Day 084 - 07 Feb 95 - Page 12

MR. RAMPTON: Wait a minute. My Lord, I am prompted to
intervene on the basis that what Mr. Morris has just told
your Lordship is simply untrue. My Lord, what actually
happened was this: The Defendants, having been at fault in
failing to provide more than one copy of documents on most
occasions, made a demand of Mrs. Brinley-Codd that she
should do a trawl of the transcript to find out -----

MR. JUSTICE BELL: I remember all that.

MR. RAMPTON: She has done it. She is still doing it. The task
is not complete. It takes a very great deal of time.
There is somebody in Barlow's office who spends a lot of
time doing it. May I pass up the fruit of Barlow's labour
so far? For Mr. Morris to stand up in this court to say
there has not been co-operation is, frankly, an outrage.
It might improve the (inaudible) if he did some work
       himself.
       (Handed to the learned Judge)

MR. MORRIS: As I said, I thanked Mrs. Brinley-Codd for the
       obvious work she has done.

MR. JUSTICE BELL: This is very helpful, is it not?

  MR. MORRIS: Yes.

MR. JUSTICE BELL: What more are you suggesting for the time
       being needs to be done?

MR. MORRIS: I have only just seen this and, as I have said
        -----

MR. JUSTICE BELL: I suggest you reserve your position on that
until you have had a chance to look through it.

MR. MORRIS: It is just that I am saying we need a system. If
Mrs. Brinley-Codd (and I never made any demands on
Mrs. Brinley-Codd whatsoever) is prepared to do that -----

MR. JUSTICE BELL: The position is we started a system whereby
anything which you actually produced goes into ring
binders. I have one of those started already. The
kingfisher blue, as it is called, Supplementary Documents
bundle V, I think the number is we have got to now. You
are going to keep that going, presumably?

MR. MORRIS: Yes, that is our intention.

MR. JUSTICE BELL: Meanwhile, Mrs. Brinley-Codd has very
helpfully produced this which you need to have a look at.
What I suggest is you look at it and then decide what your
suggestion is with regard to documents which have gone in
in the past and tell me what it is, but give yourself a
chance to look at this first. Is there a suggestion where
that might go so that I do not promptly lose it,
Mr. Rampton? I will leave it out on top until someone
       comes up with a suggestion.

MR. RAMPTON: The only place I can think of at the moment is in
