Day 169 - 04 Oct 95 - Page 50

the one hand, we have a Senior Supervisor who has contact
with the restaurant but has responsibility for another and,
on the other hand, you are saying: "Well, we are actually
calling someone who was there for a year". A lot is going
to depend on what I make of Mr. Cranna when he is called.
What I would have thought the headlines which you ought to
put, in however summary form, to Mrs. French are reluctance
to go to rap sessions, no-one wants to make waives, is
really what you are saying about that.

MR. MORRIS: The thing is she says she does not remember any
specific rap session so I do not think there is not much
       point asking her.

MR. JUSTICE BELL: You do not have to take these, but they are
ones which you could touch on, if you want. OK? Let us
put that on one side. You can put on one side also high
pressure work because I have a picture and I will hear your
witnesses on that in due course; the meticulous attention
to the labour percentage, if you want to put something on
that, at the store. You do not, in my view, have to put
attitude to trade unions because I have had a lot of
evidence on that, and I am waiting to hear what your
evidence is and then to see how it falls into place in the
       case as a whole.

MR. MORRIS: Yes. Most of it is very general and regarding
policy rather than any specific incident.

MR. JUSTICE BELL: Yes, very well.

MR. MORRIS: That is what I am trying to ascertain really is
just how much I need to ask questions.

MR. JUSTICE BELL: Is there actually any need in the context of
-- I mean, I may be making a problem where none may exist
       even by going through this.

MR. RAMPTON: I was going to respectfully suggest that was
probably right, my Lord, with this possible exception, the
bit about wage costs because, according to Mr. Cranna, that
is something which was not, as it were, internalised at the
store but came from and was the subject of discussion with
superior people. That, I believe, ought to be put because
if it were so Mrs. French would surely know about it.

MR. JUSTICE BELL: I would have thought that is probably right
because that comes from -- your suggestion is generally in
the case -- above and it is Mrs. French who is the person
overall responsible for that. But you are really being
given the green light by Mr. Rampton and me, on reflection,
that you do not have to put really any of the other
matters. You can call Mr. Cranna and either lead or take
him through his evidence so that I can do my best to get
       the measure of him.

MR. MORRIS: We have already heard a lot of evidence on the
labour targets and things like that, so I do not see
       why -----
