     1        discovery in relation to statistics or anything else
              which, it seems to me, if there is an issue between you or
     2        the matters need canvassing at all, we really ought to try
              and deal with it on Thursday.

         MS. STEEL:   We actually wanted -- well, we have not had time
     4        to do this properly, but on Thursday we think we will want
              to bring up something about the further and better
     5        particulars of the defence to counter claim, and also
              about some of the interrogatories which were not
     6        answered.  I mean, hopefully that will not take very long
              anyway.

         MR. JUSTICE BELL:  How long do you think you will be with
     8        Dr. Gregory?
 
     9   MS. STEEL:   We do not really know, but I would not have
              thought it would go into Thursday, but I would not want to
    10        give a 100 per cent guarantee on that, but I doubt it.
 
    11   MR. JUSTICE BELL:  I think we have to leave sufficient time on
              Thursday, Mr. Rampton, to deal with any matters relating
    12        to interrogatories, further and better particulars of the
              reply and defence to counter claim and any further
    13        discovery particularly with regard to the statistics.
 
    14   MR. RAMPTON:  Yes.
 
    15   MR. MORRIS:  So are we formally then not calling Mr. Walker?
 
    16   MR. JUSTICE BELL:  There is just no time.
 
    17   MR. MORRIS:  That is what we agreed last week
 
    18   MR. RAMPTON:  I did not agree anything.
 
    19   MR. JUSTICE BELL:  There will not be time realistically, will
              there, Mr. Rampton?

         MR. RAMPTON:  It will help if we can have a letter in advance
    21        of Thursday's hearing giving notice of what
              interrogatories it is said we have not answered and of
    22        what complaint or otherwise might be made about the
              further and better particulars to the defence to counter
    23        claim.  That will shorten matters.
 
    24   MR. JUSTICE BELL:  Do that if you can, otherwise I would like
              someone to remind me to ask about it on Wednesday
    25        afternoon, because I would like to give it a bit of
              thought just to know what sort of area we are working in, 
    26        do you understand? 
  
    27   MS. STEEL:   Yes.
 
    28   MR. JUSTICE BELL:  Everyone expects that one can be posed with
              a problem and give an immediate answer; it helps if one
    29        has time.
 
    30   MS. STEEL:   There are some points that is probably going to be
              easier to, but on part of the further and better
