Day 248 - 13 May 96 - Page 43

       informed.

  Q. Who was that that told you that?
       A. I believe Mike Love.

  Q. You have not got any evidence that you can give relating to
that that is not hearsay, have you?
       A. I remember a report that I saw which I am -- I cannot
remember all the details, but I think it said something
about you were -- you had won an appeal or had something to
that extent and, in fact, nothing more had happened than
been given leave to appeal. It was two quite different
       things.

  Q. Seeing as you are not able to name which news coverage you
are talking about, we are not in a position to find out
what was said and who it was said by.

In paragraph 14 of your statement you say, "In anticipation
of media inquiries at the start of the trial, the
Communications Department also prepared a background
briefing (Appendix 7) and was first produced in
anticipation of the trial beginning in April 1994 and then
updated in June to take account of the new trial date.
I understand that about 30 copies have been handed out so
       far."

Who was it who told you that 30 copies had been handed out
       so far?
       A. I think Mike Love told me that.

  Q. When was it that he told you that?
       A. Towards the end of March.

  Q. This year?
       A. Yes, it was about the time of this -- about the time of
putting the statement together. In the February, first
       part of March; somewhere there.

  MR. MORRIS: Sorry, this year?
       A. Yes.

MS. STEEL: Also, it indicates there that there was one update
in June, but we have got several different copies with
different dates on; not just two. Do you know anything
       about that?
       A. You will have to show me; I am sorry.

  Q. Are you aware there were more than two copies?
       A. I am aware there was an update which was made when the
trial did not occur as it was planned to, but that is the
       extent of it.

  Q. You are not aware of any other versions being reprinted or
       updated in any other way?
       A. No.

  Q. Mr. Morris showed you one from November 1994 this morning.
You cannot help us as to what that was?
       A. No, I thought it was basically the same.
