Day 009 - 08 Jul 94 - Page 60
1 partnership itself was unique.
2 Q. But the opening books aspect was unique. Corporations, in
your experience, why are they generally so reticent about
3 making their business practices public, I mean, known.
4 MR. JUSTICE BELL: That is ---
5 MR. MORRIS: I suppose that would not apply.
6 MR. JUSTICE BELL: -- a very general question.
7 MR. MORRIS: That is a very general question. But do you feel
that the opening of the books of the corporation is a good
8 thing?
9 MR. RAMPTON: My Lord, really -----
10 MR. JUSTICE BELL: That is a matter of political philosophy, is
it not, rather than this particular case?
11
MR. MORRIS: The Montreal Convention -- I am quite ignorant on
12 this fact, I do not mind admitting -- did it just suddenly
materialise out of thin air or was there some period of
13 consultation?
A. There was a long period of research that resulted in
14 the Montreol Protocol. The first draft of that was at the
very end of 1987. The exact initiation of all its
15 discussions, I am not in tune to exactly when they
happened. I think, as I said before, the whole CFC issue,
16 I think, came to light in 1985/86, leading to the
scientific research that initiated the Montreol Protocol.
17
Q. But were McDonald's asked for their opinion during the
18 preparations for that?
A. No. We had no contact with anybody involved on that
19 and we would only know what we knew from things in the
newspapers and other journals.
20
Q. Are you quite concerned about the way your packaging is
21 labelled, that it should be accurate?
A. Yes.
22
Q. Are you aware about what happens in other countries as
23 well, about packaging systems and content labelling for
McDonald's?
24 A. I am aware in general terms. I do not know of the
particular rules, regulations and restrictions on
25 labelling in other countries. The regulations that
I spoke to, the guidelines, the FTC guidelines, I spoke of
26 in the United States, are very detailed and in depth.
Very few people understand them in the United States.
27 I do know that there are differences across the world.
28 Q. Just to get straight to the point: Are you aware that in
Australia the Australian Trade Practices Commission
29 ordered McDonald's not to use and reuse advertisements
stating that McDonald's packaging which contained HCFCs
30 was "Ozone friendly"?
A. I am not aware of that.
