1 MS. STEEL: I just understood yesterday, it was the day before
2 I asked about them, I understood Mr. Rampton to say that if
3 we finished early yesterday, which we did do, that he and
4 Mr. Atkinson would look at them in the afternoon so in fact
5 we would get them in time to ask Mrs. Barnes questions
6 about them today if need be.

8 MR. JUSTICE BELL: That was not my understanding at all.

10 MS. STEEL: I believe that is what he said on Wednesday
11 afternoon. I will check it.

13 MR. JUSTICE BELL: I would have called him to make a decision as
14 soon as that.

16 MS. STEEL: I am not quite sure why the Plaintiffs can have
17 plenty of time to think about it, but we got shouted at for
18 the CFCs document and other documents because we did not
19 disclose them immediately they came into their possession.

21 MR. JUSTICE BELL: That is a distortion of the situation.
22 I have been extremely sympathetic about your position both
23 so far as cross-examining is concerned and discovery of
24 documents. I have done my very best to be even-handed. I
25 have lent over backwards to give you facilities which
26 I would never have dreamt of giving to counsel. You must
27 accept the indulgence I offered you in good faith. We will
28 resume at 10.30 on Tuesday week.
