Day 122 - 05 May 95 - Page 52

Q. I am not sure whether we have covered this or not. I do
not know whether you have a copy of your affidavit to hand?
A. Could you direct me?

Q. I really do not know where it is.
A. Green?

MR. JUSTICE BELL: There are some bright green ones and one of
them has your name on the spine, Mr. Nicholson. What is
the date of the affidavit when sworn?

MS. STEEL: 18th May 1994.

THE WITNESS: Yes.

MS. STEEL (To the witness): On page 3 of that there is a
reference to rap session notes. How long are rap session
notes generally kept for?
A. Well, there is nothing laid down. I would have thought
until (1) all the matters on there had been resolved and it
had been overtaken by another rap session. Some
supervisors may keep them longer.

Q. The Head Office ----
A. But they would be purged. Even if they were kept at
Head Office, they certainly would not be kept for much
longer than a year.

Q. Does Head Office take an interest in what happens at rap
sessions?
A. Oh, yes.

Q. Do you get copies of what has been said at rap sessions?
A. Well, I do get -- there is a copy of all rap sessions
sent up to the Regional Personnel office, and in the early
days in the Company they all came into the central
Personnel office, and each rap session notes are examined
by the Personnel Officer responsible for that restaurant.
They will sit with the management team when they discuss
the contents and make their plans for dealing with it.

Q. Head Office would keep them for about a year, would they?
A. I would be surprised if at the end -- unless there were
reasons to keep it in which case it would be flagged --
I would be surprised if they succeeded the end of that
current year.

Q. Are any kind of statistics on rap sessions taken, like what
the usual, most frequent complaints are, or anything like
that?
A. I think Personnel Officers or Human Resource Officers
probably keep them for their own purposes because they want
to know what is going on in their own area, but nothing
formally.

Q. I am not sure whether you said this or not, but in the
paragraph about the visits to Hackney and East Ham -----
A. Can you direct me?
