Day 068 - 16 Dec 94 - Page 40

       out for you ----
       A. May I have the privilege of seeing that?

MR. MORRIS: You can. I was going to save time by reading it.

MR. JUSTICE BELL: Let him look at it, then he will feel more
confident. Have you got the reference?

MR. MORRIS: I do not know which one it is in. Rainforest.

MR. JUSTICE BELL: I think Mr. Cesca appears in more places then
       one.

MR. RAMPTON: My Lord, it is yellow XI, number 1 in yellow XI.

MR. JUSTICE BELL: Have you got that?
       A. What number?

  MR. JUSTICE BELL: Yellow XI.

MR. MORRIS: Bottom of page 6, top of page 7. I do not know
       what tab it is.

  MR. JUSTICE BELL: Tab 1.

MR. MORRIS: Bottom of page 6, called Fresh Frozen Deboned Meat?
       A. Yes, I have got it.

  Q. It says here: "Given the problems with fresh meat, the
deboned meat will most likely be frozen. Consequently,
whole cuts of frozen, deboned beef make up the great
majority of imported beef." That is in general in the
country, as far as I understand it.
       A. If you give me time to look back at what -- where is he
       referring to?

MR. MORRIS: You can take my word for it that he is not saying
they are not using imported beef; he is saying that this is
the general problem of the McDonald's Corporation trying to
       avoid imported beef.

MR. JUSTICE BELL: What I suggest is, read the whole of C, over
the page, down until you come to paragraph 12.

MR. RAMPTON: My Lord, might I suggest that it actually makes
more sense if one starts on page B on page 5?

MR. MORRIS: To be honest, I do not necessarily want the witness
to read the entire statement of Mr. Cesca. I want to him
recognise just in that paragraph on page 6, point C, that
Ray Cesca is saying: "Less than 15 per cent of the total
amount meat used by McDonald's approved US meat suppliers
as a whole in the production of McDonald's beef patties is
frozen." I want to know how Mr. Cesca has a different
       opinion from the witness.

MR. JUSTICE BELL: Can you answer that question, first of all?
       A. I have not seen -- I do not remember seeing this paper.

MR. MORRIS: So how can Mr. Cesca ----
