Day 140 - 22 Jun 95 - Page 47

MR. JUSTICE BELL: Just pause for a moment, since I have started
this. (To the witness) Do you recall any concession or
any statement by McDonald's officials that the disparity
shrunk to 11 cents, which is what the third paragraph on
the McDonald's summary of the Towers, etcetera, report said
       it was ---
       A. No, your Honour.

  Q. -- since the raising of the federal minimum?
       A. No, your Honour. I did not speak with this reporter or
anyone from that newspaper, so I have no knowledge of that.

MR. MORRIS: If you go to page 1467 in the other file, the
pink XIV file, number 92 -- yes?
       A. In which file?

  Q. It is the pink XIV file. You have it there somewhere.
       A. Pink XIV?

  Q. Yes. Sorry, before you look at the document -- you have
       not got it open?
       A. No.

  Q. Do you accept that the differential as admitted by the
Company was 22 cents an hour before the survey was done?
       A. Wait a second. The survey that the Company did, the
one that I did, reflected the possibility that it might be
as much as 22 cents. That was the survey that we did. I
am pretty sure we communicated that. So that part, I agree
       with.

  Q. What did it say? If you look at number 92 -----
       A. OK, that is in the pink book XIV?

  Q. Yes.
       A. Yes, sure.

  Q. The fifth point down on that page: "The average suburban
       starting wage....."
       A. Correct.

  Q. "....at McDonald's does not exceed city starting wages by
more than 22 cents per hour"?
       A. That is correct.

  Q. That was part of your survey?
       A. That is correct.

  Q. That looked at actual payrolls?
       A. That is correct.

  Q. Then this report of Towers Perrin Foster & Crosby found out
that they say -- or you say they say -- that the
differential was, on average, 11 cents.
       A. Uh-huh.

  Q. So that would indicate that this was done after the federal
minimum wage raise and had a reduced differential?
       A. They are using -- I am sorry. They were using the same
