     2        A.  I was going to add before, unless they fell into one of
     3        these other small categories, like absenteeism or
     4        misconduct or something like that, on probation, but,
     5        broadly speaking, yes, they would be covered in those
     6        dismissal areas, those involuntary codes, as they are
     7        called.

    11   MR. JUSTICE BELL:  I suppose they could fall into (7) "mutually
    12        agreed" which is seven and a quarter per cent as well, some
    13        of them might; again just what the Manager thinks is the
    14        most appropriate to their individual situation.
    15        A.  Yes.

    17   MR. JUSTICE BELL:  Yes, H?

    19   MR. MORRIS:  Have you got the one that is graded as to the
    20        percentage that agree?
    21        A.  Yes.

    24        A.  Yes.

    26   Q.   It is called H1 for the sake of ease.

    28   MR. RAMPTON:  For everybody else it is H3.  For most people, my
    29        Lord, it is the last page.

    31   MR. JUSTICE BELL:  It is the last.

    33   MR. MORRIS:  Only 82 per cent agree that they get paid for all
    34        hours worked, that is the fourth one down.  When you found
    35        this out, what action did you take?
    36        A.  What happens is that -- what happened is that when the
    37        results go out, they go to each restaurant and, as part of
    38        looking into all of the areas highlighted, people, i.e. the
    39        Supervisors and so on, look at the records and try to
    40        establish, given that obviously one of the difficulties of
    41        this survey being anonymous is you cannot ask the
    42        individuals, and looked at why that might be and took
    43        corrective action, where necessary, if they found anything.

    45   Q.   The Managers?
    46        A.  The Supervisor in conjunction with the Manager and so
    47        on, the people at restaurant level.

    49   Q.   But the Managers, presumably, are going to be the problem,
    50        they are not, because they are the ones who are in charge 
    51        of scheduling and payment for hours worked? 
    52        A.  They are in charge of it, yes, but mistakes can be 
    53        made, and so then if corrective action is taken and
    54        preventative action, that is what is important.  Obviously,
    55        if it is found that someone has not been paid, then they
    56        would receive the back pay.  It can be to do with things
    57        like new people not clocking in and so on, that type of
    58        thing.
