Day 118 - 01 May 95 - Page 16

       11.00 p.m. or the 50p you get from 11 p.m. to 7 a.m.. In
any event, I suppose it is possible someone might work more
than 39 hours never working before 7 a.m. or after 7.00
p.m. if there was a busy time ---

THE WITNESS: It would be possible.

MR. JUSTICE BELL: -- or people called off and so on?
       A. Yes, it would be possible.

  Q. Then it is suggested there are from time to time in these
situations, if you just pay someone 44 hours at their rate
which, let us say, by now is 15p or so above the minimum,
because they have got a bit of experience so they are no
longer complete novices, you might, unless you check with
every employer, not come up to what their minimum wage
ought to be for the 44 hours?
       A. We would expect the manager to realise that when he
asked the person he was asking to work overtime.

  Q. So it is dependent upon the manager working it out?
       A. Oh, yes, he would know what his crew rates were.

MS. STEEL: So it is up to the manager to work it out?
       A. He would be held responsible.

  Q. Do you send around an instruction to your managers to tell
       them of that fact?
       A. They would get that on their normal training course.

  Q. On a normal training course?
       A. Yes.

  Q. Do you know where you can find that instruction ---
       A. No.

  Q. -- in any of the training documents?
       A. No, I do not.

  Q. You do not?
       A. No.

  Q. Have you ever actually seen it in the training documents or
are you just presuming it is there?
       A. No, no, it is covered in the personnel presentation on
all the management courses. Wages are very strictly
controlled. It is covered in the presentation by the
Personnel Department on the various management courses.

  Q. So that is like a verbal instruction, is it?
       A. Probably, yes.

  Q. You have not got it written down anywhere?
       A. I am not going to say we have not. I do not know that
       we have.

  Q. You do not consider it important enough to write down and
make sure that all the staff, all the managers, will be
fully aware of it and will not forget about it?
       A. Oh, I know that they are fully aware of it. They know
