Day 069 - 19 Dec 94 - Page 39
understand the industry?
A. I am going to say it again. I do not know if he was
lying. I do not know if he knew about the industry
enough. I do not know if he was intending to sell his
product, which it seems to be the case, to this particular
people that came and told him: "We want to buy your
product for the food industry."

Q. The "Jungle Burger" film has caused, or may still be
causing, some controversy, yes, in respect of McDonald's?
A. In your mind, yes. In our mind, it does not. We know
what we do.

Q. What steps have you been informed the company took after
the film was made and the whole issue of Costa Rica -- does
it export to the USA, et cetera, et cetera -- when you
speak to Mr. Madrigal and Mr. Simmons, what steps did the
company take, I do not mean to stop the film being shown,
but to look into the issues or respond to what was quoted
on the film?
A. I have mentioned quite extensively all of the research
that I have done on my part. It is well documented. I do
not see any need to go over those statements again. But
I can tell you, again, that we have made every effort to
find the facts. We have not made any effort to prove
anybody wrong. We have gone after the facts. If we had
found any piece of evidence that will indicate that they
did not follow our specifications, we would have taken a
step a long time ago. We would have taken actions against
that supplier a long time ago. We would have take actions
all the way to pursue legal actions against them. They are
still our suppliers.

Q. So no action was ---
A. I have nothing else to say.

Q. -- taken against Coope Montecillos?
A. Nothing.

Q. What about the person who was interviewed in the film --
any action taken against him?
A. You can understand, that was part of his side of the
business. He never said in that particular part of the
film that we seen that it was for McDonald's purpose. He
never gave that indication. How can we pursue and do
something wrong for him? It was for his side of the
business.

MR. MORRIS: I am just thinking, because obviously I want to
get this out of the way rather than come back to it.

MR. JUSTICE BELL: Do you want to show any more of the film?

MR. MORRIS: I am quite happy for it to be shown. I just want
to finish this line of questioning.

MR. JUSTICE BELL: On reflection, I do not think I need to see
any more. At some stage I may be invited to take the whole
thing away, or at least look again in my own time at that
part. So we can turn the machine off, can we, at the
