18 A. I am not trying to make any implication. I am saying

24 natural enthusiasm and allow the witness to finish the

34 MR. MORRIS: There is no difficulty, is there, as far as
35 customers taking part in the recycling scheme? If
36 McDonald's introduce a national recycling scheme in its
37 stores tomorrow and explain to the customers what was going
38 on, that would be quite feasible, assuming you were
39 carrying out your responsibilities at the other end? Is
40 that correct? People are capable of recycling, are they
41 not?
42 A. Apparently not in this case.

44 Q. So that is the implication then?
45 A. That they did not recycle?

47 Q. Apparently they are not capable, is that what you are
48 saying.

50 MR. JUSTICE BELL: No, they were not capable -- it is clear to
51 me the customers in the four Nottingham stores were not
52 capable if Mr. Oakley's evidence is accurate. If they
53 could not distinguish polystyrene from paper or carton to
54 the extent that it was about half and half in the bin, they
55 clearly were not capable or were not minded to co-operate.
