Day 122 - 05 May 95 - Page 38
Q. There is nothing in there about the dangers of exploiting
or abusing vulnerable people? It is only ---

MR. RAMPTON: My Lord, I am sorry, I think ---

MR. MORRIS: -- the dangers of infringing regulations.

MR. RAMPTON: -- Mr. Morris had better have some foundation for
words like that, "abusing".

MR. MORRIS: That is a matter of comment that is obviously a
theme running through our whole questioning. But the
reality is -----

MR. JUSTICE BELL: But, you see, why not ask, just ---

MR. MORRIS: The reality.

MR. JUSTICE BELL: -- put to him -- you see, every time you use
a word like "exploit", and Ms. Steel used the adjective
"blatant" earlier today, the witness who does not agree
that it is blatant or exploitation has his eye -- perfectly
understandable -- taken off the ball of the main thrust of
the question.

Might I suggest you ask, since Mr. Nicholson did not think
that McDonald's kitchens or, indeed, kitchens at all,
working kitchens, are a good place for children under
school age, that is anyone under 16, why he did not ---

MR. MORRIS: Say so in that memo.

MR. JUSTICE BELL: -- say so in that memo or somewhere else?

THE WITNESS: I cannot -- I cannot give franchisees orders;
I can only give them advice.

MR. MORRIS (To the witness): You did not give them that advice
in your memo?
A. I think I did. I think the whole purpose of the memo
is to encourage them not to do it, but if they want to do
it, they should be very, very careful and make sure that
they conform to their local government regulations. My
last paragraph on page 2 of that memo, I think, speaks
volumes to that effect.

MR. MORRIS: It says: "They should comply to the letter of the
laws", yes?
A. And my last paragraph makes that quite clear.

Q. Yes, that they should obey the law?
A. Yes, and I certainly did not know -----

Q. Apart from the law, in your memo regarding the employment
of children under school leaving age, there is not a single
word, is there, regarding any other policy or advice ---
A. No, I am spelling out the licensees, what the
regulations are.

Q. -- to comply with the law -- pardon?
