Day 035 - 12 Oct 94 - Page 37
separate bundles served apart from the ones -- there was
the ones that were actually called enclosures to his
statement and then there were some further papers. Then
there was another set that was served another day. You
may have got them the day he gave evidence.

MR. JUSTICE BELL: I am sure I have put them somewhere.

MR. JUSTICE BELL: I will work on the copy I have just been
handed. I do not want to slow things up any longer.

MR. RAMPTON: There is only one other which I shall refer to in
the course of cross-examining Dr. Barnard. That is an
article by Dr. Clement Ip in 1993.

MR. JUSTICE BELL: Someone had better bear in mind that I am
not going to be reading them in the future if I do not
know where they are.

MR. RAMPTON: I know. What we will try to do, with the
co-operation of the Defendants, is to ensure that a
complete set of Dr. Crawford's references insofar as they
exist (because we do not have some of them ourselves) is
put into your Lordship's file behind his supplementary
statement.

MR. JUSTICE BELL: Yes. If someone at the end of this
afternoon can tell me when I was handed it, I will look at
the transcript and that may tell me where it went.

MR. RAMPTON (To the witness): Dr. Barnard, do you have a copy
this article or not?
A. No, I do not.

Q. Perhaps that is the most important thing.

MR. MORRIS: Shall I hand one to you?

MR. RAMPTON: Yes, please. (Handed). Have you read this
article before, Dr. Barnard?
A. Well, I have read many of Dr. Willett's articles.
I presume I have read this one before, but I do not recall
looking at it recently.

Q. Unlike many of Dr. Willett's publications, this is not a
report on the results of research done by him and his
team; this is a single authorship article which, from its
title "Review Article", can I assume means that what he is
doing is reviewing the evidence to date from wherever it
may be found?
A. He is giving his opinion on that body of evidence,
yes.

Q. He is giving his opinion on it. Before I refer you to it
-- I am afraid I am going to refer you to rather a lot of
it -- you said, I think, before the break that Dr. Willett
was in some sense or other controversial?
A. Yes, I do, yes.

Q. What did you mean about it?
