Day 142 - 26 Jun 95 - Page 45
were disputes with other employers. It was in the realm of
Labour Relations and matters that came up from time to
time, and then we initiated a way to try to solve, what we
thought would be a good way of solving, some of those
issues rather than having issues keep cropping up and the
association in moving forward is what we suggested.

MR. MORRIS: Can I just clarify, this statement by Dr. Bosche
which was written to Eva Sachse -- I am just asking the
judge this -- I have presumed that is covered by the Civil
Evidence Act Notice?

MR. JUSTICE BELL: I assume it was put in as a Civil Evidence
Act statement in its own right.

MR. MORRIS: Yes. That has not been challenged by the
Plaintiffs, so I presume that is the case.
(To the witness): Mr. Stein, actually can we just go to
some documents? I will ask you first: The Plaintiffs
disclosed some documents relating to an allegation about
the employment in Germany of Czechoslovakian workers who
were put up in a camp and there was some controversy over
this. To be honest, the documents are in German. I cannot
remember if it was 85 or 86 or not, it may have been
actually. The documents are 1990 -- do you know anything
about that?

MR. JUSTICE BELL: Just forget the documents for the moment and
put what you want to have evidence on in relation to this.

MR. MORRIS: Yes. Again I cannot find the pleading, but do you
know anything about the employment of Czechoslovakian
workers with a special camp site set up for McDonald's
employees?
A. No, I do not. I have no knowledge.

Q. Mr. Mocha never mentioned it to you?
A. No, I have no knowledge of anything like that.

Q. We will leave that then. While we are on this subject,
Germany, do you know anything about the Gunter Waulroff
book that he wrote after working at McDonald's and the
legal action that was taken?
A. No, I do not. I know that there is an author by that
name. I know that he wrote a book about McDonald's, but my
understanding is it is in German and I do not read German,
so I do not know what the book is about.

Q. But you know there was some dispute and the legal action
was taken, do you?
A. No, I do not. I know that people in McDonald's in
Germany were not pleased with the book, but I do not know
about legal action or anything beyond that.

Q. OK. In Germany do you know if overtime is paid?
A. I am sorry, I cannot help you with that. My
understanding is that the collective agreement that has
been in existence now for some years covers all of that,
and there are no disputes over whatever is in there is in
there.
