Day 021 - 29 Jul 94 - Page 72

1 MS. STEEL: Do you mean after the witnesses of fact as well?

2 MR. RAMPTON: Yes, after witnesses of fact. Then we have
finished our evidence on nutrition and then it will be the
     3 defendants' turn.

4 I myself, as I have said it before, probably more than
once, probably more than twice, would find it of some no
5 little assistance if the courtesy and convenience which we
confer on the defendants by telling them a long way in
6 advance of the order in which we intend to call witnesses
              could be reciprocated?
     7
MR. JUSTICE BELL: How long do you think -- essentially, what
8 I would like to do is for you -- I mean someone in your
team -- to produce a timetable for those three experts and
9 the witnesses of fact. Then what I would like to do is
the defendants then to add on to that their timetable for
10 their nutritional witnesses. It may it be, of course,
that you will not be able to call all your witnesses just
11 in that slot, but if you can do, it would help. Then we
will have a timetable for the rest of nutrition.
    12
That will enable the plaintiffs to continue the timetable
13 with the next witnesses on the next topic. Which is the
              next topic after nutrition?
    14
         MR. RAMPTON: Advertising.
    15
MR. JUSTICE BELL: Coming back to recycling and waste.
    16
MR. RAMPTON: Yes, that is perfectly right. We have to finish
    17 off recycling and waste.

18 MR. JUSTICE BELL: What I suggest is if the defendants would be
kind enough to add their defence witnesses on nutrition,
19 then the next step is completing recycling and waste.

20 MR. MORRIS: You did say, I believe, earlier this week that
after nutrition it would be appropriate to have Mr.
    21 Preston and Mr. Beavers.

22 MR. RAMPTON: I would rather finish recycling and waste first.

23 MR. MORRIS: Mr. Rampton would like not to call Mr. Preston and
              Mr. Beavers probably at all.
    24
MR. JUSTICE BELL: It does not much matter which we come back
25 to next because we are just completing items. I am
indifferent as to whether we complete recycling and waste
26 before we come back to Mr. Preston and Mr. Beavers. What
I would like to do is, if it is possible, complete Mr.
27 Preston and Mr. Beavers before we move from on from
recycling and waste to virtually a completely new topic.
28 I know we touched on advertising but, essentially, it is a
              new topic.
    29
MR. RAMPTON: I agree, respectfully, with that observation.
30 That is what I should like to do. It gives us more time
also to suit Mr. Beavers' convenience, amongst other
