Day 174 - 17 Oct 95 - Page 19

eventually what happened as a result of this
correspondence? It really does just take ---

MR. JUSTICE BELL: You have to get there in the end, Mr. Morris.

MR. RAMPTON: -- one sentence -- one word, actually.

MR. JUSTICE BELL: I find it difficult to accept that I should
meet anyone about anything if I disagree with them.
I might want to write one or two letters first, and then,
if the meeting seems to be useful, by all means have a
meeting. What I want to know is how you suggest the matter
ended. Are you accepting that the union were content with
matters at the end or that they were unhappy at the end?
       Put your case on that.

MR. MORRIS: Well, if you look at the second to last page on
       page 23 -----

MR. JUSTICE BELL: It is no use giving pages, I am afraid.

MR. RAMPTON: It is dated Monday, 10th September, and it should
be the penultimate page in that section.

MR. JUSTICE BELL: What page is that?

MR. RAMPTON: It is 23, my Lord.

MR. JUSTICE BELL: Let me re-read that. Why not take it up from
       there, Mr. Morris?

MR. MORRIS: Well, I mean, the long and short of it is that
Mr. White, representing the union, was clearly unhappy, was
he not? For example, he is quoted as saying: "There is no
way staff got £5.50 increase as per National Understanding,
and there was no way anyone was getting anywhere sitting
round a table with Mr. Mehigan, and they wanted to bring
this matter to the court. This was the only way anything
would get done." So he was not very happy with the
       situation, was he?
       A. Well, by this note, that is correct.

  Q. And you were basically not willing to meet the union, were
       you?

MR. RAMPTON: No, my Lord, I am sorry, that will not do.

MR. MORRIS: I am asking a question.

MR. JUSTICE BELL: Let him put the question, Mr. Rampton.

  MR. RAMPTON: (Inaudible) the document.

MR. JUSTICE BELL: Mr. Rampton, I am sorry, if you want to take
your wig off, get rid of Mr. Mehigan, take the oath and
       give evidence, do so.

MR. RAMPTON: No, my Lord. I am sorry, but I mean, it -----

MR. JUSTICE BELL: Now you are doing it again. Remember that
