1 If we just go back to 434, something I have just noticed,
2 Jason Dixon, another person who has been mentioned in the
3 case. If we look on Friday in that week, starting
4 29th May, he is scheduled 12.00 to 8.00, and then 4.00 to
5 close, 4.00 to close; that is three days in a row. If you
6 look at 436, which is the following week, 5th June, he is
7 4.00 to close, 4.00 to close, 4.00 to close, 4.00 to close,
8 4.00 to close and 10.00 to 4.00. So he has been scheduled
9 nine days in a row. You accept that is what the
10 scheduling -----
11 A. That is what it says in the schedule.

21 badges; people move on to a yellow badge after they have
22 had their probationary review, do they not?
23 A. Yes, that is correct; after they have had the
24 probationary review, they move on to a yellow badge, even
25 though some stores in the Bristol area I used to work in
26 have basically done away with the green badge system; they
27 just incorporate people into a yellow badge.

29 Q. But at the Bath store, people are green badges until they
30 have had their probationary review, and then if they
31 pass ---
32 A. Yes.

34 Q. -- they become yellow badges; if they fail -----
35 A. Their employment would be terminated, so far as I am
36 aware.

38 Q. Right, OK. There is a complaint in one of the rap sessions
39 -- in fact, I read it out this morning -- about some green
40 badges remain green badges for five to six weeks in the
41 summer. Do you remember that from this morning?
42 A. I think I remember the comment, yes.

45 A. No, I do not specifically remember that happening at
46 the time.

48 Q. Green badges are supposed to remain that way for three
49 weeks; is that right?
50 A. Yes, three weeks up to, I believe, the last limit is
51 four weeks, if they wish to terminate their employment.

54 Q. What happens if they do not get a performance review --
55 once they had had a performance review, they would not
56 remain a green badge, would they?
57 A. Initial probationary performance, once they had their
58 probationary review, they would go from a green to a yellow
59 badge.
