9 MR. RAMPTON: My Lord, if those answers by Dr. Pattison as to
10 the extent of danger to human health of residues, even
11 supposing they are found, is to be challenged, then now is
12 the time to do it.

14 MR. JUSTICE BELL: Deal with the carcinogenesis first of all,
15 I suggest, because that is what Ms. Steel is asking you
16 about. Then I think it would be helpful if you disagree
17 with the very minimal answer to put anything in
18 disagreement to do that.

22 MR. JUSTICE BELL: Yes, but question is are you accepting it or
23 not? If this court case was about whether someone went
24 drove over a red light or not and your case was that he
25 had, and the witness said he did not drive over a red
26 light, you would not just leave it there and that is the
27 point here.

29 For all I know, you are accepting that the risk of human
30 health is very minimal, which is what the witness has
31 said. If you do not, now is the time to put to him that
32 his answer is wrong. If you have got a basis for saying
33 that it is wrong, put that too. Then it is out in the
34 open. He has had an opportunity to answer it and we will
35 be able to attach on to any further evidence in the due
36 course.

38 MS. STEEL: I have done because I have put the view of the
39 various countries that have banned that drug.

41 MR. JUSTICE BELL: I do not know, you see, because they might
42 think that the risk to human health is very minimal but
43 provided there is any risk at all, if there is an
44 alternative which is not carrying a risk they should be
45 banned, or for political reasons they may have done.

50 all means correct me if I am wrong -- you have got round to
51 suggesting to the witness. Just go back and see. It is at
52 about 35.20 you raised the question of bans in the US
53 followed by Canada, Australia and Germany.
