22 MR. RAMPTON: I hope the Defendants do not forget -- I realise
23 that they must cross-examine on animals; I am, as usual,
24 not overwhelmed at the speed with which we have proceeded
25 in the last two days -- I just ask them to remember that
26 I have two people coming down from Scotland on Sunday to
27 give evidence in this case. The more time spent in court
28 the less time they have to prepare for Mr. Atherton, I
29 think it is, the following day. My Lord, there is another
30 matter which makes it -----

32 MR. JUSTICE BELL: Are you asking for a marking so far as the
33 next witness is concerned, or is he coming down first thing
34 or on Sunday night?

36 MR. RAMPTON: They are coming but they are only at the end of a
37 telephone in Glasgow. I have no doubt that if we are told
38 that there is no sensible prospect of their beginning their
39 evidence on Monday, I will put them back, if I can. There
40 is no point their coming down just to sit in court.

42 MR. JUSTICE BELL: I was thinking more about mid-day. I
43 mean, they may choose to come down on Sunday night anyway
44 but -----

46 MR. RAMPTON: They will probably come down Monday anyway so as
47 to be ready for Tuesday morning.

49 MR. JUSTICE BELL: But if they might well start on Monday but
50 not before 2 o'clock, for all I know they might choose to
51 fly down.

53 MR. RAMPTON: That is what they are going to do anyway, they are
54 going to fly down.

57 morning rather than on Sunday night if they have a choice.
