     6   MR. RAMPTON:  I hesitate whether this evidence is admissible;
     7        I have to say it certainly is hearsay.

     9   MR. JUSTICE BELL:  It just is not evidence.

    13   MR. JUSTICE BELL:  I suppose the fact that it was said might be
    14        evidence, but you have gone a long way from the documents
    15        now, have you not?

    17   MR. MORRIS:  Yes.  It is fine for Mr. Rampton to say it is not
    18        evidence, but referring to documents that are not disclosed
    19        is not evidence and calling a witness -----

    21   MR. JUSTICE BELL:  No, you embarked on asking questions to
    22        identify documents.

    24   MR. MORRIS:  I understand that but, obviously, I want to get
    25        back to Ms. Hovi about the documents and it struck me that
    26        as Mr. Rampton asks: "Is it to have some relationship with
    27        the witness", that he knew something that the court did not
    28        know.

    30   MR. JUSTICE BELL:  You steered him away from that, did you not?

    32   MR. MORRIS:  Well, yes but -----

    34   MR. JUSTICE BELL:  You objected to him asking the question.

    36   MR. MORRIS:  Yes, but, at the same time, I wanted to know what
    37        he meant and that is why.

    39   MR. RAMPTON:  I am sorry, my Lord, I am not going to say.  There
    40        may be matters which I put to Ms. Hovi in cross-examination
    41        as to credit.

    43   MR. JUSTICE BELL:  Ask that question but we are going to rise at
    44        1 o'clock anyway.  I do not see why you need ask Mr.

    47   MR. MORRIS: (To the witness)  Could you explain the difficulty,
    48        the impression you were given on what the difficulties
    49        were?

    51   MR. JUSTICE BELL:  Not the impression.  Can you remember 
    52        anything you were told about Ms. Hovi or her performance at 
    53        Jarretts?
    54        A.  I was told that she was very keen on certain aspects of
    55        her job, that she seemed anxious to pursue matters which
    56        she could not have been familiar with in the short time she
    57        was present.  I understood the gist of what was a general
    58        comment about difficulties, that because of a
    59        misunderstanding of the true nature of this type of
    60        business, and a lack of sheer knowledge of the nuts and
