Day 037 - 14 Oct 94 - Page 37

  MR. MORRIS: Over half.

MR. JUSTICE BELL: It is about 55 per cent, is it not?

  MS. STEEL: Yes.

MR. MORRIS: Of which over half of that is from saturated fat?
       A. I would say that is pretty impressive for a salad.

  Q. There is room for improvement in your opinion?
       A. To put it mildly.

  Q. You mention they could provide vegetarian burgers?
       A. Yes.

  Q. One thing, maybe a point that might be raised, that has
been done in other stores; you have never analysed them
from other stores, from other companies?
       A. No, I have not.

  Q. It is a fact that some vegetarian food you have
       criticised?
       A. Absolutely, yes. If I come across vegetarian food
that is very high in fat, I would certainly criticise
that. Vegetarian diet almost always does tend to be
healthier, but I would never claim it is uniquely and
universally healthy. It is possible to follow a vegan
diet, for example, and eat bread and jam all the time.
That would hardly classify as a healthy diet.

  Q. So, if they brought in a vegetarian burger you would like
       to see a healthy ---
       A. I would love to.

  Q. -- vegetarian diet?
       A. Yes, I would love to.

  Q. If we move over the page, I think we have covered a lot of
ground already there. You said halfway down that page:
       "In these health conscious times"?
       A. Sorry, can you be more specific?

  Q. The large paragraph in the middle of the page.
       A. Yes. How does it begin?

  Q. "The Plaintiffs"?
       A. Yes.

  Q. I will not read the whole paragraph -- I might as well:
"The plaintiffs are in the business of selling
hamburgers. Had they left it at that, they could not be
reasonably be criticised for 'deliberately misleading the
public as to the nutritional value of the food they
sell'. However, the plaintiffs have deliberately sought
to pass their products off as 'a very valuable part of a
healthy diet'. In these health-conscious times, this is
no doubt an extremely effective marketing device. But
that is all it is. It is not the truth."

Just to briefly elaborate, how is passing off their
