     1        restaurant, somebody who has been in the restaurant almost
     2        eight years and who attends Managers' meetings regularly, I
     3        would expect to be told of such instances at Managers'
     4        meetings.  And as someone who fills in the incident report
     5        forms myself, I would expect to notice such incidents in
     6        the report forms book and I am unaware of these incidents.

    10   MR. JUSTICE BELL:  Quite frankly, I cannot tell you just how to
    11        do your case ---

    13   MR. MORRIS:  I was going to call the man a liar but I ------

    15   MR. JUSTICE BELL:  -- I will be quite candid with you.  You have
    16        to cross-examine, but I think there is a public
    17        misconception about the value of cross-examination.
    18        Sometimes it is very valuable, sometimes you can go on and
    19        on cross-examining and it just makes one wonder why they
    20        are not getting on and calling their own witnesses.  What
    21        I want you to do is challenge what you have to challenge,
    22        test with some economy the witnesses called by McDonald's
    23        and then get into your own witnesses side and hear what
    24        they have to say.

    26   MR. MORRIS:  As I was saying, I was going to challenge the
    27        credit of the witness on what he is saying, but I was just
    28        trying to make absolutely clear what he is saying.

    31        cross-examination, well and good; if you cannot, let us
    32        hear what your witnesses have to say.
