Day 111 - 30 Mar 95 - Page 40
arisen generally so far as that is concerned, because you
called your witnesses after the McDonald's witnesses have
been called. Do not try and persuade me that that which
I have clearly heard with my own ears is not so. There has
been a lot of new material.

It may mean that Mr. Rampton will wish to call evidence in
rebuttal. If he does, at the moment, I am minded to let
him do so because of the new stuff. In a thoroughly well
ordered household, all the additional matters which Ms.
Hovi has mentioned would have been put in a supplemental
statement and served some weeks ago.

No-one is stopping you going on with adducing the
evidence-in-chief, but it may be that Ms. Hovi will have to
come back and it may be that Mr. Rampton will want to call
evidence in rebuttal. We will just have to wait and see.

MR. MORRIS: If I may just make a general observation, that it
seems to me that every witness in this case, without
exception, has made a statement upon which they have
expanded and expounded. Ms. Hovi is no different; she has
made quite a substantial statement. I do not believe any
matter that she has brought up, apart from the earlier
material about general bacterial contamination which is
under her expertise, but that has all been dealt with any
way by other witnesses.

MR. JUSTICE BELL: I have listened to Ms. Hovi's evidence. I am
making no comment on it. I have heard with my own ears
what she has said. I totally disagree with what you have
just said. We will just have to wait and see whether
Mr. Rampton needs more time to take instructions before
cross-examination and wishes to call evidence in rebuttal.

MS. STEEL: There was one thing. I think you gave as an example
something about the cleaning facilities, the sterilising
facilities. That is actually under paragraph 7 of the
statement. It was mentioned in the statement.

MR. JUSTICE BELL: Do not argue about it any further. I have
ears; I have CaseView; I have the statement in front of me
and I have my own view about it. You carry on with your
evidence-in-chief and then we will see what, if anything,
further Mr. Rampton has to say then.

MR. MORRIS (To the witness): Just to finish off the actual
floor plan and the line, your concerns about the boning
hall?
A. Yes.

Q. What are your concerns about the minced beef production
which I do consider is a new point?
A. That had only to do with the fact that the cleaning was
not going to be efficient under those circumstances. That
was why I felt it important to establish a system of
monitoring the cleaning with the TVC counts but, that aside
-- we can discuss the TVC counts, if you want to, later --
an additional concern that I had in the boning hall was
that the implements and the tools that were used in the
