Day 208 - 24 Jan 96 - Page 57
MR. MORRIS: You have been in court -- have you been in court
all of today?
A. From about 11 o'clock.

Q. From about 11 o'clock.

MR. JUSTICE BELL: You were here for a fair bit of yesterday, as
well, were you?
A. Yes, nearly all -- and the afternoon, as well.

Q. All morning?
A. I came about 11, again, Monday, and the whole of the
day.

MR. MORRIS: You say you usually get your breaks at your
preferred time?
A. Yes.

MR. JUSTICE BELL: Again, you are easy to suit on breaks,
because halfway through your shift is in a lull,
comparatively speaking, between breakfast, when you are in
charge, and lunchtime, when it is very busy?
A. Yes.

MR. MORRIS: When you say, in 13, "Most crew who take early
breaks will have them staggered, by which I mean they may
take, say, a 20 minute break at the start of the shift and
a 20 minute break later", is that because the Managers
say: "Take a 20 minute break now then take a 20 minute
break later"?
A. Yes, or some crew are quite happy to take 45 minute
near enough as soon as they come on. They have probably
been drinking the night before and need a bit of food
inside them. Yes, if crew are asked and they are not keen,
the Manager says, "Would you like to take 20 minutes and 20
minutes later on"; and if they say "yes", they do, and if
not, they not are not forced to, no -- or, put it this way,
I have never heard of anybody being forced to go on a
break. I am not saying it has not happened, but I have
never heard of it.

Q. When a Manager says to someone who is working on the grill
that they should move to work on the till, for example, do
they order them to do it, just say, "Do that"?
A. Well, they would -----

Q. Or do they just say -- or do they ask?
A. No, they would tell them, yes: "Can you go on to till
now, please?" Yes, they would tell them to do it, yes.

Q. They would tell them?
A. They do not ask. They tell them.

Q. So when Managers organise the floor, they do it in terms of
instructions?
A. Yes.

Q. I mean, when people come back from their break, do they
just wander and go wherever they feel like?
A. No. When people come back from their breaks, they go
