Day 130 - 26 May 95 - Page 27
MR. RAMPTON: My Lord, if Mr. Morris is intending to suggest
that its original non-disclosure was a deliberate
suppression, he might like to ask himself why it was
disclosed at all; he did not even know about it.

MR. MORRIS: It was disclosed because would have found out it
existed after we started cross-examining, and then there
would have been even more of a row about it.

MR. JUSTICE BELL: Whose cross-examination did you have you in
mind?

MR. MORRIS: Mrs. Barnes.

MR. JUSTICE BELL: It was disclosed before Mrs. Barnes started
to give evidence.

MR. MORRIS: Yes, two days before or something.

MR. JUSTICE BELL: It was not discovered on cross-examination.

MR. MORRIS: No. What I am saying is it would have been
discovered, because we would have asked Mrs. Barnes if she
did a report.

MR. JUSTICE BELL: We cannot bother too much about that. You
have got it. If you want to make use of it, that should be
enough.

MR. MORRIS: What disciplinary action was taken against the
store management at the Arndale store as a result of that
accident?

MR. JUSTICE BELL: Was any disciplinary action taken?
A. I do not think there was, no.

MR. MORRIS: You had a report from the Inquest, did you?
A. I really cannot remember. I cannot remember having
seen -----

Q. Nobody told you what happened at the Inquest?
A. Told me, yes, but I cannot remember ever seeing
anything in writing.

Q. Who went from the Company to the Inquest?
A. Peter Richards, who was then Regional Manager Vice
President, Frank Frost, the Facilities Engineer, and
I believe Margaret Balmer from, then, Personnel.

Q. And Paul Preston?
A. No. Paul would not have gone because Peter was the
board member locally, who was involved in it.

Q. You said that you did not have a chance to talk to
Mr. Chapman, but are you aware that a statement by
Mr. Chapman, or an interview with him, was read out at the
Inquest by Mr. Shirkie?
A. I was not at the Inquuiry, so I was not aware of it.

Q. You were not told that?
