Day 238 - 22 Apr 96 - Page 16
MR. JUSTICE BELL: Fair enough. In fact, I think it is pretty
obvious that it is. Do not take that as a rejection in any
way.
A. Right.

Q. But it just cannot help me on the matters I have to decide.

MR. MORRIS: Right. Continuing to read: "Jaguapire Indigenous
Area".

MR. JUSTICE BELL: I have got that. That is 141?
A. That is 141, yes.

MR. MORRIS: "This Guarani area has been the subject of many
court actions between two ranchers and the Indians. The
ranchers have deforested the area for cattle pasture and
constantly intimidated and threatened the Indians forcing
them to leave the area on a number of occasions (Nucleus
for Indigenous Rights, NDI 1994)." Sorry, it is 1994.

"Juagary Indigenous Area" ---

MR. JUSTICE BELL: Is that 450?
A. Yes.

MR. MORRIS: " -- was identified by the government's Indian
Foundation FUNAI in 1987. Fifteen days later the 30
Guarani families were expelled by the rancher Jose Moraes.
When the Indians attempted to reoccupy their land the
rancher and a group of colleagues threatened them and
expelled them again. (Aconteceu 11/91).

"In 1992 four ranchers obtained a court order to expel 150
Guarani Indians from the Guassuti indigenous area (Folha de
Sao Paulo)." Where is that one?
A. That is 390.

Q. "In 1992 four ranchers obtained a court order" -- sorry, we
have just dealt with that one.

"Sete Cerros Indigenous Area". Where would that be?

MR. JUSTICE BELL: 449, is it?
A. 449, yes.

MR. MORRIS: "This Guarani area was the first to be contested
under the new decree 1775, by a cattle ranching company
Sattin SA (pg 12, Report to the Commission of Human Rights
of the American Anthropological Association by Prof.
Terence Turner). Although 9,000 hectares have been
demarcated it is permanently patrolled by gunmen employed
by the ranching company so that 230 Indians are reduced to
living off five hectares of land (CIMI 1993).

"The Guato have suffered the incursions and appropriations
of their land by various cattle ranchers." Is that a
particular area?
A. That is 118, right up in the northwest on the map.

MR. JUSTICE BELL: Let me find that. Yes, I see.
