Day 205 - 17 Jan 96 - Page 54

MR. JUSTICE BELL: I have dealt with that point already, have I
       not?

  MR. RAMPTON: I believe so.

MR. MORRIS: I do not recall any leave application.

MR. RAMPTON: No. I am not sure I actually made a formal
       application.

MR. JUSTICE BELL: That is why I am coming to it now. Is there
any objection to Hendon, Cox or Perrett being called?

MS. STEEL: I am sure we will get a shocked reaction, but
neither of us have actually read the statements yet.

MR. JUSTICE BELL: Can you refer me to them, Mr. Rampton?

MR. RAMPTON: My Lord, I will do my best.

MR. JUSTICE BELL: They are in 10B, are they not?

MR. RAMPTON: They will be in 10B. I think I can easily
summarise what they say and the reasons why they are being
       called.

MR. JUSTICE BELL: They are 39I.

MS. STEEL: We have not actually got copies in court.

MR. JUSTICE BELL: 39G. Ian Hendon is 39I. Christopher Cox is
39H and Kevin Perrett is 39G.

MR. RAMPTON: My Lord, do not have them here myself but, from
memory -- and it is fairly recent -- can I remind your
Lordship how this arose? Mr. Logan was to be called.
I took objection -- I said, and I think your Lordship
agreed, that his existing statement at the time was devoid
of any kind of particularity. Mr. Morris then got some
details from Mr. Logan which he, Mr. Morris, wrote down on
a sheet and a half of paper, giving names and allegations
as they related to those named people. Your Lordship will
remember that it was at about that time that we made very
extensive discovery in relation to Bath, so that your
Lordship could, as it were, take a bird's eye view over
three different months in two different years of, in
effect, the way that the Bath restaurant worked.

The reason for these three witnesses are in the case of
Perrett and Cox that they are named crew members about whom
allegations were made by Mr. Logan, according to
Mr. Morris' note, concerning the way in which they had been
treated by management at Bath. I cannot remember which
particular allegations related to those two witnesses.
Kevin Perrett's was that he was victimised or mistreated by
late performance reviews, I think; Christopher Cox, that he
was worked long hours and was badly treated by scheduling
hours, I think; Mr. Hendon is called because he during the
relevant period has done much or most of the schedule
himself -- he is a First Assistant -- and also because he
