Day 079 - 27 Jan 95 - Page 55
just cleared that point. It is a standard, and it is
unsatisfactory and next time make sure it is better. But
it is not dangerous. It is just unsatisfactory.

Q. Well, if it is not dangerous why is it unsatisfactory?
A. Because McDonald's want the best standard available.

Q. But they are prepared to take meat that is below the best
standard?
A. I am trying very hard -----

MR. JUSTICE BELL: I think you should take that up with someone
from McDonald's. That is a comment to make in due course.
Mr. Walker has given his understanding of it. I know he
has got ketchup in his veins, but he is still McKey when it
comes down to it. He has a particularly big customer in
the form of McDonald's and that is what they set out.

MS. STEEL: Are McDonald's aware that you are supplying beef to
them that sometimes is of what they would consider to be an
unsatisfactory standard?
A. McDonald's are aware of the bacteriological
specifications in our specification because they emanated
from McDonald's.

Q. Yes, and are they aware that they are supplied with beef
that is what they would classify as "unsatisfactory" from
time to time?
A. They would be aware that occasionally there would be
samples of beef which had a bacteriological gramme count
which was not grade 1. Think of it that you can pass any
test ----

Q. But it is grade 3?
A. --- you can pass any test or any exam and you can have
grade 1, grade 2, grade 3, but you can still pass the exam.

Q. But this is grade 3?
A. Grade 3, but it still passes the exam. It has taken me
a long time to think that one out to explain it to you.

MR. JUSTICE BELL: I wonder if we have gone as far as we can.
The one thing which might might be unsatisfactory on your
account of things is to call it "unsatisfactory"?
A. Yes, my Lord.

Q. Because that might an outsider to believe that it is not up
to snuff.
A. Quite, my Lord.

MS. STEEL: The next grade below grade 3, the failure, is when
it actually smells and looks off?
A. Yes.

MR. JUSTICE BELL: Do you have a bacteriological grade below 3?
You spoke of so many.
A. 50 million.

Q. Tell me very shortly about 50 million.
A. Once the meat has gone off condition and it is sticky,
