Day 259 - 10 Jun 96 - Page 71
have those notes. So far as Rampton knows, the Plaintiffs
do not have those notes, but Rampton is often mistaken and
may be now.

MR. JUSTICE BELL: I can see that their employers might have,
but I do not know that the Plaintiffs have.

MR. RAMPTON: That is correct, I am told. Anyway, perhaps we
could get on with Mr. Bishop?

MR. JUSTICE BELL: Think about that further, if you will.
I will take the five-minute break now, and then we will
hear Mr. Bishop.

(Short Adjournment)

MR. MORRIS: Can I deal with the other outstanding legal matters
first, or do you want to set some time aside -----

MR. JUSTICE BELL: Just tell me what they are for the time being
and we will see.

MR. MORRIS: It is just discovery mostly - the US video, there
is -- actually, I do not think I have that many; maybe we
can deal with it in five minutes.

MR. JUSTICE BELL: Let me see. What is the position with
regards to the United States video. Do you know,
Mr. Rampton?

MR. RAMPTON: I will tell your Lordship. Frankly, what happened
was it was done once and there was, I think it is some kind
of crew opinion survey which is a new experimental one
which McDonald's in the United States are using, and all
that happened was when we disclosed the transcript of the
video we blanked the name of it out because it is
commercially sensitive. It has no relevance what its name
was. When they did edited version of the video they did
not blank it out, and apparently it is quite difficult to
beep it on a redo and what they are doing is redoing it at
the moment so as to beep it out. That has all been
explained to the Defendants, I am told. That is the
position.

MS. STEEL: It has not all been explained to us and I do
not-----

MR. JUSTICE BELL: When can that be done by?

MR. RAMPTON: My Lord, I do not know. It is not being done by
Barlows or by McDonald's. It is being done by an
outsider. Nothing turns on it so far as the conclusion of
the evidence is concerned because it is a matter only for
final speeches, and obviously we must have it in the
Defendants' hands before everybody goes away to prepare
their final speeches. That is obvious, and that we will
undertake to do. But when it will actually be ready I am
afraid I cannot say. There is nobody of whom questions can
be asked about it is left to be called.
