     2   Q.   The adjustment of clock cards, that was something you did
     3        from time to time as well?
     4        A.  That is true.

     6   Q.   Yes.  Is it true that when you made those adjustments the
     7        staff whose adjustments were being made were not consulted
     8        over that?
     9        A.  Yes, they were.

    11   Q.   What, before the adjustments were made?
    12        A.  Yes, or if necessary -----

    14   Q.   At 1 o'clock in the morning?
    15        A.  Or, if necessary, if I found a problem with someone's
    16        clock card, for instance, at 1 o'clock in the morning
    17        relevant to the day before, you would have to write a note
    18        in the Manager's diary and then it would, perhaps, be John
    19        Gore did not clock out for his break, I have clocked him
    20        out for 45 minutes, you would leave a note in the Manager's
    21        diary; speak to John Gore the following day and if he did
    22        not, in fact, have a break or he had less than 45 minutes,
    23        you would put the money back on again.

    25   Q.   You would put the money back on again, what, the next
    26        evening?
    27        A.  Yes, so if, for instance -----

    29   Q.   You would make another adjustment?
    30        A.  Yes, if, for instance, he clocked out for his break and
    31        then at the end of his shift clocked out again and did not
    32        actually clock back in again in between, then he would not
    33        get paid for that period.  So I would have to make some
    34        adjustment to it to make sure that he did get paid, so I
    35        would clock him out, say, for 45 minutes.  I would look at
    36        the Manager's diary and if there was no note from the day,
    37        I would assume he had a 45 minute break.  I would then
    38        check it the following day.  If he said he had a 45 minute
    39        break or if he said he only had a 32 minute break, I am in
    40        a position where I can put 13 minutes back on for him.

    42   Q.   Because people are not paid for their breaks, are they?
    43        A.  They are paid -- they are only paid for their 20 minute
    44        break, well, for their 45 minute break, if they are
    45        entitled to both.

    47   Q.   What 20 minute break?
    48        A.  If an employee works over 10 hours then they are
    49        entitled to a 20 minute break if they want one.

    51   Q.   Which they would be paid for? 
    52        A.  Which they will be paid for.  The Company ruling on 
    53        this, I think, changed about a year ago.  However, we still
    54        employed a system that if they worked 10 hours or over 10
    55        hours then they get a 20 minute break, a paid break.

    57   Q.   But the 45 minute break, or whatever length, is unpaid?
    58        A.  That is right.
