Day 118 - 01 May 95 - Page 20
Q. -- hourly wage is £8 an hour ----
A. No it is not. You are quite wrong.

Q. -- when you get overtime, are you paid an extra one pound or
something on top, that being the minimum wage, or are you
paid extra 50 per cent? When you are paid time and half
are you paid 50 per cent on top of your hourly rate?
A. No.

MR. JUSTICE BELL: You may be or you not be, you are putting
what the legal obligation was. You may be right, but
I must say I would be surprised that if someone for
instance paid a very generous basic hourly rate I would
have thought, maybe I am wrong, that provided that for
overtime they paid a rate which amounted to one and a half
times the minimum hourly rate they were all right. Let us
suppose the minimum hourly rate was £4 and you were paying
£10, I would have thought that provided for instance they
kept paying £10, which is still considerably more than £6,
they were OK, which is a different point to the one
Ms. Steel was asking about, but maybe that is wrong. It
just says "the hourly rate".

MR. MORRIS: My understanding is certainly -- am I right or am
I wrong -- that the law says that overtime is paid based
upon your hourly rate?
A. No.

Q. Time and a half?
A. You are wrong. Overtime is paid on the minimum rate
payable.

Q. Well, we will see. Not everybody gets wage rises after
three weeks, do they?
A. I suppose there are some people who do not.

Q. That is right.
A. But there will not be many.

Q. Well, what percentage?
A. I have no idea.

Q. What percentage of staff get a nought pence pay rise when
they have had their review?
A. I cannot answer that question. There are 31,000 crew
people out there. I do not know their rates of pay are.

Q. You must get information coming to Personnel headquarters
about what percentage of staff are passing ----
A. No, no we do not.

Q. You do not get that information?
A. No, the Human Resource officers would check that when
they go to the store but we do not get it sent to Head
Office.

Q. These Human Resources officers when they get the
information they do not pass it on to Head Office?
A. They might do if they are concerned about it, but they
would probably deal with it on the spot. If they found
