Day 182 - 02 Nov 95 - Page 28
members are adhered to and not ignored?
A. Yes.

Q. Can you give some examples of that?
A. Well, the law provides overtime pay for any worker, if
he works more, well, in excess of his normal working hours,
which is set at a minimum of 40 per cent, but I do not
believe McDonald's ever paid that, except occasionally
maybe on Christmas Eve and Easter, at least not -----

Q. And for those night closes after the -- the night closers
got 40 per cent increase?
A. After their agreement.

MR. JUSTICE BELL: That was an increase in their rate of pay,
was it not?
A. Yes. That was an increase in their rate of pay so ...
But in the collective agreement there is -- it says that if
you work in excess of your normal working hours you will
receive 50 per cent extra before 9.00 in the evening and
100 per cent after that. These rules were put into effect
and people were actually paid this.

Q. Pause there.

MR. JUSTICE BELL: Just pause a moment. Yes?

MR. MORRIS: Your evidence is that is something that was
enforced as a result of union recognition?
A. Yes, we made sure that they paid these extras.

Q. Right. The overtime pay at 40 per cent extra, is that
something that covers just the catering industry or what
does that cover?
A. Oh, that is any industry.

Q. In Norway?
A. Yes.

Q. But McDonald's did not pay that previously?
A. No.

Q. In terms of adhering to employment law, what other laws
were enforced as a result of the union recognition that you
can remember?
A. Well, obviously we improved on the working environment,
things like that, we made them install a new ventilation
system, or we had the labour authorities come on an
inspection and they consequently ordered McDonald's to
replace the ventilation system of the restaurant. We also
had mats, cushioning mats, installed in the kitchen and the
front areas.

Q. Cushioning mats, sorry, what are they?
A. Rubber mats to -- it is very hard to walk on tiled
floors for eight hours with no rest, so we tried to
alleviate that by buying cushioning mats or making
McDonald's get cushioning mats so ......

Q. On the floor?
