1 As regards the heart disease issue, I think that is
2 something we will have to get advice on really. We did not
3 have our meeting yesterday, that was our legal advice
4 meeting, because it fell through.

6 MR. JUSTICE BELL: I would like you to tell me what your
7 position is when you come back at the beginning of next
8 term as to just who has to be recalled. I have stressed,
9 though it is probably obvious to you, that it is
10 particularly important to get organised about that because
11 the nearer one gets to the end of the evidence, the less
12 room one has to manoeuvre. The time has to come,
13 obviously, when I say that is the end of the evidence.
14 There will not be any question, however important the
15 evidence may seem, of thereafter saying: "We would like to
16 call this witness". The same applies to the Plaintiffs.

18 Even though I made be in court listening to submissions or
19 you may be away preparing to make submissions, once I say:
20 "That is end of the evidence", I mean it because it is
21 obvious to everyone, in a case like this, potential
22 evidence may be appearing day by day and month by month on
23 environmental topics.

25 I will ask Mr. Rampton to continue with regard to
26 scheduling. Mr. Rampton, all one can say is you will have
27 it make some allowance for a significant amount of
28 nutritional evidence.

30 MR. RAMPTON: My Lord, I accept that. When I say scheduling for
31 next term, I am certainly not in a position to give an
32 indication at the moment of any certainties apart from
33 Mr. Cesca on 22nd February, the Colchester witnesses at the
34 beginning of term and I would suggest -- I do not know what
35 your Lordship thinks -- that they should be given at least
36 five days until your Lordship has to go to do something
37 else on 18th January, because it is not just our witnesses,
38 it is Mr. Logan as well and so that is -- not Mr. Logan,
39 I am sorry -----

41 MR. JUSTICE BELL: There is Mr. Shafibeik,
42 Mr. and Mrs. Harrison, Mr. Brett.

44 MR. RAMPTON: That is right. There are, theoretically or
45 potentially, four Defendants' witnesses still to come from
46 Colchester and I cannot remember whether it is three or
47 four of mine. But one could, I would respectively suggest,
48 expect to finish that evidence within five days, if one
49 makes the effort, and everybody will have plenty of time
50 for preparation before they are called. Then your Lordship
51 has two days away on 18th and 19th. I would hope to be
52 able to start Bath on 22nd or very soon thereafter. The
53 Bath statements have now been served and, of course,
54 everybody has had the documentation now for a little time
55 at least.

57 After that, I do not have any more employment evidence and
58 the question then is what witnesses the Defendants are
59 going to call and when in the remaining time before
60 Mr. Cesca starts.
