Day 038 - 19 Oct 94 - Page 38

  Q. While we are on -----

MR. JUSTICE BELL: Do not forget, Mr. Morris, that at the end of
the day, as I understood it, looking at pages 5 and then 13
and following of tab 3 of the Extract, what you are seeking
to establish is that "in order to ensure the food looks and
tastes the same, etcetera, the Plaintiffs use a number of
chemical additives in the preparation of their food. 43
were listed. A number of these are believed", that is
amended from "known", "to have undesirable side-effects.
Some of the listed additives are specifically listed by the
Hyperactive Children Support Group as unsuitable for such
       children".

Then a little later on, giving further and better
particulars really of that, you asked for the identity of
each of the additives listed in the booklet published by
the Second Plaintiffs in or around 1989 which are known to
have indesirable side-effects, specifying the said
side-effects, and those listed additives which are alleged
to be unsuitable for hyperactive children. Then the 10 or
so are actually listed with alleged details of the adverse
reactions which it is said that they can cause.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: I am not suggesting that general background
is not relevant to that, but you have to tie it into that
       really.

MR. MORRIS: The last series of questions were going to, if you
were minded to think that because the government -----

MR. JUSTICE BELL: I understand that. What I have put in my own
note is the relevance of this, so that I do not just accept
that they are safe because they have been passed by one of
       these bodies.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: But keep it strictly to that.

MR. MORRIS: Obviously, we would point out that we have not yet
had a chance to amend the pleadings, as you indicated, to
include specific things that may have been missed out, but
are included in the statements that we have. So, we are
still in that sort of vague area where our statements are
taken as part of our pleadings.

MR. JUSTICE BELL: But are you changing the nature of the
       additive allegation?

MR. MORRIS: I do not think so, no, I think the styrene may
       have -----

MR. JUSTICE BELL: Let us leave styrene on one side because
       I understand that.

MR. MORRIS: Yes. There may be a couple of amendments to the
specific effects of particular additives that we have
