Day 246 - 09 May 96 - Page 13

then when he has given his evidence on it, if you think
there are particular loose ends which he has not been able
to answer, you write to Barlow Lyde & Gilbert, and it will
be a quite a short letter, asking them if they are prepared
to divulge the further information which you want.

I suggest you take that course because, for all I know, you
may refer in a few moments' time or in an hour's time to
something which makes Mr. Preston remember something which
he cannot recall now. So I think you should complete your
cross-examination of Mr. Preston in relation to it first.

  MS. STEEL: OK.

MR. JUSTICE BELL: If you think at the end of the day Mr.
Preston says he cannot help you about matters you are
asking, and if you have reason to believe that there will
not be any further McDonald's witness who can help, then
you are put to asking for information voluntarily by
       correspondence.

MS. STEEL: Yes. If I can give warning, I cannot remember
where it is in here, but there is another point I was going
to specifically apply for to be unblanked out because of
the fact that it destroys the sense of the document.

MR. JUSTICE BELL: That is another consideration. Take that up
       when you come to it.

MS. STEEL: OK. Mr. Preston, did you receive a copy of this
fax from Scope Communications Management dated 31st
       January, 1994?
       A. I do not think so, but I do not remember.

  Q. I will ask you even though you will say you do not know.
The writing at the bottom of that page appears to be Edi
Bensilum's again. Would you agree with that?
       A. Well, it is similar to the writing on the first page,
but whether it is Edi's, I am sorry, I just do not
recognise her signature or her hand script. I am not that
familiar with my numbers of employees and what they their
       handwriting looks like.

  Q. OK. Can I just ask about this document: if you go onto
the second page which is completely blanked?

MR. JUSTICE BELL: Can you give the page numbers at the bottom?

MS. STEEL: It is page 4, which is completely blanked out apart
from two lines, the first one saying, "Other items to be
considered", the second line saying, "No 1, briefing sheets
for customers in restaurants", and "briefing sheets" has
been crossed out for some reason, but do you know, these
briefing sheets, were they an afterthought or were they
something that was planned all along ever since you decided
to take this, talk publicly about ----
       A. I do not know what was in this as to whether it was a
first thought or an afterthought. It was under items to be
considered. If this is the correct order of papers, it
seems like it is coming at the end. It did not seem to be
