Day 119 - 02 May 95 - Page 31
A. No.

Q. The next question is, how does it go undetected or
immediately undetected?
A. It should not.

Q. It should not do?
A. No, because -----

Q. But is the reality this, that the Supervisor cannot check
all the hour working records of all the staff on the store,
can he or she?
A. My Lord, when I first took over Personnel, I made
Southern Ireland my responsibility. That was a market then
of 10 restaurants. When I did my audit I went through
every clock card in that restaurant to make sure that the
Irish law (which was very similar to ours) was being met by
the store managers. It is a long, arduous task but it is
one that I have found wages inspectors are most rigorous at
checking. They inevitably lead to criminal prosecutions if
we are in breach of the regulations.

Q. So if a Supervisor or Field Personnel Officer took the
view: "Well, if I make random spot checks and they know
I am making random spot checks that ought to be good
enough", you would not -----
A. That ought to be good enough. If I found that that was
not working, then I would have words with both the Field
Personnel ------

Q. That is after it has been brought to his attention and
perhaps after there has been a prosecution?
A. Oh, indeed, but there has never been another
prosecution.

MR. MORRIS: So if we can turn to the Defendants' bundle IV,
please, it is the kingfisher blue, as has been said?
A. Yes.

Q. Bundle IV, tab 17, just so we all know which we are talking
about.
A. Yes.

Q. It is in tab 17. Sorry, they are not numbered but it is
somewhere about 12 from the back. It is a time record. It
is actually in the middle of some -----
A. Is it before or after the pay slips?

MR. RAMPTON: My Lord, it is much easier to find if one looks in
the pink bundles. One does wish that some preparation be
done. It is tab 42 of volume pink XII.

MR. JUSTICE BELL: Why do you not use that?

MR. MORRIS: I have it in front of me anyway.

MR. RAMPTON: I am sure, but it would help if we have a
reference.

MR. MORRIS: I do wish Mr. Rampton would not keep saying about
