Day 121 - 04 May 95 - Page 32

       you were talking about.

MS. STEEL: You mentioned the incident.

MR. JUSTICE BELL: Unless you have to mention in open court his
name, I would not bother, quite frankly.

MR. RAMPTON: No, my Lord, I did not ask him about it.
Mr. Nicholson, I think, was asked by one of the Defendants
whether there was every a frightful thing happened and he
said there was a man who defecated ------

MR. JUSTICE BELL: It was an example.

THE WITNESS: Yes, it was given as an example.

MR. JUSTICE BELL: I mean, do we have to have a name?

MR. RAMPTON: He certainly never mentioned a name. He says now
he did not know it anyway and I did not know it.

MS. STEEL (To the witness): Did you investigate that case at
       all?
       A. No, it was investigated by a man called Bob Dunn who is
the Area Security Manager for Sutton Coldfield.

  Q. So the Company did investigate it?
       A. Oh, yes.

  Q. It was reported that Mr. Davis said that he had been made
to work shifts, forced to work shifts, of up to 90 hours a
       week?
       A. Was it?

  Q. Do you know whether that was dealt with in the
       investigation?
       A. I do not know.

  Q. You do not know?
       A. No.

  Q. Did you see the report into -----
       A. I saw Bob Dunn's final report.

  Q. Was there any mention about the number of hours that
       Mr. Davis worked?
       A. I cannot remember.

MR. MORRIS: As that is in our pleadings very specifically,
I think we should have a copy of the report as soon as
humanly possible. Can I make that formal application?

MR. RAMPTON: I am sure the application has been made before and
I dare say it has been answered. Mr. Morris should,
I suggest, scurry through Mr. Nicholson's transcripts and
see whether it has not been already dealt with before he
       makes a new application.

THE WITNESS: Yes, there was some -- the matter was raised and
I did answer it in an affidavit, my Lord.
