not that you should be able to do so.

MR. MORRIS: Do you know anything about an accident involving a
crew member called Sam whose arm slipped into a vat?
A. No.

Q. Your store at that time, the Epsom store, used the
Company's hustle policy, yes?
A. Yes.

Q. Crew were expected to hustle in all parts of the store?
A. Not really, no.

Q. So the OCLs, your OCLs, you had with your store, they were
the same as all the national ones?
A. Yes.

Q. They included hustle marking, not just on the front
counter, they included it in the kitchen area of the store,
did they not?
A. Yes, yes.

Q. Right. You would have to get staff to conform with the OCL
requirements, yes?
A. Yes.

Q. Right. So the hustle policy applied to the kitchen areas
as well as the front counter?
A. Yes.

Q. Why would it not conform, why would some parts of the store
not conform to the hustle -----
A. Well, to me "hustle" is on the front counter, moving
fast but not running, just serving the customers. In other
areas, you know, it could be -- it could not be possible.

Q. There is something wrong with hustle then in the kitchen
area?
A. It depends on the store that you are working in.

Q. In the Epsom store, for example?
A. Yes, it will be a bit difficult.

Q. So in some McDonald's stores the kitchen areas are cramped,
are they?
A. Not cramped but there is not enough space. You can
move quite easily but, you know, you cannot sort of move
fast.

MR. JUSTICE BELL: Just pause a moment. Yes?

MR. MORRIS: It is at the Manager's discretion, yes, whether
somebody after an accident receives their pay ---
A. Yes.

Q. -- that they were scheduled for?
A. At the time, yes.

Q. Yes. You exercised your discretion, did you not, that she
should be paid?
