     3        McDonald's have to show that we have for many years taken
     4        leading roles in the anti-McDonald's campaign and that we
     5        have organised demonstrations and anti-McDonald's fairs,
     6        and there has been no evidence to prove that in this case.
     7        Indeed, I referred yesterday to the evidence of
     8        Mr. Nicholson in relation to the October 1989 picket of
     9        McDonald's head office, and on day 250, page 37, line 28
    10        I asked him, "So when you say in your statement that prior
    11        to the demonstration you were able to learn the identity of
    12        two of the organisers, that is not to be taken as you knew
    13        that myself and Mr. Gravett had organised the
    14        demonstration?"  He said, "No, not at all".

    16        As I said before, he said on day 259, page 5, line 40 that
    17        he had no evidence that I had organised the demonstration
    18        and, also, you would remember the quote that I referred to
    19        yesterday where Mr. Nicholson said that he had kept an eye
    20        on me during that demonstration to see if I appeared to be
    21        in charge, or what have you, and that in his view I did not
    22        appear to be in charge and that I had kept myself to
    23        myself.

    25        So, in terms of 1989, there is absolutely no evidence
    26        whatsoever that I organised that demonstration or was in
    27        charge of it, or whatever, because we have heard no
    28        evidence from anybody else to that effect, and you have
    29        heard my evidence that I did not organise that
    30        demonstration and you have heard the evidence of
    31        Mr. Gravett that he did organise it.  There is no evidence
    32        about Mr. Morris that he even attended the demonstration,
    33        let alone any evidence of organising it.

    35        In terms of the other demonstrations, on day 258, page 37,
    36        line 20, when I was cross-examining Mr. Nicholson again,
    37        I asked him, "So in terms of who organised the October 1991
    38        demonstration, you would not know who organised that?"  He
    39        said, "No."  I said, "You would not have any evidence about
    40        that?", and he said "No."  I said, "That would also be true
    41        for October 1992?", and he said, "And there on."  And I
    42        said, "1993, 1994", and he said, "Yes."  Then I asked him,
    43        "On your evidence in fact you would not have any evidence
    44        at all about who organised anything from London Greenpeace,
    45        after around January 1991?"  There was a bit of a confusing
    46        discussion there, and he then said, "No, not after January
    47        1991" in the end.

    49        You asked him the question that he did not have any
    50        information from private investigators about what had gone 
    51        on after that date, and he said that that was correct. 
    52        Then I asked him, "Nor have you any evidence from any other 
    53        source apart from seeing us attending certain
    54        demonstrations?" and he said, "That is right."
    55        Mr. Nicholson is accepting that they have no evidence that
    56        we organised any of the demonstrations from 1992 onwards.
    57        They may wish to argue that it can be inferred from
    58        attending the demonstration that you are the organiser, but
    59        that is not the same thing as evidence.  Obviously, we are
    60        going to argue strongly against that, that you cannot draw
