2 statement, is it not?

4 MR. MORRIS: The only thing she says was work hours were cut.
5 (To the witness): You do not know why "unilaterally" was
6 put there or -----

8 MR. JUSTICE BELL: I must say, I had read it as if they were cut
9 by McDonald's which is unilaterally. If that is not what
10 she meant, I cannot see any point in putting it in her
11 statement.

13 MR. MORRIS: Can you say why you wrote in your statement that
14 the work hours were not cut unilaterally, or is it not a
15 word that you would normally use?
16 A. It is not a word I normally use, but from what Sarah
17 was saying, like, from Sarah's statement, what I got was
18 that hours were cut when Cam came in -- period -- not that
19 hours, like, there was a purpose to the reason why the
20 hours were cut.

22 Q. So they were cut but there were reasons for it?
23 A. Right, and I mean I got about this, like, when I first
24 started there, because -- I guess because I was new I did
25 not get very many hours at McDonald's with Mr. Tingley
26 there, but as I became more experienced and I had learned
27 more stations I got more hours, so I mean work hours were
28 cut, period.

30 Q. They just applied to everybody?
31 A. I am not -- well, to the night staff. I mean, from
32 what I know of, the night staff hours get cut from summer
33 to winter, you know. They get cut in from seasons or they
34 get added with the seasons. It is just depends on what
35 time of the year it is and how busy it is. There is a
36 purpose to it. I mean, we do not just -- McDonald's does
37 not just stick anybody in for any shift and then take them
38 out for -- they base it on how many people, like, if it is
39 going to be a busy day or not and that is how they schedule
40 their people.

42 Q. In 41 you said: "Rates were not depressed artificially".
43 Were rates depressed then in some other way?
44 A. Not that I know of, they -----

46 Q. Did some people get lower rates as a result of the change
47 over of -----
48 A. No, not that I know of. As far as I know, nobody got a
49 pay cut and the day staff were still receiving the hours
50 that they were getting under Mr. Tingley, but I mean this
51 is just -- I mean, I was working at night and I was in
52 school during the day, so I never saw the day ladies. You
53 know, I cannot compare with the day ladies' work and how
54 many hours they got when Mr. Tingley was there and when Cam
55 was there, because I never, I was never working with them.
56 I did not know how many hours they were getting. I could
57 tell you now because I do work with them, but I cannot tell
58 you about before because I never did work with them. As
59 far as I know, no pay cuts were made, period.
