Day 292 - 01 Nov 96 - Page 51

than paper in April 1991. That was put to him, and I think
       he reluctantly accepted that.

Page 72, I have put 'important' there,. One to 46, I mean,
you can read it for yourself, but, yes, it says there,
'Sums up McDonald's PR department lies re environmental
       damages of foam. Also see-----'

  MR. JUSTICE BELL: Advantages -----.

MR. MORRIS: 'Advantages of foam'. See also page 73, line 14,
up to there. Basically, you can read it for yourself but
they are saying one thing which he now in court would be
forced to retract. You conclude at the bottom of the page,
"Regarding the document I have been reading out it is a
bit of a plug for Polystyrene packaging, is it not", that
page. So that is quite an important part.

Page 72, line 52, we have dealt with that. Page 73, they
are claiming the plastic packaging is recyclable in 1990.
They are still, that was in 1990. They were claiming their
plastic packaging is recyclable, and therefore the same
considerations would apply to that regarding the deceptive
nature of that as would apply to other points about
recycleability of paper packaging, whatever. That was in
1990. They are not doing it now. It says there, "Judge
weighs in", page 74, line 15.

MR JUSTICE BELL: Who was I weighing into? You or Mr. Oakley?

MR. MORRIS: You just weighed into the discussion. You said,
"So the foam packaging used by Mcdonald's in the middle of
1990 was not actually recyclable." He said, "We have not
said that the packaging used by McDonald's is recyclable".
And then you read out the bit that says it is recyclable.
The words are, line 22 page 74, from the document, "it is
recyclable." Mr. Oakley, said it is.

MR. JUSTICE BELL: What was that, 74, 22?

MR. MORRIS: Yes, 74, lines 5 to 22, to 24. In fact 26.
Involved you and discussing about whether something is
recyclable or not. Basically, it clearly was not.
Mr. Oakley was claiming both it was and it was not at the
same time. So that is day 60.

MR. JUSTICE BELL: If you want to go on and finish him, you
can, but it is quarter past -----

MR. MORRIS: Funnily enough, I have actually got a babysitter
tonight, so I have a bit of extra time. Shall I finish off
       the next -----

MR JUSTICE BELL: I would not go further than the end of
Mr. Oakley. You can do page 61, if you want.

MR. MORRIS: Yes. I might as well do day 61. Page 10: toilet
rolls and kitchen rolls not made from recycled paper before
July 1989. So, they can be effectively ruled out of the
       equation.
