Day 245 - 07 May 96 - Page 65
aims and objectives documents and I look through further
publication of material, the objective was to smash
McDonald's at any cost, irrespective of the facts. You
have proceeded to try and do just that and, based on what I
have seen in your subsequent press releases, I believe
regardless of the verdict in this case, assuming for the
moment McDonald's wins and you do not, you will continue to
publish the documents if I believe what the press releases
say.

Q. Can you just name one sentence in that fact sheet which
I knew to be untrue?
A. I believe you knew the whole thing.

Q. Of which you have evidence that I knew it was untrue in,
say, 1990 or indeed 1994?

MR. JUSTICE BELL: I do not think that is a valid question
because I just have to sort it out on the evidence. For
instance ----

MR. MORRIS: If he cannot do it, then he should not be writing
press statements.

MR. JUSTICE BELL: No. It is a matter of argument for me in due
course. It is an argument which may or may not be accepted
that you say something for which you have no supporting
material then the inference can be drawn that you know it
is untrue. Whether the inference can be drawn or not, is a
matter of judgment.

MR. MORRIS: Do you have any evidence that I knew anything in
this fact sheet was untrue?
A. I ----

Q. Positive evidence?
A. I believe you knew that which was in this fact sheet
was false and you went ahead and published it anyhow.

Q. Do you have any evidence?

MR. JUSTICE BELL: You need not answer that question.

MR. MORRIS: He does not have any evidence. If he can supply
evidence like a letter I wrote to somebody, saying that --
I know that is not true but I am carrying on.

MR. JUSTICE BELL: No one has suggested that. You know what
documents have been produced and no one has suggested that.
You know that perfectly well.

MR. MORRIS: There is no a document, is there? Have you read my
statement that I made to the court about this case?
A. I have read so many statements I cannot sort them out
in my own mind. I am sure I have. If you want me to quote
it verbatim, I am sorry, I cannot.

Q. Were you aware that I said why I believed all the
criticisms made in London Greenpeace fact sheet were true?
A. I am sorry, would you say that one more time please?
