Day 203 - 12 Jan 96 - Page 49
what you are saying, could it look good on Sally if she has
achieved the targeted labour figures on her shift and the
other responsibilities that she has to perform. Quite
clearly, yes. That is a Manager performing their job
well. But I do not understand the other point you are
making.

Q. The point is this: the change was not made. Let me just
find the document which I have. Perhaps I could be
reminded whether they are just for one day only, the clock
cards?

MR. RAMPTON: Yes, they are.

MR. JUSTICE BELL: They are.

MR. RAMPTON: Some of the documents are dated the 29th, but in
fact they all relate to the 28th.

MR. JUSTICE BELL: Thank you. (To the witness): What you are
saying is, is it, that if someone in charge of the
restaurant on 28th November fiddled the returns so that it
looked as if less hours had been worked, that might reflect
well on them because they had been in charge that day; is
that what you are saying?
A. That is possible.

MS. STEEL: I just wanted to ask about -- you said that after
you investigated it, you reimbursed the crew in full. Was
that authorised from above, or is that something you did
off your own bat?
A. As far as I am concerned, it did not need
authorisation; it was an obligation that we as a Company
had, and it was my responsibility to do that. However,
I did of course tell John Atherton what the cost was and
what was going on.

Q. Right.
A. Because, quite clearly, this would affect the monthly
labour percentage, as well.

Q. Was some kind of a report made about this incident?
A. I took copious notes and statements from the people
I interviewed, and I actually got them to sign the
statements, to be honest with you. In terms of a report
concerning the whole incident, I never completed the report
about the whole incident, that is for sure.

Q. You phoned Human Relations to ask them for advice on what
to do -- Human Resources, sorry?
A. Yes.

Q. To ask them for advice on what to do. Did they not ask you
to report back to them on what had happened and, you know,
the reasons for it and how it could be prevented from
happening again?
A. At the end of the day, it is me that makes -- it is the
Supervisor that makes the decision, and the Human Resources
Department give guidance and advice. I do not recall them
having said, "Keep us informed", but we would have
