Day 139 - 21 Jun 95 - Page 50

MR. MORRIS: Sorry, he has given evidence. He said in his
       statement ----

  MR. RAMPTON: Mr. Morris, please.

MR. JUSTICE BELL: Let Mr. Rampton say what he wants and then
       you answer.

MR. RAMPTON: I deliberately in chief exacted from this witness,
and it is obvious to anyone in McDonald's, that there was
nothing of a factual nature that he could contribute to
this part of the Puerto Rico store because he was not
there. In any case, from what is written in this
statement, what could Mr. Morris possibly be expecting to
extract that had any legitimate bearing in this case? I am
only trying to save time. Whether this is a filibuster by
Mr. Morris, I do not know, but I do not see the point of
       it.

  MR. JUSTICE BELL:  I do not think it is a filibuster;
I certainly do not know that it is, but what is the point
in relation to an issue in this matter. When we get up to
1974 then I see that, but what do the 1960s have to do with
       it?

MR. MORRIS: Well, you said Puerto Rico ----

MR. JUSTICE BELL: I know what he said in his statement, but we
cannot just pick up every point in the statement whether it
       is material or not.

MR. MORRIS: I am not picking up every point in the statement.

MR. JUSTICE BELL: Say what the relevance of the 1960s is.

MR. MORRIS: To give my complete game away, and I am sure
Mr. Stein can handle it, what is Mr. Goldstein doing
running the Puerto Rico stores from Washington DC? That
was meant to be the reason that they withdrew their
co-operation with Don Miller because he was not living in
Puerto Rico. There is nothing there about the Company
       saying it was unacceptable?
       A. Excuse me?

  Q. There is nothing there, is there, about the company cock
       up?

MR. JUSTICE BELL: Do you know why McDonald's Corporation
granted a franchise for a Puerto Rico store or stores in
the 1960s to someone who appears to have operated out of
       Washington DC?
       A. There are two parts to it. Do I know?

  Q. Yes?
       A. Who they gave ----

  Q. No. Do you know, since it was the policy, during your
period anyway, for McDonald's Corporation to want people to
-- I forget the phrase you gave?
       A. Absolutely.
