Day 174 - 17 Oct 95 - Page 48

       dismissal?
       A. No. I depended on Mr. Trimble and Mr. Cullen that it
       was done correctly.

MR. JUSTICE BELL: Just pause a moment, please, because I want to
look at what the application to the Rights Commissioner
complained of. The reason is, I may be wrong, but
I thought the complaint was about dismissal for union
activities, rather than not the correct procedures. Let us
just look. I am looking at page 1156 at the moment.

MS. STEEL: Mr. McCann does say in his statement as well
       about -----

MR. JUSTICE BELL: Yes, but this is presumably what the -- chase
it up if you want. Let me just remind myself. It is not
easy to read it. Why do you not put that? Ask Mr. Mehigan
to look at that and see if he knew the terms of the
       reference.

  MS. STEEL: Which one?

MR. JUSTICE BELL: It is page 1156 in tab 62.

  MS. STEEL: Yes.

MR. JUSTICE BELL: I will not trample on your
cross-examination. Take it further if you like. Do you
       want me to put it?

MS. STEEL: Yes, if you want to.

MR. JUSTICE BELL: (To the witness) Look at page 1156, please,
       Mr. Mehigan.
       A. Yes, my Lord.

  Q. Do you remember ever seeing that or being told the contents
       of it?
       A. Yes, I would imagine I saw it after it arrived.

  Q. I will read it through, in case you have any trouble.

"The grounds of my claim: I feel that I was treated
unfairly re my dismissal. I had arranged for somebody to
work a day for me when I was unable to work. I was later
dismissed without any warning" -- remember that bit -- "it
was also my first time to have had any such problems while
working for McDonald's. This was used as a pretext to
dismiss me because of my trade union activity."

The last bit is in block capitals. But it does say he was
dismissed without any warning. Do you remember -- what can
       you tell me about that?
       A. The only thing I can tell you, your Lordship, is,
reflecting on the note that David Trimble gave to his
supervisor, that he had been warned a number of times and
not just once. I think in Mr. Trimble's notes he says he
       was warned.

MR. MORRIS: Which page are we looking at?
