Day 118 - 01 May 95 - Page 29

Q. All those people that fall into that category will work at
least one week more than 39 hours, will they not, by
definition?
A. Yes.

Q. Maybe working two weeks more than 39 hours. They would
have to, in fact ---

MR. JUSTICE BELL: No.

MR. MORRIS: -- not necessarily.

MR. JUSTICE BELL: If they were on the 79 it might be one extra
hour and one over two weeks?
A. Yes.

Q. Otherwise it might be both weeks.

MR. MORRIS: So we do know that, for example, the first store,
Romford, 4.76 per cent worked more than 39 hours?
A. Two people.

Q. Yes, it is two people but if you look at all the
stores ---
A. Yes.

Q. -- as you flick through, this is in the "total" column of
that 79 to 96, we can see 4.76, 1.78, 2.94, 6.55, 8.64,
6.77, et cetera, as we go through.

MR. RAMPTON: Not "et cetera" if you are going to go through
them.

MR. MORRIS: I am not going through them because there are
actually about 300 pages.
A. I think will you find that there are 85 pages in this
report. I have checked it before I sent it to you and I
think it is 85 for each.

Q. But as you flick through, I am sure that you can agree,
while there are some 1s and 2s and some 8s, 9s and 10s, we
are talking about something like, average, 4, 5, 6 per
cent, some go as high as 13 per cent, the Hampstead store
on page 14, or whatever. Would it be reasonable to say
that something between 4 and 6 per cent of staff fall into
that category?
A. Well, I do not know. I have not worked it out for the
whole period but, I mean, looking through, none of the
figures are particularly high. If you accept that a
supervisor has three restaurants, it would take him no time
at all to check those figures, none at all.

Q. Yes, but we are talking about, this is an absolute
minimum ---
A. Sorry?

Q. -- of something between 4 and 6 per cent of all staff in
the South-East region -- is it London or is it Southeast,
Metropolitan; what do you call your regions?
