effect, and still are. But the union has no objection to
that; we encourage a performance-related pay, as long as it
is based on the minimum wages that are provided for in the
tariffs. So there is no problem with the union versus
       performance-related pay.

  Q. Taking those tariffs, am I right that although some of the
employees are better off than they were before the
agreement, equally, some of them are worse off?
       A. No. You would be wrong.

  Q. That would be wrong, would it?
       A. Yes.

  Q. Am I not right that the rates set by the union for those
who have not served more than a few months means that they
are worse off than they would have been under the old
       system?
       A. Yes; but after six months of employment, they would
almost double their wages; and, in my opinion, that would
       make them better off.

  Q. You are not -- and this is not a criticism of you at all --
you are not in a position to say overall what has been the
consequence for the McDonald's employees who are the
subject of the agreement, are you? You do not have those
       data?
       A. What do you mean?

  Q. Sorry. Have you, yourself -- I will put it in a more
neutral way -- have you, yourself, had access to the data,
the facts, which are necessary to enable you to state one
way or the other whether the McDonald's employees who are
the subject of this agreement are, overall, better or worse
       off?
       A. Concerning pay, you mean?

  Q. Yes, concerning pay?
       A. Yes. I have been in possession of documents, the
master payrolls, and they would lead me to believe that the
       people are better off, yes.

  Q. For all the employees concerned?
       A. Yes, for all the employees concerned. One of the
provisions of the agreement is that once a year there is
       supposed to be a negotiation about performance-related pay;
and one of the things that needs to be done before one can
discuss the individual wages of the workers, the union has
to be given a master payroll showing what every single
worker earns; and I have been given those documents.

  Q. I just want to understand this. Are you telling us that
you have negotiated on behalf of all the McDonald's people
who are members of the union, or simply on behalf of those
who work at the same restaurant as you do?
       A. Only the ones that are working in my restaurant, yes.

  Q. I thought that. There is a right, Mr. Jenssen, under
Norwegian law, is there not, to inspect company financial
documents, annual reports, matters of that kind? They are
