Day 090 - 16 Feb 95 - Page 36
not need to eat throughout a whole 24-hour period.

MR. JUSTICE BELL: Unless there is a question you must ask
before we adjourn, we will break off until 2 o'clock.

(Luncheon Adjournment)

MS. STEEL: Can I just say that before lunch I said I had a
recall of Dr. Gregory saying something about problems with
aggression. I think that may actually have been to do with
the lighting levels rather than the hours it was left on.
But, in any event, the witness said he was not aware of it
anyway.

MR. JUSTICE BELL: Yes, all right.

MS. STEEL: Continuous lighting results in boredom eating
sometimes, does it not?
A. I do not know how much birds would really eat out of
boredom. There is no doubt that modern broiler strains do
have a big capacity for eating, but there must be a finite
limit, I would have thought; and I honestly do not know
whether they eat out of boredom or not.

Q. Is that something that you are -- I mean, you have heard of
boredom eating, the expression "boredom eating"?
A. No, I have not.

Q. You have not? The book that you edited, did you read all
of it when you were editing it?
A. Of course.

Q. It mentions boredom eating in there, does it not?
A. That does not refer to broilers though.

Q. I do not really know what to do. I have only one copy of
the book.

MR. RAMPTON: My Lord, if we had been, as we should have been
(if this is a relevant topic), then we should have been
forewarned that Ms. Steel wanted to rely on it in
cross-examination, as it has been my habit to do throughout
this case and in any other case, then we would have
provided a sufficient number of copies.

MR. JUSTICE BELL: How long is the passage?

MS. STEEL: It is quite short. I can hand it up to the witness.

MR. JUSTICE BELL: I suggest to just stick a Post-it on with a
marker on the Post-it so you can see where it is. Just
hand it over to Mr. Rampton for a moment, and then -----

MR. RAMPTON: I wonder, my Lord, whether if Ms. Steel is going
to make more than one reference to this book, I funnily
enough, reading the transcript of Dr. Gregory's evidence
the other day, I noticed that your Lordship did give --
I know your Lordship hates the word "homily" -- but some
kind of a friendly explanation to the Defendants about the
necessity to indicate in advance of cross-examination --
