Day 241 - 26 Apr 96 - Page 24
copies of at a convenient moment today. I am not inviting
your Lordship to make any ruling about that today. I was
going to do it on Monday because as far as I can see Dr.
Carriere is going to be yet another fairly short and
perhaps fairly short witness on Monday morning. There will
be lots of time on Monday to clear up matters like that
(Same handed).

MR. JUSTICE BELL: Look, do your best to look at -----

MS. STEEL: I was going to say there are other matters we can
deal with now.

MR. JUSTICE BELL: Well, we will come back to the voluntary
particulars on Monday because it is thought that
Mr. Carriere will not take very long. Do your best to be
prepared to have formed a view on this new witness and if
you do wish to object to him, to give me the grounds for
that. What other matters, apart from reading, are there
today?

MS. STEEL: One thing is extremely brief. It is just about
this statement served from somebody at Dewey Ballantyne

whether this is evidence from C.E.A. or what.

MR. RAMPTON: I am sorry. Yes, I think I did indicate at the
time. If I did not I do apologise. I had intended to put
a Civil Evidence Act notice on that. I think I have done
it, but again I need your Lordship's leave for that because
it is well out of time. He gives evidence as only he can.
None of the witnesses of fact can about what the state of
American law is.

MR. JUSTICE BELL: You did say at the time you proposed to call
him as a Civil Evidence Act witness. What I cannot
remember is what, if anything, you said about that actual
notice.

MR. RAMPTON: Notice?

MR. JUSTICE BELL: Having been given formal Civil Evidence -----

MR. RAMPTON: I do not know whether an actual document has been
served since, but if not -----

MS. STEEL: I am not going to be particular about that. I can
not remember what the situation was with it. That is the
only matter.

MR. RAMPTON: That is all right.

MS. STEEL: One thing I wanted to clarify is that, it is my
belief that this firm of solicitors is a company which is
employed by McDonald's in the USA, rather than kind of an
independent legal advice, and just what the situation is
with that whether that ought to be noted. The other thing
is that in the -----
