Day 242 - 29 Apr 96 - Page 31

what your ground is as well, but you think about it
further, if you think it will help you.

There are two things I want to discuss. The first is the
question of the voluntary further and better particulars
which we put over for argument after Dr. Carriere because
Ms. Steel said she was not ready last week. The other
matter is just generally nutrition witnesses because I am
becoming increasingly anxious that none have been pencilled
       into our schedule.

I need to know what is going to be done. This must be
about the tenth time I have said the one certain thing is
that Mr. Crawford must return. If I am not given a date
soon, I am going to ask Mr. Glen to ring him up and say he
must be here on a day which suits me to continue his
evidence, because he is part way through his evidence and
he has to come back to complete it.

Everything else, including recall of witnesses who have
given evidence in the past, calling witnesses whose
statements were served, perhaps even as long as ago as July
1993, and any question of leave to call any new witness,
I will deal with as and when they are raised.

As far as I am concerned, the only certain thing is
Professor Crawford coming back to complete his evidence.
If no-one says anything more, I will assume that all that
is going to happen is that Professor Crawford will come
       back and complete his evidence.

MR. RAMPTON: There is Mr. Fairgrieve, my Lord, as well.

MS. STEEL: We have said previously that we were intending to
       call Jane Brophy who -------

MR. JUSTICE BELL: Yes, I know. You must put Miss Brophy in for
       a date.

MS. STEEL: I mean, obviously, we are aware of all the things
that we have do. The problem is that publication suddenly
cropped up, and then everything that we were trying to get
sorted out got put to one side. I did try to fix up
Mr. Campbell. I have not been able to speak to him
personally since last Friday, although I did leave a
message saying that the 4th and 5th would be OK, but
I just, obviously, need to speak to him to confirm it is
still going to be all right with him.

MR. JUSTICE BELL: What I am going to make a note,
       Dr. Campbell -----

  MS. STEEL: Professor, sorry.

MR. JUSTICE BELL: He is a professor, query for 4th and 5th
June. Professor Crawford must be fixed. You intend to
call Miss Brophy, with the Defendants definitely
(inaudible), so she must be fixed. Is there anyone else
whom you want to call or have leave to call?
