Day 205 - 17 Jan 96 - Page 31

little bit round the houses by Mr. Lantos, Congressman
       Lantos, he said -----

MR. JUSTICE BELL: What they were arguing about, was it not, was
that he was talking of percentage, Mr. Stein was talking of
percentage of all the restaurants ---

  MR. MORRIS: Yes, I know.

MR. JUSTICE BELL: -- and Mr. Lamti -- is that his name?

  MR. MORRIS: Lantos.

MR. JUSTICE BELL: Yes. He was talking of the percentage of
       those who had been investigated.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: So they were completely at odds as to the
       approach to take.

MR. MORRIS: Yes. I think it is equivalent to saying you do not
have any records when you know that you can get the
information through other means by making all due diligent
inquiries of all the relevant official, in Mr. Stein's
       recent statement.

But if you look at the middle of that page, Mr. Lantos
said: "Therefore, only those 200 and 300 potentially could
be cited are we in agreement?" "That is correct,
sir." "Accepting your figure of 200 to 300, the violation
therefore is not one per cent, but it is from 7 to 10 per
cent. Do you agree with that?" Mr. Stein: "That is
       correct, sir."

So, we are talking about something from between 7 to 10 per
cent, as accepted by Mr. Stein, of all franchisees
investigated have been cited for child labour violations.
That is, we are not talking about other violations, just
child labour violations, child labour law violations.

MR. JUSTICE BELL: What at the moment I do not understand --
I mean, that might be like saying that of every 100 people
against whom allegations of crime are made, 10 per cent are
charged or whatever. You see, what I do not know, and you
may be able to tell me, is whether before there is an
investigation there is some reason to believe that there
have been transgressions. But, anyway, that is another
point; that is not on interrogatories.

MR. MORRIS: I believe it is dealt with in that testimony, that
       it is mostly random.

MR. JUSTICE BELL: Refer me to that later.

MR. MORRIS: It is mostly random or it is all random; it is a
       sweep that was done.

MR. JUSTICE BELL: That is obviously what Mr. Lantos thought.
