Day 119 - 02 May 95 - Page 33

MR. RAMPTON: Is that a question?

MR. MORRIS: No, that is just an assumption.

MR. RAMPTON: My Lord, that had better be a question rather than
a speech to Mr. Nicholson -----

MR. MORRIS: There is no reason to suppose, is there, that this
could not have been happening quite regularly at this
       store?
       A. I would be surprised if that was not picked up fairly
       quickly by supervisory staff.

  Q. What would happen to the manager who breaks the law five
times on one sheet of paper?
       A. Well, I do not know because I do not know the
circumstances but I would imagine he would be severely
       disciplined.

  Q. Have you visited the Orpington store?
       A. Yes.

  Q. Do you know who the manager at this time was?
       A. No.

MS. STEEL: Can you just clarify, the phrase "close", that does
not necessarily mean when the store closes, does it? That
is when various cleaning up and tidying up jobs have been
       done afterwards?

MR. JUSTICE BELL: Yes, I understand that.

THE WITNESS: Yes, it could be.

MS. STEEL: So it could be later than 11.00?
       A. If it shows "4 to close" it could be any time from
       11 o'clock.

  Q. Onwards?
       A. Onwards, because certain staff would be held back to do
the cleaning unless they have night closes in which case
they all leave at 11.00 o'clock. If they have not got
night closes, then some have to remain to close down the
       store, to clean the equipment.

  Q. But Night Closers are mainly in the larger stores?
       A. Night Closers are mainly in the larger stores. I would
       anticipate -----

MR. JUSTICE BELL: It does not matter in this case because it is
       bound to be after ---
       A. It is after 10.00

  Q. -- 10 o'clock?
       A. Absolutely.

  Q. That is all that matters so far as Miss Thomas is
       concerned?
       A. Yes, indeed.
