Day 209 - 25 Jan 96 - Page 32

       box?

MR. JUSTICE BELL: Just pause a moment, because I am getting up
to speed on what is there.

THE WITNESS: I have not got anything. Where is this?

MR. JUSTICE BELL: Just wait for a moment. (Pause) Yes.

MR. MORRIS: Is it OK for Mr. Logan to have -- it is exactly the
       same document.

MR. RAMPTON: No, it is not.

MR. JUSTICE BELL: By all means, subject to anything Mr. Rampton
says, ask him what he wants to say. But it is not
customary for witnesses to take notes into the witness box
with them, unless they are expert witnesses. At the
moment, I do not see why Mr. Logan should; and I have no
reason to believe he needs them.

MS. STEEL: Probably just to save time, I think, more than
       anything else.

MR. MORRIS: Especially when it comes to the clock cards.

MR. JUSTICE BELL: You see, I have not read them, and, as far as
I know, Mr. Rampton has not read them.

MR. MORRIS: He can read them if he wants to.

MR. RAMPTON: I have read, of course, all the documents. What
I have not had the benefit of is Mr. Logan's aide memoire
that he has put on the documents. I certainly cannot sit
down and read them all now.

THE WITNESS: I do not mind not having them, if that makes a
       difference.

MR. JUSTICE BELL: I did not suppose you would.

MR. RAMPTON: As your Lordship says, experts are sometimes
allowed to take their notes into the witness box, and if
       people have made contemporaneous -----

MR. JUSTICE BELL: I do not think there is any need, because the
witness himself does not want them.

MR. MORRIS: OK. It is just when it comes to clock cards, you
know, it might save time. OK. Do we need to actually read
out the questions before we read the answers, if the
       answers are self-explanatory?

THE WITNESS: It is not just this statement.

MR. JUSTICE BELL: What you have in pink volume 1, which is
there, one of them has a "1" on the front, and if you turn
to divider 2 and then to page 26 ---
       A. Right.
