Day 030 - 03 Oct 94 - Page 52

morning. At some stage before you do go away, whether
that is this afternoon or tomorrow morning, I do not know,
we will have to ask you how we can best get hold of
copies. You have obviously brought your own. You
obviously need those for your every day work, presumably?

  THE WITNESS: Yes.

MR. JUSTICE BELL: You are referring to them all the time in
       various contexts?
       A. Indeed, but besides I think the best course when the
whole documents are needed is the relevant number of
copies to produce rather than ------

MR. JUSTICE BELL: Yes, let us see.

MR. MORRIS: Is there anything else in those extracts you would
like us like to tell the court?
       A. No, particularly bearing in mind Mr. Rampton's point,
which I think is right, but I would say that in
considering documents, particularly rather vast documents
like this, my own opinion is that what is salient to this
case is not the general text of the documents but their
general conclusions. That is where the judgments are to
be found. Sometimes these are conveniently called
"Executive Summary" or some such; in other cases, they
       are clearly labelled "Recommendations".

  Q. Is there anything on the page which you asked us to copy
for the court? Everybody has copies of the pages that you
have there extracted, 2, 3, then the final -- I cannot
read the number, the tables at the back?
       A. You are still talking about the Surgeon General's
Report? Yes, again, pages 192 to 3.

MR. RAMPTON: My Lord, I am afraid this will not do. We have
only been supplied with the front page which has, I take
it, Mr. Cannon's handwriting "guidelines 1988", it is
The Surgeon General's Report on Nutrition and Health, and
then the forward by Otis Bowen MD who is the Secretary.

  MR. MORRIS: Four pages?

  MR. RAMPTON: No, two pages.

MR. JUSTICE BELL: Can someone help Mr. Rampton? Do you have
       the original there?

THE WITNESS: Yes, indeed. (Handed) Can you stick to the
photocopy for the moment because you are only being asked
if there is anything in you left hand which you want to
       refer to.

THE WITNESS: But the other thing to refer to, as I have
already mentioned, is also included in a different form in
the WHO Report in 1990, is simply a statement. This is
table 4, 5 on page 192 of what the National Cancer
       Institute Dietary Guidelines are, as issued in 1988;
dietary guidelines to reduce the risk of cancer.
