Day 021 - 29 Jul 94 - Page 73

     1 things.

2 MS. STEEL: When the timetable is drawn up, can we have some,
sort of, slippage days and reading days incorporated in it
3 so we do not get the same problems?

4 MR. JUSTICE BELL: What I think you ought to try and do is in
your preparation concentrate on nutrition, on the rest of
5 recycling and waste, including such witnesses as you wish
to call on that, and on anything further you want to ask
6 Mr. Beavers and Mr. Preston. When we have got through
that, because we have embarked on that, it seems to me you
7 ought to be able to finish your preparation for that en
bloc, then before we go on to advertising, there ought to
8 be a break then, because you will have had a fairly big
bite finishing nutrition, finishing recycling and waste
9 and finishing Mr. Beavers and Mr. Preston, then a break
              before advertising.
    10
MS. STEEL: Right. OK. I mean, I think generally it is
11 helpful to have, even if it is just like a day or so here
and there, because then if witnesses take longer than
12 expected, we do not all have to panic about not being able
to finish them before the next one is called; that is all.
    13
MR. JUSTICE BELL: Mr. Rampton, on experience so far, whatever
14 the timetable is for Dr. Arnott, Professor Keen and
Professor Walker and your nutritional witnesses of fact,
15 I think it would be well advised to leave two blanks days
before we start on the defendants' nutritional witnesses.
    16
         MR. RAMPTON: My Lord, yes.
    17
MR. JUSTICE BELL: If we do not need the time because of
18 slippage, but the defendants say they would like to take
the two days anyway to get organised for their own
19 witnesses, I will certainly be amenable to a request such
              as that.
    20
MR. RAMPTON: I do not see any realistic possibility of
21 finishing the nutritional issue before Friday, 23rd
September, as I am presently advised.
    22
MR. JUSTICE BELL: So, what I would like is you to prepare a
23 timetable for Dr. Arnott, Professor Keen, Professor
Walker, witnesses of fact on the issue of nutrition and a
24 two days gap. I would like the defendants to then have a
plan for their defence witnesses on nutrition. Then we
25 should be able to go on to recycling, Mr. Beavers and Mr.
Preston, in whatever order, subject to their availability,
26 particularly Mr. Beavers' availability, and then a further
gap before we go on to advertising.
    27
MR. MORRIS: If we could have the schedule as early as
28 possible, then we will be -----

29 MR. JUSTICE BELL: When do you think you will be able to have
              it ready, Mr. Rampton?
    30
MR. RAMPTON: I do not know, My Lord. I would hope some time
