1 things was witness schedule, our witnesses, packaging
witnesses. We are calling Brian Lipsit. We have assured
2 him that we will pay him the money when he gets here.
I know Mr. Rampton is keen to have a definite 100 per cent
3 answer. As far as we are concerned, he is coming. He
arrived on Saturday, assuming he gets a ticket.

MR. JUSTICE BELL: Where has he got to come from?

MR. MORRIS: From America. I have not got a schedule here.

MR. JUSTICE BELL: Have you got one?

MR. MORRIS: I know we are a bit behind schedule. But I think
8 that once we get on to the basic witnesses of fact it will
speed up. Mr. Lipsit is coming on Saturday the 9th and he
9 wants to hear -----
10 MR. JUSTICE BELL: Has he told you how long can he stay here?
11 MR. MORRIS: But I think he can stay for a week. I cannot
guarantee, but he would like to hear some of the
12 plaintiffs' evidence, if that was possible. So rather
than putting him on the Monday, if we could just say
13 assuming that there is going to be some of the plaintiffs
witnesses on that Monday, he should at least have a chance
14 to hear the plaintiffs' witnesses. We have had some
problem obviously getting documents to him and whatever.

The other thing that is relevant to packaging is that our
16 expert witness, Mr. D. L. Hopkins, cannot actually come
the week of 11th which is not making it easier to organise
17 things, but he is very keen o hear Mr. Mallinson who he is
compared with. I am sure Mr. Mallinson would likewise
18 want to sit in probablely on Mr. Hopkins. So, we were
going to propose, obviously it depends on what the
19 plaintiffs are able to do, that Mallinson and Hopkins are
heard on the 7th and the 8th, which would mean putting
20 Mr. Ashworth and Mr. Oakley back.
21 MR. JUSTICE BELL: Have I got Mr. Hopkins' statement here?
22 MR. MORRIS: It has been disclosed.
23 MR. JUSTICE BELL: It has been put in the bundle. You said
that in the hearing of Mr. Rampton and those who instruct
24 him. So we will see what happens.
25 MR. RAMPTON: I have to say, my Lord, there is little I can do
at the moment to accommodate Mr. Morris. It is nobody's
26 fault. Mr. Hopkins is resident in this country.
Mr. Langert is not. He has to finish by the end of the
27 week, so does Mr. Kouchoukos. Mr. Mallinson is
immovable. I say "immovable" because that is the only day
28 he can manage. The only concession I can make is that
I can shift Mr. Oakley. Professor Ashworth cannot do
29 Friday 8th anyway, but at the rate we are going at the
moment, since Professor Duxbury has to be Wednesday
30 morning, we shall still be on Mr. Langert on Friday.
