Day 206 - 22 Jan 96 - Page 50
A. I cannot recall specific instances of people
working .....

Q. It would not surprise you then if some people had worked
seven days in a row at McDonald's?
A. Some people may have worked seven days in a row as an
exception.

Q. What about eight days, nine days in a row? Does the
Company have any policy on this kind of thing, some people
could be working eight or nine days and you would not even
know, yes?
A. No. The way the schedule was compiled, it would not
allow someone, so far as I am aware, to work greater than
seven days in a row.

Q. Why not?
A. Because the two days -- the two day off period in the
period of the -- in the week.

Q. So that is for the employees' benefit or is this for the
company's benefit?
A. That is for the employees' benefit.

Q. So do you consider seven days in a row would be unfair on
the employee, really? Is that why you do it for the
employees' benefit?
A. Sorry, I do not understand.

Q. You say it is for the employee's benefit not to work even
days in a row. Is that because the Company considers that
that is too much for an employee in terms of safety or in
terms of stress or whatever else?

MR. JUSTICE BELL: Do you know?
A. Typically, the schedule is done on a weekly basis, so
there would be a ------

Q. As I understand it, let us suppose that it is normal to
have two days off in every seven ---
A. Yes.

Q. -- theoretically anyway, even if that were observed, if you
had your two days off at the beginning of one week and two
days off at the end of the other, that would leave 10 days
in a row in between, if it is so happened that you were
scheduled in that way, because there are seven days in a
week, so you have two off, five on, five on, two off. This
is just theoretical possibility, do you understand?
A. Yes.

Q. What is it, if anything, which makes you say that the way
the schedule was compiled would not allow you to work more
than seven in a row?
A. You would be mind -- when you actually prepared the
schedule you are mindful of the fact that you are looking
at the previous week's schedule to prepare the next
week's. Obviously, during some period there is a cross
over period, say, someone will be working on a night shift,
then obviously you would need to know and examine the
