3 that he is here to support McDonald's. I do not know
whether you will argue that or not, but he is called as a
4 witness, so I do not identify him necessarily.
5 MR. MORRIS: Do you think the use of colour additives is
justified in McDonald's food?
6 A. It does not cause me a problem.
7 Q. So you think it is justified?
A. Yes.

Q. So your position is different from the EC position on need
9 then?
A. No, the position I take (and I think the position
10 which is also taken by McDonald's) is that if it is
allowed by the legislation, then it will be considered for
11 use.

19 the plaintiffs have a specific expert on additives,
namely, Professor Walker. So all I suggest is you
20 consider to what extent you need to put matters in
relation to additives to Professor Wheelock if your real
21 target is Professor Walker.
22 MS. STEEL: I did not intend to go into great detail, but
seeing this has been entered into evidence, I felt we
23 ought to deal with it.
24 MR. JUSTICE BELL: It will not be held against you if you do
not put something in relation to it when it is being read
25 into Professor Wheelock's statement. A lot of it seems to
me to have been intended as historical background or state
26 of play background rather than expressing a personal view
of his.
