Day 191 - 24 Nov 95 - Page 18
the Defendants have decided they are going to call and
which they are not.

MR. MORRIS: Mr. Cantor and Mr. Bowland do not affect those
people.

MR. RAMPTON: For example, Mr. Soriano, Mr. Morris says blithely
now at the end of November that he thinks he is going to
call him. We have no indication when that might be. Until
we know when it might be, we cannot schedule our other
witnesses. Alternatively, if he is asking for us just to
go ahead and schedule our witnesses as fixtures, and for
Mr. Morris to fit Mr. Soriano in as and when there is a
space .....

MR. MORRIS: I was proposing in that week, January 29th to
February 2nd. That is why I brought it up.

MR. JUSTICE BELL: Who?

MR. MORRIS: Mr. Soriano, when we have confirmed with him.

MR. JUSTICE BELL: When do you think you will know about him?

MR. MORRIS: I just have to confirm with him really that he is
available for -- it would be next year for certain, and
after the New Year. I would suggest to him those times,
and if he can confirm those, I think we will put him in as
a fixture.

MR. RAMPTON: My Lord, again, I am afraid, I cannot readily
agree to Mr. Morris' demands, his assertions of what he is
and is not entitled to do. He behaves as though there was
nobody else on the planet. I have to suppose that we were
going to be dealing with the Bath issue in those two
weeks. I do not believe that it is open to Mr. Morris just
to say: "I am going to fix Mr. Soriano for that second
week" on what we had supposed was going to be Bath
evidence.

MR. MORRIS: If you read the schedule, Mr. Rampton, I am
talking about the week in which you are concerned about
Mr. Cantor and Mr. Bowland maybe not attending.

MR. JUSTICE BELL: What I suggest, Mr. Morris, is get as close
as you can, as quickly as you can ---

MR. RAMPTON: I am sorry, then .....

MR. JUSTICE BELL: -- to a firm decision and proposed dates and
then raise it again. Hopefully, there will not be any
problems.

MR. RAMPTON: Mr. Morris is quite right. I owe him an apology.
I got the wrong week. If he is proposing to replace
Mr. Cantor and Mr. Bowland with Mr. Soriano, then it causes
me no problem at all.

MR. JUSTICE BELL: Yes.
