Day 038 - 19 Oct 94 - Page 51
MR. MORRIS: As far as I can understand the situation, it is
that, for example, Professor Walker says: "Allergic
reactions are known to be associated with or occur through
Sunset Yellow." The question then comes: Just how many
people are affected by allergies for Sunset Yellow? We do
not have to prove, and it will save time if we did not have
to prove -----

MR. RAMPTON: My Lord, that is what I was trying to say. I am
trying to be helpful. I am not trying to make life
difficult for Mr. Morris at all. I have some slight sense
that he is floundering a bit, and I do not make any
criticism about it. One possible route, and it might be
considered in a five-minute break, is for the Defendants to
show Dr. Millstone the transcript of what Professor Walker
said about each of these subjects and ask him how far if at
all, and if so in what respects, he disagrees with what
Professor Walker has said.

MR. JUSTICE BELL: What I will do is I will break off for 10
minutes and if you need more time, Mr. Styles will come out
at about 20 past 3, you can tell me and he will tell me.
I think, first of all, if you would be so kind,
Dr. Millstone, do you think you will get a useful answer to
the enquires you set in motion at lunch time if you rang
again now?
A. It is quite likely.

Q. I would like you to do that first, because it is becoming
clear to me that it would be very helpful if you could be
available for the rest of this week. Hopefully, it will
not be necessary to detain you that long, but if you can be
available, that is, tomorrow and Friday if required. Do
you understand?
A. Yes. When I called at lunch-time I asked to swap the
arrangements from Friday to Thursday.

Q. See if you can swap it, if you can pursue that and swap it
for tomorrow, and then I might ask you to see if you can
make some arrangement for Friday as well in case that is
needed. I think it would be helpful if you could find that
part of the transcript. I think it followed in sequence,
did it not, through each of the -----

MR. RAMPTON: My Lord, it did. It would be helpful, I believe
-- I dare say Dr. Millstone is a fast reader.

MR. JUSTICE BELL: My recollection is that Professor Walker went
through the abstract which was put in front of him.

MR. RAMPTON: Yes.

MR. JUSTICE BELL: So he went from one to the next.

MR. RAMPTON: Yes.

MR. JUSTICE BELL: The other thing which would be helpful is if
you spoke to Professor Millstone, unless Mr. Rampton wants
to voice some objection to it, to ask him in relation to
each of these additives whether he is likely to be able to
