     1        A.  They were American -- I thought they were American
     2        tourists because -- I do not know whether you -- they were
     3        dressed like they were on the golf course.  He was wearing
     4        checked trousers and a sort of pullover.  It was just a
     5        very peculiar American way that you see around London.

     7   Q.   So, you did not kind of hear them talking about their
     8        holiday, or anything like that?
     9        A.  No.

    11   Q.   You were not aware of whether or not they could have been
    12        journalists or members of the legal profession in America,
    13        or just people who were English who happened to like
    14        dressing like they were going on a golf course?
    15        A.  I said it was my impression that they -- they looked
    16        like tourists to me, and they looked like American
    17        tourists.

    19   Q.   You go solely on their dress for the basis of that; it was
    20        not anything they said?
    21        A.  They did not appear to be in here in a professional,
    22        for a professional reason.  They were not making notes.
    23        They were not even taking that much notice of what was
    24        going on, to be honest.

    26   Q.   You said that they did not look at the leaflet while you
    27        were watching them?
    28        A.  I do not think so, no.

    30   Q.   How long were you watching them for, or was this just
    31        something you noticed?
    32        A.  Well, I noticed the leaflet.  They left a long time
    33        before me.

    35   Q.   Did you notice whether or not they had this with them when
    36        they left?
    37        A.  Yes, they did.

    39   Q.   Basically, you say you know it was the fact sheet because
    40        of the front cover?
    41        A.  Yes, I think that is right.

    45   MR. JUSTICE BELL:  Do you want to put whether there was a pile
    46        there, if there is any challenge?  If you do not know, you
    47        cannot put it.  But if there is any challenge to there
    48        being a pile of copies of the leaflet complained of in
    49        court behind you, available for people to take, then you
    50        should put it to Mr. Howes.

    52   MS. STEEL:   The witness did not see any being taken, so.....

    54   MR. JUSTICE BELL:  But the inference which I might draw is that
    55        if there was a pile of leaflets, as he described them,
    56        there and then someone who has the appearance of being a
    57        tourist who has come into court leaves with one in his or
    58        her hand, it might be an inference I would draw that they
    59        had picked it up on off the readily available pile.  If you
