Day 089 - 15 Feb 95 - Page 77

I would ask what limited range of documents Sun Valley
would be willing to produce. That, I will do.

MR. JUSTICE BELL: Here we have Dr. Pattison.
(To the witness): Are you a director of Sun Valley?
       A. No, I am not a director and, obviously, if I was to
disclose whatever might be required, I would have to get
       authority to do that.

MR. JUSTICE BELL: Yes. Then I will take your answers as
subject to that, but at the moment you are the only
evidence -- Dr. Pattison is only evidence I have. If you
want to argue it -- I am not going to have it argued now
and I am not going to make an order without argument ---

  MR. RAMPTON: No.

MR. JUSTICE BELL: -- but I must say at the moment if ever there
was an area where, on the evidence I have heard so far, and
there may be more evidence which has to be called which is
relevant, the easiest course would just be to get hold of
them and produce them, this is it.

MR. RAMPTON: I agree with that, but I do not presently regard
that as being something I can guarantee.

MR. JUSTICE BELL: No, very well. Let us leave it there. It
may mean delay. That is all.

MR. RAMPTON: He must, my Lord, be given the opportunity to
speak to his directors about it, to see thereafter, or
somebody on his behalf, what documents are available, how
many there are and how easily they may become available to
       your Lordship.

MR. JUSTICE BELL: Right. You have no objection to Mr. Pattison
making enquiries, have you, for the purposes of Mr. Morris
and Ms. Steel finding out what might be available overnight
in the sense of what might still be in existence and
       identifiable somewhere?

MR. MORRIS: Are you asking me?

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Sorry, I did not realise. No, it would be very
helpful if it is OK to bring them to court tomorrow ---

MR. JUSTICE BELL: No, I am not suggesting -----

MR. MORRIS: -- to save time.

MR. JUSTICE BELL: As Mr. Rampton has taken objection, we have
to follow the form. All I -----

MR. MORRIS: We may get approval tonight; in that case there
       will be no problem.

MR. JUSTICE BELL: We will see.
