Day 017 - 25 Jul 94 - Page 70

MR. JUSTICE BELL: How long do you expect he will take
2 in-chief, Mr. Rampton?
3 MR. RAMPTON: I would hope I can take him in-chief quite
shortly. I do not believe that I will refer to more than
4 one of the references. I am really concerned with the
broad picture of what he observed when he went to visit
5 the establishment operated by McDonald's suppliers.
I would hope that -- I said it before and I was about
6 right today -- he will be a good deal shorter in-chief
than Dr. Arnott. I may finish him before the mid-day
7 adjournment in-chief. Certainly, the defendants should be
prepared to start cross-examining him tomorrow.
8
MR. JUSTICE BELL: Right. Is there anything else we have to
9 deal with? The others matters I have on my check list is
sometime this week and preferably not on Friday ------
10
MR. RAMPTON: I am sorry, I do not mean to interrupt, but
11 I should say that what your Lordship does not know is that
Professor Wheelock is coming back on Friday -- Professor
12 Wheelock, you remember, the nutritionist -- he is coming
back to finish his cross-examination. I am told by the
13 defendants that it is 99 per cent certain that they will
not go beyond the end of the morning, in which case I will
14 have about half an hour or so re-examination.
15 MR. MORRIS: No. We said that Mr. Wheelock should be finished
within a day. We were given the indication that the
16 plaintiffs wanted an hour for re-examination. That should
be no problem, as far as I can see.
17
MR. JUSTICE BELL: NO. The only thing which crosses my mind is
18 obviously we want to be as certain as one can that
Professor Wheelock finishes before the break.
19
MR. RAMPTON: Unless Dr. Gregory is going to be extended into a
20 third day, Thursday will be a short day because I have
only Professor Ashworth -- the Tidy Britain person -- that
21 day.
22 MR. JUSTICE BELL: My only question, really, is -- does that
mean that Professor Wheelock can only come on Friday?
23
MR. RAMPTON: Yes, I believe it does.
24
MR. JUSTICE BELL: What was passing through my mind is in case
25 we were ready to start him on Thursday afternoon, that
would make any risk of not finishing him by -----
26
MR. RAMPTON: No, the trouble he has got a domestic problem.
27
MR. JUSTICE BELL: I do not need to know about that. It is
28 obvious there is a difficulty.
29 MR. RAMPTON: There is a difficulty, yes.
30 MR. JUSTICE BELL: We will go on with Dr. Gregory tomorrow. To
continue what I was about to say, there is the question of
