     3        A.  It is a separate town but I would refer to it as
     4        suburban Philadelphia.

     6   Q.   This gentleman MaCale, did he exist or was it a company?
     7        A.  Tony MaCale -- his name can be pronounced both ways but
     8        I think he pronounces it MaCale.

    11        A.  Italian.

    13   Q.   Tony MaCale, how many stores did he have?
    14        A.  He had I believe around a dozen stores.

    17        A.  Yes.

    20        A.  Yes, I do.

    23        A.  Yes, I was.

    26        A.  The State authority, State compliance people of
    27        Pennsylvania had done an inspection of his stores and had
    28        come up with discrepancies, as you indicated, I do not know
    29        how many, but had come up with a significant number of
    30        discrepancies.

    33        A.  The reason we became aware of it was after they told
    34        him of this he called our regional office in Philadelphia
    35        and asked for help to work on his systems and processes of
    36        whatever had occurred would not occur again.

    38   Q.   What sort of discrepancies are we talking about?
    39        A.  It was alleged that people had worked beyond hours that
    40        they should have worked; that breaks did not occur at the
    41        appropriate time, things of that nature.

    43   Q.   Did it apply to all 12 of his stores?
    44        A.  I believe so.  I think so, yes.

    46   Q.   Did you look at the papers yourself?
    47        A.  No, I did not.  My area of concentration -- he had a
    48        lawyer dealing with the matters with the State.  My
    49        principal focus was dispatching people to make sure that
    50        whatever was going on in his practices needed to be 
    51        sharpened up, and that there would be no reoccurrence of 
    52        what was going on.

    54   Q.   Did your people conclude whether or not his practices did
    55        need sharpening up?
    56        A.  Yes, they did.

    58   Q.   How was it dealt with, first of all by the authorities?
    59        A.  OK.  It was a civil matter; it was not a criminal
    60        matter.  If it had been serious they would have made it
