     3   MR. JUSTICE BELL:  Let us assume that there is not much sense in
     4        you coming back in the morning because you will just have
     5        to rush around all over the place and you will not be
     6        finished in the hour you can give us, Mr. Oakley, do you
     7        know when you can come back?
     8        A.  I could come back Friday this week.

    10   MR. JUSTICE BELL:  We have Ms. Dibb on Friday.

    12   MR. RAMPTON:  Yes, and your Lordship will remember that we
    13        rearranged Mr. Oakley to fit in with Ms. Dibb's holiday
    14        arrangements.  We have got Ms. Dibb who is supposed to be
    15        coming back on Friday.

    17   MR. JUSTICE BELL:  If Ms. Dibb comes back on Friday, we will
    18        finish her on Friday, will we not?

    20   MR. RAMPTON:  I promised that I will finish her on Friday.

    22   MR. JUSTICE BELL:  I think we ought to keep that as it is.
    23        I cannot remember whether that means we have finished the
    24        advertising witnesses or have you anyone else then?  Are
    25        there any to be read.

    27   MR. RAMPTON:  I do not think so.

    29   MR. MORRIS:  The only thing is that our witness Mr. Clay Harris
    30        has been challenged as a Civil Evidence Act Notice so
    31        I presume that means we have to call him sometime -- if you
    32        remember, the Financial Times journalist or editor or
    33        whatever.  Maybe that could be just left at any time but
    34        I am sure it is not crucial.

    36   MR. JUSTICE BELL:  Mr. Harris' part in this case is that he
    37        purports to quote Mr. Preston, so he is not giving evidence
    38        of his own knowledge.  He is just saying what Mr. Preston
    39        said.  So he can be treated as a separate consideration,
    40        really, can he not?

    42   MR. MORRIS:  Yes.

    44   MR. JUSTICE BELL:  Unless anyone has a comment to the contrary,
    45        I am really quite keen to stick to Ms. Dibb on Friday.

    47   MR. RAMPTON:  That probably means that Mr. Oakley cannot be
    48        heard again before Christmas.

    50   MR. JUSTICE BELL:  Do you know what Ms. Dibb's position is early 
    51        next week?  Did we ask her when she was here?

    53   MS. STEEL:   I think she had quite a lot of commitments.  She
    54        did specifically say that she wanted to know more or less
    55        for sure that it would be Friday so that she could fit in
    56        all the other arrangements she has to make.  At the moment,
    57        the 12th is clear.  The problem with that is that if we
    58        take away the 12th we will not get any clear days between
    59        the finish of this.
