promotional purposes." Do you think that you were
conscious of those provisions at the time of finding these
       leaflets in the crew room?
       A. I am not even conscious of it now.

  Q. Not what?
       A. I am not even conscious of them now.

  Q. There is another provision, my Lord, this is on page 32
under "Discipline", it is J at the top of the page under
the sub-heading "Examples of misconduct which may lead to
disciplinary action being taken", "posting, defacing or
removing notices on bulletin boards without
authorisation." Were you conscious of that provision at
       the time?
       A. That more so.

  Q. Was the notice board an important feature in your time as
       Manager?
       A. Yes, one of the things I did was basically to get a few
builders in. They did some bits and pieces for me round the
restaurant and tidied it up a bit. To ensure that all the
legal notices were displayed, I put a brand new board up
and put half of the board with a perspex covering over it
and the other half was basically for notices from myself or
       copies of schedules etc. etc.

  Q. Did there come a time when you went into the crew room and
saw a copy of this leaflet, a blown up copy, stuck on the
       notice board?
       A. Yes, I did.

  Q. What did you do then?
       A. Ripped it off and put it in the bin.

  Q. Was there any aftermath or sequel to what you did?
       A. None whatsoever.

  Q. Did you anybody speak to you about it?
       A. No one.

  Q. Mr. Magee, and I am summarising, suggests that he was
running an active union recruitment campaign in your
restaurant, and that he had found that 30 to 40 people had
shown an interest in being represented or joining a union.
Do you remember his saying that?
       A. Yes, I do.

  Q. If that were the truth, do you think that you would have
       known about it?
       A. Yes.

  Q. Did you know about it?
       A. No.

  Q. Why do you think that you would have known about it?
       A. Well, because the restaurant at that time, taking staff
out and having regular meetings and getting to know the
staff one on one and speaking to them one on one, I think
I would have got a little bit of something somewhere.
