Day 128 - 24 May 95 - Page 21

       A. I suppose they could have done, yes.

MR. JUSTICE BELL: It is not clear to me that there had actually
been any further burns after 19th May. Mr. Hathaway says
that burn entries were all sustained over the two months'
period, immediately following the installation of this new
type of grill. So I suppose the two months may have
finished before 19th May. We just do not know?
       A. No.

MS. STEEL: But it does also say the incidence of burn injuries
has declined dramatically, which implies that they have not
come to a complete halt. At any rate, you are not aware of
any report into this? You have not seen any report?

MR. JUSTICE BELL: Do you know anything more about it than you
       get from the letters?
       A. Normally, if it is something that has gone to -----

  Q. Do you know anything more specifically ---
       A. About this one?

  Q. -- than appears in the letter?
       A. No.

MS. STEEL: These types of clamshell grills would be used around
the country, would they not; it would not just be the
       Colchester store?
       A. There are two or three different types of clamshell
       grill.

  Q. Is it likely Colchester was the only one using this
       particular type?
       A. No, there certainly would be others.

  Q. Did you not feel you ought to get involved to find out the
implications for other stores and let them know what had
       been going on?
       A. I really cannot remember what we did afterwards, in
August 1993. Obviously, Mark took it up locally with that
particular restaurant. I cannot remember what we did.
Obviously, the point you are making is that it is a piece
of equipment we would have had in use elsewhere, therefore,
we should have communicated elsewhere, and I would agree
       with that.

  Q. But you do not know whether that was done?
       A. I cannot remember.

MR. JUSTICE BELL: Are you moving from the clamshells at
       Colchester?

  MS. STEEL: Yes.

MR. JUSTICE BELL: Shall we have the five-minute break then?

  MS. STEEL: Yes.

                      (Short Adjournment)
