Day 005 - 04 Jul 94 - Page 33
1 is going to be here or hereabouts. So, what I suggest you
and Miss Steel think about is whether you must, in
2 fairness to your case, ask them now or later, perhaps
after you have heard the specific witnesses.
3
MR. MORRIS: There are reasons for asking these questions now.
4 We are not going in detail into those subjects. We are
just bringing out some of the issues.
5
MR. RAMPTON: There is this to be said -- I do not argue with
6 what your Lordship is saying at all -- questions to which
Mr. Preston does not know the answer, fair enough, he will
7 say he does not know the answer. But there is also this
problem, that both the questions which Mr. Morris has
8 asked, as the next witness Mr. Kouchoukos will show, are
both based on false premises. That is the problem.
9
MR. JUSTICE BELL: We will see where we get. If you can
10 possibly answer a question which Mr.Morris or Miss Steel
asks you then of course do so.
11 A. I will.
12 MR. JUSTICE BELL: If the answer is that you really do not
know, equally do not hesitate to say that.
13 A. All right.
14 MR. MORRIS: I just want to ask some general questions. Do you
accept that a large volume of McDonald's packaging
15 throughout the late'80s did use CFCs of which you later
changed the composition, and many countries started using
16 HCFCs?
A. I would accept that we used in the history of
17 polystyrene packaging either CFCs, HCFCs or Pentane as a
blowing agent. That is all I would accept. As to
18 quantity and where, I do not know what we use, where in
every case. I am sorry.
19
Q. But in general you recognise that McDonald's had used, by
20 bulk, a large percentage in their packaging of styrofoam
using CFC blowing agent in the'80s?
21 A. I do know this. Styrofoam as a component of our entire
packaging is tiny.
22
Q. We are talking about the use of CFCs in McDonald's
23 packaging. Let us start again. You have used CFCs in your
packaging in the'80s?
24 A. We have used CFCs, HCFCs, and Pentane as blowing
agents in polystyrene packaging, yes.
25
Q. Are you aware worldwide whether at one time McDonald's was
26 using CFCs in the majority of its styrofoam packaging?
A. I do not know.
27
Q. Do you accept that CFCs and HCFCs are damaging to the
28 ozone layer in the world?
A. I think you have to talk to the technical people about
29 that. I do not know.
30 Q. Do you accept it is the general scientific opinion that
HCFCs and CFCs are damaging to the ozone layer?
