Day 039 - 20 Oct 94 - Page 67

opinions that you have expressed here. Do you remember
yesterday -- my Lord, this is page 18 of yesterday's
transcript; I say that so that everybody can read where it
is when they look at it.

MR. JUSTICE BELL: We will probably all remember it when we hear
       it.

MR. RAMPTON: You said this, and again I am trying to read it
without making a single mistake, Dr. Millstone. Line 33 on
page 18. This is in relation to BHA.
       A. Yes.

  Q. "Now, given that human beings do not consume BHA at those
levels", that is to say, high dosage, "and given that it
might possibly be the case that the symptoms that were
exhibited by those laboratory animals arose by some gross
overloading of their biochemistry, it seems to me the
sensible thing to do would be to require further studies at
lower doses, perhaps closer to those consumed by humans,
but in correspondingly larger groups of rodents which might
more effectively model the effects which the compounds are
likely to have on human beings, lower doses in large
groups. But that is not what is done."

Do you adhere to that characterisation of what you see as a
fault in the work which underlies JECFA ADIs?
       A. Yes, indeed.

  Q. I do not want you to expand upon it, unless his Lordship
requires you to; I just want to know whether or not you
still adhere to that assertion, proposition?
       A. I do.

  Q. Thank you. Do you recall that you said a similar thing in
relation to Sunset Yellow? My Lord, this is page 47.
       A. I expect that I did; it would be entirely consistent.

  Q. I am going to read it out. At line 15: "What they", that
is this time the Committee on Toxicity, "did not do is ask
for further studies at lower doses in larger groups, which
I would have thought would be an appropriate way of trying
to clarify the issue." It is the same point.
       A. Yes, indeed.

  Q. Can I ask you to find, if you can -- I do not know if you
have Professor Walker's references there; they are in a
bundle with an orange label on it -- IV Nutrition. It
should have "Walker" and "Arnott" on the back. You want
the first part of that, please, at tab 10.
       A. This is JECFA Report series 24.

  Q. That is right. This is an extract.
       A. Which page?

  Q. I want you to turn up tab J. You will see it is series 24,
Toxicological Evaluation of Certain Food Additives and
Contaminants. It is JECFA, as you say. It comes out in
1989. I would like you turn to the page stamped at the
       bottom 258, please?
