Day 115 - 06 Apr 95 - Page 61

me may be enough for the purpose you have in mind. You do
       not have to decide now.

MS. STEEL: I think it would be helpful if the Plaintiffs do not
just serve counter notices for the sake of it.

  MR. RAMPTON: No.

MR. JUSTICE BELL: We have not got to that stage yet.

MR. RAMPTON: I do not do that, if I may respectfully say so.

MR. JUSTICE BELL: The first page of the letter of 26th January
1993, the fourth paragraph down, I take that as evidence
that Sun Valley Poultry Limited's plan was that in July of
1993, by which time it was expected that contractees would
be fully trained to deal with Sun Valley's procedures, they
would move from eight loads to 12 loads a day allowing one
further Sun Valley team to be disbanded.

  MS. STEEL: Yes.

MR. JUSTICE BELL: Do you see?

  MS. STEEL: Yes.

MR. JUSTICE BELL: I have only picked on that paragraph as an
example. What I suggest is you when have a spare moment or
two think about whether in respect of anything else in the
documents you need more than that sort of effect. If you
are anxious about it raise it with me sometime next term.

MS. STEEL: We will check what Dr. Pattison said. To be honest,
I do not think he disagreed that much with what Mr. Bruton
was saying anyway but, yes, we will check that through.

MR. JUSTICE BELL: Is there anything else we must do?

MR. RAMPTON: My Lord, yes, I am anxious to have an update about
the Defendants' employment witnesses. We really do have to
get on. We have a bit time off and we have to get on
trying to organise our witnesses. That is not just a
       general statement.

MR. JUSTICE BELL: Can you help as to the enquiries which were
       sent out, Mr. Morris?

MR. MORRIS: Yes. We have had four replies so far, all
       positive.

MR. JUSTICE BELL: How many went out altogether, I have
forgotten the number? There were about 30 or 40.

MR. MORRIS: Some were abroad, so I did not need to send them
out abroad. I cannot exactly how many. There would be
something like 30 I should think.

MR. JUSTICE BELL: The ones you have had back, have you had ones
back indicating they do propose to come?
