Day 083 - 06 Feb 95 - Page 64

MR. JUSTICE BELL: I will extend the time to Friday of this
       week.

MR. MORRIS: On the previous documents ----

MR. JUSTICE BELL: Do you need to ask now? It is on your list.

MR. MORRIS: Yes, OK. I was not clear what percentage of stores
       that applies to in America.

MR. JUSTICE BELL: What I suggest is bring that up when you come
to it. It is the last but one item on your list.

MR. RAMPTON: They are no centrally kept statistics for the
franchised stores, my Lord. My recollection is that the
company-owned restaurants in the United States represent
about 20 per cent or slightly more slightly more, maybe 23
per cent of the restaurants. Whether it is sensible to
make an extrapolation or not one will see in due course.

My Lord, the next thing is I think it was Mr. Hawkes was
cross-examined about some remarks Mr. Preston was reported
in a newspaper as having made at a conference, to the
effect, broadly speaking, that customer research had shown
that some people did not like McDonald's because it was too
American, too rash and so on. We have now obtained that
customers' survey. It is dated 1991. Mrs. Brinley-Codd
and I have looked at it separately and we cannot make head
nor tail of it. So I cannot tell at the moment whether it
is disclosable. We are going to get some help with that,
if may we. If there are parts of it, maybe the whole of
it, that are disclosable then those parts will in due
       course be disclosed.

Two other surveys mentioned I think by Mr. David Green, one
was an Al Golan or Goland Harris survey, relating I think
to the frequency with which people ate meals in the
restaurants. The other was what I called the Santa Claus
survey in which Ronald, I think, came second to Santa. The
Americans do not have (I say the Americans I mean the
corporation) does not have any copies of either of those
surveys. They have, however, asked Leo Burnett their
advertising agents and Goland Harris their communications
agents if they have got copies of them, and if they have
and they are relevant then they will be disclosed.

Then, my Lord, there was a request for the nutritional
information underlying some statements in one of the annual
reports which I think I showed to Professor Wheelock. That
enquiry has been made to see whether it exists in
documentary form. If it does, then again it will be
       disclosed.

There was a question, my Lord now I am going to Germany
from America, of whether we needed to call or desired to
call Ava Maria Zuchsa from Germany to give evidence about
the relationship between the German unions and McDonald's,
if any. We have decided we shall not call her. Therefore,
we will answer the interrogatories which your Lordship said
