Day 195 - 04 Dec 95 - Page 69
you went back to the store and people were still working?
A. Yes, that is right.

Q. So, yes or no, was there an all night close on that day as
far as you can remember?
A. I would say if I went to the hospital at 2 o'clock and
came back at, you know, two hours later at 4 o'clock and
people were still working, yes, it was an all night close.

Q. Did you hang around when you came back?
A. No. I just happened to come back to the -- I would
have gone straight home, except they had called a taxi for
me to take me to hospital and take me back. I actually
walked home after that incident.

Q. Could that have been one of your 3 o'clock ----

MR. JUSTICE BELL: He said he would say that it was an all night
close. You cannot cross-examine him.

MR. MORRIS: So there were three all night closes in this period
which you have disclosed?
A. Yes.

Q. In the three-month period that you were actually scheduled
for?
A. Well, let us put it this way. If at 2 o'clock ----

Q. We have dealt with that.
A. Sorry.

Q. The last couple of points. In that diary you have got
quite a lot of days that start on an hour, for example 4 to
close?
A. Yes.

Q. That happens a lot of the time, and 11 to 3?
A. Yes.

Q. That is an unusual one apparently, 11 to 7, 8 to 3?
A. Yes.

Q. When you write something that starts on an hour, would you
mean you have to get in a quarter of an hour early?
A. Yes. Every time you are scheduled you are expected
to -- I mean, when I say "4 close" it is casual, and a
mistake on my part; it is actually 3.45 close. So you are
expected to arrive 15 minutes, at least 15 minutes before
your shift.

MR. JUSTICE BELL: When did you have to clock in, 3.45 or 4?
A. 4 o'clock.

MR. MORRIS: So you arrived at 3.45 but got paid from 4?
A. From 4, yes.

Q. So if you wrote 3.45 to close?
A. Yes.

MS. STEEL: On March 26 and 27th.
