Day 249 - 14 May 96 - Page 74

MR. RAMPTON: I see no problem at all. It seems remarkably
uncontroversial what she has to say.

MR. JUSTICE BELL: Then you have got leave to call her.

  MS. STEEL: Thank you.

MR. MORRIS: The one that I handed in from Dr. Michael Miller is
a Civil Evidence Act notice statement.

MR. JUSTICE BELL: I know it is. As you probably gathered from
the ruling I made on Professor Naismith, I am distinctly
uncharmed by the idea of having fresh evidence on nutrition
issues. If the brief look I have had at this reflects the
whole of it and it really goes to the same topic in respect
of which I have given leave for Professor Naismith to give
evidence, namely diet and heart disease, you probably will
not have any trouble getting leave, but I want to read the
whole thing and Mr. Rampton has to make up his mind whether
he objects to it or not.

MR. MORRIS: Can I say one thing -- we will leave it until
tomorrow. Mr. Brett is in the morning. Mr. Brett is
       confirmed for the morning.

MR. JUSTICE BELL: We will carry on with Mr. Brett at 10.30 in
       the morning.
