Day 118 - 01 May 95 - Page 36

MR. JUSTICE BELL: The point is it is not -----

THE WITNESS: It is not the kind of uniform they would want to
       wear.

MR. JUSTICE BELL: No-one would go to the disco in their
       McDonald's uniform -----
       A. No, unless it is a McDonald's disco!

MR. MORRIS: It came up in the context ---
       A. Benefit.

  Q. -- that you were talking about the wages.
       A. Yes.

  Q. That you considered that on top of the wages, which may be
considered to be low or otherwise, there were these
       additional ---
       A. Benefits.

  Q. -- benefits such as a uniform which is compulsory anyway.

MR. JUSTICE BELL: Did you actually mention the uniform as a
       benefit?
       A. Yes, I think I did, my Lord.

MR. RAMPTON: No, he did not. It is in his statement, my Lord
He did not mention it in his evidence.

MR. JUSTICE BELL: I do not think he did in evidence.

MR. RAMPTON: No, he did not. The question I asked was: "In
addition to pay, do they get any collateral benefits of any
kind?" Answer: "Yes, several bonuses, food" and so on and
so forth. He did not mention uniforms in evidence.

THE WITNESS: But I would include that.

MR. JUSTICE BELL: You would include it?
       A. Yes.

MR. MORRIS: So, if the company did not provide free food -----

MR. JUSTICE BELL: I do not know whether you really need to go
into that much further. It might be said that it is a
benefit in a sense that if you spill something down your
clothing, the clothing you are wearing in McDonald's, at
least it will not be your clothing. On the other hand, it
is clearly very much in the interests of the employer that
they wear McDonald's uniforms. It is all part of the
       presentation.

MR. MORRIS (To the witness): But, in terms of the food that you
provide for free, I believe, is it still the case that
staff are not allowed to bring their own food in to the
       stores?
       A. I am not sure. This is a matter which has been
discussed, I know. I am not sure what the current position
       is.
