Day 245 - 07 May 96 - Page 24

have been produced with no immediate end to the trial in
       sight.

Preston says: 'We went to the High Court after ten years of
trying to get this thing sorted out more amicably. We went
to do only one thing: Establish the truth. We wanted to
show that this leaflet is entirely baseless. The papers
have tried to make this into a David and Goliath thing. It
       is not big versus small."

The quote that is attributed to you there, is that a
       correct quote?
       A. Yes.

  Q. So you said to The times that you went to the High Court
after ten years of trying to get this thing sorted out more
       amicably?
       A. Yes.

  Q. And you had absolutely no personal knowledge that that was
       true?
       A. I dispute that, for sure. This leaflet had been
distributed around the world by your own admission and you
in your own publications. By "we", I do not necessarily
me, Paul Preston, or "we", McDonald's in Britain. I mean
around the world when these leaflets circulated, whether it
be New Zealand, or Australia, or Canada, or the United
States. People attempted to get to the route of what they
were about, make contact with the organisation, were not
able to do so, so, for sure, over ten years this was dealt
with on one level or another by many people.

  Q. Yes, but the implication is that you are trying to get the
thing sorted out amicably with London Greenpeace not with
various groups that are around the world printing out
different leaflets or similar leaflets whatever. The
implication is that you tried to sort it out with London
Greenpeace for ten years before you took any action to
       bring this case?
       A. Well, I do not read that into it but it is your
       opinion.

  Q. It is a lie, is it not?
       A. No, it is not.

  Q. If you turn to the second tab -- sorry, you have not got
tabs, but if you turn to No. 2 in the bundle.

MR. JUSTICE BELL: Is this on the same point or a different
       one?

  MS. STEEL: The same point.

(To the witness): This is a leaflet which was distributed
in your stores, was it not?
       A. It was printed with the intent of giving it out to
customers who asked questions about the court action. Some
stores put it in their "Did You Know Boards" for general
dissemination. I think each store was given about 500
       copies, yes.
