4 MR. RAMPTON: My Lord, after that we either decide whether we
5 admit all or some of those assertions by Mr. North about
6 McDonald's arising out of that report. If we do not admit
7 them, why then evidence beings relevant or admissible on
8 both sides, but not before.

10 MS. STEEL: With the exception of the hypothetical, the bits
11 about whether it is hypothetical or not, that is actually
12 what happened already. It was not that we wanted to ask
13 Mr. North questions about the Preston report; it was that
14 he had been through it and marked up parts that he thought
15 were relevant to comment on.

17 MR. JUSTICE BELL: You have your opportunity to take it
18 further. Quite frankly, I think some things which have
19 happened in the last two days have the disadvantage for
20 whatever reason, not having contact with a witness who was
21 of potential importance to you for some considerable period
22 of time, and now you are having the opportunity to correct
23 that to some extent by talking to Mr. North and taking the
24 benefit of his views with regard to both Preston and the
25 condition of pesticide residues.
