Day 012 - 18 Jul 94 - Page 08

     1
         Q. Was there a time when, in fact, it was distributed
     2 throughout the whole nation?
              A. That is correct. That happened approximately at the
3 beginning of August of that year.

4 Q. It may be suggested to you, Mr. Horwitz -- I would like
your reaction to this -- that the only reason that
5 McDonald's decided to prepare and publish a booklet of
this nature is they were being lent on a bit by the
6 Attorney General of the State of New York; is that right?
              A. That is incorrect.
     7
         Q. Can you turn, please, now onwards in this file to tab 9B?
     8 A. Yes, I have that.

9 Q. It is not, I am afraid, a good copy. At the top left hand
of the copy it appears to come from the Department of
10 Justice of the State of California. The Attorney General
for California at that time was a gentleman called John
    11 van de Kemp?
              A. That is correct.
    12
         Q. His deputy called either Albert or Norman Shelden?
    13 A. That is correct.

14 Q. You will see it is written to Richard Cotton at Dewey
Ballantine Bushby Palmer & Wood. Can I call then Dewey
    15 Ballantine for short?
              A. Yes.
    16
         Q. Are they attorneys in Washington DC?
17 A. Yes, they are attorneys in Washington.

    18 Q. They were in 1986 McDonald's attorneys?
              A. That is correct.
    19
         Q. Do they have an office in New York?
    20 A. Yes, they do.

21 Q. Can you see the date? It looks like June 3rd 1986?
              A. My copy is poor. It certainly is June with a single
    22 digit, 1986.

23 MR. JUSTICE BELL: What date do you think it is?

24 MR. RAMPTON: My Lord, I thought it might be the 3rd.

25 MS STEEL: There is a better copy.

26 MR. RAMPTON: Yes. I have a better copy. It is June the 3rd.
If you have a pen, Mr. Horwitz, do you think you could
27 fill that in so that if anybody wants to refer to it in
the future they can read it?
    28 A. June 3rd, yes, I have done that.

29 Q. Thank you very much. You will see that it is written not
simply on behalf of the Attorney General for California
30 but also, apparently, on behalf of the Attorney General
              for Texas?
