Day 245 - 07 May 96 - Page 75
MR. MORRIS: (To the witness): You have seen this leaflet
before, this is an A5 two-sided leaflet?
A. Yes.

Q. You have seen this before, and at the top it has "Outside
Harlow" -- I cannot read the next word -- "25th June '94".
A. It is very faint; I cannot read it.

Q. This is one of your documents. If you note on the second
side, it says, "McLibel trial starts Monday, 27th June" at
the bottom, yes? So this was on the eve of the trial?
A. I am sorry, you are looking where?

Q. Look to the second side; it has at the bottom, "McLibel
trial starts on"?
A. 27th June, yes.

Q. So that seems to be the leaflet that was being circulated
on the eve of the trial around the same time the press
statements were issued, yes, that you issued your press
statements, yes?
A. It could be.

MR. JUSTICE BELL: It is after that, is it not?

MR. MORRIS: It is after that. I will continue to read: "The
leaflets which you circulate at your store continue to be
circulated to all our customers" -- leaflets continue to be
-----
A. I think so, yes.

Q. Yes. This leaflet in front of you, is that the one that
generally gets handed out on the streets around this
country from your knowledge of looking at the bundles of
what has been handed in from different stores?
A. Well, it certainly was handed out. Is it generally?
I do not know. I do not know how to categorize that.

Q. Let us just say it was then. Can you find a single
sentence there in that leaflet on the issues that are in
involved in this case that is not -- that is either untrue
-- sorry, that is untrue and not fair comment?
A. Well, I have not read the whole thing in detail; I am
not a scientist. I cannot tell you much about methane, for
example. As to whether our packaging is unnecessary, I
would dispute that. I think we use just what is necessary;
no more. But I think people are entitled to make comment,
sure.

Q. Is there anything in there which you know as a fact is
untrue?

MR. JUSTICE BELL: Where are we going again now, because -----

MR. MORRIS: It is because just in -----

MR. JUSTICE BELL: It is not helpful to ask an individual person
if he knows it is untrue. I have heard a lot of evidence
and I am going to have to decide whether it is true or
untrue.
