Day 248 - 13 May 96 - Page 15
were letters written in 1984 expressing concern.

Q. A letter. You are aware of one letter which you have
mentioned in your statement?
A. Yes, that is correct.

Q. So, you are talking about one letter, that is right is it
not?
A. I am talking about a letter, singular, yes.

Q. Yes, the next letters were when you served writs on myself,
Mr. Morris and 3 other people in 1990; that is correct is
it not?
A. That is correct.

Q. Right. So there were no subsequent letters, and certainly
not several?
A. That is correct.

Q. Right. So why is it then that, knowing that paragraph was
incorrect, you sent it out only last week to Annette Tyde
from Sterne magazine, on 9th May 1996?
A. I am sorry, I did not send anything out last week. You
are saying my communications people did?

Q. Your communications department did?

MR. JUSTICE BELL: Have you actually... You went straight to
the background briefing, you see, without referring to the
fax cover sheet.

MS. STEEL: If you want to look at the cover note on the
front.
A. OK, yes.

Q. Why was it this was sent out last week when you knew it was
incorrect?
A. Well, I know that it is not totally incorrect and I do
not know why it was sent out last week. As it said here,
Mr. Preston is in court and not talking to anyone about the
case, internally or externally, so, I am sorry, I cannot
give you an answer, I was not there to talk to the person
-- not that I would have.

Q. So, will you be taking some action against Mr. Love, now
you have found that out, to reprimand him for having
distributed -- continued to distribute -- false
information?
A. I will leave that to the court. The court will
determine what is false or not false, incorrect or not
proper here. After that I will revisit the issue.

Q. Does it just not bother you that your company is
distributing false information, Mr. Preston?
A. Well, it is not false in my opinion. It may not be 110
per cent correct, but it is certainly not absolutely false.

Q. Certainly not 100 per cent correct?
A. I have said that.
