     1        A.  As far as I was concerned there was an open remit for
     2        him to take whatever material he wished to take.  Of
     3        course, when he visited us most of McDonald's product was
     4        being produced in France, and the laboratory testing and
     5        quality control testing is all being done in France at the
     6        moment for McDonald's.  So, those kinds of documents could
     7        have been made available to him but we would have had to
     8        have made special arrangements.

    10   Q.   You would have to get them faxed over from Orleon?
    11        A.  Yes.

    13   Q.   If McDonald's ask for any of those documents you would hand
    14        them over to them, would you?
    15        A.  Yes, of course we would.  That is part of the way that
    16        we work.

    18   Q.   Would it matter one jot to you what use McDonald's made of
    19        them or where they went then?
    20        A.  Well, no, it really does not matter.  I mean, they are
    21        there for their use and our use and it is up to them what
    22        they do with the results.

    24   MR. JUSTICE BELL:  If after hearing anything Mr. Rampton,
    25        Ms. Steel or Mr. Morris were to say those documents, if
    26        still available, were to be produced, either any documents
    27        which related to tests on food which were to go -- I say
    28        "food" I mean products which were to be supplied to
    29        McDonald's either from Hereford, was there any from
    30        Hereford at the time of Mr. North's visit in January?
    31        I forget the exact date of the visit. The report is
    32        January.

    34   THE WITNESS:  I think there would have been a small amount of
    35        production for McDonald's, perhaps once a week, happening
    36        at Hereford at that time.

    38   Q.   The visit to you was 16th August 1994?
    39        A.  There would almost certainly have been a small amount
    40        of McDonald's production going on at that time in Hereford.

    42   Q.   So you would expect to have documentation there, would you?
    43        A.  We would expect that, yes.

    45   Q.   Which is probably still in the files somewhere, is it?
    46        A.  It probably it, yes.

    48   Q.   What would be involved in discovering whether there was any
    49        equivalent documentation at your processing plant in
    50        Orleon? 
    51        A.  It is merely a question of making a phone call to ask 
    52        them if they have these documents.  What they will tend to 
    53        do is condense a day's results into a summary form so that
    54        every month we send a summary of the results to the
    55        customer.  That is what we tend to do, so what we tend to
    56        file are the monthly summaries rather than keeping the
    57        every day's result.

    60        A.  We do not keep source documents once we have put that
