    14   MR. JUSTICE BELL:  Yes.

    16   MR. MORRIS:  It might be helpful.  The Plaintiffs have said
    17        about three or four times that they are going to call
    18        somebody from Jarrets, or they may be.  They have had quite
    19        a long time.

    21   MR. JUSTICE BELL:  I had not understood that there was any
    22        commitment to it.  All I know is that I was asked to pencil
    23        in the timetable Jarrets for 8th, 9th and 10th March.

    25   MR. MORRIS:  Sorry, I did not realise.  That is when I was not
    26        here yesterday morning.

    28   MR. JUSTICE BELL:  No, that is when we were talking the other
    29        afternoon.  You were here, in fact, but one does not always
    30        catch everything.  I have put in brackets over Wednesday,
    31        8th, through to Friday, 10th March, "Jarret", but I cannot
    32        recall Mr. Rampton's exact words.  All I have put in is a
    33        space for any witnesses who may come from Jarret there.

    35   MS. STEEL:  I think, to be fair to Mr. Morris, the Plaintiffs
    36        mentioned yesterday that they were going to serve a
    37        statement within the next couple of days from Jarrets.

    39   MR. JUSTICE BELL:  Yes, I had forgotten that.

    41   MR. RAMPTON:  No, no, no.  That was not Jarret.  That was
    42        Atherton.

    44   MS. STEEL:  Oh, sorry.

    46   MR. JUSTICE BELL:  That was Mr. Wignall's sub.  But I think,
    47        from your point of view, you have someone whose statement
    48        I have read relating to Jarret.  You will make your own
    49        decision as to whether you call her.  McDonald's will make
    50        their own decision.  I am not stopping you asking 
    51        Mr. Walker about it, but if we come to a stage where he 
    52        says he does not know, if he is the only possible witness 
    53        who might ever come because there is absolutely no-one
    54        else, a bit of speculation may be justified.  But, if one
    55        is thinking there may be someone who knows better, perhaps
    56        one should take "I do not know" for an answer.

    59        definitely get another witness.
