Day 198 - 08 Dec 95 - Page 37

MR. JUSTICE BELL: No, I do not have anyone else in mind.

MR. MORRIS: Connor McCann we have read out now, have we not?
Michael Bowland we are not going to call; we will take him
as a Civil Evidence Act statement; we are happy to read his
statement out today, if you wish.

MR. JUSTICE BELL: Wait a moment; where is he?

MR. MORRIS: He is number 7, from Australia. Daniel Cantor we
do not intend to call; we will take him as a Civil Evidence
Act statement. Of course, Mr. Lamti has given evidence, so
has Miss Inglis. Alistair Duncan we intend to take as a
Civil Evidence Act notice. Mr. Soriano we intend to call.
I think that is the complete picture.

There is something else I wanted to raise, which is that
there is a witness that we have who has said he sent us a
statement six months ago, and then when I contacted him
again some time ago he said he would send it again.
I still have not received it. I do not know what the
problem is there, but he does not appear on the list.
There is someone else who said he was drafting a statement
       up for us.

  MR. JUSTICE BELL: What -----

MR. MORRIS: Obviously, we would apply for leave if we got those
       statements.

MR. JUSTICE BELL: What do they relate to?

MR. MORRIS: They are people that worked at McDonald's.

MR. JUSTICE BELL: Can you tell me the stores?

MR. MORRIS: I would prefer not to until I have the statements
in case there is any pressure put on them or through
friends they may still have there, or whatever.

MR. JUSTICE BELL: We do not even know their names, so that is
not realistic, is it? Just tell me the stores. I want to
know where I have got loose ends and where -----

MR. MORRIS: We have a reasonable belief that documents
miraculously go missing when we introduce witnesses,
whether it is by design or by coincidence I do not know,
but we would prefer not to identify the stores until at
least we have the statements and then ------

MR. JUSTICE BELL: I just do not accept that. You can tell me
       the stores just to -----

MR. MORRIS: To be honest, I have not actually got their
       statements, their details with me.

MR. JUSTICE BELL: What I want to know is, are they actually
stores which are in the picture at the moment?

MR. MORRIS: No, I do not think they are.
