5 Mr. Rampton this morning before we started regarding Hong
6 Kong. (Handed). Do you recognise this as Hong Kong? It
7 says on the right-hand side "Hong Kong 1995" -- that is
8 this year -- "McDonald's News" do you recognise that? At
9 the bottom it has: "Copyright 1995 McDonald's
10 Corporation". That is your -----
11 A. It is the first time I have seen this. I have been to
12 Hong Kong before, but it is the first time I have seen this
13 publication.

15 Q. It has " Copyright McDonald's Corporation" which is your
16 organisation, is it not, you represent? If we look at the
17 section: "We care about the ozone layer". If you read the
18 fourth paragraph it seems that HCFC-22s are still being
19 used in Hong Kong as blowing agents in foam packaging of
20 some kind?
21 A. It indicates that it has reduced the harmful effect to
22 the ozone layer by 95 per cent.

24 Q. So that is recognising it still has a 5 per cent harmful
25 effect, compared to CFC. So if it has a harmful effect on
26 the ozone layer, how can you have a heading that says: "We
27 care about the ozone layer"? That is deceiving the public,
28 is it not?
29 A. I think that is quite a stretch, Mr. Morris. I would
30 draw your attention to the third paragraph where it says:

32 "In 1987 McDonald's became the first company in the
33 restaurant industry to require in its packaging suppliers
34 to stop using foam packaging -- the use of CFCs in the
35 manufacture of its packaging".

37 Q. Yes, but the reality is if something is still damaging the
38 ozone layer, you should not have a heading say "We care
39 about ozone layer"?
40 A. Well, we do.

51 was only given to us this morning. I might have been able
52 to made some enquiries about it if I had been given it when
53 Mr. Morris got it. Your Lordship has told them several
54 times as soon as they get a disclosable document they must
55 disclose it.
