Day 005 - 04 Jul 94 - Page 83

1 in all court all day.

2 MR. RAMPTON: It is ten days; it is a week and a bit.

     3 MR. JUSTICE BELL: 15th.

4 MR. RAMPTON: From today, yes.

5 MR. JUSTICE BELL: Yes. I am looking at the overall time from
the time it was served. That is two and a half weeks.
     6
MR. RAMPTON: That certainly is not unreasonable in the context
7 of a case like this, as your Lordship says, with
              Mr. Atkinson in court.
     8
MR. MORRIS: As that raises a point about documents------
     9
MR. JUSTICE BELL: Shall I say further and better particulars
10 to be served by Friday, 15th July?

11 MR. MORRIS: We are assuming that documents to be served on the
plaintiffs of any kind are going to be put into the trial
12 bundles. They did say that the counterclaim documents
would automatically go into the trial bundles. Am I wrong
13 in assuming that, that if we are serving documents, they
were served now, whenever, eight days ago, seven days ago,
14 because it would be useful to keep updating the trial
bundle as any new documents come to light, or the
15 pleadings bundle. I mean, the counterclaim document
should be in the pleading bundles.
    16
MR. JUSTICE BELL: I have made a separate counterclaim
    17 bundle ---

    18 MR. MORRIS: Yes.

19 MR. JUSTICE BELL: -- of my own.

20 MR. MORRIS: But you have not the request yet?

    21 MR. JUSTICE BELL: No.

22 MISS STEEL: There is a spare copy here actually if you want
              one. (Handed).
    23
MR. JUSTICE BELL: Thank you very much.
    24
MR. MORRIS: Can you we just work out a management way of
25 dealing with this? Can we just assume, the Plaintiffs
agree, that any documents that are served on the them will
26 be in some way made available to yourself as well?

27 MR. JUSTICE BELL: Have you a list of the documents you have in
              mind?
    28
MR. MORRIS: That is, obviously, one of them and we have some
29 other documents which we are hoping to serve when we have
had time to do a list. We have identified the documents,
30 some of which were those recycling Tidy Britain Group, for
              example.
