3 MR. RAMPTON: My Lord, that leaves me with only two things to
4 say in general about the schedule: The one that I handed
5 up the other day is no longer accurate, obviously, because
6 people have been moved. I will redo that. The other thing
7 is that it is as generous and the most pessimistic that
8 I could think of; one could, in fact, by efficient use of
9 time make it a good deal shorter.

11 Two things that bear on that are, first, that it now
12 appears, though I have not had it confirmed, that
13 Mr. Bowland and Mr. Cantor are not going to be live
14 witnesses. The other one, which I have allowed for in the
15 schedule your Lordship has got or the calendar that
16 I handed up the other day, is the nutritious evidence.

18 MR. JUSTICE BELL: That is right. Mr. Cantor and Mr. Bowland
19 are both to be read, are they?

21 MR. RAMPTON: That is the suggestion that I picked up from
22 Mr. Morris. Whether it is right that they are not coming
23 has not actually been confirmed, but my suspicion is that
24 they are not coming. Therefore, one could lose them. Then
25 the other question, as I say, is whether, in fact, there
26 needs to be any further nutrition evidence. I have allowed
27 for it but it may be that, in the light of your Lordship's
28 ruling on the nutrition meaning, it will not be needed.

30 MR. JUSTICE BELL: I have not turned my mind to that.

32 MR. RAMPTON: I know. I was not proposing to canvass it now.
33 I merely mention it as a possibility, as a possible way of
34 shortening the schedule.

38 decision on Mr. Cantor -----

40 MR. JUSTICE BELL: I am not asking you for an answer on
41 Mr. Cantor and Mr. Bowland. All I am doing is, as I have
42 done in the past, relying on you to tell me as soon as you
43 know that the witness is going to be read to let me know.

49 MR. MORRIS: Yes. I think what we will do, we will phone
50 Mr. Cantor and Mr. Bowland -- we have been trying to get
51 hold of them -- and then make a final decision on that one
52 fairly soon.

55 soon. It is not just for the convenience of Mr. Morris and
56 his witnesses; it is also for the convenience of my
57 witnesses, particularly the ones that are employed by
58 McDonald's such as the two people in Costa Rica, for
59 example, and the independent experts like Mr. Bateman.
