Day 022 - 12 Sep 94 - Page 66

MR. RAMPTON: In substance they are identical. Since then the
defendants have produced one that makes their own
       proposals.

MR. JUSTICE BELL: So this is -----

MR. MORRIS: This is our witness schedule. What happened is
that the plaintiffs sent us a proposed schedule at the end
of December, I believe it was, and they asked us to try to
fit one or two of our witnesses in this week because they
could not fill in the days. The rest of our nutritional
witnesses would only have five days to give their
testimony. So we told them it would take at least 12 days
for our witnesses. We would fit a witness in this week.
Mr. Gardner has agreed to come and give evidence over
Thursday and Friday of this week.

MR. JUSTICE BELL: I can pencil Mr. Gardner in?

MR. MORRIS: Yes, that is a definite.

MR. JUSTICE BELL: When shall I put Mr. Gardner in, Thursday?

MR. MORRIS: Thursday and with a run over to Friday, if he is
needed. Then we were asked to put our witnesses from
October 3rd onwards, which we have done. Can I just ask,
the copy I have given you, has that got Cannon as the
       first of our witnesses?

MR. JUSTICE BELL: Yes, it has Mr. Cannon on Monday,
       9th October.

MR. MORRIS: 3rd, that is the ninth week of the trial, yes.
Then -- because there was a last minute change around
where Sally Bundey was moved to 17th October.

MR. JUSTICE BELL: Does Mr. Cannon have to come on that day?
The only reason I mention it is it is the day when certain
ceremonies take place. Although -- I had better express
it this way -- I might be only too happy not to take part
in the ceremonies, I think it is expected that I should.

MR. MORRIS: We have allowed two slippage days at the end of
       that three week period.

MR. JUSTICE BELL: I think the answer is I will find out more
about what the situation is with regard to that.

MR. MORRIS: We thought it would be a good person to start with
because he gives an overview. Then Professor Crawford
gives a more detailed expert view from his particular
field. One thing -- the plaintiffs have said they -----

MR. JUSTICE BELL: What are you proposing to do this week then,
first of all? You were hoping to finish Dr. Arnott by
lunch time and then Mr. Rampton may well have some
re-examination. So, let us say that is the menu for
tomorrow. Then we have no-one for Wednesday, so we will
take that as a preparation day. I think that is all
