4 Q. Then if you turn a couple of pages on from that there is a
5 new style pay slip dated 21st February 1987?
6 A. Yes.

8 Q. The hours there total almost 80 hours, do you see that, the
9 bottom one on the page?
10 A. Oh, the bottom one -- sorry. 79, yes, that is right,
11 yes, 80 hours.

13 Q. The following page the first pay slip, the one for
14 7th March 1987, totals 87.24 hours?
15 A. Yes.

17 Q. The one below that would come to, I think, just over ---
18 A. 77 thereabouts, 77, 78.

20 Q. -- about 78. All these instances of working more than 78
21 hours in a fortnight do not surprise you at all? Would you
22 think there is something wrong, going wrong?
23 A. Well, if that had been drawn to my attention, I would
24 have made enquiries of why he was working those hours.
25 Now, there could be many answers to that. He may be
26 someone who, I do not know how old he is -- no, it does not
27 say how old he is -- I mean, if he is an adult man, say,
28 over 21 years of age, he may have indicated that if they
29 wanted overtime he would be prepared to work it. For all
30 I know, in that store he may be the only person working
31 overtime.

33 Q. But you said it was a ----
34 A. So I would make enquiries.

36 Q. You said it was a rare occurrence that people worked more
37 than 39 hours?
38 A. Yes.

40 Q. Yes this is happening regularly to this individual?
41 A. To this man, sure. I am not doubting that there is the
42 odd individual, but I am saying if that had been brought to
43 my attention I would have asked questions.

45 Q. Then what would you have done about it?
46 A. It depends. It depends on what the circumstances were,
47 and I kind of hazard a guess as to what the circumstances
48 are in this case.

50 MR. RAMPTON: I can tell your Lordship that when he signed a
51 statement on 25th March 1988 he said that he was 32 years
52 old.

54 THE WITNESS: Well, you know, I mean, I would not approve of
55 that, but if he has indicated that he wants to, and he is
56 32 years old, and the manager has particular problems in
57 that store, that is who I would use to do my overtime.

59 MS. STEEL: So, it is not a problem if staff over 21 want to
60 work overtime or if they are doing overtime, it is not a
