11 MR. JUSTICE BELL: I do not think there is any harm in saying in
12 open court, but apparently tomorrow's clinic was cancelled
13 anyway. Ms. Steel can have an appointment at 2 o'clock on
14 Friday, otherwise she would not get another appointment
15 until late April.

17 MR. RAMPTON: With respect, that is a very great deal more
18 satisfactory than tomorrow afternoon. I would hope
19 Dr. Pattison would not have to come back. If he does it
20 would have to be some indeterminate date in the future.
21 I have Mr. Bennett fixed for Tuesday. I would be very
22 disappointed if he was not finished by lunch time Friday
23 anyway.

25 MR. JUSTICE BELL: I would like you to do your very best to
26 complete the cross-examination of Dr. Pattison tomorrow.
27 If that is not so I very much hope it can be achieved -- my
28 preference would be to complete him on Wednesday provided
29 there is not very much left. Monday at the moment is an
30 empty day.

32 MR. RAMPTON: He has set aside three days as it is. I do not
33 know if he can come on Monday. I know Dr. Pattison cannot
34 come on Wednesday. He could if he is ordered by your
35 Lordship of course, but he has an important appointment on
36 Wednesday morning with a customer or he has to make a
37 presentation. Quite honestly, after four days'
38 cross-examination by then, if the Defendants cannot finish
39 him then his convenience should, in my respectful
40 submission ----

42 MR. JUSTICE BELL: I have convenience as well. I do not like
43 coming back, if I may use the phrase, for fag ends of
44 evidence. We will see how we do tomorrow. The whole of
45 this discussion may be pointless. If we finish tomorrow it
46 may be pointless. I would like you to find out from
47 Dr. Pattison if he cannot come on Wednesday what his
48 position is on Thursday, Friday or Monday. I would like
49 you to find out what Mr. Bennett's position is on Monday of
50 next week as well, if you would be so kind.

55 statement this morning and I have not had a chance to read
56 it yet, but it may be we want a chance to ask Ms. Hovey
