Day 019 - 27 Jul 94 - Page 79
1 I cannot at the moment.
2 MR. JUSTICE BELL: Can Mr. Hill find time to look at the
transcript? It would be the beginning or end of the day
3 or beginning of the afternoon session, and wherever a
document is spoken to then deal with it.
4
MS. STEEL: It is not just out of things that are mentioned in
5 the transcripts though, because the thing about the pig
booklet, that had never been mentioned before. We have
6 not got copies. I am not sure when you were given a copy
of it, or anything. I am just a bit concerned that there
7 may be other documents where the same situation has
arisen. Because really there should not be any documents
8 in the trial bundles that have not been disclosed to us
formally anyway.
9
MR. RAMPTON: My Lord, one problem is this -- I repeat myself
10 I know, but I did mean it when I said it. On 26th July
Mr. Morris sent us a letter asking for a copy of the
11 anaemic school girls report. This was in open court
inserted by your Lordship and by the defendants,
12 I suppose, into their bundle on Thursday, 21st July, just
before the mid-day adjournment.
13
MS. STEEL: I am not sure how that helps us with the thing
14 about the pigs.
15 MR. RAMPTON: What I am suggesting is that if the defendants
paid more attention to the documents they are given, they
16 might not find this difficulty. That is an example of
it. We are asked for a document, supposedly missing,
17 which they had five days beforehand.
18 MR. JUSTICE BELL: It seems to me fair to assume that there is
nothing in your bundles or my bundles which is not in the
19 defendants' bundles, save for things which have been
produced to me over the last few days. What I do not know
20 is to what extent documents may have been put in my
bundles which were not on my desk when I came in each
21 morning. None at all.
22 MR. RAMPTON: I do not believe we have been doing that, my
Lord. If Mr. Hill has a moment or two before the end of
23 the case, then I am sure he will check through the
beginning and end of each session in court to see
24 precisely what documents have gone into your Lordship's
bundles.
25
MR. JUSTICE BELL: What happened about the pig brochure?
26
MR. RAMPTON: I believe the defendants have one copy. I have
27 one. Your Lordship has one. I do not know -- the witness
had one and I do not know where it has gone. Your
28 Lordship had two and I believe one of those went to the
witness.
29
MR. JUSTICE BELL: Does Mr. Hill have any reason to believe
30 that you have documents in your bundles or I have
documents in my bundles which are not in the defendants'
