       kept documents in your department?
       A. Yes.

  Q. You have?
       A. Yes.

  Q. Did that include accident books?
       A. It did.

  Q. What did you tell them?

MR. RAMPTON: My Lord, it depends who Ms. Steel is asking
Mrs. Barnes about. If Ms. Steel is trying to elicit from
Mrs. Barnes communications which have passed between her
and McDonald's lawyers, then Mrs. Barnes must not answer
       the question.

MR. JUSTICE BELL: No. Have you been asked how long you kept
documents in your department by Mr. Nicholson or any other
       member of management?
       A. By Mr. Nicholson, yes.

  Q. Sorry?
       A. By Mr. Nicholson, yes.

MS. STEEL: What did you tell him about how long accident books
       were kept for?
       A. I referred him to one of my people who fed back the
information I have just given to you.

MR. JUSTICE BELL: That the accident books say three years
       themselves?
       A. The statutory requirement is three years and that is
       written on the accident book.

  Q. Is there something inside the cover of an accident book, it
being a standard publication? It is the HSE itself, is it,
       which has set the form?

MR. RAMPTON: My Lord, it is to be found ---

MR. JUSTICE BELL: Health and Safety Executive.

MR. RAMPTON: --- on the cover of the Colchester accident book
which is 57L of volume 32. My Lord, we looked at it
       yesterday.

MR. JUSTICE BELL: The entry which must be kept for at least
three years from the date on which it was made, but since
they are all bound together, that means you have, in
effect, to keep the book for at least three years from the
date of the last entry in it?
       A. Yes.

  Q. That is the practicality of it?
       A. That is right.

MS. STEEL: Were you also asked -----

MR. JUSTICE BELL: I cannot even remember what I have asked
