Day 002 - 30 Jun 94 - Page 59

1 paper in front of you within a day or two anyway. We are
going to find that things will change anyway because, as
2 I have said, we may go a little faster or a little slower
than the schedule. So nothing can be written in stone.
     3
MISS STEEL: We could probably do the packaging one, you said
4 within a day or so?

5 MR. JUSTICE BELL: I said I would like you to do your best to
do that either tomorrow evening or Friday morning.
     6
MISS STEEL: Right. I mean, as far as nutrition goes, can we
7 leave it a little bit longer, at least to the weekend?

8 MR. JUSTICE BELL: I suggested about the middle of next week.
If you think are you running into difficulty on that next
9 Monday or Tuesday let me know and we will discuss it
              again.
    10
MR. RAMPTON: So long as I do not have the information I shall
11 continue o raise it because it does obviously affect the
way in which this case is progressed.
    12
MR. JUSTICE BELL: The other matter is the question of "Jungle
13 Burger", Civil Evidence Act notices.

14 MISS STEEL: We do intend to serve Civil Evidence Act Notice on
that. I am almost certain that Mr. Heller says he has the
15 original uncut statements and the tape in his possession,
and that he was willing to bring it to the court. I note
16 that Mr. Rampton says that where you get a short
transcript of little pieces of what is being said, can be
17 an inaccurate picture. It is a shame he does not apply
that to his own documents where we only get certain parts
18 of them. Anyway, we will contact Mr. Heller and ask him
to make them available as soon possible.
    19
MR. MORRIS: We have disclosed not only the transcript of the
20 film but the original uncut interviews which have been
referred to in court in the last few months. Can we just
21 say now that we want a Civil Evidence Act notice put on
              the film?
    22
MR. JUSTICE BELL: What you have to do because this is -----
    23
MR. RAMPTON: My Lord, it is rainforest.
    24
MR. JUSTICE BELL: I am looking at how you titled it. It is
    25 "Environment".

26 MR. RAMPTON: Yes, I am sorry. I called it "rainforest" in the
              opening.
    27
MR. JUSTICE BELL: So at the moment we are looking at the
    28 middle of November.

29 MR. RAMPTON: Yes, that is right.

30 MR. JUSTICE BELL: What you have to do, and you have some time
to do it, it is no use just slapping a Civil Evidence Act
