Day 061 - 05 Dec 94 - Page 78
MR. MORRIS: I have made a couple of calls, but mostly the
problem is that I have not put enough energy into it
because, to be honest, we have about four subjects going on
concurrently at the moment in this case, and I find it
really hard just to cope with the amount of paper work.

MR. JUSTICE BELL: I think you should make a good effort to get
in touch with him and say: "Look, we are all waiting for
what you are going to produce". The first thing you need
is something from him in writing, is it not?

MR. MORRIS: Yes. He is sometimes quite difficult to get hold
of.

MR. JUSTICE BELL: Right. Do your best.

MR. MORRIS: There is also the question of discovery from the
Plaintiffs. I do not know when that is happening. Do you
remember, there were documents that we went through that
you said they should provide?

MR. JUSTICE BELL: Yes.

MR. MORRIS: I think Helen spoke to Barlow Lyde & Gilbert and
they said there was a file being prepared. I would like to
know when.

MR. RAMPTON: What happened was that Mrs. Brinley-Codd told
Ms. Steel on Friday that Mrs. Brinley-Codd would do it this
week and so she will; it is Monday today.

MR. JUSTICE BELL: Put that on your list of procedural things to
be dealt with which must I think -- I do not want to deal
with them on the Wednesday, the last day of term. I would
prefer to deal with the remaining procedural matters -- may
be we would start the day by me giving judgment on the
matters we heard quite recently; go on with the other
procedural matters; make sure that is on a day which is few
days before the end of term so that if it throws up some
other loose end, we have done our best to tie that up
before we break up for Christmas.

But let us get on with Mr. Van Erp in the morning. Find
out about Ms. Dibb. Apart from anything else what occurs
to me is that if, for instance, we were able to start
Mr. Oakley on Thursday, hopefully, he would finish that
date; if he did not and he was just rolling into Friday
morning, it would obviously be much better that we carry on
with him, finish him and then start Ms. Dibb. So one wants
to know, if we did not finish her by Friday evening, could
she roll into Monday. But try to get a cluster of days
from her, apart from Friday, when she would be good enough
to come to court to complete her evidence. 10.30

(The court adjourned until the following day).
