Day 150 - 07 Jul 95 - Page 62
A. I guess it would tend to how the problem developed in
the mind of the Manager, the shift running Manager. I do
not necessarily have to know every intimate detail that is
going into the restaurant.

Q. If it was a recurring problem would you expect to know
about it?
A. I would hope so.

Q. Who would you have expected to be informed by?
A. The Store Manager.

Q. Mr. Davies?
A. Yes.

Q. But not if it was just a one-off?
A. He may still mention it to me in terms of my
conversations with him, either in person or on the
telephone.

Q. But if it was just a one-off would you be concerned if you
later found out about it but you had not been told at the
time?
A. I would trust the Manager's judgment on all matters.

Q. To make his own decision?
A. To make his own decision. I am not saying it did not
happen. I just do not recall it.

Q. You say in your statement on page 230 that a Store Manager
would not make the crew work through the night in
anticipation of such a regular visit, a regular visit being
one from the Area Supervisor, I think; yes, that is right,
if you read a bit earlier on.

Then you go on to say, "This contrast as mentioned above
with a visit by a more senior member of management such as
the Operations Manager or Market Manager." So when
Operations Managers and Market Managers and, presumably,
anyone above them was visiting, the Store Manager would
make crew work through the night in anticipation of the
visit?
A. He would ask if anybody would wish to, but he would not
make any crew work through the night.

Q. But whether or not the crew were made to work, there would
be a shift scheduled in those circumstances?
A. In anticipation we would probably put four people on at
12 midnight to six, or whatever, five or six shift
certainly; but that would not be because no one is needed
to work those hours normally; therefore, there is no
obligation on their part to work those hours. It is purely
voluntary.

Q. So what would happen if you had some kind of senior
management coming down and everybody said, "Oh, we do not
feel like working tonight"?
A. It never happened.

Q. It never happened?
