3 you did hand in this morning), for time to speak to their
4 witness. My ruling is that you must not put to this
5 witness new material which you have not given notice of to
6 the other side, unless and insofar as it relates to
7 credit. I want to make a note of that. Yes?

9 MR. MORRIS (To the witness): Have you ever witnessed or known
10 about a Manager adjusting people's clock cards for the
11 purpose of saving on the labour percentage at the store?
12 A. No.

14 Q. When Michael Logan was senior Manager on a shift which he
15 was sometimes -- is that correct ---
16 A. There were times when he was the shift running Manager,
17 that is correct.

19 Q. -- and he would use the Husky Hunter computer system?
20 A. He would do.

22 Q. Right. He would have to get into it; he would have to know
23 somebody else's personal code, would he not?
24 A. No. He would have his own code because he was an
25 authorised shift running Floor Manager. He may well have
26 known someone else's code but he did have his own code.

28 Q. I mean, every staff member had his own code but not the one
29 that would get into the computer?
30 A. No, every staff member has their own bar code which
31 enables them to clock in and out. Only Managers or
32 specifically salaried Managers and shift running Floor
33 Managers have a code which allows them access to the parts
34 of the system which allowed them to alter clock cards.

36 Q. When did Michael Logan get this status of having a special
37 personal code for access?
38 A. Presumably, when he became a shift running Manager,
39 I cannot remember the exact date, but he did have a code,
40 he definitely did have a code, because his code appears on
41 employee changes reports.

43 MR. JUSTICE BELL: Can you help me about that report, because it
44 was one of the duties I was confused about as a result of
45 yesterday's evidence? Is that a report which has nothing
46 else on it but the changes?
47 A. The adjustment audit report, I believe, the actual
48 title of it is, yes. All it is is one page, or very
49 occasionally a two page document, that has a list of the
50 Manager's code next to each adjustment they have made to
51 the clock card report that day.

54 A. For each day, and it will also have the badge number of
55 the crew member who has adjusted next to it.

57 MR. MORRIS: People having clocked in and out for their breaks,
58 the person who is doing this at 1 o'clock would clock in
59 and out for their 45 minute break?
60 A. Assuming they are entitled to a full 45 minute break,
