Day 246 - 09 May 96 - Page 63
Q. But would they be... If the nearby restaurant was operated
by the Company then the satellite would be operated by the
Company, and if the nearby traditional restaurant was
operated by a franchisee would the satellite be operated by
the franchisee or does that not follow?
A. Historically, when there was a choice to be made
between it being operated by the Company or a franchisee,
and it could have gone either way, we gave it to the
franchisee. It always erred on that side, always went to
the licensee. There may, in fact, have been a
company-owned restaurant nearby although I have to say the
circumstances do not present themselves too often, 85 per
cent of restaurants in the States being franchised, it is
pretty much a non-event, they tend to go to the licensee
who is closest and most qualified.

MR. MORRIS: I mean...

MR. JUSTICE BELL: Yes?

MR. MORRIS: When we would like to finish? As you can see, the
way it is progressing we are trying to go through the
issues and deal with material that has either come up since
it came up as an issue in the case or has not been put to a
McDonald's witness before, or because Mr. Preston is a
particularly apposite person to deal with it, and we are
certainly going to go through at least the bulk of
tomorrow. It is not clear whether we will go over to
Monday or not, but it certainly would be prudent to leave
Monday, if you like, booked on the schedule.

MR. JUSTICE BELL: What can you do this afternoon then? Why
I ask now was that if you were absolutely confident of
finishing tomorrow I would rise early because it would not
make any difference to the schedule at the end of the day.
But if another half hour this afternoon might make the
difference between Mr. Preston's evidence going into Monday
or not I think we ought to sit on a bit.

MR. MORRIS: It might be better to carry on than just to -----

MR. JUSTICE BELL: Yes. Do you want me to rise until ten to
four and we will go on for ----

MR. MORRIS: Yes, it might be helpful.

MR. JUSTICE BELL: We will rise until ten to four and I would
like you to keep going until quarter past or 20 past. If
you get stuck, tell me, because I do not want to sit here
while you are stuck.

MR. MORRIS: Right.

(Short adjournment)

MR. MORRIS: Just a couple of loose packaging questions.
I cannot find in which of the supplemental bundles this is,
but you recognise this leaflet: "Environment Phasing, the
Challenge"?
A. I am sorry?
