     1        the Defendants have decided they are going to call and

     4   MR. MORRIS:  Mr. Cantor and Mr. Bowland do not affect those
     5        people.

     7   MR. RAMPTON:  For example, Mr. Soriano, Mr. Morris says blithely
     8        now at the end of November that he thinks he is going to
     9        call him.  We have no indication when that might be.  Until
    10        we know when it might be, we cannot schedule our other
    11        witnesses.  Alternatively, if he is asking for us just to
    12        go ahead and schedule our witnesses as fixtures, and for
    13        Mr. Morris to fit Mr. Soriano in as and when there is a
    14        space .....

    16   MR. MORRIS:  I was proposing in that week, January 29th to
    17        February 2nd.  That is why I brought it up.

    19   MR. JUSTICE BELL:  Who?

    21   MR. MORRIS:  Mr. Soriano, when we have confirmed with him.

    23   MR. JUSTICE BELL:  When do you think you will know about him?

    25   MR. MORRIS:  I just have to confirm with him really that he is
    26        available for -- it would be next year for certain, and
    27        after the New Year.  I would suggest to him those times,
    28        and if he can confirm those, I think we will put him in as
    29        a fixture.

    31   MR. RAMPTON:  My Lord, again, I am afraid, I cannot readily
    32        agree to Mr. Morris' demands, his assertions of what he is
    33        and is not entitled to do.  He behaves as though there was
    34        nobody else on the planet.  I have to suppose that we were
    35        going to be dealing with the Bath issue in those two
    36        weeks.  I do not believe that it is open to Mr. Morris just
    37        to say:  "I am going to fix Mr. Soriano for that second
    38        week" on what we had supposed was going to be Bath
    39        evidence.

    41   MR. MORRIS:   If you read the schedule, Mr. Rampton, I am
    42        talking about the week in which you are concerned about
    43        Mr. Cantor and Mr. Bowland maybe not attending.

    45   MR. JUSTICE BELL:  What I suggest, Mr. Morris, is get as close
    46        as you can, as quickly as you can ---

    48   MR. RAMPTON:  I am sorry, then .....

    50   MR. JUSTICE BELL:  -- to a firm decision and proposed dates and 
    51        then raise it again.  Hopefully, there will not be any 
    52        problems.

    54   MR. RAMPTON:  Mr. Morris is quite right.  I owe him an apology.
    55        I got the wrong week.  If he is proposing to replace
    56        Mr. Cantor and Mr. Bowland with Mr. Soriano, then it causes
    57        me no problem at all.
