Day 019 - 27 Jul 94 - Page 57
1
MR. JUSTICE BELL: What I suggest is we will have our
2 five-minute break now and go on to methods of slaughter.
If you want to raise anything in relation to Oasters, tell
3 me in the morning, but you may think, in fact, it has gone
as far as it is helpful to.
4
MS. STEEL: I am a bit concerned about the fact that we have
5 not seen it before. This is a problem that has -- it is
not just with this because, like yesterday, there is the
6 pig booklet in your set of files but was not in ours. It
seems like there is a continual problem with whether we
7 have been served with things that are handed in to the
court or whatever. You know, it puts us in a very
8 difficult position if we have not got all the information
available to us that is available to the court.
9
MR. JUSTICE BELL: I do not know.
10
MR. RAMPTON: I can tell your Lordship what actually happened
11 -- it has happened before in this case -- the defendants
were handed envelopes in court on that day or the day
12 after containing the submission with the letter. If, as
has happened before, they do not care to read what they
13 are given, we cannot be answerable for that.
14 MS. STEEL: I could believe that one of us might have
overlooked it but not both of us. We do read what we are
15 given.
16 MR. MORRIS: Can I tell you, if it was an admission we would
definitely have noticed it.
17
MR. JUSTICE BELL: For all I know something has gone wrong but
18 there we are.
19 MR. MORRIS: A mix up.
20 MR. JUSTICE BELL: We will have a five minute break and then
carry on.
21
(Short Adjournment)
22
MS. STEEL: On the loading procedure, you did not watch that,
23 did you?
A. Not at Sun Valley.
24
Q. Do you know whether Sun Valley have specific instructions
25 to the catchers not to hold the birds by the legs?
A. I do not know. I would consider it to be very
26 unlikely.
27 Q. That is the usual way?
A. Yes. It would slow the whole procedure down too much
28 to carry them by the body or by the wings.
29 Q. How are they normally put on to the lorry at Sun Valley?
A. I can describe the system in general and assume that
30 it applies to Sun Valley.
