     3   Q.   So, are you saying that the rap sessions can be ignored
     4        because there is not enough people there?
     5        A.  No.  I am saying that two individuals may have made the
     6        comment at the group of the people that were there.

     8   Q.   Do you remember the Company investigating complaints about
     9        breaks?
    10        A.  No, I do not.

    12   Q.   So, the Company never bothered to try and find out whether
    13        it was just one or two individuals who were having this
    14        problem or whether it was most of the people working at the
    15        store?
    16        A.  I do not remember any investigation, you know,
    17        following this rap session report.

    19   Q.   Following any of the rap session reports?
    20        A.  I do not remember any of those, no.

    22   Q.   If we perhaps look at some of the clock card files just for
    23        one Saturday in August 1993; that is in file 2, tab 2,
    24        starting on page 310, which is a Saturday when I believe
    25        there were particular complaints about breaks.  Have you
    26        found the page?
    27        A.  I have got page 310 in front of me.

    29   Q.   Right.  Do you see the fourth person down, Tilley,
    30        Matthew Tilley, he started at seven in the morning and went
    31        for his break at 11 minutes past eight, back to work at
    32        four minutes to nine, and no break until -- well, no break
    33        until he finished at three o'clock.
    34        A.  I can see the individual, yes.

    36   Q.   And the next one.  So that is six hours without a break
    37        there.  That would be illegal; and there is no break
    38        between the hours of 11.30 and 2.30?
    39        A.  There is no break, yes.  This information would be, so
    40        far as I can see, correct.

    42   Q.   Then if we look at the next person, Stephen Clarkson,
    43        started at 12 minutes past 10, went on his break at four
    44        minutes past 11, came back on at 34 minutes past 11, and
    45        then no more breaks until he finishes at one minute past
    46        three.  So, again, there is no break there of 45 minutes
    47        between half past 11 and half past 2?
    48        A.  The information, as far as I can see, as I say, in
    49        front of me, is correct.

    51   MR. JUSTICE BELL:  Do we know which day that is; does it say 
    52        anywhere the day of the week?

    54   MS. STEEL:   It is a Saturday, 8th August.

    56   THE WITNESS:  It would have been the 7th, because the time
    57        printed is 0.41, which would have been the following day.
