Day 295 - 06 Nov 96 - Page 23
with 'Belgium, Belgium, Denmark, Denmark, Holland', et
cetera.

MR. MORRIS: Right. That is one of them. There should be two
other pages as well.

MR. JUSTICE BELL: Yes, there are. 'Finished product, No 6,
Scunthorpe' with a one in the top right hand corner, and
'Finished product tested during period 2.1.92 to 8.1.92'.

MR. MORRIS: This is the document which -- we had challenged
Mr. Walker from McKeys about the finished product testing.
He said that the final batches waiting for delivery, they
would take one patty, I think, out of every box to test,
and these were the only documents which were disclosed
after he left the witness box. And they came with those
letters of March 1995, explaining what they were. Document
9 is said to be finished product summary sheet for the
period including 12th January 1994, and the other letter,
23rd March 1995, says, "We have asked McKeys to provide the
relevant ledger sheets for finished products in the first
week of January 1992. If, when they became available, they
will be disclosed." I think these were the ones that were
finally disclosed, the ledger sheets for 10 and 11.

But anyway, the point being that rather than have thousands
of results of tested patties, it appears -- and I did make
this point at the time when we got them, I can't remember
what day it was it was brought up in court -- that they
only test one patty from a consignment destined for a
single client at a time. So, for example, if you look at
the production dates on page 10, which is the finished
product Scunthorpe document... If we note on that
document, not every day has a result.

MR. JUSTICE BELL: If you are distracted just let me know,
Mr. Morris.

MR. MORRIS: That is fine, yes. There is only one result per
day in general anyway, for consignments from the Scunthorpe
plant. And if we look at the -----

MR. JUSTICE BELL: What are you looking at?

MR. MORRIS: This is the Scunthorpe.

MR. JUSTICE BELL: This is the Scunthorpe page, is it?

MR. MORRIS: Yes. I mean, you can, you know, look at these
documents.

MR. JUSTICE BELL: Yes, I want to make sure that I understand
what you are saying about it.

MR. MORRIS: This is the evidence that was said would be
provided to show the finished products testing system and,
as I had thought at the time and turned out to be backed up
by these documents, that they seem to test one patty per
consignment per customer.
