Day 019 - 27 Jul 94 - Page 74

1 MR. JUSTICE BELL: That is one area. Do not say any more about
that. Where are the other areas?
     2
MS. STEEL: I cannot give you an answer to that either.
3 I have not prepared, but that was not the only objection,
but they are along those lines. Some of the questions
4 have not been answered properly. They have just said, "it
is within your knowledge", or whatever. They have not
     5 been specific enough.

6 MR. JUSTICE BELL: Apart from further and better particulars of
the defence to counter claim, are there any other matters
7 which really have to be dealt with before the break,
              procedural matters?
     8
MR. MORRIS: Yes. I started to draw up a list but I did not
9 have time last night. There are a few bits and pieces of
discovery. I am sure this is not a complete list, but
10 obviously there is the accident statistics which have been
mentioned a few times. There are a couple of documents,
11 I think it was the rest of the McDonald's staff
              consumption survey, if you remember.
    12
MR. JUSTICE BELL: Just pause a moment. I will make a list.
    13
MR. RAMPTON: My Lord, that is the addendum to Mr. Fairgrieve's
    14 statement.

15 MR. JUSTICE BELL: It is the amendment to whose statement? It
is the document which Professor Wheelock referred to where
16 there were percentages of people eating meals.

    17 MR. RAMPTON: Yes.

18 MR. JUSTICE BELL: At a certain frequency.

19 MR. RAMPTON: Yes, that is appended to Mr. Fairgrieve's
              statement.
    20
MS. STEEL: I think that is a different survey.
    21
MR. RAMPTON: Can I be told which survey it is? I only know of
22 three. I know the American survey, which has been in the
documents for a very long time; I know of the employee
23 survey, which is appended to one of the other witness
statements; I know of Mr. Fairgrieve's survey. Those are
    24 the only three.

25 MR. JUSTICE BELL: If I can remind you what it was that was
referred to? There was one which refers to meals.
26 Professor Wheelock suggested that a drink might be a
meal. That is the best way I can try to bring it back to
27 people's recollection, because immediately below that
question and answer there was a table which had different
28 kinds of dishes, I will describe them, although dishes are
              not in fact used.
    29
MR. RAMPTON: That is in the American report for 1990, the
    30 Annual Report, that table.
