Day 107 - 24 Mar 95 - Page 81

way you would put your case in relation to that with
       Mr. North's assistance.

MR. RAMPTON: My Lord, after that we either decide whether we
admit all or some of those assertions by Mr. North about
McDonald's arising out of that report. If we do not admit
them, why then evidence beings relevant or admissible on
       both sides, but not before.

MS. STEEL: With the exception of the hypothetical, the bits
about whether it is hypothetical or not, that is actually
what happened already. It was not that we wanted to ask
Mr. North questions about the Preston report; it was that
he had been through it and marked up parts that he thought
       were relevant to comment on.

MR. JUSTICE BELL: You have your opportunity to take it
further. Quite frankly, I think some things which have
happened in the last two days have the disadvantage for
whatever reason, not having contact with a witness who was
of potential importance to you for some considerable period
of time, and now you are having the opportunity to correct
that to some extent by talking to Mr. North and taking the
benefit of his views with regard to both Preston and the
       condition of pesticide residues.

We will resume at 10.30 with Mrs. Druce.
