Day 021 - 29 Jul 94 - Page 35

         Q. Right, but people are obviously, at this moment, eating
2 foods which are far too high in fat and saturated fat, are
              they not?
3 A. The reason that an individual has got a diet which
does not confirm to the recommendations is because of the
4 makeup of the individual meals. Again, I do not think
there is any disagreement that if a person has a very high
5 proportion of high fat foods in the diet, then it is going
to be way above the recommendations that we are trying to
6 achieve. But again I would point out to you that it is
important to have a whole range of different types of diet
7 -- sorry, different types of food in the diet. Again, we
have already mentioned the fact that many of the foods
8 that are sold in McDonald's do make a very important
contribution to the various minerals and vitamins in the
9 diet. Again, you have to accept that with animal products
generally do tend to have a relatively high proportion of
10 fat in them anyway. It is inherent in them.

11 MR. JUSTICE BELL: If I may say so, I think we are going over
-- firstly we are going over ground we have been over
12 before and, secondly, I think this is a matter of argument
upon which you and Professor Wheelock may well take very
13 different views. When you put to him the point, bulk of
food helps control appetite, and the question of fat being
14 concentrated, then I understand there was a point there to
put to him and he agreed with it and there we are.
    15
It is matters like that you need to be putting rather than
16 getting embroiled in the argument which is clear to me, do
you see, because that is a question for discussion in due
17 course or for your own witnesses to express a view on. So
it is points like your bulk of food helps control appetite
18 and how that might be relevant to McDonald's food that you
want to be concentrating on. Anything else which is a
19 matter of argument I think you can safely leave until
              later.
    20
         MS. STEEL: OK.
    21
MR. JUSTICE BELL: What I suggest we do is we break off now,
22 think about what I just said, look at your notes and
decide what, if anything, falls into the bulk of food area
23 rather than the argument area. We will start again at
five to two, because it is only stuff which falls into the
24 former category which you can usefully put to Professor
Wheelock. If you look through, in fact, there may not be
25 anything. You may think that you have put all those
points, but that is a matter for you. So have a look
26 through and decide into which category your points fall.

    27 MS. STEEL: OK.

28 MR. JUSTICE BELL: We will resume again at five to two.
