Day 247 - 10 May 96 - Page 67

MS. STEEL: Well, I think at the minimum somewhere between an
hour or two. But we have not had very long to look at
Mr. Nicholson's statement. I mean, we might think of
       more-----

MR. JUSTICE BELL: Are you ready to carry on now, or do you want
to start with it fresh on Monday morning?

MS. STEEL: To be honest, I am pretty tired.

MR. JUSTICE BELL: Would you like to go and sit down,
Mr. Preston. You will not be asked any more questions this
       afternoon. (The witness withdrew).

I am afraid it means that Mr. Preston will have to come
back on Monday morning for the completion of
       cross-examination.

MR. RAMPTON: Yes. My Lord, I can offer another witness for
Monday, because I do not want to have another half day on
Monday. I hope it would be less than an hour that the
publication questions take, since Mr. Preston has already
given some fairly conclusive answers when he was
cross-examined about publication on Tuesday of this week.
However, I do have another witness that I can offer for
Monday as well and I would like to go straight on with him.

MR. JUSTICE BELL: Who is that?

MR. RAMPTON: That is Mr. Howes, the solicitor, who was in
       court.

MR. JUSTICE BELL: Where did I put him?

MR. RAMPTON: I have also got Mr. Nicholson.

MR. JUSTICE BELL: Where did I put Mr. Howes?

MR. RAMPTON: My Lord, he would have gone into publication,
which is yellow 2. I am sorry, I cannot remember the tab
number, but he would be towards the back.

  MR. JUSTICE BELL: 2A.

MR. RAMPTON: Yes. He is very short. Mrs. Brinley-Codd put him
in volume yellow 2 at tab 11.

MR. JUSTICE BELL: Someone was told I was to put it at divider
       2A for some reason.

MR. RAMPTON: So long as your Lordship has it for the moment.
You can see how short it is. It may be that it will not
even be contested. I do not know.

MR. JUSTICE BELL: What I have it in mind to do is go on to
Mr. Howes after Mr. Preston has completed his evidence.
Hopefully, all that will be completed by 1 o'clock, and
then I would be prepared to say Mr. Nicholson, but we can
start him at 10.30 on Tuesday morning.
