     4   MR. MORRIS:  Yes, that might be helpful, yes.
     5        A.  Maybe a dozen, because if I go back to the thing about
     6        balancing the schedule of requirements was that if
     7        I suddenly found that business was growing rapidly on a
     8        Saturday, and a Saturday only, then maybe one of the
     9        actions I would look at was to recruit more Saturday only
    10        people.

    12   MR. JUSTICE BELL:  I understand that because you do not want to
    13        take them on as part-timers who want to work Wednesday and
    14        Saturday, if you all you are trying to do is have a
    15        sufficient number of employers to your burgeoning Saturday,
    16        for instance?
    17        A.  That is absolutely right.

    19   Q.   While Wednesday is staying just the same?
    20        A.  Sure, that does fit in with their requirements and they
    21        are not going to be prepared to work those sort of
    22        Saturdays only if they want to work Wednesdays as well.

    24   MR. JUSTICE BELL:   I really think you have to put what you are
    25        trying to achieve from this, bearing in mind what the
    26        issues are actually in the case.

    28   MR. MORRIS:  The reality is that people working Saturday only
    29        who are on the books for some considerable period are
    30        distorting the turnover figures in terms of evaluating
    31        whether the turnover rate is high or low, because they can
    32        be on the books for a long period of time but, effectively,
    33        they are only working once a week or once every fortnight?
    34        A.  We have people who have been working for us for maybe
    35        two years, joined at 16, only started off as a Saturday and
    36        then when they became 18 left school, joined us in
    37        full-time education.  They are on our books only because
    38        they are available to work.  If that availability only
    39        means Saturdays, whether it is day or night, then they work
    40        those.  We do not have anybody on the schedule, on the
    41        payroll, who does not work hours full stop.  We do not not
    42        terminate somebody off the payroll, as I think are you
    43        suggesting, in order to make the figures of turnover look
    44        better than they already are, because if that was the case
    45        they would not receive their P45s for their next and
    46        subsequent jobs.  So it is quite -- that cannot happen.

    50   MS. STEEL:  I just wanted to ask, the Leicester store had a 100 
    51        people on the payroll? 
    52        A.  Right.

    54   Q.   How many days a week was it open?
    55        A.  Leicester, seven days a week.

    57   Q.   Seven days a week, and what were the hours?
    58        A.  Nine till about midnight, perhaps, I think it was; nine
    59        until 11 o'clock during the week days and then Fridays and
    60        Saturdays I think it was open until midnight.
