Day 246 - 09 May 96 - Page 69

I think he is available to come after Professor Naismith in
the week beginning 20th May. Mrs. Brinley-Codd hopes to
speak to him again tomorrow morning. I think Mr. Hill has
spoken to him. But he has been sent the relevant part of
Dr. Naismith's statement. He says he is familiar with the
new material anyway. So it should not take very long for
       him to do a statement.

MR. JUSTICE BELL: No. I, obviously, do not need to stress that
time is important, because the sooner the witnesses can
come in the better and some notice has to be given. For
the time being, I advise you to treat what is in Professor
Naismith's report, giving what he says is an update in
relation to cancer, as some indication of what Dr. Arnott
may say, because it may turn out to be so.

MR. RAMPTON: My understanding is that it is more than some
indication; it is a pretty fair indication of what
       Dr. Arnott will say.

MR. JUSTICE BELL: Yes. Treat it as that, but you will get a
       statement in due course.

MR. RAMPTON: It is fair warning, but there will be a statement
       in due course.

There is only one other matter I need to mention. We
originally fixed Denise Pearce as our first witness on
Monday, 10th June, my Lord, to be followed immediately by
the publication witnesses. Whether Mr. Nicholson has
already given evidence by then, of course, rather depends
on what else happens in the meantime.

MR. JUSTICE BELL: Is Miss Pearce confirmed for that day?

MR. RAMPTON: Yes, she is, my Lord. She can only manage Mondays
and Fridays. She cannot do the 17th.

MR. JUSTICE BELL: There need not be any further explanation.

  MR. RAMPTON: No.

MR. JUSTICE BELL: (To the Defendants): Have you managed to
       make contact with Professor Crawford?

  MR. MORRIS: He is confirmed.

MS. STEEL: Actually, I did speak to him, but I have not spoken
to him to definitely confirm it. I will chase that up.
But I did speak to him before and he did say that those
dates should be all right. So, hopefully .....

MR. MORRIS: That is the 18th.

MS. STEEL: It is a matter of confirming the 18th, yes.

  MR. JUSTICE BELL: Of?

MS. STEEL: We have provisionally listed him for the 18th and
       19th.
