Day 010 - 11 Jul 94 - Page 57

1 MR. JUSTICE BELL: Was this in the Polystyrene Fact Sheet and
              Miscellaneous?
     2
MR. RAMPTON: Do you know which section it is in of your
     3 document, Mr. Lipsett?
              A. Yes, it says, in the article it says -----
     4
MR. JUSTICE BELL: I am sorry, if someone is going to refer to
5 the article, I have to be referred to it. I would like my
own because I have marked it. All I need to be told is
6 which of 1 to 12 it is in.

7 MR. RAMPTON: I wonder whether your Lordship put it behind or
              with Mr. Lipsett's statement?
     8
MR. JUSTICE BELL: Yes, that is quite right.
     9
MR. RAMPTON: Can we look at the second column, the article
10 which begins in my version two-thirds of the way down the
page: "McDonald's pull out CFC issue". Is yours in the
    11 same form?
              A. It is in a different location; that is the same
    12 headline.

13 Q. Is there a paragraph which begins: "Sources among resin
              suppliers"?
14 A. That is right. It says specifically: "McDonald's is,
however, the largest user in the US of foam polystyrene
15 food containers accounting for 70 million pounds of
polystyrene annually, a supplier source says".
    16
         Q. 70 million pounds is roughly equivalent, we have ours in
17 metric tonnes, to 31,800 metric tonnes, is it not?
              A. Sorry?
    18
         Q. 70 million pounds weight is roughly equivalent to the
19 31,800 metric tonnes, is it not?
              A. I am sure that you have done the calculations
20 properly, but I do not know the constant by which it would
              be converted.
    21
MR. MORRIS: Let us assume -----
    22
MR. RAMPTON: My Lord, I have done the calculation.
    23
MR. JUSTICE BELL: It is 2,200 pounds weight to a metric
24 tonne. Take it as being about 70 million.

25 MR. RAMPTON: Just over. Leaving that, I am going to come back
to that, Mr. Lipsett. Do you see the difference between
    26 the two statements?
              A. I do.
    27
         Q. How do you account for the difference?
28 A. I did not have this article and I was relying on my
memory of what the article said. Having read it in the
29 1980s during the campaign and having returned to
university, I did not have this material at my disposal or
30 much of this material at my disposal to refer to.
