MR. JUSTICE BELL: I thought you said Atkinson and I looked
through the front of my yellow X and did not find him.

MR. RAMPTON: Yes, he is 39B, my Lord, in yellow X. I hope your
       Lordship has a copy?

MR. JUSTICE BELL: I have got Duncan Paulson and I then go to
       Sean Richards who is 39C.

MR. RAMPTON: Your Lordship ought to have and no doubt, I hope,
had at one time Ms. Antenni's statement. She was 39A. She
has already given evidence. There ought to be James
       Atkinson as well.

MR. JUSTICE BELL: She is 42.

MR. JUSTICE BELL: I have Duncan Paulson as 39. Then I go to
Sean Richards and Rose French. Can I have, if they are not
marked, either Mr. Hill's or Mr. Atkinson's copy, then they
can have theirs replaced. I will just put it in.

MR. RAMPTON: I have a clean copy but I would like to keep that,
if I may. My Lord, there is an unsigned copy. (Handed)
My Lord, he was Manager at Marble Arch restaurant in the
mid 1990s, I think, when one of the Defendants' witnesses
under the Civil Evidence Act, Mr. Nicholas McGill, worked
       there.

My Lord, there are a couple of applications which I have to
make. One I do not think is more than a sentence which is
to ask again for the Defendants' discovery on the
counterclaim -- maybe it has already been done but if so, I
do not know -- which is the subject of an order now out of
       time.

MR. JUSTICE BELL: What is the position in relation to that?

MS. STEEL: I have got it here actually. I have just forgotten
       to give it to them.

MR. JUSTICE BELL: If you have it -- do not bother with it now
-- what I suggest is when I rise you give it to Mr. Hill.

  MS. STEEL: Yes, OK.

MR. RAMPTON: My Lord, the other thing I have to mention at some
stage, whether this evening or not, I do not mind -- it is
entirely a matter for your Lordship -- is the question of
the transcripts of the uncut interviews of the people,
McDonald's people and others, who whether interviewed for
the film One Every Mile. Your Lordship remembers that it
arose at the end of last term. I made an application for
discovery of those transcripts at that time which were then
in the possession of Mr. Morris.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: He said he felt embarrassment about it because he
had given an undertaking, some kind of undertaking, of
