3 MR. MORRIS: I do not want to say that any of our witnesses are
4 more important than other witnesses. Dr. Millstone has
5 been moved around quite dramatically. The last time it
6 was because Professor Ashworth was absolutely fixed and
7 nothing could possibly change it.

9 MR. JUSTICE BELL: Let us pencil Professor Crawford in for
10 Tuesday the 18th. If he has not finished by a quarter to
11 4 we will then take stock as to what to do about that.
12 Keep Dr. Millstone for Wednesday the 19th.

14 MR. MORRIS: I cannot remember what we agreed about Geoffrey

17 MR. JUSTICE BELL: I suggested to him that it would be helpful
18 if he could come back again towards the back end of the
19 week beginning Monday, 17th October. He said he would
20 look at his diary and let us know. Does the query mean
21 that it is suggested he should come back on Thursday the
22 20th, unless it is difficult for him?

24 MR. RAMPTON: Yes, my Lord. He is not our witness, so we
25 cannot insert him with certainty. The other thing is, of
26 course, that one must not, with respect to Mr. Morris'
27 domestic difficulties, regard the week beginning Monday
28 25th as sacrosanct. As far as possible we want to avoid
29 having evidence during that week, but if came to it, we
30 would invite your Lordship to sit at any rate one
31 additional day of that week so as to finish the
32 nutritional evidence.

34 MR. JUSTICE BELL: Yes. What I would like you to do,
35 Mr. Morris, is this. You are going to have to make an
36 arrangement for Friday 28th in any event.

40 MR. JUSTICE BELL: I do not want to pry into what kind of
41 arrangements are you making, that is none of my business,
42 but see if you can set up an arrangement for another day
43 of that week against the possibility that we might be
44 looking for a sitting day to finish one or other of the
45 experts on nutrition.

47 MR. MORRIS: I think the other point was that we were looking
48 to have a preparation reading break in any event before we
49 get on to another major subject which will be
50 advertising. So, it is not just because I have some
51 domestic problems. It was thought to be a sensible way of
52 carrying on the trial, so that everyone is prepared and we
53 have all our papers sorted out.

55 MR. JUSTICE BELL: No one is suggesting at the moment that you
56 would have less than three days during that week. That is
57 not being suggested at the moment. You have a weekend
58 before it and a weekend after it, so you have got some
59 days there. If for any reason you think that is not going
