Day 246 - 09 May 96 - Page 53

       A. I do not remember it going astray. I cannot
remember being particularly concerned about it. It asked,
I think, internally some questions that we thought others
       might be asked.

  Q. Such as fact that hospital customers might be more
sensitive to nutrition so that you more likely to introduce
test products such as pizzas, salads and apple bran
       muffins?
       A. The restaurant itself in its location is situated such
that it is not really designed for patients. Patients
I suppose can use it. It is an inside/outside location
visible from I think the platforms or very near the
platforms at one of London's prime train stations, a lot of
passing foot traffic. Members of the public use it just as
they do in all of our other restaurants. There are other
people, other employees of the hospital who use it and I am
happy to say they use it in big numbers.

  Q. Yes. Do you remember a concern that because of its
location within a hospital customers might be more
sensitive to nutrition and therefore you needed to make
healthier options available than those traditionally?
       A. No.

  Q. In your normal restaurant?
       A. I would have looked on it as a location to maybe try
some unusual things because it was a kind of a one-off at
       the time.

  Q. Do you mean try some unusual food products?
       A. Try some things that have been done around the world.
We have a breakfast programme here in Britain which is
       quite small.

MR. JUSTICE BELL: I want you to pause there because if you have
a point to make on this, I would really like you to put it
straight to Mr. Preston. He may agree with you. If he
does not, we can see whether it is relevant to pursue it.

MS. STEEL: I will deal with the final paragraph.

  MR. JUSTICE BELL: Yes.

MS. STEEL: Which says about the memo being a draft and the
fact that it left unanswered some of the more tricky
questions, for example, one linking the fat rate in
McDonald's food to heart disease, and another asking
simply: "Is not McDonald's just junk food"? Do you
       remember that?
       A. I have been asked the last question the: "Is not
McDonald's just junk food" 10,000 times. That is not novel
and it certainly is not difficult to answer.

MR. JUSTICE BELL: I do not want you to answer it.
       A. My Lord.

  Q. I cannot decide this case on whether people are concerned
about this or not. Their concern may be well founded; it
may be ill founded. If there is something to be got from
