Day 005 - 04 Jul 94 - Page 21

1 A. I think it is very close. Subsequent witnesses are
going to talk in detail about how McDonald's fits into a
2 well balanced diet far better than I can in technical
              terms.
     3
         Q. So you feel if someone said McDonald's food was high in
4 fat, they would be lying?
              A. I do not believe it is high in fat. Secondly, high
5 compared to what? A steak and kidney pie?

6 Q. A proportion of the meal being eaten?
              A. No, I would not accept that.
     7
         Q. You would not. So, if someone said that, you would say
     8 they were lying?
              A. I said the statement is untrue. Maybe they have their
     9 facts wrong.

10 Q. You were talking about Professor Wheelock last week?
              A. I was asked if I knew him. I said "yes".
    11
         Q. He provides nutritioning advice to McDonald's, does he
    12 not?
              A. Yes, he does.
    13
         Q. Have you read his statement?
14 A. I have not read it recently. I may have read it many
months ago, but I cannot say it is at the top of my mind
    15 at the moment.

16 Q. Perhaps you could turn to page 3 of his second statement?
That is in volume 8, section B, tab 4 -- sorry, it is
    17 volume 5, yellow.

18 MR. JUSTICE BELL: Yellow, 5?

19 MISS STEEL: Yes. Just read the first sentence to the court,
              please?
20 A. OK, top of the page: "I have examined the
              testimony----"
    21
         Q. Page 3.
22 A. "There is no dispute that many of McDonald's products
are relatively high in fat and in saturated fat".
    23
         Q. OK, thank you. He is your nutritional adviser?
24 A. Again, you are taking a sentence totally out of
              context. May I go on?
    25
         Q. It does say there is no dispute that McDonald's food is
    26 relatively high in fat.

27 MR. RAMPTON: No, my Lord, it does not say that. This is not
right. This is not a proper way to cross-examine a
28 witness. I know I can re-examine. He says, "There is no
dispute that many of the McDonald's products are
29 relatively high in fat and saturated fats", and then
follows the context to which Mr. Preston referred.
    30
MISS STEEL: I did read that out in full.
