I am not sure they are because that is not
actually a copy of the Act, in fact. There is a copy of
the 58 Act and some notes of the effect of the 1978 Act on
it. It is not suggested this has come from his department
in any event.
