Day 138 - 20 Jun 95 - Page 78

  Q. Is he effective?
       A. Yes, he is. He is managing those stores very well.

  Q. In your time at McDonald's have you come across any other
       such cases?
       A. That is the worse one. There have been some other
situations, maybe a handful, that would approach that
situation. It happens from time to time.

  Q. Do you deal with them as they happen?
       A. Yes, we do.

  Q. What is the Company's feeling about licensees,
owner/operators, that violate the Child Labour laws? Is it
something the Company is comfortable with?
       A. We will not countenance it. That is something that we
just do not want to see happen.

MR. RAMPTON: My Lord, I have reached the end of my
examination-in-chief as it happens, save only for this and
it may not arise. The Mexican video tapes I think have
been transcribed. I have not looked at them and I would
like the opportunity of doing that this evening so as to
decide whether or not some stage, perhaps tomorrow morning,
I would like to show them as part of my case. I regret
that. I do not know whether your Lordship was going to ask
the Defendants o start cross-examining today anyway. If
not, then perhaps nothing much is lost.

MR. JUSTICE BELL: I will talk to Ms. Steel and Mr. Morris about
that in a moment. Would it not be reasonable to wait and
see whether Ms. Steel or Mr. Morris actually challenge
Mr. Stein's account of what was going on in and around the
store on the evening in question? If they challenge
Mr. Stein's account then, provided they have been given an
opportunity to see the film and subject to anything they
want to argue, I suggest that the film could then be shown
at some stage during cross-examination so they can ask any
questions, rather than just leaving it to re-examination
       when the cross-examination has finished.

MR. RAMPTON: I had not thought about it. I will, if I may,
look at them tonight. There are two, one of which is ----

MR. JUSTICE BELL: If there is not a challenge to what Mr. Stein
has said about the three union officer supporters and what
they were doing, there is really not much point in showing
       the film.

MR. RAMPTON: I am also concerned that the Defendants are
entitled to inspection. That does not mean that I am under
any obligation to hand the tapes over. What it means is
that the Defendants have a right to come and see them in
the offices of Barlow Lyde and Gilbert.

That said, what I would like to do is to look at them
myself this evening -- one of them, I believe, is not
relevant but I would like to look at them both -- and then
tomorrow give them to the Defendants. They will have
plenty of time because Mr. Stein will be here for
