MR. JUSTICE BELL: Third paragraph, second page, was the
       particular -----
       A. First paragraph, second page, I think it was.

MR. RAMPTON: My Lord, it is, of course, not a McDonald's
document. I do not mind, as far as I can tell, without
taking instructions, whether it is copied. But, in
principle, it is a matter for the witness. True it is he
has referred to some small part of it to remind himself.

MR. JUSTICE BELL: There is no harm in Ms. Steel or Mr. Morris
       seeing it now, is there?

MR. RAMPTON: Not unless it contains information which is not
relevant to the case which Mr. Van Erp would say is
commercially sensitive and that I do not know.

THE WITNESS: There is -- I think they talk about some pricing
issues in there in there, in the rest of that letter. As
I said, it is a letter that addresses various issues and,
as I said, it was more of a reminder for me when that was
       actually carried in or implemented.

MR. JUSTICE BELL: Are the pricing issues still topical or not?
       A. I would not think so.

MR. JUSTICE BELL: No, anyway, I would not have thought .....

MR. RAMPTON: I am in your Lordship's hands.

MR. JUSTICE BELL: I suggest Ms. Steel and Mr. Morris just have
a moment to read it through; if they want to take a copy,
       then they can.

MR. RAMPTON: There is also some information in it, I notice,
about transport packaging going 100 per cent recycled.

MR. JUSTICE BELL: Yes, all right. If you want to ask any
questions on that I suggest you ask them now while you have
the letter. When you have finished asking any questions on
the document, we will have one photocopy taken, kept in
court, the original handed back to Mr. Van Erp to take-away
with him and you can decide whether you want further copies
made to be put in the bundles anywhere.

MR. MORRIS: Right. It seems to be a similar kind of letter to
others that we have that were disclosed.

MR. JUSTICE BELL: I am not suggesting it is necessary to copy
it, but you put any questions, I suggest, you want on it
now and then it can be taken out of court and photocopied.

MR. MORRIS: Can I ask you a general question about
documentation? Do you have an arrangement with McDonald's
that they have access to your documents?
       A. Yes, there is a full open book policy between ourselves
       and McDonald's.

  Q. If they need copies of any documents you have got, have
