Day 118 - 01 May 95 - Page 63

       A. I do not know what it means.

  Q. When illegalities are being discovered to be happening
within stores, as they are, as they are discovered --
obviously this is a case where one example -----
       A. But I do not know what he means by "illegalities".

  Q. Let us just assume that something illegal has happened,
yes, infringement of legalities, OK; is there some kind of
system for monitoring and co-ordinating that information
from around the country to try to identify if there are
illegalities happening on a wide scale or if there are
specific illegalities that are cropping up fairly
       regularly?
       A. If illegalities are occurring and coming to attention,
that would require an incident report form to be filled
out. That would then go to each regional office where it
would be recorded on computer. Then the department
responsible for whatever this illegality is would be asked
to enquire into the circumstances. In that sense, they are
       recorded.

Whether or not anyone is looking at them to see whether a
pattern develops, I would say that depends upon what the
illegality is. If it is employment law, it would be the
Personnel Department or the Human Resource Department. If
it was incidence of crime, it would be the Security
Department. It depends upon what it is -- and I do not
       know what that is.

  Q. The only thing I can immediately think of is that in the
two pages previous upon 1804, that came up under the
heading of Personnel regarding no-shows and lateness?
       A. Well, I cannot think of anything that could be illegal
       about -----

  Q. It is something about personnel management anyway?
       A. Pardon?

  Q. It is something to do with personnel management?

MR. JUSTICE BELL: Let us just suppose it was someone
contravening some rule or regulation with regard to
employment, a young person working too late or too many
hours. You are being asked whether there is any Head
       Office monitoring.
       A. No. I would say -- there is recording but monitoring,
it is left to the department responsible for whatever the
alleged illegality is to monitor it. It is recorded.

MR. MORRIS: What I mean by "monitoring" is not the individual
case being monitored, but the Company as a responsible
       company ---
       A. Yes, that is often done.

  Q. --- is there some kind of monitoring of -----
       A. It would be left to the department who is responsible
       for that aspect.

  Q. You said that was personnel?
