     1        and so on.  So, I think that the guideline is clear enough
     2        that it would be more a case of, perhaps, some people who
     3        had been away for some while might restart on a different
     4        rate.

     6   Q.   I thought there were not any guidelines?
     7        A.  I said there are not any written guidelines.

     9   Q.   Well -----
    10        A.  Guidelines do not have to be written, in my
    11        understanding.

    13   Q.   How are the guidelines conveyed to the store management
    14        then?
    15        A.  Well, things like training courses and so on.

    17   Q.   So the training staff have some set phrase that they have
    18        revised lots of times and they know it all off by heart?
    19        A.  Yes, they do know things off by heart; actually, that
    20        is generally it.  They do not work from a script.

    22   Q.   Can you tell us what it is?
    23        A.  Well, it is what I have said here, which is that you
    24        look at things like the person's length of service, their
    25        performance, what they left as, what their availability
    26        was, and so on, in order to decide what rate they should
    27        restart as.

    29   Q.   Which is full of several variables which could be
    30        interpreted very differently and very widely by different
    31        store managers?
    32        A.  They may be interpreted differently, but they are
    33        variable so they would vary in nature.

    35   MR. MORRIS:  Related to that, if the Manager knew that somebody
    36        was a regular employee and got some of their performance
    37        reviews, and they were not wanted to work for McDonald's or
    38        they could not work for McDonald's for whatever reason for
    39        a couple of months, can they be retained on the books to be
    40        rehired at whatever rate they left?
    41        A.  If they were away for a couple of months, no, they
    42        would then be taken from the payroll before that.
    43        Normally, about six weeks would be the maximum time between
    44        them not working and them staying on the payroll.

    46   Q.   When you say "normally" is that what the guideline is?
    47        A.  Yes.

    49   Q.   If someone is not around for six weeks, well, after seven
    50        weeks they are cut off basically, and they would restart at 
    51        the same rate or may restart at the same rate at a later 
    52        point? 
    53        A.  Yes, depending on when their employment recommenced
    54        because they would have to set up new employment.

    56   Q.   Right.  Maybe if we move on to something else for a while?

    58   MR. JUSTICE BELL:  Can you remind me, the figures on the last
    59        sheet of G2, did someone say, was it suggested, that they
    60        were 1994 figures or 1993 figures?  The reason I ask is,
