Day 175 - 18 Oct 95 - Page 51

open one's mouth. One needs notice and preparation time.
The more so since we are now going to use Thursday and
possibly some of Friday, 27th, in legal argument.

I would have sincerely hoped that we could have had some
kind of notice at the end of this week or the beginning of
next, particularly since Mr. Morris is not now going to be
in court on Friday of this week, and could usefully spend
some of that time, one might have thought, arranging the
witness schedule for the week beginning the 30th.

MR. JUSTICE BELL: You should be able to do that, should you
       not, Mr. Morris?

MR. MORRIS: I will do my best to do whatever I am asked to do.
I can only do what I can do. I am certainly trying to
schedule our witnesses as quickly as possible for all our
       interests.

MR. JUSTICE BELL: Yes. Let Mrs. Brinley-Codd know as soon as
possible and set yourself a deadline of something like
Wednesday morning just as an act of self-discipline. We
all know it is easier to get down to things if one has
       deadlines.

Unless there is anything which must be dealt with tonight,
we will resume at 10.30 in the morning.
