  Q. How was the decision reached for the MDC, for McDonald's UK
to take over what MDC was doing previously? Was that just
something that took place above your head?
       A. Well, McDonald's Corporation would have taken that
       decision.

  Q. Right.
       A. But I was not party to that decision, so -- I think
your question was why was that decision taken; is that your
       question?

  Q. No, I am just trying to clarify. You were not party to
       that decision?
       A. No, I was not party to the decision.

MS. STEEL: If you could turn to the new documents in tab 59A,
the final page of that. It might be quicker to turn to
       tab 16, the page before.
       A. Yes, I have it.

  Q. This is a telex?
       A. It looks like a fax or a telex, yes.

  Q. From Mr. Nicholson -- sorry, from you to Mr. Nicholson,
dated 31st July, 1985. You are sending him a copy of a
letter received from the Rights Commissioner about
Mr. Brian and Mr. McCann, and a copy of your proposed
reply, to seek his comments on that. Why should you be
getting Mr. Nicholson's comments about your reply?
       A. For no other reason than I was, you know -- he is
personnel advisor for McDonald's, and I was keeping him
abreast or -- can I read this for a moment, please?

  MS. STEEL: Yes.

MR. JUSTICE BELL: Yes. Read it through. (Pause)

THE WITNESS: Yes. I think the first part of the telex is on
behalf of the Rights Commissioner, OK.

MR. JUSTICE BELL: What you appear to be doing is consulting
Mr. Nicholson for his comments on your proposed reply to
       Miss Doyle, who has written for the Rights Commissioner;
and the question you are being asked is why approach
       Mr. Nicholson about it?
       A. I simply would have said it to him by way of normal
course of action, that this was how I was dealing with the
situation where I had a case referred to a Rights
       Commissioner.

MS. STEEL: That was because he had responsibility for the
       personnel matters?
       A. Yes, when McDonald's took over responsibility.

  Q. McDonald's UK?
       A. McDonald's UK, yes. Mr. Nicholson was the personnel
       manager.
