         MR. MORRIS:  The total hours are at the end.

         MR. JUSTICE BELL:  Is that actual hours worked or when you are
     3        under evening and premium- if you score 24 -- are those
              flat hours or may there be hour and a quarters and hour
     4        and a halves or double time or whatever?
              A.  I am not totally familiar on how we interpret the
     5        make-up of these.  I am not sure, sir.
 
     6   MR. MORRIS:  The last three columns before the final one are
              the hours worked on each shift, so the total hours is the
     7        number of hours; it is number of hours, it is not marked
              up.

         MR. JUSTICE BELL:  You are sure of that, are you, because in
     9        the days when I used to do some manual work, if I did
              double time on a building site, each hour went down as
    10        two.
 
    11   MR. MORRIS:  Yes, but McDonald's do not pay over time.
 
    12   MR. JUSTICE BELL:  I am merely checking.  That is all.
              A.  It is a great question for human resources, sir.  I am
    13        not sure how they mark up the numbers.
 
    14   MR. JUSTICE BELL:  It is well in excess of 39?
              A.  It is well in excess of 39, no question, yes.

         MR. MORRIS:  In a fortnight.  So, what action would be taken
    16        against these stores?  This is something you have national
              statistics on, reported every fortnight to head office.
    17        Would any action be taken against the stores?
              A.  I would guess a discussion would have taken place with
    18        the payroll people, human resources, the OPs people
              involved as to what and why happened.  I am not familiar
    19        with these four cases out of 32,000 employees, I have to
              say, but ----

         Q.   Presumably, it is the manager's responsibility; it is not
    21        the employees responsibility?
              A.  It is the manager's responsibility to make sure that
    22        the rules are obeyed, yes.
 
    23   Q.   So, say I receive this report and I was working for your
              company and I would see those stores, would I phone them
    24        up and counsel them or warn them?
              A.  They might very well phone them, they might go out to
    25        see them, but they certainly would not let that go on.
  
    26   Q.   If it had happened more than once, would that be sort of 
              in defiance of the company, would that be taken seriously? 
    27        A.  They would investigate; they would counsel the
              manager; they would make some kind of note in the person's
    28        record that they were not following the rules, yes.
 
    29   Q.   Would they do that six months later or straightaway?
              A.  They do it simultaneously as quickly as they could get
    30        there, I would guess.
