Day 123 - 09 May 95 - Page 55

Q. In 1988/1989 Pennsylvania authorities cited -- does that
mean "prosecuted", "cited"?
A. No. "Cited" does not mean "prosecuted", no.

Q. It means initiated?
A. Made an issue of, or noted. It does not necessarily
mean that we have been prosecuted, no.

Q. Right, they noted?
A. Yes.

Q. OK. That Micale management, McDonald's franchisee, in its
eight stores in the Philadelphia and Levy town area made
466 violations of child labour laws at its eight stores.
Do you know what action was taken?

MR. JUSTICE BELL: First of all, do you know about that?

MR. MORRIS: It has been admitted anyway.

MR. JUSTICE BELL: Yes, I know, but establish that.
(To the witness): Do you know about that yourself?
A. I know a little. I do not know if I can speak as an
expert on that case. You have said 88, 89, 88/89 and
Micale.

MR. MORRIS: I think so, yes. M-I-C-A-L-E?
A. Yes, Micale. Some people pronounce it "Micale".

Q. But it was eight McDonald's stores in the Philadelphia and
Levy town area that were involved in that?
A. Yes. My recollection was that there were some
violations. I do not know the range of those violations.
I know that the Company, when they were informed, when we
were informed, of those violations that we stepped in, as
I articulated earlier, in a fashion to address all of those
violations, and to make sure that the franchisee
implemented systems to reduce the possibility of
reoccurrence of those violations.

Q. Did they do so, as far as you are concerned?
A. To the best of my knowledge. I can only say that he
would not be a franchisee if there was continued violation
of those.

Q. So he is still there today in eight stores or more or less?
A. He has fewer stores today, but he is still a
franchisee.

Q. So despite 466 violations of child labour laws, he is still
there in control of, whatever it is, five or six McDonald's
stores?
A. The way you have phrased the question, you know, infers
something. I do not know the nature of those violations,
how serious those violations were; whether it was the fact
that there was a minor that worked ten minutes past the
hour that he was supposed to have clocked out or whether or
not -----
