       level?
       A. It may well be a manager or a crew member may undertake
it, whoever carries out the task should sign it. The tasks
       vary in degree of difficulty.

  Q. If, for example, a crew member was asked to do a particular
task, would a check be made to see whether they had done
       it?
       A. Well, we would check whether the thing had been
signed. I guess we train our employees and trust them to
carry out the task. If it is cleaning behind the back of a
grill, for instance, then it is probably self-evident
whether it has been done or not. We trust them to sign off
that they -- we trust their integrity that they have done
it if they have signed it off. I am afraid to say the
       majority of the tasks would be done by managers;
occasionally they would be done by crew members.

  Q. What about cleaning shake machines? Who would be
       responsible for that?
       A. In most instances, it is the restaurant manager; in
some instances it would be a training squad that does it.
There is a specific training process to go through to
enable you to clean a shake machine.

  Q. How often is that supposed to be undertaken?
       A. A shake machine is disassembled nightly. That is the
old style shake machine. We have some new ones which are
heat machines which do not need breaking down quite as
often. They go through a self-pasteurisation process on a
nightly basis. They are broken down fortnightly.

  Q. Are you aware of instances of employees finding maggots in
shake machines after they have not been cleaned out
       regularly?
       A. I have never heard of employees finding maggots
       in shake machines.

  Q. What about managers?
       A. I have heard a story -- I do not know where it is from
-- that maggots have been found in a shake machine.

  Q. On more than one occasion?
       A. Just one occasion.

  Q. Was that when you were in the position you are in now?
       A. No. This was while I was an Operations Manager. I do
not know if it is substantiated or not, but it was a
story. It has also been used as the reason why you should
clean it out; that is the result if you do not.

  Q. When you heard the report of the maggots in the shake
machines, did you take any steps -----

MR. JUSTICE BELL: Was it a report or have you just heard it
when people have been training others saying something to
       that effect?
       A. It is just something -- there has not been a report.
I have never known any fact of it being there. It just
that people have said that maggots have been found in a
