Day 297 - 08 Nov 96 - Page 40

He said during re-examination that of course he would be
concerned if people were eating McDonald's several times a
week. Was day 32, page 77. But the point he was making is
that McDonald's are responsible for whatever their
contribution is and...

Dr. Lobstein, during re-examination, also confirmed that he
considered that McDonald's statements were not the whole
truth about what they sell. We referred to a McDonald's
document, I think it came from America.

MR. JUSTICE BELL: Did you have a reference for that last one?

MS. STEEL: Day 32, page 76, sorry. He was referred to a
McDonald's document, which I think came from America, which
stated "the goal is to keep sight of your daily intake",
and he agreed that that was sensible and, well, he actually
said he found it an amusing comment to come from
McDonald's. Day 32, page 77. The point about that is that
throughout this trial McDonald's have been trying to assert
that it does not matter what you eat on a day to day basis,
it is what you eat over... Well, it seems to have varied
between weeks to months, sort of thing, but the point is,
here is an admission in their own document that the idea of
trying to adopt a healthy diet is to keep sight of your
daily intake, and, obviously, that does not mean that on
the odd occasion you cannot... You know, I don't know, if
you have got a party to go to or something like that.

MR. JUSTICE BELL: You can have a blowout?

MS. STEEL: Yes, but overall you should try and balance it
throughout the day, day by day. Dr. Barnard expressed
concern that McDonald's advertising was less than honest.
For example, he said the McLean Deluxe burger was billed as
91 percent fat free, meaning by weight 9 percent was fat,
but he said that was a complete meaningless statistic as in
fact 49 percent of the calories in the patty and 29 percent
of the whole burger came from fat. That is 29 percent of
the calories in the whole burger, with the bun included.
That was day 33, page 11.

Can I just ask, did I give a reference for the leaflet that
we were just referring to, that Mr. Lobstein leaflet from
McDonald's?

MR. JUSTICE BELL: You gave me page 77.

MS. STEEL: That is OK, I did not know if I had missed it out.

Dr. Barnard also referred to the fact that McDonald's had
manufacturer a plastic toy which came with a booklet and
was available with a Happy Meal, and that the booklet
stated "Food in the meat and protein group gives your body
the tools it needs to grow and build healthy muscles.
Eating two servings a day of these foods can make it easier
to do things like climb higher and ride your bike further."
Mr. Barnard attacks that statement and says there was
absolutely no evidence for it. He made an official
