Day 025 - 16 Sep 94 - Page 28
and Van der Kemp, the office desired to send a strong
signal to McDonald's, and therefore Mr. Mattox, Attorney
General Mattox, elected to sign it himself. Therefore,
while I believe I did draft the letter, it went from
Dallas to Austin, where it was reviewed, possibly revised,
and then signed by Attorney General Mattox.

Q. At all events, can I assume this before we have our short
break? You do not disassociate yourself from its
contents?
A. I do not, no.

Q. Or its sentiments?
A. Or its sentiments, no.

MR. RAMPTON: Thank you very much.

MR. JUSTICE BELL: Are you going back to the cholesterol ad at
some stage?

MR. RAMPTON: Yes, I am.

MR. JUSTICE BELL: All I will say is, no doubt I have missed
something, but at the moment it is not clear to me why
Mr. Gardner, or rather Mr. Mattox, in the letter, point 3
on the second page, said that the cholesterol ad
emphasises the relatively low (29 milligram) cholesterol
content of the regular hamburger, because I think there is
a column on the page which suggests the national
guidelines where there should not be more than 100
milligrams of cholesterol per thousand calories.

MR. RAMPTON: That is right.

MR. JUSTICE BELL: I think it is 29 over 263, which would come
out at about, probably, 110; it would be over a hundred,
so it would be over the limit. If someone cares to pursue
that rather than me, because Mr. Gardner may have a ready
explanation which I have missed of why it said that the
cholesterol ad emphasises the relatively low (29
milligram) cholesterol content.

(Short Adjournment)

MR. RAMPTON: The question that his Lordship raised just before
that short break, Mr. Gardner, is this: You complain in
your letter that McDonald's have emphasised the relatively
low cholesterol content of the regular hamburger. Yes?
A. Yes.

Q. The recommendation of the American Heart Association is
that there should not be more than 100 milligrams of
cholesterol for every 1,000 calories of food; is that
right?
A. I do not know. That sounds approximately right.
My -----

Q. It says so in the left-hand column of this advertisement.
It should not exceed, this is dietary cholesterol,
300 milligrams a day?
