McDonald's seven times a week, then she must identify it
2 so the witness can deal with it.
3 MR. JUSTICE BELL: Just pause a moment. What I would like to
be clear about is whether you are suggesting there is
4 evidence in the case that those other than those who are
employed at McDonald's eat as much as one McDonald's meal
5 every day, whether there is any evidence -----
6 MS. STEEL: Yes, there is.
7 MR. JUSTICE BELL: --- as to how many, if any, people do.
8 MS. STEEL: Yes, there is, but at the moment I am not dealing
with that. I think Mr. Rampton is wrong. There is
9 nothing in our pleadings which says that we are only
concerned about the health customers; we are not bothered
10 about their employees.
11 MR. JUSTICE BELL: I am not concerned with the pleadings at the
moment. Your question, if it was recorded correctly, was:
12 If it was shown that people were, which I believe it is,
eating a McDonald's meal every day, do you think that is a
13 wise move? I have your points and figures about
McDonald's employers, but what I want to know is if it is
14 implicit in that question that there is evidence that a
significant number of people, other than McDonald's
15 employees, eat McDonald's meals every day.
16 MS. STEEL: Well, at the moment I am just asking the question
that you read out.

MR. JUSTICE BELL: It is just a hypothetical question?

MS. STEEL: I am concerned about employees as well. I mean,
19 people including employees as well.
20 MR. JUSTICE BELL: I appreciate that. I am not discarding
that, but what I want to know is it just a hypothetical
21 question or are we going to have evidence that -- I have
your employees point and we know there are 31,000 of
22 those.
23 MR. RAMPTON: That is right, my Lord.
24 MR. JUSTICE BELL: What I want to know is whether there is any
evidence in the case that a significant number of people
25 in this country, apart from those 31,000 people, eat as
much as one McDonald's meal a day.

MS. STEEL: I am going to come on that. With respect, I am
27 going to come on to that, but at the moment I am just
asking -- it is not a hypothetical question because we
28 already know that the employees do.

the moment?
