Day 086 - 09 Feb 95 - Page 24

Prohibition Notices to see if there are any patterns that
       have emerged on serious problems?
       A. No.

  Q. So are you unable to draw any conclusions about what action
       local statutory bodies are taking?
       A. I think Prohibition Notices cover such a broad spectrum
of things and they can be often sorted out just at a local
level very quickly. What I can tell you is if anything of
note happens within health and safety that Jill thinks
I should know about, then I get an E mail, electronic mail,
sent down to me so I am aware of the situation.

  Q. What have you seen then in the last six months that was of
       note?
       A. Unfortunately, there was a door fell on a young child
when a contractor was changing a front door recently.

  Q. But in terms of the employees' safety?
       A. Employee safety in the last six months? I believe
there was a scale lift failure that came through, and that
would not have been a Prohibition Notice. That would be us
notifying the Environmental Health Officer of a dangerous
       occurrence.

MR. JUSTICE BELL: Do you want the five-minute break?

MR. MORRIS: Is it possible to finish this?

MR. JUSTICE BELL: Yes, it is.

MR. MORRIS: We are not far off really. (To the witness): So,
if you look at this Notice in front of us?
       A. Would you like me to read it?

  Q. Yes, have a quick skip through it. It is from Michael
       Mcshirkie.
       A. That is 794J?

  Q. Yes.
       A. OK, I have read that through now.

  Q. Do you agree with what it says?
       A. Yes, in general.

  Q. Is there anything you disagree with?

MR. JUSTICE BELL: The essence of it is that the use of portable
electrical appliances in the wash-up area ---
       A. Without an RCD.

  Q. -- without the protection of a residual current device
installed thereto will involve a risk of serious personal
       injury?
       A. I agree with, yes.

  Q. Do you draw any issue with that?
       A. No, I do not draw any issue with that.

MR. MORRIS: So, if we just go to Michael McShirkie's statement
