1 MR. JUSTICE BELL: That is wrong, is it?

3 MR. RAMPTON: That is correct. I say both in relation to
4 Professor Crawford and Mr. Cannon, we conveyed this message
5 to your Lordship's clerk. If they should come back, then
6 it may be that I will ask one or two questions; I think it
7 unlikely.

9 MR. JUSTICE BELL: The Plaintiffs can consider their position
10 -- the Defendants can consider their position with regard
11 to Mr. Cannon after we have dealt with the question of the
12 amendment and any argument which arises from that as
13 well.

15 MR. RAMPTON: I was going to ask your Lordship before the
16 adjournment, because we have administrative arrangements to
17 make, if Mr. Cannon is not coming back (at least not
18 tomorrow) what your Lordship's intentions were.

20 MR. JUSTICE BELL: I have raised that now because the question
21 I was going to ask is can Dr. Millstone come tomorrow? Can
22 you come tomorrow, Dr. Millstone?

24 THE WITNESS: I do not think I can. I have commitments which
25 I do not think -- well -----

27 MR. JUSTICE BELL: I would very much like you to come, if you
28 possibly can. Everyone has commitments, some are more
29 important than others. It would be much more desirable
30 that we went straight on if we could if there is not
31 another witness at present organised for tomorrow. That is
32 why I have raised it now rather than at five to four, when
33 it might be more difficult to change arrangements.

35 MS. STEEL: In fairness to Dr. Millstone, he was shifted around
36 because the Plaintiffs wanted to call Professor Ashworth.
37 He has been moved around quite a lot.

39 MR. JUSTICE BELL: What is the position, Dr. Millstone?

41 THE WITNESS: If I can I will make some phone calls.

43 MR. JUSTICE BELL: It is much easier to run straight on than
44 have breaks.

46 MR. RAMPTON: My Lord, can I say this? It may help. Thus far
47 -- I make that emphatic reservation -- thus far, if
48 Dr. Millstone's evidence in chief were all but or nearly
49 finished today, I do not think I am going to detain him for
50 very long tomorrow morning. So if that helps him make his
51 arrangements or readjust them, let us say an hour at the
52 most, as matters presently stand.

54 THE WITNESS: My position is simply that I was hoping to take
55 responsibility for my one year-old child tomorrow because
56 my wife is too ill to do so. I need to find somebody else
57 to do that.

59 MR. JUSTICE BELL: I would like you to do your best to do that
60 if you can. As I hope is apparent, I am not unsympathetic
