Day 254 - 22 May 96 - Page 74
McDonald's to strict proof of them we will not be able to
challenge that evidence in any way". So, if you tick all
those, then we can see what the list looks like then.

MS. STEEL: I do know one document off the top of my head which
definitely I would not agree to being adduced as evidence
unless it was proved, which is the one about where the pigs
were labelled as sheep, or something, whatever it was, the
stunning current, which, as far as I am concerned, is an
extremely fishy document. So that is definitely one.

MR. JUSTICE BELL: What I would like you to do, really as soon
as possible -- it need not all be done in one go, it seems
to me; if it can be done in one go, well and good -- but if
you can start giving information now about some documents
which obviously fall into one category or the other, i.e.
you will be prepared to admit them, or there is no way you
are going to admit them, then at least give that
information. Do that as soon as possible.

One knows from experience that you may not be able to deal
with the whole of the project in one go. But if you begin
to actually work through it you will be able to put ticks,
hopefully not many crosses, but maybe some crosses,
including the documents you have just referred to, and some
question marks against the ones you want to think a bit
more about. But I think it is very important to start
making some progress on that, quite apart from building up
a list of your own documents which you would like to know
whether they are agreed or not. There are one or two.
There was one where you were thinking of calling a witness
a survey and Mr. Rampton said you need not do that because
he was prepared to accept the contents of the survey.

MR. MORRIS: That is Fiona Winter.

MR. JUSTICE BELL: Yes, that is right. I only pick on that
because that is one which happened to stick in my memory.
But, for all I know, there are others upon which you would
get immediate reassurance from the other side that the
contents of that are accepted for the purpose of this
case.

Anyway, think about it overnight. If you can come back
even in the morning, because you have had a look in a
passing 20 minutes at it, with some comments on it -- you
have already made one -- it really would be helpful because
it is of great concern to me, I do not mind saying. You
are probably aware of that from me expressing it in the
past. The last thing we want to do is get into speeches
and find there is some misunderstanding about which
documents are admitted and which ones are not.

We will continue with Mr. Nicholson tomorrow morning. What
time do you want to break off?

MR. MORRIS: What I have asked them to do, and I have got to
check, but let us assume this is OK with them, to meet them
in the morning rather than leave here -----
