Day 084 - 07 Feb 95 - Page 15

       were, just a moment ago.

So, you have made your point, that you argue that in so far
as Mr. Rampton said on a previous occasion that he is
entitled to choose what he sets about establishing to be
untrue, you say: "Well, OK, but you have got to identify
what that is". In due course, I will hear whatever
Mr. Rampton wants to say about that, not now, I suggest,
because it is more important that by 1 o'clock you touch on
as many of these matters as you can.

MS. STEEL: This was going to be the last one we were dealing
       with this morning anyway.

MR. MORRIS: We could deal with the other matters but -----

MR. JUSTICE BELL: There is one thing which occurs to me, and it
entirely depends upon the course Mr. Rampton wants to
follow, but you were anxious about the extent of
admissions. If (and only if) Mr. Rampton would like to
give a thumbnail sketch of his understanding of the law in
relation to that, I would welcome it and you would be able
to hear it, but it is entirely a matter for you,
Mr. Rampton. I am not putting you under any pressure to
       say anything.

MR. RAMPTON: It is fairly straightforward.

MR. JUSTICE BELL: I had a very quick look (and it was a very
quick look) at the authorities in your bundle.

MR. MORRIS: Just before we deal with that, can we just finish
       off the last point?

MR. JUSTICE BELL: Certainly. I thought Ms. Steel had said that
       was it.

MR. MORRIS: Just that the Plaintiffs have identified some parts
of some of the leaflets with orange markings, you may
remember. They have not exactly pleaded those, but they
have identified what they are saying is untrue in some of
the leaflets, but they have not done it with the Fact
       Sheet.

MS. STEEL: They have not done it with any -- in fact, they
have not actually done it properly with any of the
       leaflets.

MR. JUSTICE BELL: I may be misunderstanding completely. The
orange highlightings are not in relation to this leaflet.
They may well indirectly point you to allegations in this
leaflet in that they are expressed in identical or similar
       terms in the other leaflets.

MS. STEEL: I do not know. I am not sure what Dave is trying
       to say.

MR. MORRIS: The point is they should say in the Fact Sheet what
       they are saying is untrue.
