MR. JUSTICE BELL: Now I would like some indication of time
2 just so that we can see what the schedule is like for the
days ahead. All I want you do now is give an indication
3 you if you can on how much longer you you will be
cross-examining Mr. Preston, I would then like you to -
4 then we might close this afternoon (I do not want to ask
any about that) we might close this afternoon by just
5 looking at the schedule a little, but that is only if it
would be helpful to do so.

MR. MORRIS: As you can see, we are going through the major
7 issues, touching on certain examples of things and I do
not know -- there are 3 or 4, maybe just 2 or 3 main
8 issues to go through, then obviously an overview over the
whole case. So, we should finish Mr. Preston today. Are
9 we talk being 4 o'clock.
10 MR. JUSTICE BELL: It has been pointed out to me that if we at
the end of the day have any discussion about procedure and
11 we go on until half past 4 or even later, because of
amount of documentation in the court and the machines it
12 is getting rather late by the time the court is locked up,
so if there are matters which need to be discussed I would
13 like them you to tell me by 4 o'clock so we can start
talking about them.

MR. MORRIS: I do not think we have any specific matter today-
15 they were dealt with yesterday.
16 MR. JUSTICE BELL: We will resume at 2 o'clock.

MR. MORRIS: We had a talk at lunch time and we do not feel we
19 would be finished by 4.00. We thought it would be better
to tell the court that now. We are not going to go on
20 that much longer, but we thought it would be better to say
that.

MR. JUSTICE BELL: Yes, thank you. Have you finished with
22 employment?
23 MR. MORRIS: Apart from one matter, yes. We thought we would
not really raise the issues about the counterclaim today
24 or tomorrow because we could deal with that later.
25 MR. JUSTICE BELL: No, I understand. I merely bear in mind you
asked or it may have been me asked Mr. Beavers about
26 whether any employees in the States were members of a
union.

MR. MORRIS: Yes.

MR. JUSTICE BELL: Since I have raised it, I may as well ask
29 you, are any members or any employees of McDonald's in
this country members of a union at all?
30 A. They may very well be. I do not know. It is their
right to join one if they so choose.
