Day 005 - 04 Jul 94 - Page 27

1 high in fat and sugar?

2 MR. JUSTICE BELL: Can we come back to your first question and
then come back to that: When you were asking Mr. Preston
3 whether he would agree that sugar was the first
ingredient, what were you meaning to put then?
     4
MISS STEEL: That was the question, was sugar the main
     5 ingredient?

6 MR. JUSTICE BELL: You did mean that, not just that it happened
to be first on the list in the book.
     7
MISS STEEL: As I understand it, the law says when you list
8 ingredients, you are supposed to put the main ingredient
              first.
     9
         MR. MORRIS: By volume.
    10
MR. JUSTICE BELL: Is sugar the main ingredient by volume?
11 A. I said earlier, Sir, I very much doubt it. I am not a
baker and probably that answer should come from a
    12 technical----

13 MR. RAMPTON: I do not know if it will help? May I draw your
Lordship's attention? It may be Miss Steel is right, I do
14 not know whether she is or not. One sees there in 1989
the first listed ingredient is sugar. If one looks at
15 1994, one finds the first listed ingredient is something
else: Reconstituted skimmed milk and sugar is the second
    16 listed ingredient.

17 MISS STEEL: Is there some point to what you are saying?

18 MR. RAMPTON: Whether that has any significance or not, I do
not know. One sees the order has changed.
19 A. I am not a baker, but I very much doubt -- the largest
component by volume of any cake is flour. That is what
    20 I would guess.

21 MISS STEEL: Cakes that people made at home, probably the first
ingredient would be made of flour?
22 A. I think this would be the same; I would be surprised
              if it was not.
    23
MR. JUSTICE BELL: I do not know whether Mr. Preston can really
24 answer. I do not know how they compare by weight.
              A. I do not know.
    25
         Q. I suppose a kilo bag of sugar, a kilo bag of flour and,
26 just by recollection, I suppose a kilo bag of sugar is a
bit smaller than a kilo bag of flour.
    27
MISS STEEL: I think it is done by weight rather than by
    28 volume.

29 MR. JUSTICE BELL: That is what I wondered. Do you know what
              the answer is to this?
    30 A. I do not.
