Day 095 - 02 Mar 95 - Page 14
that. They move for, the reaction, it is probably at the
max five seconds. The use of prods has been used and
studied and accepted as an animal welfare practice, so I do
not see a problem with it.

Q. You would accept that they obviously do not like it because
otherwise they would not move, would they?
A. They do not move because they do not understand that
they have to move. They are not aware of what is ahead or
what is behind. They do not move because that is their
nature. They do not know. We do not communicate with
animals as well as we would like to.

Q. If they enjoyed it, if they enjoyed being prodded, they
would stay still, would they not? They would not move away
from the goad.

MR. JUSTICE BELL: Do not worry about it. The one thing this
leaflet does not say is that animals do not enjoy this or
do not enjoy that. It is in much more positive terms, is
it not. You have to focus in on that.

To some extent I should use my ordinary judgment, but I am
obviously going to have to consider at the end of the day
what a variety of witnesses have said about animals'
reaction to various stimuli and the extent to which we, as
people, can judge the effect of that in animals. It says
in the paragraph higher up, it obviously countenances the
use of electric prods but said they should be used
sparingly to move livestock?
A. That is correct.

Q. That is a sound principle, is it?
A. That is correct. We do not want to -- anything in
abuse obviously is wrong.

MS. STEEL: I asked you the other day about whether battery
chickens were -----
A. Are we done with this?

Q. Yes, we are, sorry.

MS. STEEL: Can I just say so that the court knows what is going
on, we are kind of finishing off loose ends. There is a
video that I want to show later on.

MR. JUSTICE BELL: How long will that take?

MS. STEEL: It is half an hour long, the part I want to show
but.

MR. RAMPTON: Wait a minute, what video is this?

MS. STEEL: It has been disclosed.

MR. JUSTICE BELL: Wait a minute, Mr. Rampton. We cannot all
questions of the same person. Yes. Have you shown it
to ------

MS. STEEL: The Plaintiffs have a copy of it. We have not many
