              abolished, the company policy of a maximum number of 39
     2        hours still applies to all employees", is that correct?
              A.  That is what it says, yes.

         Q.   This was a memo from the very top yes to all executive
     4        vice president?
              A.  It was from Sid Nicholson who was Carmel's boss, I
     5        believe, back in that time frame to the officers of the
              company department heads, market managers, operation
     6        staff, right down to restaurant managers, copying myself
              and the human resources field people, yes.

         Q.   If someone breaks that policy, is that policy monitored?
     8        A.  The 39 hours a week?
 
     9   Q.   Yes?
              A.  I believe it is, yes, via the payroll system.

    11        Q.   If we go to document No. 42, the one before that one,
              then we have a chart here, what is the name of this
    12        document?  Is it a time record or clock card?
              A.  It says time record at the top.  It is not something I
    13        have dealt with in many, many years or ever in this form,
              but OK.

         Q.   This was for a time, 1987 -- this is during the
    15        circulation of the alleged, circulation of the fact sheet
              and I cannot remember whether this has been admitted or
    16        not -- as it says at the top, "Name. Under 18s" so these
              are under 18 year olds on the time record, as far as we
    17        know, yes?
              A.  Yes, it is.  I do not know whether it is a restaurant
    18        or a training document or what it is.  It is -- I do not
              see a name designating it to a store.  I know that under
    19        18s at a moment in time had to be shown separately on
              payroll records.  They had to be highlighted.  I would
    20        guess this is either an example of how to do it, or it is
              an example of what someone duly did in a store, but I
    21        cannot tell from this what it is.
 
    22   Q.   I cannot remember the name of the store.  It is disclosed
              by one of our witnesses.

         MR. JUSTICE BELL:  What do you want to put to Mr. Preston about

    25   MR. MORRIS:  We have alleged it shows various breaches,
              breaches of the employment regulations, for example.  I
