Day 197 - 07 Dec 95 - Page 36

MR. JUSTICE BELL: It might be possible to do that tomorrow
afternoon. It is not a matter of any technicality, it
just depends upon what I think is fair. I would like the
Defendants to think very seriously about whether there
really is any ground to objection to them being called.
Mr. Morris, particularly, said time and time again he just
wants me to get to the truth. I have to say that now
Mr. Coat has been asked about the contents of the
statements or forewarning of the statements of three of
them, and since he has given quite a lot of evidence about
Mr. Skehel who is the fourth, at the moment I am finding
it very difficult to see how I can fairly refuse leave if
it is asked for. At the end of the day, what I want is
that the evidence on both sides which might help me to the
     right conclusions of fact.

MR. MORRIS: Did we deal with Mr. Skehel?

MR. JUSTICE BELL: We will resume at 2 o'clock.

MS. STEEL: Can I just ------

                     (Luncheon Adjournment)

MR. MORRIS: Is it possible that we could just ask some
questions about the Neil Skehel statement because we
forget that we had got that?

MR. JUSTICE BELL: Yes, if you want to.

MR. MORRIS: I am not even sure if I do; I just wanted to
     check.

MR. JUSTICE BELL: Just sit down again for a moment,
Mr. Coton. Just read it through. It only just gets on to
the second page. Only ask something if you think it
really is vital to bring it out now.

MR. MORRIS: I do not know if the witness has a copy of it in
     front of him?

MR. JUSTICE BELL: It is in bundle XB and it is 34C,
     Mr. Coton.
     A. I have that in front of me now.

MR. MORRIS: It says that he gave you two PRS -- this is in
paragraph (5) -- he was the Supervisor just for six months
     of your time at Colchester?
     A. The last six months.

Q. Yes. He said that he gave you two PRs with the following
grades "needs improvement" and "unsatisfactory". Are
those the ones which you do not remember or what?
     A. They are the ones as I stated previously that did not
     happen.

Q. Did not happen. Is there anything else you want to say
     about anything in there?
