Day 195 - 04 Dec 95 - Page 30

       that?
       A. Yes, they did complain.

  Q. Did they complain to you?
       A. They did complain to their shift Manager.

  Q. Did they complain to you, customers?
       A. No, they would not complain to me, no.

  Q. But you say them complaining to others?
       A. Yes, I did.

  Q. He then says over the page that there are a number of
checks to make sure that raw or under-cooked meat was not
sold. Any comments on the maintenance of the holding time
       in the production bin?
       A. Holding time in the production bin -- it was,
I believe, 10 minutes but it was never -- nobody actually
adhered to 10 minutes and they were basically in the
production bin until they were sold or, I mean, unless they
were well over something like half an hour and it was
       obviously not edible any more.

  Q. He says in paragraph 12, well, I will leave the first
part. Can I just say, I think it is clear that Mr. Davis
only remembered one incident with the blocking of the
drains and Mr. Alimi remembers more, so there is not much
point in asking about that really. Sorry, can I ask, is it
possible that Mr. Davis's incident was different from the
       ones which you remember?
       A. It is possible because when I was there when --
I remember at least two occasions when the drain was
blocked, the sewerage was coming up and covering the floor
of the back room area and the kitchen, and I do not
remember the store having been shut on those occasions.
So, that incident must have happened on another day when
       they shut the store.

  Q. OK. The last bit, he says about your allegations of out of
date lettuce and onions being sold is not true; do you have
       any comment on that?
       A. All I can say is that Mark himself, I remember one
occasion now when Mark himself was in the store and in
charge of the kitchen area when it happened, and he
instructed me himself to go ahead and use it because it was
only one or two days out of date.

  Q. Over the page, page 6, I think you did allude to it in your
statement anyway, about the top hot plate falling on
       people?
       A. Yes.

  Q. Mark Davies says: "I cannot recall anyone being burnt by
such a thing happening". Did that ever happen?
       A. Well, it happened to me and I -----

  Q. That was the one where you got the remnants of a scar?
       A. That is right. So it could happen. It was basically
unsafe by design because it was loose and it was extremely
hot so it would -- and these toasters are put on a trolley,
