11 MR. MORRIS: Is it all right that we sort that out with the
12 witnesses when he has finished today, give him all the
13 references?

15 MR. JUSTICE BELL: Make sure he has got a copy of each of the
16 bundles Mr. Rampton has referred to.

18 MR. RAMPTON: I think it is right that when he has done that
19 task, it should have been done before but not matter,
20 perhaps tomorrow morning, perhaps very late tonight, the
21 Defendants to speak to the witness so as to save time
22 tomorrow to find out what it is exactly he is interested
23 in referring, without making any attempt to persuade him
24 to do otherwise.

26 MS. STEEL: There is an awful lot of stuff to read through.

28 MR. JUSTICE BELL: He cannot read every word. Dr. Barnard,
29 I am sure, is familiar with the articles in the pale green
30 bundle, so it is a question of really just going through
31 the index on the front of the bundle and making a note for
32 his own purposes for that. I suggest you make an effort
33 to get here a bit earlier in the morning and/or you make
34 an arrangement for him to read it tomorrow, so that he can
35 just say 4, 8, 12, 15, whatever it is, and you can tick
36 them on your list.

40 MR. JUSTICE BELL: You do not necessarily have to take the
41 whole bundle. What you have to take home are the first
42 few pages before the green divider which has the index to
43 it. What Dr. Barnard has to do is to look at the papers
44 which Mr. Rampton has referred to, at least, so that he
45 can read the synopsis or summary at the front. I would be
46 surprised if he is not familiar with a lot of them. So,
47 it will not be as if he is coming to them, hopefully,
48 complete afresh.

54 Dr. Barnard is perpetually engaged in and I do not suppose
55 he has forgotten them particularly. I think you should
56 try to get here a bit earlier in the morning. You have
57 permission to speak to Dr. Barnard, not about how he is
58 going to express his evidence -- there is no point in
59 doing that because he has actually given his evidence
60 apart from the references -- but mechanics of how he would
