Day 006 - 05 Jul 94 - Page 79

1 environmental affairs manager of Pacico. Did you mention
              Mr. Oakley?
     2
MR. RAMPTON: Mr. Oakley is a movable person because he is
3 McDonald's in this country, so I was going to remove him
from this week altogether and also Mr. Mallinson.
     4
MR. JUSTICE BELL: He is a forester.
     5
MR. RAMPTON: That is right. He is agreed to come on Monday
6 which is the only date he can do, apart from Thursday.
Professor Duxbury cannot be moved because he has his own
     7 academic commitments.

8 MR. JUSTICE BELL: Is he really short?

9 MR. RAMPTON: Yes, because effectively what he says is, yes, at
different times it has been perceived that the first CFCs
10 then HCFCs are damaging to the ozone layer; it is a
question of chronology more than fact. Then he makes a
11 calculation of McDonald's percentage responsibility,
contribution of those two substances, to the world's
12 contribution, as it were. Then he may say something about
methane, I do not yet know at the moment, which is an
13 issue raised by the defendants, as your Lordship knows.

    14 MR. JUSTICE BELL: So.

15 MR. RAMPTON: He is relatively short. What will not be
required of him, unless the defendants dispute his
16 calculations of McDonald's percentage contribution to the
to the world output of HCFCs, is to go into his
    17 calculations.

18 MR. JUSTICE BELL: No. So the suggestion is Mr. Kouchoukos in
              the morning.
    19
         MR. RAMPTON: Yes.
    20
         MR. JUSTICE BELL: And then?
    21
MR. RAMPTON: It is entirely a matter for your Lordship. What I
22 would like then to do is to start Mr. Langert, then have
Professor Duxbury who will be quite short, continue with
23 Mr. Langert, finish him, then go back to Mr. Preston.

24 MISS STEEL: It is Tuesday today, is it not?

    25 MR. JUSTICE BELL: Yes.

26 MISS STEEL: It is just that I thought Mr. Rampton was saying
that Professor Duxbury is immovable and he is down for
27 tomorrow morning, but he is saying he is going to
              call -----
    28
MR. RAMPTON: No. What I am saying is he cannot do any other
    29 day but Wednesday.

30 MISS STEEL: Wednesday is tomorrow.
