Day 270 - 28 Jun 96 - Page 59

MR. JUSTICE BELL: Bear in mind what I have said, because even
if it seems fair or unfair on one side or the other, it is
just going to have to be done out of pure expedience.

MR. MORRIS: Well, Mr. Morganti only very recently sent over his
       letter.

MR. JUSTICE BELL: I am not making any comment on whether you
should be allowed to put in statements before I say that is
it. But when I do say that is it, it will be it. It is
directed at your side as well, Mr. Atkinson. If something
cropped up after I had said that is the evidence, it would
       be just too bad.

MR. ATKINSON: I am not going to enter the argument, my Lord. I
just wanted to say that just because Mr. Morris has given
notice of this does not mean that because we are not making
an objection now, which would be silly not having seen it,
we may not make an objection later.

MR. JUSTICE BELL: The important thing is to serve any further
statements as soon as possible. If when you say "now I
would like to read them" there is an objection, I will hear
       it and rule on it.

MS. STEEL: I cannot actually remember this, but I thought that
some time ago the Plaintiffs said something about two more
statements or something. I cannot remember.

MR. JUSTICE BELL: I am not going to say anything which
encourages anyone to introduce more evidence. I have just
taken what Mr. Morris has said as the cue to let everyone
know that a time is going to come pretty soon when that
will be the end of the evidence.

MR. MORRIS: It will be a strategy, I should think. There are
two things. I should say Professor Susanna Hecht when I
mentioned her name. And secondly, can I just say, in
parting, that this morning when I asked the witness about
whether leaflets or whether material that me or Ms. Steel
had distributed, whether we believed it was accurate,
whether or not we distributed it or not, Mr. Rampton
muttered something like "Ah, got him now". I was not
referring, of course, to McDonald's information. I was
referring to the question I put to her about the general
belief by the group in what they were distributing.

MR. JUSTICE BELL: I did not hear Mr. Rampton mutter anything.

MR. MORRIS: No. Just in case he wants to bring it up as some
       brilliant admission by me.

MR. JUSTICE BELL: Do you have anything more to read this
       afternoon?

MR. MORRIS: No, I have nothing more to read. I just thought I
would mention that so it is clear on the transcript.

MR. JUSTICE BELL: On your Civil Evidence Act list I have made a
note that you are going to look for the ads referred to by
