Day 032 - 06 Oct 94 - Page 61

       A. True, but I then applied again every year for the next
two or three years as I knew that this existed and got one
       a little later on.

  Q. Now please turn to tab -- sorry about this -- 9 in the
       same volume.

MR. JUSTICE BELL: Are you saying there was difficulty getting
hold of it, because I see it is compiled and produced by
the PR Department of McDonald's Restaurants Limited. One
might think from its layout and some of the things it said
that it is intended for a very wide distribution?
       A. As I recall ----

  Q. There is not much point in having something called
"McDonald's Food - the Facts" if it is not distributed?
       A. When I say "distributed", we managed to get hold of it
by, I think, on the second attempt of asking McDonald's to
send it to us at the time we then knew it existed, but it
was certainly not available in outlets.

MR. RAMPTON: My Lord, I thought it best to leave that point
and to deal with it in due course by evidence, which I
easily can, for that year preceding and succeeding years.
But here is another document at tab 9, Dr. Lobstein. Is
this a document you have seen before?
       A. Have we not just had this one?

  Q. It is called "McDonald's Nutrition Guide"?
       A. Yes.

  Q. It is entitled: "Our role in a well balanced diet". This
we looked at before, because Ms. Steel was at pains to
point out that McDonald's acknowledged the help of the
British Nutrition Foundation in its preparation. Its date
is July 1985. I would like you to read the words in the
left-hand side of that page: "Golden rules for healthy
eating". Again I will not read them out; just tell me
when you have finished reading them.
       A. I have its gist, yes.

  Q. Then please turn back to tab 3, we are going backwards in
time, you see, Dr. Lobstein, to 1984, now October 1984.
I am afraid here that my pages are not numbered in the
file. Originally it looks a double paged document -- if
you turn it sideways can you find pages 12 and 13?
       A. Yes.

  Q. There are some boxes with "Eating at McDonald's and what
else is needed for a healthy diet" on. Do you have that?
       A. Yes.

  Q. Can I ask you to read the left-hand column, the page 12
       column to yourself, please?
       A. Yes.

  Q. My question is this, what substantial difference do you
see in those documents from 1984, 1985 and 1989 produced
and published by McDonald's in any substantial sense
between what those passages say and what is said in the
