Day 198 - 08 Dec 95 - Page 38

MR. JUSTICE BELL: I will leave it there then, new stores. My
main concern is to know where we have, effectively, closed
the evidence in relation to certain of the stores I am
familiar with and where we have got more to come, so that
I can get a measure of how much more is to come. So I will
not put you on the spot about that.

  MR. MORRIS: Thank you.

MR. JUSTICE BELL: Is there anything else?

MR. MORRIS: I do not think so, no.

MR. RAMPTON: My Lord, on the list I have not heard anything
about Joanne Bishop, who is number 1, and I have not heard
anything about Dan Gallin, who is number 9 of the Civil
       Evidence Act statements.

MS. STEEL: We have read Dan Gallin.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: Sorry, I forgot; but Joanne Bishop is an
       unanswered question.

MR. JUSTICE BELL: Do you know what the position is with regard
       to her?

MR. MORRIS: We have not actually spoken to her for an enormous
       length of time.

MR. JUSTICE BELL: You are still hoping to call her, are you?

MR. MORRIS: We are going to have a discussion with her and then
we will let the court know.

MR. RAMPTON: My Lord, all I would say about all of this really
is, at this stage of the case, we have been hearing
employment evidence since, I think, April.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: If Mr. Morris and Ms. Steel think that it is open
to them at any time before judgment, as it were, to keep
feeding employment witnesses into the picture, whatever
other matters we may be dealing with by then -- in
particular, rainforest and publication -- I would certainly
have something very strong to say about it.

MR. JUSTICE BELL: I think we should just leave that because the
two potential witnesses may come to nothing. If they do
appear, I will really have to look and see whether what
they have to say is going to advance the matter or not and
       give leave or not accordingly.

MR. RAMPTON: That I understand, my Lord, but we have question
marks against Mr. Patel, Mr. Townsend, who we have earlier
been told is not being called.
