5 MS. STEEL: What happened then: were they adhered to, or did it

7 A. I cannot recall the exact effect.

9 MR. MORRIS: Do you accept that the performance reviews system
10 at your store was completely inadequate to justify what the
11 Company claims as its performance-related pay increase
12 system?
13 A. I would say that people whose rap sessions have
14 indicated that they have had performance review problems,
15 performance reviews is written -- performance review is
16 carried out on the crew member.

18 Q. I am asking you -- never mind the rap sessions -- it was a
19 problem with the performance review system at this store
20 over a long period of time?
21 A. Some of the performance reviews have been late.

23 Q. Do you accept that there was a continuing problem over a
24 long period of time with the performance review system?
25 A. There is a -- I would say, yes, over a period of these
26 rap sessions there has been -- people were complaining.

28 MR. JUSTICE BELL: No, that is not the question which was put to
29 you. We have been through that. What you are being asked
30 is whether you would accept that over a long period of time
31 there was actually a problem with performance reviews, that
32 is, they were being missed or were late, and a backlog had
33 built up?
34 A. Performance reviews were late, but I cannot quantify it
35 to an extent.

37 MR. MORRIS: Are you reluctant to criticise the Company you work
38 for?
39 A. No, I am not reluctant to criticise the Company.
40 I just say I cannot quantify it to an extent of how -- what
41 quantity of performance reviews are or were late.

43 Q. Are you able to identify problems when they exist and say
44 so in the witness box?
45 A. Yes, within the -- yes.

47 Q. Continuous criticism has been referred to by people in your
48 system for getting crew opinions, rap sessions, yes --
49 continuous criticism. Is that enough for you to say there
50 must have been a continuing problem, in reality?
51 A. There are continuing problems in viewing the rap
52 sessions, yes.

54 Q. Does that indicate that there was actually a continuing
55 problem affecting the store?
56 A. There was -- I would say there were, or there were
57 problems with people's performance reviews that affected
58 their performance reviews.
