that job.

Q. Who is responsible for maintenance in the Kings Road
McDonald's?
A. Can you be specific on the type of maintenance that you
are -----

Q. This seems to indicate that there is a person with
responsibility -----

MR. JUSTICE BELL: "Maintenance person" there clearly does not
mean -- I have to say what it means to me in this country
so maybe you had better be more specific. Obviously,
I would have thought a maintenance person in this country
might be someone who does minor repair work. It may again
be a difference in the use of language.

Why do you not ask him if there is anyone who is
specifically responsible for small repair jobs or anyone
who is specifically responsible for cleanliness? If it
really matters, because you are really on about the
effectiveness of the environment/index.html">litter patrols. As I understand it,
you say, for better or worse, McDonald's ought to be using
reusables, not disposables all the time. Disposables, as
I have said in the ruling I made this morning, whether
eat-in or eat-out, you say lend themselves to environment/index.html">litter, and
there is a problem from environment/index.html">litter related to McDonald's and
for good measure you say the environment/index.html">litter patrols are not
effectively carried out.

You have, in effect, put the part of that which you can put
to Mr. Stump because he is not responsible for McDonald's
deciding to use disposables rather than reusables. It is
your case, and by all means put the essence of it to
Mr. Siddique in so far as you feel the questions are
helpful, but what I might suggest is you want to be
pressing on to getting a good reliable witness in the
witness box who can tell me what a lousy situation it was
in Chelsea.

MS. STEEL: I am virtually done although Dave has some
questions to ask. (To the witness): The position as set
out on this page, is there a comparable position in this
country or is this just an American thing?
A. There is a -- we can hire someone who would be termed
as a maintenance person, but it is up to the individual
restaurant managers on the jobs that he completes. All his
responsibilities have to be completed by a restaurant
manager and whether he delegates them to other managers, to
other members of the staff, or to a maintenance person
would be discretionary to him as long as they were
completed to the McDonald's standards.

Q. So there was no-one with responsibility solely for
maintenance and cleaning?
A. Yes, the manager.

Q. The manager has other responsibilities as well?
A. But he is in overall responsibility so he delegates all
these areas out. If he chooses to hire a maintenance man,
