Day 312 - 11 Dec 96 - Page 10

the appropriate sum would have been a very small fraction
       of £350,000".

My Lord, taking into account the circumstances of both
those cases, how the Court of Appeal approached it with the
approval of the Court of Appeal, if I may say that, in the
       John case ----

MR. JUSTICE BELL: I remember that part appearing in that
       judgment.

MR. RAMPTON: That is cited in John. One has to say that even
in the light of the guidance given by John, the brackets
I now propose for each of the separate Plaintiffs and how
your Lordship adjusts as between the Plaintiffs is entirely
a matter for your Lordship. I would not say any more about
that, if any adjustment be needed.

The brackets which we propose can, we respectfully submit,
be seen as being certainly on the moderate side, given the
gravity of the numerous allegations made in this case,
given the extent of circulation, and given as important the
way in which this trial has been conducted by the
Defendants so as to ensure maximum publicity for the
       allegations.

MR. JUSTICE BELL: Yes. I will have a look at those, if I could
       be given a full copy.

MR. RAMPTON: I am sorry about that. I do not know what
happened. It is because it was originally a two-sided
       document.

MR. JUSTICE BELL: It does not matter. Have you got complete
       copies of Houston v. Smith?

MS. STEEL: Mine seem to be OK.

MR. JUSTICE BELL: Very well. Mr. Rampton, was there anything
       else you wanted to say?

  MR. RAMPTON: No, my Lord.

MR. JUSTICE BELL: Since you are on your feet anyway, I am in
the course of re-reading the bundle in relation to
Colchester, Bath and Heathrow. If I have any further
queries I will ask you sometime, but I want to understand
the position in relation to the Alimi calculations.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: You are quite right, it was for 18th October
1986 that I did a specimen calculation, and you are quite
       right ----

MR. RAMPTON: Your Lordship double counted the sum.

MR. JUSTICE BELL: What I did, the 16.02 hours, in my sum I put
in at rate and a half when I had already counted it in my
first sum. So I came out at a figure which was too large
