2 that; we encourage a performance-related pay, as long as it
3 is based on the minimum wages that are provided for in the
4 tariffs. So there is no problem with the union versus
5 performance-related pay.

7 Q. Taking those tariffs, am I right that although some of the
8 employees are better off than they were before the
9 agreement, equally, some of them are worse off?
10 A. No. You would be wrong.

16 who have not served more than a few months means that they
17 are worse off than they would have been under the old
18 system?
19 A. Yes; but after six months of employment, they would
20 almost double their wages; and, in my opinion, that would
21 make them better off.

24 you are not in a position to say overall what has been the
25 consequence for the McDonald's employees who are the
26 subject of the agreement, are you? You do not have those
27 data?

31 neutral way -- have you, yourself, had access to the data,
32 the facts, which are necessary to enable you to state one
33 way or the other whether the McDonald's employees who are
34 the subject of this agreement are, overall, better or worse

39 A. Yes. I have been in possession of documents, the
40 master payrolls, and they would lead me to believe that the
41 people are better off, yes.

44 A. Yes, for all the employees concerned. One of the
45 provisions of the agreement is that once a year there is
46 supposed to be a negotiation about performance-related pay;
47 and one of the things that needs to be done before one can
48 discuss the individual wages of the workers, the union has
49 to be given a master payroll showing what every single
50 worker earns; and I have been given those documents.

52 Q. I just want to understand this. Are you telling us that
53 you have negotiated on behalf of all the McDonald's people
54 who are members of the union, or simply on behalf of those
55 who work at the same restaurant as you do?
56 A. Only the ones that are working in my restaurant, yes.
