Day 116 - 26 Apr 95 - Page 25

       school leaving age?
       A. Yes.

  Q. If you turn to page 715D, you should have a memo. If you
look at the next page it has a signature over your name.
       Is that your actual signature?
       A. Yes, everyone is -----

  Q. Does it just say "Sid"?
       A. Yes, everyone in McDonald's is referred to by their
       first name only.

  Q. I see. In case any licensee did not know who you were, you
were actually identified on the first page?
       A. They would know who I was.

  Q. Do you see that it is dated 26th January 1989?
       A. Yes, I do.

  Q. You say: "It has come to attention that some licensees are
employing children under school leaving age, i.e. under 16,
and I thought it might be helpful if I pointed out the
requirement to be observed", et cetera, "under the Children
and Young Persons Act 1933 when employing such children".
Then you set them out and you say at the bottom of the
page: You have to be aware that there are local
restrictions as well or there may be?
       A. Yes.

  Q. Local authority restrictions. Then over the page you give
them a warning, 715E: "Please be assured that local
government enforce these regulations most rigorously and
any contravention will almost certainly lead to a
       prosecution"?
       A. Yes.

  Q. There is only one other thing on that -- first, a general
question: Had it come to your attention that some
       licensees were doing that?
       A. Yes. I believe the Senior field Services Officer --
field Services is a department that is responsible for
ensuring licensees, franchisees, conform to the regulations
of the company -- and he had come to me and said that in
the course of a visit he was concerned that a licensee or a
franchisee had, in fact -- he had found that they had, in
fact, employed children of under school leaving age. He
asked if I would bring it to their attention that we found
this unacceptable. Therefore, I sent out this memo to all
of our franchisees for their information.

  Q. So was there a prosecution on that case or not?
       A. No.

  Q. Was there a threat of a prosecution?
       A. No, no, it was found internally.

  Q. Would you turn backwards, in fact, to page 715C which is a
letter of 16th March 1989 from the ILEA to Carmel Flatley?
       Do you see that?
       A. Yes I do.
