Day 139 - 21 Jun 95 - Page 53

  Q. But you are seeking an order to that effect from the court,
       are you?
       A. Yes, that is correct.

  Q. To order a mandatory injunction for him to take down any
signs of McDonald's, and an injunction not to hold himself
out as operating a McDonald's restaurant, or something to
       that effect?
       A. That is correct, my Lord.

  Q. And until you actually get such an order?
       A. There is nothing we can do.

  Q. Nothing you can do. He carries on operating if he chooses
to do so in the mean time?
       A. That is correct.

  Q. So the transfer of his interest, as he may have portrayed
it to Mr. Gibson to be, you say happened without your
       knowledge?
       A. To Mr. Miller?

  Q. To Mr. Miller, sorry?
       A. That is correct.

  Q. Had you actually got an order by then as you found out
       later?
       A. No, we did not.

  Q. You had just taken proceedings towards that?
       A. That is correct.

MR. MORRIS: Since that time, did you make peace with Mr. Gibson
in any way, or is he still -- I am saying the Corporation?

MR. RAMPTON: I really do believe that whether the Corporation
made peace with the franchisee that was terminated in 1974
has got nothing whatever to do with this case. I do not
know what Mr. Morris is up to this afternoon; it certainly
is not the progress of this case.

MR. MORRIS: Everything I am asking is about the progress of
this case. I would not be wasting my time.

MR. JUSTICE BELL: I can understand if you were asking questions
about what happened about the union dispute when it arose,
but what does this have to do with something in issue?

MR. MORRIS: It relates to the process of what happened in
Puerto Rico which is obviously controversial and McDonald's
have put their interpretation on events.

MR. JUSTICE BELL: What do these questions have to do with it
because unless you can explain the relevance of these
questions, I suggest you go straight to that which you take
issue with about the "union dispute" itself?

MR. MORRIS: It relates also to the previous controversy which
relates to -- it could be part of a continuum and it seems
to be part of some ----
