Day 174 - 17 Oct 95 - Page 34

  Q. Yes; and it starts off: "A group of workers claiming to be
the majority of the employees at McDonald's Hamburger
Restaurants", etcetera; that is the one, is it not?
       A. Yes, that is right.

MR. MORRIS: OK, that is all. I have not got any more
       questions on the strike.

MS. STEEL: What is the disciplinary procedure at the Irish
       stores?
       A. Are you talking about currently or at the time the
       dispute took place?

  Q. Is it different?
       A. No, not to my knowledge.

  Q. Can you just say what it is, then?
       A. The procedure for disciplining somebody, right?

  Q. Yes.
       A. Well, first they get a warning; they get a second
warning if that was necessary; and they get a third warning
which would be the final warning.

  Q. Right; and are any of those written; do any of those have
       to be written?
       A. The third one would be written.

  Q. And that is the Company's set procedure?
       A. Yes, currently it certainly is.

  Q. You do not remember it changing, then? When you say
       "currently" -----
       A. I do not. But, I mean, if you are asking me is that
the exact procedure, you know, in 1979, to the best of my
knowledge it would have been, but I cannot be absolutely
certain, because we were at an early stage in business and,
as we have grown, we have continually reviewed situations.
So it may have been the exact situation but, there again,
       it may not.

  Q. You do not actually remember it ever being anything
       different?
       A. To the best of my knowledge, no, but I cannot be
absolutely certain, as I have indicated.

  Q. That would have been the situation in 1985?
       A. It should have been, yes.

  Q. When employees were actually dismissed, they would get a
       dismissal notice, would they?
       A. They would have received a final written warning.

  Q. Is that the third one that you are talking about, or a
       separate notice of dismissal?
       A. No. The third warning would be a final written
       warning.

  Q. Right.
       A. So dismissal ---
