     3        concerned if people were eating McDonald's several times a
     4        week.  Was day 32, page 77.  But the point he was making is
     5        that McDonald's are responsible for whatever their
     6        contribution is and...

     8        Dr. Lobstein, during re-examination, also confirmed that he
     9        considered that McDonald's statements were not the whole
    10        truth about what they sell.  We referred to a McDonald's
    11        document, I think it came from America.

    13   MR. JUSTICE BELL:  Did you have a reference for that last one?

    15   MS. STEEL:   Day 32, page 76, sorry.  He was referred to a
    16        McDonald's document, which I think came from America, which
    17        stated "the goal is to keep sight of your daily intake",
    18        and he agreed that that was sensible and, well, he actually
    19        said he found it an amusing comment to come from
    20        McDonald's.  Day 32, page 77.  The point about that is that
    21        throughout this trial McDonald's have been trying to assert
    22        that it does not matter what you eat on a day to day basis,
    23        it is what you eat over...  Well, it seems to have varied
    24        between weeks to months, sort of thing, but the point is,
    25        here is an admission in their own document that the idea of
    26        trying to adopt a healthy diet is to keep sight of your
    27        daily intake, and, obviously, that does not mean that on
    28        the odd occasion you cannot...  You know, I don't know, if
    29        you have got a party to go to or something like that.

    31   MR. JUSTICE BELL:  You can have a blowout?

    33   MS. STEEL:   Yes, but overall you should try and balance it
    34        throughout the day, day by day.  Dr. Barnard expressed
    35        concern that McDonald's advertising was less than honest.
    36        For example, he said the McLean Deluxe burger was billed as
    37        91 percent fat free, meaning by weight 9 percent was fat,
    38        but he said that was a complete meaningless statistic as in
    39        fact 49 percent of the calories in the patty and 29 percent
    40        of the whole burger came from fat.  That is 29 percent of
    41        the calories in the whole burger, with the bun included.

    44        Can I just ask, did I give a reference for the leaflet that
    45        we were just referring to, that Mr. Lobstein leaflet from
    46        McDonald's?

    52        Dr. Barnard also referred to the fact that McDonald's had
    53        manufacturer a plastic toy which came with a booklet and
    54        was available with a Happy Meal, and that the booklet
    55        stated "Food in the meat and protein group gives your body
    56        the tools it needs to grow and build healthy muscles.
    57        Eating two servings a day of these foods can make it easier
    58        to do things like climb higher and ride your bike further."
    59          Mr. Barnard attacks that statement and says there was
    60        absolutely no evidence for it.  He made an official
