Day 151 - 10 Jul 95 - Page 14

where, in 1995, it was -- I cannot remember. It was the
document E3, actually. The witness will not need to get it
out. It has been accepted by McDonald's own computer
printout that something like 56/57 per cent of staff -----

THE WITNESS: Would it be helpful if I did see it?

MR. MORRIS: It probably would not, because ----
       A. With all respect, I would not feel confident making any
comments without actually seeing the document.

MR. MORRIS: Fine by me. E3 -- I do not know which file.

MR. ATKINSON: It is yellow X, my Lord, and it is tab 7, after
       Lynn Mead.

THE WITNESS: Thank you. Which particular printout?

  MR. MORRIS: E3.

MR. JUSTICE BELL: It is not numbered, but it is the third sheet
       of E3.
       A. "Current employees by length of service with the
       Company"?

MR. MORRIS: Yes, that is the one.
       A. Dated 28th March, 1995.

  Q. Yes. This has been poured over at great length in the
court before with Lynn Mead in the witness box. Unless
I am corrected by Mr. Atkinson, it is accepted that
something like 56 to 57 per cent of employees at that time,
length of service was under a year, up to the 12 months.

MR. JUSTICE BELL: If you add the percentages from 0 to 1 month
to 6 to 12 months inclusive, in the left hand column, that
comes to 56.25 per cent. The previous quarter, it was
57.77, and the same quarter the year before was 52.8. So
what is being said is that, at that time -- which is the
end of the quarter 31st March, 1995 -- 56 per cent of
McDonald's crew had been working for McDonald's for not
more than 12 months. Do not write -- have you written
       something on the copy?
       A. No, I have not. I have just put "last quarter of 94"
       at the top there.

  Q. Do not write on a court document in the future, because
another witness will come to it blind and be asked a
       question about it ---
       A. Sorry, I beg your pardon.

MR. JUSTICE BELL: -- and see your writing. It has not done
any harm in this instance. I wonder if Mrs. Brindley-Codd
could make a point of just crossing that out in due course
       in some way or another?

  THE WITNESS: Sorry.

MR. JUSTICE BELL: Do not worry. Keep it in the bundle.
