Day 265 - 19 Jun 96 - Page 58

because what we would have to do is read through all his
notes again now and then sit down and say, "Now, is there
anything else I remember apart from that?" It would take
quite a long time to do and it probably would not help me
anyway. If he said: "No, I cannot remember", it would not
help me, and if he said: "Yes, I can remember Mr. Morris
said that" or "Ms. Steel did that," it would have brought
in evidence which you would not otherwise have had. With a
certain amount of preparation I accept to be right. You
must put your challenges where there are challenges so I
can understand them and any points you want to put in
relation to the challenges. It is all right saying, as you
did the other afternoon, that you think your
cross-examination has been done in your own way and very
effective. I am not going to pass comment on that
generally. What I want you to understand is what will be
effective with me is particular challenges, so I know where
there is an issue and if, when you challenge evidence the
witness sticks by it, then put to him anything you want to
which might lead me to have second thoughts about the
credibility of the witness. But you cannot go round and
round with generalizing indefinitely. I will take a five
minute break. We will go on until about five-past-4 with
Mr. Claire's evidence and then we will deal in Chambers
with the matters that Ms. Steel raised.

                        (Short adjournment)

MR. MORRIS: Have you got bundle yellow, volume 2 in front of
       you?
       A. Yes, I do.

  Q. Can you go to divider 7 please and I am not sure what
number it is now down as. It is the notes of Mr.
Pocklington for the 1st March 1990. I do not know if they
       are in the same--

MR. JUSTICE BELL: They are in the blue volume which has got
all the notes, and what is the date you want?

MR. MORRIS: The 1st March of 1990.

MR. JUSTICE BELL: It is the blue volume you had a moment ago.

MR. RAMPTON: I have it as page 89.

MR. JUSTICE BELL: Yes. Page 89.

MS. STEEL: Have you got page 89 in that volume? There should
       be some handwritten notes?
       A. No page.

MR. RAMPTON: I think Mr. Claire is looking in the wrong volume.

MR. JUSTICE BELL: No, it is a blue. You are leaning against
it. You are touching it virtually. You have just touched
it and put it down again. What is that?
       A. Is this the same one, is it? Sorry?

  Q. Yes. Page 89 in that?
