Day 060 - 02 Dec 94 - Page 35

Q. Do you think that is a very likely scenario?
A. It may be, I do not know.

Q. You see, you have said that the company in this country
prefers polystyrene packaging because it keeps the product
fresher?
A. And hotter.

Q. Yes, but one of them is fresher?
A. One is fresher.

Q. I put it to you that people are not going to keep the
products for long enough before they eat them for that to
actually make much difference?
A. Well, you can put it to me.

Q. You would not accept it?
A. No, because everybody is different.

Q. So do you think that a lot of people actually keep their
burgers for a long time before they eat them?
A. I do not know.

Q. You do not know?
A. I have answered you.

Q. The same point applies to heat, does it not, although less
so, but in terms of in the restaurant, it is highly likely,
is it not, that the vast majority of customers are going to
get their burger, sit down at the table and eat it there
and then?
A. I would not agree with you. The same point applies to
heat but more so, not less so. If you serve a hotter
product, it is going to stay hotter longer after the
customer has purchased the product.

Q. I think we are at cross-purposes on more so and less so.
I meant that ----
A. What did you mean?

MR. JUSTICE BELL: Is what you are trying to put that, granted
that the reasons Mr. Oakley has given for sticking with
clam shells for certain products apply to take away, they
do not apply, you would suggest, if the purchaser is going
to eat them in the restaurant, and so you could have a
different packaging. For instance, for a Big Mac according
to whether it is going to be taken away or eaten there, is
that what you are getting at?

MS. STEEL: Not exactly, because I would not actually accept
that they could not manage without foam for take-aways
either, but particularly in the case of in-store eating,
customers could actually manage perfectly well without foam
packaging, could they not?
A. No.

Q. You do not think so?
A. No.
