Day 095 - 02 Mar 95 - Page 33

MR. MORRIS: Would you not say if they were there for three
weeks that that would be cruel, not to be able to turn
round for three weeks?

MR. JUSTICE BELL: He has said that if they could not move for
three weeks he would have a problem with that. If they
could not move for the half hour when the piglets were
feeding he said, words to the effect, that he could live
with that.

MR. RAMPTON: I think, in effect, he said more than that. He
said he would need to look at the whole thing, see the
pigs, see the conditions.

MR. JUSTICE BELL: I have that. Thank you.

MS. STEEL: Carry on, please.

(The video recording continued).

MS. STEEL: The piglets shown there, have you seen piglets in
those conditions?
A. No, not in those conditions. In the US most of them
are confined in a closed environment. In a cold
environment they could be in confinement. I have not
visited those, but are they in pens, yes, they are.

Q. They are in pens?
A. Yes.

Q. What would be the floor, wire mesh or concrete?
A. It could be whatever. It changes with the environment
and the resources and whatever they have available. It
could be concrete. What I have seen most of it is
concrete, concrete and then they can go outside. They are
definitely bigger from what you have seen, what we see on
the film. They are several times bigger.

Q. Carry on please.

(The video recording continued).

MS. STEEL: Just pause, please. That would be fairly typical?
A. Absolutely. Well, what?

Q. The slurry lagoon?
A. Not like that, absolutely not. The Environmental
Protection Agency have some requirements of how you can
eliminate waste. That waste that gets slurry, that goes
there goes into a lagoon, but the lagoon has to be aerated,
it carries bacteria, the air-flow that goes out of there
has to be as good as the water that went into the factory.
That is one of the requirements of the Environmental
Protection Agency. What you see there is not typical.
What you see is a lagoon, yes.

Q. A lagoon would be typical?
A. Yes, typical, the lagoon, but it does meet the
requirements. It is not like it represents a hazard,
