Day 165 - 27 Sep 95 - Page 48

       say about that?

  MS. STEEL: About the 11th?

MR. JUSTICE BELL: About 11th and come what may finish on or
       before the Thursday 21st.

MS. STEEL: I think if he has to come before Christmas then
starting on the 11th is the best option.

MR. JUSTICE BELL: What I am going to do, as I am empowered to
do, if I say the 11th rather than the Monday before that,
the 4th, I am going to say because I think it is perfectly
fair to you and it brings a bit of order into the
proceedings, he will be released not later than Thursday
21st December come what may. Do you understand what I am
       saying?

  MS. STEEL: Yes.

MR. JUSTICE BELL: That is why I asked you if you have any
       comment to make about that?

  MR. MORRIS: No.

MR. JUSTICE BELL: I do have power to make directions about how
long people will take. I have been reluctant to do it but
it allows nine court days which is absolutely ample. In
fact, I would have thought six or seven was more than
ample. It allows for any little hiccups which may happen
along the way, but I am giving everyone an opportunity to
say anything before I make any such direction.

MR. RAMPTON: My Lord, we will make immediate enquiries. They
may not have immediate rules because I do not know where in
the world Mr. Cesca is at the moment, but at least we can
speak to his signature I expect to find out his
availability. If it is at all possible to fix him for the
11th December to run over if necessary, and I have a heavy
heart when I say that I am bound to say, we will find out.
We will also find out whether he can start the week before
if the end of that period, that is to say the week
beginning the 18th, were a problem.

MR. JUSTICE BELL: I would like you to make enquiries, you have
really said the same thing, for a start date for Mr. Cesca
on either Wednesday 6th Thursday, 7th, Friday 8th or Monday
       11th of December.

MR. RAMPTON: My Lord, it might be, for example, I do not know,
perhaps I am hypothesising too far, but it might be that he
could start on 4th because he could not really go beyond
the 13th or 14th, I do not know. If that were so I would
bring it back to your Lordship and tell your Lordship.

MR. JUSTICE BELL: I will hear anything which anyone on either
side would like to say about that, but the enquiry I would
like to be made is whether it is possible for him to start
on one of the four days I have just mentioned.
