4 A. It is the only incident I know of where sewage has been
5 found to have come up into the restaurant.

7 Q. You would expect to know if that kind of thing happened?
8 A. I would expect to, yes. I would expect to hear about
9 it.

11 Q. Just for your information -- I will just read it out; it is
12 paragraph 12 of Mark Davis's statement that we were looking
13 at -- "However, I only recall one occasion when sewage did
14 come up through the drains. It was never visible to
15 customers. After initially attempting to solve the
16 problems ourselves, I decided to close the store until the
17 drainage company, Dynarod, had cleared the drains and we
18 had cleaned up the restaurant". So you accept that it
19 happened at the Colchester -----
20 A. Oh, certainly, yes, as I say, and I am very careful
21 about it, is the only one I had heard of.

26 was Southend?
27 A. Southend, that is right and I did not know about the
28 Colchester.

35 happening at local stores, even things you expect to hear
36 about, and, basically, you are not hearing about them?

38 hear about.
