5 that effect, or just you do not remember?

8 Q. Right. There were some photographs disclosed recently --
9 I do not know whether it is worth putting this to the
10 witness, seeing as he said he does not know any of the
11 private investigators, that he has not met any of them
12 apart from Mr. Clare.

14 MR. JUSTICE BELL: What you could do, if you like, you could ask
15 him now and he can look overnight through those and then
16 the first thing when you come back to Mr. Nicholson you can
17 ask him -- he is looking through them now -- whether he
18 recognises anyone there as a private investigator
19 instructed by Barlows or himself.

23 MR. RAMPTON: My Lord, I suggest that they go into pink
24 publication 2. There is a tab which there is a video for
25 that date, which is tab 7.

29 MR. RAMPTON: Yes, there is nothing in that tab.

33 MR. RAMPTON: These are ours. We did disclose them as soon as
34 we found them. They were in a different shaped album and
35 we have now had copies made of them. I think I showed them
36 to Mr. Carroll when he was giving evidence. Yes, the video
37 has been disclosed for ages, but we have found the
38 photographs as well.

40 MR. JUSTICE BELL: When I rise I will put them in 7A.

42 MR. RAMPTON: My Lord, by all means let Ms. Steel take the
43 course of showing the photographs to Mr. Nicholson to see
44 whether he can help. Whether or not he can, I would ask
45 through your Lordship that we are told now, not as part of
46 Mr. Nicholson's evidence, but we are told now who it is in
47 these photographs it is alleged by the Defendants to have
48 been an agent of the Plaintiffs and what his or her name is
49 alleged to be.

51 MR. JUSTICE BELL: What I suggest you do is follow up the
52 question you have just put that private investigators
53 attended pickets of Head Office and handed out leaflets on
54 those pickets, to which Mr. Nicholson said that he had no
55 knowledge, by which he meant he cannot remember. If you
56 suggest that, ask him the question as to whether he
57 recognises any investigator in any of these photographs.
58 Then if it is your case that any particular person is a
59 private investigator, point that person out to
60 Mr. Nicholson and ask him to think again.
