5 MR. MORRIS: Mr. Magee says he did not know of any previous
6 example of management enforcing this rule about getting
7 access to people's lockers if they did not change their
8 lockers, did not change on each shift, so does that
9 correspond with what you say, that in reality you did not
10 go around enforcing this rule?
11 A. No, the sign was up in the crew room and to be honest
12 with you, I did not really need to enforce it that much.

14 Q. Because you really left it up to the trust of the staff to
15 comply with the policies as they understood them? Yes.
16 You did not track and monitor whether they were doing it
17 every day you just said?
18 A. No.

20 Q. So, in fact, people, quite logically, quite a lot of
21 people, were probably, in effect, keeping the same locker
22 each day?
23 A. They might well have been for a couple of days, or a
24 week, or a day. I had far more important things than to
25 track each individual locker.

27 Q. So if someone had broken into someone's locker, someone
28 from management had done that, it would be an extreme
29 circumstance?
30 A. Yes.

32 Q. But management had the right to do that? They had a right
33 to get access to a locker if they considered that someone
34 was disobeying your policy?
35 A. I would not call it a right. It is just ----

37 Q. They had the ability to that if someone was infringing
38 policy?
39 A. In an extreme case, yes.

41 Q. Did Mr. Magee -- I might as well put to you another point
42 which is in Mr. Magee's statement. For the record, it is
43 on page 5 of his second statement. You do not have to look
44 at it -- challenge you about the theft of union leaflets
45 from his locked locker by management and then was told by
46 you, "Fuck off somewhere else"?
47 A. Not that I am aware of.

54 you have a good relationship?
