9 A. I cannot really tell what the picture is.

11 MR. JUSTICE BELL: Yes, quite. But we have got the same one.

13 MR. MORRIS: We have the same one. This is a McDonald's
14 advert. Is that correct; you remember this one? It is a
15 recent one I think?
16 A. I think I do. I see a lot of this stuff. I do not
17 remember every one of them.

19 Q. I think it is a 1995 advert in the national press. Do you
20 recall it?
21 A. That means nothing, but it has our name at the bottom.
22 I think it is possible we did it, yes.

24 Q. Well, let us assume that you did. We certainly served it
25 and it has not been challenged. I am sure you did do
26 it. "We grew it from seed, we nurtured it, we watered it
27 for 150 days, we looked after it, we harvested it and we
28 still do not know if we can use it." It goes on about you
29 only have the best quality, and this kind of stuff. That
30 is a recognition, is it not, that you are responsible for
31 what suppliers, however far down the chain of supplying,
32 are doing in your name?
33 A. We are responsible for the food that we sell over our
34 counter and operate a system of due diligence, making sure
35 we know as much as we possibly can about what suppliers are
36 doing about our products, as far back as we possibly can,
37 so that I can stand up in places like this and say we did
38 everything we are supposed to have done, yes.

40 Q. OK. Thank you very much. We can put that away now. There
41 was one thing in tab 2, before tab 3 that you were in, in
42 tab 2, that I was going to refer the court to and as we
43 have this out we might as well do it now. It is tab 2, and
44 it is actually the document No 3 in that tab. It should be
45 a document called "McDonald's an the environment".

53 second page under "McDonald's packaging", under
54 "alternative packaging", it says, second paragraph, "in
55 1990 after extensive trials we decided to phase out foam
56 burger packaging completely and by late 1991 all
57 restaurants Australia-wide were wrapping burgers in a new
58 paper wrapping. The paper wraps are generally better for
59 the environment because they require less resources to
60 produce, resulting in less waste and are biodegradable. Is
