Day 205 - 17 Jan 96 - Page 56

Lordship indicated, directed or ordered (and I am not sure
which it was) we should serve our Heathrow statements by
5th January which we did do, I think because the Defendants
said they wanted time to read them.

MS. STEEL: Ironically enough, we have had plenty to do over
Christmas and I have been ill.

MR. RAMPTON: What your Lordship, in fact, said was this, on
the 15th December, on page 17: "I give leave to call
Mr. Beech, which I had already indicated I wish to give
leave anyway. I merely indicate (and I will be surprised
if the Defendants objected) that it would only seem right
that you, that is the Plaintiffs, should call a witness
perhaps more in response to Mr. Beech, but it is important
that a statement of any such witness or witnesses be served
fairly soon, should I give direction to be served by Friday
the 8th". I said that is not the date, it is Friday the
5th. Then we said we would serve them by Friday the 5th
and we did. Whether your Lordship -----

MR. JUSTICE BELL: I think leave to call the witnesses whose
statements you served was implicit in that.

  MR. RAMPTON: I hope so.

MR. JUSTICE BELL: Again, I do not think it is a question of
       counting hairs.

  MR. RAMPTON: No.

MR. JUSTICE BELL: It is a question of the weight to be attached
       to however many witnesses ---

  MR. RAMPTON: It is.

MR. JUSTICE BELL: -- on either side. So I have given leave to
the Defendants to call Mr. Beech, and I will give you leave
to call, I think it is, Mr. Hendon, Semir Khazna, is it?

MR. RAMPTON: No, my Lord. Their names are Khazna.

  MR. JUSTICE BELL: Dave Roberts?

  MR. RAMPTON: Roberts.

  MR. JUSTICE BELL: Kim Moffatt?

MR. RAMPTON: Paul Le Maire and Steve Plaister. None of them
will be long witnesses and it is our hope that we deal with
them in a couple of days.

MR. JUSTICE BELL: Yes, I would like you, some time earlier
rather than later next week, to give a batting order for
       those.

MR. RAMPTON: We have got that and we can do it now. It is
being written down. I am sorry, I have not got the
appropriate files with me otherwise I would be slightly
more efficient in answering your Lordship's enquiry. The
