     4   MR. MORRIS:   Customer vomited after biting into the burger.
     5        But they won on appeal, which makes no difference, because
     6        the point is they were selling undercooked food likely to
     7        lead to food poisoning.

     9   MS. STEEL:   They won on due diligence.

    11   MR. MORRIS:   Yes, due diligence-negligence kind of line.

    15   MR. MORRIS:   Due diligence, which has no relevance, we think,
    16        in this issue here.  But it is relevant, of course, that
    17        they were selling such a product.

    19        He talked about increasing their burger cooking times twice
    20        in the last five years.  Day 100, page 29.  That memo --
    21        that was the John Atherton memo which I read out earlier --
    22        was brought up on day 100, page 34.  Mr. Kenny said that
    23        the old system had been a particular worry with the Quarter
    24        Pounder.  He said that antibiotics and growth hormones,
    25        McDonald's would not use beef in the UK subjected to
    26        antibiotics or growth hormones because they were "not
    27        desirable" in the food chain.  Day 100, pages 49 and 50.

    29        He also said McDonald's would not want them, pesticide
    30        residues, in the food chain because of health risks.  That
    31        was day 100, pages 50, 53 and 54.  53 and 54, I think, and
    32        then 50 was where we brought up the National Research
    33        Council.  Page 50 on day 100 is where we brought up the
    34        National Research Council report on pesticide residues and
    35        their carcinogenic risk.  Mr. Kenny admitted that the
    36        lettuce used by McDonald's contained pesticide residues,
    37        day 101, page 19.  Right, that is that.  (Pause)

    39        Actually, I have found another interesting bit of
    40        Mr. Kenny.  He was the one who said that twenty seven and a
    41        half million birds were reared by Sun Valley for McDonald's
    42        use each year.  You remember, we were trying to work out
    43        where we had heard that.  Day 101, page 31, line 58.
    44        I think that deals with that.

    46        Actually, there is something that did not come up under
    47        animals specifically, when Helen gave her submissions, but
    48        another reference to Mr. Kenny is that he was questioned
    49        about the matter of chickens being killed without being
    50        properly stunned before slaughter, and dying of ill health
    51        in the broiler sheds, and he recognised that 275,000
    52        chickens per year destined for McDonald's were not properly
    53        stunned before slaughter.  Day 101, page 34 and page 32 is
    54        the dying of ill health questioning.

    56        I think the reference to Mr. Beavers and the milkshake mix
    57        came up on day 125, page 15.  The references about how many
    58        customer complaints McDonald's get, and Mr. Walker, that
    59        McKey gets, were on days 80, page 29, and day 86, page 59.
