Day 015 - 21 Jul 94 - Page 60

1 diet, very careful, you are going to risk your health in
              the long term?
2 A. I think that would be fair comment, and I would say
the same to anybody who decided they wanted to have bacon
3 and eggs for their breakfast every day.

4 Q. I do not know whether you have the defendants bundles?

5 MR. JUSTICE BELL: Is this yellow?

6 MS. STEEL: Blue I think they are.

7 MR. JUSTICE BELL: Statements or exhibit.

8 MS. STEEL: Documents. It is number 75.
              A. Is it volume IIIA?
     9
MR. JUSTICE BELL: It should be bundle III, a blue one: Grazing
    10 in Peckham.
              A. Which tab are we talking about?
    11
         MS. STEEL: 75.
    12
MR. JUSTICE BELL: I would not have thought there would be much
13 grazing in Peckham for a very long time. Maybe I am wrong
              about that.
    14
MR. RAMPTON: I do have to say in relation to this document,
15 the defendants may not understand these things, that
whilst it may be that they are entitled to put a
16 proposition taken from an inadmissible document to a
witness and to ask him whether he agrees with it, they
17 should understand that unless Fiona E.C. Curruthers is to
be called as a witness to prove the facts asserted or the
18 propositions asserted in this document, anything that is
in this document is not evidence.
    19
MS. STEEL: We have a witness coming to talk about this
    20 document.

21 MR. JUSTICE BELL: You need not bother about that at the moment
because you have to preface your question according to
22 whether you are going to call someone to support it or
not. But you ask your question and let us see if there is
    23 anything wrong with it.

24 MS. STEEL: For Mr. Rampton's information, this survey was
conducted by the London Food Commission. Mr. Bob Stein
25 from the London Food Commission is coming to give evidence
              on our behalf.
    26
MR. RAMPTON: That does not help unless Mr. Bob Stein is going
27 to prove the truth of the contents.

28 MR. JUSTICE BELL: Let us have the question first.

29 MS. STEEL: Is Mr. Rampton going to prove the truth of all the
              documents he has produced.
    30
MR. JUSTICE BELL: Ask your question.
