Day 003 - 30 Jun 94 - Page 42

     1
         Q. So in each part of your training operation or information
2 dissemination, there is one of these policies, is that
              right?
3 A. Yes, that is correct.

4 Q. If you turn over two pages you find the new policy?
              A. Yes.
     5
         Q. "Sexual harassment is unwanted behaviour of a sexual nature
6 by one employee towards another; racial harassment is
unwanted behaviour of a racial nature by one employee
7 towards another." Then it sets out a number of other
requirements or policy statements about sexual or racial
8 harassment. Over the page, this is for the employee
handbook: "Equal opportunity employment", do you see
     9 that?
              A. I do, Sir.
    10
         Q. "McDonald's is an equal opportunity employer". Again I am
11 not going to read it now. It would be a wearisome
business. Is McDonald's an equal opportunity employer?
    12 A. Absolutely.

13 Q. That runs to several pages. So does the next document and
the one after that. Please turn over to tab 10A, can you
14 tell us -- if you cannot somebody else will -- what these
documents represent? The first one somebody has written
15 "For employee handbook" at the top. Have you any idea
what the dates of these are by looking at them?
16 A. Well, they could be very recent but we have had
something like this in place for years. But the basic
17 words really have not changed.

18 Q. That is what I was going to ask you. I was going to ask
you, how long a policy of this kind had been in place?
19 A. It started with me in 1964.

20 Q. When do you, roughly speaking, think it was first produced
              to writing?
21 A. Probably in the late 1960s I would think in the US.

22 Q. You see that in addition to the two which are for the
employee and crew handbook there is one in the middle
23 headed "For crew notice board". That is in the
restaurant, is it, the crew notice board?
24 A. Yes. The crew notice board would be in every
              restaurant, yes.
    25
         Q. Now I pass briefly, my Lord, as a matter of fact since my
26 next topic is the rainforests, about which I must take a
little bit of time but not a long time----
    27
MR. JUSTICE BELL: It would be convenient to pause there.
    28
MR. RAMPTON: My Lord, yes, with this in mind. Mr. Beavers,
29 who must go back to America on Saturday, should be
interposed and Mr. Preston then can follow, if that is
    30 convenient.
